On XX/XX/2020 I was served a summons for debt collection. ( However, it was not served directly to me, it was served to my boyfriend. This is the first time I was notified of the debt. I went to court to file my answer, and was informed that the case had not actually been filed. 807. False or misleading representations ( 5 ) The threat to take any action that can not legally be taken or that is not intended to be taken. ( 9 ) The use or distribution of any written communication which simulates or is falsely represented to be a document authorized, issued, or approved by any court, official, or agency of the United States or any State, or which creates a false impression as to its source, authorization, or approval. ( 13 ) The false representation or implication that documents are legal process. In the paperwork I was served I was not given the option to dispute the debt, only to file an answer, which I was unable to file because they had not actually filed a case. I wrote a letter to the company, with a copy of my answer ( sent on XX/XX/2020 ) stating that I was willing to pay the debt that I owed, but because I was not made aware of the debt until now I should not be held responsible for the interest or attorney fees. I then received another letter in the mail giving me a number to contact if I was interested in settling the debt. ( Dated XX/XX/2020 ) I called the number, and voiced the same resolution to the debt collector. She immediately stated that she had been trying to reach me since XXXX and had sent three notices to my address, then put me on hold to get the settlement amount. While I was on hold I went through my phone and did not find record of any voicemail and went through my unopened mail and did not find anything from the debt collector. When I was taken off hold I told this to the debt collector, and I was told that it was " petty for me to be arguing about this. '' I said that I thought the account was closed, and did not know another charge had been allowed to go through, I was never notified by the creditor or the debt collector until I was served the " court '' documents. She then began to verbally berate me, saying that I was irresponsible and that " she always checked to make sure her accounts were closed '' and that I was responsible to follow up, while not taking any ownership of the creditors or her responsibility to notify me in writing of the debt. I hung up the phone, and she immediately called me back demanding my credit card information. I requested that I be given records of the times she attempted to contact me by mail and by phone because I had no record of it, and I assumed she would have this information if she was planning to take me to court for the debt. She told me she " doesn't have time for this '' and was " done wasting time on the phone with me. '' She hung up the phone, and I then called back and asked why she was refusing to provide documentation. She told me she would request the documentation IF I settled the account and I would get the documentation IF the request was approved. She refused to give me any more information and repeatedly asked for my credit card number, saying things like " well I guess we'll see you in court and you'll have to pay the full amount instead of settling it now. '' I also asked her how she would have left voicemails on my phone when she was not aware that it was a private voicemail because I do not have a greeting on my voicemail identifying that it belongs to me, she became very rude and short with me. I was told that since I am not paying the attorney fees and interest it will be filed as a partial settlement and my credit would be negatively affected. I agreed to settle after being repeatedly harassed for my credit card information and told that I might get the information I requested in the mail.

In XXXX, the banks were in crisis. We had been given a 2nd mortgage by XXXX XXXX XXXX to put a new addition on our home at XXXX XXXX XXXX XXXX XXXX CO XXXX. Back then, the values of the homes were inflated so the loans could be approved. Shortly after obtaining the loan, the banks crashed. We had our primary mortgage with XXXX XXXX XXXX, one of the largest culprits in the scandal. We had purchased a new home, and our realtor suggested renting our old property since we could never sell it and pay of the existing mortgages. We had a renter for a year and he lost his job due to the economic decline back then. The payments were not being made. I worked with a realtor for almost a year to attempt to short sale the house. XXXX approved us moving forward with the short sale if we paid them {$3900.00}, which we did in good faith. We had a buyer and were ready to close. Out of nowhere, XXXX XXXX XXXXXXXX put our home into foreclosure, just a day before we thought the short sale would go through. The home was foreclosed on, and XXXX XXXX XXXXXXXX did not take any further action on us however the 2nd we had with XXXX XXXX XXXX would not budge. XXXX wrote off the debt and most likely received a huge tax credit and turned us over to Francy Law firm for collections. Francy sent us threating notices to sue and if we didn't settle with them, they would take us to court, file a judgement against us and they could ask for ( and win ) 25 % of our income as a monthly payment. l I was scared, working a full time job and didn't know how to fight this. We couldn't afford an attorney. We believed what they were telling us, so we signed a settlement for the debt for a substantially lower payment than the 25 % of my income. The loan started out at {>= $1,000,000} and we have since paid {$35000.00} on a home we no longer have. The foreclosure caused my credit to take a hit for a few years. We still owe a balance of {$37000.00} and we are seeking help/advice if there is anything at all we can do? We have paid {$35000.00} in good faith to Francy ... our job with XXXX is questionable. They just laid off XXXX employees and we are looking to retire soon. We would really like to get out from under this if possible. Thanks for any help you can provide.

