When I received my pay check on XX/XX/XXXX there was a garnishment so I called my payroll department to find out where it came from and how much it was for and the only information they could provide me with was to contact the general session court and provided me with a phone number to call. I called and was told it was from XX/XX/XXXX and was told I could contact XXXX so I called XXXX and the rep stated she could not help me and I needed to contact Garner and Conner so I called Garner and Conner and spoke with someone name XXXX and I asked her what this was pertaining to and at first she stated it was XXXX and XXXX and XXXX and that there was several things on there and I told her there was no way that XXXX and XXXX could be on there as I currently have XXXX and my vehicle is paid for that was financed through XXXX and she then asked if she place me on hold while she researched the account and then she stated it was for XXXX/XXXX. I asked her what was the original amount of this so called loan/credit card as I have never taken out a loan with this bank and said she did not know what the original amount was but stated they received a judgement in the amount of {$12000.00} back in XX/XX/XXXX. She went on to tell me that they had re-filled the garnishment 6 months later as they had not received a payment but stated that they received a garnishment in the amount of {$87.00} on XX/XX/XXXX, she stated that I made two {$50.00} payments via money orders in XX/XX/XXXX and that I had paid a total of {$3200.00} and I asked her how could that be if I only made 2 {$50.00} payments plus the one garnishment for {$87.00} plus the one the just took for {$330.00} clearly that does n't equal out to be {$3200.00}. XXXX stated that I had faxed them a copy of my pay stub and car payment and a medical bill as well as my cable bill back in XX/XX/XXXX and had agreed to pay {$50.00} a month. I think that something needs to be done about all of these debt collection agency 's that go around buying up old debts and harassing consumers over time barred debts and on top of it can not even provide you with the original amount needless to say I thought you can not be sued on a time barred debt. Something needs to be done to protect the consumer especially when they go in and obtain a garnishment on a time barred debt. I would like my money returned and the garnishment STOPPED!! Otherwise I will have to seek the advise of an attorney.

On XX/XX/XXXX, I reached out to the attorneys office, Garner and Conner in Tennessee representing creditor XXXX XXXX to follow up with them regarding a payment arrangement for a balance of {$15000.00} that I had from a voluntary repossession. When I spoke to the Legal Assistant, XXXX XXXX, she informed me that I now have a default judgment as of XXXX of XXXX which now made the balance {$25000.00} accumulating interest daily. I was totally unaware about a default judgment because I never received any correspondence regarding it because of course, I was trying to work something out with them before the new alleged court date ( original court date set for XX/XX/XXXX ). I had been in contact with this office since XX/XX/XXXX to set up a payment arrangement initially dealing with a legal assistant who no longer works there. When I filed a complaint around that time, they responded by saying they had reset my court date to give me more time to arrange a payment plan. The court date was never reset, and this was also confirmed by the Nashville XXXX XXXX court. XXXX XXXX sent me a letter stating that if an acceptable arrangement isnt worked out, the matter would be pursued in Nevada where I currently reside as of XXXX, and I hadnt heard anything else since. After speaking with XXXX, she informed me that my case would be handed off to another legal assistant, XXXX XXXX. XXXX XXXX requested my last two check stubs and my monthly expenses which I provided on XX/XX/XXXX and offered 20 % of the balance, so Im not understanding what is taking so long to decide if they would accept my offer for a settlement. We literally just went through a pandemic, and people are trying to get back on their feet including me. I am trying to take care of this matter and get this mistake behind me, and I feel that they are stalling and I am getting the runaround. XXXX was supposed to check with her supervisor to find out what happened to the court date that was supposed to have been reset. The ball was dropped somewhere and this is not only affecting me, but the future of my XXXX son, as I am a single mother. Ive followed up with XXXX a couple of times regarding this, and she stated that her supervisor hadnt looked into it yet and it had been 2 weeks that passed. I called today because another 2 weeks has passed and still nothing!

