At the beginning of XX/XX/XXXXupon closing on our new home, I discovered that Iberia Bank was inaccurately reporting information regarding a previous auto account that had been repossessed. We made arrangements to repay the outstanding amount on the loan and accidently missed a XXXX payment and called at the end of XXXX to inform them of our oversight and our intentions to provide a double payment in XXXX To our shock, Iberia Bank stated they had already sent it to garnishment. My husband and I had no choice but to file bankruptcy although the defaulted auto loan was about the only debt we had. We were advised by our attorney that only one of us should file since we lived in a community property account and had been married for over 10 years. My husband filed and the debt mentioned in this report was included it in my husband 's bankruptcy. For approximately a year after the bankruptcy Iberia Bank continuously called and harassed me. I eventually reached out to our attorney and a cease and desist letter was sent to Iberia Bank. In response to the letter they stopped calling but apparently turned thier attention to my credit history. In XX/XX/XXXXmy husband and I began the process of purchasing our first home. Naturally our underwriter requested information regarding the account. I reached out to the special assets department of Iberia Bank and was told to speak to a representative by the name of XX/XX/XXXX. I explained the situation regarding my husband 's bankruptcy and the fact that my debt was included under his bankruptcy according to community property state laws. My husband and I have been married for over 10 years and remain currently married as of today therefore my debt was included in his bankruptcy which was discharged inXX/XX/XXXX. XXXX would not give me any information and adamantly refused to give me anything in writing regarding my account. After speaking to XXXX on 2 different occasions and getting nowhere, I asked if I could speak to a supervisor. The supervisor told me that I was incorrect in my interpretation of community property laws however she would send me a letter stating the information regarding my account status with Iberia Bank. This request was made onXX/XX/XXXXXX/XX/XXXX The supervisor told me on the phone that she would be sending me a hard copy, she also asked for my address and also if I would like an electronic copy sent as well. The letter never showed up so I began calling again to which I was told that I would only be able to speak to a different supervisor by the name of XXXX XXXX. XXXX informed me that I would never ever receive a letter from Iberia Bank stating my account status and he had no record of my call with the previous supervisor or any of the previous failed dispute attempts. The supervisor I spoke to originally ironically did not give me her name. He then repeatedly told me to take it up with the credit bureaus. I explained that I have filed a total of six complaints towards Iberia Bank regarding this issue, hired a law firm and spent multiple hours on the phone trying to get this corrected. The problem was each and every time I called to inquire about the account or ask questions, Iberia Bank immediately would update my account with 120 days past due. As stated above, this account was included in the bankruptcy therefore I was unable to even pay on the account much less, all of a sudden be 120 days past due. UntilXX/XX/XXXXXXXX this account was not reporting. The date of the first update wasXX/XX/XXXX and the second update was on XX/XX/XXXXwhich is the date of the letter promised by the other supervisor. The inaccuracies at this point included : foreclosure terminology instead of the correct repossession terminology, the account appeared open when it was supposed to be closed inXX/XX/XXXX and numerous late payments after the date of my initial inquiry into the account. I stated for three months repetitiously then I will need all three of these inaccuracies corrected and documentation to prove that such inaccuracies were updated correctly. They refused to correct the information & repeatedly stated you will have to take that up with the credit bureau 's ; to which when I called the credit bureaus they told me that Iberia Bank verified the information, the inaccurate information. I would then turn around and call Iberia Bank and he would repeatedly state that I needed to take it up with the credit bureaus. This consumed over three months of a daily struggle, 6 to 8 hours a day desperately trying to get correct information reported to the credit bureau 's. We are in the middle of a house closing and the inaccuracies have caused this much strife and eventually cost us our house. Iberia Bank was made aware of all of this throughout the entire past four months however refused to budge on anything brought to their attention. As a last resort, onXX/XX/XXXXXX/XX/XXXX I decided to walk into a local Iberia Bank branch and ask for information regarding my account. The branch manager immediately pulled up my information and low and the hold the requested letter from XX/XX/XXXXwas in my file. The branch manager printed it out and gave it to me however it only stated that the account has been charged off not closed as it should be reflected. I then attempted to call XXXX with the Special Assets Department of Iberia Bank back and hopes to get the correct information reported. He again defaulted to the statement you 'll have to take that up with the credit bureau 's and furthermore told me that the credit bureaus must be obtaining their information from the wrong address and I should provide them with the correct address so that the correct information would be reflected. As absurd as this actually was I followed through with his request and as expected the credit bureaus immediately told me that I could not provide such information it would have to be given by the bank self due to the fact that Iberia Bank subscribes to their service therefore they must provide information to the credit bureau 's. After many phone calls to all three credit bureau 's on a regular basis it became apparent that Iberia Bank was simply moving in accurate, illegal informati after many phone calls to all three credit bureau 's on a regular basis it became apparent that Iberia Bank was simply moving in accurate information from one credit bureau to another does making it almost impossible to keep up with/and or correct. OnXX/XX/XXXXXX/XX/XXXX after many persistent phone calls and threatening to report them to the FTC and to contact the president of Iberia Bank, XXXX XXXX and XXXX XXXX agreed to send me a letter stating they were in fact reporting inaccurately. OnXX/XX/XXXX they provided me with a copy of the universal dataform that was supposed to reflect a triveta update to each of the credit bureaus. The following information was to be corrected : no late payments past XX/XX/XXXX no foreclosure terminology and no open account. The changes were accurate however they were only reflected on my credit report for approximately 48 hours. Upon further investigation of the submitted Universal Data Form, it was brought to our attention that they also illegally change the responsibility from a joint account to an individual account and they also increased the total amount from {$9900.00} to approximately 13,000 and one day later increased the amount owed to approximately 19,000. They also added 76 late payments to my 72 month term account after sending documentation stating all late payments were to be removed pastXX/XX/XXXX All of which is false and illegally being reported to all three credit bureau 's. Iberia Bank has refused to correct the most recent inaccuracies and have defaulted back to staing that I need to contact the credit bureaus to which I called and supplied all of my letters however due to the time restraints of the situation it was in my best interest to contact CFPB. I can provide all documentation regarding the letters written to me from Iberia Bank stating the fact that they were in accurately reporting, the copy of the universal dataform and many screenshots of their reporting over the past 4 months. This situation has cost my family and I our home and the opportunity to even purchase a home. We will not be able to ever purchase a home without Iberia Bank correcting the information. As mentioned, I have spent approximately 6 to 8 hours daily to get this corrected. The following INACCURATE information is showing on multiple credit reporting agencies : Account open, amount past due of {$19000.00}, joint account now shows individual account responsibility and 76 late payments. The account should ACCURATELY reflect the account closed inXX/XX/XXXX, joint responsibility, and no late payments after XX/XX/XXXX. However, at this point, I would like the entire debt to be removed from all three credit bureau 's so that Iberia Bank has no means of accessing my Social Security number or any of my information in the future due to multiple failed opportunities to accurately and legally handled the situation. They have changed the information they are reporting on a daily bases and I have no faith that any information reported by them will be reported correctly and will not be changed in the future unbeknownst to me.

