I am filing a new claim because my original claim filed XX/XX/XXXX to try and stop the sale of my house on XX/XX/XXXX was responded to by the company Franklin Credit on XX/XX/XXXX and my claim, without any option to appeal was summarily rubber stamp closed. It is disheartening that an agency that is supposed to be for the consumer, didn't even take the time to read the response and that it did NOT answer the question of the claim. I am attaching the documents I prepared to appeal thier non-answer, taking much time away from trying to fight this, filing emergency XXXX to stop it, etc... only to find out I can only leave " feedback ''. Please see my response to original claim number XXXX. I have attached all the documents so you'll have context. I am in receipt of Franklin Credit Management Corporations ( Franklin Credit ) CFPB response to my initial claim filed on Wednesday, XX/XX/XXXX. I received notification of the response on Friday, XX/XX/XXXX. Although I appreciate the response submitted, however well-crafted, is filled with inaccuracies, half-truths and fails to answer the question of the claim filed. I will point out inaccuracies, as well as again, ask for an adequate response/action from Franklin Credit and appeal to the CFPB for sanctions against Franklin Credit and proper remedy given to me due to the continuously irresponsible and egregious actions by Franklin Credit . In the second paragraph, it is accurate that my late husband agreed to a HELOC through XXXX XXXX XXXX XXXX XXXX for a total line amount available of {$230000.00}. However, Franklin Credit states it was to refinance an existing mortgage loan, which is untrue, inaccuracy # 1. Has nothing to do with my CFPB complaint today. I confirm that he did file XXXX XXXX on XX/XX/XXXX while XXXX 2nd was with original issuer XXXX XXXX XXXX XXXX XXXX. As anyone who was involved in the housing market crash, this filing was not unusual given the circumstances, and done so legally. Has nothing to do with my CFPB complaint today. Per Franklin Credit on XXXX, XXXX, XXXX, XXXX XXXX XXXX XXXX XXXX went bankrupt and sold our loan for pennies on the dollar to Bosco Credit LLC. Thats when communication stopped and I never received a bill or any notices from this new lender I personally tried calling XXXX XXXX XXXX XXXX XXXX to find out where the loan was going, but the phone just rang. So we waited for notice, new statement and I do not remember ever seeing anything, never received a phone call. According to Franklin Credit, they began servicing the loan on behalf of Bosco Credit LLC on XX/XX/XXXX. I can not confirm nor deny this as we knew nothing, again were sent nothing about them taking it over or a new statement asking for payment. The dispute over how much of the line was used still remains in contention, as I can not clearly make sense of these statements and thus far Franklin Credit has not shown actual proof of funds dispersed, theyve relied solely on the modification agreement signed in XXXX in a very stressful time, so I wont address that here. Has nothing to do with my CFPB complaint today. In the fifth paragraph, I confirm that the XXXX XXXX XXXX was dismissed in XX/XX/XXXX. It is disingenuous to assert that XXXX XXXX did not contact Franklin Credit. Again, we didnt know Franklin Credit existed, so how could we contact Franklin Credit ? I can attest with certainty that Franklin Credit never contacted me at my number, and I was married to XXXX XXXX for 33 years prior to his death, and any phone message on his phone that had to do with financials, he would have 100 % told me, forwarded the message to me, write a note to me with all the information. None of that ever happened. I dont know if Franklin Credit called him or not- did anyone leave a message? The loan is in my husbands name and I was never notified of the debt. Again, this has nothing to do with my CFPB complaint today. On XX/XX/XXXX Franklin Credit filed a notice of default, the first I had heard from them, and acknowledge I received the notice. As Franklin states the amount was {$380000.00}. Again, didnt know who or how to find them and get in touch with them. And then when the pandemic grossly inflated home prices, here comes Franklin Credit marching along with all the XXXX 2nds coming for homes and families. Has nothing to do with my CFPB complaint today. I would also like to point out, in Franklin Credits ( Exhibit F ), which Ive attached pertinent pages noted as XXXX XXXX XXXX, on page XXXX under XXXX XXXX XXXX XXXX with ( or exception from ) Civil Code Section 2923.55 and Authorization of Agent ( For Notice of Default ), the reason marked is The provisions of Civil Code 2923.55 do not apply because X the loan is not secured by a first mortgage or first deed of trust that encumbers real property described in Civil Code Section 2924.15 ( a ). I am not an attorney, but I can read, and it would appear to me that their reason when they tried this the first attempt in XXXX is inaccurate- there is a 2nd mortgage which encumbers the real property. Again, not an attorney but it surely looks like this was also done incorrectly. Has nothing to do with my CFPB complaint today. I acknowledge that my attorneys office contacted Franklin Credit to submit a modification request and mitigation. I cant speak to the owners, I dont know who they are. I acknowledge that Franklin Credit did return to my attorneys office with a trial modification shown in ( XXXX XXXX ). I confirm that I did reject it- and was then forced to file XXXX XXXX. It would appear that Franklin Credit and its owners are very benevolent in granting a trial modification that I just simply rejected. Here is the offer and the truth : Down payment due in 30 days from letter date of {$150000.00}. Thats correct, nothing in the trial modification means anything unless I magically produce {$150000.00} in cash ( certified check ). Not to mention there would still be a large principal and then a balloon payment of {$130000.00}, and a monthly payment of {$2000.00} due 17 days later from the {$150000.00}. Here again is Franklin Credits artful language which left all that detail out of the letter and buried it in ( XXXX XXXX ) which Ive attached ( notice the mailing address is incorrect ). How can anyone with a straight face think this was a reasonable offer of modification? Its truly the worst part of corporate capitalism greed. Franklin Credit made it crystal clear they had no intention of working with me as each time my attorney went to court, the court was told that Franklin Credit was, in fact, working with me and had offered a trial modification, then they came back again, which isnt mentioned in the letter, for a second modification offer of {$50000.00} down payment and $ XXXX mo XXXX Again, if I had {$50000.00} I likely wouldnt be I this situation, but then the monthly payment is unreasonable. They made their intentions clear and my only remedy was filing bankruptcy- they forced me into it. Due to Franklin Credits unwillingness to be genuine in their offer of reasonable mitigation, the plan became unfeasible due to the large increase in plan payment, so it was dismissed late XX/XX/XXXX. Heard nothing from Franklin Credit. Has nothing to do with my CFPB complaint today. I am willing to pay the debt if we are able to work out a reasonable loan workout that offers an affordable payment on a monthly basis. I have offered this to Franklin and was denied. On XX/XX/XXXX, Franklin Credit posted a Notice of Trustees sale on my house. My HUD Housing Counselor informed me that a servicer must, by law, give notice of intention to foreclose with NOD and workout options prior to posting a Notice of Trustee Sale, which Franklin Credit did not comply with. Franklin Credit as much as admits to it in their response- The Notice of Trustees Sale notified XXXX XXXX that a foreclosure sale was scheduled for XX/XX/XXXX and indicated the amount of unpaid balance and other charges was {$670000.00}. This represents an increase in less than 24 months of {$290000.00}. I acknowledge it was posted on XX/XX/XXXX, but as I had no prior notice that they were going to file a Trustees Sale on the property, actually nothing from them still in writing other than the ridiculous trial modification. I started calling the 1st mortgage servicer XXXX XXXX as I believed that was who had filed the notice on my house. In clearing up with a XXXX loss mitigation representative and both of us realizing that her system didnt show any notice, I realized it had to be the XXXX. Since I had no prior notices, no contacts, no phone numbers from Franklin Credit, I called the number on the notice, which is the Trustee Attorney. I left a message, and got no response and my call was never returned. Panicked, I immediately contacted XXXX XXXX, a HUD housing counseling agency for help as my attorney was no longer representing me, I was advised to call Franklin Credit and at the conclusion of our conversation, I was advised to file a complaint with CFPB for notice violation and to stop the sale of my property. The complaint was filed on XX/XX/XXXX. Much to my surprise and hope, I received a call from XXXX XXXX of Franklin Credit on XX/XX/XXXX at XXXX PST regarding a letter they received. On XX/XX/XXXX after receiving the message, I dialed XXXX TEN times before I was even able to get through to leave him a message, which by that time was after XXXX EST. I called the main number I found XXXX EIGHT times, left message, no response. I called on XX/XX/XXXX always busy. I called NINE times on XX/XX/XXXX, and in pure desperation, I called both numbers at least ELEVEN times on XX/XX/XXXX before finally speaking with XXXX XXXX. That is FOUR days wasted. Here is what may be the most egregious and disingenuous language in this response letter, Although foreclosure sale is scheduled for XX/XX/XXXX, XXXX XXXX has been notified that her account may be reviewed for available loss mitigation options if a complete application package is submitted by XXXX EST on XX/XX/XXXX. On the face of it, thats correct. Again, Franklin Credit leaves out the reality of my conversation with XXXX XXXX. It is true that after the majority of our call on the XXXX XXXX XXXX did offer to consider a review with no guarantee if I can submit a modification package within the hour. Given that I was at work that would be difficult but was prepared to leave work to do it. They were giving me unrealistic timelines to get the loan mod information back which is not offering me ample time to submit a full packet for a reasonable workout. However, what Franklin Credit has conveniently left out of this, is that I was also told that if I didnt have a very substantial amount as down payment it wont be considered- no matter when I filed or didnt file it. I asked him to clarify what that amount would be and his general response was your trial modification required a {$150000.00} down payment, its increased to {$210000.00}. As calmly as possible, I told him all of it is ridiculous and unreasonable. Who has {$210000.00} sitting in the bank and in this situation? This should be criminal. I told him there is no way I have anything close and what I clearly heard from him is without a $ 100,000+ down payment, Im wasting both our time submitting anything. As I cried hysterically, I received the notice of the Franklin Credit response to CFPB and was absolutely floored at the lengths this company will go to in glossing over the real story here. So, just like in XXXX, they forced me to file an emergency bankruptcy that didnt need to happen if they would have followed the law and actually were genuine in their words and actions. So, I ask, where in this response does Franklin Credit EVER answer my complaint of no notice prior to the Notice of Trustee Sale? How can they honestly believe theyve adequately addressed anything but everything that didnt answer the complaint? This company is expert at skating the truth and I am sure they take advantage of many borrowers who had no say in being thrown to these wolves with these tactics. It is crystal clear they intend to deep corporate pocket me until my XXXX daughter and I are on the streets. I have always been willing, but a person cant be willing with offers as ridiculous as these non-offers. I request CFPB look further into this for sanctions and at a minimum requiring them to start the process over with proper notice, and Ill hope against hope that maybe someone there will actually try and help me. I am asking for them to provide me the full package required as XXXX XXXX just told me documents verbally, and the opportunity to submit a loan modification application and it be reviewed so I can work with them and get a reasonable workout. I am currently working with my HUD housing counselor to get financial counseling in an effort to pay my bills and obtain a loan workout to stay in my home. I appreciate your help in resolving this matter.

