Sir, I am complaining about the method of business used in my case and presumably in all cases, by 1st Heritage XXXX XXXX XXXX XXXX XXXX XXXX ( full address enclosed ). If this practice is used in all their loan processes, many people have been and are today, being cheated out of thousands of dollars. I offer two scenarios, both of which can be substantiated by my testimony and anecdotal evidence and/or the testimony and position taken by 1st Heritage themselves. I borrowed money from 1st Heritage over a year ago and have been paying monthly installments on this loan since that time. I am a retired XXXX veteran and recently came into a sum of money from the VA. Deciding to pay all my loans and get out of debt, I called 1st Heritage to get the payoff amount. Scenario number one ; I called 1st Heritage around XXXX XXXX, XXXX, and asked them how much they needed for me to pay the loan completely and close the account. I was advised, an amount of approximately {$2400.00}. I didnt write this amount down and I didnt record the call. 1st Heritage will dispute the amount, asserting instead that they had told me an amount closer to {$2500.00}. They didnt record the call either so this amount is their word against mine however, I ask that you consider two things, ( anecdotally ). First, if my intention was to pay off the full amount, why would I have intentionally shorted them by less than {$100.00}? Second, since I was sending them such a large amount, ( I immediately scheduled a payment since I use online banking with XXXX XXXX here in XXXX Mississippi ) is it likely that I would have gotten this amount wrong since I was sending such a large amount. At any rate, I sent them {$2500.00}, approximately {$50.00} more than they quoted, in an attempt to make sure the required payoff amount was covered. My scenario number one asserts that they intentionally misled me about the amount I was told to send, ostensibly so they could keep the account open and add more interest to the payoff amount. Scenario number two ; Later, I received a statement from 1st Heritage, ( statement date, XXXX XX/XX/XXXX ), indicating that I had a balance on the account of {$1600.00}, with a payment due of {$190.00}, indicating additionally that they had received my payment of {$2500.00} on the XXXX of XXXX. I called them immediately and was told that the {$2500.00} was short of the full amount owed, and that there was actually an additional {$50.00} approximately, owed on the loan, over and above the {$2500.00}, and further, that extra {$50.00} had increased, due to interest, to approximately {$320.00}. In short, to pay the loan in full, I had to give them an additional {$320.00}. This meant that the extra {$50.00} ( they alleged was still owed on the account ) had increased six times the full amount, to {$320.00}, in less than three weeks. I asked them how that could possibly be, even if they were right in that I had sent the wrong amount, with the {$2500.00}, and I was told that they charged the amount the state of Mississippi allowed them to charge and that the increase of six-fold was allowable under Mississippi law, ( in the interim I went to 1st Heritage two days ago with cash and paid this {$320.00} and obtained a paid in full receipt ). At any rate, I sent a complaint to the Mississippi XXXX and was advised to further contact your office. The state XXXX has asked for a response from 1st Heritage and I have asked for a full accounting of my transaction with them from the beginning of the loan process. Neither of these has been received as of this date, XXXX XX/XX/XXXX. If 1st Heritage is allowed to add on such outrageous interest to a loan, many people will be indebted to them their entire lives. I was fortunate in that I had come into a sum of unexpected income, but even I have been cheated, in my opinion. I am appealing to your office for regress and to move to keep this from ever happening to anyone else. If such criminal behavior is allowable under Mississippi law, this too needs to be addressed or at least the public needs to be made aware so people will be warned and decline to do business with such loan-sharking operations. I have the documentation to substantiate these claims other than the accounting Id asked for from 1st Heritage. I have been in communication with XXXX from the Mississippi state XXXX office, XXXX XXXX. She agreed to allow me to give her first name. I received a personal loan from First Heritage Credit on XX/XX/XXXX in the amount of {$XXXX}. 