I was on XXXX XXXX looking at pre-approved auto refinance. Came across an ad by XXXX XXXX. It was talking about loan rates, so I feel in some financial information, but didnt enter anything on the credit check or social security form as I didnt want a hard credit check or application done. Next thing I get is an alert that a hard pull was done without my social by a finance company called first investors. I called them and told them I never did a real credit check or gave my social number and this was illegal and fraud. Pictures attached. I have since spoke to rate genius that they falsely advertised, this was fraudulent and negligence by them. Here are the emails from both sides. On XX/XX/XXXX I was asked to co-sign/borrow for a XXXX XXXX XXXX XXXXXXXX from XXXX XXXX. As this is a subprime loan the APR is 20.58 %, {$11000.00} finance charge, making the {$15000.00} financed, that amount includes {$290.00} for Gap Addendum Waiver into {$27000.00} total. We had signed a contract earlier in the week for a XXXX that was {$5000.00} less but XXXX XXXX XXXX turned down that loan but approved the higher loan. I told the sales manager that I did not want to get into a loan with over {$11000.00} in interest, that is a whole other car and I am on Social Security XXXX and not comfortable with being responsible for it. The manager came in and assured me that the loan could be refinanced without me after a year of good payments, but what he did not say is no one will refinance a car that is over 10 years old and it turned 10 a week after signing the contract. If I had known that fact I would have never put myself in this kind of debt. On XXXX XXXX a letter from XXXX XXXX XXXX XXXX stated that the payment from the dealership on behalf of your addendum has not been received. And it is their understanding that the payment will not be sent. And the dealership would be responsible for the Gap waiver should there be a total loss. After paying for more than a year and a half on XX/XX/XXXX we went to XXXX XXXX XXXX XXXX and they gave us a XXXX that we did not see, showing an accident report that we were not told about and potential odometer rollback indicated and they would only give {$3000.00} in trade. I tried to call the dealership but they had closed down by then. On XX/XX/XXXX I filed a complaint with the OCCC and they closed it without sending me any of the proof, I asked for them and in the documents XXXX sent on XXXX XXXX was an inspection for the car dated XX/XX/XXXX with XXXX miles and on XX/XX/XXXX dealer inventory on my XXXX shows XXXX and I have an odometer disclosure with XXXX. From XXXX through XXXX there is a XXXX mile difference. Also they sent a document that says Gap Addendum Waiver that we have never seen. The information shows the car as NEW and msrp as {$60000.00}, and the signature of the borrower is a forge, you can clearly tell the signature looks like the sales manager who signed next to it. The name is spelled wrong and the numbers for the date is not how either of us right, I am not even on it but I drive the car. With it came a letter from XXXX XXXX XXXX XXXX, to whom it may concern there is an active policy, when I pulled the policy up it is just a typed document not signed and dated. I started calling XXXX XXXX in XX/XX/XXXX asking what the odometer reading is on the title because we have still have not received a receipt and she asked me, don't I know how many miles my car has, I said I want the miles OFF the title and she said they didn't have it there and to go to the DMV. By XX/XX/XXXX we were getting a letter from First Investors Financial Services saying we were to pay them now. On XX/XX/XXXX I did a title search and on titlecheck.us the NMVTIS vehicle history report shows the mileage as exempt, and the Power of Attorney we signed can not be used if the car is subject to federal odometer disclosure statement. The application for Texas title does not show exempt it has mileage and the county of title issuance the dealer filled out. I sent a complaint to DMV on XX/XX/XXXX and the investigator said the miles were just typos by the inspection stations and the business closed so they can't do anything. I contacted First Investors Financial Services in XX/XX/XXXX and asked the same question about mileage with no response. I finally sent emails to the higher ups and explained the situation and that the sale is void under Texas Transportation code chapter 501 sec.501.073. He asked me was I wanting to voluntarily surrender the car, no I do not, this is no fault of ours and my credit is excellent now and will not except it on my credit and our remedy is to have the contract cancelled and they take the car. He said they disagree and the car is exempt because it is 10. As I told him, the car was 9 when we signed the contract and that they have a copy of the odometer statement and the title receipt they sent me shows miles as N/A. There has been no reply in 2 weeks. I am afraid they are about to do as XXXX and sell my contract and I have to go through more. I know there is a violation of the DTPA, Texas Transportation code, Texas Financial code, Federal Odometer Act, Business and Commerce code. Stallion lied to the OCCC. And they sent the OCCC a bill of sale from the auction and they paid a little over {$8000.00} but I am paying {$27000.00} for the same car! And it does not matter if I pay early they are charging more finance charge each time, which my contract says the finance charge would be less. We just want out of something we would have never gotten into if not for being led by the manager. We have already had to replace the transmission and the headlight twice in the first year and have paid 3 years on a car with no clean title.