Summary of Facts : 1. On XX/XX/XXXX, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX R-G '' ) granted XXXX XXXX a loan in the amount of {$260000.00}, due XX/XX/XXXX, with interest at the rate of XXXX % per annum. The loan was evidenced, among others, by the issuance of a Mortgage Promissory Note payable to XXXX or to the order for the aforementioned sum. The Mortgage Promissory Note was signed, as a signatory, by XXXX XXXX. 2. After XXXX was closed by the XXXX XXXX XXXX XXXX XXXXXXXX XXXX in XXXX, and the Federal Deposit Insurance Corporation ( `` FDIC '' ) was named the receiver, the mortgage loan that is the subject of this Third-Party Lawsuit was transferred to XXXX. XXXX. By XX/XX/XXXX, XXXX XXXX was hit by Hurricane Maria. As part of the unprecedented ravages of the natural disaster, XXXX XXXX residence suffered severe damage making it uninhabitable and forcing her to move residence and ensure the best welfare of her minor child. XXXX. XXXX XXXX was not only forced to rent a residence in order to provide a safe roof for her minor son, but also to hire the services of XXXX XXXX to represent her in the processing and negotiation of the claim with the insurer XXXX. XXXX. XXXX finally issued XXXX ( XXXX ) checks namely : check number XXXX in the amount of {$38000.00} and {$160000.00}. These checks were drawn payable at the order of the Respondent and XXXX checks that, at present, have not been disbursed to the Respondent or credited to the debt in question. In fact, the only disbursement made by XXXX was a refund for the amount previously paid by the XXXX XXXX for the removal of a tree and cleaning of the yard in order to gain access to the property. XXXX. Since then, the funds have been frozen in an escrow account initially at XXXX, then at XXXX, and currently in an account at Bosco and/or Franklin, which is unknown and about which Bosco and/or Franklin has refused to provide any information and/or formal notification, despite multiple attempts to do so. XXXX. Because of this, XXXX XXXX was forced to hire a lawyer who, despite his best efforts, could not help her access the funds paid for by the insurance. XXXX. In addition to the damage caused to property by Hurricane Maria, there is a subsequent deterioration of the property for reasons attributable to the negligent administration and unfair practices of Bosco XXXX. XXXX. From the beginning, Bosco XXXX and its unfair practices have intentionally and negligently imposed a series of illegal and undue obstacles on XXXX XXXX regarding the availability of funds paid by XXXX. This series of obstacles which, to date, continues to impose is part of a pattern that has caused a range of repercussions for it in terms of delinquent debt, the progressive deterioration of the property, its ability to do the same to make it habitable, subsequently preventing it from making the necessary repairs and improvements to your residence to make it habitable again and / or fulfill your obligation. Because of this, XXXX XXXX had to hire another lawyer again. XXXX. For information and belief, XXXX also issued a XXXX ( XXXX ) check payable to XXXX XXXX allegedly for expenses. The correctness and/or regularity of this transaction is unknown. XXXX. The only disbursement made by XXXX, to date, is a refund for the amount paid for the cleaning of the yard and removal of a tree. XXXX. Since XX/XX/XXXX, XXXX, XXXX, Bosco and / or Franklin have deposited the sum of {$200000.00}, however, they have been reckless and negligent in presenting a cause of action knowing that there is money deposited in an " escrow '' account that approaches, if it does not equal or exceed the total balance truly owed. XXXX. In XX/XX/XXXX, XXXX urged the action of collection of money and foreclosure. XXXX. Sometime after the filing of the Writ of Enforcement, XXXX XXXX 's account was sold to him and transferred to Bosco XXXX. This information was never provided to XXXX XXXX and without communication as provided for in the RESPA Act, supra. The aforementioned law, in its section 2605, requires a notification at the time of a transfer in the loan. Section 2605 reads, as appropriate : ( b ) NOTICE BY TRANSFEROR OF LOAN SERVICING AT TIME OF TRANSFER ( 1 ) ( 2 ) TIME OF NOTICE ( A ) In general Except as provided under subparagraphs ( B ) and ( C ), the notice required under paragraph ( 1 ) shall be made to the borrower not less than XXXX days before the effective date of transfer of the servicing of the mortgage loan ( with respect to which such notice is made ). XXXX. It is not until XXXX XXXX counsel filed a " Written Request '' with XXXX that on XX/XX/XXXX, XXXX XXXX was allegedly notified of the transfer of her account, that is, after the expiration of the term provided for in the RESPA Act. We must indicate that this communication was never received by her and that transfer was not notified to the Court in a timely manner. XXXX. Franklin sends an inspector, XXXX, to inspect the residence and he claimed that Franklin 's practice was always to pay reimbursements for the arrangements paid by the owners and not to pay any amount to make the arrangements paid for by the insurance. XXXX. In addition, as a result of Franklin 's negligent actions, XXXX XXXX has not been able to defend itself in the case filed by XXXX XXXX in collection of money demanding payment for the services rendered in the negotiation against the insurer, there being a Judgment against the defendant in case XXXX. XXXX. Even Franklin continues month after month to make negative credit reports to XXXX XXXX totally destroying her credit empirical. XXXX. They do not have a physical office in XXXX, or person assigned to the case of insurance or loss mitigation, they have not provided a response to the requests for information and / or documents, the account number and balance of the account that has the insurance money, or the price paid for the property. They only provide XXXX XXXX with a XXXX number with people who attend to her from abroad and who say they have no information about the case or the insurance account and only take messages and offer the same generalized information. XXXX. XXXX and, even more, Bosco and/or Franklin have been reckless and negligent not only in administering the mortgage and discharging their contractual and legal obligations, but also during both judicial and out-of-court proceedings., as well as when filing a cause of action, especially when they have not complied with the legal prerequisites to be able to file a cause of judicial action for enforcement and knowing that there is money deposited in an escrow account that approaches, if not equals or exceeds the total balance truly owed. XXXX Despite the above, XXXX XXXX has complied on more than 5 occasions with the process and documents required in Loss Mitigtion, and on more than 4 occasions she has presented estimates from different contractors and certifications to access the disbursement of the insurance payment. XXXX. However, so far no bona fide offer has been submitted, no real options for retention of property, nor has any payment of the property insurance payment been disbursed. XXXX XXXX was even asked to provide a certified insurance policy for the property when even the previous insurance payment has been hijacked by Bosco XXXX. XXXX It is important to mention that XXXX XXXX has the economic capacity to pay the mortgage, however, being forced to rent another residence so she could not make both payments. And she can not return to her residence due to the non-payment of the insurance money to make the necessary arrangements and that has been kept by Franklin Credit.