XXXX XXXX, owned by Iberiabank ... re : XXXX XXXX Ln # XXXX Initially, I sent a letter to XXXX XXXX advising them of our financial hardship in XX/XX/XXXX. The hardship initially was due to a car accident in which my partner was rear-ended off the freeway, at a stop light. The cause/driver had slammed into his rear-end at 70 mph. A month later he suffered seizures which were being caused by XXXX XXXX XXXX, and XXXX XXXX XXXX, which resulted into XXXX XXXX XXXX over time and his inability to work for nearly 2 yrs. My initial request for assistance began in XX/XX/XXXX ; they acknowledged the request in late XX/XX/XXXX. During the interim, several attempts for assistance were pursued with the lender to resolve assist in our hardship delinquency. My loan originated over 15 yrs. ago, having been sold to different lenders at least 3 times. I have never had a point of Contact for Iberiabank or XXXX XXXX Loss Mitigation Departments. During this timeframe I pursued all avenues for mortgage assistance. I contacted HUD, Greenpath, Keep your Home California and several additional programs offered to distressed homeowners. After several conversations, I was referred to a Supervisor with HUD who advised me that neither XXXX XXXX/Iberia Bank were participants which cooperated with any HUD programs available. The Supervisore did, however tell me to contact my lender to see if they could provide me with a one-time exception to my loan to participate in HUD programs ( Iberiabank/XXXX ) which would enable HUD to step in. She assured me that HUD could then provide me with any financial assistance needed. Prior to last XX/XX/XXXX, my FICO score was XXXX. Because of her ( supervisor 's input ) I was encouraged to immediately write to Iberia/XXXX requesting the one-time exception to my loan, to comply with HUDs requests to me. I ensured the requests were sent via ito both XXXX & Iberiabank via XXXX XXXX, requesting a delivery signature, for confirmation. To date, there has been no acknowledgement or response from XXXX or Iberiabank. So, due to the urgency and coming Sale Date, I began to research Iberiabank, XXXX and anyother source for information and more background. What I discovered was that the Dept. of Justice had sued Iberiabank/XXXX for improper underwriting, erroneous claims, fraudulent underwriting and failing to honor fiduciary relationships, with HUD ... it got worse as you read the releases. The DOJ won this case against them with an award of $ aXXXX XXXX being paid to HUD. This infomation alone made it was clear to me that HUDs true issue was not Iberiabanks participation with HUD, or a needed exception to my loan. It clarified the prejudice of a large lawsuit that HUD won against my lender. My being able to obtaining a one-time exception from this lender was not going to be a magic bullet. The sigma of Iberiabank/XXXX XXXX past relationship with HUD was more likely HUD 's determining factor. The HUD lawsuit wasovershadowing the circumstances to enable me keep my home. The 2nd TD holder, XXXX XXXX XXXX has made the commitment that if Iberiabank/XXXX provided me with a modification, my loan would automatically be approved with their loss mitigation department. So, now my 2nd TD is being determined by Iberiabank/XXXX. This lender was determining my future on both loans, ensuring that on the Sale Date projected my home would be going back to them. All documented proof of our hardship, including requested medical records had been in their hands for a month or more, without communication from Iberiabank/XXXX. I wam sure my request for a modification will go on being ignored up to XX/XX/XXXX and going to Sale on the XX/XX/XXXX. I have requested copies of my original loan documents as I am entitled to from the lender two separate times, with no response or acknowledgement. I have confirmation of their receipt. My fear is that the pending Sale will go through awarding Iberia/XXXX XXXX my home. Iberiabank/XXXX will continue to ignore any requests for a hardship Modification, ignoring the California State Law California Homeowner Bill of Rights which ensures that a property can not go to Sale while a modification application is pending with a lender. Iberiabank/XXXX - will not acknowledge the laws or rules, I base this on both my experience with them as my lender and the public track record. The HUD lawsuit with my lender appears to be directly penalizing me, the homeowner from obtaining any assistance from anyone whatsoever. The consumer is getting the short end of the settlement from all angles. Neither Iberiabank, or XXXX XXXX have seen fit to respond to my communications, so I was hoping that your agency would be able to speak in a volume that may grab their attention, hopefully prior to my losing my home of 20 yrs. My communications with people at Iberiabank and XXXX XXXX is as follows, ( this list of names does not include the loss mitigation departments. I was not given a point of contact for this lender 's workout efforts..it 's been hit or miss. They have not provided me with verification that they have the documents showing both their ownership of my loan or the ability to foreclose on the home ... everything is ignored. The names below represent the most recent XXXX XXXX communication to each Iberiabank ( owner ) of XXXX XXXX as well as the XXXX XXXX to XXXX XXXX in Florida. The missed payments all started when I got laid off from my job in late XX/XX/XXXX, due to an outsourcing of my duties, and I immediately did whatever I could to find a new job. Pretty soon I was no longer able to make the payments on the mortgage. I even volunteered for months to help others with the XXXX XXXX job search group at the XXXX every week to find work. At this time my wife was working part time as a XXXX XXXX XXXX which was obviously not enough to keep the payments current. We asked the owner of the mortgage at the time, XXXX, if we could apply for a modification and they told us they would not accept it. Since we have rental properties where we were behind in payments and were able to modify all 3 mortgages for them we thought as an owner occupied property, we would have at least as good of a chance at a modification on our home. This seemed strange but we just kept trying to find employment first since that was critical. We thought at this point in order to have a chance we would both need to find full time work, even though my wife was a XXXX XXXX XXXX XXXX and had raised our XXXX children in XXXX she would do what she could to find a job. We contacted a state sponsored program for NJ Homesaver that we were told was a grant that could help us and just as we applied, the program was changed and the church in XXXX XXXX, XXXX said they couldnt help us with that program any longer. Unfortunately the job search wasnt working in XXXX XXXX. Since my wife has family in the XXXX XXXX, XXXX area we began looking there and we both found full time jobs, so in XX/XX/XXXX we moved in with family and started in our new jobs. Sadly, a week after I started in my role, XX/XX/XXXX, the president and founder of the XXXX XXXX XXXX I was working for was tragically killed in a plane crash in XXXX. Which put the company on a bad financial path right from my start. Therefore, by XX/XX/XXXX, the XXXX XXXX could not make payroll any longer and I lost my job again. Right around this time we were notified that the mortgage was sold to Iberia and in XXXX I contacted them to ask about a modification. At this point I would need a job to apply for the modification and went looking for work again and was offered a job in XXXX in which they would train me and I took it even though the job was outside of my field, I thought it might work out. Even though it didnt work out it eventually lead me through a friend I made at a volunteer organization, The XXXX XXXX XXXX in XXXX, to a good XXXX XXXX which is in my field. Then I contacted the new owner of the mortgage Iberia about a modification, now thinking we had the requirements for a modification. They agreed to accept a modification and sent us the modification application and now there was hope. Now that I finally had a stable job and the mortgage was sold to Iberia Bank we had a chance. Also, with both my wife and I working full time, we thought our chances were good at a modification. At this point we had an extension on our XX/XX/XXXX taxes and had to finish them for the modification. We focused on this with our accountant in XXXX XXXX but the process dragged out and we missed the XX/XX/XXXX deadline to file electronically and we had to submit by paper. This, I didnt realize, would delay the process drastically to get the IRS to be able to confirm to the bank that the return was submitted. On XX/XX/XXXX, I called Iberia to check in about the status of the foreclosure and they confirmed by phone that a date had not been set. Little did I realize, my daughter misunderstood the paperwork that was posted at the house on XX/XX/XXXX. We believe there was confusion over the notice about tenancy and we didnt realize about the sheriff sale, and didnt act. That was an error I feel horrible about. Not knowing about this we then received paperwork from a lawyer saying we had to pay rent or vacate the premises. The letter was dated XX/XX/XXXX and the rent was due XX/XX/XXXX. The letter was postmarked XX/XX/XXXX. It also said our lease was terminated and we had to vacate the premises no later than XX/XX/XXXX. Then we were mailed a tenancy summons to appear in court on XX/XX/XXXX, as part of the eviction process. At this moment we called Iberia again because the letter seemed strange. When I called them I, again, asked about the foreclosure and at first the woman said there was no date set. Then after about 10 minutes of confusion she said there was a sale on XX/XX/XXXX. I was very surprised since just a few weeks before the sale date I had spoke to them where they confirmed my number as they did on every call and told me there was no date set. We didnt get any real chance to work with Iberia as they had lead us to believe that we could and didnt even have the chance to make our case. At this point in time I just want the chance to have an agreement to resume making payments on the house where we have lived for almost 20 years, raised our XXXX daughters, and thought it would be there to be sending off our oldest daughter for her wedding this XX/XX/XXXX.