I was sent a letter in the mail XXXX XXXX2020 from fancy law firm in regards to a charged off auto loan that I had with XXXX XXXX XXXX as soon as I received the letter I called them to see what my options were I offered to make a XXXX dollar payment arrangement a month until I can go back to work when I will be able to pay XXXX dollars every XXXX and XXXX of the month which are my pay periods they told me that those options would not work I will have to pay more than that because the interest rate is over XXXX percent I still explain to them what my income was and the representative that I spoke with said they will Sue me and they will also try to reach out to the other party listed on the auto loan. On XXXX XXXX two thousand and twenty a representative named XXXX contacted me I missed her original call so I called back about an hour or so later I again explain to them the payment arrangements that I could pay and at that time XXXX became very aggressive and very rude she said that I could have paid my stimulus check for the debt I could have used my unemployment I told her I didn't have any unemployment to give at the moment she said they could take my unemployment XXXX also said they will continue to call until it gets resolved or they will Sue me in court she also stated that she would contact the other party which is my great aunt on the loan she asked me what kind of income my great aunt had what I had on her and I told her I had none to give, and she continued to just get more and more aggressive and very, very rude, every time someone calls from this law firm, they are very rude and nasty, they threaten you, I understand that they do not have to go with the payment plan that is offered, however, they still need to be able to handle calls in a well manner, they should not treat people the way that they have been treating them. When I first reached out to this law firm, the very first representative I spoke with said the minimum amount they could take was XXXX from me, however, she did not reiterate if that was every XXXX weeks, every week or every month, so if me offering XXXX every XXXX and XXXX, once I go back to work, is not suitable, they should have never told me that amount if that was a lie

I wrote to global check services regarding the extensive fraud that has occurred under my name and disputing the demand for payment that I continue to get from this company, and their response was to send information that I dont know how to get. They are requesting {$500.00} from me for online gambling for a XXXX XXXX account that I dont have. This money should have never taken because my accounts were closed back in XXXX. I have attempted to resolve but are asking for a notarized affidavit of forgery. All I have is my FTC report # a submitted police report along with identity theft alert and locked credit reports. Im not sure what I can do to satisfy their requests and frankly I have been jumping through hoops and even obtained legal counsel since my bank did not follow regulation E when I noticed the unauthorized transactions on my accounts. They did not investigate until my money was stolen from my account. I have issued several statements regarding my banks misconduct only to continue to fight for my rights. I would appreciate any help you can give regarding my situation. I am failing when I continue to point out and explaining that due to their inability to follow regulation E my accounts would be in good standing given their decisions to not give me any money, since no investigation was done in the appropriate time frame. That the account in question with XXXX XXXX XXXX should have never been an issue since this was part of many, fraudulent transactions that I had brought to their attention back in XX/XX/2020. Im not sure what to say about the account that is requesting that I pay since I am not sure how any money would have been received from the closed account. If theres any other way to get money from an account that was closed In XXXX, specifically the XXXX of 2020 that would be all for XXXX XXXX XXXX to explain, since I opened a new account, it has been compromised but they continue to refuse me my disputes. I have never used the new account that is also been closed due to money lost. I just dont understand how much I am supposed to lose that XXXX continues to refuse lawful assistance according to the EFTA/ FCA/regulation E and so many other consumer rights that are being dismissed.

The language on the XXXX XXXX XXXX is threatening. It states in part "a bench warrant "will" be issued for your arrest" which was highlighted in yellow marker. I cannot believe that XXXX XXXX XXXX Attorneys allow their collection attorney to use this kind of threatening language as a scare tactic to make someone pay considering the FDCPA "least sophisticated consumer" language should apply. This is a classic definition of a "least sophisticated consumer" This was originally a $XXXX CC for an XXXX yr old kid when she opened her bank account. The debt now states she owes$XXXX. She had tried to work out payment arrangements with XXXX XXXX. And was successful in making some of the payments but school, and job constraints made it difficult to keep current. This complaint is against BOTH XXXX and FRANCY LAW FIRM XXXX XXXX XXXX Atty Reg# XXXX, XXXX XXXX XXXX, XXXX XXXX, XXXX, CO XXXX phone # XXXX- Case#XXXX There is scheduled for appearance hearing XXXXXX18.- Law Firms, Banks, Credit Union, et.,al. should not be allowed to use this or any kind of language that threatens a person with incarceration because of a money debt. This language caused a serious physical and emotional stress in XXXX XXXX because although she has a fulltime job she does not make enough money nor does she have the money in saved to pay the debt and she was fearful of going jail. This scared her to death and know one should be scared that their freedom is going to be taken away because they have the inability to pay a debt.

My ex wife sent me the letter today XX/XX/2022 for a judgement filed by francy law firm. All payments and communication was always sent to my ex wife as she is the primary on this account. I was never called or emailed by this company letting me know that she was not making the payments on this account. They are now using legal tactics to threaten me to pay without any written, or verbal communication. I called the number listed on the form for francy law and left 2 messages today XX/XX/2022 and was sent to voicemail. No one has returned my calls. As I was never informed by this company in anyway I now have been threatened by them with legal action to sue. This falls under the threatening tactics law set to protect coustomers from these actions.

I have been harassed by Francy Law firm for the entire pandemic. I lost my job due to the pandemic. Francy Law have sent two employees to my house during a pandemic threatening to sue me. To take my stuff. Putting my family at risk of a deadly global virus. I have called them to let them know I dont have a job and they keep harassing me. The total owed is {XXXX} and they are harassing me daily. Weekly. Milllions of people have died and every time they knock and hand me filthy paper work, they are putting me and my families health at risk. I dont even actually owe, this owes amount is fees the bank charged me. Fraudulently! After I had already closed my account.

Fancy law has harassed me, took money out of my account without notice twice. I have been paying on time the one month my credit card info was stolen and I couldnt pay she threatened to sue me and garnish all my wages until paid.
