The company known as GABA Law Corporation wherein XXXX XXXX, XXXX attorney and owner, along with his associate XXXX XXXX violated my FDCPA Rights. Under the FDCPA, I have the right to dispute the deb and the ( 1 ) Right to notice of the debt ( 2 ) Right to Contest the debt ( 3 ) Right to verify the debt. In XX/XX/2012, XXXX XXXX contacted me by telephone and out of nowhere indicated that he was contacting me to collect a debt on behalf of XXXX dba XXXX XXXX XXXX. He indicated I was being sued and judgment was being obtained against me. According to the FDCPA I have the Right To Notice of Debt within 5-days of XXXX XXXX and GABA Law Corp. contacting me. Where GABA Law Corp. must send me a letter telling me ( 1 ) the amount of the debt ( 2 ) name of the creditor ( 3 ) information about what I can do if I think there has been a mistake or if I don't actually owe the money. I never received a letter of notice from GABA Law within 5-days indicating the amount of the debt or any information about what i can do if I think there has been a mistake and I don't actually owe the money. i explained that day to XXXX XXXX that I did not owe the debt and referred him to the membership agreement that I signed specifically page 2, paragraph 4, that reads : It is further understood and agreed that I may resign my Membership from the Club at any time by giving at least 30 days advance. Per FDCPA If I do not owe the debt I should be allowed to dispute the debt, the debt collector can not report it to a credit reporting agency unless and until it verifies the debt. GABA Law Corp. reported the debt before they received my dispute letter and they never gave me an opportunity to provide them my dispute letter. By not giving me the opportunity to provide them a dispute letter GABA Law violated my Rights. If I would have been allowed to provide my dispute letter GABA Law must notify the credit reporting agencies that the debt is disputed, instead they reported a Collection to the credit reporting agencies, and obtained a Judgment without properly serving me with a summons I never have been served by GABA Law yet GABA Law again mislead the court to believe that I had been served and simply didn't show up to court implying the " no show '' was an admission of guilt GABA Law has violated the FDCPA and the Fair Credit Reporting Act by reporting a debt that it knows, or should know, to be false. GABA Law in association with XXXX dba XXXX XXXX XXXX are reporting incorrect information and their incorrect reporting appears in Background Investigations for employment opportunities and continues to result in Adverse Action Notice that has impacted my ability to receive employment opportunities and creating financial hardship. This is a careless, malicious, tactic that should be retracted and removed from my record. The truth is, I became a member of the XXXX XXXX XXXX for less than one year. Using simple math at a rate of {$520.00} per month x 12 months would only equal {$6300.00} You ( GABA Law ) and the creditor are reporting {$19000.00}. In XX/XX/2012 I suffered a serious injury to my XXXX and was diagnosed with a XXXX XXXX XXXX of my XXXX XXXX. This can be verified through my medical records. Under the care of my physician XXXX XXXX, XXXX. of XXXX XXXX XXXX I was unable to participate in any type of physical activity. At that point I notified XXXX XXXX XXXX and spoke with the accounting department who took my information and said they would report my incident and contact me if they needed further information. I also submitted a written letter notifying them of the same. The Agreement I signed with XXXX ( enclosed ) clearly states It is further understood and agreed that I may resign my Membership from the Club at any time by giving at least 30 days advance. Now considering I gave XXXX dba XXXX XXXX XXXX a 45+ day notice and spoke directly to the Accounting Department and followed my verbal conversation with a written notice, I also provided them the name and phone number of the XXXX XXXX XXXX at XXXX XXXX XXXX in XXXX XXXX , California .

Gaba Law Corporation XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, CA XXXX XXXX XXXX, a debt collection lawyer, filed a law suit in XXXX Superior Court demanding payment of {$2600.00} for a debt that was not owed. Action was filed on XXXX XXXX, more than 4 years after I made the final payment to the creditor in XX/XX/XXXX. XXXX 's suit is barred by the CA stat. of limitations. I have a written receipt from the creditor for the entire final amount due. XXXX XXXX, the debt collector and his erstwhile creditor never made even a single demand for payment of this fake amount during the entire 4 years, because I didn't owe anything. The XXXX XXXX debt collection law firm specializes in this type of coercive, fraudulent use of lawsuits to collect court-imposed penalties against innocent consumers. For example, in series of car repossession deficiency cases, XXXX XXXX filed collection lawsuits, falsely claiming that the amounts were owed for '' credit card '' debts to avoid the deficiency notice required under the CA Auto Sales Finance Act. However, in a XXXX federal consumer class action in U.S Dist CT N.D. CA ( XXXX XXXX ) XXXX XXXX XXXX, Case No XXXX, Consumers were awarded {$380000.00}, costs and attorneys fees against him and his client, in addition to the amount awarded to compensate members of the class. His method of collection is to file lawsuits against consumers for relatively small amounts, wait for the consumer to default. Then, he moves in to collect attorneys fees based on predictable defaults from courts that are unaware of his method of collection. If you are sued by this debt collection law firm in California, Beware!