Tuesday XX/XX/XXXX at XXXX I was excited to open a business account for the 1st time. I thought I had all my documents, but I was missing my EIN number. XXXX told me I could get the IRS to fax the information to bank. But in the meantime, he could set-up my personal account. While he was doing that, I was looking up the IRS number on my phone. When I got on the IRS web page it would not let me click the number to dial. So, I got XXXX 's sticky note cards on his desk write the number down. I call the IRS but shortly hung-up because the lady that was assisting XXXX told me that she another number which was essential the same number I JUST dialed previous. I was a bit aggravated because I was already waiting on hold for 7 minutes and I had another appointment to attend XXXX XXXX. I gather my things and left. Few hours later I got a call from XXXX asking, I did I accidentally grip a business card when I was gathering my things? So, I search my car, purse, wallet but I didn't see it. I give him a call back to confirm told him I'll be back on Friday to finish the business account. Friday, XX/XX/XXXX XXXX 2nd try to open the business account. When I arrived, I told the lady at the front desk I wanted to open a business account and I have the IRS on the line to fax my EIN. The lady that was helping me didn't even know the bank had a fax machine. The was the 1st flag! The IRS confirm the fax was sent the 2 lady claimed they didn't receive it. So they provide me with another fax number the IRS confirmed again it was send. The lady received it but didn't see my personal profile set-up yet and XXXX had to finish it to gain credit for the account. 2nd red flag! I was under the impression XXXX set-up my personal account on Tuesday as he stated ... ... I go to XXXX 's desk. He asked me look through my purse again for the business card. I did and I found it in my wallet mixed in with the other business cards, I apologized and gave it back to him. In my mind it was a total accident. No big deal. Suddenly, the lady from Tuesday that give me the same number for the IRS comes over and accuses me of stealing a business card and needed an explanation. I told it was a total mistaken it was NOT intentional. XXXX and this lady when back and forth with me over a BUSINESS CARD of a PERSON I DO NOT KNOW or CARE to KNOW!!!! They were asking why would I do that? Why would I take bank property information? We saw the cameras and saw you put it in your purse. AS IF I WAS A CRIMINAL!!! They made me feel like I was a THIEF and discriminated against! I'm TELLING THESE FOLKS IT WAS A PURE ACCIDENT!!!! WHY WOULD WANT BUSINESS CARD FROM SOMEONE I DO NOT KNOW!!! They are in cahoots together saying we are trying to know why too. During this process, I felt harassed and discriminated against. After all of that they asked me are you sure you still want to open your account with us. Red flag number 3!!! Deep inside I didn't because I thought those actions were not called for but .... Since I just drove from XXXX XXXX, GA to XXXX, GA during my lunch break, was on hold with the IRS for 35 minutes to get my EIN faxed and I had ALL my paperwork I just needed my account now so I could go! They XXXX started acting like my EIN number was not valid even though the IRS JUST FAXED .... After an hour and a half later, he provides me with a rejection letter stating they can not open my account with no indication of why!!!!! NOW, I FEEL LIKE THIS IS DEEPER MATTER AND I FEEL BEING WRONGFULLY TARGETED!!! Please see the attachment below : ( As you can see there is no REAL reason checked why I could not open an account ) FYI- I opened my account with XXXX XXXX today with no issue under 30 minutes with the exact same documentation.

