This is to add to the current complaint I have against Great Western Bank ( GWB ) and re-reading the old compliant from XXXX, GWB seem to think that a document can be delivered and recorded at anytime when in fact the document must reflect the issue at the time when GWB would have been owed a debt. When GWB recorded the Deed of Trust ( DOT ) on XX/XX/XXXX, it was not owed a debt against the property at XXXX XXXX XXXX XXXX XXXX, because the mortgage loan had been paid in full by XXXX XXXX XXXX ( XXXX ) on XX/XX/XXXX, which all financial interest in the XXXX XXXX VA mortgage loan. As the recording of the DOT is not mandatory but if the document is to be recorded the recording party must have a current financial interest at the time of the delivery and recording of the document. Yes XXXX is the successor of the mortgage loan debt and on XX/XX/XXXX, when GWB cause the DOT to be recorded the debt belonged to XXXX for 22 days and they had already had the loan accepted by Ginnie MBS program which the UCC3 procedure was perform and the blank endorsed Mortgage Note was relinquished to Ginnie making Ginnie the owner of the Mortgage Note, but is not authorize the power of the DOT because it did not purchased the mortgage loan as it not authorized by US Congress to buy or sell mortgage loan. As long as the lender does not sell the mortgage loan they don't have to record the DOT until they want to sell the loan or foreclosed on the property, which GWB did sell the mortgage loan on XX/XX/XXXX and after that date are not owed a debt and have benn paid in full. So XXXX can not be a party to the Mortgage loan as the requirement are that GWB is asking that XXXX join with the recording of the DOT which the DOT does not take effect until the it is delivered and recorded at XXXX XXXX XXXX XXXX XXXX XXXX and XXXX system is not started until a valid DOT is recorded to start that process. GWB last stated that Nebraska Statute 21,20,168 was repealed in XXXX, however the legal recording occurred in XXXX! GWB responded that I bring this up with the servicer of the mortgage loan, but as GWB imputed into XXXX on by XXXX XXXX on XX/XX/XXXX that service rights transfer took place on XX/XX/XXXX as GWB was still servicing the loan through that date. GWB XXXX XXXX have a uncomfortable option to come to me and have my wife and myself sign a new DOT to grant XXXX permission to recorded before XX/XX/XXXX, new XXXX owned the Mortgage loan, however, after XX/XX/XXXX, it is Ginnie Mae through the UCC3 procedure that is owner of the Mortgage Note but not the loan debt, and XXXX XXXX XXXX is not inform of the XX/XX/XXXX sale of the mortgage loan and that on XX/XX/XXXX, is now the owner of the Mortgage Note that restricts XXXX from acting on the mortgage loan as they don't have authorization of the Mortgage Note that protecting the MBS that they created and have received monies from the investors that is required to be paid back before the mortgage loan is released from the Ginnie pooling. It is all about the timing of the recorded DOT as to who could non-judicially foreclose as only the originator can call the loan due without having to provide proof of ownership of the mortgage loan, and when another party is calling the loan due as the UCC3 procedure and the physical transfer of the Mortgage Note has taken place then UCC9 must be followed which in XXXX NE Statute 21-20,16 was in effect and XXXX did not have certificate of authority and violated NE Statute 76-2710 using the invalidly recorded DOT, as nominee to file Assignment of Deed of Trust to XXXX XXXX XXXX that did not paid GWB or XXXX or Ginnie value for the Mortgage loan and prevented me for rightly defending my property. GWB on XX/XX/XXXX, imputed into XXXX Transfer of Beneficial Rights Option 1 that indicates that the transfer took place on XX/XX/XXXX the day my loan was accepted into the XXXX Ginnie MBS. So on XX/XX/XXXX XXXX knew that XXXX did not own the Mortgage Note because it imputed the data required for all mortgage loans placed into the Ginnie pool, but there was a violation of Ginnie requirement that the DOT and all assignment be present in the loan file when placing the loan into the pooling but GWB know the DOT has not been recorded and there are no assignment which one is required from GWB to XXXX. Yes GWB does not own the mortgage loan after XX/XX/XXXX, however they still are acting on the mortgage loan due to not recording the DOT when they had authorization to do so with that authorization ended on XX/XX/XXXX! The debt follows the Mortgage loan which was owned by XXXX, however, the failure to start the recording doe not grant a late filing when that party doe not have a financial interest to place a lien against the property when in fact GWB been paid in full before delivering the time sensitive instrument! Because GWB illegally recorded the instrument it allow XXXX and XXXX the ability to make it look as if XXXX purchase the debt from GWB 6yrs later as XXXX XXXX was not inform about the XX/XX/XXXX sale and the XX/XX/XXXX blank Mortgage Note transfer to Ginnie which both GWB was aware of at the time! GWB needed to have deliver and recorded the Deed of Trust between XX/XX/XXXX and XX/XX/XXXX because it is not owed a mortgage loan debt from me after XX/XX/XXXX, as the Deed of Trust is not mandatory to be recorded unless the bank wants a lien against the property, as XXXX did not record an Assignment of Deed of Trust as it was their option to do, but XXXX who lost {$30.00} XXXX and now does not exist had a different way of doing business and have a duty to have needs a DOT recorded by XX/XX/XXXX as GWB failed to record the initial DOT on or before XX/XX/XXXX when that was the last day they had a financial interest in the mortgage loan!

