Therefore, my position is being clearly stated, these accounts do not belong to me, meaning that you are reporting inaccurate account information within my credit file. The fact that these are inaccurate account information means that you, this credit-reporting agency, are reporting incorrect accounts. 1. FMS INC bal. {$1400.00} I am well aware of my rights as a consumer. The Fair Credit Reporting Act requires that you, the credit-reporting agency report accurate and/or correct account information within my credit file. My credit issues are very specific, these accounts and/or items do not belong to me. This means that you are reporting incorrect account information within my credit report. It is this in mind that I request that these listed accounts and items be Blocked and Deleted. XXXX XXXX credit card Summary : The credit card company and its collection agency refuse to provide verification of the debt they claim I owe but continue to insist I make payments. In response to my inquiry, they sent incomplete information that does not show all payments made and the total due on the document they sent does not correspond to the amount they claim I owe. I have sent numerous letters and had numerous phone conversations and they still refuse to provide debt verification documents.
Details : Due to unforeseen expenses, I fell behind in credit card payments, including XXXX XXXX. XXXX/XXXX sent my account to XXXX XXXX XXXX for collection. See attached XXXX form dated XX/XX/XXXX ( Atch 1 ).
I made payments to XXXX for a year, then received correspondence from FMS Inc., dated XX/XX/XXXX ( Atch 2 ) that my account had been placed with FMS for collection. I did not receive any notice from XXXX, XXXX, or XXXX XXXX that my account had been sent to another agency. The FMS form included a balance due that appeared extremely high and I called FMS on XX/XX/XXXX to discuss this amount. FMS rep. XXXX XXXX told me the record showed my last payment was XX/XX/XXXX ( acknowledgment of payment made to XXXX - Atch 3 ). I said I made a payment in XXXX ( Atch 4 ). I called back on XX/XX/XXXX and spoke to XXXX XXXX ( XXXX ). She also said no payments had been received. On another occasion, I talked to FMS rep XXXX XXXX who said they would get a record of payments from their client and send to me. XXXX said I should wait until he gets the information before making more payments, and that he would call me. I also talked to FMS XXXX XXXX on XX/XX/XXXX who told me the client had not yet sent the records ( contemporaneous notes Atch 5/1-2 ). On XX/XX/XXXX I went ahead and made a payment ( Atch 5/3 ).
When I received the information that was supposed to verify the balance due, the package was nothing more than copies of old XXXX bills. The last XXXX bill showed a XXXX balance and payment due the previous year ( XX/XX/XXXX ) of {$950.00}, considerably less than the balance claimed by FMS ( Atch 6 ). No records of my payments in the interim, including payments to XXXX XXXX XXXX were provided. I contacted FMS and was told this was all the information they had. I asked about my payments to XXXX but they said they could send me only the documents that XXXX provided. They ignored my claim that I had paid XXXX for a year then started sending notices to make a payment.
On XX/XX/XXXX, I wrote to FMS with copy to XXXX and XXXXXXXX XXXX - sent by certified mail - reiterating the sequence of events, that verification sent was of incomplete, and requested each to provide the documents I had requested ASAP ( Atch 7 ).
I did not receive a response from XXXX. FMS sent a form dated XX/XX/XXXX, stating that my XXXX credit card account had been closed and returned to XXXXXXXX XXXX ( Atch 8 ).
I received a letter from XXXXXXXX XXXX dated XX/XX/XXXX, stating, " We are currently reviewing our records in order to provide you with a meaningful response. As soon as we complete our research, we will send you a letter than will explain the results of our review. '' ( Atch 9 ) I heard nothing more from XXXX for weeks so I wrote again XX/XX/XXXX, noting that I had not received a response, and providing copies of previous correspondence ( Atch 10 ).
Then FMS started calling me again, after saying they had closed my account. I again wrote to XXXXXXXX XXXX, letter dated XX/XX/XXXX ( Atch 11 ) but have not heard from them. FMS continues to call me, usually with automated phone messages to call them. When I talked with an FMS representatives on XX/XX/XXXX, he continued to insist they had sent all the information they had. He repeatedly persisted with this argument to the point of harassment.