I have a vehicle loan with First Investors Servicing Corporation ( Lender ). Due to the events of XXXX it had become difficult to maintain my personal liabilities ( bills ) at current and satisfactory status. In XXXX of last year, I had reached out to the lender to advise of my plans to make my account current and arrange payment. The agents I spoke with wouldn't indulge any reason as to why the loan was past due, but rather yelled, belittled, and threatened to take my car. They wouldn't entertain a payment arrangement that would satisfy the account the first week of XXXX ( the following month ). I was so upset with the interaction with the agent and her XXXX and scared that my car would be taken away before I could satisfy the account, that I immediately pulled funds from my 401k. Then subsequently paid {$1100.00} in XXXX, by, XX/XX/XXXX. Moving forward a few months my payments were scattered, but in XXXX of this year, XXXX I paid {$800.00}. Due to the new year and becoming financially stable, XX/XX/XXXX or XX/XX/XXXX all of my liabilities would be current and in good standing, due to the economic stimulus payment of {$1400.00} being mailed to my on XX/XX/XXXX. I received an email from the lender on XX/XX/XXXX requesting I contact them. I did so via email, and i received no reply. I am not going to put myself through a battery of XXXX again by calling them. Today ( XX/XX/XXXX ) I received another email from the lender indicating that I need to contact them ASAP due to the account being past due. The email also indicated that if the account isn't made current " promptly '', it will be " escalated '' to enforce the note, and since " enforcement '' would include " moving to the pre-repossession stage and then possible repossession of the motor vehicle serving as collateral ''. Today, I noticed my car was missing, and my property XXXX didn't tow my car, I called the lender. They indicated to me that the vehicle was repossessed this morning. They have assessed a total charge of {$1900.00}. Charges including {$1100.00} past due amount, {$18.00} late fees, {$730.00} security payments, {$460.00} in repossession fees. On XX/XX/XXXX I received an email communication from the lender to contact them due to my account status. I promptly replied to the email seeking resolution, however, the lender never responded. Today XXXX XX/XX/XXXX XXXX, I realize my vehicle is missing. After speaking with my residential property XXXX, and they affirmed that they had not towed my vehicle, I immediately contact the lender. The lender informs me that my vehicle was repossessed this morning. The lender sent me an email this morning ( XXXX XXXX XXXX ) asking that I contact them promptly in order to resolve my account status. If I do not do this promptly, then the lender may enforce the note/contract, and move to " pre-repossession '', and then possible repossession of the vehicle. EMAIL BODY VERBATIM : " My name is XXXX XXXX from First Investors Servicing Corporation. Your account has now reached the stage where it must be resolved promptly, or it will be escalated, and we will move enforce the agreement and protect our interests. Since enforcement will include moving to the pre-repossession stage and then possible repossession of the motor vehicle serving as collateral, it is imperative that you contact us ASAP to make satisfactory arrangements. Please call us at XXXX. If you do not have a business relationship with us, please disregard. '' According to the lender, on XX/XX/XXXX and XX/XX/XXXX, my account status is in " pre-repossession ''. However, the lender repossessed the vehicle without allowing me to comply with their email communication. The lender can not ask me to contact them promptly to avoid repossession, if, in fact, they have already repossessed the vehicle. Please also note that the monthly statements that I have received did not indicate stages of repossession. The lender is in violation of, but not limited to, UDAAP under the Dodd-Frank Wall Street Reform and Consumer Protection Act. This complaint should also be recorded and sent to the FTC for review for possible FDCPA violations, regardless of the lender being first party. This complaint and details will also be forwarded to my attorney, XXXX XXXX, XXXX with XXXX XXXX XXXX. All communication from the lender in response to this complaint or any of their unlawful actions towards me, must also copy or send said communication to my attorney. XX/XX/XXXX Initial loan application is made to XXXX XXXX ( " XXXX '' ). Loan approved principle {$21000.00} at 5.17 % interest. I also receive preapproval loan at 4 % interest. I chose XXXX over dealer financing offer for 4.75 % interest + TT & L + new tires + oil change due to the lower 4 % rate. XXXX approves loan at 4 % rate and I agree. XX/XX/XXXX I received email requesting electronic signature for loan at 5.17 % rate @ XXXX. After phone call with XXXX the rate is corrected and approval email at 4 % rate is received @ XXXX. Following email link, the Consumer Loan Agreement was signed @ XXXX ( cosignor ) and @ XXXX ( me ). Due to mistake, the Consumer Loan Agreement stated a rate of 5.17 %, total payments of {$24000.00}. Error gives interest rate which is higher than agreed amount and higher than my alternative financing. The mistake was not immediately noticed. XXXX emailed instructions to claim funds and provide to the dealer. Instructions state dealer must note XXXXs lien on the title file Lien Entry Form. XX/XX/XXXX - Original title still not received, car was registered using the Bill of Sale and late fee was paid. XXXX XXXX recognizing payments are {$20.00} high, I discovered interest rate error while reviewing Consumer Loan Agreement. I contact XXXX, error was acknowledged, and XXXX promised to correct it. I was asked whether I wanted a refund of overpayment or amount credited towards principal. Interest rate not immediately corrected, I assumed XXXX needed time. XX/XX/XXXX I again contact XXXX about issue. XXXX acknowledges error and promises to correct. XX/XX/XXXX I contact XXXX because interest rate issue still remains. XXXX advises they don't have title and their lien is not perfected I apply for duplicate title and wrote down instructions for the lien registration on a note. I believe I requested the title be sent to XXXX. I have handwritten note, no additional proof. For unknown reason, neither party receives duplicate title. XXXX XXXX - Interest rate still no corrected, I contact XXXX. XXXX advises loan being assigned to First Investors ( " FI '' ). I obtain FI contact information from NWB. I call FI, they don't have complete file. FI advises to call back in one month. XXXX./XXXX. XXXX XXXX, account XXXX for FI advises I have obligation to get duplicate title and register lien. I can not sign/register lien form for FI. Consumer Loan Agreement requires I " fully COOPERATE with [ lienholder ] in placing and maintaining your security interest '' and " authorize [ lienholder ] to file a conforming financing statement or other similar document to perfect lien ''. FI denies 4 % interest rate and advises account in default for failure of my OBLIGATION to perfect lien. Interest rate increased to 25 %. All payments made on time and in the amount requested through auto ACH. XX/XX/XXXX FI mails Lien Entry Form via XXXX. XX/XX/XXXX lien entry form filed and registered title. Rate never reduced. So since the pandemic I have been struggling to pay my car note I was working with a lady name XXXX I been paying my car note and when the pandemic hit my hours where tremendously cut I explained this to them and the hardship i was facing, and they stated they have no programs that could help me. Dear Sir or Madam, I am writing to initiate complaint against First Investors Servicing Corporation ( First Investors ). The particulars are as follows below : I had a repossession that occurred on XX/XX/XXXX concerning my XXXX XXXX. Shortly thereafter, I entered an agreement with Mr. XXXX XXXX, a representative at First Investors Servicing Corporation where the stipulated agreement was for {$8000.00} and monthly payments were to be {$150.00} a month, after completion of said payments the debt balance would be forgiven. As previously mentioned, I was making said payments to XXXX XXXX as agreed and in XX/XX/XXXX I was going through some financial difficulties due to my wife 's health and medical issues because of her XXXX. I made payments when I had the means to make them. In XX/XX/XXXX, Mr. XXXX gave me an ultimatum that if I did not make my past due payments of {$600.00} by the end of XX/XX/XXXX that my account would be transferred to another debt collector. I made {$1000.00} in payments to First Investors and by chance wanted to get a status update on my account from Mr. XXXX. However, he never responded to my phone messages. I later found out that Mr. XXXX breached his arrangement with me and forwarded my account to another debt collector XXXX debt collection. I never received notice of the transfer of my account. I escalated this issue to his manager, Ms. XXXX XXXX. Initially, Ms. XXXX brought back my account from XXXX XXXX XXXX and received another account representative at First Investors. Ms. XXXX tried to reassure me that the payments made on my account with First Investors were reflected. I asked her for a copy of the accounting as well as all my documents concerning my account because she said that it was {$3000.00}. All I wanted was proof for my records that said payments were properly reflected before making further payments. On XX/XX/XXXX, I sent a letter to Ms. XXXX to receive the documents that I requested previously from her department that proved that the balanced still owed on my account was {$3000.00}. She told me that she would place my account on hold, review my file and listen to the recordings ( telephone conversations between Mr. XXXX and myself ) concerning my account. Please note, that the only reason that I did not file a complaint earlier was because I unreasonably relied on the assurances made by Ms. XXXX concerning my account. I did not hear from her for two months and found out that First Investors sold my account to another third party debt collector, XXXX XXXX, XXXX on XX/XX/XXXX. This whole matter has been handled very unprofessionally as well as under handed concerning my account. I am displeased with the service as well as the attention concerning my account because I felt that had I not inquired about my account, I would've essentially been in limbo because I would have been still paying First Investors in good faith even though they initially transferred my account to XXXX XXXX XXXX. I would like a resolution in this matter and feel that the attempted transferring of my accounts were without merit and deceptive. It is not unreasonable to ask for a proper verified accounting of your account, in light of the mismanagement of my account initially. To this date, I still have not had a proper accounting of my account ( in terms of what is still owed ).

My phone conversation to them before XXXX/XXXX/2016, was that I would be calling in with a different bank account number ; because my military bank account I would have the money on the XXXX/XXXX/2016. Well, with the pain and suffering that I 'm going through I was n't able to call in that day. The very next day, I tried the internet and trying to place in the numbers of my account ; and it kept kicking me out and stated. That my account numbers does n't match. I even put in my social security number, and it would still showed no account exist on that social. I even send them an email about the problem. I got an email showing the same numbers I 've been trying to pay on my account. I tried to get a hold of First Investors, every time I tried calling I was place on holding. I refinanced my vehicle loan with First Investors Financial in XXXX of XXXX. There was a ton of back and forth with me having to pay my old lender because checks weren't sent on time, then they were asking for payments too, etc. We finally got that straightened out and I was able to make my first loan payment. Unfortunately, I have numerous health issues. The main one being that I am 100 % XXXX in one XXXX and 80 % XXXX in the other. This leads to frequent FMLA leave usage from work where they won't fire me, but I also won't get paid. I went through a horrible period where I had multiple surgeries and was out of work for a good period of time. My wife, who is authorized to speak on my account, called in to see if we could get assistance with catching up on payments since I am now back to work. To begin with, every person she spoke to was rude to her. She got put through to an account manager that told her that my loan had not been up for repossession review but since she called, she was going to push it through for review. My wife called to work out a solution and was told her call just made things worse. The rep didn't listen to my wife when she tried to explain our situation. Instead she strong-armed my wife into a payment plan that my wife told her we couldn't possible meet. We requested an extension, or to tack the missed payments on to the end of the loan, but she refused to do anything but basically force us to make 4 payments in one month. My wife made a payment of {$640.00} on the XXXX of XXXX as agreed. Then the other 3 payments were to be made on XX/XX/XXXX. However we only had enough money to make 1 payment of {$640.00} on XX/XX/XXXX. We are still behind XXXX, XXXX, and XXXX. My wife scheduled another payment of {$640.00} for on XXXX. Now I get a letter in the mail today XX/XX/XXXX. That was allegedly sent on XX/XX/XXXX saying I have 13 days to pay {$3000.00}. Getting