On XX/XX/2018 My mother, XXXX years old, went to Iberia Bank to secure a car loan. It was around XXXX when my mother went to the Iberia Branch in XXXX XXXX XXXX XXXX XXXX XXXX , FL XXXX where she XXXX XXXX XXXX was supposed to assist her. My mother speaks English fine, however, for certain transactions that has technicalities such as a bank loan, she usually has me on the phone with her ( when Im unable to accompany her ), to allow me to jump in and assist with any technical terms. I am her daughter, XXXX years of age, and I have power of attorney so that I can take care of all her affairs. I was on the phone listening, when my mom told XXXX XXXX that she is interested in getting a car loan, and that she has me on the phone to help if needed. His first response to her was that she should apply for a loan with the dealership. My mom didnt understand why he would help her, so she asked him to call her. He sounded very angry and impatient with her, as if she was wasting his time. XXXX XXXX called me at XXXX from the bank, and he with a very rude tone, told me that my mom should apply for a loan with a dealership. I politely said to him, that I thought this was a bank. She would like to apply with this bank and shop around for the best rate. He then proceeded to say that she should go to a credit union, they will have the best rates. He additionally said that the Iberia Bank in the location he is in will be closing, and they have a lot of fees, and its best to go to a credit union or the dealership. He was discouraging my mom from applying for the loan at all cost and did not want to serve her. I said to him that she wants to fill out the application with Iberia bank. He said that she would need to fill out the form. I said I would help her, I have power of attorney, and he can email me the form at work. He emailed me the for with the origination fee and doc stamps fee. Perhaps its because my mother is XXXX, but he tried all tactics to discourage her! He told me that I have five minutes to fill out the form and send it back to him and that she needs proof of income. I informed him that I have all that information but he was not interested in hearing me or helping my mom at all. He said that he is not comfortable to help my mom and went to get his manager whose name is XXXX ( She refused to give me her employee number ). I informed XXXX that XXXX was very abrupt with my mom and kicked her out of the bank even before she had a chance to tell him what she wanted or needed. I said that Would she have received the same treatment if she was a different race? and from there, XXXX said to my mom that YOU NEED TO LEAVE THIS BANK NOW OR ILL CALL THE COPS AND NOT TO RETURN!!! She went and open the door to kick my mom out of the bank!!!! I hope theres a camera that you can review to see that my mom had XXXX on XXXX XXXX and has XXXX XXXX and was rushed out of the bank!!! Im not sure what crime my other committed for her to feel the need to call the cops on her! What did she do wrong? Why was she not given the opportunity to apply for a loan like every other hard working citizens??? Why was she discriminated against the minute she walked in the bank??? My mom was so shaken by this experience and has never been sooooo humiliated!

My wife and I have had a car loan with IBERIABANK for over three years now for a car she drives and are extremely upset with how they have handled payments. Our first issue came about when we first opened the account with IBERIABANK and realized there was no way to set up an online account to conveniently submit automatic payments like we do with all of our other bills, loans, credit cards, etc. As such, my wife assumed she had no other choice but to drive to IBERIABANK once a month and hand them a physical check. This was rather tedious and some months she would forget and would be a day or two late, resulting in a late fee being charged. So after about two years of frequent late fees, I encouraged her to call customer service to see if they could set up automatic payments over the phone. They said they could, but each time she called to set it up, only one payment would go through, even though the transaction appeared on our statement as " AUTO TRANSFER CREDIT ( ACH ) '' ( see attached statement beginning at XXXX/XXXX/16 ). In other words, customer service was putting a transaction through at the time of the call but not setting up re-occurring payments for us even though they were telling my wife they were. This happened on several occasions ( see attached account statement ) and resulted in XXXX derogatory remarks on our credit reports from IBERIABANK ( 30 days or more delinquent on payments ). I recently called IBERIABANK when I saw this about a month ago to let them know that we had been told automatic payments had been set up and therefore were not aware those payments were that late. Two different customer service agents on XXXX different calls told me they were transferring me to the loan department and then subsequently dropped my call. I was calling from my office phone ( a landline ) so I know it was not a product of bad mobile service. I continued calling and was finally able to get transferred to the Special Assets Department and spoke with XXXX XXXX who informed me that not only did those customer service agents attempt to connect me to the wrong department ( and drop my call ), but that customer service agents can not set up automatic payments. I asked him if we could correct the delinquent notices on our credit report since there was clearly an issue with their customer service department, but he only defended customer service by saying that we should have followed up to make sure the automatic payments had been set up. I asked him if I could speak to his superior and he told me he was out but that I would receive a call later from him which I never did. He also emailed me a form to fill out so that we could finally set up automatic payments. I filled it out and sent it back a few days later with a voided check but have not since heard back from him. Three weeks have now gone by and still no word from XXXX. The first automatic payment was supposed to go through on XXXX/XXXX/16, but nothing has shown up on my bank statement from IBERIABANK. I do n't know what else to do at this point. We 've never had any issues like this with any of our other monthly payments. And now it has affected our credit scores significantly and I do n't feel like it is our fault.

