In XX/XX/XXXX, I tried to get Flex Path Capital ( XXXX XXXX XXXX XXXX # XXXX XXXX XXXX FL XXXX ) to voluntary repossess my car but my account manger would not follow up on my request. In XXXX XXXX, I was about to trade the car but I was unable to due to my credit score with the late payments. XXXX XXXX, I mailed a request in writing to get my car repossessed and left voicemails on XXXX phone. The car was eventually towed by my apartment complex after she also spoke with XXXX who thought I just didnt want to pay for that car and he was advised it was stilling for several weeks without tags. I told the complex manager I was trying to get Flex Path to pick up the vehicle, but they never did and the complex towed it. In XXXX of XXXX, i purchased another vehicle and was advised that the loan with flex path was charged off. I sent another letter on XX/XX/XXXX, letting them know I have received emails from the Recovery department and on my credit report the loan is still open. I havent made a payment since XXXX and the loan is still reporting late payment 150+ days late. In XXXX of XXXX, when I received an email to contact this company about a settlement. The discussion for heated because the {$8400.00} thats on my credit was now over {$13000.00}. The original company ( XXXX ), I got my car from owner was indicted on federal charges for fraudulent schemes in XXXX of XXXX.

Please refer to my prior complaint : XXXX My loan was being serviced by XXXX XXXX XXXX XXXX XXXX XXXX or XXXX XXXX XXXX at one point. Initially, I complained and they claimed they could " neither confirm nor deny '' that I had any loans with them. Finally, after several phone calls they were able to give me a phone number to the new student loan servicer which is Flexpath Capital, LLC.
I was able to contact someone there and they said that they were now servicing the loan and that it would take time for them to input my data into their system. I provided them with my updated information and they said that for now, I should pay my student loans by telephone. I have been making monthly payments over the phone in the amount of {$700.00} since XX/XX/2021. I have not received a statement nor is it clear if they even have information on the original loan. At this point, I'm not even sure if the loan is valid and I'm simply paying because they simply think I'll continue to pay without question. We've asked for login information and gotten nothing. Now, six month later I'm still paying telephonically and there's no way for me to track who actually has my loan.

I am a victim of identity theft. Due to the Corona Virus Pandemic, we are all facing which has me sitting still at home and I saw the recent news about the multiple XXXX Data breaches. I decided to look at my credit reports from the 3 major credit bureaus and found that someone had used my Identity. I have no idea how the theft took place. I also have no knowledge of any suspects. I did not receive any money, goods, or services as a result of identity theft. I contacted the Credit Bureau and told me to file an Identity Theft Report which I am doing. I appreciate your effort in getting this matter resolved. Thank you. Please let me know if you need any other information from me to block this information from my credit report. Thank you.

After filing a complete with the CFPB on XX/XX/XXXX the loan from Flexpath Capital is still open after requesting for it to be closed. The last payment made on this account was XX/XX/XXXX. The company responded that the loan is being handled with a XXXX XXXX but is still open. This company XXXX XXXX XXXX XXXX was Dissolved on XX/XX/XXXX. Even after reposting the errors with the Credit Bureaus it would drop and reappear as open.
