I discussed with XXXX XXXX XXXX, a debt collector, from Freisem, Macon, Swann & Malone, LLP ( FMSM, LLP ) to have a settlement on my debt with XXXX XXXX XXXX. We had an agreement of {$4000.00} to settle my total amount of {$5400.00} and the attorney would help to dismiss the garnishment from XXXX Magistrate Court. However, Mr. XXXX did not inform me that he already received one of my paycheck ( amount {$460.00} ) from the Court and our agreement would include that amount. Therefore, the total amount paid was {$4400.00}, which is not our original agreement ( {$4000.00} ). I tried to contact Mr. XXXX to get the refund but the conversation did not end well, he refused my request.
I hereby filing this complaint to ask for assistance regarding this issue since I am currently struggling with a severe financial crisis, and such collection practice from the FMSM, LLP is unethical and unprofessional.