13. My first payment was due on XX/XX/XXXX and when they contacted me to remind me about this payment, I explained to them that it would be a couples days late. I began receiving 7-10 phone calls, random text messages, and repeated calls to my employer over the next week from our first conversation. I finally spoke to the company rep again and she proceeded to call me " ghetto trash '' while cursing and degrading me over the phone. I have to admit, I lost my temper and told her I would see her in court. I was angry and at the time not willing to discuss any further business with this company. As time went along receiving multiple calls, text messages from the employees personal cell phones pretending to be a friend or acquaintance of mine, I ignored the harassment. First Heritage filed a motion against me in civil court. We agreed upon a payment arrangement during this court date and I agreed to make monthly payments to the local court clerks office. The attorney there representing First Heritage was nice, but simply told me that the amount was going to be higher because he wanted his money too. I ended up filing for bankruptcy in XXXX of XXXX, but the trustee denied my repayment plan agreement based upon a job change with higher income. This resulted in my attorney dismissing that request and refiling with a new repayment plan in XXXX of XXXX. First Heritage Credit was included and notified of all of these motions per federal bankruptcy rules. First Heritage received payments on a total balance of {$XXXX} worth of debt owed to them in accordance to the repayment plan that was approved and managed by the bankruptcy trustee from XX/XX/XXXX until XX/XX/XXXX. I requested a dismissal from my bankruptcy in XX/XX/XXXX based on the fact that I feel like I can manage the small amount of debt I have, outside of student loans, on my own. The case was officially dismissed, per my request, on XX/XX/XXXX. On XX/XX/XXXX I received a call from a First Heritage rep stating that I had made no payments and that my balance was in excess of {$XXXX}. I explained to him the situation, but he was extremely rude. He stated that I didn't request the bankruptcy dismissal and that the payment I was in agreement and able to afford wasn't enough for them. I pulled all of my paperwork up and called the rep back. I advised him that there was a total of {$XXXX} paid toward the debt and that the balance he gave me was incorrect.He was adamant that I was wrong and threatened legal action. Upon review of my paperwork, I noticed that I was charged fees for life insurance, XXXX XXXX, property insurance, unemployment insurance, and an auto club fee of {$XXXX} that I had no idea about. The annual percentage rate for the original loan was XXXX %. I'm not sure how much in attorney fees have been added to my account, but the rep advised me today that interest was being charged daily since the loan origination date and that XXXXy didn't matter because it wouldn't protect me from daily interest charges even though payments were being made to them. I feel like this company has unethical business practices. I am in no way disputing the fact that I owe for this loan, but I am firmly in disagreement with the erroneous fees and collection practices in place.I am willing to make monthly payments that fit my budget in order to still be able to maintain my household and feed my child. I would like to see some of the erroneous fees removed from my account and have a written agreement in place for a payment plan. I would also like to ensure that during my XXXX time that no further fees and/or interest were added on to my account balance.

I borrowed a loan XX/XX/2014 to cover some of my expenses. I was struggling to pay my bills, rent and go to school full-time. In the beginning, I was able to comfortably make my payments every month but after a while I got behind and I was making sure to called this company periodically to explain my financial crises. Sometimes, they would call me if they did n't hear from me and I thought everything was fine. I figured they would be willing to work with me. I WAS SO WRONG. When they finally found out a got a new job that paid me every week, they wanted to know when I would be able to pay. Of course, I was ecstatic about finally finding a job that paid me frequently ; however, I was hit with my job cutting hours and my rent went up AGAIN. So I had only made one payment before I could n't pay again. One of the representatives, XXXX made a point to call my job without my consent to look to collect debt from me. I had already talked to her a few weeks earlier but she was hunting me down, although every time we spoke, she claimed she understood and would be willing to work with me. As time passed, this company got more aggressive in their attempts.They would call me from every possible extension, leaving voicemail after voicemail. It gotten to the point where they were deceptive -- -XXXX would call from her personal cell number and leave messages, looking for me to pay up. It was times I would call and ask could they possibly settle my account. Besides, the account was established almost two years but they said they absolutely did n't take any amount less than the balance owed. No matter what I did to get help, these people have been inconsiderate, harrassing and complete liars. Recently, the