Today XX/XX/XXXX, we were informed by our agent via third-party text message from First Home Loan Originator ( LO - T.B. ) '' FHA won't budge-I 'll have her adverse -- -- HUD responded and they have to make 3 timely payments under the newly revised payment plan. They could close in XXXX - we can condition for proof of 3 timely payments. They can not prepay, just FYI because I figure they may ask. You can't pay ahead - they have to make the payments for 3 consecutive months. '' This LO - T.B. refused to communicate with us, but instead dealt with the seller, seller agent, and our agent all XXXX with the exception of the buyers ( us ) which is known at the conception of the loan process. Our LO-T.B. sat on the tax liability info sent to him in XX/XX/XXXX when we originally began the process of home purchase prior to COVID-19. He was aware of this debt, and did not disclose the information until after over 30 days with Underwriting, which resulted in a delay that caused duress and physical impairments due to stress, lack of communication, and evasiveness. Accordinge to LO-T.B. the tax liability is the very reason why we received the adverse. However, this information was originally enclosed ; he did not reveal. The LO -T.B. and my husband had a phone altercation, in early XXXX as he ( husband ) felt that the LO -T.B. made a derogatory statement that was racially driven about our inability to understand the process, in which progressed a swift decline in communication, customer service, and rapport. I noted a change in treatment in early XXXX - it was communicated to the LO -T.B. who did not address my findings whatsoever ; he ignored my email. In XXXX, about the XXXX ; we submitted a contract on a home nearby. We had already began the process months prior ; only needing an updated credit pull which was done on XX/XX/XXXX or so, we continued with this same LO -T.B. with me working with him since he and my husband did not see eye to eye. After the contract was submitted, Appraisal done, Home Inspection & Radon testing was paid by us - the buyers ; we continued to working to gather information to substantiate the original closing date of XX/XX/XXXX. During this process - early in XXXX - we got a change of heart concerning the house and the interaction with the LO - T.B., and asked for a release from our Agent. A release was sent and to my knowledge signed, but no release was given - approximately XX/XX/XXXX. In the process, we began working with another LO -R.E. from XXXX XXXX, when our agent phoned about a week later to encourage us to keep the house, and that he would assist with some sort concession, and we " might as well stay with the XXXX LO - T.B. as he had gotten further than the new LO - R.E. ; we oblige his professional opinion contrary to instinct. Our New close date was set for XX/XX/XXXX or XXXX. New disclosure forms were completed and the process continued. Everything that was asked was swiftly provided as we were trying to execute the process to synchronize our lease termination with the move in to the hopeful newly purchase home - those dates originally were XX/XX/XXXX, which would give us approx., six days to close the door to the leased house. In the course of time, as were are being asked more things over and over again ; I myself confronted the LO - T.B. about his negative and derogatory treatment and condescending statements. I contacted one the assistants from First Home, letting her know that we were being treated like " XXXX XXXX receiving a handout '' on XXXX XXXX. After that, the closing date changed again to XX/XX/XXXX. Mind you, we are scheduled to move out of our current home XX/XX/XXXX ; fortunately, we were able to get an extension from the XXXX XXXX company. We were asked to get additional documentation of what had already been received, as well as the communication with the LO - T.B. and us was reduced to him speaking to our agent and the sellers agent regarding our loan process. He was instructed not to by any means communicate to the seller or her constituents our progress. He continued to disclose our status to the seller and her agent. My agent and I with the LO - T.B. had numerous conversations via phone and by way of text message. The LO -T.B. was very evasive and could never tell us outright where we stood, or when the actual clear to close would be delivered. In the course of this time, the date changed again to XX/XX/XXXX. We have thus had 3 request of release, in attempt to save our EMD per the agent 's recommendation. In the meanwhile, my family is in disarray, the seller completely moved out of her home, and we were planning this quick and abrupt transition we thought we were headed for. During the final week, we were asked for another verification of employment, tax return signature on page 1, transcript request from the IRS. He informed us that the transcript was 4056T was just for the file. However, the next day after stating that he came back with requesting the transcripts. I got on to Irs.gov and retrieved the transcripts at their request - the day past. The next request was proof of payment for the tax liability - that too was sent. The next was verifying the current account balance by going to the IRS website, and clicking on account balance and select each year so " they '' could see the specifics. The screen shot sent to the LO -T.B. reflect the balance ; clicking on the year did not indicate anymore specifics. It became very humiliating as he verbalized about our delinquent taxes ; my agent to witness. i sent the information that he requested and replied that I relinquished my integrity for a house, as I felt that the transaction had long exceeded necessity it was retaliation and abuse for our previous confrontations. XX/XX/XXXX had come and gone, and this LO - T.B. had not contact with us, nor did let us know what the Underwriter was requesting. Our information came by way of our Agent regardless of my husband and I being the borrowers. This LO - T.B. continued day by day and week by week to lead us on to believe that we " were still holding our approval. '' He to date has not sent an adverse letter, which he stated that he would in a few hours today - XX/XX/XXXX @ XXXX. As it stands, no letters have been sent, no explanation as to what the UW 's recommendations were, and no final resolve has been rendered. There is many variables to this situation, and of the truth, I am not able to write everything concurrently as there are so many moving parts. One thing is for sure ; this LO - T.B. did not handle the process correctly. The very area that he states is the reason for the adverse is what he has known since XXXX, in which he did not disclose the information until the final hours. I was very concerned that our confrontation would result in this adverse effect, and it has indeed! This ill transitioned, has cost me financial hardship, stress/duress of being lured and humiliated, misinformed, and verbally abused with sly and slanderous comments regarding our credit, my husband 's job changes, and how complicated our file was without explanation when asked. This company did not follow handle our file correctly. Many people were affected by the non-disclosure of this tax liability from the beginning of the process. We are in the midst of a Termination of Agreement with our current lease ; possibly homeless if we are not able to retract the agreement. This non-disclosure would have brought instability of living for family to include XXXX grandchildren under XXXX some of school age. We have everything in our current home in disarray based on the misleading information given when given and the failure to communicate true and accurate information to us and the UW in a timely manner. I am currently in XXXX XXXX. in a tax Credit community with familiarity with dealing with compliant like scenarios, given that my community deals with HUD as well, but to withhold information until the zero hour, and to speak to us as if we were " fresh off the boat '' with no education and incapable of processing the process left much to be desired. The finished result is possible homelessness with only 2 days to respond, financial loss - EMD monies may not be able to be retrieved, Loss of additional monies for inspections and tests lost, as well as peace of mind and the common courtesy of general customer service. What would cause a person to withhold value information in their profession opinion that would be so detrimental at the end? I am so very sorry we continued to work with LO-T.B. and First Home Mtg. I can provide documentation outside of this portal ; it will not allow me to upload.

