I took out a payday loan with 605 Lending ( FSST Management Services , LLC, d/b/a 605 Lending ( referred hereinafter as 605 Lending, LLC ) ) for the amount of {$500.00} after experiencing an emergency. At the time, I was asked to call to complete the loan process where they say their script on the contract, outlining that the agreement I was to be spent should be signed online to complete the process. All this time, the person who is handling my case is providing me with an overview about the interest minimally -- as in the rates are stated on the agreement that they then asked me to sign and submit while they were on the phone with me. I did not have a chance to go through the exact fine print or terms, but was able to see the percentages at the top and the amount owed. They also said that I was to make payments for the next 12 months bi weekly as per my pay schedule, and I went through and logged each upcoming pay date. They also showed via the page I was provided that the loan would be charging an AYP of what at the time I thought was 440 %. Very expensive but being desperate and pressured I signed and received the funds. Later, I was able to log into the account and reread the loan terms but noticed there was a higher interest rate than I previously saw at over 775.96 % and each payment would be {$150.00}, making the loan well over the originally borrowed {$500.00}. I paid as the terms were outlined though unhappily, especially since no one covered nor is it stated how the principal amount would be payed using my payments. As time moved forward and a few payments were made I had a few issues with early payment processing and subsequent overdrafts on my end and asked the company to switch from ACH debit via writing/ email. They agreed, but sent a LONG email with a gist of " Remember to follow the terms YOU signed and pay this loan, etc. '' which I understood and said thank you for. In this same email I saw that they were then asking that I send my payment or call in for payment 3 DAYS PRIOR to my original due date and that if i did not I was by proxy allowing for them to sign a check in my name for the amounts owed. I declined and called them asking to make sure they knew not only was this not acceptable but unwelcome. I also said that I would not pay until my due date which is my right as the consumer but was met with the same " Follow your agreement '' line. I again stated this was not acceptable and again tried to reach out where I was again met with opposition. Upon further reading the agreement, they have a section labeled under the ACH/ Debit section stating that as the signee I " may not revoke the authorization to prepare and submit drafts on my behalf until such times as the loan is paid in full ''. Under thisclause is then another clause stating another payment option called a " REMOTELY CREATED CHECK ( RCC ) AUTHORIZATION '' and is outlined as such : " If you elect to make your payments by remotely created check ( otherwise known as a demand, draft, XXXX, preauthorized draft or paper draft ), then by electronically signing this Payment Authorization Agreement you authorize Lender to create checks bearing your name and other information as may be required under applicable law, rather than your handwritten signature, drawn on your bank account below, and to submit each check for payment to your bank or financial institution ( Remotely Created Check ) in the amount of each payment due, under the payment schedule or otherwise to Lender under this Agreement or any amount on any dates on which you and Lender later agree. If a remotely Created Check is returned unpaid by your bank or financial institution, then you authorize Lender to create and submit a Remotely Created Check for any late fees or other amounts accrued pursuant to this Agreement. You agree that your typed name or other designation mandated by applicable law will constitute your authorized signature fully reflecting your intent to authenticate any such Remotely Created Check. If you believe the Lender charged your bank in a manner not contemplated by this Payment Authorization Agreement, then please contact Lender. '' After speaking with my bank the tellers both through the online service and at the physical locations ( separate occasions ) said that an ACH and an echeck are basically the same and by revoking one I revoke the other concurrently. Also, If i do not personally authorize each check it is considered fraudulent. At this point I have tried to with no success ask that the lender kindly stop auto drafting from my account but to no success. to date, I have paid {$1200.00} with a remaining balance of {$480.00} -- all of which I am totally unsure as to how I will repay without these drafts. I have contacted the company multiple times and have even attempted to facilitate the issue through the XXXX XXXX XXXX of whom the company did not respond. I am seriously unsure how to proceed and worry this lender will use their means to further hinder my ability to pay off this loan and escape this predatory financial situation.