During the closing of our loan between XXXX XXXX Bank ( XXXX ) and my wife and I we signed a Deed of Trust ( DOT ) allowing the bank to place a lien against the property under XXXX requirement and that lien could be transfer to successor or assign, and Mortgage Electronic Registration Systems ( XXXX ) was allowed into the process by the recording of the DOT first by recording the DOT by a party that held the loan debt. Now because XXXX failed to delivery and record the DOT while having owned the loan from XX/XX/XXXX and XX/XX/XXXX when it sold the XXXX XXXX XXXX loan to XXXX XXXX XXXX ( XXXX ) on XX/XX/XXXX, but first register the loan with XXXX on XX/XX/XXXX, before it recorded the DOT which does not start the XXXX titling because as required the DOT must first be recorded. XXXX did endorse the Note on XX/XX/XXXX, to XXXX, however, this information was not reported to XXXX County Register of Deeds that XXXX had sold the loan to XXXX, and the fact that XXXX on XX/XX/XXXX, did transfer ownership of the Note to XXXX XXXX on XX/XX/XXXX, when placing my loan into their ( XXXX ) XXXX XXXX XXXX as XXXX would access the XXXX system on XX/XX/XXXX, and perform Transfer Beneficial Rights - Option XXXX, from old Investor in XXXX to new Investor XXXX XXXX, stating the effective date XX/XX/XXXX, the date the Note was endorsed in blank by XXXX and relinquished to XXXX XXXX per XXXX requirements for pooling of all XXXX pooled loans. XXXX who on XX/XX/XXXX, did deliver and cause to have record the DOT in violation to XXXX XXXX XXXX as XXXX sold the loan on XX/XX/XXXX, and has no financial interest in the loan because it has sold the loan to XXXX XXXX days before informing the State that it still owed a debt against my property, when the fact is XXXX was not owed a debt, but XXXX was the debt holder would was not the owner of the Note as it relinquished the XXXX process blank Note to XXXX XXXX . XXXX on XX/XX/XXXX, when transferring the title inside of XXXX should know that as over XXXX % of all XXXX XXXX XXXX loans are XXXX pooled as my loan was, and transferring to XXXX on XX/XX/XXXX, was because the loan was accepted and ownership of the Note was a requirement! XXXX ownership is not supported after the loan is pooled because XXXX is owner of the Note yet is not authorized to ever buy or sale a mortgage loan which they did not do in this case as with every loan pooled into the XXXX XXXX XXXX. XXXX should not have transferred titling in XXXX which it know XXXX did not purchase the loan from them, and that XXXX purchase the loan, and that this is XXXX business and not that of XXXX who sold all interest in the loan on XX/XX/XXXX. XXXX was addressing my situation when XXXX President XXXX XXXX wrote the XX/XX/XXXX, Limited Power of Attorney but not recorded at XXXX XXXX until XX/XX/XXXX, due to XXXX assigning all its XXXX XXXX Fed Gov Backed mortgage loans in a bankruptcy remote procedure to XXXX XXXX Bank who started mortgage servicing these loans on XX/XX/XXXX. XXXX stops existing on XX/XX/XXXX, and could not and did not sale my mortgage loan as they transferred the Note endorsed to XXXX back on XX/XX/XXXX, which XXXX is aware of as the XXXX Milestone report recorded the illegal transfer by XXXX to XXXX. There is no debt owned because XXXX did not own the debt and XXXX who is dead can not claim ownership and was not in title at XXXX XXXX or XXXX. So XXXX claims it was acting as nominee for the successor because there was no assigned as XXXX who is in violation of XXXX XXXX XXXX as it does not have a financial interest in the loan. Because XXXX illegally has recorded the DOT on XX/XX/XXXX, it set in motion the foundation of this crime just as in XXXX XXXX XXXX XXXX XXXX XXXX the XXXX case were XXXX could not provide proof of ownership and the judge awarded XXXX {$3.00} XXXX as the same law firm working for XXXX XXXX XXXX XXXX XXXX out of XXXX XXXX is also working for XXXX, XXXX and XXXX in the illegal foreclosure on my property. The title is cloudy and is in need of quiet title!

I had a balance in XXXX and I was paying it off. The card was terminated, I called XXXX XXXX and was told the card was terminated for not charging enough to my XXXX XXXX card account, but I received not any statements. I called XXXX XXXX and was told I had a typo on my address that I corrected several times but never received mail explaining this from XXXX XXXX. The charges stopped but later in XXXX they started up again unexpectedly with no notice. In midXXXX the charges started again, and I did not notice because I still shopped at XXXX XXXX and used my debit card for purchases since my XXXX XXXX card had been cancelled by XXXX XXXX. The charges appearing on my bank account were from XXXX to {XXXX} per month and were from a made-up check that was not my check. The checks had my name in the upper left-hand corner, First Interstate Bank in the middle and codes such as XXXX XXXX XXXX XXXX and a check number, i.e., XXXX. I called First Interstate and complained that I felt the charges were fraudulent and I wanted them stopped, that I had not authorized them and did not know what they were for. I was told to go online at First Interstate and to fill out a form to stop these payments, which I did. I assumed the XXXX XXXX check withdrawals stopped and did not hear back from First Interstate Bank or XXXX XXXX. Later I found the XXXX XXXX checks re-appearing as withdrawals over and over. I called various phone numbers at XXXX XXXX and was told the statements would be sent and that the card was shut down, this happened numerous times. They said the same incorrect address of XXXX XXXX XXXX XXXX was used after I continued to correct it to XXXX XXXX XXXX XXXX, up until two days ago ( XX/XX/XXXX ) when I called XXXX XXXX, XXXX XXXX, XXXX XXXX XXXX XXXX XXXX XXXX and again corrected the address, I could hear them laughing at me! Then I was told that the card was active now with a XXXX balance that nobody could explain what I was being charged for? I asked for all records and was told they could only send me records for 7 years then they said they would send me records for 18 months and that they would send a new card to me. I called First Interstate Bank again and spoke with XXXX XXXX ( in XXXX Office I believe I dialed XXXX XXXX ). I told him I had ongoing charges, the last on XX/XX/XXXX for {$54.00} from XXXX XXXX check that was not mine. I asked him to stop the withdrawals to my account, to that I did not authorize these charges and that I believed them to be fraudulent. I told him that earlier I was told to fill out stop forms on the First Interstate banking online. He said that I must have authorized the charges and that he could not stop the charges. XXXX was un-cooperative. I asked him to confirm the dates of the charges and he never gave me an answer. He stated that I could not even tell him what specific form I filled out to stop the payments. I described it but he appeared to be really focused on his authority and asked me when I was born He said that I had authorized this and there was no way it could be stopped. I told me I would file a complaint and he did not care. I called First Interstate Bank on XX/XX/XXXX at XXXX XXXX and spoke XXXX XXXX. She tried to help and appeared to be a good representative. She said this situation looked like fraud but said she could only go back 18 months. She said she saw charges ongoing. She said I need to get ahold of a banker that she could do nothing, and everybody was at lunch. She said that she would immediately have a banker XXXX XXXX or XXXX call me back today. She told me to work with XXXX XXXX. Nobody returned my calls and today I looked at my account and see another XXXX XXXX Charge being processed. Please help me stop this blatant fraud.