calls have stopped but now I have a new problem, the company is pulling my credit report every few months, trying to ruin my credit further with hard inquiries because I could n't pay them. So I called the company up last week and complained about my credit report being pulled. According to them, I agreed to them pulling my credit when necessary but I do n't recall signing anything agreeing to that but then again, it has been two years ago when I opened the account. So I explained to XXXX I am looking to settle my account. I do n't know why I thought anything would change but she said she could n't settle the account. I owe {$1200.00}. I asked to settle for {$600.00}. However, XXXX said she would n't settle for half. So she put me on the phone with her supervisor XXXX. When I spoke with the supervisor XXXX, I had complained about the harrassment and the unwillingness to settle. So, she finally asked me what did I want to settle the account for. I negotiated {$800.00} and she agreed over the phone. She told me to call her back Monday with an update when I got the {$80.00}, Now, today is Monday, XX/XX/XXXX. I called and asked to speak to XXXX but XXXX spoke with me instead. I explained to XXXX that her supervisor XXXX and I spoke last week about settling the account for {$800.00}. She was quiet a minute on the phone and she placed me on hold before coming back. She informed me that XXXX never agreed to settle the account for {$800.00}. According to XXXX, XXXX said as I quote word for word " Some customer called her and said she would pay {$800.00} towards the account and pay the remainder at a later date. '' XXXX completely lied about what we had discussed and got my hopes up of finally settling this account and moving on with my life. I am very disgusted that they play mind games and try to ruin customers ' lives over money. I could see if I was a customer that did n't call and update them or did n't offer anything. But two years is just too long to deal with bull like this.

CFPB, I am currently serving in the military. I was informed on some errors on my credit report due to renewal of my security clearance. XXXX, I wrote to the credit bureaus and informed them they were inaccurately reporting information that will potentially cost me my job. I submitted supporting documentation ; fast forward to XXXX, I lost my job because they didn't fix the errors on the credit report. 1. I submitted information to fix the following accounts : XXXX XXXX ( Mortgage ), First Heritage, XXXX XXXX, and XXXX. 2. XXXX, I sent certified mail to the credit bureaus ; still no change. 3. XXXX, I sent certified mail explaining and pointing out the errors, still no change. 4. XXXX, I sent certified mail to explaining and pointing out the errors with supporting documents, still no change. 5. XXXX, I sent and added credit report image from XXXX showing the each entry side by side with clear errors, still no change. I also contacted the creditors reporting the information by mail asking them to fix and errors and provide me proof of the debt, still no change and no response. 1. XXXX XXXX is reporting a Foreclosure on one bureau, 120 days on another, payment history does not match, date open doesn't match etc. This is a major account responsible for my job lost in the military. 2. First Heritage, I sent multiple letters asking them to verify the debt and or delete the debt. Still no response. I called and spoke to the company and ask the don't have document to provide me but keep stating the account information is accurate and verified. 3. XXXX XXXX have been taking payment from me but will not update the account. They stated they closed and charged off the account, but I was still making payments. The military had me used a company to make payments to them just to show external payment history to provide proof for my security clearance. The account is still not update. I called and asked who they sold the account to, and no representative can give me a straight answer. I lost my security clearance and job because of this account. 4. XXXX. I had to paid this account because the military wanted proof of action. I don't own this account. I asked them to since remove it, but they keep stating is verifiable but will not provide me proof. This is one of the account listed on my security clearance file. Lastly, I asked the credit bureau by mail to provide me proof of their method of verification and have not received anything since XX/XX/2019. The creditors and data furnisher have not provided me any documentation to substantiated these debts. I have called and sent certified mail even with evidence ; still refusing to make the changes. I went as far as sending image of the each credit report side by side from IdentityIq showing the errors, but they will not make fix the issue. I have lost my security clearance and my job. I kept receipts of my certified mail and certified