In XX/XX/XXXXwe purchased our owner-occupied home in XXXX County California using 80/20 financing. Both loans were funded by XXXX XXXX. XXXX XXXX XXXX serviced the 1st and Franklin Credit Management Corporation serviced the 2nd. It is Franklin Credit Management Corporation who we are having a problem with. Dollar amount is {$220000.00} as of XX/XX/XXXX. In XX/XX/XXXX through a 3rd party working on our behalf contacted both XXXX XXXX XXXX servicer of 1st and Franklin Credit Management Corporation servicer for our 2nd asking to modify our loans. Our 3rd party representative was able to successfully negotiate a loan modification with XXXX XXXX XXXX. XXXX XXXX XXXX agreed to lower the interest rate beginningXX/XX/XXXX and ending on XX/XX/XXXX. Franklin Credit Management Corporation would not or could not modify the 2nd mortgage. With the financial crisis and Franklin Credit Management Corporation 's continued unwillingness to modify the loan we were forced to prioritize and chose to pay our payment on our 1st mortgage and no payments on our 2nd mortgage. XX/XX/XXXX the mortgage payment on the 1st increased substantially. ByXX/XX/XXXX with the increase in payment continued decline in our business we were unable to keep up with the larger payments. XXXX servicer of our 1st mortgage filed a NOD on our home. Home was listed for a short sale in XX/XX/XXXX an offer was accepted inXX/XX/XXXX. Short Sale was canceled XX/XX/XXXX and a loan modification was requested. All information requested was provided by us to XXXX including the information on the 2nd mortgage. On XX/XX/XXXX our HAMP federal loan modification was finalized. The principal balance was increased. The interest rate was lowered and fixed. Term extended 2 months. We were given a principal balance reduction. Our modification agreement included a balloon payment of due at the end of the loan. It was our understanding from XXXX that the 2nd mortgage was taken care of with the HAMP federal loan modification. XX/XX/XXXX a Notice of Default and Election to Sell Under Deed of Trust was filed on behalf of Franklin Credit Management Corporation. THERE HAD BEEN ABSOLUTELY NO CONTACT with Franklin Credit Management Corporation or any other company representing them prior to this filing SINCE XX/XX/XXXX. ALL CONTACT WITH THEM STOPPED AFTER OUR HAMP LOAN MODIFICATION. THIS ACCOUNT ALSO WAS NOT REPORTED TO ANY OF THE 3 CREDIT BUREAUS SO WE HAD NO IDEA WE STILL OWED ANY MONIES ON THE 2ND!! IF WE HAD KNOW WE WOULD HAVE ADDRESSED IT. When asked why there has been no phone calls, statements, emails or personal visits their reasoning was we sent them a letter in XX/XX/XXXX telling them not to contact us anymore, but yet they continued to send statements until XX/XX/XXXX. When asked why they stopped contact in XX/XX/XXXX they said the account was in collections, but there was no collection activity by Franklin Credit Management Corporation or an outside company on their behalf. They also claim to have sent us a Notice of Default and Intent to Accelerate dated XX/XX/XXXX sent via first class mail which we NEVER RECEIVED!! even thought their " NOTE '' states all notices were to be sent certified mail per section 7 and section 12 of the Deed of Trust and Request for Notice of Default. We also never received proper notification per the FTC rules when in XX/XX/XXXX Franklin Credit Management purchased this loan themselves. We contacted them numerous time between XX/XX/XXXX to XX/XX/XXXX trying to negotiate a settlement or a modification. Franklin Credit Management Corporation employees were rude, disrespectful and downright unreasonable. We were forced to file Chapter XXXX BK in XX/XX/XXXXto stop them from foreclosing on our home. Even hiring an attorney Franklin Credit Management Corporation has remained completely unreasonable and all attempts for a modification or settlement have failed to date. In summary Franklin Credit Management Corporation is in my opinion a PREDATORY MORTGAGE LENDER AND SERVICER who did not contact us either by phone, mail or a personal visit before filing a Notice of Default. They have racked up large amounts of penalties and interest and have been unreasonable refusing to work with us to resolve this matter. I am sure that the AG 's from all the states that bought suit against the Banks and help create programs that helped us such as the HAMP Loan Modification would not want a junior lienholder such as Franklin Credit to come in after remaining silent for several years and foreclose and take our home after we have worked so hard to keep it. We were one of the less than 5 % whose 1st mortgage balance was reduced and if it was not for that reduction and our outstanding performance to meet all requirements to obtain that principal balance reduction Franklin Credit management Corporation would have no position today. Our desired resolution is for Franklin Credit Management Corporation to modify our loan removing all penalties and interest that has accrued unbeknownst to us reducing the balance back to {$110000.00} which was the principal balance at the time of the default. Lower the interest rate to 3.75 % for 30 years lowering the payment to {$550.00}. We desperately need your help with this PREDATORY company I truly believe operates outside of the regulatory guidelines as it suits its own purpose before they succeed in foreclosing on our home now that the BK has been dismissed. In XXXX my XXXX ( XXXX XXXX XXXX took out a XXXX with a total amount available of {$240000.00}. Any records I have left from that time, as well as my recollection, we took one distribution of either the minimum of {$40000.00}, up to {$70000.00} but never over that, and certainly not the full amount. It was originated through a XXXX XXXX which went under in XXXX crash. At that time in XXXX, it was sold at least 3x that I know of, and then it just disappeared and I tried to find it, but I couldn't find it. In XXXX we worked out a modification with our first, and the attorney working with us when I asked about the 2nd, he said many of these XXXX XXXX can't be located. That was XXXX. Fast forward to XXXX, my income reduced because XXXX XXXX XXXX returned from a XXXX XXXX for XXXX ( XXXX XXXX XXXX ), and my husband had to cut back on work/income due to XXXX XXXX So I started the process of trying to work out a solution with the first mortgage XXXX. They sold to a private trust investor who was unwilling to work with us, so we filed XXXX. XX/XX/XXXX XXXX XXXX XXXX XXXX which not only took away a good source of income, but further XXXX XXXX XXXX XXXX XXXX XXXX XXXX. My XXXX attorney worked with our first mortgage servicer XXXX, but when we filed in XXXX, I had him include the amount due on the 2nd of {$70000.00} even though I'd still never been able to reach anyone on it. After XXXX closed everything down, I lost my job, but was able to work with the 1st. As equity was increasing in homes, suddenly Bosco/Franklin Credit Management XXXX XXXX XXXX XXXX and sent a previous attorney that I used to try and find them an acceleration notice on XX/XX/XXXX with a total due of {$380000.00}. I disputed that with them through my XXXX attorney, completed and submitted a loan modification package. Over the next XXXX months, we went back to them many times trying to come to a modification- this company would NOT work with me on ANY reasonable solution. Modification offer # 1 : {$100000.00} up front payment, then {$3000.00} a month. Not feasible. Modification offer # 2 : No up front payment, then {$5800.00} a month. Outrageous. When my attorney went back again, and although the court told them to work something reasonable out, they would not budge, and meanwhile I was paying $ XXXXXXXX XXXX Franklin in XXXX XXXX, they would not move and in less than 2 years, they destroyed my XXXX that was working, judge had to dismiss because they were now claiming I owe XXXX XXXXXXXX nearly XXXX which in plan payments became unsustainable. On or about XX/XX/XXXX they put a notice of trustee sale on my door. We did not return to see it after the XXXX with a sale date of XX/XX/XXXX XXXX XXXX XXXX I have never recieved ANY communication from this company directly that I am aware of. No notices whatsoever of this sale, and my XXXX attorney did not receive it either as the XXXX had been dismissed because of them end of XX/XX/XXXX. In desperation, I called XXXX, because this just CAN'T be right or legal and the counselor, after speaking with her, recommended I file a complaint as she's seeing this often now with these XXXX 2nd mortgages. They've made it clear, they want my house, and are willing to break laws and throw vulnerable families out because of pure greed. I will now need to go back to the 1st because this 2nd destroyed the agreement I had in XXXX ( assuming the sale is stopped on XX/XX/XXXX ). What can I do? How can I stop this from happening on Monday XX/XX/XXXX? I've left a message with the trustee attorney, but no response. I'll keep trying to get through to someone there but to no avail so far. I wish I had known about CFPB and the HUD counselors as I have spent all my extra funds and time to pay for this dragged out process- Franklin XXXX XXXX XXXXs just stringing me along to break my bank and ability to fight them. So I essentially lose my house to a deceptive business who increases amounts wildly ( double in less than 2 years ), and made it impossible to find them when I XXXX have had legal remedy as a predatory lender. After about five six years of not hearing from the second loan holder, I received a delinquency notice and possibly foreclosure of my property i.e XXXX XXXX XXXX XXXX XXXX XXXX XXXX, CA XXXX. During the intervening period, I received no demand nor any bill from this company. I initially requested the documents I signed as I have no recollection of dealing with the company. On XX/XX/XXXX through the help of XXXX Law Office who claims to specialized in Foreclosure intervention, I was approved to reinstate the loan with a trial period of six months. At this point, no documents that I signed as requested was never produced or provided. I was demanded to remit the amount of {$42000.00} out of a {$110000.00} initial loan. As I did not have the funds immediately, I had been informed of Trustee Sale many, many times. In XX/XX/XXXX, I remitted via wire the amount of {$43000.00} and paid the scheduled payments of {$1000.00}. In going through my files, I came across a notice from the FRANKLIN CREDIT MANAGEMENT an offer of {$16000.00} settlement for whatever account is outstanding. I continued to remit to them in good faith the agreed monthly payments, until I received a refund of the amount, and the return of my uncashed check for the XX/XX/XXXXpayment.When I called to inquire what happened, I was told that the uncovered " fraud '' in this transaction and was five a number of a lawyer to call for further details. I tried the number numerous times and left messages requesting return call, nothing happened. InXX/XX/2018, I decided to sell the property as I am XXXX years old and planning to undertake the final steps towards retirement. During the title search/preliminary task, Franklin Credit alleged that my account was taken under a fraudulent circumstance ( SSN of my daughter who has the same name as mine which was rectified with SSA files and was accepted as an error without prejudice ) I had to suspend the sale as the company gave me and my realtor the hardest time to complete any transaction attendant to the sale. Then a certain XXXX XXXX started talking specifics of my personal information with my realtor and who knows who else. Very derogatory information with conclusive information without the benefit of inquiring or validating them with me. One of which is his constant communication with my son-in-law who claims that if it was my daughter 's social security number, then the property is theirs. The next step they did is to send me a Trustee Sale notice onXX/XX/XXXX. My realtor then made the effort to research and work it out with the Franklin Credit through XXXX XXXX to stop the sale and re-negotiated for a more reasonable settlement amount, in consideration of the circumstances and the funds already remitted to them. The remedy according to them is for me to remit the amount of {$97000.00} no later than XX/XX/XXXX and adamantly disagreed on any sale proceedings whatsoever. Firstly, I am not in a position to produce that money, if they will only agree to proceed with the procedural normal sale of the property, which is very promising at this point, they can get the money due them and we can close the working relationship on a positive note. Secondly, they had violated my rights to the requested documents and the proper procedure in billing and collection and notifications. Above all, they have no rights nor permission to discuss any of my personal matter with anyone. I have a good standing with my first note holder and if only they were professional enough to deal with the situation fairly, we could have work a positive working relationship. For your information, in the duration of my beggings and requesting with Franklin through XXXX XXXX, I felt harassed, bullied, violated and abused by a somewhat predatory lending company. At this point, it is urgently requested that the foreclosure proceedings be stopped and sale will proceed as a matter of course, so every lenders entitled to payments will be fairly satisfied.

