First Continental and XXXX XXXX and XXXX XXXX XXXX XXXX wants to collect {$21000.00} and foreclose my home with new VA Loan Servicer XXXX XXXX of XXXX, Texas. Also, wants me to make VA Loan payments of {$1800.00} on a VA Loan and home purchase that is fraudalent, Scams and Corruptions. Respectfully I will not make VA Loan Mortgage that is in Federal and State Fraud and corruptions. There is a major issues on VA Loan and purchase of XX/XX/XXXX with a major fraudalent, Scams and Corruptions with XXXX XXXX of Texas and XXXX XXXX XXXXXXXX XXXX XXXX XXXX and XXXX XXXX inflanted the appraised value of the home and sold me my new construction home for {$240000.00} a home that was bigger than mine sold for {$160000.00} on XX/XX/XXXX and no homes was sold in XXXX , Texas for {$240000.00} before XX/XX/XXXX. My XXXX in Texas prepared me a letter on my behalf in regards of fraudalent, scams and corruptions of First Continental, XXXX XXXX, XXXX XXXX of Texas and XXXX XXXX XXXX XXXX I can not and unable to pay no VA Mortgage over {$900.00} with property taxes of {$400.00} and Homeowners Insurance of around {$300.00} a month and property taxes in Texas is escalating. I am divorced, retired, XXXX and I live alone in my home. I only receive {$3700.00} California Cal Pers XXXX Lifetime Pension Income with No Social Security Benefits.I am XXXX years old.and XXXX I have been XXXX since XX/XX/XXXX till Present.and have a XXXX XXXX. I am in California having XXXX XXXX XXXX with my Primary XXXX XXXX XXXX XXXX since XX/XX/XXXX till Present. I have pains.on my XXXX XXXX XXXX XXXX XXXX .since my XXXX in XX/XX/XXXX. Also, My new XXXX construction home has a major plumbing leaks on the inside of the walls of the master bedroom closet.and damages is about a estimated of {$41000.00}. I filed a Texas XXXX XXXX claim onXX/XX/XXXX and insurance company and XXXX XXXX hasn't approve my legitimate claim. XXXX Attorney XXXX XXXX of XXXX XXXX, California is assisting me as a Military Veteran and only on XXXX XXXX claim. I made contact with XXXX XXXX XXXX by emails, because my home has a ten year warranty and XXXX rep stated that the two or three years Warranty has terminated.According to XXXX reps statement they stated that my home was built in XX/XX/XXXX and completed by XX/XX/XXXX orXX/XX/XXXX. I close escrow on XX/XX/XXXX. Notice : If VA Lender investors wants me to release my home to them, I like for them to provide me with the equity funds from my house as a fair settlement on Discrimination and Retaliation against me as a XXXX Military Veteran. I don't know the value of my home and my request is with respect to accommondate me on my XXXX XXXX relocation and shelter Cost out of Texas. If VA lenders will not modify my VA Loan and make my payments very affordable to {$900.00} including with property tax and homeowners insurance and also pay my VA Mortgage from XX/XX/XXXX till XX/XX/XXXX. Than is permissible that we have a fair resolutions and agreement what's noted on my Federal Government complaint. Notice : I will not fill no more VA Loan modification applications as i have done five VA Loan modifications with First Continental and XXXX XXXX, VA Lender can provide all my information to transfer VA Lender servicer in XXXX, Texas. If VA Loan will not be modified than I am respectfully requesting a fair resolutions to VA Loan frauds, scams and corruptions and Discrimination and Retaliation against me as a XXXX US Military Veteran and XXXX XXXX Citizen. Here is a recap of what our concerns are : The mortgage company, First Continental Mortgage ( the original mortgage company, will be known as F.C.M. ), sold our loan 15 days after closing. F.C.M. did not and would not provide a 15 day transfer notice. F.C.M. forwarded the new mortgage company, XXXX XXXX, also referred to as XXXX., a quote for homeowners ' insurance post closing, causing XXXX, to pay the premium, acquiring a second homeowners insurance premium from our escrow account, back in XX/XX/XXXX ; however I was able to catch this issue, contact the insurance company, and request a refund for the second homeowners insurance premium. F.C.M. stated that even though the mortgage was sold ( inXX/XX/XXXX ) before the first payment was made, the first payment needed to go to them. My concerns was that this initial payment would not get reflected on the loan balance, escrow, or interest, etc. The first payment was due XX/XX/2019. We discussed this with F.C.M. further and they stated