We were referred to Gateway Mortgage by our real estate agent since XXXX had already approved the builder of the home we were in contract to purchase with. I first spoke with XXXX XXXX on XX/XX/XXXX and he informed me of their one-time close construction to perm product. I was told that I would just need to do one initial closing and that the loan product was a 20 % down, 12-month construction loan that would convert into a permanent loan automatically at the end of the construction period. I was told that there was a second loan that came a long term rate lock that ran concurrently with the construction loan and came with an approximately {$5000.00} extended lock fee that got reimbursed when I modified to the second portion of the loan, I was told they take this fee to ensure I do not try to work with any other lenders during the construction period and that I would lose that fee if I switched lenders. I asked XXXX what would happen if construction ran behind the 12-month schedule and was informed that the loan would be extended typically in 3-month increments but that there would be an extension fee associated with any extensions. There were items in the loan documents that outlined the costs of extension so I had no reason to question what XXXX had told me. This information provided by XXXX was further confirmed by the marketing material advertising this product on Gateway Mortgage Websites. XXXX and XXXX underwriting were providing our construction contract that outlined a 8-12 month build project and signed a contract with the builder outlining the same timeframe. We received our closing disclosure on XX/XX/XXXX which I sent back due to an error in the loan amount. It showed the wrong amount but the correct term of 30 years and a fixed rate of XXXX with the first 11 months being interest only and principal being applied to start in month XXXX. XX/XX/XXXX I received notification from XXXX XXXX that I had actually been approved to only put 10 % down so they were increasing my loan amount to approximately $ XXXX in order to reduce my cash to close. I agreed that this was ok and reviewed the closing disclosure which again stated 30 years and a fixed rate of 3.625 % with the first 11 months being interest only and principal being applied starting in month XXXX. XX/XX/XXXX I received an email from XXXX team that said the below Please find the attached final CD for your closing. The amount you need for closing is {$82000.00}, to wire the funds, you will need to contact the title company for them to give you the wiring instructions. Their information is below : Thanks, and let us know if you have any questions. Again this was the same disclosure I had signed that stated Closing Disclosure Stated I was receiving a 30-year loan with a Fixed 3.625 % interest rate that could not increase after closing. Since I was told this was a onetime close and I had a closing disclosure confirming had a 30-year fixed rate mortgage I had no reason for concern. Our loan closed the next day on XX/XX/XXXX At no point during the research of XXXX materials for this product, discussion with loan officer, or during the closing process was I made aware that there was a risk of not get the locked interest rate, nor was their any mention of any risk of my payments nearly doubling. I was told that this was a XXXX time close loan that would modify at the end of the construction period. My construction to permanent change notification document states Rate for final modification is locked prior to closing the construction phase. Your end rate will be the same or lower, as your construction rate. When I received a closing disclosure that said I was receiving a 30 year loan with fixed rate that would not increase. I had no reason to question this because this is what I had been told from the beginning of the process. On their website XXXX describes this loan as Perfect for homebuyers with good credit, stable job and income history, and are seeking to build their dream home with the flexibility of conventional financing combined with the cost savings and convenience of one loan closing. In XXXX brochure they describe the modification process as below : MODIFICATION PROCESS : Although your builder has completed the project and has received the final draw, the modification process must be completed before you move into your new home. XXXX. Rate : You must lock your permanent interest rate. If you locked during construction, this step is complete. If you have not locked, please contact your Loan Originator to discuss your lock. Afterwards, your Loan Originator will inform our modification desk of your loans particulars. XXXX. Updating Credit Information : Depending on your XXXX and credit score, XXXX may require updated income and credit documentation to ensure the best rate possible. XXXX. Document Signing : Once your rate is locked, we will contact you to arrange a time for you to sign the modification documents. XXXX. Funds Due at Signing : Expenses due at modification may include the following : Construction interest due up to time of signing. Prepaid interest due on the permanent loan. Escrow setup ( property taxes, insurance, and mortgage insurance ). Any shortages in the inspection fees. Any unforeseen costs not paid from the initial closing. On approximately XX/XX/XXXX. I was notified by the builder of my project that they were running approximately one month behind the estimated 12-month timeline due to issues with XXXX, a large fire in the area combined with supply chain issues on a couple of the materials needed for the home. My builder reached out to the loan administrator at Gateway Mortgage with the same information and was told on XX/XX/XXXX they are being fairly lenient because of Covid with extensions. She said when the loan is within about 30 days of expiring, the loan officer will send a letter asking if you need an extension. After receiving this information I reached out to my loan officer XXXX XXXX along with the other assistants involved in my initial loan transaction to notify them with as much notice as possible of the potential delay and to prepare for anything that would be needed for an extension. I did not receive any response from XXXX and still have not received any word from him as of today XX/XX/XXXX. On XXXX I reached out to XXXX XXXX who sends my monthly statements because I still had not had any response from anyone at XXXX regarding an extension. At this point, I was provided with the information that XXXX XXXX was no longer with the company and that my new loan officer was XXXX XXXX. I immediately called the number that she provided and the phone was answered by an assistant of XXXX XXXX. At this point I was first informed that the permanent loan would only be extended up to 30 days. I asked him what happened if the rate expired and I was no longer able to qualify for the permanent loan. His response was that his advice is to make as much income as possible and wait to see what happens. I informed him that with only a couple of months left to convert the loan it was unlikely that I would be able to add enough income to offset an approximately {$18000.00} annual increase in payments based on current rates and approximately {$540000.00} over the life of the loan. I again asked him what options I had if I dont qualify for the new loan payments and was told that he would call me back. On the afternoon of XX/XX/XXXX I still did not have a response from XXXX XXXX 's assistant so I sent an email requesting a call from XXXX to review my concerns and to prepare for what we needed to do to have a successful modification from the construction to perm loan. I received a call back from XXXX the same day but we were not able to connect until the next morning XX/XX/XXXX. On XXXX I made contact with XXXX XXXX XXXX At this time I was first informed that my rate lock had already expired a few days earlier on XX/XX/XXXX. He expressed frustration with XXXX XXXX for doing this to dozens of borrowers where he locked the rate long before the loan actually closed causing the permanent loan to expire months before our construction loan without explaining that impact to the borrowers. This decision left us with a rate lock that expired before our estimated completion date of the build. According to XXXX this now requires us to get a new loan at current rates that we can not afford. At todays rates the new payment is approximately {$1600.00} per month higher or over 60 % higher than what we were quoted and under the impression was locked and fixed since we had closed our loan months before. All of XXXX ' promotional materials for this loan product stating that once you " lock the rate this step was complete '' are completely false. I asked XXXX why I was not contacted prior to our rate lock expiring as we were told would happen 30 days prior by multiple people at XXXX and he stated that he is very busy with hundreds of files. I also asked XXXX if he or XXXX had ever informed me that he was my new loan officer to which he had no response. Had I been informed that I had a new loan officer I would not have lost several weeks trying to get a response from XXXX and would have had the opportunity to extend my lock the initial 30 days per XXXX policy. I again asked what options I have if I can not afford the new payment since I am now a couple of months away from having a {$620000.00} loan that needs to be paid off and XXXX is not willing to honor the rate for the modification I was given at closing on the XXXX close mortgage. I even restated that I was willing to pay the lock extension fees for the extensions which I was originally told I would incur. XXXX response was that he can not speak for the board at XXXX but that they would probably not want to foreclose. I again asked XXXX if there were any options to work together for a solution that was not foreclosure since I am willing and able to pay the amount originally locked and would have never taken the loan if I had known there was no option to extend due to COVID delays and he stated that there were not any other solutions and that it was not his fault my builder was running behind. He also stated that there are hundreds of people at XXXX in the same position as me. I asked him if that isnt there a problem with their practices if they have hundreds of people with no ability to repay the loans that XXXX generated. To Which he had no response. He lastly stated that if I have a problem with Gateways policies I can give the owner of XXXX, XXXX XXXX a call. XXXX told me that he was the head of XXXX for TN and there was no branch manager above himself that I could speak with. In my opinion, there are many unfair and predatory practices involved in XXXX One Time Close Product that by XXXX XXXX 's own admission are harming hundreds of their consumers. XXXX. Admittedly they have a loan officer that was explaining the XXXX rate lock as running concurrently with the construction loan which it did not. They have documents in the loan package stating the rate for the modification will be the same or lower than the initial rate. Since other banks offer true onetime close loans the loan officer has an incentive to mislead the borrower into thinking that this is the same or very similar product. They also had my build contract showing a 12-month build, which was reviewed by the loan officer and I assume the underwriter and not one mention was made that I would not have the option to extend the rate to the projected length of the build. Essentially negating any benefit I would have gotten from choosing this product. XXXX. They blatantly disregarded any fiduciary duty or duty of care and fair dealings owed to me as a client of a closed loan with them. They avoided contact prior to the expiration of my rate lock. I attempted to make contact with my loan officer prior to the lock expiration and got no response. Not only that the new loan officer responsible for my file did not attempt to make me aware that he was my new contact. He also stated that he was the manager and was aware that this was a problem happening with many of XXXX XXXX 's files and still no communications. This shows an attempt at deception to allow the lock to expire so that they would not have to honor their commitment or their policy. XXXX. Their advertising materials blatantly mislead the borrower regarding the true facts and risks of this product. Nowhere does it state that it is possible for rates and payments to double at the end of 12 months or in my case at the end of 10 months. XXXX. In combination with misleading advertising and statements to send a closing disclosure that states a 30-year conventional fixed-rate loan in which the interest rate can not increase after closing and then 10 months after the closing inform me that that was not correct and that they can double that rate is false and misleading. XXXXThey have the borrowers in a very tough spot after closing the initial loan because XXXX. The builder has to be approved which takes time so finding an alternative that meets the criteria during the allotted time frame is not really a option if there are any issues with the builder. XXXXThey also have the borrowers in a pinch after closing because even though they supposedly closed both loans at the closing table if there are any delays in the timeline they are able to cancel and make more by denying the borrowers an extension and forcing them to take out a new loan at a higher rate causing a drastic increase in payment that they may not be able to afford. If the borrower does not qualify for the new rate then they have no ability to repay the construction portion of the loan making their one-time close loan not really a one-time close loan. XXXX. Multiple people within this institution use the fact that there are two different loans with two different terms to selectively and falsely answer questions from the consumer. For example, I asked multiple people, multiple times regarding extending my loan and was told that before during, and after closing my loan I would be contacted 30-60 days prior and given an option to extend at a cost. When it came down to it they are now telling me that is true but only on the construction portion of the loan. If a consumer asks a question about a one-time close and a lender chooses to only answer the question about one-half of that loan and not make mention that it does not apply to the other portion, that is dishonesty and deception. This is also a problem within the loan documents. Since there are essentially two different loans that supposedly close at the same time modify later there are a lot of documents involved in the closing. They blur the lines between those two loans to create confusion for the borrowers. There is a page in my note that outlines the cost and process of extension that matches what XXXX originally told me. When I point to that after the fact they again state well that it was only for the construction loan and now tell me that they do not need to honor that for the loan modification. I feel that XXXX Mortgage employed a multitude of deceptive and unfair tactics in generating this loan. When making the branch XXXX aware of the problem I was not offered a single solution other than wait and hope they choose not to foreclose. I feel that both my original and current loan officers were clearly not working in my best interest and breached the fiduciary responsibility that they had to me.

Greetings I am XXXX XXXX the natural person the Consumer / assumed Obligor, I was involved in a Consumer Transaction, and I closed on the home on XX/XX/XXXX. and on that day I was told that I would receive the contract. Which was supposed to be on XX/XX/XXXX, 7 days after. this is not a refusal to pay, I just want answers to each point in this complaint, why was i not allowed the right to rescission to cancel or rescind this contract when I learned that the property was not in the condition that the 3-hour inspection that I had to pay for, said that it would be? water heater outdated how did that pass inspection a/c unit CRACKED LOOK LIKE ITS BEING HELD UP WITH SOME TYPE OF BLACK GOO. but i was not informed i had to find out when i moved in that is FRAUD. see the images attached. Contracts are promises that the law will enforce. Contract law is generally governed by the state Common Law, If a promise is breached, the law provides remedies to the harmed party, they've made multiple mistakes. see attachments Though A few days after signing, I turned on the AC unit, and later that night my ceiling began to leak, I have the text messages from XX/XX/XXXX, of me requesting my contract, I have messages stating that I did not want to move in until that very problem was fixed. I have not received a complete contract with my wet ink signature, instead of a fully disclosed contract or a conformed copy that was to be mailed to me as stated in the security deed, I was sent home with an incomplete warranty deed that had the sellers wet ink signature on it, it did not have my wet ink signature on it. and because i did not have a fully disclosed copy of my contract or a conformed copy as stated on the security deed which I just received a digital copy of on XX/XX/XXXX there is not one rescission of signature form signed by me or the lender dated for the same day as the note, which is XX/XX/XXXX the date of signing, nor was I informed of my right to rescission/rescind or cancel on the house. which I am lawfully supposed to receive upon the day of signing the contract. Both XXXX XXXX XXXX and GATEWAY FIRST BANK/GATEWAY MORTGAGE GROUP are requesting monthly payments at the same time for the same property. I have the emails and recordings to prove the mistakes, XXXX XXXX is the so-called lender of the loan ; they sold a promissory note that was not to be sold said by XXXX XXXX XXXX I also found that a trust was fraudulently constructed in my name by XXXX XXXX XXXX listing me as the grantor, but they said the grantor gave away all of its rights why would I agree to that?! I didn't get to read those documents, I have also found in the limited warranty deed that mers was there the whole time it's more proof in the conversation with the ( CFPB Agent XXXX ) that I learned who XXXX was. I did not get a chance to fully read those documents until XX/XX/XXXX. THEY WERE NOT ALL FULLY DISCLOSED AT SIGNING DAY. and Agent XXXX helped me find out through ( XXXX XXXX XXXX, that GATEWAY FIRST BANK/GATEWAY MORTGAGE GROUP now has the note and is acting as the servicer over my ( promissory note ) which I also didn't even get a copy of. I was informed by XXXX XXXX XXXX of XXXX XXXX XXXX tried to get the note back from ( XXXX ) approximately on XX/XX/XXXX, but ( GATEWAY ) said " no, not without my consent '', I first filed a complaint with the CFPB against the two mortgage companies that are involved back in XX/XX/XXXX. I have all the evidence of these companies ' depriving me of my rights to full disclosure. Though the CFPB claims they can only help, " if a large number of people report the same issue making the same claim '', that is unfair. GATEWAY FIRST BANK/GATEWAY MORTGAGE GROUP are now trying to expedite the foreclosure process on the home unlawfully ; Regardless of providing me with proof of me having a contract with Gateway Mortgage Group Gateway first bank, I requested a proof of claim. And they have yet to do so, I have yet to receive the original wet ink autographed documents, and I have yet to receive a human signature from gateway mortgage on the same document as mine. The manner in which they are conducting business is unlawful, neither one of the companies can provide verified proof of claim, stating that they gave me anything, Which is in complete civil and criminal violation of the entire truth in lending act 15 USC 1601-1667j ( full disclosure ). # XXXX they said on the CFPB complaint that payment was to begin in XXXX but the documents, I received in XXXX say otherwise, I requested that information be disclosed to me for further examination. Pursuant to 15 USC 1611- Criminal Liability for willful and knowing violation Pursuant to 12 CFR 226.23 ( b ) ( 1 ) ( i ) Rescission provisions of regulation z Again I have evidence providing the many mistakes made by both XXXX XXXX XXXX and Gateway Mortgage Group / Gateway First Bank XXXX including recordings, Text, email, pictures, and documents. that I just opened on XX/XX/XXXX from XXXX XXXX of XXXX Mortgage, delivered quietly on XX/XX/XXXX, XXXX has my number he could have told me he delivered the documents, though this document is not entirely what is required and does not respond to my Notice point for point, and are not in full compliance with Georgia Consumer Protection Division or the previously mentioned Truth in Lending Act. The definition of contract law : According to contract law, an agreement made between two or more people or business entities, in which there is a promise to do something in return for a gain or advantage, is legally binding. Contract law is the center of many business dealings, and anyone entering into a contract should that failing to abide by the contract, even by mistake, could result in serious problems. promise 1 ) n. a firm agreement to perform an act, refrain from acting or make a payment or delivery. In contract law, if the parties exchange promises, each promise is " consideration '' ( a valuable item ) for the other promise. Failure to fulfill a promise in a contract is a breach of the contract, for which the other party may sue for performance and/or damages. 2 ) v. to make a firm agreement to act, refrain from acting or make a payment or delivery. BREACH OF CONTRACT see security deed ( the one i had to purchase per page ) page 55. where it states " 12. notice except for any notice required under applicable law to be given in another manner a any notice to borrow provided for in this deed shall be given by delivering it or by mailing such notice by 1st class mail address to XXXX at the property address or at such other address as Bower may designate by notice to lender As provided here in. 13. governing law in law ; severability ability. The state and local laws applicable to this deed shall be the laws of the jurisdiction in which the property is located. The foregoing sentences shall not limit the applicability of federal law to this deed. in the event of any provisions or clause of this deed or the note Conflicts with applicable law, Such conflict shall not affect other provisions of this deed or the note note which can be given effect without the conflicting provision and to this end the provisions of this deed and the note are declared to be severable as used XXXX used hair in cost expenses and attorneys fees include all sums to the extent not prohibited by applicable law or limited herein. 14. Borrowers copy. XXXX shall be furnished a conformed copy of the note and of this deed At the time of execution or after recordation hereof ''. I WAS NOT GIVEN A CONFORMED CONTRACT THE DAY OF SIGNING, NOR DID I RECEIVE THE THUMB DRIVE THAT WAS PROMISED, I HAD TO GET THE CFPB INVOLVED FOR XXXX XXXX XXXX, TO EVEN TAKE ME SERIOUS AND SEND WHAT WAS SENT VIA EMAIL. Georgia Consumer Protection Division <<<<<< -click the link ( to go to website ) What Georgia says about Canceling a Contract directly from the website. If a contract qualifies as cancelable, how must this be disclosed to me? " At the time the contract is signed, the salesperson must orally explain your right to cancel the contract and must give you : A fully completed receipt or a copy of the contract ( written in the same language as used in the sales presentation ) stating the date of the sale and the merchants name and address. The contract or receipt should state in ten-point bold type that it can be canceled before midnight on the third business day after the transaction took place. This information should be located near the place where you sign your name on the contract, or on the front page of the receipt if no contract was used. Two copies of the Notice of Cancellation, the form which you send to the company if you decide to cancel the contract. The seller must fill in the date the sale was completed, the name of the merchant, the address to which you would send the cancellation notice, and the deadline for canceling the contract. The notice must also include a full explanation of your right to cancel and what you must do to cancel ''. I DID NOT GET THE CONTRACT UPON SIGNING DAY. I WAS NEVER INFORMED ON HOW TO CANCEL THE CONTRACT. IF SOMETHING WAS WRONG WITH THE PROPERTY WHICH THERE WAS AND STILL IS. I MADE COMPLAINTS TO THE CFPB, OCC, and FTC. I SENT NOTICE OF RESCISSION THROUGH CFPB, FDCPA Georgia Consumer Protection Division, and THROUGH CERTIFIED MAIL. Requesting Redress, a Cease and Decis How do I cancel a contract?! According to Georgia Law : " Review the contract to confirm that the three-day cancellation period has not passed. Do not include Sundays or national holidays when counting the three days from the date of your signature. To cancel the contract, sign and date both copies of the Notice of Cancellation and either mail or hand-deliver one copy to the merchant by midnight of the third business day after signing the contract. Keep the second copy for your records. Since you may need to prove that the cancellation notice was sent on time, you should use certified mail ( return receipt requested ) so that you will have the receipt as proof. If the notice is hand-delivered, be sure to get a signed and dated receipt. You are not required to state a reason for canceling the contract. Instead of using the Notice of Cancellation form, you also have the option of canceling the contract by sending a letter or telegram to the company within three days. Again, keep a record of when and where you mailed or delivered the notice letter. If the merchant failed to provide a Notice of Cancellation form, you may cancel at any time ; however, once you receive the Notice form from the merchant, you only have three business days in which to cancel. You have the right to cancel the contract if the cancellation period has not expired, even if the merchant has provided goods or begun the agreed-upon work. In this case, the merchant is not entitled to any compensation ''. I did not receive the contract until after my complaint was filed with the CFPB in which I had already exercised my right to rescission/cancellation, I opened the email on XX/XX/XXXX, it said the email from XXXX XXXX XXXX XXXX sent on XX/XX/XXXX. A little later, I received a letter from Gateway Threatening foreclosure, stating that HUD from Oklahoma would be a new party involved. Keep in mind that the security deed says on pg 55. " 13. governing law ; severability. The state and local laws applicable to this deed shall be the laws of the jurisdiction in which the property is located ''. What happens after the contract is canceled? The merchant is entitled to reclaim any goods delivered to you under the contract, and you must make them available for pickup. The merchant is responsible for all expenses associated with the return of the goods. However, if you fail to make the goods available to the merchant or fail to return the goods after you promised to do so, you must pay all obligations under the canceled contract. Within ten days after receiving the proper notice of cancellation, the merchant must : Refund your money. Cancel and return to you any papers that you signed. Arrange for the return of the product and return to you any trade-in you may have given as part of the sale. Notify you whether any shipped or delivered goods will be repossessed or abandoned. Within 20 days after receiving proper notice of the cancellation, the merchant must : Pick up any merchandise you have, or it is yours to keep without any further obligation. Reimburse you for any mailing costs incurred to return the products ''. They have no proof of Claim! Gateway First Bank is acting as my power of attorney without my consent, they are violating my XXXX amendment rights as the Consumer which is says in part " nor be deprived of life, liberty or property without due process of law ''. this is being done under the Color of Law. I have yet to receive an adequate response to my conditional acceptance. filed with the CFPB, by Certified mail on XX/XX/XXXX, nor the one sent via the XXXX dispute. XXXX mortgage is still contacting me about foreclosure and insurance that they forgot during closing. It is a complete mess. Gateway Mortgage is acting as my power of attorney through XXXX XXXX XXXX XXXX. 15 USC 1692 ( E ) False or misleading representation. The False or misleading information that any individual is an attorney. and a debt collector?! and is also my power of attorney?! how