Franklin Credit is COMMITTING FRAUD AGAINST A BORROWER AND THE INVESTOR THAT THEY ARE SERVICING A MORTGAGE ON BEHA LF OF. Franklin credit fil ed an NOD against a borrower on X/XX/17 and has ALREADY SET AN AUCTION DATE ON THE PROPERTY AS OF X/XX/17 . By C A state law an A UCTION CAN NOT BE SET UNTIL 90 DAYS HAS PASSED FROM THE NOD FILING. I WAS INFORMED OF THE AUCTION DATE BEING SET BY A REPRESENTATIVE AT FRANKLIN ON X/XX/17 , well short of the 90 days required by CA law. It is obvious that there is a pattern of FRAUD that FRANKLIN CREDIT commits on a regular basis as evidenced by the XXXX complaints in the CFPB database already. We have been working on a loss mitigation work out ( Short Sale ) with the 2nd mortgage on a property Franklin Credit is the servicer. Franklin credit has been very difficult to work with since contacting them in XXXX about workout options. XXXX Credit was contacted on X/X/17 and sent an authorization letter and payoff request. After multiple attempts to contact XXXX XXXX we were n't able to speak with them until X/XX/17 when I spoke with a representative by the name of XXXX XXXX . He told me that the XXXX was XXXX and the account was past due for approximately XXXX or 110 months of missed payments. At this point he ordered a short sale package to be emailed to me. On X/XX/17 a payoff was received from XXXX XXXX XXXX in the amount of {$210000.00}. On this same date the " SS requirements '' package was also received from a XXXX XXXX XXXX . The property was available for sale and an offer was not received until X/XX/17 at which point the entire package was faxed and emailed to Franklin Credit, a s they will not review incomplete packages. The offer that was presente d to Franklin Credit is about 20,000 above current market value of the property and from an all cash buyer. On X/XX/17 I followed up w ith Franklin Credit an d they confirmed receipt of the package and did n't request any additional information and stated that upper management would have an answer by Wednesday the XXXX . XXXX called me this same day and said that management declined the offer and wanted an offer closer to the UPB of the mortgage. The numbers on the closing statement were re-evaluated and we were able to present a higher net which was sent via email on X/X/17 . On X/X/17 another decline letter was received via email. On X/XX/17 Again the numbers were adjusted to meet the net Franklin requested to submit to management again, XXXX . The settlement estimate with a letter of explanation of value and a comparative market analysis was emailed to Franklin. On X/XX/17 I spoke with XXXX twice. He had called me at XXXX Pacific time and said that the file was marked for auction. I questioned him about this as the NOD was filed on X/XX/17 and 90 days had not passed per CA state law. He said that the auction was already set. At this point, XXXX ordered a BPO on the property to confirm that the information we were providing was accurate and that the offer was actually in excess of current market values. The BPO was performed on X/XX/17 . XXXX will not provide an amount of the BPO or the actual BPO report that was performed when it was requested. On X/XX/17 I tried multiple times to communicate with XXXX XXXX about the offer and was just put on hold and disconnected multiple times. I also tried to email XXXX and XXXX XXXX XXXX without any response. After calling multiple times I received an email with another denial letter. On X/XX/17 I was able to speak to XXXX . He told me that there was nothing that could be done as an auction was set for XXXX on the property and that management was countering the offer to XXXX . BY WAITING THIS LONG IT IS EVIDENT THAT FRANKLIN CREDIT HAD NO OTHER INTENTION THAN TO FORECLOSE ON THE PROPERTY AND DEFRAUD ALL PARTIES HOMEOWNER AND INVESTOR

For almost 3 years, since modifying our loan with our first mortgage company, we have been trying to get our servicer for the second mortgage company to consider a modification as well. However, it 's as if every submission has resulted in lost/missing documents or documents we can not secure ( for example, a payoff amount of the first mortgage because an appraisal would be required ). Our 2nd mortgage is approx. 81 months in default. I ca n't seem to locate a billing statement sent by our 2nd mortgage ; I do n't remember the last time we even received such a billing statement. We have had little to no communication ( written or verbal ) with our 2nd mortgage company for over 6 years now. When we have called to ask a question or make an inquiry of our 2nd mortgage company, the call would end because the 2nd mortgage company would hang up on us. When we attempted to call back, the phone would ring and then you get music for a few minutes before getting a dial tone. We have never been given a single point of contact within the company. When we ask to speak to the person referenced on recent correspondence as the Loss Mitigation Manager, she is NEVER available and when we ask to leave a message, we are transferred to a voice message that the message is cutoff and you just hear the beep. We have left messages, but have never received a return phone call. We have borderline begged for some sort of resolution so we could start making payments again. Servicer of 2nd mortgage company offered a settlement approx. 18 months ago of a total of {$10000.00}, however, we could not gather the funds needed before the deadline date ( despite communicating with them of our intent to exercise the settlement, we were denied because we were 4 days late ). We thought we were finally working towards a modification review only to be blindsided while standing in our driveway early Saturday morning by a local real estate investor who informed us that our 2nd mortgage company has recorded a Notice of Trustee 's Sale the day before. We hired legal counsel to assist with negotiations and received a repayment offer with terms considered unfair and unconscionable - {$21000.00} Down Payment, {$3600.00} per month for 12 months totaling over {$64000.00} in 12 months. Our AGI for XXXX was approx. {$78000.00}! We appealed and received a revised offer approx. 36 hours before the scheduled foreclosure sale The only way the sale would be stopped is if we immediately wire {$10000.00} as a down payment and payments would be {$1900.00} a month for 36 months. Again, a repayment offer with terms considered unfair and unconscionable and setting us up for failure. We again asked for an offer to match the forthcoming bankruptcy plan of 60 months and no down payment, we were denied in less than a few hours, and informed we were in default of the first offer. We had to file Chapter XXXX bankruptcy to stop the sale of the house, which has now been rescheduled from XXXX/XXXX/16 to XXXX/XXXX/16. The review process for each submission was completed by the 2nd mortgage company servicer in less than 4 days, the last was declined same day - within hours ( emailed request XXXX/XXXX/16 at approx. XXXX, and letter declining modification dated XXXX/XXXX/16 and envelope postmarked XXXX/XXXX/16 )! The servicer failed to disclose the " actual reasons '' for the loan modification denials. The denials simply stated that the decisions were based on an investor requirement. The investor requirements failed to identify the requirement that is the basis of the denial. If decisions were based on net present value, we were not provided with the inputs used in making the calculation. Our offer to settle for {$10000.00} was also rejected. The total principal of this note was {$64000.00} and approx. 13 % interest with another 20 years to go on the loan ( current monthly payments would be approx. $ XXXX/mo ). This company lacks interest in helping us.