that credit will be made and that we would receive a 1098 form, at the end of the year ... Not sure how F.M.C would credit or make any payment adjustments without having the loan, but we went along with it, because these transactions are traceable ... F.M.C. insisted that when the loan was sold, that they made concessions for the first ( XX/XX/XXXX) payment ... We did not see this credit based on loan balance that was reported by the new loan service-er, XXXX XXXX, provide an escrow report, showing P.M.I. fees accessed from our escrow balance, funded and established from our closing fees, for the first payment, for the month of XX/XX/XXXX. We made the XX/XX/XXXX payment to F.C.M., however XXXX. accessed P.M.I. fees for XX/XX/2019, further depleting the escrow balance. XXXX XXXX first payment was not due, until XX/XX/2019. Why would XXXX. be requesting P.M.I. fees for a month that they did not service the loan? The first payment due was given to F.M.C. because XXXX. first payment, was not due until XX/XX/XXXX. XXXX XXXX escrow report does not show an adjustment regarding a payment received for the month of XX/XX/XXXX, however XXXX. accessed and deducted a P.M.I. fee from our escrow balance for XX/XX/XXXX anyway. XXXX XXXX escrow report also shows a balance adjustment ( reported on XX/XX/XXXX ) reducing our escrow balance to {$310.00}, but no data showing where the funds went ... After speaking to a XXXX. agent, the notes stated that F.C.M. contacted XXXX. to release funds to pay XX/XX/XXXX taxes, in the amount of {$900.00}. The difficult part is, the home was new construction and was not built until XX/XX/XXXX, and we did not purchase the home until XX/XX/2019. We did not owe any XX/XX/XXXXtaxes ... After talking to F.C.M, F.C.M. is stating ( in writing ) that too much money was released to XXXX. to fund escrow, and the refund was not forXX/XX/XXXX taxes. F.M.C. is stating that the refund request was for an over-payment made during loan transferring, while establishing escrow. This is not what they told XXXX. to get the funds or payment. If F.C.M. requested these funds, post title/closing, why? If taxes were due, the title company, would have addressed it ... We are not responsible for XX/XX/XXXX Taxes and do not understand why XXXX. released the funds to F.C.M. without any question or concern for XX/XX/XXXX taxes. We do not understand why, XXXX, did not protect our escrow funds and paid a second homeowners insurance policy, then released additional fees back to the original loan service-er, F.M.C. We need our first payment credited to our loan ( principal, interest and escrow ), and we also need our {$900.00} refunded back to our escrow account, as well. Please help correct this oversight. I received notification on XX/XX/XXXX from an XXXX XXXX stating I represent Advisa Mortgage Services , Ltd. regarding the Loan issued to you for the Property. Advisa recently learned that prior to closing and despite affirmatively acknowledging the information provided in the loan application as true, accurate, and complete, you failed to disclose a pre-existing debt with XXXX XXXX XXXX XXXX. Specifically, XXXX XXXX XXXX is listed as one of the Borrowers on the XXXX Deed of Trust recorded on XX/XX/XXXX under Document No. XXXX in the XXXX XXXX, Texas Real Property Records. A courtesy copy is attached here as Exhibit A. As a result of this misrepresentation, Fannie Mae has demanded that the loan servicer repurchase the Loan, who in turn has demanded that Advisa repurchase the Loan from the servicer. Advisa must repurchase the Loan by XX/XX/XXXX unless documentation satisfactory to rectify the issue is provided to XXXX XXXX no later than XX/XX/XXXX. By this letter, Advisa demands that you send a written explanation and all necessary documentation for use in responding to the allegations of an undisclosed loan and your purported misrepresentation to me via email to XXXX no later than Friday, XX/XX/XXXX at XXXX XXXX XXXX. Anything you provide to me will be submitted to XXXX XXXX XXXX XXXX not Advisa or the Loan servicer determines in its sole discretion what constitutes satisfactory documentation. If Advisa is required to repurchase the Loan, Advisa intends to pursue all available remedies for default provided by law, in equity, or under the Note,1 Deed of Trust,2 and/or any other loan documents. I requested XXXX send me the demand from Fannie Mae however I did not receive anything. My concern is When I initially