I took out an online loan through Rushmore Financial, which is an entity of FSST Financial Services, LLC. I was not aware of their affiliation with the tribe prior to taking out the loan. The original amount was for {$1000.00}, and was deposited into my checking account on XX/XX/2020. Since XX/XX/2020, I was making payments of {$330.00}, which were all finance fees and not going to my principal loan balance. So far, as of my last payment on XX/XX/2020, I have made a total of {$820.00} ACH payments to them, yet I still owe a balance of {$1000.00}. I wanted a copy of my contract, to look over the loan agreements, as well as my payment schedule. I spoke with a customer service representative, and I was informed that I can not get my contract via email due to the fact that " Electronic documentation can be altered. It has to be faxed or mailed. '' However, none of my original documentation was ever emailed or mailed to me, nor was it even offered to be emailed or mailed when I first applied. The reason I was requesting this information is because I called on XX/XX/XXXX to get the payoff amount for my current loan without any fees, as I would have liked to pay off my balance on Friday, XX/XX/XXXX. However, I was informed by " XXXX '' that I have to call 3 days in advance in order to setup this arrangement. But, I have no documentation stating how far in advance I would have to call in order to do that. I asked if there was anyway that I could just make this payment on the XXXX be my final pay off amount. I was told no. Instead, she told me to call back on the XXXX, after the finance fee payment on the XXXX was processed, in order to set that up. I had until XXXX CST on Monday, XX/XX/2020 to arrange that. If I did not make that cutoff, I would be hit with another finance fee. I did not want to pay for another finance fee when I wanted to pay off the entire loan. I asked to speak to a supervisor, who called me back. I spoke with " XXXX '' at Rushmore Financial, and it come to my attention after doing research prior to his phone call that per California State Law, Rushmore Financial is not legally licensed to do short-term/pay day loans in the state of California. I told him of this, to which he informed me that since they are under the umbrella of a XXXX XXXX ( XXXX XXXX XXXX XXXX ), they have no obligation to follow local or state laws in the state of California. This is not true, per state and federal laws. It is also illegal to lend a loan of any kind without providing the consumer with a copy of the signed contract via email, mail or fax. I informed XXXX of this as well, as this was not offered to me upon signing the contract, and I still do not have a copy of the signed contract. They sent over recordings of the original phone call, stating that I would have to sign it. But, the contract was not emailed to me, nor did I get a copy of it sent to me after signing it. I was told on the phone by XXXX that since I did not request a copy or make my own copy prior to signing, it " disappears '' and I no longer have access to it. I have to request for it to be sent to me via mail or fax. XXXX informed me, as well as their customer service team via email, that I am still obligated to pay the loan and that they would be processing the ACH withdrawal on XX/XX/XXXX for {$330.00}. I arranged a Stop Payment Order with my bank to block that from happening, and I informed Rushmore Financial of this. They then told me that if my payment did not go through, I would be hit with a {$100.00} fee, and owe {$1300.00} and it would be sent to their collections department. I have informed them that I would be filing formal complaints, and sending a cease and desist letter via USPS. They have now offered to send my original signed contract as of today, XX/XX/XXXX and stated that they just need confirmation of my address to send it USPS or fax number. I have not responded to that email for confirmation. All of this is documented in my email correspondence. I also have taken screenshots of the call time lengths, and dates of the calls, to show that I did indeed speak to people at Rushmore Financial.