mail receipts in case they denied receiving it. Sadly it has become necessary to file a chapter XXXX. I have retained an Attorney and preparations for a bankruptcy filing are being made. My Attorney has instructed me to direct creditors to his office. In XXXX/ XXXX of this year ( 2016 ) I notified several of my creditors of this development and all of my creditors with the exception of one have shifted communication to his office. I have a loan with First Heritage Credit,XXXX, TN XXXX Voice : XXXX Fax : XXXX In addition to making initial notification of the impending bankruptcy by phone to them in XXXX/XXXX. 2016 I also sent them via certified mail on XXXX/XXXX/16 a correspondence which served as my cease communication written notification. I again re-iterated my Attorney contact information in this communication that was received and signed for by First Heritage Credit on XXXX/XXXX/16. This communication also had the following FDCPA excerpt enclosure which highlighted point # 2 : 805. Communication in connection with debt collection ( 15 USC 1692c ) ( a ) COMMUNICATION WITH THE CONSUMER GENERALLY. Without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction, a debt collector may not communicate with a consumer in connection with the collection of any debt- ( 1 ) At any unusual time or place or a time or place known or which should be known to be inconvenient to the 15 USC 1692b 15 USC 1692c 805 15 USC 1692c consumer. In the absence of knowledge of circumstances to the contrary, a debt collector shall assume that the convenient time for communicating with a consumer is after XXXX o'clock antimeridian and before XXXX o'clock postmeridian, local time at the consumer 's location ; ( 2 ) If the debt collector knows the consumer is represented by an attorney with respect to such debt and has knowledge of, or can readily ascertain, such attorney 's name and address, unless the attorney fails to respond within a reasonable period of time to a communication from the debt collector or unless the attorney consents to direct communication with the consumer ; My Attorney information is available upon request incidentally. Despite these developments First Heritage Credit continues to make collection calls and has now begun to also harass the personal references I provided at the inception of the loan. I have three dated recordings from them ( XXXX and XXXX ) saved on my phone at present. Since I am also choosing to publish this complaint I am including this link : XXXX which give a lot of good information about repeated calls to debtors and references as well as a reference to a written cease communication. Prior to paying off account XX/XX/2019 the payment history reflected on my credit report showed current and on time for the entire year. After paying the account off in XX/XX/2019 through their online portal, the balance owed showed {$0.00} and I know longer had access to the portal. XXXX came around and it showed a 30 day late on my credit report for XXXX, but the account had been paid in full prior to XXXX. I contacted the lender and the branch manager assured me the issue would be taken care of, but I would have to wait 30 days until they report to the bureaus again. Throughout this scenario I had made it clear to the lender that I am in the process of refinancing my home and need the corrections to be made ASAP. XXXX XXXX the update reported and instead of removing the error First Heritage went back and added 8 late payments to the account. After the dispute with the branch manager I had deemed it as some form of retaliation to affect the refinance of my house. I later met with the District Manager at the office and have the entire conversation documented. He stated that the errors are to do with the companys system issues. The first error that caused these chains of events was XXXX cents in interest that they stated they forgave. The manager said that even though the online portal showed the account paid in full I should have known there was a XXXX cent balance even though their system showed otherwise. He stated that he would contact the credit department to remove the late payments, He stated that they would not remove the late payments which is in their own discretion and suggested that he will discuss with the companys attorney to remove the account. He stated that the attorney stated that according to FDIC they could not remove the account from my credit report which I instantly knew that was not true. Imagine refinancing your house, your personal dwelling, and in the process of paying accounts off completely to be Debt Free a company feels the need to attempt to strip the entire process away. Imagine the stress that has been experienced through this month not knowing if I will lose my house because paying off a loan has backfired to the extreme due to this companies systematic errors. I have attempted to reach out to this lender but have received