On XX/XX/XXXX, a XXXX XXXX XXXX check in the amount of {$12000.00} made payable to me ( XXXX XXXX ) for an injury payment from XXXX insurance was stolen. Although the check had been endorsed to my XXXX XXXX XXXX XXXX account, had the account number and " for deposit only '' on the back of the check, the thief was able to replace my name with their name and address on the front of the check ; replace my signature on the back of the check ; however, the account number or " for deposit only '' was not tampered with. The check had already cleared when I became aware it had not reach my financial institution. According to a copy of the cleared check I obtained from XXXX it looks like the check cleared or was deposited on XX/XX/XXXX at an Iberia Bank. Even if the " fake name and signature '' on the check matched, what is the probability that the thief and I had the same account number???? A police report was filed and I have been working through XXXX to get the issue resolved. I was initially told by XXXX XXXX ( My injury case manager at XXXX ) that the process could take up to 90 days and that XXXX XXXX XXXX would contact me and send a package of information to complete for its investigation. XX/XX/XXXX, I had not heard anything from XXXX XXXX XXXX so called and emailed XXXX XXXX. I did ask for points on contact for XXXX XXXX XXXX at that time ; however, I was informed he would be the liaison. this process was new to him as well and had been given guidance by his supervisor. There have be intermittent follow-ups. My last update from XXXX XXXX on XX/XX/XXXX ; he stated that XXXX XXXX XXXX was trying to get the Iberia Bank to make good on the check because it should not have been cashed and the outcome would be know on XX/XX/XXXX. I called ( left a voice message ) and e-mailed XXXX XXXX on XX/XX/XXXX after not being contacted with any new information. This lack of information has been occurring throughout and I think that i have been very patient during this wait time. I am totally exhausted at this point. I asked for information on points of contact at XXXX XXXX XXXX, file number associated with this case and other information as I needed to be much more involved and explore other options. I spoke to someone in this office ( Consumer Financial Protection Bureau ) and told how to submit a complaint on line. If your office can help in any way, I will be most grateful. I was also told to contact the Georgia Bar Association to get the name of an attorney in my area. ( Note : I think the check may have been stolen from my mailbox but am not certain. I have been a customer of XXXX since XX/XX/XXXX ( encouraged to open accounts due to a mortgage refinance solicitation that required " all '' accounts be moved to the bank as a condition of the loan ). XX/XX/XXXX, I noticed on the Bank web site that it was being acquired by Iberia Bank. However, I received very little in the way of substantive information about how the acquisition would affect my accounts or banking relationship. In fact, in advance of and since the acquisition, I have receive NO new terms or conditions relating to my accounts or services, such as my Bill Pay service. Only after the acquisition took place did I learn that I would no longer receive bills from third parties through my Bill Pay service ( after several bills were not delivered and payments were late ). To date, I am still trying to correct delivery issues with the billers due to difficulties with the prior bill delivery requests made by XXXX. I have not received debit cards for my accounts. Apparently my account terms have changed now requiring minimum balances and I am being charged service fees ; however, I did not receive advance notification of these changes to my accounts. I also was informed ( after the fact ) that the bank routing number and account numbers were changing and that I was responsible for notifying billers who drafted payments from my account. I have requested new checks for my account, but the Bank has never delivered them. I have reported all of these issues to the Bank on at least 5 occasions, by telephone and in person. On at least two of these occasions, I requested a return call from the private banker who opened the accounts initially. I never received a return call. I was told on at least two occasions by representatives from the Bank that the transition has been challenging, that other customers have complained, and that other customers did not receive communications about the transition. I also was promised that the service fees removed from my accounts would be replaced. They have not been. Finally, after my last call to the Bank expressly frustration about the Bank 's failure to correct any of the issues that I had complained about, I finally received a call from the private banker, who threatened to unilaterally close my account for " berating '' the bank employees ( in other words, complaining about legitimate service failures ) and thereby causing other business disruptions to my personal finances. Now, I have left two additional messages with the same private banker to address issues with my account and I have received no return call.

I got laid off from my job in late XX/XX/XXXX and immediately did whatever I could to find a new job. Pretty soon I was no longer able to make the payments on the mortgage. We contacted a state sponsored program for NJ Homesaver and just as we applied the program was changed and the church in XXXX XXXX NJ said they couldnt help us with that program. I eventually got another job in XX/XX/XXXX but that company couldnt make payroll as of XX/XX/XXXX and I was out of work again. I went looking again and even took a job outside my field and it eventually led to a good XXXX XXXX which I have had 30 years experience in. Then I contacted the bank about a modification. They sent us the modification application and now there was hope. Now that I finally had a stable job and the mortgage note was sold to Iberia Bank we had a chance. Also, both my wife and I were working full time, I also thought we had a solid shot as I worked full time and my wife was a XXXX XXXX XXXX XXXX. I called them and asked about my options and if they had a date for the sale yet on XX/XX/XXXX. They did tell us we must submit our XX/XX/XXXX return which was not finished yet. ( We had filed an extension ) When our accountant had taken longer than we expected to complete the tax return, we then called again to make sure there was not a date for the sale in XX/XX/XXXX and they said there was no sale date. As of today, we were not served with any paperwork from the court or Iberia Bank accept for the Lis Pendens which was sent to us XX/XX/XXXX. We then received paperwork from a lawyer saying we had to pay rent or vacate the premises. The letter was dated XX/XX/XXXX and the rent was due XX/XX/XXXX. The letter was postmarked XX/XX/XXXX. It also said our lease was terminated and we had to vacate the premises no later than XX/XX/XXXX. Then we were mailed a tenancy summons to appear in court on XX/XX/XXXX, as part of an eviction process. We were never formally served and had no idea any of this was going on until XX/XX/XXXX when we received the first letter from the lawyer. We were also told by a lawyer that we didnt use any postponements, which makes the case that we had no idea that any of this was going on. We never even had the opportunity to plead our case in front of a judge. Iberia made it seem as though we would be considered for a modification while all the while they were proceeding with the foreclosure behind our back. We just want a chance to keep our home!