Great Western Bank ( GWB ) who violated XXXX XXXX XXXX as it illegally recorded the Deed of Trust ( DOT ) on XX/XX/XXXX, when in fact it had already sold my Dept of VA XXXX XXXX XX/XX/XXXX, to XXXX XXXX XXXX XXXX XXXX ) but failed to deliver and record the DOT while XXXX ownership the debt which ended on XX/XX/XXXX. The issue of failure to provide XXXX with the correct Deed of Trust ( DOT ) and Assignment of DOT was address in the XX/XX/XXXX, Limited Power of Attorney ( POA ) by GWB XXXX XXXX XXXX as GWB only originated XXXX loans that it sold to XXXX in XXXX XXXX which all had DOT recorded and XXXX XXXX Deed of Trust except for my loan which did not have a Assignment of DOT up and until after XXXX stop existing on XX/XX/XXXX, when in fact the FDIC declared it a " failed bank ''! GWB knows who the successor of my loan was and it was XXXX that GWB endorsed the Note on XX/XX/XXXX, by VP XXXX XXXX. There is no assign and is reason the POA that was not recorded until XX/XX/XXXX, when XXXX was at the end of assigning the XXXX XXXX Fed Gov Backed Mortgage loans to XXXX XXXX Bank starting on XX/XX/XXXX in XXXX XXXX with the XXXX or so XXXX mortgage loans ending in XX/XX/XXXX with XXXX or XXXX more taking place after that date. Here are the names of the other XXXX loans that GWB originated in XXXX XXXX and sold to XXXX, XXXX, XXXX and XXXX all having assignments to XXXX. Understand that XXXX stop existing on XX/XX/XXXX, and did not have a assignment in my loan file, and as GWB did not create after the fact a assignment neither could XXXX because it would expose the XX/XX/XXXX, sale of the loan, but also there was a blank endorsed Note to XXXX XXXX using the XXXX procedure that all Fed Gov mortgage loan must have to be placed into the bank 's XXXX XXXX XXXX. Now after XX/XX/XXXX XXXX does not exist and is no longer a member of MERS and MERS can not act as a nominee as they are not working for the GWB who sold l interest in the loan on XX/XX/XXXX, and the successor of the loan was XXXX, but the stopped existing on XX/XX/XXXX, without selling the loan because the Note is owned by XXXX who is in physical possession of the mortgage Note and no one been assigned because GWB XXXX up when not recording the DOT in the timeframe and required. MERS violates XXXX XXXX XXXX and as they never received a certification from the State of XXXX XXXX of XXXX which XXXX them from using XXXX XXXX as this matter should have used the XXXX procedure to provide proof of purchasing the loan debt which XXXX did not purchase the debt from GWB ever XXXX XXXX to trick XXXX XXXX into recording the XX/XX/XXXX Assignment of DOT that was just entered into the matter of Release of XXXX, made it appear that XXXX paid value for my loan from GWB as if XXXX did not purchase the mortgage loan on XX/XX/XXXX, which can not be told to XXXX XXXX due the date is after GWB has sold the debt and does not have a financial interest in the loan after XX/XX/XXXX! XXXX does not own the Note after XX/XX/XXXX, which is XXXX owner of the Note after GWB. The recording of Assignment of DOT on XX/XX/XXXX, is a illegally recording as it after XXXX exist and XXXX never purchased the mortgage loan. GWB who does not create XXXX XXXX XXXX and did not know that the mortgage Notes are all endorsed in Blank taking away the ability of the lender to act on the XXXX. However, XXXX XXXX is not authorized by US Congress to buy or sell a mortgage loan! As in the recent XX/XX/XXXX, CFPB XXXX XXXX against XXXX for {$3.00} XXXX for abusing XXXX XXXX of its customers I am XXXX of those victims. We have had a loan from XXXX XXXX XXXX that was always current and never late in 7 years. First Interstate Bank bought out XXXX XXXX XXXX this past summer. During the summer my wife and I were in the process of getting a mortgage loan with XXXX XXXX XXXX Our credit had been pulled in XXXX of 2019 and again in XXXX of 2019. My fico score at the time of the XXXX inquiry was XXXX and my wife 's was XXXX. About 2 weeks from closing, I was informed that our credit fico scores had dropped 100 points. I contacted my old banker friend at XXXX XXXX XXXX regarding the drop, he informed me that First Interstate bank reported the loan they inherited during the merger as a CHARGE OFF. XXXX XXXX he can be reached at XXXX ( now with another bank in XXXX ) contacted XXXX XXXX who was an employee of First Interstate Bank, after she left her position with XXXX XXXX XXXX because of the Merger. She sent a letter to the Mortgage Co which read as follows, XXXX XXXX XXXX Loan # XXXX, now First Interstate Loan # XXXX ( as a result of a merger, is current with the last payment amount of {$150.00} being made XX/XX/2019. If you have questions, contact XXXX XXXX at XXXX. The loan on my credit report and my wife 's showed as a charge off loan. Needless to say this almost cost me my mortgage since this all took place 12 days before we closed the loan. The damage to our credit report has been devastating for a couple of XXXX year old people. There was never any mention of the taking responsibility for charging off the loan as you can see in the wording of this short letter. The drop in fico score has cost me getting a lower % rate on our home and has cause problems with our credit card companies and lowering our lines of credit. I have been refused credit do to this mistake. I have been working with XXXX XXXX the Assistant General Counsel for First Interstate Bank in XXXX Montana. His phone # is XXXX. There contention is that they corrected the mistake on the credit report and no damage was done to either myself or my wife 's credit??!! My daughter in law is a XXXX XXXX and XXXX XXXX of a large bank and she suggested that contacting this bureau was going to give me the satisfaction we need to settle this. I have letters that I have sent to XXXX XXXX and letters he has sent me back with absolutely no responsibility on their part. I was in the process of buying a new truck, and because of the misrepresented credit reporting, my rate that was for $ 2.49 % went to 4.99 %. This is just one problem First Interstate has caused me because of the major error on their part. I am seeking damages in the amount of {$40000.00} to get this settled and our score up and above where it was in XXXX of 2019. We never bought anything, took out loans, did anything to hurt the mortgage process as per out broker XXXX XXXX who can be reached at XXXX. She has been a big help in getting mortgage to close even with the situation ( we had paid off almost {$35000.00} in debt to get the loan approved and rise our fico scores which it did ). I don't think that banks even though it was a mistake should not accept responsibility of damaging a persons credit and then taking not accountability for doing such a thing. XXXX XXXX contents that there false reporting had know effect on our credit and they are not responsible. The damage is done and now they must face reality!! Great Western Bank ( GWB ) did on XX/XX/2003, had delivered and record a Deed of Trust ( DOT ) after the fact that they had already been paid in full by XXXX XXXXXXXX Bank ( XXXX ) on XX/XX/2003 as the Mortgage Note was endorsed by GWB when the sale took place. As GWB had between XX/XX/2003 through XX/XX/2003, to have delivered and record the DOT, however, after that day on XX/XX/2003, GWB was no longer owed a debt by me and was not the " holder in due course '' and could not place a lien against the property. Violation of State of Nebraska XXXX occurred when GWB had the DOT recorded and at some point after selling the mortgage loan debt that was transferred to XXXX and in the Mortgage Electronic Registration Systems ( MERS ) which only begins when a valid recording of the DOT has been delivered and recorded at the local register office, and in this case that is XXXX XXXX XXXX XXXX XXXX Office , however, as GWB did realize that they had not recorded the DOT as they imputed the information into the MERS system on XX/XX/2003, that they were transferring the " Title '' inside MERS performing Transfer Beneficial Rights-Option 1, stating the transfer took place on XX/XX/2003, when in fact on XX/XX/2003 the DOT had not yet been delivered and recorded. On XX/XX/2003, the mortgage loan was accepted into XXXX 's XXXX XXXX XXXX which as a requirement of the XXXX pooling the DOT and all assignments are required in the file as with the UCC3 procedure of endorsing the Mortgage Note in blank and transferring it to XXXX making XXXX the owner of the Mortgage Note, but because XXXX can not and does not purchase the Mortgage loan debt, it is not entitled repayment of the debt, but by being in possession of the Mortgage Note it stop all action on the loan because XXXX does not have the ability to act as they don't own the Mortgage Note. GWB now removed from the Mortgage contract and XXXX having already taken possession of the endorsed Mortgage Note and XXXX endorsing in blank the Mortgage Note and acting as the custodian of records for XXXX without having a recorded DOT because one has not been delivered until XX/XX/2003, when in fact neither GWB or XXXX could have delivered and recorded a DOT or assignment of DOT because XXXX is owner of the Mortgage Note, but itself can not record a DOT due to the fact that they are not owed a debt as they are not authorized by US Congress to buy or sell a Mortgage loan and are not a originator of any loans. GWB could not deliver and record a DOT against my property as they were not owe a debt after XX/XX/2003! The Mortgage loan is a non-secure debt as a valid DOT was not recorded by GWB. Why did GWB not inform XXXX XXXX that a sale of the debt occurred on XX/XX/2003? Because of the fact it would have alerted the register that GWB was not the party to be recording the DOT after XX/XX/2003, and would have been XXXX who from XX/XX/2003 until XX/XX/2003 to be the one that needed to record a DOT signed by me giving XXXX the authorization to record, and after XX/XX/2003, there not ability to record a DOT due to the fact the loan been accepted into the XXXX XXXX XXXX XXXX pooling.