XXXX XXXX Mortgage XXXX XXXX XXXX XXXX XXXX XXXX XXXX, IL XXXX Dear CFPB Representative : On XX/XX/XXXX, I logged into Your Mortgage Online, First Home Mortgage 's ( XXXX ) payment portal, only to discover that XXXX blocked XXXX from making mortgage payments online. When I contacted their Customer Service Department, they routed me to the XXXX XXXX Department, where I learned that my payments for XXXX and XXXX had been rejected and that XXXX reversed these checks due to insufficient funds. XXXX had provided no prior communication regarding the check reversals had been provided to me, and I had not received any mail regarding this either. I asked the XXXX XXXX representative which bank they had attempted to pull the funds from, and they were unable to tell me because the XXXX XXXX Department could not access that information. The representative indicated that I would have to make payments through certified funds via XXXX XXXX ( until XX/XX/XXXX ) and that I was not allowed to make payments via phone or through a customer service representative. This posed a financial barrier for me, as it required payment of excessive fees, including a {$100.00} processing fee required when funds are withdrawn through a bank account ; a {$240.00} fee to process payment through credit card ; and a {$180.00} fee to process payment through a debit card or XXXX XXXX. For XXXX and XXXX payments, I received an e-mail notification confirming that my payment had been received and was in process ( XXXX confirmation # XXXX ; XXXX confirmation # number is XXXX ). I had not received any e-mail stipulating that the payments did not go through. As I had made previous payments through Bank XXXX XXXX ( BofA ), I assumed it was through this bank. I immediately contacted XXXX, and they confirmed that my account had sufficient funds. I generated the statements and letter from XXXX, and e-mailed it to the XXXX Department, as was explained to me by XXXX XXXX representative. On XX/XX/XXXX, the XXXX Department e-mailed me. Unfortunately, the XXXX Department, charged with investigating payment-related issues, is not reachable via phone, and responses can take up to XXXX weeks or more. The only way to escalate information is through e-mail, fax, and mail, as no intermediary direct calls are allowed to this Department, which further hinders case resolution in a timely manner, as per the guidance of the Consumer Financial Protection Bureau. The XXXX Department asked for statements that outlined transaction history or a letter on bank letterhead noting the amount of funds in the account on the days for which XXXX and XXXX were made. I furnished a letter from the bank stipulating that I had sufficient funds and attached bank statements for XXXX, XXXX, and XXXX. Their follow-up letter indicated that payments were attempted to be processed through an account ending in XXXX through the XXXX XXXX XXXX XXXX XXXX ), not BofA. I contacted XXXX for guidance and support on why the checks had been reversed. They confirmed that I had sufficient funds in my account, that their systems did not show any attempts to withdraw funds from XXXX XXXX Mortgage, and that no errors showed a reversal check. To this end, I submitted statements from XXXX that further demonstrated that I had sufficient funds. They noted that the statements did not correctly show any errors and transaction history. They requested a bank letter. On XX/XX/XXXX, I provided them with a balance statement and XXXX letter outlining the funds available. They noted : " We have determined that we can not waive the fee at this time, as we can not substantiate that this fee was assessed due to an issue in our systems or the servicing of this account. '' Further : " After reviewing your loan, we concluded that your XX/XX/XXXX payment created online stated the account type listed as a checking account. Per the letter sent to us the account ending in XXXX is a savings account. '' Since I had entered multiple queries since XX/XX/XXXX, they had not provided any information regarding the XXXX and XXXX payments, although I had produced documentation with proof of funds. However, they noted that the XXXX payment had been returned due to the wrong account being selected. This is false, as I was already blocked from making payments in XXXX. There is no way that I attempted to make a XX/XX/XXXX mortgage payment when I was restricted from doing so through the portal. As of XX/XX/XXXX, I have not received guidance or public-facing policy stipulating that there would be penalties imposed or mortgage holders who mistakenly did not check off whether an account was in a checking or a savings account ; or for mortgage holders that had no knowledge of check reversals. When I learned of the check reversals, I immediately worked to rectify the issue and sent XXXX, XXXX, and XXXX payments through separate bank checks. These checks have since been posted. Of note, I had never missed a payment. XXXX continues to impose negative credit reporting, late fees, blocking portal access, and requiring that I submit certified funds. In XXXX, I sent a cashier 's check for the XX/XX/XXXX mortgage payment, and XXXX can not locate the check. On XX/XX/XXXX, the XXXX XXXX customer service representative suggested that I put a stop payment on the XX/XX/XXXX payment. This is not ideal, as I would have to wait 90 days before the {$2600.00} payment is refunded. Moreover, XX/XX/XXXX has already been reported as late by the mortgage company, even though they could not locate the check which had been sent to the same address as the XXXX, XXXX, and XXXX payments. On XX/XX/XXXX, I received a packet stating that I had been approved for a partial claim. This was confusing to me, as the payment had increased by {$20.00} to {$2600.00}, and I needed clarification about how this was supposed to help. In addition, XXXX has threatened me with a Partial Claim Deed of Trust. When I contacted the Customer Service and Loss Mitigation Departments, neither Unit could ascertain why a partial claim had been approved with the mortgage essentially staying the same plus {$20.00}. XXXX XXXX Mortgage 's response was disproportionate to what they allege concerning issuing false payments. They had issued penalties, such as late fees, adverse credit reporting, and had blocked access to the payment portal, requiring me to send cashier 's check ( one which they could not locate ). My XXXX XXXX had fallen to XXXX due to their disparate case investigation, impacting my ability to access credit, refinance, or obtain lower interest rates. In addition, they had explicitly stated that they could not waive any fees because " as we can not substantiate that this fee was assessed due to an issue in our systems or the servicing of this account. '' It was predatory that I have to carry the burden of additional fees and negative reporting history because they were unable to determine the origin of their fees or whether the issue was due to their system or XXXX. Additional notes : The Customer Service and Loss Mitigation Departments can not read the notes that another Department crafted, so they can not speak to the status and progress of my claim. The Loss Mitigation Department could not clearly explain the " principal curtailment '' payments or for which months the mortgage payments have been posted. They ( incorrectly? ) explained that if I go above the {$2600.00} mortgage payment, the amount will not be processed, and a check reversal will be applied for the total amount. I noted that there is unclear mortgage payment history and statements, as evident by " principal curtailment '' amounts. This inaccurate description of payments and transaction information is misleading, and I did not understand what it meant. The XXXX XXXX Department does not have access to essential information, such as verifying the bank account number I used to make payments. Unsecured items ( e.g., correspondence, bank statements ) are accepted via e-mail, and pose a security risk. I would appreciate any guidance or support that CFPB can offer. Best, XXXX