Gateway Mortgage Issue Billing A payment was made on XXXX/XXXX/XXXX for the amount of XXXX and the money was supposed to be taken out of the account and then rejected on XXXX/XXXX/XXXX, stating that the account was not found. Then on XXXX/XXXX/XXXX, over the phone, I talked to XXXX, and explained that they are having some type of billing/payment issue and it needs to be looked into and fixed, because of errors in the billing/payment system a payment of XXXX was made, Again the money was supposed to be taken out of the account. Then on XXXX/XXXX/XXXX it was rejected for the same reason. In both case the same routing and account numbers were used. I called Gateway Mortgage and talked to XXXX to try to get this fixed and verified that they have the correct routing and account number in their system, which they did. At this time I felt that I needed legal representation, so I contacted my attorney which contacted Gateway immediately and got a complete run a round. My attorney XXXX XXXX, from XXXX XXXX XXXX Law firm spent weeks contacting Gateway Mortgage and he was told that the problem would be fixed immediately. While waiting to hear back from Gateway Mortgage, my attorney discovered that the conventional account loan has been completely frozen. At this time I contacted Gateway and talked to XXXX to try to get this fixed and verified that they have the correct routing and account number in their system, which they do. At this time he stated that in the past they were having some issues with account numbers that 14 digits that were not working or going through and being rejected. He stated to me as this time no payment or access could be made to the conventional loan account. My son-in-law which was an authorized to handle accounts, contacted XXXX about 2 week of XXXX XXXX to confirm that there was no issues to worry about with foreclosure or penalties do to errors and was told by XXXX that there was many more options before it got to that point. Application for Assistance On XXXX XXXX, XXXX I was emailed by XXXX XXXX which he sent a LMP, Application for Assistance document, which I which I needed no assistance what so ever with funds being available for transaction the assistance was needed in Gateways billing issue. I filled out and signed the application and then email back on XXXX XXXX, XXXX. Filling out this application was to give time for XXXX Mortgage to find out the exact issue with their billing. On XXXX XXXX, XXXX I received an email from XXXX XXXX, who stated that she is working with Gateways payment processing department and working on figuring this out for you. As soon as I know something I will let you know. Conventional change to Escrow without any notification or consent : Then about XXXX XXXX, XXXX Gateway Mortgage had sent a check to my insurance company, XXXX XXXX, paying the full cost of the premium. I found this out from XXXX XXXX, my insurance agent that I had been insured for 6 years, she explained that she was not able to give me very much information but she was able to tell me that Gateway Mortgage had paid the premium and insured the conventional as an Escrow account, which was very odd to me. At this time XXXX XXXX stated to me that I would be receiving a full refund for what I had paid in to the annual premium. Very uncomfortable and worried about what changes Gateway Mortgage was making with no consent from I XXXX XXXX Loan borrower. I then contacted XXXX at Gateway Mortgage he had no clue or idea of what was going on and advised me that someone form Gateway Mortgage would contact me. Nobody from Gateway Mortgage made any attempt to respond to me by, phone, email, at this time. I contacted my attorney which contacted Gateway Mortgage and was referred to their legal department where he spoke to Gateways legal representation. I then later found out that Gateway had changed my account from a Conventional Loan ( non-escrow ) account to an Escrow Conventional Loan account. I spoke to many sources that were knowledge in the field of loans and real estate and was advised that was happening was very incorrect. During this whole time I was still willing to make payments. I even got a checking account, to ensure that the account number was under 14 digits. But I did not receive any billing statements or emails with instructions. The only item that I got was a letter stating that my property was going on a foreclosure docket list and my property was being auctioned off. I once again frantically contacted my lawyer which contacted county of XXXX, Texas and was able remove from docket list and contacted me back. My lawyer contacted Gateway Mortgage at this time and stated to them that Legally they had to give me 20 day prior to auction day which fell the first Tuesday of every month, their letter of foreclosure was provided to me 10 days prior to auction day WHICH WAS ALSO INCORRECT. Selling of Property : At this my attorney advised me to think of other options, referring to selling of property. At this time Gateway Mortgage had not only concerned me enough to list the property on real estate market. I contacted local real estate agent XXXX XXXX at XXXX XXXX XXXX in the XXXX area, which assisted with the selling of the property. I informed XXXX of what Gateway Mortgage had done and that the foreclosure process was still being pushed so that there was no lack of information given, he at this time stated to me that he being in the real estate market had never heard such thing. At this time I nor my attorney had heard back from GatewaXXXX Mortgage about anything. I had been waiting at this time roughly 5 months to make payments and had taken every measure to make payments, and could not even do so due to some so called frozen Escrow account that was created by Gateway Mortgage. So basically at this time I was forced to sell my property unwilling due to WRONGFUL FORCLOSEURE. For the record To Whom It May Concern the property sold within 3 weeks. Derogatory Statements : With all of the stress that was caused, all legal fees paid, having to uproot, and relocate I felt like Gateway Mortgage h ad completely tried to rob me for my property seeing how they had the upper hand by being the Mortgage company and Lien Holder. I had never heard of a derogatory statements on a credit report due to always being responsible and paying my bills, I carried an XXXX credit score up to this time. The complete time that all the issues were trying to be situated I was never AT ALL informed that ANYTHING WAS BEING FILED ON MY CREDIT. 7 months of negligence waiting on Gateway Mortgage to respond to any issue that they had caused, I not once was ever told my credit was being complete destroyed. There was not only a 30 day, 60 day, 90 day but there was a derogatory that was filed as a 120 day on going active non-payment and this was 45 days after Gateway Mortgage had been paid in full of XXXX I also discovered that Gateway Mortgage added roughly about XXXX in penalties to the pay off. Again I nor my attorney ever informed of any such penalties along with derogatory statements. This tells me that Gateway Mortgage clearly by far were treating me fairly, being very dishonest and should have no right at all to carry the responsibility of loaning to anybody. For the record I had no idea that Gateway Mortgage had ruined my credit to the fullest. Gateway Mortgage has started dishonestly and unfairly ruining my credit from the start of the issue without ever having any intent on informing me of doing so. My credit had been destroyed so bad that it went from XXXX credit score to a XXXX credit score, do to Gateway Mortgages indentations. For the record I was completely blinded by this that I found all this out in the middle of the process of buying another property in a completely different city. I contacted several resources and finally I was able to file this complaint against Gateway Mortgage hoping that nobody else ever will have to experience all the dishonesty and unfairness I had to experience with Gateway Mortgage. BBB information about Gateway Mortgage : In this complaint I also did some research, and found out that I was not the only victim of Gateway Mortgages lies and unfair wrong doings, I learned that there was so much as 17 other occurrences that Gateway Mortgage have had in the past, WITH 1 GENTLEMAN having THE SAME EXACT issues at the EXACT TIME TO THE TEE. This proves to me that Gateway Mortgage is not only very dishonest and very unfair. I will be providing all documents supporting my complaint on my behalf. To whom it may concern, I believe our FHA loan was processed and handled incorrectly.This is mine and my husband 's 1st home purchase. My concern is only being brought up after the renewal date of our flood insurance as of XXXX XXXX. Our flood policy was written prior to our closing and " approved " by the underwriters at Gateway Mortgage Group in XXXX XXXX, Texas. Not at any time prior to closing were we advised of the flood " conditions '' or cost, other than the quote from our seller and the quote from XXXX XXXX XXXX, of this property, other than by the owner, she told us in XXXX it had 4inches of water to the kitchen, yet she was so afraid of the mold she remodeled the entire house. She even provided us with a flood insurance quote, so we would know how much the insurance would cost. That quote was handed over to our loan officer. We did not go through the quote she recommended, but through XXXX XXXX XXXX which our loan officer recommended, who got an even better quote for us. That was that about the flood insurance, nothing more was discussed. Nothing was told or advised to us about previous claims, or the fact that the flood policies we had DID NOT meet FEMA or FHA requirements, or that Gateway was going to " allow '' the flood policy from XXXX for 12mo. Now, with that said, The night before closing, our loan officer calls about XXXX and says " We forgot about your flood insurance, you need to bring XXXX more dollars to closing tomorrow ''. We did. At closing the lady at XXXX XXXX told my husband what each page was, and to sign. No detail of any page. We closed, things were final, we left, happy family. In XXXX or XX/XX/XXXX I received a letter from Gateway stating they have not received our flood insurance policy yet ( that they are responsible for payment for, you would have thought they would have gotten the policy copy for the receipt? ) and that they were going to place insurance if not received. I faxed them what XXXX, our flood insurance agency, had sent us. A few weeks later Gateway sent a document stating a notice of lender placed insurance effective XX/XX/XXXX to XX/XX/XXXX for an insured amount of {$900.00} for flood zone AE CHRA with an annual premium of {$230.00} including taxes and fees was being put in place by Gateway Mortgage. I called them and had to refax the XXXX policy and eventually a few days later they removed the lender placed flood insurance and I received the confirmation letter of them doing so. This would have been the second time that Gateway would have " reviewed '' my flood insurance policy. In XXXX of XXXX, I began receiving notices from XXXX about policy renewal, which I paid no attention to since we have an escrow account, Gateway would pay it. In XXXX I began receiving cancelation notices from XXXX for non-payment. I called Gateway and asked why it hasn't been paid, and the customer service man I spoke with, Amid, stated he didn't see XXXX as my policy holder. but XXXX XXXX XXXX, and " things '' just didn't look right. He saw multiple policies on our account. He attempted to call XXXX but got no answer. After a few days I called XXXX and asked if anyone from Gateway had attempted to contact them and the lady said she believed another lady in the office was working on it, but that the policy had been canceled as of XX/XX/XXXX for nonpayment and that I needed to contact Gateway again. The lady informed me that Gateway has actually made the payment for the renewal and then put a stop payment on it. I called Gateway back and got a different person, who began to explain to me that the XXXX policy we had did not meet FEMA requirements, and that Gateway only allowed the policy for 12mo and after that I was required to get FEMA approved flood insurance. I don't see how Gateway is able to bend any rules, and if they accepted the policy the first time why not every time? They told me that Gateway would place flood insurance on the property until I got an approved policy. This was a major concern for me at this time due to Hurricane Marco heading our way, but they assured me we were covered in the event of a flood. The lady gave me the website to FEMA Floodsmart and told me I needed to find a policy and they would lift the lender placed insurance. What I don't understand is how Gateway has the ability to have flood insurance on my property, but I am being denied? I contacted my insurance agent and let him know, and he started the search. A few days later I received a bill from Gateway stating my mortgage note was going from {$1900.00} to {$2800.00} for the next 12 months to fix the escrow account and recover their expense ( which i don't see how any family could ever possibly adjust to ) due to a shortage in our escrow account. Which also means, that IF we do get a flood insurance policy, it will still put our mortgage note beyond our means of paying, which would have also been realized before closing.Obviously I immediately contacted Gateway and asked for an explanation of the shortage. I was told by the escrow department, that {$4100.00} was " paid out of their pocket, and they had to recover their money since our escrow account did not have it ''. I do not understand how our escrow account was not " prepared '' for the 2nd year of our loan, including our flood insurance if Gateway knew I was only going to have the flood insurance policy the loan was approved with, for 12mo, and after that the flood insurance would increase.With no other explanation, she said I would need to speak to the insurance department, and I told her I have already, but transferred anyway and was told the same thing about the 1st policy only being allowed for the 1st 12mo and now I have to get a new one. So, due to my husband being unemployed still from covid and me only bringing home {$500.00} a week already struggling, we decide we have no choice but to sell our dream home. We get in touch with a local real estate agent and give her our situation. So, in order for her to be able to sell our home, she needs to know the cost of the flood insurance, and she starts calling for quotes on the property. She is immediately declined due to " repetitive claims on the property ''. She tries a few other companies including her flood insurance company who is FEMA approved, XXXX insurance. They declined for the same reason. I called my insurance agent to see what results he came up with and he is also being declined for the same reasons, and files with the Repetitive Loss Department through FEMA. We still have not heard back from that department. As of today, the only flood insurance I have is the lender placed by Gateway who won't even cover my personal property for the amount they are charging. A few days pass and the real estate agent calls to inform me not only are we being declined flood insurance on an FHA loan that is required to have it, in XX/XX/XXXX, FEMA has rezoned my property from high risk, to a Floodway, and she doesn't think she will be able to sell our house. I obviously freaked out and broke down wondering what we were going to do. If we would have known all of this before we closed or even in the process of buying, we would have NEVER picked this house. We were already approved for the loan, we would have picked a different house AND known what to be looking for when it came to the flood insurance or flood map. As 1st time home buyers we were clueless of it all. I contacted lawyers, professionals, friends in the field, and everyone feels the same as I do, this loan should have never been approved if the flood insurance did not meet requirements, somebody should have caught the fact that flood insurance for this property address would be difficult or impossible to acquire and brought to our attention prior to buying this home. Now here we are only 1 year into our 1st year of home ownership and we have been put in a situation of no return and it feels as if no help. I feel as if Gateway Mortgage failed in informing us on these conditions and circumstances and have put my family in a horrible situation and I think they should have to buy this loan back, return all of our money and they should be the ones " stuck '' with this home in this situation and be told " best of luck to you ''. On XXXX2022 we closed a XXXX XXXX XXXX XXXX on our property in XXXX XXXX XXXX At closing our loan was serviced by XXXX Mortgage. o On XXXX2022 a message was sent to us stating our policy through XXXX met their terms for acceptable coverage and we needed to bind it so that we could proceed. o On XXXX2022 we submitted the requested/required bound homeowner 's policy to complete the funding of our mortgage loan. o XXXX XXXX2022 XXXX Mortgage received the same bound policy directly from XXXX for approval prior to binding it. o The policy clearly stated that it EXCLUDED windstorm insurance due to the location of our property, XXXX XXXX XXXX o XXXX mortgage accepted this policy and funded our loan without requiring the purchase of independent windstorm insurance. o We closed ; signed documents, notarized, and filed. o The monthly payment and escrow were partially determined based on this homeowners policy. o This was set at {$1300.00}. Principle and Interest {$1200.00} Escrow {$88.00} On XXXX2022 XXXX Mortgage notified us that our loan was being transferred to a new servicer, Gateway Mortgage. XXXX Mortgage states the effective date of this transfer is XXXX. On XXXX2022 Gateway Mortgage notified us that we were being transferred to a new servicer, Gateway Mortgage. Gateway Mortgage ( XXXX XXXX XXXX Mortgage License XXXX ; XXXX XXXX XXXX XXXX TN XXXX ). Gateway Mortgage states the effective date of this transfer is XXXX In both notices there is clear language that states nothing in our actual loan terms will change, just the company servicing it. Our original loan does not include conditions relating specifically to the requirement of or obtaining windstorm insurance. On XXXX2022 we made our agreed upon mortgage payment of {$1300.00} and have the mortgage statement dated XXXX On XXXX2022 Gateway issued an initial letter stating that their records show that o Your wind insurance expired, we do not have evidence that you have obtained new coverage. Because wind insurance is required on your property, we bought insurance for your property. You must pay us for any period during which the insurance we buy is in effect, but you do not have insurance On XXXX Gateway issued a second letter stating that their records show that o Your wind insurance expired, we do not have evidence that you have obtained new coverage. Because wind insurance is required on your property, we bought insurance for your property. You must pay us for any period during which the insurance we buy is in effect, but you do not have insurance o This letter included a section quoting the cost at {$4900.00} annually. On XXXXXXXX Gateway issued a third letter stating that they had not received insurance information for our property location. o In this letter they included We will cancel this insurance coverage as of the effective date of an acceptable replacement policy that you provide. If this effective date is not the same as or prior to your old policy expiration date of XXXXXXXX there will be a premium charge for the lapse in coverage. In all three of these letters Gateway states that we had windstorm insurance at some point prior to the servicing change and did that we did not keep/renew it. It is our contention that this language is used in order to legitimize the force placed insurance as it can not be enacted and placed unless the loan holder has cancelled their policy or allowed it to lapse. The coverage can not be deemed insufficient to meet requirements as it was accepted and in force at the time the loan was closed. The policy in place is current, is the original accepted coverage policy and was never cancelled or allowed to lapseespecially since it is paid through escrow. Gateway purchased XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX o Policy Tracking ID : XXXX o Named Insured listed as Gateway Mortgage. o The policy is not in our name as the loan holder and attempts by us to obtain 1st hand information regarding this policy have yielded no results because this is the case. o The website indicates this is a firm based in XXXX with a new XXXX operations based in XXXX o Taken from the website : We offer products in the following areas of coverage : Energy Insurance Environmental Insurance Errors & Omissions Fine Art and Specie Kidnap and Ransom Personal Accident Political Risk Terrorism and Sabotage International Surety Reinsurance Casualty Reinsurance Property Reinsurance Specialty Reinsurance o We have attempted to research these coverages and to this point none appears to be applicable to windstorm insurance coverage. o We have also attempted to reach out to XXXX XXXX to no avail regarding the policy. o The final clause of the Document from XXXXXXXX states THIS DOCUMENT IS ISSUED AS EVIDENCE OF INSURANCE ONLY. IT DOES NOT CONSTITUTE A LEGAL CONTRACT OF INSURANCE. On XXXXXXXX we received a notification from Gateway dated XXXXXXXX stating our monthly mortgage payment would be changing effective XXXX o The original amount is {$1300.00} ; Principle and Interest {$1200.00} Escrow {$88.00} o The new amount is {$2400.00} ; Principle and Interest {$1200.00} Escrow Payment {$490.00} Shortage Payment {$620.00} o An increase of {$1000.00} In addition Gateway contends that the original policy and the policy they received on XXXXXXXX differ in the information on the exclusion of XXXX XXXX. However, the copies obtained directly from XXXX on XXXX XXXX XXXX XXXX XXXX are identical ( see attached ). We contest this increase and the addition of both a requirement of windstorm insurance and the force place insurance. We never had windstorm insurance and were never notified before or during the loan process with XXXX XXXX that this was necessary. We have not been supplied a copy of the force placed insurance policy. The terms of the service transfer state nothing will change with the terms of the loan : this would include insurance coverage and escrow not related to taxes. We contend that Gateway Mortgage is attempting to rectify an oversight in their own initial loan agreement at the cost of the loan holder. Documentation and points of contact are readily available to support each of these disputes and claims.