the letter today has essentially given us 2 business days to come up with {$3000.00}. I struggle to believe this letter was mailed on Thursday of last week and is just getting here. We are trying our best to catch up on these loan payments, however we are receiving no help and just outright rudeness when we call to ask for help and also questioning why it is my wife doesn't work. I had not anticipated being off of work for the better part of a month and missing payments. I am now back to work and can keep up with the regular payments, but I we don't have enough to catch up on XXXX quick enough to stop repossession. We are just asking for an extension of XXXX payments and fees to the back of the loan so that we can make our XXXX payment and be current and not have to worry about the threat of repossession. In XX/XX/XXXX I purchased a XXXX XXXX. About 5 weeks later the XXXX had an engine compartment fire that destroyed the vehicle. After the insurance company did there investigation an insurance check was issued on XXXX XXXX, XXXX in the amount of {$17000.00}. After the payment the balance was {$1000.00}. I contact First Investors Financial Corporation and set up a 50.00 a month payment plan. After making a few payments, on XXXX XXXX an entry of {$290.00} was added to my balance owed. I contact the lender and question the XXXX and get put on hold, transferred etc. no explanation is provided. I continued to attempt communication with the lender requesting they prove the debt with a copy of my contract and/or account statements. Not wanting issues to effect my credit I requested to speak to someone in management, and after being transferred was able to settle the account for {$500.00} and agreed to pay before XXXX XXXX and management agreed to email me the requested documents. The documents never came and the XX/XX/XXXX, deadline passed.I periodically spoke with the lender over the next few months, trying to get an explanation for the {$290.00}. The lender began reporting the debt to the credit agencies despite never meeting my request to validate the debt. Frustrated watching the lender destroy my credit I contacted the lender again on XXXX XXXX and settled the account for {$590.00} verification code # XXXX, hoping I could get them to correct the credit agency reports now that i had paid the debt. The next day I received an email containing all the information I requested back in XXXX, XXXX. My complaint involves the lenders irresponsible handling of the account from the time the Insurance check was paid to them. Why did they withhold the information I requested to validate the debt from XX/XX/XXXX then provide the information in XX/XX/XXXX after I settled the debt? In the meantime destroying my credit despite my efforts to comply. I have spoke to several people about the issue since I satisfied the account on XXXX XXXX and the lender reported to the credit agency again on XXXX XXXX reporting 180 days late. In my opinion after making the payment and speaking to several employees of the lender they should correct all negative reports to the credit agency. If they would have complied with my request to validate the XXXX as required by law none of this would have happen and my credit would not have been ruined. They reported me again in XXXX. This is there error and they should be forced to correct everything they wrongfully reported to my credit!!!! I also explained to them that I am 100 % XXXX Veteran on a fixed income. My only request is they repair the negative credit entries that could have been avoided if they followed the laws protecting consumers when reporting to the credit agencies.

First Investors has failed to acknowledge that their employees failed to effectively communicate an accurate record of what status of my account was. Due to erroneous information/lack of information provided to me, First Investors reported a 30day late that is adversely affecting my credit score. Ive communicated with their Credit Dispute department who sent me a letter telling me the information is being reported accurately. No explanation how they couldve possibly arrived at this conclusion. I was never sent a bill for said amount. I made every attempt by calling them to clarify status. XX/XX/XXXX As of this date i had not received any correspondence or phone call from FIFG. i received a missed call this day and i immediately returned call, I was informed that my car payment was overdue, after informing her to clarify the terminology because i was again confused because i had made my last payment on XX/XX/XXXX and wanted her to clarify that this payment was a " payoff '' not a regular payment. after some research on the reps part she confirmed this was my payoff amount. I then proceeded to pay this amount on XX/XX/XXXX via phone payment. I implore that you assist me. First Investors failed to give me the correct information to enable me to make said payment hey are now reporting 30 day late. I was in contact with them throughout this entire process. The last 4 years I have tried and tried. Letters to XXXX, calls, copies front and back, nothing works. The bank tried to help and saw these incorrect items on my 3 credit reports. We have been attempting to enroll in a Covid 19 program for payment assistance sinceXX/XX/XXXX Here are the notes we have on our end : XXXX > first call to inquire about the program found on your website offering Covid 19 payment assistance. We asked about credit reporting and he relayed to us that they were not reporting any late payments during this Covid crisis at the very least and not to worry about it at this point. XXXX XX/XX/XXXX> spoke to XXXX due to XXXX not available because of vacation and that the case # was now missing on the declaration for the insurance. We never received another call back since. XXXX XXXX I spoke with a manager whom indicated that we still were not enrolled in a program and that we could start the process for a different program at which point I informed her that we were already attempting to refinance with a credit union. I asked her if we needed to make a payment in order to have to time to refinance which we knew could take about 10 days and she was unsure and directed me to call another #. At this point in time we have given up on any program and have successfully secured new financing from XXXX XXXX XXXX XXXX XXXX. How ever, I was un pleasantly surprised to find any creditor reporting late payments of any kind while we are in this Covid Crisis period. We are both now unemployed and have no idea as to how long this will continue base on government guidelines. However the loan will be paid in full with in the next few days and I would like the credit department to remove the late payment and correctly place a paid in full closed account remark instead. I respectfully ask that this be done immediately.