I am a first time home buyer with a budget of {$130000.00} to purchase a fixer upper and cover necessary rehab. I was referred to XXXX XXXX XXXX XXXX by my real estate agent. On XX/XX/XXXXI received an email from the lending agent confirming that my application and all supporting documents had been received. XX/XX/XXXX, email from the lender - " Ran some quick numbers for you. You should look for properties that will fall around a {$200000.00} total acquisition price. For example, you could find a house going for {$170000.00} and put {$25000.00} in renovations, 150/50,125/75, etc '' Based on this email, which I forwarded to my real estate agent, I made the decision to make an offer on a house. My agent set up a call on XX/XX/XXXX to go over the financing in a conference call with the lender. On the XXXX I received the first " EstimatedItemizedFeeWorksheet '' from the lender, which I immediately flagged as not appropriate for someone with excellent credit and assets for a 20 % down payment. What I actually said was that putting the minimum of 3.5 % down would " violate my degree in economics. '' The lender claimed he did not know I could afford more and said the estimate fit the average buyer for this type of loan. I asked about a 15 year mortgage, he said that wasn't an option, but that I could refinance when rates went down. I explained that the new fed chair plans to raise rates 4 times this year alone. He spoke for over an hour and even with my education and work experience over the past 15 years, it was confusing and very hard to follow. I had trouble trying to even decipher the notes typed during the call because he went on so many tangents. I requested he re-do the paperwork for a conventional XXXX XXXX Homestyle Loan with 20 % down. I assumed the new paperwork would give me the information I needed to evaluate it on my own. I received a second worksheet a few hours after the call on the XXXX. The loan amount was increased without explanation, and the down payment and closing costs were {$16000.00} above what I had already stated was the maximum I was willing to spend up front. At that point, I started contacting other lenders and doing as much research as I could on my own. I informed my real estate agent that I was not happy with the lender and that I was looking elsewhere. I wrote back to the lender explaining I could not afford his latest estimate and described my confusion with the types of loans, rates, and mortgage insurance combinations we had been discussing. I requested a written comparison of the options and any useful reference materials helpful for 1st time home buyers. I followed up with additional questions, eventually requesting a spreadsheet with a breakdown of the numbers. The only response I got came the next day after my offer was accepted and the purchase contract was signed. The lender wanted to have another talk over the phone. We set up a time to talk on XX/XX/XXXX. Shortly before our call was scheduled to begin, I requested he send me new paperwork to review ahead of time for the sake of " efficiency. '' He still had not responded to any of my questions from two days before. He sent me a third worksheet, but the loan amount was still above the limit I had set, and the property on the worksheet was still listed as " TBD, '' which meant the real estate tax estimates weren't right. Taxes are very high here and I just moved to the state a month ago. XX/XX/XXXX email to lender : " I'm having trouble here because I submitted all the paperwork over a week ago, and these worksheets aren't winning me over. I know it's a very low-cost loan. I appreciate that you and xxxxx have been willing to take me on as a client when there are other more valuable deals out there. However, the information I provide doesn't get inputted, the questions I ask get ignored, and these worksheets seem built from standard excel formulas, which I can do myself in a few minutes with minimal effort. Please help us both by putting me in touch with someone who does have time for me. '' His response was that he couldn't provide the information I requested because he didn't want to violate " fair lending laws. '' This is is stressing me out so much I can't sleep, so I spent most of yet another night up doing research online. A few hours ago I found the cfpb webpages that describe what a Loan Estimate should be and the regulation that requires a lender to provide this within three days of receiving a loan application. I checked around to make sure this wasn't an old regulation and that the information was current before deciding to submit a complaint. It's been 12 days since I submitted my application. This is the second lender with First Home I dealt with. The first one was even less responsive, so I didn't bother submitting all the supporting documents for my application because he didn't respond to even the most basic questions I put in writing. I thought it was just one guy who was maybe too busy and a great service provider. Now I see that it's part of their business strategy.