Recently, I took out an FHA XXXX with Gateway Mortgage. A XXXX wraps a new mortgage with a rehab loan. I was assigned a certified Inspector, XXXX XXXX, by Gateway Mortgage. They are supposed to manage the GC, project, to prevent theft & protect the HO. XXXX XXXX did not only not protect me he put me in financial harm by hiring the GC of his choice after running mine off for several reasons. I trusted him, he's a retired XXXX XXXX. I just can't wrap my head around the deception, intent of theft by him, especially since he is certified by HUD! He has zero XXXX complaints until mine gets published. XXXX XXXX is responsible for writing up the scope of work, the cost- & the permits that need to be pulled. The GC, XXXX XXXX, is responsible for hiring subs, making sure they pull permits, engineering reports, etc. Then XXXX, the FHA Inspector overlooks him & submits for draws. The mortgage Co. Is NOT supposed to disperse any funds without copies of permits attached, any engineering & city inspections closing a job. They disbursed without any such attachments!!! XXXX XXXX, GC of XXXX XXXX, hired XXXX XXXX XXXX they turned around and subbed job to XXXXXXXX XXXX XXXX XXXXXXXX XXXX did the job they were told to do so they are not responsible for what went wrong. XXXX ) My foundation called for 20 steel piers at perimeter of entire house. They put in 14 concrete pilings. No permits. No inspection. Bogus engineers letter. Approximately a $ XXXX job that incl. Some beams & sonotubes as well. The actual written project was estimated to be $ XXXX incl. the GC fee. So not only did they not use what my engineer said this house needed, they kept the difference of the 2 jobs. Concrete v. Steel. So theft of Approximately $ XXXX on foundation or in reality the entire amount $ XXXX plus the cost to undo error in materials. XXXX ) No HVAC permit pulled, no electrician used. Brand new 2.5 ton for upstairs, 1150 sqr ft. No kitchen so smaller, set on 70 it's 77 degrees. GC or Inspector won't return calls as soon a they figured that I had busted them. Only good to come from it, preventing It from happening to others. I didn't realize XXXX XXXX was not supposed to know any of the parties involved & signed a conflict of interest disclosure. XXXX XXXX continually butted heads with my GC of choice, finally making him quit, he then, at the XXXX hr., stuck his GC into the contract. He inspected my property back in XXXX XXXX, we closed in XXXX XXXX, they started work in XX/XX/XXXX on foundation. I now have a structural engineers report with measurements, the house is now more undeveloped than before the foundation job was completed by them. The HVAC is currently being repaired, not installed correctly & may have damaged units & /or shortened their life spans. The furnace flues were not replaced or repaired, new report states carbon monoxide risk, tech turned off gas until repair can be made. {$8000.00} to bring to code & repair the faulty installation. That dies not include missing equipment that was supposed to be included per HUD inspectors write up of work, i.e., XXXX XXXX XXXX lights {$2400.00}, new air plenums... I dont have a new foundation estimate as of yet, working on it. I need all the money the HUD INSPECTOR & GENERAL CONTRACTOR were paid out of first draw, approx. $ XXXX & whatever the cost of remediation on both jobs will be, incl. The HUD inspector fees. The rest of the project needs to be completed but the money has to be used to remediate these two jobs. My believe is that someone at mortgage Co. Is in on this scam with HUD inspector & General Contractor. The HUD inspector & Gen. Contractor also intimidated my wife while I was at work, making threatening remarks & had her sign for 1st draw even though she's not on the note & asked them to wait until I was off. They refused & showed up anyways, she is on XXXX XXXX medications that leave her groggy & brain fogged. One comment by HUD inspector, XXXX XXXX, was, " when I find out I'm terminal, I'm taking some people out before I go ''. GC, XXXX said to my wife over phone that she had " XXXX '' him over on the foundation bid because the Rep for XXXX XXXX XXXX, XXXX XXXX said in front of her & GC that he could do same job for half the price that was on work write up. My back deck was cut up & nailed back together, it's a safety risk now. My grass was killed off by them leaving dirt on yard for over 3 weeks. No permits, no engineers, no inspections as required. My name is XXXX XXXX. I have a mortgage with Gateway Mortgage Company. In XXXX of XXXX my home, situated at XXXX XXXX XXXX XXXX XXXXXXXX XXXX, experienced substantial water damage from a pipe failure on the second floor. Because of the severe damage, my insurance company disbursed enough funds to pay off the unpaid balance on the mortgage. A total ofXXXX was received by Gateway from my insurance proceeds. Gateway failed to apply the funds to my account after receiving the check. I did not endorse the back of the check. In XXXX, Gateway proceeded to go to foreclosure while not applying the insurance proceeds to the balance of the account. Because Gateway would not address this error, I filed bankruptcy to avoid further foreclosure proceedings and maintain shelter for my children. Gateway then told my attorney they were not aware of any money from the insurance proceeds. Through my attorneys quiry, my phone records were pulled to confirm how frequent I contacted the servicer regarding the insurance funds prior to the foreclosure. The foreclosure proceedings were suspended. After the suspension of the foreclosure, Gateway found the funds and applied to my past due balance. Additional fees accrued on my account, of which, the servicer was not able to explain the purpose of the funds. In XXXX, an additional {$39000.00} was added to my account resulting in a balance of {$39000.00}. The servicer did not explain the reason for such fees. After the onset of the pandemic, I was forced to file bankruptcy again. While in bankruptcy, Gateway failed to disclose any additional owed fees and/ or balance. During the bankruptcy proceedings, the servicer did not present any funds to the court. However, HUD presented a second mortgage to the court, which was a partial claim. After reviewing my file, the attorney advised me that the servicer was committing creditors lending fraud. Since that time, Gateway has not been transparent with my account. I have been told by customer service representatives that I owe between {$39000.00} to {$120000.00}. When asked to explain why I owe {$120000.00} versus the lesser amount I am not provided a clear answer. Because of all the events over the last six years, I feel filing a complaint may help to highlight the poor and substandard servicing Gateway practices. In XXXX of XXXX my home, situated at XXXX XXXX XXXX XXXX XXXX, XXXX, experienced substantial water damage from a pipe failure on the second floor. Because of the severe damage, my insurance company disbursed enough funds to pay off the unpaid balance on the mortgage. A total ofXXXX was received by Gateway from my insurance proceeds. Gateway failed to apply the funds to my account after receiving the check. I did not endorse the back of the check. In XXXX, Gateway proceeded to go to foreclosure while not applying the insurance proceeds to the balance of the account. Because Gateway would not address this error, I filed bankruptcy to avoid further foreclosure proceedings and maintain shelter for my children. Gateway then told my attorney they were not aware of any money from the insurance proceeds. Through my attorneys quiry, my phone records were pulled to confirm how frequent I contacted the servicer regarding the insurance funds prior to the foreclosure. The foreclosure proceedings were suspended. After the suspension of the foreclosure, Gateway found the funds and applied to my past due balance. Additional fees accrued on my account, of which, the servicer was not able to explain the purpose of the funds. In XXXX, an additional {$39000.00} was added to my account resulting in a balance of {$39000.00}. The servicer did not explain the reason for such fees. After the onset of the pandemic, I was forced to file bankruptcy again. While in bankruptcy, Gateway failed to disclose any additional owed fees and/ or balance. During the bankruptcy proceedings, the servicer did not present any funds to the court. However, HUD presented a second mortgage to the court, which was a partial claim. After reviewing my file, the attorney advised me that the servicer was committing creditors lending fraud. Since that time, Gateway has not been transparent with my account. I have been told by customer service representatives that I owe between {$39000.00} to {$120000.00}. When asked to explain why I owe {$120000.00} versus the lesser amount I am not provided a clear answer. Because of all the events over the last six years, I feel filing a complaint may help to highlight the poor and substandard servicing Gateway practices. Further, I hope this complaint brings resolution and clarity to my mortgage issue. Lastly, I am owed {$15000.00} from the Gateway, as advised by a customer servicer agent. The failure to acknowledge the insurance proceeds ; erroneously placing me foreclosure ; and inability to provide me with the exact unpaid balance highlights the subpar servicing practices of Gateway Mortgage Servicing. The vast deficiencies are unacceptable for a mortgage servicer.

On XX/XX/XXXX around XXXX XXXX while speaking with XXXX XXXX about the status and different loan estimate sheets, why the numbers were increasing when deductions/credits for surveys, and title loan was not showing applied and I needed an explanation. While in conversation, he first asked me about the dividend solar account, on my credit report ( is was current in payments ), and I state i had solar panels on my home, he then stated " you probably have a lien on your home by the solar company because once you sign with them they sometimes go and file a lien on your property if you default on a payment. I explained they have no reason to do that, because I have my payment auto drafted so that should not occur. I asked, isn't that the job of the title company to check and see if there is a lien? and why would you be telling me that? His response was " I just don't want you to wake up one morning only able to eat peanut butter and jelly sandwiches, thinking to yourself, what have you done. '' My response was, did you really just say that to me? He laughs, then says, I want to make sure you are comfortable in making the right decision. I told him " I didn't appreciate him speaking to me that way and it was offensive and unprofessional. '' I also stated that if I thought I couldn't afford it, I wouldn't put myself in this situation. I have never been late on my payment, and paid extra on my mortgage anyway, so the increase is manageable. I also stated that I felt this was just another way that people try to keep you from obtaining your dreams and goals, and I was not going to accept it and not to give up or be discouraged, despite all the negative is he speaking. I was explaining that my homeowner 's insurance company sent me a letter of cancellation because I had solar panels ( which I purchased in XXXX ), now the increase of my insurance has doubled. I didn't understand that because I thought solar panels are to help the consumer save money and energy, but I'm being penalized for it. Because I have to have homeowner 's insurance, unfortunately the cost has doubled. I then asked, shouldn't you be trying to help me not discourage me? I also asked if I was still going to be able to have the automatic draft of the XXXX and XXXX of the month for my mortgage. He replied " no, they weren't doing that anymore ''. ( I was told on XX/XX/XXXX that I should have been grandfather in for this service by Virginia a customer service representative for Gateway I asked if you were trying to help me, shouldn't you be trying to refer me to an insurance company that could possibly give me a lower rate and accept the solar panels? I asked him to please get back with me once the title company has checked for a lien and any information about an insurance company with lower premiums so I can move forward. In regards to XXXX XXXX XXXX XXXX XXXX XXXX, I had spoken to XXXX XXXX prior in regards to the title insurance and if I was to receive any discount or waiver because I'm refinancing and with the same mortgage company and residing at the same location? XXXX XXXX stated that I needed to speak with the title company. He sent me the information for XXXX XXXX and I contacted him the same day, XX/XX/XXXX by phone and explained that XXXX XXXX referred me to contact him about waiving title insurance fee or some type of discount. XXXX XXXX response was " you can only receive a discount if you are refinancing with the same mortgage company ''. I replied, I was still with Gateway and was refinancing with them as well. He then replied, " you will receive the discount at closing. '' On XX/XX/XXXX was my closing day in which I meet with XXXX XXXX who stated she was filling in. While signing the paperwork, I asked about the credit I was told I would be receiving, her response was " she knew nothing about it '', and if I was to receive a discount the mortgage company probably rolled it into my mortgage '' I sent an email a few days later asking for a response to show where the credit was given, I never received an answer to show where I could see the discount if applied in my mortgage. I was outwordly discriminated against verbally, treated unfairly, disrespected as a XXXX women. For the tone, and freely expression of making such comments is totally unacceptable. I felt like I was trying be discouraged by XXXX XXXX to refinance my mortgage, but ONLY because of MY determination and tenacity to push forward and not give into the tactics, I was able to succeed with my refinancing.