I currently have XXXX private student loans which were sold to debt collection agencies. The first loan has sent me an invoice with what I owe, total interest, a breakdown of monthly payments due, and when my loan will be paid off. The second loan is with an unregulated debt collection office called Gaba Law Corporation. The only actual lawyer there is the owner and the XXXX people I have dealt with are not lawyers. When I ask them for info on what interest will be charged and how much interest I have paid up to date, they do not give me straight answers. The person who handles my file is very short with me and instead of giving clear info like how much interest I paid for the month or by when my loan will be paid off, he sends me short, irritated emails with vague information. In XXXX my balance was {$7200.00} and I have since paid {$470.00}. My balance is now {$7000.00}. Only 40 % of my money went to principal. My other debt has charged me 10 % for the total amount owed annually, so it 's a set amount for the year and I make monthly payments which lowers the principal substantially. Gaga Law Corp. charges this 10 % interest per day, and changes the amount every single day so I can never keep up with what I have paid and what I owe. As far as i 'm concerned with what I can afford to pay them I 'll be paying them for countless years considering the amount of interest I am being charged. I have emails proving all of this information above showing the vague, unhelpful, rude emails they send me when I ask for simple information.

In XXXX 2011 I had an accident while using a rental car from XXXX corporation. I was assessed a charge for that accident and paid in full in XXXX 2011 using a credit card. I have both the receipt for the payment from XXXX and the credit card statement showing the payment to XXXX. I also have the credit card statement the following month showing my payment of the bill from the credit card company. XXXX somehow did not correctly record the payment and after attempts to get me to pay the bill again and trying to recharge my credit card, sold the collection to a collection agency, XXXX and XXXX. XXXX and XXXX contacted me and I provided my proof of payment. XXXX year later I was contacted by a legal firm, Gaba Law threatening collection action. I again provided full proof of payment of the outstanding original bill. Now almost two years later Gaba has filed in the local, XXXX CA, superior court a lawsuit for collection of debt. I have tried to work with each of these corporations and provided them with proof of payment with no success. At this point I need to engage legal support in order to demonstrate and counter this frivolous lawsuit. Gaba has also filed a credit default with the credit agencies which is false. As Gaba indicates that any complaint should be filed with the FTC, the FTC directed me to the CFPB. Thank you.

XXXX ( as XXXX ) is committing fraud on behalf of Gaba Law Corporation in their serving process. According to their clients, I was served In XXXX 2014 with a lawsuits from XXXX by a person named " XXXX XXXX '' Upon calling and searching for a way to contact XXXX ( as XXXX ), I have asked for the full name of this person who supposedly served me which leads to a circle of the attorney and XXXX ( as XXXX XXXX ) telling me to call the other party about the server 's full name. I am at my wits end with this matter, due to the fraudulent service of this company 's employee leading to a default Judgement against in a that I was n't able to defend myself from. The fraudulent service in question was a substitute service given to a " XXXX XXXX '' who does not exist. The company 's name is listed on the documents, however they wo n't give me the person 's full name. Their client Gaba Law wo n't give me the person 's name and tells me to refer to the sheet, which is illegible. XXXX XXXX XXXX is acting fraudulently and should be found liable for violation of the FDCPA for falsifying information on legal documents in order to collect a judgement. Even the phone number that was listed on the legal documents was false.

I received a call this morning from an attorney 's office in regards to a debt they said they have made multiple attempts to contact me and I 've left several voicemails but I have not received any of those today was actually the first voicemail I received from them. Upon speaking to this individual identified myself my name but did not give any other information aside from my phone number and he did not attempt to verify that I was who I said I was and continued to give me information in regards to the debt. he said that he will be advising the party that sucker out their attorneys office if I do n't make attempt to payment. I felt very pressured to try and do something give you simply said that some is going to file a lawsuit against me if I do n't do something right at this very moment. Now this long offices out of state so I 'm not sure what their procedures are what the laws are in regards to being out of the council but I feel very harassed

In the XXXX my husband contacted XXXX XXXX collections in regards to an account that appears on our credit report. The company referred him to their legal department ( Gaba Law ) stating they are only the ones that control this account.My husband spent two days attempting to contact Gaba Law. He was eventually able to get a hold of someone via email. The company refused to settled and stated that the judgment amount was XXXX as of XX/XX/21. We do not have a Judgment on us at this time or any previous time. The wording used in the email defining this as a judgment was misrepresentation. I contacted the company on XX/XX/21 offering a settlement via email. They again refused to settle out .I requested validation of the debt. In return I received a copy of a lease and a letter stating the account and that as of XX/XX/21 the debt is XXXX. The company misrepresented the amount owed and the fact that there was a judgment against us.