First Interstate Bank ( " Lender '' ) approved the loan and disbursed the funds after viewing all application info and insurance cards, which were required to be submitted. A few months later, Lender sent letters via unregistered mail advising that updates needed to be made to the insurance deductible ( lowered from {$2000.00} to {$1000.00} ). Those letters were not received as our mail was on hold and we were out of town. No additional use of our contact information was made - Lender has both an email address and TWO phone numbers at which we can be reached. Instead of trying to actually reach us, or even trying to confirm in any way that we had received the letters, Lender very quietly added {$10000.00} to our loan on XX/XX/22. No notice was sent of this whatsoever. A month later, when one of our credit reporting systems picked up that our balance on the loan has INCREASED, we were very surprised to see that the XXXX $ XXXX had been added to our balance. We called the Lender and learned that this is an " insurance premium '' for insurance with the {$1000.00} deductible covering the life of the loan- but we have 67 out of 72 months left and we have already updated the deductible. We have now discovered that the payee for the insurance that we are paying $ XXXX for is the Lender, that they are charging us interest on the insurance premium they are charging almost 6 years in advance, and that THE LENDER EARNS A COMMISSION ON THE INSURANCE POLICY they scammed us into. I believe this is the definition of a racket. Furthermore, since the loan term did not change and the balance has increased, our loan payment has increased but we were never given notice of this, not even when we were on the phone with the lender discussing this very topic. Lende withheld material information that would certainly lead to us making an insufficient payment next month, leading to more fees and additional credit score impact. This is a very shady practice and I'm sure it makes First Interstate Bank a lot of money at the expense of well-menaing people everywhere who, like us, always pay their bills and choose to do the right thing whenever there is awareness. We've already updated our insurance. Lender has still not updated our payment amount so we don't even know how much to pay. We now see that we have a loan with a shady scammer lender and will be refinancing as soon as possible, but our credit score has already been impacted by this and we face significant financial impact as a result of the additional > $ XXXX dollars added to our loan that we didn't budget for. First Interstate Bank is predatory and failed to inform us when they had the means- the intention was always to charge us this scam fee and earn their extra commission and interest. My Mother 's Trust account of which I am trustee and only legally authorized signer was allowed to have approximately {$40000.00} worth of checks written on it from XX/XX/XXXX ( date written ) of XXXX to XXXX. I reported this when I received the XXXX statement. I was told I had 60 days to report this from receipt of the first statement that showed fraud. When the complaint was addressed I was told I had only 30 days in the state of Wyoming from the date the first statement was available. This would mean that I was requited to do online banking and or contact the bank by phone, guessing when the date would be that it was available as per her response, the date is different each month. My mother was XXXX and did not use a computer. I rarely used the account except to pay for her bills. I feel this was a reach to require this and would like proof of this rule. Additionally, in my research regarding a bank 's duties, there is a level of trust that a customer should be able to feel, based on the bank 's fiduciary duties to ascertain that checks written have been signed by the correct person, signed by the person named as owner of the account and that the information such as title and address on the checks match any previous transactions, however this small bank allowed 11 checks to go through consecutively without noticing any of the red flags, including the fact some of the checks were quite large. My mother 's address was changed on the created checks from her address in Wyoming to an address in XXXX XXXX TX and a complete stranger was allowed to write each check. Additionally I was told different versions of the amount of time required to report.. I reported the day I received the XXXX statement and was not concerned that I did not receive the XXXX statement as I had also received a letter in XXXX saying an account at that same small bank had an incorrect address. ( it did not or I wouldn't have gotten the letter ). The bank 's response was that they apparently did not have client 's information in one database as an excuse as it was " for a different account?? : '' The bank watched my account activity and requested a copy of my POA and Will although this was sent by my Mother 's financial adviser in XXXX, brought in to the XXXX branch physically by me in XXXX and kept by them and requested again. I was told each time, copies were made and put on file but no one seemed to have it. I did send it to the XXXX XXXX in XXXX who scrutinized my use of the account but did not notice 11 Fraudulent checks that were clearly fraudulent went through without notice. The last response stating that I only had 30 days from the random date accessible only online or via phone makes me question, also, if that is also the case in the bank in the state of Montana that I had to contact initially since after several calls to both branches in XXXX, no one answered. l believe the Wyoming banks are branches of the XXXX XXXX.