I just purchased my very first home in XXXX, OH. I had a very rough experience with my mortgage company and real estate agent. The sellers were not honest on their Ohio disclosures form, which I do have proof of with the seller opening up a little more about the defects in the home after closing as well as old receipts I had found in the home after I moved in. I had attempted to seek legal advice from 2 attorneys that have stated they simply just don't know how to handle this because they can't make sense of the numbers on my closing disclosure form paperwork and they simply don't know the " in 's and out 's '' of XXXX regulations therefore, it was suggested I reach out directly to XXXX. The home I purchased has severe deficits including, XXXX needing completely replaced including duct work HVAC is inoperable, pluming needs completely repaired as well as lines needing to be redirected into the septic tank the plumbing is also not up to code my well pump and entire well itself is bad so I dont know if the water Im showering in is harmful or if the filter I use for my drinking water is sufficient enough to make the water coming into my home safe to drink, foundational issues ( it rains in my basement when it rains outside ), mold in my basement/crawl space and drywall that needed to be taken out as well as carpet I have taken out, and mold in appliances the sellers had left behind, the washer and dryer and second bathroom tub had been installed by the sellers boyfriend, therefore were not installed correctly causing my floor to be unstable in the second bathroom and the washer and shower drain are both draining into my side yard and not my septic tank. My septic system had to be completely replaced. Which was not completed until 2 months after I closed on the home. Luckily, I had asked the seller for the last pump receipt for the tank and based off what I saw I asked her for an inspection to be completed. The inspection had to be completed by the county due to the system being SO damaged. The county had noted the 2 drains leading into my side yard ( shower and tub ). The seller 's listing agent had received a report notating all deficits that had been found within the system as well as the county demanding the whole entire system be replaced. I was not given this report due to " the seller owning the information '' therefore my team and I were all unaware of the 2 wastewater drains needing to be redirected into the tank. We received a quote for the new system, the seller and I had made a deal on how it was going to be paid for, but unfortunately the drains were not added into the quote because the seller as well as the listing agent had failed to disclose the full report issues, nobody knew about the issue. An appraisal had been done on the house that was inaccurately reflecting the conditions of the home as well as the systems in the home. I brought this up to my mortgage company and they ignored me and my concerns and told me nobody is scamming you out of money I had never even brought anything up as a scam. I was simply trying to make sense of numbers on my documents. The sellers brought it to my attention they were unaware that I was a XXXX loan because had they have known that they never would've sold the house to me because it " took money out of their pockets '' My appraisal was conventional based. The mortgage company had stated that the reason my loan took so long to be approved was because they needed to make numbers look a certain way to get my loan guaranteed approved by XXXX. I looked at the limitations for income in my area of XXXX and I am considered a low-income household. But, from what I'm seeing, from them they made it seem like I was a " moderate '' income household. To wrap up my extremely long message I am now drowning in mortgage debt and repairs just to make the house safe and livable, I don't believe this house during inspection/ appraisal time followed XXXX regulations. I believe my appraisal was fraudulent to benefit the mortgage company, which come to find out XXXX mortgage had lost their license back in XXXX due to fraudulent loans and just reopened in 2019. My loan documents and contract do not match. I just really need some help with which direction to go. I want someone who works USDA to even possibly pull my file from them to overlook everything because I'm not sure if it was presented to USDA correctly. My mortgage company is XXXX mortgage.

On XX/XX/2020, I received a letter in the mail from Gateway Mortgage, a division of Gateway First Bank, requesting that I contact them ; no further information was provided. Before this mailing, no other information was received from Gateway mortgage. On XX/XX/2020, I contacted Gateway mortgage and was forwarded to a mortgage loan counselor. On the call, the mortgage counselor informed me that Gateway Mortgage had not received my XXXX payment of {$150.00}, which I had submitted on XX/XX/XXXX. I explained to the mortgage counselor that I had made the payment using online bill pay through my bank, XXXX, and they showed that Gateway had not processed the payment. It was also noted that the phone number that Gateway Mortgage had on record was not my phone number. Since they had purchased my loan from another bank, it appeared they had not maintained accurate records. With the mortgage counselor still on the phone, we called the bank, XXXX, who did verify verbally to both the mortgage counselor and me that the payment had been sent to Gateway and that Gateway had not processed the payment. Gateway mortgage counselor stated they had not received the payment but that she would open an investigation and that someone would contact me within 48 hours ; during the call, I specifically provider the mortgage counselor my cell phone number to ensure they would contact me at the correct number. The mortgage counselor also stated that when they called me back within 48 hours, if Gateway had not located my payment, I could make the payment over the phone or pay my bill online through their web portal. To expedite a resolution and prevent any potential payment issues, I immediately signed up through the Gateway Mortgage online to make the payment. At that time, I discovered that I could not make a payment, instead of receiving an error message stating that Due to your account status, you are not permitted to make online payments. I waited for Gateway Mortgage to call me back but never received a call. On XX/XX/2020, I received a certified letter in the mail stating that I have breached the contract between myself and Gateway mortgage and that the amount of {$320.00} must be received no later than 30 days after XX/XX/2020 or that Gateway Mortgage would immediately accelerate the principal balance or pursue foreclosure proceedings. I immediately reached out to Gateway Mortgage through their online portals complaint department to rectify the situation. Simultaneously, I responded to Gateways letter that their information is invalid and requested they immediately retract the false credit reporting. That letter was sent as certified mail Tracking Number : XXXX and was delivered at XXXX XXXX on XX/XX/2020, in XXXX, OK XXXX. I received a response on XX/XX/2020, from Gateways compliance team via email stating that they had received my communication submitted through their website. We're currently researching the information I provided. Gateway Mortgage further requested a copy of the check for their review. On XX/XX/XXXX, I retrieved a copy of the check from the bank, XXXX, and I submitted it to Gateways compliance team. On the same day, I received another letter in the mail requesting that I contact Gateway mortgage. I spoke with another mortgage counselor who told me that someone had tried to contact me on XX/XX/XXXX ; however, I had not received a call. She discovered that the phone number I provided to the first mortgage counselor on XX/XX/XXXX had not been updated in the system, and the wrong number was being called. The mortgage counselor attempted to reach someone from the compliance department to whom I had emailed a copy of the processed check per their request. However, she could not verify and stated that the compliance department would reach out once she had had a chance to verify my emailed check copy. On XX/XX/XXXX, I received notice from my bank, XXXX, that Gateway Mortgage had processed the payment for {$150.00} on XX/XX/XXXX. Neither my bank nor I had sent a replacement check or made any other payment arrangement. I emailed Gateways compliance department for a status update since I still had not received any feedback and received a message back stating that they were reviewing the documentation submitted and will have a determination soon. As of XX/XX/XXXX, I have not received any further information from Gateway Mortgage and still have no resolution regarding my dispute.

This complaint has to do with the improper behavior of Gateway Mortgage that occurred during/after hiring of a XXXX : XXXX XXXX XXXX XXXX ( XXXX XXXX ). There appears to be some sort of relationship between the contractor and the loan administrator of my escrow account. The contractor on at least 2 - 3 occasions ( verbally XXXX told me that she and XXXX talk all the time. I didn't believe her at first but now I have to wonder. The bank for some reason NEVER had her sign a contract before wiring XXXX $ XXXX. EVERY contractor prior to a background check completed one of these. Here is a quick time line : XXXX XXXX because the contractors ( who I fired ) would not vacate the property and and tried to make entry, I had to call the XXXX XXXX XXXX. XXXX XXXX wrote them a Trespass Warning. XXXX XXXX @ XXXX I notified my loan administrator, XXXX XXXX XXXX what had happened. However, I found out from another contact in XXXX that XXXX had already called XXXX and talked to her about the police being called. I have this email chain from XXXX. XXXX XXXX XXXX tells me in email but legally since you terminated her, I am not allowed to send over anything per attorney. All I can do is wait is for you all to provide me with a resolution. I asked XXXX to call me ( the only time I spoke to her ). I was told that the account was frozen until XXXX and I came to some sort of resolution. She again stated that she was not allowed to share anything with me per XXXX lawyer. This is the main reason I called/hired a lawyer ( XXXX XXXX ). XXXX XXXX @ XXXX XXXX I followed up on my concerns about the phone call a. Coming to a resolution with XXXX the only resolution XXXX will agree to is letting her walk away with my money b. Concerns about the money being frozen XXXX XXXX @ XXXX XXXX I asked XXXX to send the letter and communication from XXXX lawyer to my lawyer ( XXXX XXXX ). She pretended to try and fax the letter to him but said it wouldnt go through. I say pretended because on XXXX XXXX she finally admitted to me there was no lawyer. Again, on XXXX XX/XX/2021, XXXX admitted that she NEVER received anything from XXXX lawyer because there never was one. It was clear she was trying to coerce me into agreeing to XXXX demands for whatever reason ( s ). XXXX XXXX @ XXXX XXXX XXXX sent me an email I already know there has been issues with the contractors before me, unfortunately I did not know that before I agreed to take on your project. The only way she would have known about this contractor issue was through XXXX XXXX. Why is my loan administrator providing the contractor I fired with personal information? What else did she share? For months, they had the draw inspector use the terminated contractor 's ( XXXX ) work scope. When I complained about it and stressed that we should be using the one for XXXXXXXX XXXX XXXX ( the company currently working on the house ), that is when I was notified that we actually had to use the ORIGINAL work scope that I closed on ( XXXX ). Because of this, we spent $ XXXX that is considered misappropriated. I already lost several thousands to the contractor who stole my money and not counting the thousands of dollars it cost to fix the destruction they left behind. XXXX XXXX @ XXXX XXXX XXXX sent me an email claiming that I did not need to request an extension until 30 days prior to the 1 year anniversary of my loan ( XXXX XXXX ). It was a copy and pasted email from XXXX XXXX ( or at least it appeared that way ) XXXX XXXX @ XXXX XXXX XXXX XXXX ( XXXX manager ) told me that my extension ran out in XXXX. She also told me that they never did a background on XXXX XXXX XXXX XXXX XXXX. I was never informed that they were not going to do this since it was done for every other contractor I interviewed ( post XXXX ). This contractor also submitted false receipts/work claim to the bank and nothing was done about that. They allowed her to keep the money. XXXX told me ( again, email ) that she would reach out to XXXX after the inspection to notify her of the amount due back to the bank. I found later from XXXX that she never did that. For whatever reason, she allowed her to keep the money even though the inspection clearly showed $ XXXX % work completed. I kept every email and text messages and can back everything up. There are just so many back and forth emails I wasn't sure what all to include.

I recently had an opportunity to due business with Gateway at a location in XXXX Kansas. Unfortunately this did not end well and legal action might need to be pursued. I have filed a complaint with the Kansas Officer of the State Banking Commissioner and with the Kansas Attorney General. I have tried many times to get in contact with this location ( XXXX XXXX ) as well as his regional manager XXXX XXXX to no avail. I have left messages and sent emails and no one has responded. I am submitting this complaint with the expectation this can be worked out and we can reach an agreement to suit both sides. If not I will have no choice but to seek legal council and pursue this matter through the legal system. The more the public finds out the more other applicants may question the outcome of their loan decisions. I submitted an application with Gateway on XX/XX/XXXX. I was assigned to XXXX XXXX ( Branch Manager ). He asked for paystubs, tax returns, w2 's and such to prequalify us for a home we had a contract on. I uploaded all this information into their system on XX/XX/XXXX. We were notified we were prequalified. On XX/XX/XXXX we had a contract on a HUD REO home. They said they began working on the loan on XX/XX/XXXX even though they were given copies of the contract on XX/XX/XXXX. They ordered us to get a structural inspection, estimates for repairs, estimates for appliances, as well as resubmitting all the pay stubs, w2, and tax returns and such. We struggled back and forth with them because the items they were asking for did not line up with the FHA guidelines we were reading and so we questioned them. Every time we did they would come back with the same response. It is a Gateway requirement. As it was getting time to set a closing date they sent an email to us letting us know we would be required to put up money in an escrow for repairs. We began to question this and was asking why it was not going to be rolled into the loan. We further more was asking for a detailed explanation of how this was going to work so we could ensure we would get our money back because we needed it for other items. Then I sent an email that stated I had done some research on their company and how I discovered they had lost their license in other states, been banned in Georgia, and fined in many other states for fraud and I was just wanting reassurance we were okay. I sent this email to XXXX XXXX on XX/XX/XXXX. I also sent one to XXXX XXXX on XX/XX/XXXX. On XX/XX/XXXX I received a message from XXXX XXXX that we were headed back to underwriting for clear to close which we were trying to do on XX/XX/XXXX. Then all of a sudden on XX/XX/XXXX I received an email from XXXX XXXX that they had " missed the 6 month on job '' requirement for FHA. That I could go conventional if I wanted. I asked him to run the numbers and let me know that we could do that. I wanted this house. This house was not an easy home to replace. The price and amount of land it had does not happen in this market. I had 6 weeks and money invested in it. Then on XX/XX/XXXX he sends me an email that states he looked at it they were higher and he doesn't think we would want to do it. I then sent an email asking for the numbers so I could make the decision and I never heard anything back. I qualified for and had the down payment for a conventional loan. I was not given the opportunity to pursue a conventional loan nor was I given a reason as to why I could not. It was not XXXX XXXX 's place to make the decision for me as to whether or not I would want to do it or not. It was MINE. I believe this sudden interest in getting rid of me was because of my questioning the validity of some of their actions as well as my research into the company. I was retaliated and discriminated against because I was seeking the truth. Not only did I lose the house I wanted and invested money in I now am incurring more expenses while I find another home to purchase. All of the people involved deal with loans all day long. They did not " miss '' this requirement they just wanted me gone. XXXX sent me an email over a month ago stating I would be reimbursed for the XXXX XXXX ( {$350.00} ) and I have not received any compensation. I am also seeking compensation for the unnecessary expenses I have incurred because of the disregard for my interest.

Starting on XX/XX/2020, I notifieXXXX XXXX XXXX XXXXXXXX that I needed forbearance on my federally backed mortgage loan due to financial hardship caused by the COVID-19 emergency. I was informed that because I recently filed for Chapter XXXX bankruptcy I was not eligible for the CARES ACT mortgage forbearance. I voiced my objection and informed them that they must provide the forbearance. XXXXXXXX XXXX XXXX did not provide the forbearance. After reading all of the HUD Mortgagee letters, I came to the conclusion that the CARES ACT did not disqualify individuals with federally backed mortgages from receiving the forbearance. The week of XX/XX/2020, I contacted XXXX XXXX XXXXXXXX again requesting the forbearance and again was refused. I stated that my federally backed mortgage property was not part of the Chapter XXXX bankruptcy plan, and the payments were being paid outside the plan by me. XXXX XXXX XXXX at that time informed me that they had received an update from HUD stating that individuals in Chapter XXXX bankruptcy were not eligible for the CARES ACT mortgage forbearance, which turned out to be false. On XX/XX/2020 I contacted the FHA Resource Center by phone ( reference number XXXX ). I was provided documentation on the CARES ACT, which I read through completely. I called XXXX XXXX XXXX on XX/XX/2020. This time after a lengthy amount of time speaking with XXXX ( no last name provided XXXX. She stated that she could not provide the forbearance. At that time, she forwarded my call to XXXX in the XXXXoss Mitigation Department. XXXX informed me again that XXXX XXXX XXXX would not provide me with the CARES ACT mortgage forbearance. I insisted that XXXX XXXX XXXX provide me with the link to the HUD update that provided information on not allowing individuals in Chapter XXXX bankruptcy to receive the CARES ACT mortgage forbearance or provide a letter from XXXX XXXX XXXX stating why I could not receive the forbearance. On XX/XX/2020 I spoke to XXXX again and was informed the XXXX XXXX XXXX would not provide me with a letter or a link. On XX/XX/2020, again I contacted the FHA Resource Center regarding CARES ACT - Mortgage Payment Forbearance ( XXXX ) specifically asking, " Would a Chapter XXXX bankruptcy disqualify me for the CARES Act forbearance program?. '' I received a phone call from a HUD-FHA representative - XXXX XXXX. She informed me that she would contact the mortgage lender and provide documentation regarding the CARES ACT forbearance. I called her back to make sure that we were specifically referencing any information regarding Chapter XXXX bankruptcy that would disqualify me for the CARES ACT forbearance program. She returned my call and stated that I am not disqualified from the CARES ACT forbearance program because of the recent Chapter XXXX bankruptcy. On XX/XX/2020, I called XXXX XXXX XXXX. I was not allowed to speak to anyone in their Bankruptcy Department or Legal Department. I was finally able to speak with XXXX who was the head of the Loss Mitigation Department. He informed me that he was familiar with my complaint and had been involved for a few weeks. Again, I requested forbearance on my federally backed mortgage loan due to financial hardship caused by the COVID-19 emergency. At this time, I provided the HUD-FHA representatives name and contact information. He informed me that XXXX XXXX XXXX 's legal department, in their legal opinion, determined that any individual in Chapter XXXX bankruptcy is disqualified from receiving mortgage forbearance through the CARES AcXXXX program. On XX/XX/2020, XXXX XXXX XXXX forwarded an application for a regular mortgage assistance program to my bankruptcy attorney, which is not the same as the CARES Act forbearance. The regular mortgage assistance programs have more stringent conditions attached, which would cause me more hardship. This attempt to force me to apply for assistance outside of the CARES Act is outrageous. XXXX XXXX XXXX is in violation of the CARES Act and should be stripped of opportunity to provide or acquire government backed mortgages.