In XX/XX/XXXX I took out a XXXX payday loan from Rushmore Financial. It was one of 6. out of control, I quickly agreed to have XXXX XXXX recommended to me, begin working for me to settle these payday loans. They told me toi send out an offcial letter stating i dont want them to cotninue to take out weekly payments from my bank. XXXX and the rest of them all got these letters. I did recieve 3 different agreement settlements working with XXXX XXXX, XXXX was one of them. I still have the agreement, the email just to confirm a few years later when they first started harrassing me, and my bank records that was set up to hold these fund, that I finished paying my debt to XXXX in XX/XX/XXXX. The past week, my aunt, my cousin who lives in another state and my father have recieved calls from someone claiming to be with the Department of XXXX XXXX, and threatened me that he had no choice but to push this form for wages of my XXXX social securitty to be garnished if I didn't pay the XXXX for this Rushmore Financial debt. As soon as I heard those words, I told him I already paid and go ahead and do whatever cause I have proof. He called me 3 more times, then at night, and now this morning I got a call claiming his name was XXXX XXXX a mediator from XXXX XXXX of sumner working on trying to keep XXXX 's lawyers from prosecuting me to the fullest extent, he claimed they were ready to move forward for identity theft, and fleeing from the law..he even started the conversation by verifying the last 4 of my social security number so innitially I was unsure. XXXX XXXX IS a mediator. He references rushmore lawyers wanting nothing more than toi take me to court, and I stop him to say Dude, i paid that. What do you need from me in order to clear this up? He says he needs my original account number so he can verifiy with XXXX and then close case.., .the thing is..the original account number is my social security, and i reazlized he already knows the last four, ,needless to say harrassing family members whom personal information. was NOT given out to them myself, pretending to be an official with XXXX XXXX i live in, and threatening serious legal allegations for a XXXX dollar loan i paid off in XXXX.

Received a voicemail with a case number and a callback number. Immediately after receiving this voicemail they called my sister trying to track me down. They were looking for me under my former married name which was legally changed back to my maiden name in XXXX as part of my divorce. I was told I was speaking to XXXX XXXX with XXXX XXXX XXXX XXXX. I was told I was going to be sued by VIP Loan Shop for breach of contract and malicious intent to evade payment. I was told they sent me a letter via standard mail XXXX days ago informing me of my debt. I never took out a payday loan. They claim the loan was taken in my name under my social security number and date of birth in 2010. I asked why this was just now being brought to my attention XXXX years later. When I informed her I must be a victim of identity theft she kept repeating that I was ethically responsible for the debt, and because they hadn't received a response to their later they proceeded with a process server to issue me a summons to court. I asked her how I was supposed to respond to something I never received she told me she was a neutral party and could only tell me my case was going to civil court. They claim the loan in XXXX was for {$990.00} but due to interest I know owed {$1700.00}. She also told me my account showed in good standing in 2010, but just recently went delinquent. There were too many inconsistencies and refusal to provide information. Upon researching it, the initial phone call came from Rent To Own Hm XXXX. This phone number appears to belong to a bakery in XXXX, XXXX. The numer I was give to call back was XXXX. The person answering refused to give me a business name. None of what I'm be accused of happened as I regularly check my credit report and no payday loans exist. I advised XXXX that I was filing a police report for identity theft and would hire a lawyer if necessary. She then told me " hiring a lawyer will be really expensive and you'll also have to pay court costs unless you resolve the debt. '' I told her no thanks, I would proceed with the police report and lawyer.

I received the loan ( Application XXXX ) from Rushmore Financial on XX/XX/2020. I asked the man who authorized my loan if I would be able to pay the loan off early without penalty and he said yes. The loan was for {$700.00} with my first payment due on XX/XX/2020. I called Rushmore Financial on XX/XX/2020 to pay the loan off in full. The customer service representative informed me that I needed to schedule my payment more than two days in advance of a payment that was already scheduled and would be required to pay the first fee of {$310.00} that was already scheduled. None of this payment would be towards principal. I emailed the company to complain about the rejection of my payment. I received a response that I needed to pay more than two days in advance. I called today, XX/XX/2020, to pay the {$700.00} balance, which is twenty six days in advance. The customer service representative informed me that I owed an additional {$310.00} in fees because I did not call twenty four hours after a scheduled payment. She stated if I was not paying the full {$1000.00}, she would not receipt any money towards principal today. I then emailed the company again to verify the conversation from the phone call and they replied that I would need to pay the additional {$310.00} in fees. I do not want to continue the payments that are scheduled as the next 2-3 payments are fees only and every payment after that is only 5 % towards the principal amount. I requested a copy of my loan documents and have not yet received them. I went back to the email that was sent for me to sign the loan and the link no longer works and I can not obtain my documents online.