XXXX I purchased a home and the home was purchased with a XXXX mortgage, Franklin Credit. XX/XX/XXXX the home was foreclosed and I moved out XX/XX/XXXX. I never ever heard from the original mortgage holder. The Franklin Credit company threaten to garnish my pay wages and take me to court if I did not pay them. I paid them over the years, but I was late on the payments. Fast forward to XX/XX/XXXX, I was planning to purchase a new home, so I called the Franklin Credit company to try and put things in order and to try and catch up on the payments. They told me I could do this and that they would modify the loan and all the arrears would be dropped. They made it seem like this was a fresh start. I would have a lower interest rate and things would just be as if this was a new personal loan. By the way, this company never had reported any of this to the XXXX credit bureaus since I had the loan as a matter of fact, the original mortgage company did not either. So I agreed to the terms of the loan. When they sent out the new loan agreement papers, there was a trial period of 3 months starting in XX/XX/XXXX thru XX/XX/XXXX, I paid the new loan amount as agreed. After the trial period they posted the information with the XXXX credit bureaus and it was listed with all the arrears from XX/XX/XXXX thru XX/XX/XXXX. They even listed the 4 months that I had paid during the new agreement as late. I have tried several times to call and talk with this company about listing this loan as a XXXX mortgage and how could they even modify this loan and call it a XXXX mortgage when I do not own the property and there is no lien. I wrote the credit bureaus ( XXXX and XXXX ) several letters asking for assistance in this matter. I have been working with a company since XX/XX/XXXX, that said they could help me with this situation, and to no avail. I even wrote letters to the Franklin Credit company asking that they rescind the XXXX mortgage wording and re-write this a personal loan. They refuse to do anything at all. They told me this is a second mortgage and even though the loan was modified does not mean it 's not a mortgage. I stated that I no longer own the property and since XX/XX/XXXX someone else has been living there. I sent them the public records showing the new owners of this property. They told me I should stop calling them, stop sending them letters and stop having the credit bureaus send them letters, I even had finance people from home mortgage companies speak to them on my behalf. They told me this would not help at all. They will not change the information listed as a XXXX mortgage. When I asked to speak with a manager they told me there were no managers to speak with. This has hindered me from moving forward with the purchase of a new home for 1 year now, because the lenders are hesitant to give me another home mortgage loan while my credit report states I have a XXXX mortgage that has been delinquent for a long time, even though I have cancelled checks to prove that since the loan has been modified there has not been a late payment. Should this Franklin Credit company be allowed to call this loan a XXXX mortgage even though I no longer own the property. This has been a nightmare and very stressful for me. I have a XXXX and XXXX mortgage on my home that I took out in 2006. I have struggled for years to keep up with the monthly payments on both loans. My income has drastically decreased over the last several years and the main source of income was mostly brought in by my husband. We almost lost our home a couple years ago when we fell behind on the first. We were successful at modifying that loan, the payment is still high but we were able to afford it. The result of my declining income led us to then fall behind on our XXXX. This is when our real troubles began. The XXXX is with Franklin Credit and they have turned out to be extremely difficult to work with on any foreclosure alternative. The modification plan that we were finally approved for asked for a hefty down payment and increased our payment 3 times higher than it was before. After seeking help from several family members in an attempt to borrower the down payment Franklin Credit wanted-which would put us in a deeper hole. We had to come to the realization that even if we could borrow this money from family we could not afford the modified payment that was approved, it was almost XXXX a month- on top of the payment for my XXXX which is XXXX. Additionally our family members can not offer us any help because we owe over XXXX on my XXXX. It was just impossible. Through all these problems, my husband and I have now separated. At this point I would like nothing more than to resolve this debt and short sale this home. Another feeble attempt! I listed my home and accepted an offer to send in for review to FC. The agent we are working with is now encountering the same rude, unprofessional behavior that I experienced, they refuse to let you speak with a manager and hang up on you. IN an effort to continue to work with them several offers have been made to them, along with a request for a payoff demand of my loan, all were just flat out denied. This bank gives no direction, no counter they will not reveal the market value they believe my home is worth- this is what is affecting their decision! They advised my agent that they believe they will make all their money back at foreclosure and still pay off my XXXX. Withholding this information is just plain out underhanded- what do they have to hide? They tell us that this information is private but I have a right to receive any appraisal or valuation on my home made by them-especially one affecting any decisions for foreclosure alternative programs. They are forcing me into foreclosure and to make matters worse California is a recourse state for any loan that is not purchase money, this was a refi. I hardly make enough money to pay rent now I have to now worry about having them come after me when they realize that they over valued my home and wrongfully foreclosed instead or just be forced into bankruptcy! When they have to sell my home as a REO, because it needs repair and finally realize their value was inflated they will try to sue me, my home is underwater by the XXXX. We could have worked this all out, I have been forthright in my dealings with this institution. All I ask is to be given the opportunity to try and resolve this debt with them, to have them kindly work with a person going through a real hardship.

I have a property that I am trying to complete a short sale and the debt for the property was included in a bankruptcy that was discharged almost 6 years ago. I made arrangements with the primary mortgage company ( XXXX ) to still pay the monthly mortgage amount for them to allow me to stay in the home which I had been doing for over 2 years. Last year around XX/XX/2017 I received a notice of foreclosure proceedings that was going to be started on the property by the junior lien holder on the property XXXXXXXX XXXX who is being serviced by Franklin Credit. I did not receive any of their prior notices because everything was being sent in my ex husbands name and I was served notice because I lived in the property at the time about the pending foreclosure. When I reached out to them I tried to do a loss mitigation process with them and offered then a settlement amount of XXXX at the time which they declined stating that the offer was too low. After going back and forth with their servicing company Franklin Credit we could not come to a resolution and they would not accept my offer. Franklin Credit opened a foreclosure case in XX/XX/2017 for me in Maryland and started the process even though I was trying to make arrangements with them. Since they would not accept the settlement offer I decided to do a short sale on the property to avoid the foreclosure. I put the house on the market last year in XX/XX/2017 and received a cash offer from a buyer asking to purchase it for the agreed upon amount of the first lien holder XXXX. When we were ready to go to settlement and the title company tried to clear us for settlement we found out that the junior lien holder had filed a lien against the property preventing me from selling the property and obtaining a clean title. I reached out to Franklin Credit who is the servicer for the junior lien holder and I have been working with XXXX XXXX and he told me to resubmit an offer to the company to see if it would be accepted. XXXX will only allow a maximum of XXXX be paid to the junior lien holder which I offered to Franklin Credit to get the lien released. They refused the offer and countered it stating that they are looking for a payoff of {$30000.00} before they will release the lien or they will proceed with the foreclosure. I have been rebuilding myself and my credit since I filed for the bankruptcy 5 years ago and I am trying to protect my credit and not have a foreclosure on my record when I have been trying to work this out with them. I am in danger of loosing the buyer that I have as we were supposed to go to settlement in XXXX of last year and he wants to pull out his offer. It seems that Franklin Credit is trying to cause me an undue stress by forcing me into foreclosure. The home is vacant I have already moved but I do not want to have this fall on my credit. As this process is drawn out by them their are fees that keep adding up from the HOA for the property that I am trying to avoid as well.

XX/XX/XXXX, a representative from Franklin Credit came to my house around XXXX. She asked my name and stated that she had a letter for me. I informed her that on the letter my name was spelled incorrectly. She asked for the correct spelling and wrote it on a piece of paper. She stated that the letter was regarding a property that I had defaulted on. I told her that the only property I 've ever owned is the one that I currently reside in. I told her that I did not want to accept the letter since my first name was spelled incorrectly. I told her that I was unaware of the debt because I had been the victim of identity theft years ago. She told me to contact the company to have the matter rectified. The letter only contained a note instructing me to call a XXXX number. I called the number repeatedly and it would ring one or two times, then there was an automated prompt, after which the line would disconnect. No one ever answered. A week later I received a certified letter from them detailing the alleged debt I owed from an outstanding promissory note from XX/XX/XXXX. I contacted the company and they attempted to try to set me up on a payment plan. I informed them that I was the victim of identity theft and that the IRS and credit bureaus were aware of the fraud. They said they would make note of it on the account. I heard nothing about it for months. On XXXX XXXX, a man identifying himself as a sheriff arrived at my house after XXXX. I was served a summons initiated from the company Franklin Credit claimed to be servicing the debt for ( XXXX XXXX XXXX XXXX XXXX ) and give me 20 days to reply with a written response. After reviewing the summons and the claims made, there were inconsistencies that I repeatedly pointed out during this process. The incorrect spelling of my first name on the promissory note, in addition to the inconsistencies with my signature are all points that I made in my response. At the alleged time of the note, I was a full-time student at a university and also working part-time at that university while living on dorm. I was dependent on my wages and student loans at that time. I informed the representatives that I did n't even qualify for a personal loan at that time, so I know I did n't qualify for a mortgage. Unfortunately, my repeated attempts to get the matter rectified has remained unresolved. In fact, the office of the attorney for the plaintiff contacted me to say that they would be proceeding with the lawsuit against me. Despite them requesting my identification, they acknowledged that my first name was spelled incorrectly on all documents, including the notarized promissory note and continued to state that the signature " somewhat '' matched mine. I feel as if they are trying to take advantage of me. They are applying many different tactics and trying to force me to pay a debt that is n't mine.