In early XXXX, I was contacted by the Risk Management Department of Iberia Bank informing me that my credit card had been compromised. I immediately cancelled the card and a new one was issued to me. I am fairly certain that the card was compromised at the XXXX XXXX in XXXX, XXXX since I place an order for XXXX copies of the paper and incurred a $ XXXX charge. I started to receive merchandise at my home and I contacted the XXXX County Sheriif 's Department and filed a report. The officer told me to keep the '' stuff '' and catalog the products. Several weeks later, I received an affidavit from the Risk group of XXXX and I noted that XXXX of the products I received. The bank had given me credit for all the charges, however, when I received my next statement, the XXXX items were charged to me. I made numerous calls to the XXXX and also to XXXX and spoke with a XXXX XXXX. She then escalated the problem to a person by the name of XXXX in the XXXX. After being offended by her screaming at me over the phone, I asked her what I should do. She told me to return the products to the vendors which I did. On XXXX XXXX, I faxed to her the XXXX receipts and she acknowledged on XXXX XXXX that she received the fax. She then informed that she sent it to " upper management '' for review and that she would call me on Saturday, XXXX XXXX with an update. She never called! I called her on Monday, XXXX XXXX and asked why she did n't call to which she had no answer. I then told her that I was recording the conversation. She was very pleasant on the call! However, she said once more that " upper management '' did nothing with the information and said maybe they were on vacation. She declined to give me a name or phone number for " upper management. '' I sense a great deal of APATHY within her and the department. On XXXX XXXX I spoke to a XXXX in that department and she provided me with a phone number of XXXX to contact. The number was bogus ... .some company trying to sell stuff ... .I felt that they were playing with me ... .and they were. Today, XXXX XXXX I filed a complaint with the BBB. Also, XXXX XXXX of the Sheriff 's department has not spoken with any of the vendors to get the IP address. I feel I had no choice but to escalate this to the Consumer Protection Agency.

On Saturday, XXXX XXXX I was a victim of fraud on my Iberia Bank debit card. I had the card with me while I was reporting the fraudulent charges. I immediately contacted the customer service line and reported the three charges ( total {$1100.00} ). It appears that Iberia bank sent me a new card in the mail and somehow the new card was intercepted in the mail. The representative told me that I would get a call from the bank within 48 hours. I never received a call from the bank so I contacted the bank and was told that I would get a call from the Fraud department. On Thursday, XX/XX/2020 I called again and was told that they did not have in their file my report of fraud from Saturday. They claim they only blocked my card on Saturday for any future use but did not have any information about the 3 fraudulent charges. At that time, I reported the 3 charges to the bank representative and I also immediately responded to a Fraud text that I received ( see attached fraud text ). He later sent me a form I had to sign reflecting the disputed charges and said I would hear back from the bank after their investigation. The very next day, I received an email stating that the bank denied my claim for fraud because they claim that my PIN number was used. I have never given my PIN number to anyone. How can they deny the claim without conducting a thorough investigation? I don't understand how they can deny this claim as fraud was definitely committed! I did everything I could to report the fraud immediately and stop my card from further use. I did not make these charges!! Do they know who did? Where are the videotapes of the transactions? What do I need to do to get my funds back in my account? I believe the bank has been unfair and is entirely responsible for this fraud as I never received the new card they sent me and this is the card that was somehow intercepted in the mail. They claim that since both of us roommates share the same street address, this constitutes a household. However, I claim that since they are a bank federally regulated by the Federal Reserve Board and by CFPB, and are insured by FDIC, that Federal Law, including IRS regulations and definitions prevail over any and all other State, County, or local laws and customs and practice, as it pertains to Federally Supervised commercial banks. I am with Iberia Bank. My branch location is the XXXX XXXX XXXX. I set up a " push '' draft with Iberia for direct deposit to my landlords account with XXXX XXXX. In XX/XX/XXXX I called to find out why the draft had not occurred. XXXX XXXX in customer service told me that the draft rules had changed. We entered into an agreement to purchase a XXXX Truck from XXXX XXXX XXXX XXXX XXXX XXXX XXXX Indiana. After numerous e-mails, a wire transfer of funds was sent and the truck was to be delivered the next week. When we received no information about the delivery, we called the dealer and the phone was not working. All information is still up on the website, including the truck we supposedly purchased. We tried contacting the bank that our bank, XXXX XXXX XXXX, transferred our money to and they are very rude and told our bank agent that they do not like dealing with XXXX XXXX XXXX and will make them jump through hoops before dealing with them. However, they did let XXXX XXXX XXXX know that the funds in the account we sent our monies to were frozen. This happened on XX/XX/XXXX and Iberia Bank of Louisiana is still not cooperating about what has happened to our {$25000.00} that we transferred. The XXXX XXXX XXXX XXXX XXXX XXXX is still advertising classic cars for sale, but will not answer our phone calls. I am attaching all the e-mails and information I have to substantiate our claim. On the wire transfer instructions, it is listing Iberia Bank with a XXXX Indiana address, however, there is no Iberia Bank in Indiana and our monies went to Iberia Bank in Louisiana according to the routing number. Our XXXX XXXX XXXX Agent, XXXX, has called them numerous times and they will not deal with her. I filed a report with the Police Department in XXXX Indiana, however now that we know the bank is in Louisiana, I had to call the police department there are they would not take a report. hello the closure of my account was XX/XX/2016 amount {$2800.00}. I applied for a XXXX job on a website called XXXX due to my divorce. So I started telemarketing I did an online orientation for 2 days and my first check was like {$200.00} and that check was fine it cleared. The at home telemarketing job allowed the person to work unlimited hours so being I was behind on my bill I worked almost XXXX overtime along with my XXXX regular pay and I filled out a direct deposit form but my 2 day check and my XXXX regular pay check came via XXXX and the direct deposit would probably start the XXXX check I was told. Well I deposited my XXXX check for {$2800.00} and the telemarketing company or the person behind it took not only the {$2800.00} out of my account but also almost {$1000.00} the money for my bills out of my account I was broke well past broke at this point. I went to the XXXX police department and after explaining everything to the detective and showing him what little evidence I had he gave me the news I was scammed. I informed XXXX XXXX of what the officer told me and the bank manager was suppose to call me but never did. I went to the bank about 4-5 times. I called their corporate office trying to reach the right person to help and next thing I know I see it says suspected of fraud activity. I can't explain how I felt when I read that. Is every person that is scammed or conned by someone in a different country that the BBB talks about considered a fraud? The bank maybe a victim but I am a victim also and it's almost 3 years later and I'm still having problems with this issue.