My wife and I have made attempts to contact the lender, First Investors Servicing Corporation, and when we have called, we have been left on hold for nearly 45 minutes and hung up on. We have also responded via email as we understood they may be bogged down from common concerns regarding Covid-19. This matter is complicated. I used XXXX XXXX ( Now First Investors ) as a refinance bank to pay off XXXX XXXX, and thus XXXX XXXX became my new lender and lien holder on my non negotiable title in Oklahoma. The problem is that XXXX ( First Investors ) failed to fill out proper paperwork with the OTC to have XXXX XXXX removed, while they added themselves ( XXXX XXXX ). What is also horrible is that XXXX XXXX claimed to have sent XXXX a lien release when XXXX Paid them off ( XXXX XXXX ) on XX/XX/XXXX. I have issued separate complaints for both lenders through the CFPB. Now I have two lien holders on my title when actually, both ( XXXX and XXXX ) should have been removed once the vehicle was paid off on both of their ends. XXXX was paid off in XX/XX/XXXX, and XXXX XXXX ( who transferred their auto loans to First Investors ) was paid off in XXXX of XXXX. I am unable to receive a clear title, free of liens because these two lenders refuse to process the proper paper work. How can you pay off a vehicle and still have lienholders on your title? Oklahoma is not a title holding state and they do provide your title with lienholder if you still have a balance on your loans. The lien holders are responsible for clearing this up with the OTC ( Oklahoma Tax Commission ). Please investigate this complaint and advise XXXX and XXXX to comply with Oklahoma law and remove themselves from my title. XXXX ( First Investors ) also needs to forward SIGNED and valid lien releases from themselves, and XXXX who sent to them after the XX/XX/XXXX payoff. XXXX should not be listed as a lien holder since they were paid off in XXXX, and this is considered FRAUD! First Investors isn't even listed on my title. They never submitted anything to the Oklahoma Tax Commission removing XXXX and XXXX from my title. Aren't First Investors a loan Servicing company, yet they have not done their job, according to the Oklahoma Tax Commission and this is also fraud and deceptive business practices. I recently found some accounting and billing issues and these issues have been reported to all three credit bureaus XXXX XXXX XXXX and XXXX XXXX. On XX/XX/XXXX I submitted a partial payment to First Investors Servicing Corporation check # XXXX XXXX XXXX XXXX {$200.00}. My monthly payment is was not due until XX/XX/XXXX, but to get a jump on my payment since I was granted ( 2 ) month extension due to Pandemic. But after looking at my payment history I noticed that ( {$15.00} ) was applied toward late fees and XXXX {$180.00} XXXX towards interest. How this be when I was granted extension ( see attached PDF ) if you look at XX/XX/XXXX, same time I was granted the extension First Investors Servicing Corporation received a payment for ( {$290.00} ) and that payment was allocated as ( {$210.00} ) towards the principal and ( {$77.00} ) was allocated towards interest. I have not gone over all my payment history but I feels these regularities are part of same issue am complaining about now. Where do the late late payment fee come in at, when I was granted a ( 2 ) month extension? The next issue First Investors Servicing Corporation have notifying the XXXX, XXXX and XXXX about my payments as being late even during the pandemic period presently I have ( 19 ) late payment showing on all three credit bureaus report XXXX see attachment ). I usually pay my car not on the XXXX of each month before the next month become is due. I've been assessed late fees just about every month even during pandemic period. This matter needs to be addressed and corrected. When I call and complain they place a notation on my credit report that negative remarks driving my score down. After my car was deemed total loss by the insurance company, My original auto loan was sold of to another company called XXXX XXXX XXXX. The new financial company informed me that my title to the vehicle would be released to me once all payment was submitted by the insurance company and the GAP department. When asked for someone to email me an up to date bill. I was told NO. First investors recently took over loans for XXXX XXXX XXXX. I received a letter about the merger but no instructions on future payment. I made my payment on the due date to XXXX. First investors started to call me frequently as a debt collector. When I spoke to XXXX XXXX I advised him of my payment and emailed him my bank statement showing every previous payment including the one they where turning to collect as paid. This was XX/XX/XXXX. My XXXX was supposed to process the payment and call me back as soon as he was done. I continued to get collection calls so I called Mr XXXX Back on XX/XX/XXXX to which he seemed caught off gaurd and claimed to have not gotten my statements. At that point I emailed them to him again and he said he had them in hand as was going to escalate it to the proper department. I asked them to stop calling my previous employer trying to collect a debt I did not owe. I called first investors back again on XX/XX/XXXX after paying my XXXX payment to make sure it was credit correctly. At that time my account still shows delinquent. I was advised a email would be sent to the manager in the payment processed department by the name of XXXX XXXX who would be in the next day at XXXX and have all of my information. I checked my loan information today and saw the payments have not reflected on the principal in some months now and that the principal and the interest flipped backward instead of the interest going down. I called them again today XX/XX/XXXX to be told the XXXX XXXX is not in until XXXX XXXX and that the person I spoke to XXXX XXXX would email her again to let her know to contact me. I have continually made overpayments towards my vehicle loan in an effort to reduce the principle amount and, in turn, reduce the amount of interest being paid towards my loan. I contacted FIFSG ( First Investors Financial ) when I noticed all of my overpayments were being split between principle and interest. I contacted FIFSG the first time via telephone and was advised this would be corrected. When my payment was made in XXXX 2015, I reviewed my account and noticed the first request and resolution had not been honored and my overpayment again was split between principle and interest. I sent an email and received a response to allow XXXX hours for my request to be processed and the change to occur. After making my XXXX 2015 payment, I again noticed no action had been taken to correct the payment allocation on the overpayments and my XXXX payment had, again, followed the same pattern. When I contacted FIFSG on XXXX/XXXX/2015, I spoke with a gentleman who identified himself as XXXX XXXX, a Team Lead. I explained my reason for calling, how I contacted the company twice before and no changes had been made. XXXX XXXX then tried to tell me how my interest was being calculated on a per diem basis and why the amount of the per diem interest was being calculated and I have a simple interest loan. I explained to XXXX XXXX my request was to have the overpayments applied to the principle and the interest remediated, I was advised both verbally and in writing this would be done and my account still shows no changes. XXXX XXXX continued to explain to me how interest worked and I advised I was well aware of how Finance worked considering this is my career field. I then advised I was going to file with the CFPB if this did not get changed. XXXX XXXX continued to argue with me and I ended the phone call with the statement of filing with the CFPB to step in and help.

