They not only THREATENED to sue me on debt that is too old to be sued on, THEY IN FACT DID. Gemini Capital Group, LLC and their attorney XXXX XXXX ( XXXX, CO ) actively pursed a lawsuit against me on a debt they knew to be a Time-Barred Debt. The debt was a credit card account Gemini had purchased that was originally a credit card from XXXX XXXX XXXX. They completely disregarded the Federal and State Laws on debt collection practices, harassed me in XXXX County Court in Colorado, and attempted to even illegally obtain a judgement against me in XXXX County Court. I had to fight them for approx. a year against their illegal practices, and if I did n't, they were stampeding their way through the County Court in XXXX County Colorado with complete disregard of the FDCPA. In fact, they almost got away with obtaining a judgment against me, illegally so, except by shear happenstance of me learning of their activities within a XXXX Report I had acquired for other informational purposes. I was then forced to hire a lawyer to protect me from their pursuit of extorting monies from me for time-barred debt. They simply were n't going to back-off until they could bully me into paying monies that they were attempting to extort from me. They have a total disregard and cavalier attitude in regard to the FDCPA, and fully believe they can bully monies by their `` XXXX '' activities by misusing county courts to file lawsuits that are wrongful against consumers thinking they are above the law and can commit this criminal activity against naive consumers, out-lawyering consumers, and willfully and wantonly ignoring federal and state debt collection practice acts and laws that are in place to protect consumers.

I called today to discuss Complaint Numbers XXXX and XXXX. She states she did see the complaint but that it was not my name. Therefore, she was unable to speak with me regarding the protests. I explained to her that the case goes back to XXXX. She explained that was not a valid case number on her end but gave me a corrected case number of XXXX. She gave me numbers for senior resources then we were disconnected. I tried to explain to her, as I had previously stated, that I had credit protection from XXXXXX/XX/XXXX at that time when I went to court for the garnishment. Still, I could not find the documentation I saw, and I am attaching this case. It is dated XXXX XXXX, 2002. I also have other documentation from XXXX regarding my accounts. Since there is a garnishment, I would like to have this removed from my account. I am a senior raising my XXXX-year-old granddaughter, who is an orphan. I called today hoping to resolve this but was disconnected. Also, I received a notice sent to my school account that I had to start paying {$50.00} per month to them without notification to a school email which is not one that I usually use.
Plus, there are two accounts and I have credit protection on both accounts in which I did list both numbers below.
Also, I am disturbed about this entire situation from Gemini Capital Group, and my credit did improve, and now I feel if I don't pay this {$50.00} to them, it will severely impact my credit again. I wanted to speak to someone today, but it was mute. I hope you can help me.

Gemini Capital are notorious in trying to collect fraudulent debt. Their attorney refused to compel discovery from the court. They claimed that they served in a house I did not owe and also I was in XXXX at the time of service. This company and their shady lawyers must be confronted and fight back legally. I won the set aside Motion and got my garnished money back. I urge anyone who has a problem with this company, please contact me at XXXXXXXXXXXX and let us get together and hire a lawyer and file a lawsuit. This does not even have an address or phone number you can contact them but you can contact via XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX, DE XXXX. I wish you all a great luck and fight back if you are correct or debt is old and does not comply with the statue of limitation. I heard this company and their shady lawyers trying to collect debts from 1970 's. Just XXXX their name and you will see the truth.

In XXXX Gemini Capital Group , LLC filed Motion with XXXX XXXX XXXX for garnishment of my income for a repossessed vehicle from XXXX. I've been on XXXX since about XXXX. The same Gemini Capitol Group has filed Motion for Revival of Judgment again. Nothing has changed in my living status. I'm still on XXXX and can't believe the predatory nature of this company to do this to me again. I don't believe they can garnish my income from my bank deposits every month from Social Security. What are they wanting to do to me, ruin my credit? I have no vehicle and my credit will not allow me to finance another vehicle. They add more stress in my life with a total income of about {$18000.00} yearly that is very predatory nature of this company and what is going on in America

In 2012 I filed with the court a Notice of Intent to Defend, Response to Admissions, and a Response to Complaint on a Contract with Gemini Capital Group, LLC with XXXX XXXX XXXX as their Attorney. I never received any further communication after my Response to the complaint. My situation still has not changed and has in fact become worse. I have no checking account and own nothing. I am currently on assistance. I received a letter saying that I remain indebted to this company still, for an even larger amount. I feel like this company has already caused me hardship in the past by harassing me about this said debt and I would like them to stop. This supposed debt is from over 7 years ago.

I was served and went to court on for a credit card debt and I was garnished. The issue is it is my understanding when I went to court I disputed that the debt was too old or that there was credit protection on this account, I am still not sure if it was from XXXX or Bank XXXX. I am sure that I did not own $ XXXX. I have been garnished and I did not work the majority of last year being I was treating for XXXX XXXX. I am a XXXX and I do not know when I am returning to work but I would like to have this off of my credit report.

This is a debt that was purchased and then resold to XXXX companies that harassed me and later sued me and are now garnishing me for a debt in which I had a credit protection on my account in case I had stopped working. This debt is so old but being that it has been resold it it still alive. I tried to fight it stating I was not served the documents in questions ; however, the case was mute and my wages are garnished because of this.