XXXX switched to a new website on the weekend of XXXX XXXX. The first problem I had with this transition was that XXXX set a temporary password on my account for the new website. This temporary password was the last XXXX of my XXXX. Not an acceptable level of security. The second problem I had with this transition was that I receievd notification of the transition too late to log in to the old website and get the statements I had not yet downloaded. I figured this would not be a problem because I could download them from the new website. This is not the case. They did not move statements to the new system. I sent an email on the new website to request the statements, but never received a response. I then called on XXXX/XXXX/XXXX at XXXX. I spoke to a woman but did not get her name. She said that I would need to pay XXXX per statement because they had all been archived. She also said she would not be able to help me with this. I later called again at XXXX on the same day. I spoke with a XXXX. He said that I needed to send an email on the website to get my statements. I explained to him that I had already done this. I sent a second request after the call. The third issue I had with the transition is that there is no option for closing the account. I mentioned this to XXXX when I was on the phone with him. He mentioned that if I send and email that I want to close the account and withdraw all the money I will not be charged any fees. There is no verification of this that I can find, so I am concerned that they will charge me a fee.

On XX/XX/2019 I open a checking account online with Iberiabank. At the beginning of the application process their website states : This account opening process will only take a few minutes to complete. You can also save and retrieve the application later if you need to. We welcome all applicants who reside in Alabama, Arkansas, Florida, Georgia, Louisiana, Mississippi, Tennessee, and Texas states to apply online. You must also be a United States Citizen to apply for an account online. For all non-U.S. Citizens, please go to your nearest branch to apply for an account. I applied, made a deposit, got information for online checking and was able to log in with my new account number. I received several emails welcoming me. I found out a day later that my application was refused because I didnt live within 60 miles of a branch. This was standard policy. No where on their website or during the application process did they mention this fact. You would think their application process could easily determine if you live within 60 miles of a branch. If this was the policy then why not simply state that we take applications in these states as long as you live within 60 miles of one of our branches. The way it sounds as long as you live in one of these states you can open an online checking account.I had already set up direct deposit from work. Thankfully I was able to cancel this before my next check came out. Can you imagine the trouble I could have incurred with my pay check going to a closed account.

XX/XX/2018 my debit card was used fraudulently for a large number of purchase, approximately 29, and a dollar amount near {$5000.00}. I notified my bank when I discovered my account was overdrawn. I was never contacted by the bank as to unusual activity on my account or transactions that weren't consistent with my regular banking activity to see if I was in fact using my debit card for these transactions. When I asked why the unusual activity on my account didn't draw suspicion and the fraud department didn't contact me I was told because all charges were local. In the process of their investigation it was determined that some of the transactions were done by a family member who briefly stayed in my home and took the card without my knowledge. I was told if I filed charges with the police I would get my money back. I was given provisional credit after I complied with the banks request and filed a police report then a few days later the credit was withdrawn and the case closed. I was informed it was a personal matter and they could not give me my money back and I would have to personally try to get my money back from the individual involved. I never received any documentation from the bank concerning their investigation and what evidence they had that the individual identified had made all the purchases and why in a case of fraud I could not recover my money.

XX/XX/XXXX - I visited a restaurant in XXXX, Texas. Later that evening, Iberia fraud department called and left a message about suspicious charges. I went and looked online the next day to look at the transactions and noticed that there were charges made to my account in the amount of {$160.00} that I did not authorize. I spoke with someone at Iberia bank fraud department on XX/XX/XXXX after i viewed these transactions and they said that they would put a hold on the transactions from this establishment. They said that I needed to go into my local branch and file a fraud report. I went into the local branch on XX/XX/XXXX and filed the fraud report. On XX/XX/XXXX, the transactions went through. On XX/XX/XXXX, I received a letter saying that my dispute was denied. They said that i needed to contact the business but no one answered the phone at the business and it appeared as if the business was permanently closed because i went to the restaurant at the same time on XX/XX/XXXX. Iberia Bank has reported on my Consumer report that I have {$410.00} as a charge off which is incorrect. I worked with the main office of Iberia Bank getting all of the fees correct that my local bank messed up on. I was trying to close my savings and my checking account. The employee left my checking account open due to a XXXX charge that was still pending on my account and stated that once that cleared they would freeze the account and I would have to come in a sign. By the time I came in there was over 400.00 of NSF fees that the bank was allowing some autopay transactions go thru knowing I was closing the account and was told that I didn't have to worry. I would have time to change all my information and notify my creditors I was closing that account and give them new account information. Once working with the main office of Iberia Bank, they removed most of the fees and I did a phone payment for {$260.00} as the final payment on XX/XX/2018. There was no charge off or any issue with the debt. This is inaccurate information. I did go in and out of this bank and speak with 3 employees, including the manager over the woman who completely lied to cover herself. In early XXXX, I opened a personal checking account online successfully. I received an account number, I made my initial deposit to fund the account, set up online banking, and even made 1 direct deposit into the account. All this happened successfully within the first couple days of opening the account. Then all of the sudden my online banking went frozen. I called customer service and they said I needed to go to a branch to see what happened. I talked to banker, XXXX XXXX, upon arrival. He was more than willing to help me at first. XXXX needed to ask the branch manager, XXXX XXXX, a question about my account so he got up and left the desk. When XXXX came back all he said was that my account is closed. I made 6 withdrawals in one statement period from my money-market account at XXXX ( the online version of IberiaBank ). I was charged a {$15.00} fee for too many withdrawals. I called them twice, and they said that because 7 withdrawals were made in XXXX, that I exceeded the maximum number. But those are not the rules established in Regulation D of 12 CFR 204. The rule is not " monthly withdrawals, '' it is " per statement period. '' My statement period was from XX/XX/2018 to XX/XX/2018, and I made exactly 6 withdrawals in that time period : XX/XX/2018 - withdrawal for {$100000.00} XX/XX/2018 - withdrawal for {$1100.00} XX/XX/2018 - withdrawal for {$10000.00} XX/XX/2018 - withdrawal for {$5100.00} XX/XX/2018 - withdrawal for {$100000.00} XX/XX/2018 - withdrawal for {$4200.00} Their response was that I made another previous withdrawal in XXXX : XX/XX/2018 - withdrawal for {$10000.00} And therefore they charged a {$15.00} fee. On XX/XX/2019 I opened a business checking account online with iberiabank in respond to their promotion offer XXXX. The term states, earn a {$200.00} business checking cash bonus when opening a new business checking and make 15 client-initiated debit transactions ( use your debit card, write a check, or use Online Banking with XXXX XXXX ) within the first 90 calendar days of account opening. I applied for a small mortgage through Iberia Bank ( on XXXX XXXX in XXXX XXXX ) in early XXXX. I sold my current condo in order to pay off all of my debts ( $ XXXX ) and lower my monthly expenses. On XXXX XXXX I was notified by the buyer that they had accepted my offer of a XXXX so I emailed my lender the information he needed to begin my mortgage application. He let me know that my realtor had already sent him that information and that he would be sending me my disclosures that afternoon. However, I did n't receive them until the XXXX. He was very hard to contact and very slow at replying to emails. I was scheduled to close XXXX XXXX. I did n't receive my final disclosure document until XXXX XXXX on a Saturday. My first disclosures showed that Closing cost were overpaid by {$870.00}. My final disclosures showed that I needed to bring {$1200.00} to closing. I was confused as to how my closing cost went from XXXX dollars to over a XXXX dollars bringing my total closing costs to over {$8000.00} on a XXXX loan. I tried to get in touch with my lender but of course, as always, he was unavailable. I received a flood insurance settlement check. The check was issued and posted to my account 3 weeks later than it was said to be. The check was put towards my line of credit and I have checks bouncing and being charged for a return fee, when the money in fact is in there. The bank is refusing me access to my own account funds and is telling me they need receipts to distribute out funds. ( for my line of credit ). I 've never had to do this before. I 've been a good customer of theirs for over 14 years and have been through several floods with them. My credit is being ruined, I ca n't pay my bills, or work on my house because I have to provide receipts for the items I purchase. But, I have to have money to be able to purchase anything. And I would be glad to provide receipts. Prior to receiving the check they agreed putting it towards my line of credit was a good idea. After the check was deposited without discussing it or giving any reason, they lowered my line of credit, giving me no access to funds available. Reversed checks they first covered and then returned them and charged me for them.

