Got a text message early today from phone number XXXX, saying I had to contact them about a failed bank transaction and that it was urgent for me to call them. So I called, and this guy by the name of XXXX XXXX answered, without identifying the name of the company not giving me a debt collection warning or anything. He was asking me to confirm my information, which he had already in hand ( name, date of birth, social security number, place of employment, and old bank account info. ). He was also being very rude. I kept on asking for his name and the name of the company and he would say it very fast and would get agitated. I told him I think youre a scammer and he went off on me. He started screaming at me, saying that it was a shame that Im a cop and I cant pay a {$400.00} debt. And that he was going to give me a courtesy, but instead he threatened to file a lawsuit for harassment and file criminal charges against me. He also stated that the debt was from a company called XXXX XXXX, and that he was representing them. I would repeatedly ask for his name and the name of the company he worked for and he rudely told me Learn English! And grab a pen!!!!. I was very offended by that. Rude and unprofessional! He stated he worked for a company called First Direct Mediation, based out of XXXX, NY. I also kept on asking to speak to his supervisor or manager and he was saying he had no supervisor or manager, that he worked for himself. All while raising his voice at me. I was at the doctors office on an appointment when this call happened. I told him I had to hang up because I was going to see the doctor and he still acted rude towards me and hung up on me. I then immediately searched in XXXX the name of the company and found the website and called and asked to speak to a manager. My call was transferred to a a gentleman named XXXX who identified himself as the operations manager. He seemed more reasonable and respectful. I told him about what happened and I asked if an individual named XXXX XXXX worked there. He confirmed to me and apologized about Mr. XXXX behavior. I also advised XXXX that I will be reporting this to an attorney at a consumer law firm. He apologized once again and said he will listen to the recording of the call with Mr. XXXX. I have spoken to an attorney at a consumer law firm and they will be taking action and investigate further into this company and the actions of XXXX XXXX. I submitted this report to the CFPB for record and so the CFPB can also see the abuse of debt collection companies and not much is being done about it.

On XX/XX/2020, A company by the name of First Direct Mediation contacted my mother and stated that they needed to speak with me about an important business matter. When I called that day, no one answered the phone. I got a phone call on XX/XX/2020 from my ex husband stating that the same individual from that company called and left a voice mail that they were a litigation service on behalf of the school district ( that I work for ) and that a client of the school made a complaint against me. My ex husband was upset because we have not had contact in years, certainly not in the time that the claimed debt, was owed and he was never used as a reference. When I called the number my ex husband gave me, no one answered by First Direct Mediation. They instead asked me how they can direct my call and why I was calling. When I told them I got a call and my name, they switched me over to a Mr. XXXX ( or XXXX ). He confirmed that the debt was passed down from a loan company. He asked if I ever truly intended to pay on this bill and that I was a liar and lying to him. When I asked him about the amount, not only did the amount not match, but the amount I paid and owed was also grossly overstated. I advised him that I would be calling the company direct to confirm where the debt had been sent to. He stated that it's fine and he'll be ready when I call back because they can't help me. After I hung up with him, I called the loan company,. I was advised that my loan had been transfered to collections and the collection company is XXXX XXXX XXXX. She gave me the phone number and this company is not in any way affiliated with First Direct Mediation. They also advised me that there were a number of complaints by customers against First Direct Meditation and others for scams. They do not send their past due accounts to any business by that name. It is obviously a hoax or scam.