I received several debt collection letters from the debt collector. The most recent one dated XX/XX/XXXX XXXX letter states that I owe a total of {$4900.00}. The credit card was opened without my consent I assume many years ago before XXXX possibly XXXX as I was a victim of identify theft during that time. The debt collection letter changes each time and I states four different amounts that I owe. {$4900.00}, {$3200.00}, {$390.00}, and {$2800.00} Which is quite concerning for me. I reached out to the original credit card company to get more information about the account and the account could not be found. I also provide my social security number and an account was not found. I responded to the creditor with a debt validation letter to validate their claim against me. The have never responded. My most recent letter was sent on XX/XX/XXXX. I continue to receive letters pertaining the amount only. They will not validate the debt or any information. The credit card number is non-valid, fraudulent or the debt collector does not have correct information and therefore will not respond to my letters with proof. I understand that Failing to respond to a Debt Validation Letter while continuing to collect on the debt is a direct violation of the FDCPA and I like to report them.

The original debt was owed to XXXX, who obtained a judgment against me. I paid them in full. A third party collector contacted me several years later, stating they would garnish my wages or levy my bank account if I did not pay. I told them the debt was paid in full, and provided proof. They stated the proof was not good enough. I have transcripts of internet conversations with XXXX that shows I have a zero balance and they state that they did not send this account to collections. The more information I provide to the law firm collecting my debt, the more they say the proof is not enough. To prevent them from garnishing my wages or levying my account, I have paid them for several years on a debt they know is not valid. They will not give my money back, and will not contact my attorney as she requested. As of right now, they have approximately {$1000.00} of my money that is not owed to them. I have been fearful of stopping payments because when I do, I receive letters detailing that they will take all legal action against me. I have a young daughter at home to provide for, and I can not survive if they levy my account. I feel as though I 'm being extorted to pay a debt that has already been paid, almost twice now.

Garner and Conner purchased this debt from the apartment agency I used to rent from. In email communication to me, their representative said that he would have to negotiate with former landlord on my behalf about the amount I would have to pay. He was lying, because my credit record shows the debt was paid off to the apartment company when Garner and Conner purchased the debt. They got an agreement with me on false pretenses. Then, my father was killed suddenly while I was negotiating with Garner and Conner. I did fall behind a little in the initial down payment but I am more than caught up at this time, even ahead of the agreement. Without any mail or email or call, I got a summons to court for XXXX XXXX. It is true that I agreed I could be sued if I did n't pay on time but they gave me no warning at all that a summons was in the works.

My wife and I was trying to buy a home and pay off anything that stood out on my credit report. I had a judgement against me that was garnished from my check for a year paid every week out of my paycheck. This garnishment was over according to the contract and the attorneys office that filed the claim against me informed me that I still owed XXXX. We was trying to close on our home in XXXX of 2015. They would not answer or return any ones phone calls or emails, letting that amount gain interest. After several emails and phone calls over the next few months we finally got a hold of these people to get the amount. It ended up being somewhere around XXXX since XXXX. They have withheld my own documentation from me for prolonged periods of time causing A LOT more money to be paid out than what was needed. These people are criminals.

Garner & Conner PLLC Attorneys At Law ( they do not advertise as a debt collector ) located at XXXX XXXX XXXX XXXX XXXX XXXX XXXX Tennessee XXXX. Phone number XXXX https : //www.garnerconner.com/ My Last communication was in XX/XX/XXXX and since that time have garnished my checking account as of XX/XX/XXXX and left me with no money to pay my bills. I called the number my bank provided me and had to leave a message but got no return call. Around the time of the last communication I hired an attorney to have the matter dismissed " with prejudice ''. This attempt to collect an old debt that has been charged off should be made illegal. Particularly that they can have the matter " legally '' bound by court that they can wipe out your entire bank account so that you can not pay your bills. I have all my documentation for this issue.

I have been working with Garner and Conner since 2010 regarding a collection account and they continue to change the amount owed and are charging a 10 % daily fee. I called today and was given an amount and then they sent an email with another amount. Which is the way this collection continues to go. The original debt has been paid and they have charged more than 50 % of that debt in interest.