We purchased our home in XXXX of XXXX with First Home Mortgage Corporation. The purchase process was very smooth. We paid a down payment of +30 % and voluntarily chose to escrow taxes and insurance to make our life easier ; however, the loan servicing has been a nightmare. Our tax bill for the second half of XXXX should have been approximately {$2100.00} consistent with the loan closing documents and the City property tax formula. On XX/XX/2021, the City issued a tax bill in the amount of {$12000.00}, which was erroneous as it classified the property as vacant as though no purchase had occurred and the home was not occupied, and occupancy was a condition of our loan. As soon as we saw this we contacted First Home Mortgage to make sure they noted this was an erroneous tax bill as the City had the property classified as vacant as it was before the loan transaction. They assured us they tracked the Citys actions and they received or accessed all information associated with our taxes. First Home Mortgage also informed us that our tax bill of approximately {$2000.00} would be paid on time and they did not have a tax bill from the City in the erroneous amount. We also immediately contacted the XXXX Office of Taxes and Revenue who issued a corrected tax bill for {$1800.00} with the correct classification of occupied within a week and more than a week before tax payments were due on XX/XX/2021. On XX/XX/2021, we received an email from First Home Mortgage showing they had paid the erroneous {$12000.00} in taxes for the second half of 2021 and we had a deficiency in our account. But we contacted the Citys taxing authority several times a week and they assured us that no {$12000.00} payment had been made. To this day, the City confirms no such payment was made ( I have attached the City record of all payments made for the second half of 2021 ). We provided First Home Mortgage the correct tax bill ( 3 ) three times via email based on their requests and advised them the City had received no tax payment at all and penalties and interest were accumulating. Several weeks went by while First Home Mortgage looked for the check they said they had paid to the City and the City continued to add interest and penalties for non payment. This went on throughout XX/XX/2021. On XX/XX/2021, We escalated our concern and pressed First Mortgage to find our money and pay the taxes. It wasn't until XX/XX/2021, ( 2 ) two months later, that they " refunded '' our escrow and paid the proper tax amount ( including penalties and interest ) for late payment. Even though they knew the tax bill was erroneous, it was never paid and eventually they returned our money to our escrow, they issued a new monthly payment adjustment based on the erroneous tax bill which increased our monthly payment by more than 30 %. We have repeatedly asked them to update the analysis to reflect the actual tax bill but their response was The good news is you will get your money back in the end. Well we need our money now and cant afford to give them an extra {$1000.00} to {$1500.00} each month that is excess escrow. Since they refused to correct the analysis we notified them we would prefer to cancel or waive escrow and pay our taxes and insurance ourselves. Over a three week period we made our request verbally twice with supervisors in their escrow division and not once did they tell us this just couldnt be done. At one point they told us they would send us the request form but that never came and they told us it was not available on their website. On XX/XX/XXXX, we made our request via email and we repeated that request the next week. We contacted them on XX/XX/XXXX, XXXX, and XXXX and on the evening of XX/XX/2021 we received an email telling us our request was denied because First Home Mortgage Corporation does not waive or cancel escrow, period! We were confused since our loan officer made it clear that based on our down payment and credit record that escrow was not mandated and this is consistent with the loan disclosures. We were never informed that escrow was mandated and could not be waived or cancelled because that was First Mortgage Corporations stance. Just the opposite. We were told if we ever decided not to escrow, as long as our payment history was good, they would agree since it was voluntary. We trust ourselves more at this point to make our payments of taxes and insurance on time and to pay attention to obvious errors in those bills.

Last year I had my payments on bi-weekly payments and didnt miss any payment while over paying it. I was also unemployed twice during this time. My mom had a XXXX and I became the sole guardian of her the last six months of the year. I lost my job due to that and used my last bit of savings paying my mortgage. I caught XXXX from her being in and out of the hospital, XXXX XXXX, & XXXX. I had to find another job to cover bills and went over the road in XXXX XXXX XXXX The lack of work causing me to lose my job and desperately look for another to cover my bills and mother health expenses. In XXXX XXXX My funds was depleted and I was contacting my billing companies for mercy and payment plans at the time until I was looking for another job. XX/XX/ I became delinquent on my mortgage/bills by 60 days and was struggling to make ends meet. I was able to finally find a job and attempt to dig myself out of the hole after being unemployed and the block of insufficient funds from my bank account. XXXX XXXX I realized my automatic payments did not resume and contacted the bank about the payment issue to my mortgage company to resolve the issue and attempted to pay online. XX/XX/ I contacted First home mortgage in reference to the delinquent mortgage payments. I was told by a representative that I wasnt allowed to pay online or over the phone because of my delinquency. I was only allowed to pay in person & through the mail. I explained to the representative that I worked odd hours and would not be able to make it to any location during business hours. I told the representative I didnt feel safe sending large amounts of money unsecured through the mailing system because if it gets lost Im still held responsible for the missing check of large amounts and the delinquent amount. Loss mitigation sent a partial claim application between XXXX XXXX XXXX XXXX I called about getting assistance for lack of work and was told that my partial claim letter had expired. I told the man I spoke to I never received the letter and he said he was going to mail another and told me to fill it out and send it back ASAP to get the ball rolling. XXXX XXXX I received a letter from an attorney stating for foreclosure was processing and I need to fill out the paperwork attached to the legal documents. I obliged unknowingly that it wasnt the proper forms disclosed to me in XXXX XXXX and contacted loss mitigation to confirm if everything on the Lawyers form was true. I spoke to a woman and faxed the information to First home mortgage. I filled out the HUD/HAF application for Maryland like the representative told me for assistance awaiting a response. A week later I called back to get an update and spoke to the same man from XX/XX/. He told me I filled out the wrong forms and the partial claims division never sent my partial claim since XXXX. He also stopped the modification and put in for another partial claim that I agreed to in XXXX to prevent confusion. XX/XX/ HUD/HAF contacted me and told me they ran out of funding for Maryland and was not able to assist me. I received several letters for foreclosure and total call on my loan from Lawyers and first home. I was distraught and had called my loss mitigation team every week about the issue and told them the state no longer offered assistance. The customer services representatives told me to not to worry about the letter and the partial claim was pending. They also said that the time frame was XXXX business days but it was going on XXXX at the time with no ESTIMATED ARRIVAL TIME in sight. A few of them stated that they were escalating the issue but I never heard anything back from any superiors from moss mitigation. XX/XX/ I have now called every single week like I was told by the representatives. No one was able to give me actual information or put time through to a manager. I was told on Friday XXXX XXXX XXXX by a representative that legal action was being taken against me for failure to pay my mortgage when I was told the week before to ignore. She escalated it Friday to management. Saturday XXXX XXXX A officer showed to my house with legal paperwork stating I was served for court. They paper work states I didnt contact HUD/HAF , First home mortgage, or loss litigation when I have been contacting them all. I called yesterday and they stated it was escalated and getting worked on by partial claims once again but they did not mail anything out yet.