applied for the mortgage on XXXXXXXX XXXX XXXXXXXX XXXX I had 1 mortgage which was XXXX XXXX XXXX XXXX which was currently on the market for sale. XXXX XXXX XXXX ( XXXX XXXX ) debt was not listed on my application as at that time I had no intention of another mortgage loan. In XXXX I advised Advisa Mortgage of the intentions on co-signing the loan for my sons home. I assume before closing on my property at XXXX XXXX XXXX XXXX a new credit report was pulled which wouldve provided the same information about XXXX XXXX. I was verbally asked about the credit pull and I advised Advisa I was co-signing on my sons home. I was also asked about a check that cleared my account and I advised Advisa mortgage that it was a down payment for my sons home. To my knowledge I provided all correct information to Advisa. Also based on my calculations with the added debt I still qualify with no issues. Im a little concerned that I brought up this mortgage almost a year ago and its just now being questioned. Please advise if I need to seek legal counsel as I was more that forthcoming with Advisa Mortgage about the XXXX co-signing, deposit etc. I assumed they had done their duty and pulled new credit and updated the loan documents accordingly Now Im receiving and email and given less than 48 hours to reply with no documentation backing up their claim. Also its not my fault the mortgage company didnt do what they were supposed to and disclose the information to the underwriter after I told them what was going on. I did nothing wrong the mortgage company is at fault for not disclosing the information and now they want to come after me

- Loan origination in XX/XX/XXXX through XX/XX/XXXX with First Continental Mortgage Company - Principal and Interest payment - {$1600.00}. - Filed for loan modification, trial period XX/XX/XXXX through XX/XX/XXXX - principal, interest, taxes, hazard insurance - {$2000.00}. Paid trial payments and was subsequently approved for loan modification with new payment of {$2100.00} with the terms changed from 30 years to 40 years. All property taxes for XXXX paid. - XX/XX/XXXX through XX/XX/XXXX - approved loan modification payments at {$2100.00} for principal, interest, property taxes, and hazard insurance. Made timely payments. - XX/XX/XXXX - received a letter that property taxes increased, which in fact, property taxes did NOT increase. County and school tax records will show my property taxes at almost XXXX since the house was purchased. First continental mortgage ignored my information and insisted on increase. First continental mortgage increased mortgage payments to {$2700.00} and refunded escrow of {$4400.00}. Inquired about the refund, they stated all property taxes were paid and this was the overage and per law they couldn't keep that amount in the escrow account. Said I could put it back and ask for another escrow analysis to try and reduce payment. Decided to use money to help assist with monthly payments. - XX/XX/XXXX - Received a notification from MUD tax department that my property taxes of {$4200.00} were delinquent. Logged into account and see that a total of $ XXXX was paid to property taxes, indicating that all taxes were paid. Reached out to First Continental Mortgage informed them of the delinquent notice, expressed to them that I should not have to be penalized for a mistake they made. They paid the delinquent tax bill from my escrow account as opposed to taking accountability for error and their company absorbing the cost - XX/XX/XXXX - Received an escrow analysis stating my payments starting XX/XX/XXXX would be {$3500.00}. It is unethical for a loan company to increase mortgage payments in this manner for someone experiencing and constantly expressing financial hardship. The increases have created challenges and constraints of me meeting other financial obligations and has severely impacted my long history of outstanding credit. Going from {$2100.00} to {$3500.00} in a span of two years on one income, XXXX children, and other financial responsibilities does not reflect First Continental Mortgage responding ethically to my financial hardship. The loan modification from 30 to 40 years and paying twice as much from the origination of the loan is more than highway robbery, and should be more than unethical, it should be illegal. With or without the {$4400.00} refund they mistakenly gave me, this is detestable and threatens the ability for me and my children to have a home.