We started a construction loan in XXXX presenting the amount the builder told us was needed to build, XXXX. We later found out that the builder, XXXX XXXX, was not licensed and lowballed the amount it would cost to build. The loan originator, XXXX XXXX, and the mortgage company where she worked, Gateway Mortgage, allowed us to continue by keeping information from us about the builder not having a license, and we believe that there was a breach of confidentiality, a conflict of interest and deception by the mortgage company and the loan originator to keep our business. XXXX XXXX and Gateway Mortgage company knew that the builder did not have a license and we have an email that was given to us by the State of Tennessee where XXXX XXXX and the construction loan manager, XXXX XXXX discussed this. They did not tell us any of this. The mortgage broker was also the builders girlfriend which we also found out later. That is where the confidentiality and the conflict of interest comes in. We did not know any of this until the builder quit after the bank told him to stop building because he went way over budget on the partially built foundation. We looked for new builders, but their quotes were anywhere from XXXX more than what the builder told us it would cost to build. That is when we figured out that he had low-balled the cost to build. We were told by Gateway Mortgage that we would have to build it ourselves. My husband and I work full-time and have zero experience with building and we are not from the area. We did manage to get the house built, doing a lot of the work ourselves and using subcontractors, but not for the original amount we were given by Gateway Mortgage. The only reason we found out about all of this was the housing inspector for the State of Tennessee told us that the builder did not have a license and that we should turn him in. We turned him in to the State of Tennessee. The builder presented the email string between our XXXX XXXX and XXXX XXXX as part of his defense to prove that the bank knew and he didnt do anything wrong. Fast forward to now. We are XXXX over budget, not including about XXXX of our own money, and instead of having a 2.4 % interest rate and an affordable payment, we are left with yet another refinance of the construction loan ( this makes the 2nd ), another XXXX in closing fees ( this makes the 3rd and a total of about XXXX ) and we are looking at a 6.7 % + interest rate and a payment of XXXX which is something we are not sure we can even afford. We are both in our 50s and this was our first home. We would have never even took out the loan in the first place if we would have been told that XXXX XXXX did not have a license to build, that he was dating XXXX XXXX and that he lied about the cost to build so that we would let him be the builder and not look at other builders. Since then, XXXX XXXX has moved on and works for another mortgage company. We are at the pint now where we have to close on our construction loan with Gateway and we have to do a refinance because of the new interest rates. Gateway Mortgage did not tell us that we could look for other financing until we asked. There is more to the story. There are facts about the appraiser/appraisals that have been ordered by Gateway. Its supposed to be random and anonymous, but we have somehow had the same appraiser every time that we have had to get a new appraisal. He always uses comps that makes the appraisal come in too low, and then changes his comps and somehow comes in at the exact amount needed. We are about to close on the construction loan and refinance again. We have already heard from the same appraiser once again. So, since we had the same guy in the past, we are worried that he will do the same thing again. Come in too low and we wont be able to come up with the money that we need to complete the loan. At that point, we are afraid that we will have to default on the loan and lose the house that we have put so much into.

We have a XXXX XXXX XXXX Loan through Gateway First Bank ( aka Gateway Mortgage ). We have currently completed all renovations as planned and stated in the loan documentation. However, Gateway is trying to force us to complete renovations that were never included in the loan plans & specifications and would cost us $ 10-20K out of pocket. We discovered that this is because of an appraiser error in the initial Subject To appraisal, which was supposed to be an estimate of the homes value after the specified renovations are done. The error at hand ( one of many, see below ), is that the appraiser incorrectly stated the house would be a completed 2.5 bath. However, a master bathroom full renovation at no point was ever to be included in the valuation, nor was a master bathroom full renovation planned in our loan at all. At the time of appraisal it was a 2 bath, and still currently is, as was the initial plan. The renovations were very clearly laid out in our loan documents, and were also attached directly in the appraisal, resulting in conflicting details within the appraisal documents. Gateway and the appraiser ( from XXXX XXXX XXXX XXXX XXXX, WA ) have both refused to correct their errors in our appraisal. We are at a loss of what to do here, as we have fulfilled our contractual obligations for the renovations we agreed upon. It is wrong that they are forcing us to do more renovations because of errors that were not our doing nor our responsibility to correct. We have been going back and forth with Gateway for over a month with no resolution. We are now hiring a lawyer and filing formal complaints. Because of Gateways unwillingness to fix their own errors, we are unable to refinance. This is costing us thousands in the high interest rate they have us in, and their required PMI. For more context, here are all theerrorsin the initial appraisal packet from XX/XX/2018 : * Inconsistent/incorrect information throughout XX/XX/2018 appraisal, despite being given all plans and specifications of renovation items : * Listed as 4 bedroom ( is only 3 bedroom ) * Listed as 2 bath ( was at that time, and currently still is 2 bath ) * States, Additional features will include new ( er ) exterior paint, tile flooring, vanities, toilets, fixtures. None of these items werelisted in our loan plans and specifications at all. * Incorrect materials listed, stated as Additional features will include new ( er ) vinyl windowscomposition shingle roof, granite slab countertops, tile backsplash. Appraisal wasnotassessed using the plans and specifications. Higher quality materials were listed in plans and installed, thus increasing the value. These items were : 1. Metal lifetime roof ( vs. composite roof ) 2. Metal insulated windows ( vs vinyl ) 3. Custom designer soapstone countertops ( vs granite ) 4. Custom designer soapstone slab backsplash ( vs tile backsplash ) * Renovation plans and specifications weredirectlylisted out in the appraisal documents, thus it should be concluded that the appraisal should be considered for the correct items it was supposed to be accounting for, no more no less. * XXXX XXXX XXXX loan website directly states that in regards to the renovation plans, These plans and specifications also must be used by the appraiserfor assessing the value. This clearly did not happen, nor did Gateway correct the errors. In addition to the + $ 100K of loan improvements in the property, we have spent over $ 34,000in improvements outside the loan to increase the value inmanyother areas. We've spent over 800 hours of unpaid labor on the house, for which would have been well over $ 30,000to have this work done by contractors.Documentation has been provided to Gateway & appraiser, and we can provide all receipts and comparison bids upon request. We have documentation of comparison properties that are similar to ours, or without any renovation, and the average value isfarabove $ 500K.

For the past six years, I have had a mortgage with Gateway Mortgage Group, Loan # XXXX. During my time with them, I have had several negative incidents occur which finally led to my decision to refinance with another company in order to drop them as my mortgage carrier. The refinance was completed this past XXXX and the loan with Gateway was paid off on XX/XX/2017. Among the incidents that led to this decision was their general lack of customer service especially when I asked them if there were any options available to help me get my monthly payments back on track due to a change in my employment, which led to me, being paid on a bi-weekly schedule instead of a monthly schedule. Because of this change, I no longer had the ability to make my payments within the XXXX grace period and usually ended up making it a few days after the XXXX of the month, which led to late fees being charged on a monthly basis. Their response to this request for help was that they did not know how to help me and stated that I should just continue making my payments late as long as the full monthly payment amount was paid before the end of the month. When asked about the late fees, they stated that I should not worry about those and that they will be " taken care of '' at the end of the loan. In addition, there were also issues with their escrow department, as they would continually raise my monthly payment each year due to their inability to properly calculate the amount needed for taxes and insurance for that year. Even so, I continued with the loan for a few more years until finally this year decided to refinance to a 15-year loan. Despite the on-going issues with customer service and escrow, I decided to give Gateway Mortgage another chance and asked them to handle the refinance for me. In doing so, they ended up costing me about 1 % in loan interest rates as they fully accepted a home appraisal, which was clearly known to them to be incorrect and undervalued. Even though I submitted proof to them that it was wrong, they refused to order a new appraisal so I canceled the loan. By this time, I decided that I no longer wanted to have them as my Mortgage lender, so I decided to refinance elsewhere. Toward the end of the refinance process, I contacted Gateway Customer service one last time via email and by phone to request if they could forgo the {$1300.00} in late fees as a sign of good will. Especially considering the fact that loan was going to be paid in full and that, the late fees were not a result of my carelessness but rather my change of employment. They responded by quoting the golden rule and stated that they did have the authority to remove the fees, but that they felt I was not worthy for them to do so. After this initial communication, I tried to plead me case a few more times via email, but all subsequent emails were ignored. Once the loan was to be paid off, both the title company and the loan processor handling my refinance informed me that they had received the final payoff notice from Gateway ( see attached ) and that they would be sending additional monies above the stated payoff amount only to cover any possible late fees for XXXX. They stated that if Gateway did not charge any late fees that I would be refunded the overage that was sent. After reviewing Gateway 's calculations, I noticed an error in that they charged {$100000.00} as the payoff and {$130.00} toward extra unknown fees ( see attached ). The payoff amount submitted to the title company and to the lender, by Gateway, stated a payoff amount of {$100000.00} ( which already included fees and interest ). The amount paid by the loan company for the payoff was {$100000.00}, which included the stated payoff amount from Gateway 's statement plus any possible late fees. This leaves {$220.00} unaccounted for, which I believe should be refunded back to me.

I was told that after my home reached 78 % of the appraised value, that the PMI ( Private Mortgage Insurance ) would automatically be removed. My home was appraised for XXXX After paying my note down to XXXX, I called to see why the PMI was still being charged. I was told by a Gateway Mortgage Rep that the value of my home was not yet at 75 %? I explained that I looked on CFPB 's website and quoted them the following regarding Private Mortgage Insurance, " Even if you dont ask your servicer to cancel PMI, your servicer still must automatically terminate PMI on the date when your principal balance is scheduled to reach 78 percent of the original value of your home. For your PMI to be cancelled on that date, you need to be current on your payments on the anticipated termination date. Otherwise, PMI will not be terminated until shortly after your payments are brought up to date. '' I am fully current on my payments and have never been late. I have attached a copy of the appraisal value of my home. I have also attached a form from the company, Gateway Mortgage Group, stating that at 78 % ( not the 75 % that I was told on the phone by the representative ) of the original value of the property, the PMI would automatically be terminated. I have since learned that they base the Original value on the LESSER of the sales price or the appraised value. So I fell under the removal of PMI based on current value. For this Gateway Mortgage requires an appraisal. I asked the Gateway Mortgage representative who to use and was told to get a BPO or a licensed appraiser. I thought this sounded a bit strange, so I again looked to the form that I asked the representative to e-mail me. It clearly states " Only appraisals submitted by Gateway are subject for approval '' at the very bottom of the form. It also says that I MUST submit my request in writing at a specific email address and include the appraisal fee. Next came the " seasoning requirements. '' The representative tried to tell me that there was a condition based on the amount of time that I had the loan as to what percentage I had to meet. Again, according to the Consumer Financial Protection Bureau, " Other things to keep in mind about the Homeowners Protection Act Loan investors, including XXXX XXXX and XXXX XXXX, often create their own PMI cancellation guidelines that may include PMI cancellation provisions beyond what the HPA provides. But these guidelines can not restrict the rights that the HPA provides to borrowers. For example, the HPA does not contain any requirements for a loans tenure before a borrower may request cancellation or be eligible for automatic PMI termination ( known as a seasoning requirement ). '' My complaint is that ended the phone conversation very confused. I was given incorrect or wrong information at each step. Problem 1- Loan Closing- was told that my PMI would be removed at 78 % of appraisal value ... WRONG Problem 2- Told the value had to be 75 % by Gateway Mortgage Rep ... .WRONG Problem 3- Told percentage of PMI condtioned based on years ( seasoning ) ... .WRONG Problem 4- Told to Get your own Brokers Price Opinion or Appraisal by Gateway Mortgage Rep ... .WRONG ( this would have cost me between {$150.00} to {$500.00} if I had listened to the representative. ) Not only is it apparent that the representatives at Gateway Mortgage Group do not know the rights afforded for PMI by the Homeowners Protection Act, but do not even know the correct procedures within their own company. It is not acceptable to me that I should not only be misdirected, but told to go and spend money on something unnecessarily. If I had not caught the representative 's error I would have been out hundreds of dollars. In addition, the amount of confusion was inordinate.

I financed my new home through Gateway Mortgage group. Everything has been okay the first few years until just recently. Back in XXXX I received a check from my old homeowner 's insurance company ( XXXX ) for the amount of {$2600.00}. This was odd to me so called XXXX. They stated it seemed that they had been overpaid for the insurance from my escrow account, and were returning the amount to me as I had switched to a new company through my work. They stated there was no balance for me and that the money was for me. Still skeptical I called my new insurance company to see if it was needed to cover anything that was not paid, they stated everything was paid to date and that the check was not needed. STILL skeptical I contacted Gateway Mortgage to make sure that I had not missed a payment I was unaware of, or to make sure that my escrow account was n't low or missing a needed amount. The service rep over the phone ran an escrow analysis and stated that it was paid up and I had no balances. I asked SPECIFICALLY if that money was needed to be placed into my escrow account, I was told no. My fianc also called the mortgage company to verify, and was told the same thing. I never heard anything else from the company. I used the money for XXXX and to help pay other bills needed. My payment for the year of XX/XX/XXXX had always been {$1100.00}. When I checked my bank on the morning of XX/XX/XXXX, the payment jumped to {$1400.00} with no warning. I went online and noticed that the change was in my escrow payment. I called the company and they stated that I was short ( what do you know ) around {$2600.00} in my escrow account. I immediately stopped the person and stated that I did n't know how that could be because I had already checked with the company about this specific matter ahead of time to save me the headache. She then stated, " you 're right I do see where you called about this, I am so sorry this happened. However, we are not able to advise you on how to spend that money. '' I then stated that if I called to specifically ask about placing the money in the escrow account, then you are not advising me, you are answering my question. I also stated the fact that a company would not look out for the best interest of their customer and tell me that that money should be placed in escrow in the event there is a shortage, is a failure of customer service. She stated that my escrow payment actually went down but I am now paying for the shortage. My fianc called a few days later and spoke with them about the issue again, he stated that we would pay the shortage because we could not afford the payment to go up that much, even though we did not feel at fault for this situation. The person on the phone stated that the total due amount may be lower and that they could run another analysis on the escrow to see what would need to be paid. I then get an email, stating that not only did they not run the analysis, but they are wanting to place my account on a 3 year repayment plan to pay off the difference. This is not what I asked for. So I attempted to email them again XX/XX/XXXX regarding the resolution to this issue that I never received. It is now XX/XX/XXXX and I have not been contacted except for an automated email stating they received my submission. I need this resolved before I have to pay my next mortgage on the XX/XX/XXXX and with them dragging their feet, I can tell this will not happen. This is why I am needing your help. I do not need anything refunded to me, I just ask that Gateway pay the difference in escrow needed as they advised me that I not need deposit the money I offered to them. I have made all payments on time and never have any disputes with them until now. This is not right and I want this resolved.

Just over two years ago our homeowner 's insurance premium was set to increase to almost double what we were paying due to wide spread weather in our area. We received the proposal of rate increase in the mail and began immediately searching for a new insurance company. We found a new insurance company and added them on to the escrow through our mortgage company. The mortgage company used our escrow account to pay the premium to the previous insurance company with the excessively high rate. We cancelled our policy with the old insurance company and the mortgage company told us that we should receive a check from them since they had already paid our policy in full for the year. We received a check in the mail, deposited it into our account, and then transferred funds online to our mortgage company via their website. We checked the box that stipulates that the current deposit, the amount dispersed to the prior insurance company, should be reallocated to refund our escrow account. The mortgage company applied some of the funds to the escrow account, some of the funds to our loan principle and some of the funds are still somewhere in their computer. At this time, we were told, that they were switching over to a new computer system that was supposed to be more '' beneficial to their customers. '' The new computer system immediately began generating monthly statements indicating that we were behind a months payment on our mortgage account and that our escrow account was underfunded. We brought the oversight to their attention and they promised that they would review our account to correct these inaccuracies. A couple of months passed with no returned calls, corrections or adjustments. We then called to indicate our concern and were met with associates that were pleasant but unable to ascertain why our escrow account was still short. Our account was pushed up to the supervisory level in both the accounting department and the escrow department for review. We were promised numerous times that after review we should expect a phone call from the mortgage company with a solution. We never received a phone call nor was there a solution presented. These events occurred over a timeline of a year and a half. The next year our taxes and insurance premium decreased by nearly {$500.00} but the amount was never reflected on our mortgage statement as a decrease in our monthly payment. We again called and asked why our monthly payment had not decreased to reflect this change. We were told, again, that an escrow supervisor was reviewing our account and we would have to wait for her to call us. We called to speak to her, because she did not call us, to see if any progress was made. She stated the she had figured out the problem. She said that our monthly payment was not decreased due to the 60 month agreement we made with the mortgage company to rectify our escrow account shortfall. I was dumbfounded in that neither my wife nor I had ever, or would ever, agree to anything close to this far fetched plan. The escrow supervisor was now totally confused, she again stated that she would look into this some more and report back to us. No word since, that was two weeks ago. I am afraid that this issue will continue to compound itself if left unchecked. We have called numerous times over the past two years to genuinely come to a solution with our mortgage companies associates, but there does not appear to be any end insight.