I bought a XXXX condo in XXXX. First mortgage {$140000.00}, 8.25 % from XXXX, 2nd mortgage XXXX, 13.35 % From XXXX in XXXX. I had XXXX small children and our apartment was converting to condo and out of my price range. My credit at the time was fair. I had been living in the US Virgin Islands for 7 years. Within months of buying the place, the financial crisis occurred and BOTH lenders were out of business. My 1st mortgage went to XXXX ( XXXX ) and lowered to 3.75. Thank you. My second loan ended up on the desk of Franklin Credit Management Corp of XXXX XXXX NJ. I was current on both loans and remained that way until ... .. In XXXX or XXXX, Franklin calls me and says we are lowering your interest rate to 4 % for the next 12 months. Why ... I asked myself. I was not behind on my loan.. What happens after 12 months? They said, We'll extend it for another 12 months ... ... ..that never happened. After 12 months, they called me said, OK now we go back to 13.35 % ... ... and I said No ... ... I told them I did not want the home for free but I would like a FAIR interest rate ... ... .they took my financial information over the phone, turned me down for loan modification on the call and I believed I was being taken advantage of ... ... .I believe they lowered my interest rate to 4 % because there were being audited and interested in getting my 13.35 % loan off their books. After the audit, business as usual, back to 13.35 %. I am digging to find proof of that audit ... .If that fact is true, they lied to me AND to the auditors of the Federal Government ( or State, I am not sure ). Long story short, I have not paid them a dime since the day they refused to consider a loan modification, asking for financials over the phone and making a decision without a written application appears to me haphazard and unprofessional.. The conversation is on a recording in their log. THEY were the one 's recording the call for quality assurance. I was current on BOTH loans at this point. I believe both my original loans in XXXX were excessive, however, I signed with the intent to refinance after 12 months. I was not the cause of the financial crisis but XXXX and XXXX, and continuing Franklin Credit, were playing the game. XXXX immediately lowered my 1st mortgage rate voluntarily, and my second mortgage servicer, Franklin Credit Management Corp, should either return all funds paid to them by me under a predatory original 2nd loan bought from XXXX, be forced to modify my loan, and/or move to drop the foreclosure matter. The investors of my 2nd mortgage are XXXX and XXXX. I have never done business with them directly. Their names are on the foreclosure papers. I would appreciate any help or guidance you can afford me in this matter. I am fighting for my home and protection of my family. Also, my 2nd mortgage loan is not on my credit report.

About the same time the economy was starting to slide and home prices would eventually tank. My wife lost her job at a diabetic supply company, but I was still employed at the county government ( {$1200.00} biweekly ). We carried the mortgage for about 3 years, but eventually fell behind. First to suffer was the HOA fees then eventually the mortgage came crashing in on us. We tried loan mods that were being offered at that time but, the bank on the XXXX on the first loan complied abut eventually we missed another payment so it was cancelled., the second mortgage company Franklin Credit Management ( FCM ) wasnt as forthright with any modifications. Facing foreclosure, our next plan was to do execute a short sale. That was arranged and presented to XXXX and FCM. Both balk at he short sale price and he home went o foreclosure. Fast forward to XXXX I get served for garnishment of wages for the second mortgage from FCM. {$61000.00}. It took me from that incident back in XXXX to the present to finally get my credit back on track, only to have FCM come after me for that second mortgage loan. When presented with original loan docs during the court remediation. It showed that I signed a balloon payment second mortgage. I swear to XXXX, I would have never signed a balloon payment second mortgage on purpose. I really believe they tricked me. That would be ass-nine!!! I swear to this day there were some hidden objectives then with this2nd mortgage in addition to the coercion that we faced. I think this may have been predatory loan. I reached a mediation with via the courts, but they instead got a court ordered garnishment hat is taking more than 25 % of my income on a bi weekly basis How can they go out of business in XXXX filing bankruptcy, then come out of bankruptcy and come after me? For a loan they probably got waved thru bankruptcy. Can you CFPB help me with investigating Franklin Credit Management for unfair loan practices that involve coercion, mis-information and mis-leading loan practices? The Franklin Credit Management bought out my second mortgage a few years ago when my house was upside down -- dropped almost half, and placed a lien on my property. I have been trying to settle this since then, but no avail. XXXX XXXX has been harassing me, sending me false statements since XXXX of XXXX. This was my second mortgage servicing company. This is past the statute of limitations and they have violated several federal consumer protection laws, including the Fair Debt Collection Practices Act and the Truth in Lending Act as well as state consumer protection law. I sent them a cease and desist letter XX/XX/XXXX, through email and told them to contact my attorney. They know I'm in a lawsuit with the lender ( zombie mortgage ). However, they are now sending a monthly false statement after not sending monthly ( periodic ) statements for 13 years. The statute of limitations in Florida is 5 years past default. In XX/XX/XXXX, they added an additional {$30000.00}. In XXXX, they added an additional {$10000.00}. The loan was charged off in XX/XX/XXXX and the loan holders are not entitled to interest payments stemming from the years when I did not receive periodic statements. In addition, the note was canceled in XX/XX/XXXX and reduced to a judgment. It forced me into bankruptcy since I was a single mother with low income. " Amendments to the TILA periodic statement rule were designed to prevent the surprise appearance of a long-dormant second mortgage together with unexpected claims for years of accrued interest and fees. ( Reg. Z, 12 C.F.R. 1026.41, implementing 15 U.S.C. 1638 ( f ) ). Under the rule, servicers must keep borrowers informed about the status of a second mortgage, including whether it has been charged-off or re-activated for collection, as well as who currently owns the loan and how to contact appropriate parties for up-to-date information. The rule requires heightened periodic statement disclosures when the loan is in arrears. TILAs Periodic Statement Rule and the Bar on Collection of Interest and Fees on Charged-Off Mortgages. '' ( NCLC ) They DID NOT do that, plus the note doesn't exist! Their harassment is causing me much XXXX, more financial issues, sleepless nights and health issues. They, and others like them, are harassing people who have survived the last XXXX XXXX, covid, losing many loved ones, the current inflation and they want to steal our homes. The banks caused the last recession with unfair and deceptive tactics and now they're doing it again. A few years ago I refinanced my home to obtain a lower mortgage payment/rate. At closing I was promised a lower rate, which I signed to. After closing I received documents differ from the ones I signed at closing. 15.99 percent rate is unfair and inhumane. In XXXX of 2019 I attempted to get home improvement loan on my house. I discovered there were liens that had never been released. I did the work finding the people having those properly removed. I also discovered there was a second mortgage that was not paid ... the mortgage was in my husband 's name, he passed 7 years ago, I only knew of the one that I took over financially responsibility for. It took some digging around, but I found the lender that had the second mortgage. I was instructed to fax a request to settle the balance. I started on XX/XX/2019 with my first settlement offer, after a couple of week, it was declined. XX/XX/2019, I submitted another request, after a few weeks it was declined. XX/XX/2019, I submitted another request, I received another decline 2 weeks later. I spoke to a gentleman that advised me to go higher, when I submitted request for $ XXXX on XX/XX/XXXX, I didn't hear anything and when I called I was told it was approved and just awaiting signature. Then I got a call that it was declined, they wanted the full amount owed. I said ok, I wish you would've just said that in the beginning. I then asked if they could just send me paperwork to assume responsibility of the loan and to do a modification. After a couple of weeks, I called back asking about modification package, he would say it was sent out. I would always ask if they could just email it to me, not it had to be mailed. weeks would go by and nothing, I called back and he finally gave me an excuse that it was returned. There is no way, the address is the same and we have the same postman. I asked if they were putting my husband 's name on it, again the postman knows I am still here so I don't know who would've returned it. I never saw proof of the return, we have community mailboxes, hopefully if it was put in wrong box my neighbor would bring it to me. They would email declination of offers to me, but they couldn't email the modification package? I have recently started getting letter from attorneys regarding foreclosure, I was confused because I pay my mortgage on time every month and I remembered I have never resolved issue with Franklin Credit.

Hello, I am filing a new complaint as the Franklin responded to the previous complaint but issue has still not been fully addressed. The company responded back with a history of the loan, but did not address the issue of forbearance during the pandemic. As previously stated we were able to workout a repayment plan in addition to receiving assistance from the CA mortgage relief payment following our forbearance. That said, we advised Franklin during the pandemic of our financial hardships, including but not limited to loss of pay, illnesses, car accident, onset XXXX caused directly from the pandemic, we made payments as we could stayed up to date with mortgage protections/laws HUD agency even state of CA. Franklin never once said that we were facing foreclosure due to the pandemic and homeowners protections in place. Our last payment to Franklin cleared XX/XX/XXXX in the amount of XXXX. I advised Franklin that we were working with the state for assistance, kept them abreast of status updates. I advised them that the stated denied as they're not assisting with 2nd loans or HELOCS only firsts and advised me to reach out to the servicer as I should have been offered some type of work out plan after the forbearance. I told them the only thing they told me was that I needed to pay the entire past due amount in addition to attorney fees and there is some XXXX plus charge on there as well. I obviously am in no position to pay that full amount. We are wondering why we were sent directly to pre foreclosure and where the letter advising us that our forbearance had ended and offered options to rectify. At the end of the day we just need help and the actual amount of the payments missed and for what months, the payments we made so I can compare to bank statement in addition to the copy of the letters stating our forbearance was over. We have been through a lot, things have not been easy, we have fought for our home. We are just everyday Americans with XXXX struggling after a pandemic to survive. Please help us. Thank you so much.