Company called my office today to discuss debt collection. When I attempted to ask questions about the debt, the caller XXXX XXXX who said he was calling on behalf of First Direct Mediation, began yelling at me and degrading me by calling me an XXXX. When I tried to explain that I have attempted to work with the original creditor to settle this matter, but then I receive threats of people coming to my home, people calling my mother and threatening her etc, he stated that he would send the police to my home and/or my work. He continue to yell at me and berate me, then hung up the phone. When I called back and asked to speak with a supervisor I was connected with Mr. XXXX again who made statements about the 8 years he went to school to become a lawyer and that he could not wait for me to be taken to court because " the calls were recorded and I laughed at him '' while he was yelling at me and threatening me. I told him it was unprofessional for him to act this way and to threaten to send people to my home where my son live and he said " no one cares about your son ''. I told him that I too am a professional and went to school and I know that it is unacceptable for him to treat me this way. I told him I am a XXXX XXXX XXXX and he said to me " well you need XXXX XXXX treatment ''. I then told him I was ending the call and hung up. I was then contacted by the HR department at my job questioning if he was supposed to call to do an employment verification. I explained the situation to the HR manager who disclosed to me that Mr. XXXX was also extremely rude with the switchboard operator when he was trying to obtain my office phone number.

On XX/XX/XXXX, I received a debt collection call from : XXXX XXXX First Direct Mediation XXXX XXXX XXXX, XXXX, New York. XXXX XXXX He stated he was attempting to collect a debt obtained by XXXX XXXX via XXXX XXXX XXXXXXXX XXXX on XX/XX/XXXX in the amount of {$700.00} plus interest and the total due is now {$1000.00} He insisted I settle the debt today over the phone that he could settle it for {$720.00} The problem is : XXXX XXXX XXXX have never obtained a XXXX Loan in any amount. 2 ) I did not request this XXXX loan- I feel that my identity might have been stolen. My drivers license was lost on a trip between New Jersey & New York. I reported the license lost and/or stolen when we returned home. I do have a case number. 3 ) He did have my name, SS # ( although I did not confirm that info for him ). He gave me an email address that was associated with this loan : XXXX ( not my email address ) and stated that when they tried to Auto Draft $ $ for repayment from my XXXX account, the draft was returned due to insufficient funds. I have NEVER opened or had an account with this bank. 3 ) Mr. XXXX XXXX verbally told me that if I did not get back with him before XXXX ( Eastern Time ) he would have to turn the information over to the court, I might as well pay the amount- a lawyer and having to appear in Court will cost more money. He also told me that a lien could be placed on my home & other property owned my me or my husband. Can you please advise me on how to proceed with this issue of stolen identity? XXXX XXXX, who identified himself as a representative from the civil processing division of First Direct Mediation, repeatedly tried to get ahold of me, starting on Tuesday, XX/XX/21, about a pre-litigation complaint allegedly filed against me. He referenced a file number XXXX. He stated that I only have XXXX hours from that date to either call myself, or have my attorney call him to make a formal statement, but he didnt say in the voicemail what the complaint was about, or who his client is making the complaint. XXXX XXXX XXXX then proceeded to call my father, XXXX XXXX, trying to get ahold of me about the same issue. XXXX XXXX then tried to call me today, XX/XX/21 about the same issue, only this time in the voicemail, he stated I had until XXXX XXXX to respond myself, or with my attorney, otherwise his client would proceed further by verifying my employment, and sending out notification for me to appear in court. Again, XXXX XXXX XXXX did not state in the message what the complaint was about, nor said who his client was making the complaint. I feel very harassed that XXXX XXXX would not only threaten me with verifying my employment, but continuously trying to contact me, and even my father, and not even supplying me with who his client was and what the complaint is about. I need XXXX XXXX to stop harassing me, otherwise I will contact my attorney, and take legal action against XXXX XXXX and First Direct Mediation for harassment.