We entered a COVID relief forbearance with Gateway Mortgage Company utilizing the Cares Act. We have been paying our mortgage regularly since XX/XX/XXXX after the forbearance ended and have been working with Gateway to modify the mortgage. XXXX and I noticed on our XXXX credit reports ( attached credit report pages 41 and 43 ) that Gateway reported that we were 180+ days behind in XXXX and XX/XX/XXXX and that the balance of our mortgage had increased from {$71000.00} to {$76000.00}. When we had spoken to an agent with Gateway about resuming payments, we were told that our balance would not increase. Furthermore, according to the Cares Act, Gateway is unable to report us to the credit bureau for the time we were on the forbearance and they are not allowed to add additional interest to the account. " There wont be any additional fees, penalties or interest added to your account. But, your regular interest will still accrue. No additional interest should be accrued. I contacted Gateway via web form and phone to report these discrepancies. We received a Credit Resolution letter dated XX/XX/XXXX ( see attached ) stating the information submitted to XXXX was correct. I also spoke to the agent about the Loan Modification Agreement. On the front page ( see attached ) it lists a New Money ( Cap ) amount of {$6200.00} and New Principal Amount of {$77000.00}. These were not terms we'd agreed to and I was told it was interest added onto the end of the loan. I asked for the underwriter to give us a call and made it clear I was not rejecting the modification but simply asking that it be fixed. A few weeks later I called again because no one had called us back. I spoke to the same gentleman and he said he'd expedite the request. Later, his supervisor called and I advised him I was still waiting for the underwriter. On top of this, the amount due each month has changed. The payment made on XX/XX/XXXX was {$610.00} and the payment made on XX/XX/XXXX was {$670.00}. These payments were made directly with an agent and the payments were the monthly payment due quoted by the agent. Today, XX/XX/XXXX, we received a letter dated XX/XX/XXXX stating Gateway was withdrawing our request for Solution to assistance as of XX/XX/XXXX and that foreclosure was possible ( see attached ). The reason give was that we had not contacted them in a timely manner to resolve the matter. We've been trying to resolve the matter for months. I called a representative today and demanded to speak to a supervisor who is due to call me back. They reported inaccurate information to the credit bureau, attempted to increase the balance of our loan, and are now attempting to foreclose on our house due to their unethical business practices. The Cares Act is meant to protect us and we've taken every measure to follow the requirements and have continued to make our monthly payments as required. We've been waiting months for an underwriter to contact us. 1. Gateway Mortgage foreclosed on our home when they no longer owned the loan. My loan was taken over by XXXX XXXX. Id got my loan docs from the company and everything, when I then got a notice that my prior bank foreclosed. Gateway realized their mistake apparently and somehow took our loan back from XXXX XXXX 2. My loan got behind because I continued to pay my monthly payment, not realizing at some point Id gotten a late fee. Being that I didnt include the late fee, Gateway would put my payments in a reserve account all while charging monthly late fees. After a while of holding my payments in a reserve account they finally sent all my payments back. I called to clarify why and thats when I was told my payments had to match the exact amount due otherwise they cant accept it. I then asked the total due to bring the account current. I paid the exact amount given ( XXXX ) and brought the account current only for them to charge me {$900.00} in attorney fees a few months later. Id exhausted all my resources to pay XXXX do we couldnt afford to pay the additional {$900.00} that was added from me previously being behind so that threw me back in the same cycle of them putting my payments in reserve/charging late fees. After so long they returned all my payments as they did before but of course I now owe attorney fees/late fees. Instead of trying to pay the amount they demanded again I instead obtained an attorney. My attorney filed a case of which is ongoing ( XXXX XXXXXXXX XXXX Gateway Mortgage ) but in the meantime there was a stay. Gateway went against judges orders and kept sending the XXXX police/constable to have us evicted. The first 2 times they came we called our attorney or the courts and they were told to leave because the mortgage company had no grounds for eviction. The 3rd time they came they showed up on Saturday XX/XX/XXXX so that we wouldnt have access to our attorney or the courts to tell them the eviction was illegal and to leave. My family was forced out that day, all of our possessions thrown out. We were forced by the XXXX police to sign docs for the mortgage company saying we wouldnt return otherwise wed be arrested. We only signed because they said they would take my husband to jail for tickets and instead of letting us get our needed possessions make us immediately leave. 3. We have been trying to reach Gateway repeatedly since we were illegally thrown out and they refuse to speak to us. We reached their attorney once and he had them call us, but they gave us a payoff of more than XXXX XXXXXXXX. We bought our home fort XXXX XXXX XX/XX/XXXX. How could they expect us to pay twice that to get our home back? We sent them an approval for financing but we refuse to pay the amount theyre demanding. This company has taken advantage of my family in every way and are continuing to try to strong arm us. All we want is our home back for the correct amount owed and theyre refusing to have the conversation or give a breakdown for the amount theyre asking for. Theres so many violations this company has committed against my family and I want them held accountable per XXXX CFPB assisted homeowners with their loans when XXXX XXXX did the exact same thing to their customers and I just hope cfpb can do the same for my family with this company.

I entered into Covid Forbearance with Gateway Mortgage XX/XX/XXXX and in the transition of forbearance I was forced into a Modification. They come back with loan modification documents with an increase in rate causing an increase in monthly payment. I have called and spoke to XXXX requesting contact with loss mitigation or underwriting to request other payment options more specifically partial claim. My account was noted and received a call from XXXX on XXXX indicating that my request to appeal my modification was denied and I exhausted partial claim. I had no options pay the outstanding balance in lump sum or agree to modification. If these options didnt work they will start the process of Foreclosure. I asked my account be noted to have a Supervisor call me, at which time I was informed they return calls 24-48 hours. I called again on XX/XX/XXXX requesting update on Supervisor call and was informed I should receive call on Monday XX/XX/XXXX. Today, XX/XX/XXXX I received alert from Credit reporting agencies, that Gateway reported my account delinquent and reported last payment on XX/XX/XXXX, when last payment was submitted on XX/XX/XXXX for the actual monthly payment. It appears that my rights were violated under the FHA after Covid Forbearance and my XXXX payment was not applied to my account. I can resume my monthly payment with an option of partial claim for 5 Covid forbearance payments. After doing research and CFPB site see : Forbearance ends with a payment plan, not a lump-sum payment Homeowners who receive COVID hardship forbearance are not required to repay their paused payments in a lump sum once the forbearance period ends. You can talk with your mortgage servicer, or start with a HUD-approved housing counseling agency , to discuss a repayment plan that works for your situation. Most servicers must offer forbearance, and the others can provide options The COVID hardship forbearance applies to all federally backed and federally sponsored mortgages, which includes HUD/FHA XXXX VA, USDA, XXXX XXXX XXXX and XXXX XXXX mortgage loans. This includes most mortgages. Homeowners with federally backed loans have the right to ask for and receive a forbearance period for up to 180 dayswhich means you can pause or reduce your mortgage payments for up to six months. Additionally, you can request an extension of forbearance for up to 180 additional days, for a total of 360 days. The consumer reporting protections of the CARES Act continue to apply to the time period that was covered by the accommodation after the accommodation ends. My husband and I started our home buying and construction loan process with XXXX XXXX in XXXX of 2018. We had never gone through a construction loan before so we had let XXXX know this. We had issues with XXXX not being honest with us about interest rates and really did not hear back from him until it was time to close, after closing we had some issues and was directed to the wrong person by XXXX, the contractor taking 2 draws from Gateway Mortgage and cash from my husband and I had given him, XXXX also told us that a contractor had never stolen money from a customer or a mortgage company before and then we never heard from him again. We recently settled with the contractor 's insurance company and started repairing the little things that were left to be done as the contractor had completely demolished the inside of our house and then never did any work so he had to be fired. XXXX XXXX, who included XXXX XXXX in this email as well had contacted me back in XXXX before we settled with the contractor 's insurance asking for us to complete the repairs needed in the house as they needed to close our construction file and remove the lien on our property. So as we finished what was required, I sent XXXX XXXX an email back asking what I needed to do to have the lien removed, she replied back asking for the information of my loan officer and the title company in which XXXX XXXX was included in again, I sent all the information needed along with a copy of the lien. I never heard back from XXXX XXXX again and never heard from XXXX XXXX at all in this matter and I contacted XXXXXX/XX/XXXX manager but never heard from him either. I contacted XXXX XXXX as she was the only person throughout these 2 years of dealing with Gateway and being a PAYING customer of Gateway that had consistently responded to my emails. I called XXXX XXXX 's office and spoke with his receptionist, left a message for him to call but never got a return call. I wrote this email to XXXX stating that I was going to contact XXXX and XXXX 's superiors to let them know that these employees do not care for customers and did not respond. I then got a response back from XXXX stating that she had been searching for the lien in XXXX county but could not find it and that it probably did not exist. I then responded back and stated that I sent all of that information to her and that the lien was in XXXX County in which was in the previous email that I sent. I thought that Gateway would have all of this same information that I provided as they are the mortgage company that we have our home loan with. I do not believe that Gateway cares about their customers, XXXX XXXX obviously got our business and then never have any communication going forward. These 2 years with Gateway has been a terrible experience as I feel the only employee that they have that was honest and returned communication was XXXX XXXX. I would never recommend XXXX XXXX or Gateway to anyone.

Gateway Mortgage Group , LLC misled me about qualifying for a home loan. In XX/XX/2017, I was pre-approved for a {$140000.00} VA home loan with XXXX XXXX XXXX XXXX in XXXX XXXX, TX. I am unemployed and my only income is my XXXX XXXX pension ( {$1700.00} gross monthly income ). I have no debt except my credit cards which I pay in full each month. On XX/XX/2017, I signed an agreement to purchase a home for {$210000.00} and provided a copy of the contract to XXXX XXXX XXXX XXXX. I liquidated most of my retirement investments ( {$80000.00} ) for a down payment to purchase the home. On XX/XX/2017, XXXX XXXX ( XXXX XXXX XXXX XXXX Loan Officer ) informed me that the loan was being passed on to one of their " sister '' companies " Gateway Mortgage Group '' in XXXX XXXX TX, because they could not process my VA loan. On XX/XX/2017, XXXX XXXX ( Gateway Mortgage Group Loan Officer ) instructed me to fill out a new loan application on-line. Immediately, Gateway Mortgage Group pre-approved my home loan for {$140000.00}. On XX/XX/2017, I received a copy of the loan application for my signature. I noticed some discrepancies on the application such as my loan was now a conventional loan instead a VA loan ; my gross monthly income was higher than the amount on my monthly income statement ; and the total amount of my assets was more than double the amount I reported. Before I signed the application, I contacted XXXX XXXX about the discrepancies. XXXX XXXX told me it was common practice to increase the monthly salary amount ; the type of loan did n't matter because of the size of my down payment ; and the total amount of my assets would be corrected. XXXX XXXX told me to sign the application and she would correct the total amount of my assets in the system. On XX/XX/2017 -- 3 days before the scheduled closing date -- XXXX XXXX informed me that she failed to verify the property taxes on the home I was purchasing. As a result, I no longer qualified for the conventional loan unless I increased my down payment. I informed the XXXX XXXX that I could not increase my down payment. XXXX XXXX stated I qualified for a VA loan ; however, the process would take another 30 days and I would have to pay for another home appraisal. On XX/XX/2017, I filed a complaint with Gateway Mortgage Group Corporate Office in Oklahoma and requested reimbursement for the money I spent due to XXXX XXXX 's negligence. Gateway Mortgage Group refunded me the home appraisal fee, but did not reimburse me for the other expenses -- claiming the expenses are " out of Gateway 's control. '' Despite their claim, it does n't change the fact that Gateway Mortgage Group misled me about qualifying for a loan and should be held liable for their actions. Further, Gateway Mortgage Group can not claim they hold " a high standard for Customer Experience ... '' when I was duped by their loan officer. My first-time home buying experience was horrible.

On XX/XX/XXXX I purchased my first property located in XXXX, New Jersey. This is a 4-unit residential property, with 2 bedrooms in each apartment. The mortgage company is Gateway Mortgage and my account/loan number is XXXX. The purchase price of the property was {$360000.00} plus {$25000.00} for renovations as this loan is an FHA 203k Loan. The total loan amount at closing was {$380000.00}. My monthly mortgage payments are {$3200.00}. The payments started in XX/XX/XXXX and I began to make the payments without any rental income. I anticipated between {$1200.00} to {$1500.00} per unit from three ( 3 ) units and I intended to reside in the fourth unit. Since XX/XX/XXXX no renovations have been done on the property. I began making payments in XX/XX/XXXX and made my last payment XX/XX/XXXX. I exhausted approximately {$15000.00} from my savings account to maintain the payments. As of now, my loan account is delinquent and I am facing foreclosure. No renovations have been done because the real and actual cost of the renovations to make the property livable is approximately {$60000.00} to {$100000.00} and not {$25000.00} which was allotted by the mortgage company. I have thus far received estimates from six different contractors who all thoroughly walked through the property and provided an evaluation. They all stated that the property needs, at minimum, {$70000.00} in renovations. My complaint is that Gateway Mortgage and the Realtor and the General contractor committed multiple counts of mortgage fraud and violated HUD/FHA guidelines. 1. The contractor never conducted an actual walk-through prior to closing which was sanctioned by Mr.XXXX. On the contrary, Gateway Mortgage closed on this loan stating that the contractor conducted a walk-through. He only saw the property once, with me, after closing. It was then that he stated that {$25000.00} was not enough to cover the renovations. Gateway Mortgage fraudulently processed my 203k loan because they claimed that this write up was conducted by a contractor and it was not. 2. I was told by my realtor that a Certified HUD Consultant was required to view the property and submit a separate write up for renovations. After I submitted the HUD Consultant write-up to Gateway ( before closing ), I was told by the loan processor that the HUD Consultants write up was not necessary. I only recently learned that if the renovations do not exceed {$30000.00}, that a HUD Consultant is not needed. Again, the Realtor and Gateway Mortgage violated FHA 203k loan guidelines by purposely keeping the cost of renovations under {$30000.00} to avoid a HUD Consultants involvement and oversight. Gateway Mortgage pushed this loan through in order to maximize that selling price and to minimize that cost of renovations in the paperwork and closing documents.

Gateway has refused to comply with my cease and desist demands. Gateway has been notified and continues to harass me with communications and refuses to respond to written disputes for disclosures in compliance for the Fair Credit Billing Act, Truth in Lending Act disclosures demanded that were withheld regarding the finance charge and the amount financed. Gateway refuses to disclose documentary material disclosing federal or respond to communications delivered in writing, proceeds held on behalf of obligor, fund approved and acquired on behalf of consumer. Gateways negligence has been very distressing and has put a strain on my personal life in dispute with Consumer reporting agencies. Gateway has threatened foreclosure alleging default as obscene language to disgrace the consumer despite demand for validation of debt compliance to Fair Debt Collection Practices Act. We anticipate Gateway will in good faith with clean hands address the claim brought forth.

I closed on this loan on XX/XX/XXXX with the XXXX XXXX. On XX/XX/XXXX, I received a letter from XXXX XXXX stating that the loan was transfered to Gateway First Bank> The letter also stated that nothing else about my mortgage payment will change. I received a letter from Gateway XX/XX/XXXX stating the same. Sometime later I received a letter from Gateway First Bank stating that my property insurance had expired and I needed to purchase property insurance, including wind and hail. As this was not the case, I assumed that they had made another error ( In XXXX they had made a mistake with the escrow, collecting my mortgage payment and placing it in tax escrow. I am 100 % XXXX XXXX XXXX exempt from taxes and the initial loan was written without a tax escrow. This was rectified ). On XX/XX/XXXX, I received another letter stating that the property insurance was expired on this property and I needed to purchase wind and hail. They, Gateway First Bank, had purchased wind and hail for me and I would be responsible for the charges. I phoned Gateway on XXXX and spoke with 4 cus service reps who informed me that my homeowners insurance did not include Wind and hail coverage and that I had to purchase it. I explained to them that I was informed by XXXX XXXX that I did not live in flood or XXXX XXXX and I was not required to purchase wind and hail to close on my loan. I closed without wind and hail coverage. Each individual at Gateway Bank explained that it XXXX not have been required with XXXX XXXX, but now that they are servicing the loan, Gateway requires it. They repeated over and over that I need to purchase wind and hail because they have purchased it on my property, since XXXX, and I would be responsible for payment of the policy they purchased. I made them aware that all correspondence from both the previous bank ( XXXX XXXX ) and themselves ( Gateway First Bank ) stated that nothing about the mortgage loan would change, just who collects it. They continued to express that their bank ( Gateway ) is now requiring wind and hail, although I was not required to have it with XXXX XXXX and it closed. I also asked them to provide documentation to show that this coverage is required on my loan after closing or to have the situation escalated to be resolved. They refused.

Gateway Mortgage District Manager XXXX XXXX recently listed a house w/ XXXX XXXXr- XXXX XXXX that my wife and I were interested in. We had got our prequalification done months ago so we could move forward w/ an offer as soon as we found a house w/our prequal amount ( {$300000.00} ). Soon after we submitted our offer XX/XX/2018 our agent called me to inform me there is a note on the internal portion of the MLS listing that requested the buyer to go through Gateway for their prequal. I told my agent that why do they need this if we have already prequalified and she responded that the seller ( Gateway Mortgage ) was just looking to prequal w/ them and to talk to us so we could go forward. My agent also sent me a phone # for a loan officer XXXX XXXX XXXX to give him a call and see what he had to say. I asked our agent does this mean they are taking my offer for their house and she said she would ask ( she texted listing agent and called and got no response ). My wife and I went ahead and called XXXX. He started the conversation by telling us we could do the prequal over the phone or on line. My wife told him she did not think it was necessary and also did not feel comfortable giving the seller our personal info. At this time XXXX said he would keep it private even though his manager is the seller of the property. When we asked about his relationship w/ XXXX he said they were co-workers. When my wife asked why we would need to redo a prequal XXXX responded that it was to make sure we had qualified for an amount to cover the loan and the seller felt more secure if the loan was a local lended. This is when my wife assured him we were w/ a local lender and that he must empathize w/ us being put in this awkward situation. He said he recognized the lender and said he was just doing what was asked from him from the seller ( his manager. ) and implied that if we did not go ahead and get a prequal letter from his company that the contract may not go through. We ended the call soon after he told us of his weekend availability. Two minutes later we received a text from our agent that our offer was rejected. I asked my agent today XX/XX/XXXX for a copy of the inter MLS portion and she said they removed the mortgage steering language from the listing since Friday.