nothing but prolonged responses and disrespect. I disputed the account on my credit reports ... .... it came back " verified ''. I then sent a letter to 1st Heritage on XXXX, XXXX asking them to verify the account with my contract. I received a reply letter back from XXXX XXXX XXXX. It was just a general letter they send out. It didn't have a contract or any paperwork that I was requesting. I mailed out my 2nd letter to XXXX XXXX asking again about the contract with my signature AND also stating inaccuracies that was on my credit report. XXXX XXXX was reporting on my credit reports that date of last payment was XX/XX/XXXX but on the payment calendar it showed a payment in XX/XX/XXXX. They also had a bunch of discrepancies on the payment calendars that I stated in my letter. They replied to my 2nd letter with the SAME letter they sent out before. Not addressing any of my facts. FCRA U.S.C.1681i ( a ) ( 5 ) ( A ) ( i ) that all information must BE ACCURATE, VERIFIABLE OR BE DELETED. FCRA U.S.C.1681s-2 ... .. these furnishers have to provide ACCURATE information when reporting to the credit bureaus. I sent a final 3rd letter in attempts to get accurate information, only to be sent the SAME letter they sent the first 2 times. In my 3rd letter, I asked them to verify aspects of the acct. They were reporting different " date of last payments ' and payment history wasn't correct. I also asked for them to produce the XXXX for the accounting owed. If they claimed a loss on taxes, made any insurance claims or took a loss and not crediting the client. They sent no such information or paperwork. XXXX XXXX is not in compliance with the FCRA. We as consumers have every right to ask for verification from creditors to make sure they are reporting 100 % accurate on credit reports. I even stated what was reporting wrong on the reports and asked numerous times for XXXX XXXX to send me proof of the inaccurate reporting ... ... and I got nothing. It is companies like this that feel that do not have to comply with Federal Laws that are their to protect consumers.In their letters, it states to provide them with details regarding specific information that was incorrect. I complied with that and gave them items that were wrong. And asked them how they got the balance they got, which is wrong. They are suppose to be able to provide me this information and verify all aspects of the account and they have FAILED to do so. According to FCRA 15 U.S.C.1681s-2b ( 1 ) ( E ) ( ii ) if an item is found to be INACCURATE, INCOMPLETE, OR CAN NOT BE VERIFIED, the furnisher MUST DELETE!

I feel my consumer rights have been violate by First Heritage Credit. I recently received my XXXX report. To my surprise on section 8 i had a small claims judgement. I had no knowledge of. I called the clerk 's offices and asked about this judgement. The lady stated i was served on XXXX XXXX. I told her no one had served me anything. The lady stated they can tape it to the door. I told her no one left anything taped to my door. She looked to see where it was left. But she couldn't find where it was left. Only a note stating i was hostile and uncooperative. She told me the judgement was for XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX cents. I told her i never received anything about this judgement. She stated because i didn't show up for court. The courts side with First Heritage Credit. She told me i can write the courts. On XXXX XXXX i received an alert from XXXX XXXX letting me know First Heritage ran my credit. I called CFPB to file a complaint on them. The agent i spoke with told me to call First Heritage. To see why they ran my credit. I called First Heritage and spoke with XXXX. She stated as long as i owe them, they can run my credit anytime. XXXX stated i was served on XXXX XXXX. I told her i was never served and that was a different date from the courts. XXXX stated the could be the wrong date. She placed me on hold. Then the manager XXXX took over the call. He stated the same thing about running my credit. I asked when i supposed to been served. He said XXXX XXXX. XXXX stated the balance was over XXXX XXXX dollars and some dollars. How would you like to pay this. I told him my ex-husband the one whos been paying this. He stated spouses do it all the time. I asked him for a printout of the payment history. The one they gave me i gave it to my divorce attorney. It had on it the husband made payment or made a payment arrangement. He said no get it from your attorney. I called the corporate office at XXXX. I was transferred to the audit compliance department. I spoke with a XXXX told her what happen. She stated the same thing about running the credit. XXXX in the audit compliance department stated my balance was XXXX XXXX dollars but that could be wrong. The account was charge off XXXX XXXX. This company is reporting inconsistent. This account was update on my credit report XX/XX/2022.