I closed on a property on XXXX/XXXX/XXXX financed by an FHA 203K renovation loan ( {$170000.00} purchase + construction = {$230000.00} loan amount ). The intent was for the house to be my primary residence following construction. The General Contractor submitted a zoning permit application to the local township on XXXX. The zoning permit would then be submitted with a building permit application to the county. On XXXX, we received a denial based on the fact that the existing use of the property, though single-family residential, is a non-conforming use on a Commercial zoned lot in a Commercial District. This was shocking to me since it was sold to me as a single family home! Commercial zoning was not noted on the property listing, appraisal, tax records, title paperwork, etc. I notified the representatives from the title company, mortgage company and my real estate salesperson on XXXX/XXXX/XXXX via email and subsequently spoke with them on the phone. Due to the complexity of these issues, I retained an attorney on XXXX/XXXX/XXXX and he began communicating with the mortgage company on XXXX/XXXX/XXXX. I found out just a few days ago that the loan has been sold! The new company servicing the loan expected my first payment on XXXX/XXXX/XXXX on the full amount of {$230000.00} even though no construction was done! Apparently the lender did not pass along accurate and complete information to the new servicer. I am now in a position where I own a property on which I can not do construction and in which I can not reside. I also can not use it as a commercial property, even if I was inclined to do so, because my loan is based on this being my primary residence. And I now need to make mortgage payments on a property I ca n't use while paying rent for my current residence. The response from FHMC follows : " After closing, First Home Mortgage received a letter from XXXX XXXX attorney stating the subject property was zoned as commercial and as a result, she is not able to obtain the necessary permits required to renovate the home. During the application process, the property was represented to First Home Mortgage and XXXX XXXX as being residential from various sources including the listing, appraisal, tax records and title report. Our general counsel has been in communication with and will continue to communicate with XXXX XXXX attorney while she pursues this matter with the title company and the title insurer. We will assist XXXX XXXX in her pursuit as we can in order to resolve the matter, but respectfully decline her request to forgive the balance on her loan. In the interim, First Home Mortgage intends on putting the title insurer on notice regarding any future claims we may have as well. XXXX XXXX loan was structured with three mortgage payments built into the loan amount because it will take three months after the renovations begin to inhabit the property. This is typical on renovation mortgages with significant work to be completed. As such, XXXX XXXX mortgage payments will be paid out of her escrow funds for the first three months. As for the sale of her mortgage, First Home Mortgage sells all of the mortgages that we originate and there is no delay in doing so on renovation mortgages. Since there is never an option to delay the sale, we would only communicate an immediate sale to a customer. I can only speculate that XXXX XXXX may have received misinformation from a third party that was not affiliated with First Home and unaware of our processes. Regardless, the timing of the sale of XXXX XXXX mortgage has no impact on her situation. '' My response is this ... The loan was structured to include 3 mortgage payments at my request only because the property was to be uninhabitable during construction. Since no construction is in process, it is incorrect of FHMC to make those payments. Also, where is the {$64000.00} that was not used for construction or mortgage payments? According to FHMC attorney, he believes that XXXX holds the funds. According to XXXX, FHMC is responsible for the maintenance of the rehab escrow account and disbursement of funds from that account. What about all the extra money in fees, points, etc. that I paid for the larger loan amount? The bottom line is this. My FHA 203K owner-occupied residential rehab loan is no longer valid. It can not be an owner-occupied residence because it is commercially zoned. I had no interest in purchasing a commercial property.

XX/XX/XXXX : After receiving past due notices for XXXX and XXXX payments I contacted customer service and was transferred to loss mitigation and loss mitigation said my payments were misapplied and explained I had to email XXXX I sent an email that day explaining the situation ; I asked to speak with a supervisor and loss mitigation told me that my mitigation processor would contact me via phone by the end the business day ; I never received a return call XX/XX/XXXX : Contacted loss mitigation to follow up and I was told that my payments went all to escrows and that I had to contact the escrow department and the only thing they could do was put another 3 month forbearance on the account to allow time to get the issue resolved ; I contacted the escrow department and there were not payments applied ; the escrow department transferred me to the customer service department where I had to explain the situation again ; this time a supervisor was contacted and the supervisor stated that when my account was released from loss mitigation the due date was set to XXXX not XXXX and this is why all of my payments were posting one month in arrear. The supervisor said she was sending an email to loss mitigation to correct this clerical error because the forbearance was through XXXX and due date should have been XXXX. I was assured the issue would be resolved by the next business day. XX/XX/XXXX : I followed up to see if the issue was resolved and was transferred between loss mitigation and customer service until I asked for a supervisor ; the supervisor asked me to explain the situation again and read the notes and stated that the issue needed to be sent to the management team to be addressed because he could see all of the efforts that I had made to address the issue. The supervisor explained that I would receive a call and an email from a member of the management team. To date ; 15 business days have elapsed and I have not received a call or any correspondence from a member of the management team Other attempts to resolve this issue : XX/XX/XXXX : emailed XXXX XXXX no response ) XX/XX/XXXX : emailed XXXX XXXX received a letter via mail that the issue would be researched and I would receive a response with the legal allotted time ) no response and the supervisor told me this legal allotted time is 14 business days XX/XX/XXXX : sent message via XXXX XXXX ( online portal ) received a response on XX/XX/XXXX that my account was noted that I spoke with customer service on XX/XX/XXXX and to allow 30 business days for the issue to be resolved- I have received no response. To whom may concern, I'm having issues with my mortgage company : First home Mortgage. XXXX. On XX/XX/2022 - My family received an " annual escrow account disclosure statement and change of payment notice prepared for '' - stating that the mortgage payment for our house will be increased by {$2600.00} dollars a month by XX/XX/2022. XXXX. After doing our own research we discovered that the property tax bill was calculated incorrectly by the DC government and the mortgage company has made a payment for the incorrect excessive amount that was increasing our mortgage. XXXX. First House Mortgage was notified immediately requesting for us to contact the Government of the District of Columbia to correct the property tax bill. We immediately proceed to contact XXXX, and after our request, a new tax assessment for the property was provided on XX/XX/2022. The " STATEMENT OF PROPERTY '' ( attached ) specified that a correction was made an a tax credit of {$13000.00} has been applied to our account. XXXX. The same day - XX/XX/2022, we reached out over the phone to XXXX XXXX XXXX to request the correction of our Annual Escrow Account so the monthly mortgage payment was corrected and would reflect the monthly payment with the correct value. XXXX. Repeated calls and communications were necessary to explain the situation to First Home Mortgage and to request them to collect the credit from XXXX. At this point, my husband and me - the owners of the property - can't understand what was the reason for their negligence to collect the credit and correct the account. After a week of constant requests, we were informed on XX/XX/XXXX that even after collecting the credit from XXXX a new Escrow Account Statement was needed to show the correct Monthly mortgage payment making us wait additional weeks. XXXX. On XX/XX/2022, we received a new Escrow Account Statement, however, the statement does not apply the full credit provided by the government to the account and still requests the additional {$2600.00} dollars a month for the XXXX and XXXX mortgage payment. XXXX. After calls on XX/XX/XXXX, XXXX, and XXXX to try and obtain information from First home Mortgage they CAN NOT explain the reason behind not applying the full credit to the account. The only solution provided is that " They have made a mistake '' and all we get is : " we are sorry but you have to make the payment otherwise late fees will apply '' and if they make the correction at some point they will provide the difference as a credit.

