RE : Attentively review my formal writ composed declaration of not proven complaint misinformation that is all or in part : deficient of the adequate current status in the fullness of TRUTH, ACCURACY, COMPLETENESS, TIMELINESS, documented OWNERSHIP, certifiable RESPONSIBILITY, or otherwise irrefutable, complaint obligatory, and regulatory requisite reporting thereby mandating your immediate actions to rectify and remedy and any infractions behavior ( s ) by retaining or returning to demonstrate TRUE, CORRECT, COMPLETE, and COMPLAINT XXXX XXXX data field formatted reporting!!! I am a victim of identity- theft, I am writing to request that you block all accounts disputed as fraudulent on my credit reports with XXXX XXXX XXXX XXXX and XXXX. This information does not relate to any transactions I have made. I did not give anyone authorization or consent to use my personal information. I hereby exercise my legal rights enacted by Congress and The Federal Trade Commission, which explicitly states when a victim of identity-theft dispute a fraudulent account on his/her credit report it shall be honored by all credit bureaus and all fraudulent information should be blocked within 4 days and proper notification shall be given to all data furnishers pursuant to section 605b of The Federal Fair Credit Reporting Act. Failure to comply shall lead to complaints being filed with The XXXX XXXX XXXX Consumer Financial Protection Bureau, and Attorney General stating your companys unlawful collection practices, misrepresentation of creditworthiness, defamation of character, and noncompliance to abide by laws enacted by Congress to protect victims of identity-theft who's credit been impacted by acts of fraud. Because I know my rights under THE FAIR CREDIT REPORTING ACT, CONSUMER CREDIT PROTECTION ACT ( CCPA ), and FAIR and ACCURATE CREDIT TRANSACTION ACT of 2003 ( FACTA ). I will be taking action. I also know my rights under this paragraph of Section 312 of the FACTA LAW : SEC.312. Procedures to enhance the accuracy and integrity of information furnished to consumer reporting agencies. ( b ) duty of furnishers to provide accurate information. -- Section 623 ( a ) ( 1 ) of THE FAIR CREDIT REPORTING ACT ( 15 U.S.C . 1681s-2 ( a ) ( 1 ) is amended ( 1 ) in subparagraph ( A ), by striking " knows or consciously avoids knowing the information is inaccurate '' and inserting " knows or has reasonable cause to believe that the information is inaccurate '', and ( 2 ) by adding at the end of the following : ( D ) DEFINITION -- For purposes of subparagraph ( A ), the term 'reasonable cause to believe that the information is inaccurate ' means having specific knowledge, other than solely allegations by the consumer, that would cause a reasonable person to have substantial doubts about the accuracy of information. Policy states. According to the Fair Credit Reporting Act FCRA 611 ( 15 U.S.C 1681 ), Procedure In Case of Disputed Accuracy. ( a ) Reinvestigation ( 1 ) Reinvestigation ( a ) In general. Subject to Subsection ( f ), if the completeness or accuracy of any item of information contained in a consumers file at a consumer agency is disputed by the consumer and the consumer notifies the agency directly, or indirectly through a reseller, of such dispute, free of charge, conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate and record the current status of the disputed information, or delete the item from the file in accordance with paragraph ( XXXX ), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer or reseller. Therefore, my position is being clearly stated, these accounts do not belong to me, meaning that you are reporting inaccurate account information within my credit file. The fact that these are inaccurate account information means that you, this credit-reporting agency, are reporting incorrect accounts. XXXX. XXXX XXXX XXXX {$1200.00} I am well aware of my rights as a consumer. The Fair Credit Reporting Act requires that you, the credit-reporting agency report accurate and/or correct account information within my credit file. My credit issues are very specific, these accounts and/or items do not belong to me. This means that you are reporting incorrect account information within my credit report. It is this in mind that I request that these listed accounts and items be Blocked and Deleted. According to the Fair Credit Reporting Act FCRA, Section 1681c ( 2 ) Block of information resulting from identity theft. 