I got behind in my vehicle loan beginning with the XXXX payment. I scheduled XXXX months of payments to come out on Friday XXXX XXXX XXXX . First Investors is a subprime loan lender who banks off of people in despera te measures trying to get a loan so they can work and have transportation. With my interest rate and payment amounts of {$510.00} a month, I am paying more than 3 times what the vehicle is worth. It 's highway robbery and they can not help their customers more in these financial situations? They have to understand that their customers are paying 3 times as much in monthly payments as a normal consumer would. I understand these loans are risky but at the same time, but {$510.00} a month for my vehicle is outrageous. I was promised when I got to the car that I could refinance for lower payment and now that is definitely not the case.

Once I started dealing with 1st Investors my monthly payments seem to always be an issue. I have never received a single bill by mail nor email stating my monthly payment was coming up or statements. I call first investors to make a payment and nobody can ever take my payment. Per the agent the call needed to he transferred elsewhere. I receive calls from another agent every month to collect my payment. I do not have access to my account to keep track of my payments. Online login states account is no longer active. This year XXXX there has been several payments that have been collected but then get a call from an agent stating I am 2 months behind and I need to make both payments, when in reality my payments have gone through and I have proof. On XX/XX/XXXX repo was was outside my house to take my vehicle due to me not paying. Additional charges were added to my bill due to repo having to come to my door. The amount due onXX/XX/XXXX per the agent was less than XXXX dollars. NowXX/XX/XXXX the amount due is XXXX. As I was calling to make this month’s payment I was told repo was processing the pick up of my car since XX/XX/XXXX payment wasn’t made !? I have disputed and contacted this company ( First Investors FIN SERV ) several times about the debt that has been listed on my credit report. The in 2015 my car was repoed when i was in between jobs. I never received a call from the company to try and get the car back. Never received information when the car was sold at the Auction. By law the company is to advise me about this debt. The full balance that the car was first financed is listed on my credited report with XXXX & XXXX. Overtime the debt was charged off and the company had been paid off. I was living in Florida at the time of repossession and the Florida Statues XXXX was in total violation because the company never provided me with detail of when and where i can go get my personal belongings that was left inside the car, they never gave me a option to get the car back, the also never provided me with the dates and where the car would be auctioned off at, nor did they provide me with the information of how much the car was auctioned off for. Which totally violates the law. I have requested this information in writing from the company ( First Investors FIN SERV ) on several occasions to provide me with all of the documents pertaining the loan. I was only sent the original loan information and not the following documents requested. The amount that was listed on my credit report was for the original amount of the loan when i first financed the vehicle excluding the amount that i had paid on the car for a year before the car was repossessed. I emailed First Investors Financial Services on XX/XX/18, Due to the Harassing Phone calls that I received during the day. As I previously advised a collections Rep about the amount of Voicemails that were being left on a daily basis on a single phone number. Calling from different numbers all day long. Phone numbers that are near my own phone number or on XX/XX/18 called from my exact phone number ( spoofing calls ) .This company is based in the XXXX Area and Georgia Area . So why am I getting calls from XXXX, XXXX, XXXX area codes? disguising phone number to collect a debt. Then getting text messages from the company when I did not give the okay to contact me by text message on my cell phone. I also received several emails to my email address advising me to contact the company about my past due account. I have been open and honest with this company about the struggles that I have been going through the past few months and still maintain keeping a payment coming in monthly. I emailed regarding a late payment that was made. Requesting a 'goodwill ' adjustment because it was reported to the credit bureau as a late payment and we have been working our butts off to pull our credit out of the gutter and restore it from bad choices made as kids. As seen by my 17 % interest rate we really need this adjustment made. We have made all other payments ON TIME or BEFORE the due date and to be told that this will not be adjusted off is very discouraging. Upon them running our credit they came back and let us know we were approved through a lender called Firsr Investors Financial Services. My payment was in the {$500.00} range. Upon signing the contract with XXXX, the Finance manager told us our magic word was going to be yes he told us that First Investors would be calling us and asking various question about the vehicle, such as Does it have running boards, does it have a sunroof, does it have a toe package? The finance manager told us the only way the loan could get approved is if we lied and said yes to all of that. Despite my better instincts I followed his advice. My husband was laid off in XX/XX/XXXX, we decided to voluntarily let the XXXX go back due to financial difficulties and we had already exhausted all our our extensions with First Investors. According to my credit report, our vehicle loan was charged off and sold to XXXX XXXX XXXX, however we havent recieved anything from them or First Investors stating where it was sold and for how much. Ive tried to contact First Investors via email and phone but havent had any response. According to my state, WV, limitations, a company has 2 years to get you the auction information on the balance of a vehicle thats been repossessed. My husband and I are still waiting. We feel like since its been this long it should be removed from both of our credit reports, and the loan contract we signed was for a XXXX XXXX that had all the bells and whistles, not the one that was repossessed.