I ran into hard times and kept in contact with the lender. Every other phone call they were threatening to sue. When I spoke with them two weeks ago I told them I would pay this week. However they could n't wait and I received the papers they were suing me last Friday ( XXXX ). Even after serving me, they continued to call and I spoke with a representative that same day and she never referenced the fact that they were suing me. I find it repulsive that they would do this to a loyal customer who has had three loans with the company. One of them has been paid off, one has a balance of less than {$500.00} ( for which they are suing me ) and another one that I 'm working hard to bring current. Yesterday ( Monday ) I was informed by a neighbor that she was contacted by XXXX at First Heritage and was told to give me the message that she was trying to contact me. The law says that they can only contact other people when they believe I have relocated and/or they ca n't find me - and they are only allowed to do it once. Needless to say that is NOT the case since I spoke with them Friday and the fact that they left a message with my neighbor further violates the law. This is the 2nd time they have done this. The first time XXXX called my neighbor less than a week after I had spoken to someone in their office. They are also texting me - something else I do n't understand since I speak to them at least once a week. I never gave them permission to text me and I no one in their office has stepped up to pay the rates associated with such texts. No, I do n't talk to them daily because all they do is threaten me and continue to ask for what I do n't have. I was working with their office and keeping the accounts no more than two months behind. I was told by their rep XXXX that I should pay on the secured account the last time I paid and that I could pay the loan account the next time. All that did was manipulate me into being three months behind on one of the accounts so they could then sue me. This is harassment and it 's invasive and embarrassing. There was no reason for them to ( 1 ) sue me and ( 2 ) contact my neighbor and leave a message with her regarding MY loan. This has got to stop!!!

Some time prior to the initial incident, XXXX contacted me after I had already made a promise to pay. She contacted me the day prior, then again the day of my pay promise. I asked her not to repeatedly contact me unless I miss my pay promise. Once a pay promise is made and they make contact with me, I do n't believe I should be repeatedly harassed for the payment. You ai n't gon na win, '' then " You just mad cuz I called you out on your mess, '' and " I do n't care because imma be ok after this arbitration, honey. '' She then accused me of speaking to her in such a manner because " she 's XXXX ''. She expressed that I spoke to her colleagues differently because she 's the only XXXX girl in the office. It is my understanding that she is new to the office, therefore, I 've never met her and only conversed with her via telephone. This was actually the first conversation I ever had with her. I had no way of knowing the XXXX of her skin and that is absolutely irrelevant and absurd. Never in my years working with First Heritage Credit have I been harassed, disrespected or spoken to in such a vulgar and obscene manner. Prior to this incident, First Heritage Credit has always been professional, sympathetic with my shortcomings, and willing to work with me to find solutions. It baffles me that they would employ such a negative representation with their company. I am absolutely ashamed of this company at this point and never want to do business with them again.

I filed an original complaint against First Heritage Credit in XX/XX/2018 because they continued to contact me at work after I told them back in XX/XX/2018 to remove my work number and not contact me at the number again. They continued to contact me there on multiple occasions. I filed the original complaint, to which the company responded saying that no calls had been made since I instructed them not to back in XX/XX/XXXX. That was a complete lie. Today, XX/XX/2018 at XXXX XXXX, XXXX XXXX at the XXXX location of 1st Heritage Credit contacted me again at my work number. I asked her for her full name, which branch she was calling from and who her manager was. She provided this information. I asked to speak with XXXX, who she said was the branch manager. I asked XXXX why she was contacting me at work, after they have been told repeatedly not to contact me at that number. XXXX said he was not aware of her calling my work number and apologized. I asked why my work number was still in their system, as I had previously been told it had been deleted. He said he wasn't sure, made a reference about his DM that I didn't understand, and said he would make sure it was removed. I told him I had already filed a complaint with the CFPB and that I would be filing another one. I hung up with XXXX and then called XXXX XXXX, who wrote the response on behalf of 1st Heritage for the initial complaint. I told her who I was, what had happened that instructed her to get her XXXX branch under control. I also informed her that I would be filing another complaint with the CFPB. I then hung up. They continue to harass me and put my job in jeopardy. I want them fined this time around.