1. Purchased home on XX/XX/XXXX. 1st Mortgage ( $ XXXX ) with XXXX XXXX XXXX XXXX, 2nd Mortgage ( $ XXXX ) with XXXX XXXX XXXX XXXX. Purchase price for home was $ XXXX 2. I contacted XXXX as I was no longer getting the bill 's and they responded by saying they hadn't received all the information on the loan, and quickly it transferred another bank and then again another bank and I was unsure who I needed to pay. 4. From XX/XX/XXXX to XX/XX/XXXX we made our payments ontime thinking we were paying for both mortgages, but in XX/XX/XXXX we received a forclosure packet from Franklin Credit Management Corporation. We throught from XX/XX/XXXX to XX/XX/XXXX we were making our payments, we weren't receiving any correspondence regarding a 2nd mortgage and our credit report no longer showed the 2nd mortgage or any late payments so we were extremely confused as to why we would be served forclosure papers. I have attached the notice of default we received from Franklin Credit stating we needed to pay {$39000.00} to cure default. 6. From XX/XX/XXXX until XX/XX/XXXX I was trying to figure out what was going on with regards to the 2nd mortgage as I thought it was paid, and because they were going to foreclose I had to start making payments on XX/XX/XXXX of {$1700.00} per month up until current. I have sent the following letter to Franklin Credit Management Corporation after a series of very unsatisfactory telephone calls from me to them trying to sort out the issues described below : To whom it may concern : I have been in contact with your office by phone XXXX XXXX ) multiple times over the past month in an attempt to resolve an issue of outstanding payment that you have identified as a " deferred interest payment, '' but have not been successful in receiving clarification of the several different narratives that have been presented to me regarding that issue. You will note that the statement dated XX/XX/XXXX shows a {$0.00} balance on the loan referenced above, after having received a payment of {$1100.00} on or around XX/XX/XXXX, representing the final balance figure given for the previous month. You will also note a long history of timely payments - as well as a note on this statement indicating that " if payment is received after XX/XX/XXXX, {$0.00} late fee will be charged. '' You will also note that on the statement dated XX/XX/XXXX, there is a description of " Transaction Activity '' that shows that there has been a {$48.00} " Late Charge Assess ( because full payment not received by XX/XX/XXXX ) '' even though the balance of principal and interest is still shown to be {$0.00}. Additionally I have attached a copy of a letter dated XX/XX/XXXX indicating that there is a payment due of {$1900.00} plus late charges, for a total amount due of {$2000.00}. When I have inquired by phone about this payment and asked for a copy of the terms to which it refers, I have only been told that the payoff amount is {$14000.00}. I recently went through a chapter XXXX bankruptcy that has completed and is being discharged in the next month. I have 2 loans on my home. One for XXXX and a smaller loan for XXXX through a company called XXXX XXXX XXXX XXXX XXXX : XXXX XXXX XXXX XXXX XXXX, NJ XXXX XXXX I was instructed by the trustee in our chapter XXXX case to contact the mortgage company for future payments. I have done so, but they will not tell me what the balance is, what the payoff amount is, or anything else, they only give me the option to pay on their website, and have cussed at me and my husband on several different occasions, hung up on us, and refused to send any statements to my home. I have not received any correspondence from them over the last 5 years, and have requested it in writing 6 times now. Each time I have complied with what I am asked to do, and each time I am refused information on my mortgage loan. I'm starting to think that the loan may be paid in full by now. We paid XXXX in arrears, and XXXX in principal on the loan for a total of XXXX. I just want to know if I have a balance left so that I can pay it off in full, or if the loan is already paid in full, as the initial loan was only XXXX. I can't get a straight answer from their company, as soon as I give them my mortgage account number they either put us on hold, for 20 min., sometimes as much as 45 min. at a time ( hoping we'll hang up ) or get viciously nasty spewing expletives, and hang up on us for asking about the account. I have lived in my home for several years. I initially had XXXX mortgages ( $ XXXX and $ XXXX XXXX but they were ultimately combined to XXXX lender, as a part of the nationwide foreclosure fraud finding matter. My mortgage was modified and I have paid XXXX note for over XXXX years to XXXX lender. In the last year, I started receiving notices from different lenders advising that I was behind on the $ XXXX mortgage. Ultimately those lenders morphed into XXXX XXXX XXXX XXXX XXXX, as Certificate Trustee on Behalf of Bosco Credit XXXX. When I advised that I knew that there was only XXXX mortgage because it had previously been combined by XXXX, they could offer nothing to support otherwise. I confirmed the same with XXXX, where a supervisor advised that the loans were combined. They still however took me to court where I appeared pro XXXX and a XXXX XXXX Georgia XXXX XXXX awarded them by home, I have appealed. The court never allowed me to present evidence from XXXX that would have supported my assertion. But I have researched them and this appears to be their modus operandi all over the country, swooping in claiming that homeowners have defaulted on loans that were modified and they have done nothing to collect on said loans or contact the consumers for many years. It appears to be the second wave of unscrupulous and predatory mortgage lending and collection practices. I suspect that XXXX XXXX XXXX XXXX XXXX, as XXXX XXXX XXXX XXXX XXXX Bosco Credit XXXX bought the paper for my mortgage from a seller who no longer owned it. We had a second mortgage equity line with XXXX years and years ago. After XXXX folded and sold all of their mortgages we tried to find out who our new lender was with no success. We then went through a chapter XXXX bk that discharged in XX/XX/XXXX which listed XXXX as discharged. Five years later in XX/XX/XXXX Franklin Credit Management contacted us saying they intended to foreclose on our home. We have incurred thousands and thousands of dollars in legal fees, our credit has been negatively impacted and the title to our home is a mess. The major legal issue I have with Franklin is that we never received the service transferring notice that is supposed to be sent within 15 days of a mortgage being transferred to another servicing company. Had they complied with the Servicing Transfer Notice requirement ( or any of the other lenders in between XXXX and Franklin ) we would have been paying them and might have even been able to negotiate a loan modification. However, we were not notified. Franklin Credit Management was responsible to notify us within 15 days of receiving our loan for serving and they did not and it has cost us dearly. We have contacted them multiple times trying to negotiate a settlement or modification. They were rude, disrespectful and unreasonable to the point we had to hire an attorney. I truly believe this predatory servicing company is operating outside regulatory guidelines as it suits their purposes

I entered into a repayment agreement with Franklin Credit Management Corp about XX/XX/XXXX. Which I agreed to send the company a lump sum payment of {$8000.00} to be received by mid XXXX XXXX, to bring my delinquency current. After receipt of this lump sum payment, I was to resume regular monthly payments of {$270.00}. To honor this agreement I acquired a personal loan for the amount of the lump sum payment ( resulting in a monthly payment of {$230.00} ) and forwarded the payment to the mortgage company. Unfortunately, my lumpsum payment reached Franklin XXXX day past the payment deadline. Because the payment arrived XXXX day late, another {$4000.00} in fees was added to the original {$8000.00} requirement. The company accepted the {$8000.00}. And I agreed to a new monthly payment amount of {$540.00} for the following XXXX months to satisfy the {$4000.00} in new fees, and to bring my delinquency current. Unfortunately, COVID happened, which left me unable to maintain the $ XXXX monthly payment. I explained the circumstance to the mortgage company, but they are unwilling to help find a resolution. As a result, an initial second mortgage monthly payment debt of {$270.00}. Resulted in a new payment of {$770.00} XXXX {$540.00} payment to Franklin plus {$230.00} payment for the personal loan ). Which leaves me in a worse financial position than i began. I was forced into making an irrational financial decision in a desperate attempt to save my home. I need help. I don't know what to do.