1.Block. Except as otherwise provided in this section, a consumer reporting shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from alleged identity theft, not later than four ( 4 ) business days after the date receipt by such agency of 1. Appropriate proof of identity of the consumer ; 2. A copy of an identity theft report 3. The identification of such information by the consumer ; and 4. A statement by the consumer that the information relating to the transaction by the consumer. I have provided all of the above listed four ( 4 ) items within this package. Therefore, I expect these listed accounts to be deleted and blocked within ( 4 ) business days. This is clearly an identity theft issue. I am also entitled to receive a free copy of my credit report, so I am requesting a free credit report and that all of these accounts, public records items, and inquiries be permanently blocked and deleted. I have a small new personal loan from Guarantee Loan Service ( XXXX XXXX XXXX, XXXX XXXX, TX XXXX ) ph # XXXX XXXX of {$400.00} that was due for it's first monthly payment of {$60.00} on XX/XX/XXXX. This company calls and uses text messages excessively and harasses their customers. During XX/XX/XXXX - XX/XX/XXXX ( 3 days were weekend and holidays ) I was called on my personal business cell phone a period of 5 times with 2 of those calls answered by me confirming I would be making a payment. I was left 3 voicemails, and additionally I was texted 3 times ( which I replied to 2 of them separately from the phone calls ). The company made contact with me 4 times within 4 business days ). I spoke to the Manager ( XXXX ) on ph # XXXX XXXX and made the minimum payment on XX/XX/XXXX when my account was 7 days past due. I informed XXXX not to call my cell phone any longer or text and instructed her company to cease and desist future calls to that number. XXXX said, she will not stop calling and demanded I pay the loan in full if I didn't like it. I informed XXXX that the cell phone they called is a personal business cell phone and that I do not want them calling there anymore because even when I answered and confirmed I would make the payment they still called and texted daily. I also informed XXXX that she could not simply demand payment in full and that I have a monthly contract and within the 10 day late fee grace period. I was asked to make a payment and provided my debit card info by phone. XXXX texted me harassing me again even after I paid my minimum payment due and wrote to me, " Then do not use a business phone for personal business Have a great day '' on XX/XX/XXXX @ XXXX CST. I had already paid my account current as of XXXX XXXX CST and ended my business call with them. On the phone call XX/XX/XXXX @ XXXX XXXX CST XXXX says they don't need to follow CFPB Regulations or acknowledge cease and desists. XXXX says they can call whoever and however many times they want and text. XXXX said that she is a collector and that's what she will do. This company knowingly harasses customers for payments by phone and text. Additionally, I did not receive a verbal confirmation of the amount of my payment made, date of payment, nor was I provided with a confirmation number for my debit payment by phone with XXXX. I do not believe they take payments over the phone in a manner that protects consumers or their information as required by regulatory guidelines. I would like this complaint logged and investigated. My personal loan went to collections. The collection agency ( Popular Finance Services ) has been harassing me for payment. I am XXXX and can not work or afford to send them any payments. The total amount they are attempting to collect is {$790.00}. Their harassing collection behaviors include : 1. Coming to my house repeatedly, even after I asked them to stop coming. When I ask them to leave they refuse. 2. They shout, they say hurtful and mean things to me. 3. They laugh at me. 4. They asked my son, who happened to be with me at the time, to pay the debt for me. They told him he was a bad son for not trying to help me with my bills. 5. They told my daughter over the phone that she needed to pay the debt for me. 6. They call me in excess of 3 times each day, but often they call from different numbers each time so I can not block them. 7. They frequently call me after XXXX. 8. They argue and badger me over the phone and in person, and do the same to my family, to pressure us to pay.

Re : Unauthorized Credit Inquiry While reviewing a recent copy of my [ XXXX ] cre dit report I noticed a credit inquiry by your company that I do not recall authorizing. I understand that you are allowed to put inquiries on my file, but only if I have given my authorization. Please have this inquiry removed from my credit file as soon as possible. I have sent this letter certified mail because I need your prompt response to this issue. I would greatly appreciate receiving a written response that you have had the unauthorized inquiry removed. XXXX Cease and Desist letter was mailed to Guarantee Loan Service informing I would not be able to continue payment due to a financial hardship. XXXX Guarantee Loan representative called my home requesting payment Early XXXX XXXX Guarantee Loan went to my neighbor 's house at XXXX XXXX XXXX XXXX XXXX XXXX TX XXXX to let her know I owed them money. They also requested she give them a call to let them know that I am at home. Since then, XXXX XXXX has been calling my neighbor repeatedly regarding MY debt.

I sent a cease and desist letter to Popular Financial several weeks ago and they continue to harass me and use threatening language. The letter was sent XXXX XXXX, 2016. When they call they state they do n't care about what the letter states and harass me over the telephone.