As of XX/XX/XXXX l have requested a relief on my VA Loan and mortgage payments and have filled application correctly and provided all documents, requested by lender for VA Loan Modification. In which in Texas Laws has a non disclosure ammendment in not disclosing your private information. It has been 90 days and there is no amicably remedy or resolutions in making my VA mortgage more affordable. In which lender knows that l am XXXX and Retired, Divorced and live alone in my home and have XXXX Lifetime income pension, without Federal Taxes been deducted until VA Loan modification is ammended. Once, VA Loan Modification is ammended, than XXXX XXXX XXXX will start deducting {$600.00} to pay Federal taxes. I owed {$9000.00} in back taxes from XXXX, because of the high mortgage payment and lender VA loan process didnt disclose on Federal taxes not bern deducted during VA home purchase on XX/XX/XXXX. I have told prior lender XXXX XXXX of XXXX, Texas and First Continental Mortgage that l can not afford the VA mortgage of around {$1700.00} or {$1800.00} @ month. But lenders refuse to take matters into account before selling home on XX/XX/XXXX l sign documents because lenders stating that my VA mortgage will be lowered. On XX/XX/XXXX l discovered Frauds on VA Loan and Escrow and filed various Federal complaints that Lender opted to pay my VA mortgage from XX/XX/XXXX till XX/XX/XXXX. First Continental Mortgage stated they supported me to give me financial hardship relief. Why didnt Lender modified my VA loan in XX/XX/XXXX and made it more affordable? Than on XX/XX/XXXX, lender modified loan but is was still to high for me at {$1900.00} or {$1.00} XXXX. I sign documents on XX/XX/XXXX because l was going through a foreclosure status as l am going through a Foreclosure status on XX/XX/XXXX. Why lender investors wouldnt approve VA Loan modification and lower VA mortgage payments? Maybe, because investors and lenders are tired of me alerting the Federal Government in reminding Federal Government of the VA Loan Frauds and Escrow Frauds. I am going through XXXX XXXX XXXX XXXX and stress and fears in losing my home in been homeless on the streets of XXXX, Texas. My family in XXXX, XXXX has a major issues with Hurricane Irma and devastation and possible lives with be lost because of the Hurricanes. On or about XX/XX/2020, a representative from XXXX XXXX contacted me by phone and said they were following up with me on a request I made to my mortgage company to lower my monthly payments and assist with the loan modification I had requested with my mortgage company First Continental Mortgage on or about XXXX or XX/XX/2020. They said they could help me lower my interest payments and monthly mortgage payments. I sent them all the financial items listed in their email and formally requested assistance with loan modification or refinancing. They stated that I had to pay 3 consecutive payments of {$22000.00} per month using 3 separated post dated checks. I wrote them 3 checks for XXXX, XXXX, and XX/XX/2020. In XXXX I was contacted by First Continental Mortgage stating I had not made any payments and my escrow was now behind. I sent them proof of the 3 payments and my bank statements to show what and when I had made the 3 payments. First Continental stated they never received them and I now owe {$1700.00} in escrow due immediately. I paid the {$1700.00} the next day to cover my escrow. First Continental confirmed they received that payment. I told them about XXXX XXXX and they suspected fraud. I began making payments to First Continental again in the amount of {$2800.00} payable by cashiers check, I made 5 payments totaling {$14000.00} to First Continental. I also requested a forbearance or loan modification with First Continental on our about XX/XX/2020. I submitted all the financial documents and now they wanted payments of {$2900.00} mo. I said wait, I can't afford the payments I have now and I've asked for a loan modification to lower my payments, why are the payments increasing? Then I received a letter returning XXXX of my cashier 's checks that I sent to First Contenintal Mortgage. They are no longer accepting any payments from me and I can't get anyone to respond to emails or phone messages. When you call each call lasts a minimum of 45 minutes and then it disconnects. No response. I am the sole XXXX of my XXXX year old elderly mother and I help my son take care of my XXXX year old grand daughter. This is our only home and I'm scared we are going to be foreclosed on due to fraud or foul play. All we are asking is for assistance to refinance the mortgage to lower the payments to a total {$2000.00} including escrow.