XXXX XXXX I spoke with XXXX XXXX at First Interstate Bank about the service charge on my account. She informed me it was because my balance was not over {$250.00} when the statement cycle ended. Now, Ive made sure that on the XXXX of the month it is over {$250.00}. XXXX XXXX I call First Interstate Bank again as I see that I was charged yet AGAIN another service charge fee. She didnt know what a statement cycle was and that she had no authority to reverse that fee as she is not a banker. Only a banker was able to do that. I told her I wanted a complaint submitted. She stated that every day it has to be over {$250.00}, and that on XXXX XXXX it fell to {$240.00} so that was why I got a service charge fee. I asked her if my account is over {$250.00} by the end of the statement cycle, it shouldnt matter as it is over {$250.00}. She said that it did matter regardless. She mentioned I could do a direct deposit to the account but I chose not to do a direct deposit to that account because when I started my new position Great Western Bank was in the middle of merging with First Interstate Bank and it was not fair to the finance department to have to figure out where my paycheck was to go to, just because the banks were merging and it would mess everything up due to routing numbers being changed all over again. I expressed that nothing with this merger seems to be good and that I didnt ever have these problems with Great Western Bank XXXX XXXX said well maybe we are more sticklers with First Interstate Bank than when Great Western Bank. I told her I wanted a complaint filled about this as well. That isnt right. Even XXXX XXXX is not this bad, in my personal opinion.