I received a letter dated XX/XX/XXXX from First Investors Financial Services , Inc. stating that my request for an Auto Loan Refinance was denied due to information obtained from XXXX, a consumer reporting agency. I did not, nor have I ever, requested an auto loan refinance with this company or any company. I purchased a new vehicle in XX/XX/XXXX and it is financed through XXXX and I have no intention of refinancing. I called the company today XX/XX/XXXX to discuss how this could happen, but was told they had no record of this under my social security number and that the social listed on the application was different, but they would not provide any further information. When I requested to speak to a manager, I was told I could not and that they would not provide any further assistance. I then requested my XXXX credit report to confirm if in fact an inquiry to pull my credit report did occur from this company and confirmed it had on XX/XX/XXXX. This is 1 ) an invasion of my personal privacy ; 2 ) damaging to my personal credit record/score and more importantly 3 ) a violation of the Fair Credit Reporting Act ( FCRA ) as this company had no right or legal " Permissible Purpose '' to pull my credit report. The whole purpose of this regulation is to protect consumers such as myself, so there must be action that can be levied against this company for misuse of their authority. I filed a dispute with XXXX today and have filed this complaint with the FTC and the CFPB in an effort to determine what I can do to prevent this from occurring again to myself or others. Due to unforeseen circumstances we requested a payment reduction for our XXXX XXXX XXXX. We spoke to a XXXX XXXX and she was to be handling our account. We email her XXXX pay stubs and bills that she requested. This was on XX/XX/XXXX. During this time period my husband and I received daily phone calls about the XXXX. On multiple occasions we would answer the phone and speak to a representative up to XXXX times in a day. Their excuse was that they use an automated computer and they could not control who it calls. Not one of these representatives bothered to read the file to see that our case was being handled. We got a car loan through First Investors Servicing Corporation on XXXX/XXXX/XXXX. My husband lost his job XX/XX/XXXX. We paid up until we asked for 2 differed payments, which we were granted, but after that we were unable to catch up and pay on time. In XXXX XXXX, we gave the car back to them because they would not work with us. We were hoping to refinance through them, but we were told that is something they do not do. When we got the later stating what we owed left on the loan, we were taken back on the amount. It was extremely high! Even with late fees, we were floored to see the balance. We began investigating our account and found out that when we paid, AND current, different amounts went to the principle amount towards the loan. Every month up until XX/XX/XXXX, had a different amount. One time, only {$5.00} went to the principal. Seriously ... {$5.00}. We contacted a lawyer and found out that in XX/XX/XXXX, First Investors had already been fined XXXX dollars for doing the same to others AND false reporting to all XXXX credit bureaus. The lesson has not been learned. Now they have added on more fees and costs and now we owe more on the car then we even took the loan out for! They are bad, bad people and have no right in giving anyone a loan. Please stay away from this company and if by chance you are stuck with them right now, I seriously advise you to take a good look into your account and even check the credit bureaus. We are now loacting an attorney to help with deceptive trade practices, because this is what they are doing. Thank you.

My account with XXXX XXXX XXXX XXXX was recently report falsely 30 days late for the month of XXXX even though at the time I was in the process of filling an extension which was granted and I was told they would not report a 30 day late. At that time I wanted to be better safe then sorry so I asked for a letter and the representative I spoke with told me not to worry and I have his word that they will not report a 30 day late. On many many occasions we have contacted the finance company and gap Insurance company to try to resolve the issues and each and every time has been a failed attempt to correct. In XX/XX/2014 we purchased a XXXX from XXXX XXXX in XXXX NC and within a short period of time the vehicle was totaled in a car accident on XXXX XXXX in XXXX which for starters wasn't our fault and in the process of the insurances handling their business we somehow ended up with a {$600.00} +/- fee on our hands. Ironically enough we purchased a 2nd vehicle from the same dealer just a used car this time instead of new and the issue of the outstanding balance came up and we financed the extra and it never was applied and it is now on our credit reports and when I disputed it with XXXX after all these years it somehow went to {$780.00}. Then the used car we purchased we had for roughly 3 years or so and it got totalled as well and it was also fully insured and had gap coverage as well and somehow we got stuck with a {$6800.00} balance which is now on our credit reports. My wife got them to remove it on her XXXX but it still shows on her XXXX, and it shows on both for mine. We really don't see why we are the ones being shafted when we took all the proper steps to make sure we were covered in case of these types of events. I have been having issues with first investors since XXXX. I have disputed this account several times and even reached out to first investors in an effort to settle the debt, but no agreeable arrangement could be made, and any help in this matter would be greatly appreciated. I had an auto loan with first investors since XXXX, and I have paid faithfully until XXXX. In XXXX I began to notice that my account balances to raise instead of dropping and other inflated charges began to appear. I called to inquire about account balance and was consistently met with hostility. with no other option available in XXXX refused to make any further payments until an audit of my account was completed. first investors finally repossessing the vehicle mid XXXX and selling it. I started disputing the information reported to the credit bureaus immediately. with every dispute The debt came back as valid. upon hearing about the lawsuit XXXX lawsuit between the CFPB and First investors, I reached out to FIFS in an attempt to settle my account but FIFS would not respond. I contacted XXXX XXXX and 1st Investors Financial SErvices about several inquiries that are on each one of my credit reports from their company. I explain that the inquiries were not authorized by me. During the times the inquiries were made I was in XXXX XXXX getting ready to move the following month I had no need to be shopping for a car in Missouri, I also advised the rep that I was a my ex had used my identity before and that could have been the case. I asked the rep to provide me with the original document with my social security number and signature proving that I made the inquiries, because their company is reporting the inquiries in the sate of TEXAS I have the RIGHT to request VERIFICATION of how they received information. XXXX XXXX sent a letter back dated XX/XX/17 stating that I had to contract the dealerships to get a copy of the original contract, hence the dealerships are in XXXX XXXX Missouri. I called the dealership and they said that they destroy contracts unless they are approved. I told them that I never came into their office and applied nor did I apply online they told me that I had to contract XXXX to get the inquiry removed. I am tired of going back and fourth to get something removed in which I never inquired about in the beginning. I was late on my monthly payment - the company offered me a plan to pay a lower amount - instead of {$420.00} I was supposed to pay {$350.00} for six months. The company asked me to send some documents by fax like proof of salary, insurance - I did it twice and they said the documents were not legible - after that they asked me to send the documents by regular mail to an office in XXXX - I did it and they insisted those documents could not be read - they asked me to pay {$600.00} dollars but when I tried to pay they said they can not accept the money because they were having problems with the computer. Every time I offer to pay they refused to accept the money, and instead accepting payments they threaten me that if I dont pay them XXXX XXXX dollars they will repossess two cars. I offered to pay them {$450.00} dollars every two weeks and the company refused to accept the money. I dont want the plan they offered me - I just want the company to accept my payments every two weeks but I can not do it online and they dont accept the money by phone unless is the whole amount of XXXX XXXX dollars. I have the names of all the employees with whom I have been in contact with and I have the impression their behavior is like the strategy the XXXX XXXX employees had from their bosses to make the situation worse for the people with mortgages that led them to lose their property and even the health of their children.