Our application was filled out by the lender and incorrectly. Lender would not correct the application, insisted we sign or it would delay processes. Lender would not provide rates and payment terms. Lender would consistently ask for the same income and bank statements even for the same dates. Lender was not responding to emails until settlement date was 3 days away and then they began asking for income documents again. Lender was negligent in retrieving documents we sent them. Lender had multiple agents asking us for the same documents. Lender blamed title company, blamed seller 's agent, blamed buyer 's agent. Lender would promise to work on file and get back to us but did not, several times. Lender confused prior property with current purchase. Lender would not lock in the rate. Lender selected incorrect loan type ( they listed as a foreclosure and an investment, instead of second home/vacation home. Lender 's appraiser used data and pictures from prior evaluation and used incorrect information on final appraisal. On day of supposed settlement we called president and left a voicemail. We were directed to vice president, his son. We were then contacted by three more people. Lender agreed we have a valid complaint and understood we will submit in writing. Lender assigned another agent to call us and start the process over when we were already passed settlement date for second time. One agent was an investigator who asked for documents to from XXXX ( on XX/XX/XXXX ) to substantiate lenders own processes instead of helping us. Process ongoing since XX/XX/2022 and last contact was XX/XX/XXXX. We have done our due diligence. Lender is also assuming sellers assist as payment for points which we did not agree to paying. We merely wanted to know what the difference in payment would be if we paid a point vs XXXX points. Lender refused to communicate rates and P & I on closing disclosure. Lender also would not provide access to company portal and made us send our income documents and all other documents through email. Lender also emailed us someone else 's correspondence, which we deleted per law. We have already paid out of pocket for contractor 's repairs per inspection results and still did not settle.

I monitor my credit report very carefully as I am in the process of trying to obtain a loan with XXXX Mortgage. On XX/XX/2019 I received an alert that my credit was pulled. I checked with my lender as the inquiry was from XXXX XXXX and the alert said a Lender has requested a copy of your credit report. My current lender assured me this was not their inquiry as they no longer use XXXX XXXX. I was contacted by my previous Lender on XX/XX/2019 about the same time my credit was pulled. He called to follow up in my house search I made him aware that I had found a lender that worked with me and my house closing is this month. The next morning I checked again with my lender to make sure it wasnt her team that pulled my credit and again she assured me it was not her. I tried to contact XXXX XXXX my previous lender to verify if he pulled my credit report but he did not answer. I text him and he indicated he did pull my credit report by accident due to him having another customer with the same name. However I find that very hard to believe if you have to give all my personal information name, address, date of birth and social in order to run my report. My lender then asked me to contact his manager to make him aware and to have them remove the illegal inquiry. I contacted XXXX XXXX Mortgage come to find out XXXX doesnt work for them anymore he is now at Gateway Mortgage. I then contacted his current manager and still no response. I had to call around to get XXXX XXXX current email and managers email. Once I obtained this information I emailed his old manager XXXX XXXX current manager XXXX XXXX and XXXX XXXX on the illegal pulling of my credit report. Not only did he illegally pull my credit report but he took my personal information from XXXX XXXX Mortgage and used it to pull my credit through Gateway Mortgage. I received an email from a XXXX XXXX on XX/XX/2019 expressing apologies on the accidental pulling of my credit and they would work on reversing this act. The company was XXXX XXXX Loan officer XXXX XXXX He told me on since before XX/XX/XXXX that I had been approved for a {$120000.00} at a 3 % interest rate. He had all of my info I had filled out an application and all. On two separate occasions I did a inspections on houses thinking that this process would work. The most recent was XX/XX/XXXX he told me everything with the loan good to go that I could continue with an inspection on the house. I signed a contract with the owner of the house stating the XX/XX/XXXX would be our closing date. I paid {$350.00} for an inspection and {$50.00} for a reinspection. I paid my escrow and found insurance for the house all under his instructions. He told me he ordered an appraisal around XX/XX/XXXX no appraiser ever contacted my realtor to make an appointment he said he cancelled it and ordered another one through another company around XX/XX/XXXX again no one contacted us so he said he switched the company for a third time and had an appraisal scheduled for XX/XX/XXXX the closing date. On XX/XX/XXXX I received multiple messages from him asking be for multiple documents I had already sent him drivers license, social security, insurance info, proof of employment, exc when he sent me the documents it was another application my husbands info was all wrong the closing date was wrong and the loan amount and interest rate was wrong. I tried explaining to him the contract ends XX/XX/XXXX and I thought all this paperwork was done. He refused to acknowledge anything I was asking him. I then received the first of any notification saying he ordered an appraisal XX/XX/XXXX at XXXX and said he would have everything done by the following day. I again stated we could not wait because the contract expired that day. He better brushed me off saying I needed to then get ahold of the title company. I tried to get help from another lender after telling XXXX I will no longer need his services and the other lender told me I did not even have a case number. XXXX lied about everything that had to do with my paperwork and loan costing me, the owner and my realtor money and time.

I have had a hard time getting back on my feet since covid. The first time my home was in forclosure was in XXXX when the pandemic first started. My forbearance was over in XXXX of XXXX, and I applied for the Texas Homeowners assistance Fund on XXXX XXXX, however previously I applied and was denied. My second application with XXXX is still open and active and I communicated that with my mortgage company. They have to ability ro look my case number up, and I was informed that when they looked up my case number nothing was showing up. I tried for weeks to get my caseworker on the phone with the XXXX and nothing was done with my application until XXXX on my forclosure date XX/XX/XXXX. My home was sold, and my mortgage company wouldn't nldo their due diligence to see if I really did have an open case with XXXX. I also was unaware that once I was out of forbearance that they opened a second mortgage. Initially was not explained to me that it was a second mortgage on my home and also being refinanced. My home was sold on XX/XX/XXXX in a forclosure auction and I feel as though this should not have happened especially since I had been applying for TExas homeowners assistance for a year and a half. I have nowhere to go, and I will not be able to find a home for my children and myself with a forclosure on my credit. And the company who purchased my home has already left a note on my door. I can answer any questions you may have, and I know that since my home was already sold that there isn't much I can do, bit I feel like the ball was dropped between texas homeowners assistance fund and my mortgage company Gateway.

I am currently in an active chapter XXXX bankruptcy and I want to voluntarily reaffirm my debt with Gateway mortgage. I have filed pro se. I am able to file the document myself with no charge. Gateway states that if they send it to counsel that they will charge my account. For me to be able to file I have to have the original signatures which the bankruptcy manager at gateway XXXX is refusing to send it to me. Stating that he does n't trust me and that he will not send it to me because I could change something. I am a bankruptcy lead for a mortgage company and I know that I can not legally change the information as that would be fraud. I have conveyed this information but he still refuses to send it to me. The court allowed me to file the reaffirmation but with deficiency of the mortgage company needing the original signature. When I contacted XXXX this morning he stated that they are sending to counsel and when I called I advised about not billing the fee to my account as that would be incorrect XXXX hung up on me. 1. With the note and mortgage that I signed at closing it does state that a fee may be assessed if referral to counsel is necessary " if there is a default '' we have never been in default on our mortgage account. 2. I have opinions from multiple local attorneys stating that the fee has to be listed in the reaffirmation agreement to be able to charge to the borrower. In this case the fee was not included in the reaffirmation agreement that I signed and filed. So in this case I do not believe that they would be able to charge the fee to me. All I want to do is reaffirm the debt to ensure that my monthly payments are reported to the credit bureaus as I know without the reaffirmation agreement they would not be able to. Again I can file it for free I just need the original signatures from the mortgage company which has refused and they are going to send to counsel and bill my account for something I can do for free.

I received a home improvement loan through the Texas XXXX XXXX XXXX XXXX ( XXXX ) program ( loan number XXXX ). When the first payment was due, I had not heard anything about making a payment so I inquired as to where to send the payment. I then sent the payment to where I was instructed to. This payment was received and I my bank statement shows that the check was deposited. After this, the mortgage was sold to Gateway Mortgage Group ( new loan number XXXX ). On XX/XX/XXXX I received a call from Gateway informing me that I had not made my first payment and I was told that " If you don't make the payment your credit history will be impacted. '' I instructed them that I had, in fact, made the payment. I was then told Gateway had purchased my loan from the XXXX and the address I had sent my payment to was not with Gateway, after which I instructed to make another payment. I objected and told them they were the ones that had failed to do their jobs, not me, and they were now trying to punish me for their actions. I had done everything required of me and even more. It was not my fault that they had failed to get the deposits from the XXXX. And, now, they were calling up, threatening me, and demanding I make a second payment. The caller said it wasn't a threat because he had said, " if ''. I told him it was perceived as a threat and I feel any reasonable person would agree. I demanded that the caller take this up with his supervisor and they should call me back with the resolution. I have now received a letter from Gateway demanding I make this payment. I did what was required of me. I not only made the payment, but when there was no contact concerning payments, I reached out and found out where I needed to send it. Now, Gateway is threatening my credit history and demanding I pay double because they failed to obtain payments that had already been made to the XXXX when they purchased the loan.

In XXXX XXXX , I tendered payment-in-full as per UCC article XXXX , to the mortgage servicer via USPS certifi ed mail with return receipt green card. The valid negotiable instrument was dishonored by refusal, nonperformance, and not returned to me. In accordance with UCC 3-603 ( b ) there was discharge. After numerous communications and legal Qualified Written Request, I was told that my mortgage was sold. On XXXX XXXX, 2015, I emailed XXXXXXXXXXXX a copy of a delinquent notice I received for my XXXX bond. The payment was due XXXX XXXX. After receiving no response, I called and spoke with your customer service agent XXXX XXXX on XXXX XXXX. He was very helpful and asked me to resend the delinquent notice directly to him. Several days later I received a voicemail message on my home phone from another Gateway employee that they had corrected the problem and payment had been made. On XXXX XXXX, I received via Certified Mail a notice showing that the original amount due had been paid, but the late charges were not. This was sent via email to XXXXXXXXXXXX on XXXX XXXX. Another follow-up email was sent XXXX XXXX after I had not received a reply. On XXXX XXXX, I received a second certified letter, so I called Gateway again. I can not remember the name of the representative I spoke with that day. Rather than just trying to get payment made I asked for an explanation why your company has such a hard time with a simple escrow payment. I was assured after XXXX minutes on the phone that a computer error was corrected and payment would be made. Through indirect channels, I learned my home was being prepared for auction to pay the outstanding balance. The XXXX bond website still shows XXXX has not made payment at XXXX Since I have a vested interest in maintaining my home, and Gateway 's staff appears to be functionally incompetent, I paid the outstanding fees via personal check on XXXX XXXX. Because all late fees incurred were caused by the failure of Gateway, I demand immediate reimbursement for the {$290.00} I paid to satisfy the outstand amount due as set forth in 12 CFR 1024.34 of the RESPA. I also request Gateway make any necessary changes to ensure all future escrow payments are made in timely manner.

I am a first time home owner and I purchased my home in XXXX of XXXX. At my closing, I was told to put away a certain amount of money for escrow as there might be a shortage. I did as instructed and fast forward to XX/XX/XXXX, I get a tax bill that higher than expected, based on the discussion that took place at the closing table. The bill was sent to my mortgage company and they paid it. To recoup their funds, they built the amount into my house note, which increased my house note by a little over $ XXXX/mthly. I was offered a modification as a way to assisting me by reducing my mortgage and allowing me to put away the additional funds for my upcoming tax bill. The trial period for this arrangement was for four months. Once I completed it, my interest rate was to be reduced from 5.125 % to 3.25 %. I have since completed the trial with on time payments and received my paperwork for me to agree to the loan 's new XXXX XXXX XXXX XXXX XXXX During the evaluation, I start receiving letters from a few of my credit card holders that they are either reducing my limits or closing my accounts due to non-payment of real estate. This is not accurate and upon speaking with Gateway Mortgage, they tell me that they won't report my house payments until I restart the process. They want me to do a new appeal because the date of my signature and the date of the notary are two different dates. In the mean time, my credit has received adverse actions from four of my creditors. Three of them have reduced my credit limits and one has closed my account all together. This is unjust and inaccurate and I would like for this company to be investigated for their unethical practices.

I received a statement showing that I was almost {$1100.00} short in my escrow account due to the fact that my mortgage lender switched ownership and did not include an RHS fee in my anticipated activity for the XX/XX/XXXX year. Also, I do not have paperwork showing in closing that I agreed to pay this fee. I have attempted to contact my lender and spoken with a customer service representative. They are only agreeing to allow me to pay the shortage back over a 24 month period instead of 12 months. As I told the representative, this was their fault and based on my paperwork, I never agreed to pay this RHS fee. I 've never received a letter or any other form of paperwork stating that a new fee was being added. Also, I have had problems with my payments since the beginning XX/XX/XXXX. In XXXX, I wrote a check on XX/XX/XXXX. I had to contact the company on XX/XX/XXXX because my check had yet to be processed. I wanted to make sue that the check had not been lost. The customer service rep stated that he had the check in his possession and would send it for processing immediately. I also had a late fee of {$35.00} due to this. He was able to correct it at the time. In XXXX, I paid another monthly payment online as a one-time payment. It took XXXX days to process and resulted in another late fee charge that I had to address. I am aware that the new law implemented in XX/XX/XXXX about the RHS fee applies to my loan. However, I am not sure that it is legal for the new owner to back-date my loan when they bought it out in XX/XX/XXXX and are trying to charge me the RHS fee for XXXX of when my old company did n't charge me at all.

Gateway mortgage has and continues to maintain to recklessly disregarded HUD guidelines as well as violate federal law under XXXX to avoid providing the best relief available for this borrower under HUD guidelines. In spite of the fact that this loan is insured by FHA Gateway has insisted that the borrower can not add his wife to the application unless he provides proof that they are legally married which is in direct violation of ECOA. Gateway also refused to reconsider the wife 's income after Gateway acknowledged it would use it once we provided proof of her continued employment which we did. Gateway refused to provide the reason for denial until after we contacted HUD that compelled them to release it. Gateway offered the borrower, under duress, a covid partial claim if he provided a letter saying that his income was effected by the pandemic. The letter he provided said his wife 's income was effected not his. The offer did not reduce his payments in fact they went up. The borrower 's interest rate remains above 6 % and he has an escrow shortage in excess of {$10000.00} that has not been cured. We have spoken with XXXX XXXX, loss mitigation mgr, who appears to be the most inept, uninformed, untrained manager we have ever encountered and definitely needs to go back to some remedial training because the terms he was using XXXX HUD assumption ) have been outdated for decades. This is the 3rd complaint we have submitted through CFPB. There is currently an open HUD file as well. I sincerely hope the new administration will take more of an enforcement approach to resolve the inequities for this borrower.

I, XXXX XXXX , natural person, consumer, alleged obligor, and original creditor of an open-end credit plan extended via my credit card for a consumer credit transaction to Gateway Mortgage Group on my behalf via a deceptive form that converted my interest a consumer and creditor unlawfully as borrower. I am the card issuer and cardholder for the accounts payable issued via consumer application as valuable accounts receivable. I granted the security interest to as debtor for the consumer credit transaction. Gateway usurped my credit and proceeds via account receivable secured credit application. I was coerced in completing a promissory note in the refusal of my endorsement by closing agent of the promissory note compelled for a blank endorsement as an illegal restraint. I issued a security despite being original secured creditor to consumer credit transaction. Despite misrepresentation of consumer credit transaction, Gateway has been advised to comply with my right of 12 CFR 1016 privacy and confidentiality and to cease the role of consumer reporting agency and communication with third persons, XXXX, XXXX, XXXX, XXXX etc. viz. consumer reporting agencies. Gateway has disregarded my revocation of right to report and continues to violate my right of privacy. Gateway has noticed of this billing error and has not responded. This issue pertains to my Secondary Home Improvement Loan - originated and serviced by Gateway Mortgage - a division of Gateway First Bank. This morning ( XX/XX/2023 ) I talked with a Gateway Mortgage representative named XXXX. He was about the least helpful associate I've dealt with in decades of working with Banks and Mortgage Lenders. My question surrounded why Gateway mortgage has been incorrectly applying the extra payment I started sending to them since last XXXX. Basically, they've been taking the extra payment and applying it ahead in a way that ensures they are receiving their interest payment. He told me that I did not need to make a payment until next XXXX!! Every other bank in the world takes that overage and applies it to the Principle- on the month it's paid. I am asking the CFBP to look at this suspect practice as it clearly violates Truth in Lending laws ( and I'm sure several other laws aimed at mitigating deceptive practices by large banks ). Moreover, XXXX said that he'd " submit a ticket and some supervisor would call me back in 24-48 hours ''. When I asked him for the ticket number for confirmation he said he couldn't give it to me. Beware of this company!! They do NOT keep customer service in mind and their practices are clearly something the CFPB should investigate. At this point, Gateway Mortgage has applied over {$600.00} to their own interest vs. buying down the principle of the loan. Again, this is a very deceptive practice and one that should be punished.