Hello. My ex-husband took out a construction loan ( s ) with First Interstate Bank to build a home ; the property ( which was out of state from our residence ) was valued at XXXX, we borrowed at total of XXXX from the bank, paid another XXXX for it's construction and then ran out of funds. The bank then issued us credit cards to continue to make loan payments. We sold the home for XXXX and were coerced into signing a collateral loan for XXXX on a business property in our home state. We have been trying to obtain our loan file ( containing loan draws - which the bank was directly distributing to the construction company, invoices, receipts, etc. ) from the bank for 5 years. Despite hiring 4 law firms to obtain our loan files - THE BANK HAS REFUSED TO ALLOW US TO VIEW OUR FILES. Recently the bank sent an email to my ex-husband, who gave them permission the release the loan files to current attorney - XXXX XXXX ( XXXX ) XXXX, AGAIN THE BANK HAS NOT RELEASED OUR LOAN FILES. In fact, they have added {$870.00} to the payoff balance of the collateral loan for their legal expenses ( my attorney tells me that this is a violation of South Dakota law ). Should a US bank be permitted to withhold loan file details from the loanee 's inspection? Is the loanee ( who is responsible for paying back the loan ) not the owner of the content of the files? Can the bank unilaterally decide to add their legal fees to a loan payoff? If so can I unilaterally decide to deduct my legal fees from the loan balance? PLEASE assist us in dealing with First Interstate Bank. I realize, that this is a complicated complaint that has unfolded over years and contains hundreds of pages of documents, letters, and correspondence - I am incredibly frustrated trying to deal with First Interstate Bank - they have been unwilling to negotiate with us. I opened my {$1000.00} limit credit card with the bank in XXXX of XXXX. In XXXX of XXXX I received a call that my card had been shut down due to a merchant compromise that included my card information. The rep informed me that they would mail me a new card. Due to having reached my limit on the existing card I did not activate the new card. I had given my old card to my ex spouse because I thought the card had been closed. My ex spouse needed a card on file for an account and that was one I thought could be used without making charges. Over the span until XXXX of XXXX, transactions were still allowed to be processed on the card. I later found, after the account was closed out that this card was also my default card for mobile payments and I had initiated transactions as well had my ex spouse. By XXXX the account had over {$11000.00} dollars due. While discussing this situation with the bank I was accused of credit card fraud by deliberately making NSF payments. This is not the case, as their online banking system allows for payments to be canceled after initiated. I had initiated a minimum payment to the card on XX/XX/XXXX. I promptly canceled the payment within minutes due to the amount being much higher that I usually pay and submitted a payment for my usual amount. That is when I noticed the balance. I attempted to call the company to get my account closed, but I was informed it already was. I thought nothing of it and continued making payments as I had before. In XXXX I received a letter that my account had been closed due to NSF payments being made. This, again I thought nothing of, because the account to my knowledge was already closed. When I visited Montana, I brought the card with me and made a transaction using the physical card as an experiment. I presented the receipt to the banker and informed them of the situation. I was informed that there was nothing that could be done about the credit reporting and that I would need to continue to make payments of 3 % of the principal balance going forward.

had multiple items clear my checking account that had no available funds or overdraft protection called the bank on XXXX XXXX XXXX and spoke with XXXX in the call center who was unable to explain how the items were cleared causing a negative checking balance as well as multiple overdraft charges these are items that i did not authorize and have never been paid in the past when using only a debit card since XXXX was unable to explain to me she transferred me to XXXX at the XXXX branch who told me those funds would clear since i authorized the payment i asked how the funds would clear since i didnt authorize the bank to clear them and now i am stuck with almost XXXX XXXX dollars in overdraft fees on top of the items that clear putting my account at over XXXX XXXX dollars in the negative again she couldn't explain just asked me if i was interested in an overdraft account which i advised i was not i just wanted to know how the funds cleared and she kept asking me if i was authorizing the overdraft fees which made me laugh because why would i finally i explained my frustration and asked for the overdraft fees to be returned and she told me since the items were paid i owed the fees then told me i do have an overdraft of XXXX XXXX dollars but couldnt tell me when i signed up for it i have had a good account and only use it for personal transactions but i feel that once again no one is able to explain after i have not had any incidences on my checking account for some time XXXX could only go back to XXXX where a gas station charge was made and the following day a deposit was made so no overdraft charge was made she explained the overdraft charges i received last week were due to the account not having a balance and in the negative for a few days i told her i knew that thats why i am calling but not getting anyone to tell me how it happened i am hoping this gets to the correct person because i have tried to handle this directly with the bank before making this complaint

On XX/XX/2022 a check was written on the XXXX account in which I am in charge of. The check was fraudulent and approximately 12 more checks were written in large amounts up to XXXX per check for an approximate total of {$40000.00}. I contacted the bank both in person and via phone, and filed a police report on the exact day I discovered this when I received my statement showing these checks that had clearly been manufactured with incorrect address and title, signed and written by an stranger when I am the only signer allowed on this account and the only person allowed to do any business of this account. I was told I had 60 days from the receipt of the first statement showing fraud to report and receive the stolen money from First Interstate, XXXX, WY. I was well within that time as I reported on XXXX XXXX 30 days from when I should have received my first statement showing fraud. I received a letter showing my address needed verified rather than a statement for XXXX. All the checks went through the bank with no question and most were clearly cashed by a XXXX XXXX XXXX XXXX in VA. Approximately XXXX was returned after about 2 weeks and no other updates have been made. I've had 2 other banks tell me First Interstate should've returned the money to my account, by law, within 48 hours, but I have still not received the remainder that is missing. I've emailed and called and am still missing approximately {$20000.00}. Please help. I was also told this my be a case of elder abuse as I was told that I should've banked online and would have discovered this sooner.. I am not comfortable with online banking and am over XXXX. On XX/XX/XXXX, I bought a used vehicle and financed it through First Interstate Bank ( XXXX, MT ). I was unable to actually pick the vehicle up until XX/XX/XXXX due to inclement weather and schedule conflicts. I live 2.5 hours away on the other side of the XXXX XXXX. from the dealership. During that time, the vehicle sat on the dealership 's lot and did not move. On XX/XX/XXXX, I was finally able to pick up my vehicle. On XX/XX/XXXX, I had my truck insured for the ride home and for the next year, etc via the insurance company I use for all of my vehicles. When I got my statement from First Interstate Bank, it stated that I was past due on my payment even though I had autopay set up. Here, it turns out, they had imposed a forced insurance coverage charge on my truck for the time it sat on the dealership lot from XX/XX/XXXX to XX/XX/XXXX ( 41 days ) at a cost of {$780.00}. The insurance company they used was XXXX XXXX XXXX XXXX XXXX XXXX. I received no notification that I had insurance on my truck while it sat. There was no declarations page sent, no indication of any kind of the type of coverage I had, no app on my phone to use... nothing. As it can be seen on the attached document, the coverage wasn't even issued until XX/XX/XXXX. After many phone conversations with First Interstate, XXXX XXXX XXXX, and the dealership ; First Interstate wouldn't budge. They are still charging me {$68.00} a month for twelve months ( a total of {$810.00} ) for 41 days of insurance coverage. That's $ XXXX ( $ XXXX = XXXX ) or, realistically, $ XXXX ( $ XXXX = XXXX ). That is an exorbitant amount for coverage.