In XX/XX/XXXX a letter was received in reference to a second mortgage debt. I provided information of the bankruptcy discharge, as well as the debt was accelerated nearly two decades ago and various collection activities occurred over 15 years ago. Under the law the debt is time-barred. I disputed the debt with the company, XXXX XXXX XXXX, in which they replied that they wanted copies of acceleration letters. Those letters were provided to them in XXXX. Since that time, they have begun attempts to collect the time-barred mortgage. At no point have they responded to the dispute nor responded to the twice made request for a full chain of title, documentation of the full chain of title, all endorsements, age of debt, last payment on the account, current accounting, last actions taken on the account, calculation of limitations period, original creditor name and address and all alleged transfer dates should be provided under the dispute previsions. A request was also made for all licensing and legal authority to act on and pursue said alleged debt within the state of Ohio. To date, again, nothing was provided yet collection attempts have began. A relative forged my name on a mortgage document in XXXX when I was undergoing treatment for XXXX in XXXX. they purchased a home in XXXX and paid on it for 1 year XXXX then stopped. They then forged a quit claim deed and signed the property over to themselves which I complained about but nothing was done by the state of Michigan or the XXXX XXXX XXXX. Now it is XXXX and I receive threatening and harassing letters from this company threatening to sue me for a debt that for XXXX isn't mine and secondly, they are owed XXXX on a property valued at over {$200000.00} and their recourse is to foreclose on an illegally obtained property which I offered to attest to. However they continue to harass me after 16 years has passed and make threats. The statute of limitations in texas is 4 years and since 17 years have passed, they have NO legal recourse, and no right to threaten me. I received a note on my front door on XX/XX/XXXX from Franklin Credit Management Corporation to call regarding a debt. There was no account number provided. The number is XXXX. I called and the woman asked me to verify it was me by giving my SSN and I foolishly did so. She said it was for a second mortgage in XXXX. I told her I never had a second mortgage and if this was truly a debt it was no longer cals 14 years later. She told me to make a fraudulent mortgage report with the police because it was real and her attorneys were handling it. She said. Could send them an email requesting all of the supporting documentation and gave me the email address but still no account number. ( XXXX ) I asked if I had taken a second mortgage out in XXXX why had it never shown in my credit report? Ever? Because this was fraud. She hung up. I sent an email requesting supporting documentation and if they did not have it to stop calling me. I did not receive anything. After being in a foreclosure process, the mortgage company ( XXXX ) sold the property to Franklin Credit Management. I went through a Loss Mitigation process. They accept my application and I was paying in advance the monthly payment. We ( Franklin Credit and I, XXXX XXXX ) sign up a new mortgage arrengement. It was {$410.00} monthly. Payment that I was doing one month in advance. All of a sudden I realize that they were than applying the payment because they made an escrow analysis and the payment was more.It seems that they do it unpurpously because they have allways want to reposes the house. I believe that is the increase on the payment they should notify me in a letter explaining the reason. Those payments has had to be reported as partial payments and they don't, so my record will show that I haven't made a payment at all what is not true. They are charging me late charges, insurance payments and " other charges '' not specify and by the way my account will soon summited to a Foreclosure Procedure. I can feel a bad intention in all of these.Beside the amount of money that the insurance assign me due to Huracane Maria damage is lost. FEMA is carrying an investigation in these case.

My XXXX mortgage was originally with XXXX XXXX XXXX, who went out of business and the servicing of my loan was transferred to Franklin Credit aka XXXX. They have been nothing but a nightmare refusing assistance unless it is in the form of usury. They refuse to comply with California Statues, specifically, the HBOR. My wife and I were so nervous we completed the application for mortgage assistance incorrectly stating the yearly amiount of income the column which called for monthly. Based on that mistake, Franklin Credit demanded {$24000.00} down and {$1400.00} a month on a {$110000.00} which was originally {$70000.00} and when we emerged from bankruptcy it was only {$56000.00}. I explained the mistake to Franklin Credit who refused to give me another application stating it was too bad and that the loan was recasting. My calculation shows {$110000.00} is at 9 % for 120 months ( 10 years ) however, my original note was only at 8 % for 30 years and my original payment was {$600.00} a month. Furthermore, Franklin does not indicate where the {$24000.00} dollars requested would be applied to. These tactics have XXXX my wife and out, my total monthly income is only {$7000.00} a month.

Franklincredit management company is not proactively to released the lien on my property which court ordered for extinguishing since XX/XX/XXXX and they are using the tactic in case consumer lost their record and have to pay them again. I just recently apply for a loan in late XX/XX/XXXX that is how I found out I had outstanding lien against my property that I need to resolved. Luckily I had my bankruptcy discharge filed with county clerk as permanent record. When my new bank loan reached out to them and they had received the lien release request but they don't work it in timely manner and keep saying call us back next week. My bank called them in first week of XXXX and send them an email on XX/XX/XXXX and today is XX/XX/XXXX I called them and the customer name XXXX told me to call them again next week and hoping their vendor can get it done in the next two weeks. This lien should be taking care of back in XXXX if they respected court order strongly. This is causing a lot time delayed and frustrations. My second loan mortgage company from XXXX is demanding {$65000.00} principal balance and a additional {$23000.00} late fees and delinquency fees to stop the foreclosure on my home. In XXXX , I took out a second mortgage from XXXX XXXX . In XXXX , the loan was sold to XXXX XXXX . In XXXX , I obtained a release of lien so I could sell the property ( XXXX XXXX , XXXX , MI ). At that time, the interest rate was hiked to almost double the original amount due to the loan no longer being a mortgage loan and I continued paying. Als o, I have struggled some financially in the past 5 years and had to ask for a re-aging of the loan. Even though I completed the deferment agreement which stated the late fee balance and interest would be tacked on to the end of the loan, this did not occur and penalties are still showing as due. I never got a notice from the sheriff department about this so I could have gone to court to defend myself. I received notice from Franklin Credit on my door on XXXX/XXXX/2016 that my home was going to be foreclosed on XXXX XXXX, 2016. I had received a letter dated XXXX/XXXX/2016 that i was awarded a repayment plan and had until XXXX/XXXX/16 to respond. I met with my HUD certified foreclosure counselor the day i received the letter and we found that my profit and loss statement that I submitted had income for one year but listed expenses only for one quarter which made my income seem much higher. We submitted a letter of appeal along with supporting bank statements to show that my income was not as high as they calculated. I called in to ask if they received the appeal on that was submitted via email on XXXX/XXXX/2016 the day i received the notice of sale and they said they had not. I did have a mortgage with XXXX for 28 years. Due to economical problems ( lossing my job ), I went through 4 Loss Mitigation process. At the end, the bank sold the account to a collection agency ( Franklyn Credit ). Again, I went through another Loss Mitigation process. I received a letter recently from Franklin Credit who is suddenly and mysteriously regenerating a bill that was closed out in a foreclosure back in XX/XX/XXXX-XX/XX/XXXX for a property they even have listed improperly at XXXX XXXX XXXX XXXX NC and the physical address was XXXX XXXX XXXX XXXX because the Attorney we hired who was handling everything had committed some fraudulent activity with hundreds of clients just like myself and I wound up with 2 Payments to different lenders at ridiculously high rates and not long after he wound up in XXXX for this subprime lending scam. This is XX/XX/XXXX and this was generated coincidentally on the same exact date that I had called XXXX complaining about my FICO score being 30 points lower that my XXXX or XXXX FICO scores. I can not afford my home ; I requested a loan modification from XXXX Franklin and they approved me at a payment I can not afford. So, I tried to do a short sale, hired a Realtor, obtained an offer over the value and my realtor submitted to the lender. They took 2 weeks to review and then denied me for no reason, other than they want over {$100000.00} more from a buyer of what the house is worth. I know for a fact they have approved hundreds of other short sales using the market value. They refuse to use the market value with my situation. There is no other rational explanation on why they will not treat me the same as others clients. On XX/XX/2017 I received a letter from XXXX XXXX XXXX XXXX stating I owed XXXX. They said if I do n't respond in 30 days they would assume the debt was mine. I responded the business day by certified mail asking them to validate the debt, prove that I signed a note of some kind and prove it is not a scam. I also flied a complaint with the Minnesota Attorney Generals office asking the company to " Please provide proof that the debt is mine, that they have the legal right to collect, and that this debt is not some sort of " Time Barred Debt. '' I am worried that this company is trying to scam consumers into paying debt they legally do not owe. I am a father of XXXX and work three jobs just to stay afloat. My partner and I bought a house in the XXXX redevelopment area in XXXX, CO in XXXX. Right after we signed these mortgage documents, our loan was sold to XXXX. Unfortunately, our house was foreclosed in XXXX. We never received any documentation as to the loan being transferred to another company or any other subsequent companies. My partner filed Bankruptcy while we still lived in Colorado and I did not. We were told by the attorney that his bankruptcy would take care of my obligation. In 2012 i applied for a HAFA short sale with the primary mortgage holder and Franklin Credit Management the primary mortgage holder approved the short sale, a couple of months go by and Franklin Credit would not give an answer at that time the potential buyer pulled out. The house then went into strict foreclosure XXXX XXXX with a law end date of XXXX XXXX. I have experienced what seems to me as harassment from Franklin Credit Management Corporation. Franklin credit has not been showing up on my credit report however I received a letter in the mail stating the amount that was old as well as well as a certified letter on XX/XX/XXXX giving me 30 days to contact them. I worked wit h Franklin Credit to arrange a payment plan to get back on track after experiencing financial hardship. On XXXX / XXXX / 17 I submitted a down payment as requested and have yet to receive any documentation stating that they received they payment. Today ( XXXX / XXXX / 17 ) I called them to ask if they had received my wire transfer in the amount of {$1900.00} and I was told that I would not be receiving any documentation on the status of my loan unit the repayment plan was complete ( 24 months ), and they also would not verbally tell me if the original down payment was received. I tried to call an additional 3 times and either got hung up on, or was transferred to a managers voicemail that was non existent. I find this very hard to believe and I feel uncomfortable paying additional payments if they can not verify to me that they are receiving payments.

I bought my home in XX/XX/XXXX. I was approached to do a second mortgage XX/XX/XXXX to do some needed repairs on our home. I did not really understand what I was were getting myself into.