On XX/XX/2022, I received a call/voice message from number ( XXXX ) XXXX, from a woman named XXXX XXXX claiming to be with the Florida State Processing Department and informing me that they had been contacted by firm XXXX XXXX XXXX who were seeking to file a collection claim against me via the XXXX XXXX XXXX XXXX I called the firm with the direct line and case number provided to me in the voice message and spoke to " XXXX '' ( didn't get his last name ). He sounded legit, stated that my debt was with Rushmore, and gave me account number XXXX. I agreed to a {$500.00} settlement and paid a {$200.00} installment on it on XX/XX/XXXX, with the remaining {$300.00} to come out this Friday XX/XX/XXXX from my debit card. After the fact, I realized that I had already paid two settlements on Rushmore, one with XXXX XXXX XXXX XXXX on XX/XX/2022 for {$240.00} and another on XX/XX/XXXX with a company named XXXX for {$350.00}. Both of these, I found out, involved the same account number XXXX, while this one with XXXX and XXXX has a different one. In addition to that, I looked up reviews about the website and its direct XXXX XXXX XXXX XXXX XXXX line and have found that many have deemed it as a scam. I think I have partially fallen for this and want to report it. I got 3 calls from a? Credit collection agency called XXXX. They were calling on behalf of VIP LOAN SHOP/XXXX XXXX XXXX. They have also called my husbands cell & my step sons cell phones twice after asking them to stop. They said I took out an online loan, had it sent to my bank, then closed my account so unless I pay them {$760.00} they will serve me papers for breech, worthless?, and defrauding a business and that will cost me {$1800.00}. I have not had a loan with them and never heard of them. I have been a victim of identity theft in the past and received notification that my personal information has been located on the XXXX web??? They also threatened to go to my employer with this information ( Ive been on XXXX for years ). There are different phone numbers they call from and different numbers to return their call with different names and claim numbers. I would like to file charges and collect {$1000.00} from them for each call they have made for harassing me and my family even after being told to stop. This is starting to affect my health!

To whom it may concern, Creditor/ company that they identify as XXXX XXXX XXXX XXXX XXXX has contacted my girlfriend on 4 or more occasions and left messages in regards to a debt possibly owed through Rushmore Financial. These calls started on XX/XX/2020 and have been occurring multiple times daily through today XX/XX/2020. They state they will be serving me papers for debt owed through a courier to my home and or employer. However I am informed them multiple times that I no longer live at address on file nor work at employer they have on file. I have attempted to provide new address and they then hang up and call back and continue to harass me. When they call back they state same thing all over again about coming to my home and employer to serve me but won't allow me to provide new address. A mediation company named XXXX XXXX XXXX XXXX call me from the number XXXX. They told me I had an unpaid debt owed from Everest Cash Advance and that I was being reported to XXXX for fraud reported by XXXX XXXX XXXX due to using a check as collateral and closing the account before the collateral could be paid. They could not tell me the date of this purported fraud other than that it was reported XX/XX/2015. I supposedly owed {$2800.00} but due to Covid relief I could settle for 50 % of that over the phone. They told me repeatedly that they were not a debt collector but wanted to know if I wanted to settle the account before they reported it to XXXX which would then freeze my current bank account for up to 7 years. On XXXX I was contacted by an XXXX XXXX with XXXX XXXX XXXX. Indicating I owed a debt to Rushmore financial in the amount of {$45.00} I was told if I did not pay I would be charged with defrauding a financial institution. I emailed a cease and desist letter to rushmore on XX/XX/XXXX. It was received by them. I resent it on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX, but I have continued to receive calls both to myself AND to my employer. On the last 2 occasions that XXXX from Rushmore contacted my employer he left a message with my employer stating that he was calling from Rushmore to discuss my account and that it was important that I called him back. Each time I emailed Rushmore and reminded them that I am NOT allowed calls to my employer, plus that I wanted email or postal mail, to cease and desist calls and that I would like assistance in figuring out how to clear my account since I am affected in work hours by COVID19. They have not adhered to the cease and desist and they continue to ignore my email requests for a response of any ways I can settle my account.