I am being overcharged interest every month. I am being double charged. I called my card company twice and spoke to XXXX people who said that my rate is XXXX and that is fact. Deal with it. First Interstate Bank is charging my account {$5.00} a month for a service fee. They are not supposed to do this when there is a direct deposit every month. I have contacted them twice and it was supposed to be fixed. Now again in XXXX a {$5.00} fee appears. I have sent letters to the bank and numerous agencies. Your agency has been contacted twice. My complaint # is XXXX. I talked to XXXX by phone and she said now she needs a picture ID, my E-Mail address, phone number, and she asked for my age before she can give me the results. She was courteous. I can not take phone calls on my home phone because it upsets a family member. I prefer to receive mail. The bank said the fee was deducted initially because of the deposit dates. The direct deposit is Social Security. Social Security is the most dependable deposit of funds that there is. If First Interest Bank is deducting funds from all their Social Security customers, they're making a lot of money from people who might not be able to babysit their bank accounts. CFPB needs to look further into this banks fraudulent practices. It's hard to log into an account when there is not a place to so. All the account features are for accounts that already have passwords.

I took my dad to open a new account We are having trouble with my brother abusing his POA his POA has since been revoked. When we got to the bank an XXXX XXXX offered to help. She asked my dads name and asked who I was. I replied im his daughter. She announced my name XXXX XXXX stuck her hand up in my face and said she wouldnt be opening any accounts for me today. Savings accounts I opened in XXXX for my then minor sons for their college funds have been charged for monthly service fees for " inactivity ''. We have had this mortgage since XXXX and we have always had an escrow account to pay our taxes and insurance. The mortgagor did not pay the homeowners insurance again. Stating that they did not receive a bill from XXXX. Well according to XXXX they had the address that they have always had which is an address in XXXX XXXX, SD not XXXX, WY. SO when I contacted the mortgage company they told me that it was my fault that they did not receive the insurance bill to pay it. That it was in our mortgage contract that it is our responsibility to make sure that they receive the bill. Now keeping that in mind we have had the same homeowners insurance much longer than we have had this mortgage company. So if they received the bill the last 3 years and paid it ; they should have received the bill this year and paid it. Also the mortgage company says it has 30 days after the due date to ay the bill. NOW I WAS TOLD THEY DEPOSITED MY CASHIERS CHECK OF {$4600.00} TO COVER TRANSACTIONS COMING OUT OF THE ACCOUNT. NOW IF THE MONEY IS TO COVER TRANSACTIONS WHY WOULD THEY NEED TO FORCE DEBIT THE MONEY OUT, IT SHOULD HAVE BEEN DEPOSITED AND THEN TRANSACTIONS WERE TO COME OUT. WITH ANY BANK WHEN MONEY IS DEPOSITED IN THE ACCOUNT, THE BANK DOES NOT FORCE DEBIT IT OUT YOUR ACCOUNT FOR THE EXACT SAME AMOUNT. THE BANK HAS TO SHOW WHY IT WAS FORCED OUT AND WHAT TRANSACTIONS IT COVERED. THE TRANSACTION DOES NOT SHOW IT WAS COVERED JUST THAT IT WAS A DEPOSIT AND THEN A FORCE DEBIT. Do to First Interstate Bank delay on our construction loan of 5 months past occupancy. Home owner initiated contact to get the loan roll over process initiated. Home owner did much of the work that is the banks responsibility. Documents signed from builder, preparation of paperwork, communication and confusion. This then created a {$4400.00} interest payment when our new mortgage payment will be {$3600.00}. Due to the banks delay, lack of preparation, lack of communication we paid nearly {$1000.00} extra in XXXX month and then turning around and having to pay {$3600.00} for the mortgage payment. This has been a hardship for our family and we should have never gotten to a payment that high had the bank done their job. On top of that at the closing the bank representative was a no show, leaving us with unanswered questions, frustration snd confusion on next steps. Current payment and future payment. Since I am unable to get in contact with management at my bank, I would like to know why the practice of overdraft fees continues during the COVID-19 pandemic? Am I incorrect in thinking that banks will be getting stimulus packages like any other business? I have not worked for a month now and have recently incurred overdraft fees which I will not be able to address until XX/XX/XXXX. I have already been charged {$150.00} in overdraft fees and my account and additional fees begin XX/XX/XXXX or XXXX. Of the {$160.00} I am presently overdrawn, without the {$150.00} in overdrafts I am overdrawn by less than {$10.00}. Surely given the extreme circumstances of the pandemic the practice of charging overdraft fees should be waved. According to many sources over 75 % of American families live paycheck to paycheck. Certainly my situation is not unique and if allowed to continue will cause irreparable financial crisis ' to millions of American families. Overdraft fees are ethically questionable in the first place, but in these extreme times their continuation is the worst form of usury.