After reviewing my XXXX credit report I was very concerned to realize that I had negative items listed that are all medical debt from the same company FMS Inc with the original debtor showing XXXX. I immediately contacted XXXX and was told they did not have any services rendered to me with a balance owed ( I am including documentation ) which shows any services I had have a XXXX balance and that had if had any services ( Which I did not ) they would have been fully covered insurance. This leads me to believe either this is a matter of identity theft or someone else 's information reporting to my report. I have struggled to navigate through the muddy water of removing these medical debt inaccuracies on my credit report which continue the negatively impact my overall credit. I have never received any communication from FMS Inc stating that I owe the debt nor have they legally validated the debt after several disputes with FMS Inc. as well as XXXX & XXXX I have had continuous medical insurance with my employer since XXXX through XXXX as well as dual coverage from my husband which is a XXXX service member through XXXX. This is also validated through XXXX the original debtor which I am including in documents ( this would leave no reason for an unpaid medical bill ). I have disputed the validity of this debt with XXXX and Fms Inc. multiple times. I do n't know how The credit bureau 's or FMS Inc could accurately or fairly verify the accuracy of this debt and still remain within HIPPA laws. XXXX was unable to validate anything was owed which I am attaching Billing info as documentation. I am including my history with XXXX, My Insurance Info and everything else that should allow XXXX the promptly remove these inaccuracies from my report. I feel very violated that I even need to provide my medical history to show that I have not had services unpaid through XXXX.

I was contacted several times by a company calling themselves FMS, a debt collection service. They asked to speak with " my name '', and I stated this is him, how can I help. They inform me they are FMS and it regarding debt collection. They then refuse to tell me who the creditor is, the reason of the debt and the original creditor until I give them my date of birth and social security number.
I offered to verify they have the correct information or not but they refused to cooperate. I informed them I will never provide that information to a caller, don't care who they say they are. They informed me they can not help clear this up if I do not cooperate. I informed them not to call me again if they insist on this game playing.
Since that first time I was called on XX/XX/2020 at XXXX MT and XX/XX/XXXX ( I do not have the time for that showing up but I am certain I can get it if needed from XXXX ).
I do not remember the date of the original contact but so far I have told them 3 times to not call me again. First not to call if they continue with same withholding information until I provide private information then the 2nd and third time I told them not to call me again no matter what.
I got a letter from them on XX/XX/XXXX that it is a medical debt from a local hospital demanding full price of {$3400.00} which would have been settled with insurance for about {$600.00}. Also, some of these debts may be covered through a Workers Comp issue but they do not outline all the charges, they just say ... Multiple - See Reverse, then just an account number and amount owed is listed on the back. Ridiculous!
I have called back to get information but again need to verify all the social number, date of birth etc.
Company is Oklahoma FMS, Inc. in XXXX Oklahoma. The original creditor is XXXX XXXX XXXX Hospital in XXXX, Idaho.
I am sending a letter to them demanding an outline of charges and dates. They refused to provide information to me or even permit me to place a request over the phone for any information until I verify over the phone.
I want them help to the full extent of the law and penalized for their behavior, demands, and phone calls when told to put in writing and not to call me.

Last XXXX, a Collection Agency I have never dealt with in the past, " XXXX XXXX, '' somehow sourced an old debt of mine that was settled in XXXX and started pursuing me about it. They also added this [ time-barred and Settled ] debt to my XXXX Report, which is causing me a great deal of XXXX since I am applying for student loans for my XXXX.
I originally Settled via FMS Incorporated, which was working on behalf of XXXX to recover the debt back in XXXX I promptly supplied them with a copy of my original Settlement Letter from FMS, confirming my Settlement as of XX/XX/2012. This letter did not convince them. I also Contacted FMS to ask what they can do to assist and they said they can do nothing. All they would be able to do is issue me a copy of the same settlement letter that I have. I contact XXXX multiple times to explain and disputed multiple times with the Settlement letter and told them that this matter keeps bouncing around like a hot potato.
I've kept my documentation and do not understand why ; despite hours of conversation, this debt is still on my credit report. I've also been harassed by other collectors, some I am sure are scams, about this debt over the last several years. Not only have I shared the Settlement letter, but I've contacted XXXX XXXX XXXX at XXXX, to confirm and they were able to pull up the account and certify for me that there is a {$0.00} balance due on that account and it is settled. I asked them for a letter I could share with XXXX XXXX and FMS, but XXXX said they " can not print one because it is so old, but if XXXX, XXXX XXXX or FMS want to call them they can certify it for them verbally. '' Since the housing crisis, I've worked very hard to repair my credit -- and this is the worst possible time for this to happen. No one is willing to accept the proof I have or seek certification from the original creditor. I believe this is a breach of the Fair Credit Reporting Act. What recourse does a consumer have in a situation like this? It seems, none.