First heritage Credit in XXXX, TN called asked for the wrong person I asked that the not call the phone anymore and XXXX XXXX or should I say XXXX still did. Also called a work number and was asked not to call there and she called again the next day which is a violation of the fair debt collection practices act. That vey next day when she was told not to call the day before spoke to an HR director asking personal information about an employee. And told the HR director that she was going to garnish the wages when she shouldn't and where can she send the garnishment to. This employee has not even been served so that was a threat when the company doesn't even have a judgement. XXXX XXXX XXXX slandered this employees name and discredited her deformation of character. I spoke with her supervisor XXXX XXXX who works out of XXXX, TN office he said he knows nothing of the issue and that she shouldn't have said that if there was no judgment and employee has not been served. I also called the county clerk office in XXXX to see if they sent anything through there courts in XXXX county circuit court. I spoke with XXXX and XXXX on XX/XX/XXXX she explained she has not filings with the courts under any such name or other names possibly used. XXXX XXXX also said he would contact me by the end of the day to let me know what was going on. I never heard from him and I as well called the office back and he still was not there. On XX/XX/2018 I received a call from 1st heritage asking if I wanted to take out another loan. I told the representative no if it was going to report as an hard inquiry, she said no its going to report as a soft inquiry its not going to effect your credit at all. I had been receiving calls during the previous weeks as well and I was declining the offer. So after the call was done I had an alert saying that it was a hard inquiry on my report. I contacted the company explaining that it was a hard inquiry instead of a soft likebshe inquired. I had the account for over XXXX years with timely payments until I lost my job in XXXX 2014. I made my last payment as of XXXX 2014. I had no income including no unemployment and have not made a payment on the account. I have been speaking with them each month regarding my inability to pay. I received a letter from XXXX XXXX XX/XX/XXXX stating that owed an original creditor an amount. The letter stated that I needed to contact the firm. That the amount stated is delinquent & owed. I went in to make a payment on my account and I noticed that the computer showed that I owed more than I was suppose to. I asked the employee why was it showing that but she had no explaination so she proceeded to get the manager! When the manager looked at my account, at first she could n't figure out why either, so I asked for a copy of my payment history and saw mistakes! At approximately XXXX XXXX on Thursday, XX/XX/XXXX I was at my place of busines which was not open for business and the manager at 1st heritage Credit ( XXXX ) he knocked on the door and my manager let him in he introduced himself to her as a welcome to the neighborhood and then walked past her to me and began to collect on my account. I have been receiving several calls and letters in the mail from a company called 1st Heritage Credit. They stated that they sent a live check in the mail and that I have cashed it or gotten a loan from them. However, I have NOT received any sort check in the mail neither have ever cashed one. I do know that all mail that looks like junk mail to me I just throw away. I never opened any mail I received from this company until one day when I got a nasty phone call from 1st Heritage Credit. I told them that I have not received a check from them, I have not cashed a check from them, I have never taken a loan out from them, have never did business with them and furthermore don't need too. However, they kept calling and continued sending me nasty letters in the mail and they are still doing so to this present day. I called the none emergency police agency twice and talked to an officer and had them look up the company. My company has not given raises in 4 years. My overtime was taken away completely over 2 years ago. Cost of living constantly going up. Couldn't pay bills. Signed up with a Debt Relief company over 7 months ago. Have legal protection with them. The attorney made frequent calls to First Heritage and their attorney ( I signed a power of attorney ) and they would never even speak to them about a payment plan with the Debt company. First Heritage called me at WORK trying to collect this debt even after the power of attorney was sent to them. If I answered the phone, I informed them that they needed to contact my attorney, that they were taking care of this matter, but they still called me at work and my cell phone. Instead of working with getting paid, they took it to court and want to garnish my wages ( which money is already going to the debt company to pay them ) They have a horrible attorney and ruthless people working for this company. My husband and I purchased furniture from XXXX XXXX. We applied for a 24 month interest free loan through XXXX XXXX that was being financed by 1st Heritage Credit ( First Heritage Credit XXXX XXXX XXXX XXXX, XXXX, XXXX, LA XXXX, Branch Manager XXXX XXXX ). The amount of the furniture purchase was {$2700.00}. We received correspondence from 1st Heritage stating our payment amount was {$100.00}. This means we would not pay off the purchase price within the 24 month interest free period if we paid their " payment amount. '' We then received a " 1st Heritage Payment Statement '' stating that our loan amount is {$3800.00}. 