I am writing this letter to inform you of, what seems to me, to be a lending practice that discriminates against women by requiring additional documentation from female loan applicants. I have cancelled my transaction with the lender but felt it was important to report this practice as it may affect others in the future. I was attempting to refinance my home to consolidate my first and second loans, benefit from a lower interest rate and take some additional cash out to pay off a student loan and do home improvements. I have plenty of income, tons of equity in my house and significant other assets and net worth. I spoke with a loan officer and did not foresee any issues. After massive amounts of documentation was provided, the lender then requested I send copies of my separation agreements from two long dissolved marriages so they could be assured that I didnt have any obligations to my ex-husbands that they needed to know about. The first separation agreement was entered in XXXX, several years before I purchased, as a divorced woman, the property in question. Here is a little background. I purchased my house as the sole owner in XXXX and have been the only owner and borrower ever since. I have never owned this home with another person nor has any other person been a borrower or co-signer on the loan. I have refinanced it once and taken out a home equity loan since I purchased it. Never have I been asked for this documentation. In fact, never have I been asked for this documentation for any reason ever. It is simply not relevant. As part of the transaction, I was also adding my current husband to the deed and the two of us were co-borrowers. No such request for this type of information was made of my husband. In fact, it was never asked if he had been married before or had any contractual agreements with any individuals. When I questioned the lender about it, I was told my name change triggered this request. That is clearly discriminatory as in the overwhelming majority of cases, it is only women who change their name due to marriage. This practice puts an unfair burden on women to prove they dont have any lingering obligations to past spouses and does not require the same of men. I have not faced this sort of blatant discrimination since the time I attempted to purchase a car in XX/XX/XXXXwithout my husband present. My experience has been these archaic practices toward women and marriage ended long ago and I was quite surprised to find it rear its ugly head in XXXX.

I was approved for a forbearance on my mortgage account for the months of XXXX, XXXX and XXXX of XXXX because I was suddenly medically retired, and my pension checks did not arrive for three months. I was told to call back in the third month to resolve the forbearance and decide how to move forward. I called back, and was told that I would be able to defer my payments to the end of my loan, and that I should start making payments again in XXXX, and I would receive something in the mail in the next few months. I started making monthly payments again in XXXX, but never received the mail. In XXXX, I observed that my credit score had dropped, and that the mortgage company was reporting every payment I was making to be three months late. I called back to inquire what was happening, and was told the original person I spoke to at the end of my forbearance never submitted the paperwork to end my forbearance and defer the three months of payments. I was told it would be submitted for the deferral and to their research department to fix the errors in my credit report. I did not receive another call, so in the beginning of XXXX, I called again to ask if they had resolved it, and was told that I could email their research team with the deferral approval letter, so they could fix my credit report. The letter states that my loan is brought current, and the previous late fees that were given in error would be removed. I then received an email reply that says since the company did not submit the paperwork correctly for end of the forbearance, my XXXX payment was applied to XXXX, my XXXX payment was applied to XXXX, and so on. This has led to almost a year of payments being reported as three months late. The fault lies with the mortgage company for not submitting the end of my forbearance correctly. Since I was not notified that something was wrong, now almost a year of payments are reported late on my credit report, and my once very good credit score, is very low. I have shown the credit companies this deferral letter, but they have not fixed it, and have told me that I need a statement from the mortgage company fixing the mistake they made. The mortgage company continues to say that they have reported this accurately, when they have not. I was approved for a three month forbearance and deferral, I never missed a payment, and I was never late on the payments that they told me to make, however they are reporting to the credit agencies that I was late on every payment since XX/XX/XXXX.

When I applied for my mortgage I switched lenders to one that I found online listed under the program I was trying to receive. The Program was XXXX XXXX XXXX In Maryland and the lender it gave me was first home mortgage and my point of contact was XXXX XXXX. I sent her all my information for pre qualification I received my letter and started the process. Everything needed to be handled in a rapid manner in order to qualify for the program. The lender took so much time in processing the paper work I almost lost the house which the location alone fit the safety needs of my family and affordability for me financially. Finally when the closing date came up the lender underwriter tells me that he was n't going to count all of my income towards my income even though I had direct documentation of my income. I was in a program that was more secure then his job, and yet he made a personal decision to disqualify just enough of my income to raise my dpi and unqualified me for the program. As I reached out to that company of course they would n't let me speak to the underwriter. The deadline for the submitting the papers to the program than came and went. I asked about switching to another lender but because they dragged there feet unnecessarily. So then it got to the point where I would ether come up with another XXXX dollars to close and raise the amount of my mortgage and monthly payments. XXXX dollars I lost because of someone inaccurately making a decision that was wrong. I was in an emergency situation living in a pest infested house on a section XXXX program and I finally got myself in a position to move my life forward and my first step into the real world I get robbed by the lender I choose. I went with this program because they seemed to be the experts in the program I was using, instead I feel like I was robbed as a result. My income at the time of the loan being processed in my income before the loan was being processed still qualified. Thats why I made it through pre qualification and thats why they did n't deny the amount of the loan because it fit in my budget. I do n't know if this was redlining or what personal issue with unions that this underwriter had, but there was no reason to deny me my program. The very definition they gave me on income and hourly workers defined my income within the means.

I feel that I may have become a victim of predatory lending from representatives of First Home Mortgage. I placed an offer on a home in XXXX of 2019. Although the loan was approved, I chose to rescind the offer on the home. I informed the lender, via a verbal telephone conversation, I did not want my loan over {$1800.00} per month and I required down payment assistance to put down and little cash possible. He assured me all would happen. My loan ended up being placed at one of the highest interest rates available and although I did not qualify for down payment assistance, I was never told until I questioned information that was being forwarded to me. They attempted to include a second mortgage in the form of down payment assistant and disguise it as a program. The final offer from the mortgage companies company consisted of a mortgage at a slightly lower interest rate, however they insisted on depleting my saving and attempted to have me move into a home with nothing. I filed bankruptcy over two years ago and did not want to put myself in a position to lose a home, possible go into deeper debt, ruined my credit and possible lose my job. One of the requirements of my employment is to stay in good financial standing. Although I submitted documentation supporting I could not afford the loan, the lender told me well before approval the underwriter planned to approve regardless. That they would look bad if they did not approve a loan for a XXXX women and I would have no choice but to refuse the loan and owe my realtor a 3 % commission and be sued by the home owner. I was being made to feel like I had no choice in the home purchase, refuse and be sued. The lender along with the realtor attempting to use the threat of a lawsuit to scare me into a home purchase. I was never provided a correct closing disclosure document although I requested it several times prior to the scheduled closing date. I am requesting assistants in reviewing how the loan was processed and if it should have been approved at all. The underwriter requested additional information, a budget and a statement on why I filed bankruptcy. I believe the lender used a part-time job I have worked for less than two years to qualify me. I am not confident they submitted documentation reflecting this. Please see the attached documents.