I have been called about 10 times a day from scam numbers. I answered and was told by 2 different people that I have a payday loan from XX/XX/XXXX from a company called XXXX XXXX for XXXX dollars that is now {$1200.00}. The lady said they were filing charges against me, was yelling at me, and hung up in my face. The second company contacted me today, XXXX XXXX regarding a payday loan from VIP Loan. This was supposed to be in XXXX for {$610.00} dollars. I spoke with a lady by the name of XXXX XXXX. She said she could be reached as ( XXXX ) XXXX ext XXXX or the number that called me ( XXXX ) XXXX. I tried to call both numbers back and they didn't go through. I haven't taken ANY payday loans and the information they provided was wrong. Can you please assist or give me some guidance on what steps to take.

My boss received a call from a Mr XXXX, informed her that someone is on their way to my job to serve me papers. He gave her a document number and a telephone number to call. I called the given number, XXXX, spoke with a XXXX XXXX. He states he is with XXXX XXXX XXXX, and there are 2 civil suits against me. He states it's with Rushmore Financial and supposedly I took out a {$500.00} loan. He also states that I can pay right now and the payment will only be {$850.00}. He states that if it goes to court, I will have to pay them {$2500.00}. I told him I have to look into the validity of this loan. He said that it's too late and I will just have to go to court over this. I know that consumers have a right not to be served at work or be threatened with a lawsuit or jail time.

I received a call from a XXXX XXXX at XXXX, claiming that they attempted to deliver a package and if I didn't call they would return it. When I called the number they left me XXXX a man answered didn't identify himself and said I owed {$1100.00}. If I agreed to settle for {$600.00} by the end of the month or paid {$97.00} a month I would not be served a judgement. When I looked into it. It was for a payday loan back in 2012 and the past due was {$450.00}. I also received an agreement for installment from a XXXX XXXX. I responded back to the email requesting further information as the amounts did not add up. When I looked up the actual pay day loan company, they do not exist anymore and they also were not authorized to lend anyone anything.

Last week they spoke to my daughter ( who answered my phone as I wasn't there ) and gave her specific details about what I owed, that legal action would be taken, that I twice tried to defraud the company, that my payment was declined. They also contact my father, who I would never use as a reference. They also contact my sister, after she told them I was not at that number, and left her very rude voicemail intended for me ( knowing it was not MY phone number ) that they were seeking legal action against me. On initial phone call I asked for letter, or written proof of who the original creditor was and they would not give it to me. They said it was from 2016 but used an address that I have not lived at in about last 13 years.

On XX/XX/XXXX I took out a loan with 605 lending which is owned by fsst management services for XXXX dollars ..This loan is an illegal loan in the state of Illinois per the Illinois payday loan act which states a loan company must be licensed in the state of Illinois which this company is not therefore making this loan illegal ..Per Illinois state law a loan company can charge a maximum of 99 percent interest annually and this loan company charges 720 annual interest therefore making this an illegal unenforceable loan per the Illinois payday loan act ..to date I have paid XXXX Dollars which is the principal on the loan ..would like this loan to be settled for the XXXX already paid and no further contact with company ..

I sent a revoke authorization of payment to 605Lending and XX/XX/2021 I received a email from the lending company saying they received the authorization and would stop taking out automatic payments. I also did a stop payment with my bank. XX/XX/2021 a check was written from my account in the amount my monthly payments were from this company. I dont write checks or own a check book. I called my bank it is currently being disputed for fraud to get my money back. In mid XXXX I let the company know of my situation financially and that I was out of work they didnt want to work with me. But writing a fraud check to get their money is illegal and if it isnt fixed Ill be taking legal action.