On XX/XX/XXXX I contacted FMS to resolve my debt based on my credit report. I asked the representative what my total balance was with their company and she looked up several accounts and gave me a large sum. I asked for a settlement offer and was told {$520.00}. I accepted that offer and paid that sum of money. I paid {$520.00} and thought that it was the end of my business with FMS.
On XX/XX/XXXX I received 2 bills in the mail for 2 more accounts with FMS dated back to XX/XX/XXXX. I re-checked my credit report and continue to see 4 balances with FMS which are different than what is listed on the bills. I contacted the company and they didn't seem to have any knowledge of the paid accounts. After providing extensive information, They finally located my payments and informed me that I paid for a number of other balances but that these balances are unpaid. They refused to tell me which balances have been paid ( so I can distinguish the paid balances that are inaccurate on my credit report ) and they are unable to provide me with an explanation of why I still owe them after I was given a settlement balance offer to settle all of my accounts with FMS.
I was told that I was settled up with FMS only to find out that they did not disclose 2 accounts and they are continuing to try to collect on those accounts but will not provide the info for what I have actually paid for.

I get several missed calls and then when I do pick up I am hung up on and this time it was from phone # XXXX on XXXX @ XXXX pm XXXX. I called back and asked for a supervisor to find out why people are calling and hanging up on me and to the nature of the call as well.
Repeatedly when I would ask a question I was responded to with a question. When I finally spoke to a " XXXX '' who claimed to be the supervisor he said he was with FMS and they are an asset management company. I had repeatedly asked if this is a " debt collection company '' for which again I would receive either no answer or a question back in response.
This is very shady and deceptive to say the least and all I could gather from the call and from speaking to XXXX is that FMS is an asset management company and he said he was located in XXXX.
I do have my call back to FMS and XXXX recorded and am more than happy to provide a copy by whatever means necessary.
XXXX ended the call by asking if I wanted my number removed as if this was a telemarketing call. I told XXXX I am well aware of the FDCPA laws and and believe this is a collection call so I told him to " cease and desist '' not even knowing if in fact this is a collection call but simply due to the lack of information being provided by FMS XXXX XXXX, it just feels like a typical shady collector call.

Hello, I opened a Visa Credit Card in one XXXX XXXX XXXX on XX/XX/XXXX with a temporary account number. The permanent account number and credit line should be sent to me with my card afterwards.
However, I never received anything regarding this credit card until I received a call from a collection company ( FMS, INC ) recently. During the call, I found out that the mail address they had was wrong ( missing the XXXX XXXX " XXXX '' ). That's the reason why I have never received any documents from this credit card account ( issued by XXXX XXXX ), neither the physical visa card. I have copies of all receipts with wrong mail address, which have been resent to me by FMS. I will upload one month as example, but can provide all, if needed.
As of XX/XX/XXXX, the total balance due is {$190.00} ( with initial balance {$38.00} in XX/XX/XXXX ). Additionally, my credit score has been impacted significantly.
I have contacted FMS and XXXX XXXX to dispute the interests charged on this account and to get my financial score corrected on the credit report. Highly appreciated for your help!

FMS Collections is harassing XXXX of our deposit customers over a duplicated mobile deposit check item that had already cleared customer 's account.
Our consumer paid a common laborer XXXX XXXX XXXX XXXX {$180.00} for labor. XXXX XXXX deposited this check by mobile deposit with another bank ( XXXX ). This item cleared consumer 's account at our bank. Later, XXXX carried the original check to XXXX and cashed it there. Our bank returned the check as a duplicate item. XXXX referred it to FMS Collections and who has been harassing XXXX XXXX. They refuse to talk with our bank with our consumer present to try and resolve the issue. Our consumer does not owe XXXX the money. XXXX does. XXXX has since been arrested and jailed on other financial crimes with other citizens and bank. Our consumer was unable to get any assistance with XXXX since XXXX is the party that has the original claim against our consumer. It is only {$180.00} but he should not have to pay the item since he does not owe nor should XXXX XXXX Bank have to pay it. Thanks

I have asked FMS to verify that I owe this debt on three separate occasions. I attached the letter that i have sent. Their response has been that they only have access to certain information. They have not provided the original copy of the contract between myself and the original creditor, the proper legal assignment contract between them and the original creditor. A line by line accounting of the original account, including detailed transaction history. Proof that they are licensed to collect debt in Colorado.
What they have sent are a bunch of statements with no transaction history. They just show late fees on top of late fees. Absolutely, no transaction history.
I have spoken with a lawyer and he told me that without the above referenced verification this will not stand in court.
Once, again I am requesting what I asked for in my original letter. If you can not provide that to me, collection efforts need to stop. This is a clear violation of the FDCPA