XXXX XXXX has been calling my number repeatedly several times a day.. He also is calling family members and my place of employment. He calls from a number XXXX with a name showing XXXX XXXX on caller ID. He leaves a number XXXX, ext XXXX to call back.. The company is showing First Direct Mediation if you XX/XX/XXXXnumber. His message states ... .. " This is XXXX XXXX XXXX I am calling for XXXX XXXX. This is my final attempt to contact you regarding your paperwork that will leave my office at the close of business today. Due to your negligence and responding, you will be reported as non compliant. To stop these proceedings, either yourself or your legal representative will need to contact this office today at XXXX and my extension is XXXX ''. Another message left on my phone and my sisters voice mail. " This is XXXX XXXX. I am calling for XXXX XXXX. My office has been retained to retrieve a statement under a pre-litigation complaint that has been filed by my client file number XXXX. Prior to any further proceedings on the state law, you are permitted only 48 hours to respond with a formal statement. Either yourself or your legal representative will need to contact this office today at XXXX and my extension is XXXX ''. These people in my opinion are trying to use these scare tactics and it will not work on me.. I won't answer their calls and have blocked them until they call from another spoofed number.

First Direct Mediation located in XXXX, New York is allegedly attempting to collect very old debt that is time-barred in the State of California. They have not provided any written verification of said debt, but have continued to make phone calls to me, my place of employment, family and friends. This company, through various " civil processing department '' representatives, indicates that I will be receiving court summons in the next 24 hours unless I contact the debt collection company to resolve the matter. They call using various robot phone numbers and their threatening voice mails have been retained. I have asked the company to cease all debt collection and abide by the laws of the Fair Debt Collection Practices Act, which they continue to ignore. Most recently, they called me, my family and friends on XXXX leaving threatening messages as well. Despite their threats of court summons the past few weeks, no one ( as of yet ) has provided such summons. I have blocked their number ( s ) going forward and sent the email attached. This seems like an elaborate scam and attempt to extort money. Phone # s they have used are : XXXX, XXXX and other phantom numbers.

First Direct Mediation contacted me on the behalf of XXXX XXXX XXXX. He told us that the debt collection agency that had it tried to contact us for almost a year. We havent received a letter. We were in the process of getting XXXX XXXX added to a XXXX plan. We are trying to get back on track. 2020 really hurt us. We wanted to try a XXXX plan before bankruptcy. I informed him of that. He then told me XXXX XXXX was going after us for theft by deception, fraud, etc. when that is not true. We had loans with them and paid them off several times. We just got stuck in hard times during covid and pay reduction. But like I said. We wanted to do a XXXX and pay our debt back. He told me that it didnt matter that even if I filed bankruptcy the debt could not be discharged which I was told is completely false. So I canceled adding them to my XXXX and set up a high amount payment plan with them. I feel like he tried to scare me into setting up a plan with them.

I received a text message early today from an unknown number, saying I had to contact them about a failed bank transaction and that it was urgent for me to call them. I called back and spoke to a gentleman he stated he worked for a company called First Direct Mediation, based out of XXXX, NY. He asked about a loan I took out years ago from plain green loans and I explained to him that I paid them over 3000 more than my XXXX I took out and the outstanding balance was because I asked for 2 extensions during the time I was making payments to the loan. He tried to set me up on payment plans and I told him he was crazy because I cant pay that much in a month especially during this time with COVID-19 he said he will talk to the creditor to see what he can do but if I do not call back before 5 he will file it with the court. This is really disturbing for agencies to falsify and threaten people this way.

Someone named XXXX called. He did not say which company he worked for. He stated this is a final attempt to complete processing paperwork. He said due to my negligence in responding, I will be reported as non-compliant. He never mentioned who the debt collector is or the amount of the so called debt. I do not have outstanding debts. All of my credit cards are current. This person is harassing me and my family as well. Apparently, he is calling anyone with my last name or anyone who is connected to me. My former mother in law, my sister and brother-in-law, my ex-husband. This is harassment for a fictional debt.

Plain green! First direct mediation has threatened me and even called my mother speaking about debt that I owe. They threatened that I did fraud. NEVER in my life did I commit. They threatened me that they have all my information and he couldve done something. He was very rude! When I asked for proof they told me they couldnt it wouldve take to long. Called me three times in less than a hour time frame. Even was told he was an attorney and rushing me to provide my payment information!