XXXX XXXX is an illegal lender in the state of XXXX. I have tried to call them many times to address issues I am having with repayment. The company is unwilling to work with me. I told the company I was having some health issues and they demanded to look at the amounts I was paying for treatment through my bank account. They were also requiring a doctors note to assist with payment arrangements. The loan was {$900.00}. I have since paid {$1500.00}. Their agreement also does not allow customers to revoke XXXX. Their agreement states even if you revoke XXXX, if there is still a balance due, they can continue to draw on your bank account which is not legal from my understanding.

I have been contacted numerous times from mediation, collections for VIP Loans saying I will be sued, they will be delivering summons for court, etc. I have asked for written proof of this debt from XXXX ( Texas ) which they say they have sent several times but I have never received it. They start hollering at me, talking over me, telling me I just dont want to pay my bills. I know this is past the statue of limitations here in Texas but they call my husbands business leaving a message and when I repeatedly ask them to not call me on that number she starts hollering and saying they can contact me on whatever number they have for me.

I received a notification through XXXX XXXX that there was a change to my credit report. When I checked I saw a collection on my report. I looked up the company that filed ( XXXX XXXX XXXX ) the collection on my report and since I had never heard of the original creditor, I called and asked them to email me the original creditors information. I told them I had never heard of VIP Loans before and this was not mine. They verified my email address said have a nice day and then hung up very fast. They didn't email me any of the information either. I need to get this off my credit report asap,

This company has continually for YEARS ( 2017 ) harassed me into paying a loan that I have not received notice or proof that I owe for. They have called my work and my personal phone and threatened with criminal charges for the outstanding loan. When I have asked for proof of debt owed ( I do not have recollection of this loan under my name. I have never done business with Rushmore Financial ) they stated they will send me proof and I never receive it but the calls continue to come. It has been a nightmare and I would just like this resolved.

I originally called the number XXXX - Acct # XXXX, spoke to an inidividual briefly and then was placed on hold for the next 40 minutes in which I hung up. I called back, lady said it was a chain of which I needed to go through, I did swear, but after 40 minutes holding and wanting answers, I was supposed to hold again. I have not heard from these people other than this phone call and message left, there has been no written correspondence, only that they were serving me at my work or home tomorrow for a judgement. I received an alert from XXXX that a collection was added to my credit report through XXXX XXXX and associates with original creditor vip loan shop on XXXX XXXX, XXXX. Collection stated that the loan was taking on XXXX. Prior to the alert from experian, i had no knowledge of vip loan shop. I have never taking out any loan through vip loan shop. They called me in XX/XX/2023 to settle a debt but they threaten me that if I do not make a payment plan that they will come to my job or come to my house and also garnish my wages. They also told me that they have my Social Security number. I tried to start a payment plan with them and is not able to pay it back at the moment so now they called me again. I was left a voice message stating that I would be served legal papers for a court date on XXXX XXXX, 2021. I called the number back and was directed to a so called lawyer. This lawyer tried to get personal information and stated that I committed wire fraud on an loan with Rushmore Financial. I began to laugh, as I have not conducted any business with this company. I borrowed money from Rushmore Financial in XXXX. I paid the amount in full and have a receipt of payment from them. In XX/XX/2019 I obtained a {$1500.00} loan from FSST Financial Services DBA : Rushmore Financial XXXX XXXX XXXX XXXX South Dakota XXXX. California Assembly Bill passed XX/XX/2019 put a cap on loans at 36 %. Rushmore is charging over 1026 %. First of all I did not even know who FSST Financial Services or 605 Lending. Apparently they go by both. I never applied for a payday loan. This company something is screwy because they knew about me. Then they tell me that they are above the law and threaten me. I never ever applied and I would never ever ever.