Received call from FMS at work on XX/XX/XXXX and called that following day before there office closed and spoke with one of there representatives that I can not receive calls at the workplace. They advised me the number was removed. I Received another call on XX/XX/XXXX at work from XXXX XXXX. I then Contacted FMS XXXX XXXX XXXX ( FMS ) again since it was the weekend that following Monday and spoke with XXXX on XX/XX/XXXX advised XXXX to remove my work phone number from there list and advised them my workplace does not allow personal calls. I then received another call from another Male from FMS after my co-workers advised them I can not take those calls at the workplace. The company refuses to listen to my requests on having the company remove my work number since i can not take personal calls in the workplace. XXXX also threatned that if i didnt pay up there was going to be a nasty report sent to the major credit companies. She was short and rude.

In two written statements to FMS INC I've made it clear that the two accounts in collections that they hold on my credit report are not mine and are a result of Identity theft. Dates of both letters are XX/XX/XXXX and XX/XX/XXXX while expressing to cease contact.
I received three calls today, XX/XX/XXXX and three calls a day for the last two months attempting to collect this debt. I've blocked each number. A new number calls each time and the voicemail state FMS INC in an automated attempt to collect.
Today, XX/XX/XXXX a XXXX account was made with my name, pictures of my family and a profile picture that was not me. Also, a XXXX number was used. This account showed up on mother 's account impersonating me and or trying to gather information on me.
Either way this is disturbing behavior and a part of a long series of behavior to either use my identity or collect on debts that are a result of identity theft.

Good afternoon, I received a phone call on XX/XX/2020 at XXXX XXXX from a private caller who then transferred me to a representative on my old nay account this phone call was from FMS collection. We are in the middle of a pandemic where my finances have been affected. the representative i spoke with was very condescending and belittled me. I explained my work has been affected and his response with a little laugh was we have to keep the economy going and we still have to pay bills. After explaining my situation he said he was going to report me as refusal to pay and hung up on me. I have not received any letters from this company at all informing me that they have my account. This is horrible and the worse phone call I have ever had to deal with. I would like to know what can be done about this and how I can get proof on who is handling my account along with a letter in the mail for a number to contact.

In XXXX and AXX/XX/XXXX XXXX did not post payments to my XXXX 's account in a timely manner. I have repeatedly provided documents from XXXX XXXX to prove those payments were made, in full and on time. XXXX charged late fees for bills paid in full and on time. Then they repeatedly charged additional late fees for the unpaid late fees until they got to {$290.00}. They stopped charging the late fees when they " ACKNOWLEDGED '' that they had in fact received both payments on time and in full : XX/XX/XXXX paid in full {$370.00} XX/XX/XXXX paid in full {$170.00} In spite of the fact that XXXX provided the documentation proof, XXXX did not remove the charge for late fees of {$290.00}. Several collection agencies call and harass me and my family trying to get ILLEGAL FRAUDULENT late fees paid. They continual add these late fees to my credit reports as NEW items hoping that I will just pay them anyway

After repeated calls from XXXX XXXX XXXX XXXX XXXX XXXX XXXX, OK XXXX I called them back in an attempt to find out what the nature of the debt they were calling about was. After several minutes talking to XXXX XXXX where she got my information to make sure of my identity she finally told me they were a debt collection company and trying to collect a debt. This was after she questioned me about my identity.
I asked what the debt was several times and was never told. I asked for a supervisor and again they began asking me my name, dob, social security number, address and phone. I declined to give the information again and was hung up on.
I can't verify that this is a legitimate debt as they will not give me any information.

XXXX old, expired checks from a jobs training program were cashed by a a XXXX branch. XXXX checks had been voided and they clearly stated in bold, black lettering that they were " VOID AFTER 90 DAYS. '' XXXX hired FMS, Inc. to collect the debt. Their agent called the XXXX office shouting, demanding money, claiming I was violating the law by not giving it to her. I sent FMS a letter ( attached ) asking them to provide proof of debt. ( delivery confirmation attached ) because I had received a letter from FMS saying they are attempting to collect a debt and that I need to respond within 30 days, ( letter attached ) which I did.