I am a property investor with several properties in both Idaho and XXXX XXXX as well as XXXX. When I was in the US in XX/XX/2019 I was encouraged to open an account with First Interstate Bank in XXXX Idaho. At the time I signed all the forms and provided all the identification that they required. They did not indicate that would be any problem with me being an XXXX resident when I met with the representatives of the bank, XXXX XXXX. On returning to XXXX, they informed me that even after providing additional information to them and signing another form for the second time, they informed me that they were going to close my account. I wish to lodge a complaint against this bank for misleading statements and incompetence as it became apparent that they never should have offered me an account or opened one for me. I have tried customer service, and bank location # s. Every time i've gotten the message " call back when we're open at XXXX XXXX '' even though I call past XXXX. There is no way to contact their customer service #! This company ( First Interstate Bank ) did a buyout of my bank ( XXXX XXXX XXXX ) and for WEEKS i've been unable to reach a representative to give me access to my accounts. The previous login information for XXXX XXXX Bank doesn't work, and neither does their XXXX application. On XXXX reviews they CLAIM that this is a " transition period '' but that merger happened weeks ago, and why would that affect the parent company 's customer service lines improperly telling customers that they're closed, HOURS after they open?! Go ahead and dial their customer service number ( XXXX ) and TRY to get through to an actual representative. It is impossible. They took my accounts from XXXX XXXX XXXX and have STONEWALLED not just me, but many other customers from accessing their accounts FOR WEEKS. This is criminal. Please look into this, I beg you.

For 20 years I held a free checking account at XXXX XXXX XXXX. Over that time I never accrued any fees of any kind. I moved away with an XXXX XXXX assignment a long time ago and since forgot about the account where it continued to never accrue any fee or charge of any kind. First Interstate Bank acquired XXXX XXXX XX/XX/2022. Without my knowledge and without any contact, the account held there immediately started accruing completely arbitrary and predatory {$25.00} fees for various reasons and now there is over {$230.00} in overdue charges. I only just learned about this because of a recent credit check I ran. Since I'm not in the area, I can not attend to this in person and there doesn't seem to be a way to remedy this amicably or close my account in an easy manner as I wish. Now they posted an 30 day overdue account to my credit report and my flawless credit took a XXXX point hit, all because they want to apply random fees and charges that were never part of my original account -- terms that I never agreed to nor was even made aware of.

On XX/XX/ 2018 my account was presented with a charge for {$39.00} and the bank paid the amount out. This caused my account to overdraw. I had opted for a service when I opened this account that would prevent overdrafts by not paying if there was no money in the account. My local bank was taken over by a large bank and they said that they changed my preferences to allow overdrafts. The said that they mailed me a notice, but I never saw it. The bank then proceeded to charge consecutive overdraft charges every five days. They also said that they were allowed to do this now that they are a different bank then the one I signed up with. Once my account was overdrawn for over a month they forced closed my account charging another {$50.00} for a total of {$320.00} in bank fees, at the time my account was closed after the {$50.00} charge my negative balance was {$360.00}. The amount I am negative in the account is {$40.00} and the bank fee 's are {$320.00}. This is 800 % in fee 's in just over one month.

I recently viewed my Credit File with XXXX, and noticed an account that was listed as Open, when it should have been listed as Closed. So I disputed the account information and received a notice from XXXX that my dispute was denied. The bank verified that my account is still open. It should not be open. Also, there is a balance of {$43.00} being listed as due on this account in my credit file. This is wrong. I paid this account in full to XXXX balance and then after confirmation that my payment was processed, I called the number on my card and requested this account to be closed. My final statement dated XX/XX/2023 shows the final payment of {$43.00}, with a XXXX XXXX of XXXX. This is the final statement that I received for this account. I have received no other statements since this final statement requesting payment or showing a balance due. When I go online to my accounts on the bank website, there are no credit card accounts currently listed.

On XX/XX/XXXX, I set up one ( XXXX ) $ XXXX transfer from my First Interstate savings account to my external US savings account. I received two separate emails from XXXX saying they received my request to transfer $ XXXX. I contacted XXXX saying I only authorized one transfer for $ XXXX. A few days later I got emails from XXXX saying three ( 3 ) external transfers for $ XXXX each were completed on XX/XX/XXXX. I sent multiple secure messages to XXXX saying I did not authorize three separate transactions, only one. They responded saying my account showed three separate transactions that only I could have made. I used to have a checking account with Great Western Bank. It was absorbed by First Interstate Bank. Prior to absorbing the company I was informed that my account number would be closed/changed because their business had a previous customer with the same account number. Despite my best efforts to maintain an account number that Id owned for 40 years. I was denied keeping my personal account. I opted to close all accounts with Great Western Bank before First Interstate took-over ownership. I completed all signed paperwork stating that the account was closed. I had funds put on my account on the XX/XX/XXXX so I could order two items on XXXX. The orders caused two separate holds on my checking account. Previously with my account multiple fradulant debit card purchases were allowed to process in my account overdrafting it again at the managers discretion. First Interstate Bank closed my account without notice because of a zero balance that persisted for 30 days. I was not given a chance to bring the balance up or given any warning at all, I found out when I went to check on my direct deposit that was scheduled to hit on XX/XX/21. I called the support number for First Interstate Bank and was informed my account had been closed on XX/XX/21. I had applied for a usda home loan through first interstate bank on XXXX. On XXXX I was contacted by a loan officer and my husbands and my credit was ran 5 times in a period of 3 days. That many inquiries damaged our credit and the bank never even got back to us after 4 weeks. On Friday, XX/XX/2022, First Interstate Bank experienced what as called a " server error '' and no funds could be withdrawn. This second time in within a year that this bank has ha major system errors that have resulted in frustrations and poor customers experiences ( see my complaint from XXXX, 2022 ) .Funds were clearly available, but the Bank was denying them to the customer. The tellers ' best advice was to use the ATM machine outside of the bank, which is not available to anyone without a debit card. My previous complaint with first interstate bank is that they appeared to not have the successor in interest process. It appears to still be the case. I provided them with the information on XXXX and they should have responded within 30 days. Almost 4 months later they have not responded.