I bought my condo unit in XXXX, XXXX, making my first payment on XX/XX/XXXX. As a rule, I make all house payments one month in advance. That is why by the time I made the XX/XX/XXXX payment, I couldn't understand why I was receiving a notice that my XXXX, XXXX payment had not been made. I was to find out the Lender was not accepting my monthly mortgage checks due to a computer problem. I was told to stop payment on the XXXX thru XXXX, XXXX payments. XXXX XXXX, my Bank, checked everything out on my side and determined there were no problems. The computer problem was corrected in XXXX and I made a lump sump payment to cover the missing months. The problem is that, even though I had nothing to due to the problem, the Lender filed negative information against my credit report. They reported non payment of mortgage payments and " unknown information '' under 2 months. For the months from then to now I requested correction of all the negative information, but they refused stating, " I send them documentation showing payments were made in a timely manner and a copy of the unbridged credit report ''. They were given all this information when I paid the lump sum payment. The Qualified Written Request from XX/XX/XXXX was answered by saying they had already furnished an answer. I was told RESPA did not apply when I gave them the offending sections. On XX/XX/XXXX, XXXX called ( XXXX x XXXX ) and left a message stating all the credit problems and negative comments had been resolved and were no longer on my credit report. I accessed that information and noting had changed. I called XXXX and left a message that I needed the documentation to show my records were clear, but she never called back nor did I get the information. I am still in the same negative position I was in XXXX. I advised them that I bought a car in XXXX and I was turned down from 3 lenders and the interest rate I was forced to pay due to their malfeasance cause my monthly car payments to be exorbidant. I have spent untold hours of work trying to get this straightned out, but the Lender contimues to igorne me to my deteriment.

On XX/XX/XXXX, I received an alert from XXXX alerting me my credit was pulled by XXXX XXXX XXXX. I did not recognize this and I called XXXX XXXX XXXX at XXXX ( XXXX ) XXXX. I was told my credit was pulled by XXXX XXXX at First Home Mortgage and I have to contact this company to dispute the inquiry. I do not even recognize the name XXXX XXXX, nor I have authorized an " XXXX '' or First Home to obtain my credit report. I have not even spoken to anyone at First Home. I performed a search on XXXX " XXXX XXXX First Home '' and found his email on the website at https : //firsthome.com/XXXX. I sent an email to him ( attached ) though I have not heard back as of making this complaint. I attempted to dispute this via XXXX but I do not see a way to dispute Hard Inquiries. I did work with XXXX XXXX at First Home back in XX/XX/XXXX when I purchased my home, and my credit report was pulled then, but I have not authorized First Home nor anyone employed by First Home to pull my credit since XX/XX/XXXX. I did reach out to XXXX via E-Mail in XXXX XXXX about refinancing, but I never heard back from him and I proceeded with another lender. I am now in the process of refinancing my home with XXXX XXXX / XXXX XXXX and I close in a little over two weeks. It may appear to the bank/lender I am actively shopping for credit, which is not the case. This inquiry by First Home is unauthorized and as far as I know, a violation of the CFPB. It could hurt or lower my credit score and potentially impact or raise red flags as I get closer to settlement. This is absolutely frustrating. Please assist as I do not know how else to get this removed from my credit report.

This is my second Consumer Financial Protection Bureau ( CFPB ) complaint against First Home Mortgage, relating to an ongoing issue with my COVID Loss Mitigation application. The saga began in XX/XX/ when I first requested the application, but it was not until XX/XX/2023 that I received and submitted it. The application was accepted for processing on XX/XX/2023, and I was told to expect a decision within 30 days. Concurrently, I was advised to apply for the Maryland Homeowner 's Assistance Fund ( MHAF ), which approved up to {$40000.00} in funding for me on XX/XX/2023. To facilitate this, I made a payment of {$3200.00} to First Home Mortgage on XX/XX/2023, as advised by their representative. However, the process was disrupted when MHAF required an updated mortgage statement from First Home Mortgage. Despite multiple requests from MHAF and my Veteran 's Affairs Technician, the lender failed to provide this document, leading to MHAF denying my assistance application on XX/XX/2023. I have filed an appeal against this decision, as the denial was not due to any fault of mine. The last communication I received from First Home Mortgage was on XX/XX/2023, merely stating that my application was under review. My VA Technician 's request for an update, sent on XX/XX/2023, has been met with silence. This ongoing delay and the lender 's unresponsiveness are not only hindering my financial assistance efforts but also negatively impacting my federal security clearance and my credit report. The lender 's lack of communication and action is exacerbating these issues, leading to increased hardship and uncertainty about my financial future.

On XX/XX/21 @ XXXX ( EST ) I called First Home Mortgage ( FHM ) to request a Mortgage Statement-spoke w/ XXXX-put on hold for ~10minutes and I hung up. XX/XX/21 XXXX I called back to FHM and reached XXXX and he agreed to fax a Mortgage Statement that he said they have 3 days to fax. A Mortgage Statement did no arrive. On XX/XX/21 at XXXX I called back to FHM and reached XXXX who told me that they are not by federal law permitted to fax a Mortgage Statement but she would request one be mailed to me. ( Since I locked in an interest rate with XXXX ). Just to be sure it was mailed-I called back XX/XX/1921 XXXX and reached XXXX and explained the situation-a Mortgage Statement was not mailed, I asked to speak to a manager and was transferred to XXXX it was XXXX when XXXX picked up the phone. XXXX said a Mortgage Statement can be mailed or faxed-I requested both mail and fax and asked if she could fax at that time-again told they have 3 days. I still have not received a Mortgage Statement.. I even told XXXX that I was going to report them. I tried to sign into web page and can't get in. I have a coupon book and do not receive a Mortgage Statement. All I need is a Mortgage Statement. Thank you for any assistance.