I closed on my mortgage on XXXX XXXX with the XXXX payment being due on XX/XX/XXXX. Soon after I closed, as I expected, I received a letter saying my loan would be sold. I thought this would occur before the first payment date ; however, it did not. On XX/XX/XXXX, I went into a branch to make my payment. The teller told me I could indeed make a payment in the branch and attempted to pull up my account. She could not locate the account my my account number or ssn. She called the asst manager who also attempted to pull up my account, but she could not find it either. She called the mortgage servicing department who said that the payment had to be mailed. I filed a complaint bbagainst IBERIABANK for using a false debt to income ratio to deny my application for a home equity line of credit.The response letter is further evidence of what I experienced. This bank will not explain what their criteria is concerning debt to income ratio, and how it is calculated.They have now changed the reason for the loan denial to lack of verifiable income.This is also false. And the monthly debt payments of less than XXXX was verified by the credit report.There are no inconsistenciesregarding the hand written tax return. All of these falsehoods ; and changing the original reason for denial ; to lack of verifiable income, is more evidence of my original thoughts. I have a HELOC with Iberia bank that was established in XXXX. At the time of this writing and the time that the issue I'm reporting occurred I've had a zero balance on this HELOC. In XXXX of XXXX I was contacted by an Iberia employee in reference to a past due annual fee for my HELOC account. I informed the employee that I did not receive any communications via email or letter mail regarding this annual fee and that the fee was late due to no fault of my own. The employee agreed with me and advised to just pay the fee as soon as possible, which I did. I made multiple purchases on several occasions in XXXX to a company called XXXX. They charged my bank international fees and every fee was drafted and paid correctly out of my Iberiabank account. Now 2 weeks later XXXX double charged me all those fees again for no reason ; I have not made any recent purchases. Because of this my bank account totaled {$640.00} in the negative. I'm a first time home buyer who just closed on her first home Friday, XX/XX/2018. Iberia Bank was the bank that handled my loan. My Iberia Bank debit card was compromised by a criminal. I noticed fraudulent activity on my account, on XXXX/XXXX/16, with XXXX separate charges, all on the same day for a grand total of {$800.00} ( $ XXXX $ XXXX {$200.00}, and {$6.00} in transaction fees, {$2.00} for each withdrawal ). This is alarming, because I had my card with me the whole time, and never shared my card, or information with anyone. I have been charged an overdraft fee of {$86.00} from Iberia Bank and I am concerned. When I checked to place the balance of an amount. I called on XXXX/XXXX/16 or around that time and I had an incident with a fee and it could not be reversed from the company. I had to leave and go to XXXX just came back and saw an overdraft fee in the amount of XXXX odd dollars. The day of the overdraft I called and asked for an overdraft fee not to be placed on my account. I have had discusions before which have been very cordial with this bank. I attempted a transfer from my checking account, by scheduling it for XX/XX/2019 in advance. Over a week later, I noticed the transfer had not occurred and there was no record of my transfer when I logged into my account. I tried submitting a new transfer, but the system would not let me schedule any transfer that would cause my account to drop below a balance of {$5000.00}. Upon reaching out to the bank, I was told there was a hold on these funds, which I had deposited at account opening over TWO MONTHS earlier, and that there was no expiration date for the hold on the funds. The agent did not attempt to solve the problem. It is completely inappropriate, against policy, and possibly illegal for the bank to have an indefinite hold on over {$5000.00} of money in my checking account. According to the bank 's Regulatory CC Disclosure, these funds should be available for withdrawal/transfer by the second business day.

After having a substantial relationship with Iberia Ban k, I got a notice they have decided to close my account and gave me no reason whatsoever. I had one issue with a wire transfer which was refused and caused an issue on my account, while I was traveling for a family emergency. The signer on my account had his account effected and him being on my account effected my relationship Upon fixing the issue, I was told my accounts were to be closed including all of my lines of credit, business accounts and personal accounts. I am an ideal client and maintain substantial balances in the accounts and own and operate recognizable businesses. There was no reason whatsoever my accounts were closed. I had issues which were addressed and fixed the moment they were brought to my attention. I want to have my relationship back as this is the only bank which operates in all the states we do business.

Iberia Bank increase the amount of my escrow by an incredible amount. I call customer service and also went into the local XXXX, La. Branch to get an explanation, but no one could or would give me and answer to the increase. I was informed to just continue to make my regular monthly payment until the matter could be sorted out. I was contacted earlier in the year by a representative from Iberiabank. I left voicemail but never received an answer back.