I was not informed of an increase in my monthly payments on my mortgage. I was notified by mail on XX/XX/2023 of a shortage and late payment. We have paid through my credit union bill pay with no negative history. Our monthly payment was sent to a different file due it not being a complete payment. I contacted them on XX/XX/XXXX ( Monday since they are closed on weekends ), and they advised that as long as the payment is sent in and " Date time stamped '' by the end of the month we would not be in default. They advised it would take several days to process but as long as that it is sent by the end of the month there would be no issues. I paid the balance through bill pay with my Credit Union on XX/XX/XXXX. They received it and sent it ( according to their records ) on XXXX XXXX. It was not processed until XX/XX/2023. I have contacted Gateway Morgage multiple times and they have refused to acknowledge their error. Even when they listened to the recording where we were specifically given the stated information, they still refused to fix the issue. My last conversation with a supervisor she acknowledged that we were given improper information by their representative, but she still refused to provide any assistance. My wife 's and my credit rating both dropped significantly due to the incorrect information that their representative gave us. Furthermore, they have absolutely refused to assist us in any way. Our credit rating has been excellent with no issues in the past.

Earlier this year, Gateway Mortgage accepted and deposited my XXXX mortgage payment on XX/XX/XXXX ( XX/XX/XXXX ). They then reported that payment ( which was already withdrawn from my account by them ) as late because the escrow amount had gone up by {$67.00} between my XXXX statement and my XXXX statement. When I discovered the discrepancy, I immediately paid the remaining {$67.00}. That was on XX/XX/XXXX, only 28 days after my XXXX mortgage payment was due. Gateway Mortgage has marked my payment history with a " 30 days overdue '' remark, which is incorrect, because XXXX only has 28 days. However, they insist on reporting my payment as late because they follow a policy of payments being late because of the month, not the actual number of days ( XX/XX/XXXX, XXXX XXXX, XXXX ). My payment was not 30 days overdue and my credit report has an error on it due to how Gateway Mortgage chooses to report. I can provide documents from my bank and from Gateway Mortgage which show my timely payments. The property in question is : XXXX XXXX XXXX, XXXX, PA XXXX. I would like the late payment notification on my credit report to be removed immediately, as this is a dishonest and inaccurate portrayal of my payment history with Gateway Mortgage and is adversely affecting my credit score. I had some issues with my online account with XXXX Mortgage. I had been in contact with them regarding these issues and my issues with my payments not being processed correctly. The issue started in XXXX XXXX was resolved in XXXX of XXXX . I had my credit report pulled in XXXX and was unaware that Gateway had reported three ( XXXX XXXX , XXXX XXXX , XXXX XXXX ) 30 day late mortgage payments on my account. I had been in contact with them about these payments and even had the late fees removed after speaking to someone about the issues. I contacted multiple people at gateway trying to get these removed off my credit report do to the issues that I was having and the fact that I have never had a late payment on my credit report in the last 8 years. The were unwilling to work with me in my situation. After writing a good faith lette r ( which I have included ) to the CEO, I asked for them to removed ju st the late payment from XXXX XXXX off my credit report and I was told that they were unable to do this and that I would need to file a dispute with the credit bureaus. They advised me that they would be willing to work with me this way. I filed with all XXXX credit bureaus and they did not do what they said they were going to do on my credit report. I am very upset with he lack of customer service provided by Gateway Mortgage and their inability to work with their customers.

Last XXXX my wife, XXXX and I ( XXXX ) received the document from the Gateway mortgage of XXXX, Texas for the first time for what reasons, we did not know. Then some- time later her second elder son, XXXX said that the Gateway mortgage agency wanted to know all about his parents and their finances without our knowledge and our per-mission. They argued that it was just information in the Gateway Mortgage wanted to know. Why? What's more, they had said nothing about the co-signers - that's - XXXX may have expected us to get involved in their affairs as I had suspected at first. So many months had passed until last Monday the Gateway mortgage mailed the documents in which they expected us to be co-signers. Such documents ( some of them that I did not understand, and I did frankly tell XXXX that I was not sure of what I did not understand. But XXXX used his forceful request for us to sign so quickly and mail them to the Gateway Mortgage before the coming Friday. We are retired, and XXXX is XXXX XXXX XXXX and I am XXXX XXXX XXXX. What's more, we are XXXX since birth. Your website said : " You do not have to sign such document, as mortgage if you do not understand. '' That is a relief for us. I need your help on this case. Gateway Mortgage sold our loan to XXXX XXXX on XX/XX/2023. They failed to report this correctly to both XXXX and XXXX. Both credit bureaus are showing twice the amount owned on the same house due to Gateway continuing to falsely and illegal report our mortgage with them as open instead of closed. Our reports still show our Gateway mortgage as open with a current amount of {$270000.00} and with XXXX XXXX with a current amount of {$270000.00}. This shows future creditors that we have an open balance of {$540000.00} and two mortgages which is false. A dispute was opened with XXXX on XX/XX/2023 and the letter from Gateway showing the sale of the loan was provided. On XX/XX/XXXX, Gateway knowingly, illegal, and falsely told XXXX that their loan with us was still open. XXXX denied the dispute and kept the information on our credit reports due to Gateway reporting all the information as accurate - open account. Additional information was provided such as the letter Gateway sent to our insurance company asking to be removed from our policy and they are no longer our lender. Gateway knowingly, illegal, and falsely told XXXX again on XX/XX/2023 that our loan with them is still open and all the information on are report is current. On XXXX XXXX, I spoke with the loss mitigation specialist XXXX regarding issue with my credit reporting. I told XXXX that Gateway was putting on my credit report that I had a Balloon on my Mortgage and the information was incorrect. I let XXXX know that My payments was deferred from Covid and the remark should be a deferment not a balloon if anything. XXXX let me know that a Balloon is kinda like a deferment and that is why it's on there. I begin to tell XXXX that this is false information because I do not have a balloon and you should not put something on someone credit report if that is not what it is and that is false information. She then let me know that this is the company 's policy. When I ask to speak to a supervisor she would not let me speak to her supervisor and told me she would put in a ticket for one to call me back because her department does not handle credit. A supervisor has still not call me back at this time to try to fix this issue. I have attached the deferment showing that this is not a balloon. Also Gateway should have report payments from XX/XX/XXXX - XX/XX/XXXX reflecting timely payments through forbearance which they did not report. page 5 of the forbearance agreement state that credit report will have this reflected and this was not done as well because there is no data reflecting for those months.

This is regarding XXXX, XXXX, XX/XX/2021. I have paid my mortgage payment every month in a timely manner. My monthly payment went up by {$60.00} due to increase in homeowners insurance. When I found out my homeowners insurance went up, I changed companies. I have a copy of all my payments made on time. They're actually paid automatically through a bi-weekly payment program that I have enrolled in to pay my mortgage off early. The mortgage company applied my payments to principal instead of my monthly note and reported me to the credit bureau for being 30 days late. If they had put my payment in unapplied funds like they've done previously, the next payment would have corrected the shortage within the 30 day grace period. My payments were made. If they had not applied the payment towards principal, I wouldn't be in this situation. All I'm asking the company to do is apply the payments made like I have requested, the problem of resolve itself. The supervisor that I spoke with confirmed herself that I have made my payments in a timely manner. The problem is they wanted me to make an additional payment, which I eventually did just until the problem could be fixed on their end. We are part of the devastation that hit Louisiana in the flood of XX/XX/2016. Our house received 56 inches of water. We have requested a second draw from Gateway Mortgage Group and they had and inspector come out and saiy that we are at 1 % repair. Gateway says they can not release anymore money until we are at 50 % complete. The money they sent us, {$25000.00}, was used to buy materials : demo supplies and tools, windows, insulation, electrical materials, sheet rock and finishing supplies, primer and paint, flooring, and hire contractors to complete repairs on plumbing, electrical, insulation, sheetrock, painters, window hangers. Luckily I am able to do flooring and a few other repairs to save money. I have exhausted all of my financial resources trying to recover the loss of 5 vehicles, and over 50,000 dollars of household contents where we only received XXXX for that. My wife and XXXX teenage children have lived in one room and a shell of a house for 4 months. We are now fighting to repair our home with 30 % of the repair money and not able to get the anymore until we are at 50 % complete. Do the math : We are in financial ruin. Gateway mortgage left out taxes on my monthly payment to qualify me for a loan. This is the second time they have done this to me. I bought a home with them in XXXX and they left out school taxes and mudd taxes. I only found out months later after receiving notices my payment was going up and I was required to back pay. I recently bought a new home in XX/XX/XXXX and they did it again. I thought the first time was an accident but then it happened again. My new mortgage payment is now more than I am able to afford and I am being back charged for the amount they left out in closing. I would have not agreed to the mortgage if I had known the actual payment amount. This I believe was manipulation of my ability to pay to force qualify the loan. According to my monthly statements, if a make my payment on or before XX/XX/19 then a late charge would not be accessed to my account. I made my payment on XX/XX/19 at XXXX and I received a receipt stating my payment was accepted by XXXX XXXX XXXX. Because the company had close they posted the payment on XX/XX/19 and charge my account a late fee. When I call the company stating that the payment was made on XX/XX/19 and I have a receipt to show my payment was submitted on the date a late charge would not be assess. Gateway Mortgage is the loan servicer on my loan, but they have made a complete mess of my mortgage and will not rectify their accounting errors. They claim that I am 13 payments past due, but I am not late a single day on my mortgage. I have never been in financial trouble or have I had any money issues since I purchase my home and have made every mortgage payment on time. I was hopeful that they could quickly fix the problem, but it appears that their Accounting Department can not get this corrected and now my loan is in foreclosure. I make plenty of money as my mortgage payment is only about 15 % of my gross income. My job is extremely stable and I have been there for about five years. My mortgage payment is around {$480.00} per months and I send them money orders every month. I can provide proof of payments if need, but they should be able to fix this on their own. I found fraud in the so called loan process i.e. servicing, and originating the credit. Notice was enacted of the violations on commercial law and common law. The mortgage servicer 's fraudulent activity has voided the contract and nullified the contractual obligation of the payee. I revoked the power of attorney and instructed the company to forward the chattel papers to the updated trustee. They refused to comply with my demand. Now, they are processing an illegal foreclosure of my personal property, which is not lawful because they sold their security interest when they transferred/ assigned my promissory note to an investor that is trading my " instrument/ note '' on the open market. All of this is not legal because in Alabama, all transfers/ assigns are to be filed with the county recorder 's office. The mortgage servicer, once mortgage lender, have no lien on my property, which makes the frivolous foreclosure process an illegal procedure. They committed securities and wire fraud by sending me a forged document ( a copy of the single indorsed security instrument ) via email communication. First of all, I want to say thank you for approving my COVID forbearance during the pandemic as it was a time of a lot of uncertainty and overall a very difficult time for me financially. I am writing to request your help as I recently learned I have several rolling 30 day lates on my mortgage which started back in XX/XX/XXXX then ended when my forbearance was approved in XX/XX/XXXX. I recently called and spoke to a representative named XXXX who helped me understand that I missed my XX/XX/XXXX payment then all of my future payments were posted for the previous month. This is unfortunate as I had no understanding of the missed payment issue and would have doubled up to get it addressed right away. I strongly feel most of the rolling 30 day lates are inaccurate because when I made my payments on your portal each month I was making them within the 30 day window yet I was still getting reported as 30 days late most months. It is my understanding that as long as I made the payments within the 30-day time period I wouldn't have been a full 31+ days past due which is what is required to report me as 30 days late.

Gateway Mortgage, a division of Gateway First Bank, XXXX XXXX, sent me confirmation of my loan being paid off and a lien release issued in XXXX of XXXX. Reporting to credit bureaus of no activity since then. As of today Gateway mortgage is wrongfully reporting my acct now showing a Past due status as of XXXX of XXXX and now showing a balance of {$560.00}. They have somehow added a balance back on to the mortgage, that was paid off, and then retro-actively hit me with late reports all the way back to XX/XX/XXXX. This is a huge error on their part and needs to be resolved immediately. I was notified by all my credit monitoring today of this error. On the XX/XX/2019, I paid my mortgage payment of {$1600.00}. This was to XXXX XXXX XXXX. I also signed paperwork stating that I wanted my taxes reimbursed once my tax exemption was finalized. I was approved and opened a new checking account from Gateway First Bank on XX/XX/23. There is a promotion for {$250.00} for the checking account once you meet certain requirements. While trying to complete the process to meet the bonus requirements I first successfully transferred {$270.00} to open the account and the amount posted to my Gateway First Bank Checking account. On XX/XX/23 I checked my account on the app and online and saw that my account was no longer there and there was not notification or message from the bank of what happened. This bank approved me to open the account with a {$250.00} bonus attached and then closed my account with no notification and received all my personal information and still have my initial deposit of {$270.00} not stating what will happen to that. On XX/XX/2016 Gateway Mortgage sent an escrow disbursement to my homeowners insurance company. On XX/XX/2016 thee check was returned by the bank which meant my homeowners insurance was n't paid. I got a notice from the insurance company about this which said the payment was due on XX/XX/2016 and they never received a payment. I got in touch with the mortgage rep who emailed the escrow dept and I guess they sent another check by regular mail which means the insurance had not gotten it on XX/XX/2016. Nobody ever offered any kind of explanation for what happened. If my insurance agent had not called them we would have never know they even mailed another check late. I had more than enough money in my account to cover the check. I think they owe me some answers for this, for which they refuse to give. They wo n't even say I 'm sorry. My payment went up due to my tax bill increasing. That is fine and I am willing to pay what I owe. Gateway additionally raised my payment by {$96.00} due to " shortage '' which is actually not a shortage but a reserve cushion. Although RESPA allows the mortgage company to collect a cushion, it is not a requirement per FHA, XXXX or XXXX so it is up to the mortgage company. I can not afford to give Gateway an additional ~ {$1200.00} this year just to sit in the escrow account and never be put to use. I emailed them and asked them to waive the requirement and they never responded. I left this " shortage '' off of my XXXX 2017 payment and now they are refusing to apply any of the payment until they receive it, threatening me with additional late charges and fees if I do not pay it. I applied for re-financing with my current mortgage company at my current residence back on XX/XX/2020. It has been one delay or surprise after the other and often I am the one doing ALL the follow up. Delays include documents going into someones spam ( or so they claim ), them trying to push the responsibility of finding HOA documents on me, delayed and/or inconclusive responses to my email inquiries and also big surprise half way through the process that my mortgage is being sold before I close. I am writing to complain about a denial of account opening without proper explanation. At the end of XXXX, I tried to open a checking account online with Gateway. I asked if I would be able to refinance my FHA mortgage with Gateway Mortgage Group LLC. Im currently on forbearance and they stated they would not refinance my mortgage as part of their rules. I asked for a letter stating guidelines while on forbearance first they stated they will not send any letter, and also stated, we will mail it to you. My mortgage company does not have proper documentation of my previous mortgage, and the Termination Statement according to UCC 9-513 was never recorded in my county 's registars office. I refinanced with the same lender and now the old mortgage doument has vanished. Then my security on the Note was sold, without notifing me, nor filed according to the regulation. My current mortgage is insured with a title insurance company, with makes the selling of the Security Insurment invalid. My bill was due on XX/XX/XXXX. I paid my bill on XX/XX/XXXX. I understand I did pay my bill late, however, since there are only 28 days in XXXX I was not 30+ days late by paying on XX/XX/XXXX. This did not stop XXXX XXXX from tagging my credit bureau with a 30 day late derogatory mark though. Gateway mortgage company was the servicer of a mortgage I obtained in 2016. Last year, during XXXX, I was told that my mortgage was in forbearance. However, I still made every payment on time. Gateway sold my mortgage to a different mortgage company. When the interest rates dropped really low this past year I attempted to do a refinance. At this time I found out that my credit report was showing XXXX late payments when my mortgage was with Gateway. I have reached out several times to Gateway to have this corrected with no success. They are holding money I paid to them for annual insurance and county property taxes. To allow me to pay these annual charges myself they are requiring I pay nearly {$500.00} to stop prepaying these insurance and tax amounts. I have reviewed all the closing documents at the time of the loan initiation and can find no mention of this excessive fee. This predatory practice by a large corporation has no basis or merit for such an excessive charge other than to dissuade the consumer from taking these funds from Gateway and keeping them in their own bank account!

My loan was sold to a new mortgage services company, XXXX XXXX XXXX, and I was never notified by my existing mortgage service, Gateway Mortgage Group. it is my understanding they are required by law to notify me within 30 days of my loan being sold. I am being notified every month even when forbearance was issued and my statement explains how many days late I am as well as Im being charge a late fee every month I dont pay. Now my statement tells me Im currently in loss mitigation and soon will be in foreclosure. Im still being charged late fees every month. We have attempted multiple times to talk to our Mortgage Loan Provider with the given Covid-19 situation to re-finance without fruition. They do not seem to want to assist us. Back in XX/XX/2021, I was late paying my mortgage payment. I tried via phone and through the website to pay. The phone system said the payment had gone through though it had not. Trying to pay online was also extremely difficult and convoluted. After I had finally made the payment, it was late and reported to the credit bureau as delinquent even though I had attempted repeatedly to make the payment. Today I received a call for the collection department for the XXXX payment and I told the collection representative that I had till the XXXX before the payment was late. I received a letter from Gateway, the title of the letter states Escrow Checks. There was over a {$900.00} surplus as of XX/XX/XXXX ; however, Gateway mortgage never sent me the escrow surplus check. It was sneaky how they titled the electronic escrow letter as Eacrow check but did not send to me. Rather, they transferred my account to a new serviced and said I have to speak with the new serviced about the escrow surplus check.