He is claiming that his company was the originator of my loan, I not once stopped sending payments to us bank. I don't know what to do, the fake documents from the court about my property, it is us bank vs mel the documents attached to paper is first home mortgage and account number that's not mine, XXXX XXXX law firm who is us bank lawyer is part of this. XXXX XXXX firm has somebody forging my name and the are falsifying documents. XX/XX/XXXX, I submitted a formal request asking that my mortgage company remove my Private Mortgage Insurance ( PMI ). I was told that this was not possible and I needed to pay the loan so that my loan to value ratio was at least at 80 %. Another solution was, since my loan was at 82 % loan to value ratio, they suggested that I get an appraisal ( {$500.00} ). I followed the instructions of paying additional money on the loan. In XX/XX/XXXX, I had a loan to value ratio of 75 %. I submitted my request again. Now they are telling me that are denying my request and I absolutely have to get an appraisal in order to remove PMI. This has been a disaster from the start. I got incorrect information from the loan officer who works for the company. I was told that once my loan to value ratio hit 78 %, the lender was required to remove my PMI. Now at 75 %, I am being told my other officials at First home mortgage that the only way for me to remove PMI is to pay for an expensive appraisal. I honestly believe that these individuals are preying on me because I am a first time home buyer and regardless as to how many classes I took prior to my purchase there are things that I just didn't know. I would really like help getting correct information on removing my PMI since I have shown " EXCELLENT '' payment history, etc.

My mortgage company sold my mortgage, changed my account number, lost my payment, did not give notice of a late pay and reported me to the credit bureau as 30 days past due. I have paid my mortgage on time every month for over 25 years. My mortgage payment was due on XX/XX/23 and I sent payment on XX/XX/23 from my bank and this was verified. The mortgage company sold my mortgage and changed my account number several months before. They sent me notice of the account number change later in XXXX. At that time, I made changes to my payment for XXXX. That was due on XX/XX/23 and I sent payment on XX/XX/23. That payment was received by my mortgage company and applied to my XXXX payment. I was also reported as 30 days past due. After multiple hours and multiple calls of trying to contact them, they constantly stonewalled me. They said research was the department that could make a determination and they cant talk on the phone. Therefore, I was not able to resolve the issue. I have proof that my payment was sent out and there was no contact by the mortgage company that payment was late or going to be late. In fact, all mail correspondence with this company has taken several weeks to reach me.

I first received notice from my home insurance company ( XXXX ) that my escrow payment for the year hadn't been received, on XX/XX/XXXX. I immediately contact my mortgage servicer, First Home Mortgage Corporation and informed them of the issue. They stated they never received the invoice, so the insurance company emailed the invoice directly to the email address provided by the servicer ( I was CC'ed, so I have evidence of the email and invoice going out ). I then received another email from my insurance company on XX/XX/XXXX stating they still didn't receive the payment. So I contacted my servicer again and provided them the information the insurance company requested as proof of payment in order to avoid cancelation of the policy. I never heard back from the servicer. Then today, on XX/XX/XXXX, the date my policy is set to expire, I receive another email from my insurance company stating they are cancelling my policy because payment was not received. I had to pay the insurance escrow payment out of pocket to avoid my policy being cancelled. On XX/XX/XXXX I received my Annual Escrow Account Disclosure Statement, which adjusted my mortgage payment effective XX/XX/XXXX. The statement included activity from XX/XX/XXXX through XX/XX/XXXX in order to project the balance at the end of period. The statement included an actual tax payment of {$2900.00} in XX/XX/XXXX, as well as two " projected '' tax payments of {$1500.00} each in XXXX of XXXX. The " projected '' payments are for the same actual payment that was made. As a result, this statement shows my escrow account as underfunded by {$3300.00}. Due to this mistake, my mortgage payment was increased by {$240.00} starting XX/XX/XXXX. I contacted First Home Mortgage on XX/XX/XXXX about this error and was told that it would be reviewed and I would be contacted. On XX/XX/XXXX, I contacted them again and was told that the matter had not been looked at. First Home is fraudulently trying to take my home from me but putting me into default at their own whim and against policy. Due to my status as a XXXX XXXX XXXXXXXX veteran, the state of Maryland does not require me to pay property taxes on my home. Therefore, last fall, I requested that our mortgage company, First Home Mortgage, no longer require us to pay into an escrow fund to cover property tax payments to the county where we reside. First Home Mortgage did reduce our monthly payments accordingly in or about XX/XX/2022 and promised to refund the escrow overage within 30 days. We never recieved any refund of our overage, notwithstaning my again requesting a refund nearly a month ago. We are current on our mortgage payments and there are no other issues. PMI was removed from my account on XX/XX/2022. An escrow analysis was run on XX/XX/2022. This analysis took into account pmi. I no longer have pmi yet they are escrowing as if there is still pmi as well as collecting a shortage. I asked them to run a new escrow analysis and they have refused. They will collect more than {$3600.00} in escrow over the next 12 months. My taxes and insurance are less than {$1800.00}. Collecting this amount is almost twice what is needed to cover my taxes and insurance. I called on both XX/XX/XXXX and XXXX and got the same response. In Maryland and escrow account is not mandatory. This is our second complaint because First Home Mortgage refuses to cooperate with us and the Virginia Mortgage Relief Program to receive payment to save our home. This is an extremely time sensitive matter and the funds are available and waiting, we are very confused as to why they wont accept the funds and get this matter situated and why it is taking them as long as it is to handle this matter. I requested and was approved for forbearance with First Home Mortgage starting XX/XX/XXXX until XX/XX/XXXX but they still processed a payment from of my checking account on XX/XX/XXXX. This payment caused my checking account to go negative and incur overdraft fees ; as a result of a depleted account automatic payments for my HOA fees, credit cards, and utilities payments were returned. I can supply bank statements upon your review. I've had multiple discussion with both their Customer Service and Loss Mitigation teams and was told that a refund will take 7-10 business days ; one month later and I've yet to receive the refund. First Home Mortgage claims not to have received my mortgage payment, despite my bank showing that payment was received and deposited into their account. Instead of investigating this matter on their own, First Home Mortgage required me to do all of the legwork to prove that they had cashed my check. They do not accept emailed images of the canceled check, requiring faxed materials instead. If a check has been cashed by a lending institution, it should not be the borrower 's obligation to demonstrate that.