For the last few months I have been told verbally ( recorded line supposedly ) that I would qualify for another deferment ( 2 month deferment ) to help me get my loan caught up as I have been paying one month in arrears for months. I was told to just keep making a payment monthly even though it 's behind and I would qualify in a " couple '' months. I feel completely mislead by this company. I submitted a complaint in XXXX of this year because they refused to help me when I was behind. They offered me a fresh start program. I submitted the paperwork immediately only to be informed that it was most likely " lost on the managers desk '' so I submitted it again when I got a letter after jumping hoops and talking to manager of fresh start department. I scheduled a payment and was told it was all set up. Then I go out of town last week for my gmas funeral. I notice Saturday that my payment did not come out. I just received a letter in the mail threatening reposession if I did not make a payment within 13 days of the date of the letter. The letter was dated XX/XX/2020. I did not receive that letter until XX/XX/2020. I can verify this with informmed delivery through USPS. I have been trying my best to get back on track with this loan. I have been making at least one payment a month, but that is not helping my past due balance. I communicate mostly through email due to a an auditory processing disorder. I can show email after email of me begging for assistance without any reply. I had been out of work due to covid and then had my wallet stolen and my accounts drained. First off I never missed or was late with a single payment to this company. The loan was sold to them and same is true for previous loan company. The loan was paid in full on XXXX. When I initially contacted them they stated they needed 30 days to ensure everything went through and was processed out. Whatever that means. I gave them the 30 days and contacted them, I was told it was not processed, via email, and I would have to contact the title department but was given no contact email or phone. When attempting to call them I was placed on hold twice and both times disconnected. Further emails went either unanswered or triggered response with no follow-up. I used XXXX to view my credit score for free. The site kept asking my why I am checking my score. I chose anything in the drop down menu in hopes it would stop asking me the reason for checking score. after I chose auto refinance which was picking anything it asked me a series of questions. In reviewing XXXX XXXX credit report, I found that first investors financial service corporation placed the incorrect balance amount along with the duration period of the false balance on my XXXX report. On XXXX I acquired an auto loan from First Investors XXXX XXXX, GA. The loan was for 72 months. The loan should have been paid on XXXX. I contacted First Investors on XXXX and asked about the pay-off on the loan. I was shocked when they told me that I still owed {$9000.00} on the loan! I send letters to all three credit bureaus requesting validation of several accounts including one listed on my report from XXXX XXXX XXXX XXXX on XXXX/XXXX/XXXX. I received paperwork approximately on XXXX/XXXX/XXXX of a contract and payment history and total amount owed. This is in regard to late payment notices sent to all three CBRA 's by FIFSG. Please remove those notices. FIFSG claims to have a program to help its clients keep current and those that have fallen behind. Due to COVID-related unemployment and issues with CA EDD which I informed the company 's Account Manager, I would need to arrange payments at a later date which I did and made certain they were kept. The Account Manager stated that this would not be an issue and did not state that this would place a negative mark for late payment on my account. I paid the back due and prepaid the next due payments to keep my account ahead. In complete contradiction to their commitment to not penalize me, they placed late payment notices on my CBRA 's. This is dishonest and a violation of FCRA which states that they are required to inform a customer of a negative action that will be taken when questioned about the repercussions of making a payment arrangement.

I obtain a loan from fifsg in XX/XX/2013. My payments did not begin until XX/XX/2013. Ive made payments before the due dates or sometimes 5 or more days after the due date. While being XXXX to help out with Hurricane Harvey. I wasnt getting paid as much since we were under state orders. Also since I was on military leave from my job I wasnt getting paid as much at all. I relayed this to the finance company everytime. They knew I was XXXX and I relayed to them that I was protected under the sailors and soldiers act. I refinanced our truck loan with 1st Investors Servicing Corp and never paid a late payment. Our truck value was almost a loss compared to the amount of my auto loan. I entered into a settlement ( XXXX 2012 ) to payoff off the loan at a lower amount with out impacting my credit. This account was opened up in behalf of my ex wife and she did agree to make the payment. The company continues to report to the credit bureaus that payments are 30 days late every month. Payment was made late in XX/XX/2019 and instead of reporting the month it was late they instead continue to report XXXX and every month since as being 30 days late which is not correct. It is being reported that I had three 30 day late payments from XXXX, following two 60 day late payments from XXXX. Additionally, it was reported that I had two 60 day late payments in XXXX, when there were two on time payments made in XX/XX/20 and XX/XX/20. The vehicle was purchased with an extended warranty that should have covered the drive train. I reported an issue the the transmission and they said the issue was out of the scope of the warranty. This problem later led to mechanical failure of the vehicle. I made a double payment in which one of the payments was applied towards the principal balance as it should have. However, the second payment also was applied to the next monthly payment. The second payment should have reduced the principal balance that interest is being charged against which would reduce the monthly payments.