1st Heritage 's statements and correspondence have been very misleading. We did not agree to a loan amount of {$3800.00}. We also do not owe them {$3800.00}. We feel as though 1st Heritage is making these process misleading and trying to get us to pay an extra $ XXXX for the furniture that was financed. This process is so frustrating that will likely take money out of a saving account to pay off this loan as to not deal with a dishonest lender. Received a check in XXXX as part of a pre-screened offer. Check was valid until XX/XX/XXXX. It clearly says pre-screened to receive the check. I don't apply for things to avoid hits to score and in dealing with loans previously I know if I got a live check they've determined you met credit criteria and did not have to run credit again. I cashed check on XX/XX/XXXX due to car issues taking out loan. On XX/XX/XXXX the company first heritage ran a hard inquiry with XXXX knocking my score down XXXX points. I immediately called them and they initially denied it and said only soft pulls are done for pre screen offers and I should NOT have gotten a hard inquiry. On XX/XX/2020 I called 1st heritage credit of XXXX mississippi and asked if they give loans to military personnel. They said they do so I applied and got the loan. At this time I was XXXX XXXX military and did not know anything about the military lending act. The APR of this loan is 37.640 % which is above the 36 % limit enforced by the military lending act. Also they required me to have premiums in order to receive this loan which is another violation of the MLA. I want to take the next step in order to void this loan but do not know how because it does not say on the internet and many attorneys I have called do not know of the military lending act. I have reached out to the issuer of the loan saying they violated the rules of the act and to void the loan but they will not. They sent this information to their attorneys to review this situation and are waiting for an answer. Received a THIS IS A LOAN check in the mail from 1st Heritage approximate amount {$1500.00}, deposited to account and made 5 {$110.00} payments and got behind 2 payments. Branch manager came to my HOUSE and left handwritten threatening notes in my mailbox spring of XXXX during XXXX! I have a closed account on my credit report from a company called First Heritage Credit that I am not aware of. I have never had any dealings with this company. She then, received a text that said, " Hey girl, how are you? I requested a cash loan. I was told that I qualified for the loan but had to list personal property to secure the loan. I was then told that I had to also purchase property insurance to make payments in the event that I defaulted on the payments. I was told that the loan also came with life and XXXX insurance and road side assisstance. These products were NOT offered to me as an option, but rather a condition. I was told all premiums would be prorated only for the months the loan remained active. When I returned the next month to pay off the loan in full all before the first monthly installment was ever due. I was told that I owed all of the money I borrowed plus 403 %. I have already sent complaints about this matter than has been resolve only mad worst. 1st Hertiage Credit continually called me at work, when I repeatedly ask them not to contact me at work. They tried to serve me papers at work and when I wasn't there he made one of my employees call me and put me on speaker phone so she could hear everything that was going. He then wanted to know if he could leave the papers at work where all my emoyees could see. I told him no that he needed to delivery to my house. I have applied for loan through first heritage credit and have not heard from them about my application. I have not received any letter in the mail for denial or approval. I am sure I have been denied but I am legally entitled to an adverse action letter. I havent received anything. My credit has been checked by them as I can see it listed as an inquire on my credit report. Their website has a pre-qualification form for personal loans that specifically states " this will not affect your credit score. '' I did the pre-qualification form but decided not to pursue fully applying for the loan. The local branch still pulled my credit report, resulting in a hard inquiry without my permission. I received a loan for $ XXXX {$800.00} from 1st heritage credit and was signed up for extra stuff I didn't want or need. I inquired about paying the loan off early as to avoid some the interest and was told it wouldn't do any good. I was going to have to payback {$900.00} over what I borrow.