As of XXXX XXXX I received a statement from XXXX XXXX Mortgage to pay for VA XXXX XXXX charges and fees of {$7500.00} as I have been waiting for VA XXXX underwriters approvals for my VA XXXX XXXX since XXXX XXXX till Present. I can not pay {$7500.00} for VA Mortgage or VA XXXX modification Fees and property Inspections charges and fees. Why is XXXX XXXX Mortgage investors Underwriters stalling to approve and make my VA Mortgage affordable under {$7000.00} - {$1800.00} a month.? It appears that XXXX XXXX Mortgage is continuing to Retaliate and Discriminate me as a Cuban-American XXXX Military Veteran.and Plus my XXXX Lifetime status. I am waiting for the new VA affordable Mortgage payment so I can start making my timely payments starting XXXX XXXX. Also in due of respect to First XXXX Mortgage I have told lender administration in writing and verbally phone conversations that I do n't have no Attorney representing me of XXXX, Texas Attorney XXXX XXXX. I attempted to purchase a home through XXXX back in XX/XX/XXXX. The Home I tried to purchase was XXXX XXXX XXXX in XXXX , TX , XXXX. The contract was written up and never thoroughly discussed with me, even when I asked specifics from the builder rep XXXX XXXX. I asked if the earnest money I placed with him would be retained for any reason. My response from XXXX XXXX was " XXXX does not keep earnest money ''. I went ahead and went through the partnering lender XXXX has, called Advisa Mortgage. The lender XXXX XXXX started to harass me by calling at inappropriate times at night. Due to this I complained and spoke with the lenders manager, XXXX XXXX. This resolved nothing but instead created more inconsistency between the home builder XXXX and I. I received an email from XXXX XXXX, XX/XX/XXXX stating " ..a DocuSign package from XXXX XXXX , this will have several documents that are required to process you loan. Currently your rate is not locked, we need you verbal or written communication regarding which option you want to move forward with. '' I did not agree to options given to me by Advisa Mortgage.I then received the DocuSign packages from XXXX XXXX on XX/XX/XXXX & the same one XX/XX/XXXX. The XXXX XXXX documents I did not sign due to wanting to discuss contracts and options in person with lenders.This was impossible with Advisa Mortgage. Advisa Mortgage company even wrote in an email to the home builder and myself on XX/XX/XXXX and said " Just keeping everyone in the loop, we are on track to close XX/XX/XXXX per the XXXX closing report '' .Communication with Advisa was completely unethical, the manager XXXX XXXX had approved a loan I did not agree to on XX/XX/XXXX. This created a " Default '' for me with XXXX home builder. XXXX sales rep XXXX XXXX failed to return any of my calls and did not reply until XX/XX/XXXX via email stating " XXXX XXXX is cancelling your contract and retaining your earnest money due to non-performance and default of contract ''. No specific action was explained to me as to why I defaulted. I still have no resolution for the evident inconsistency by XXXX and Advisa. I have attempted to communicate with both builder and Advisa Mortgage Services to come up with a solution to our differences.

Around of XX/XX/XXXX.-XX/XX/XXXX I applied for VA Loan modification and during the process I filed a Bankruptcy Chapter XXXX on XX/XX/XXXX. VA Lenders First Continental and XXXX XXXX and approve loan modification in which mortgage was still not affordable. But I signed documents because of my fear losing my home. On XX/XX/XXXX, I also requested for VA Loan modification as mortgage is not affordable and VA Lender had me fill three of four applications for XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. On XX/XX/XXXX I was denied on VA Loan modification and during application VA Loan modification process Va lenders pull my credit about five times and my credit scores has dropped to around 580. On XX/XX/XXXX VA Lenders pulled my credit with XXXX, XXXX and XXXX for another VA Loan modification.Why pull my credit if modification is going to be denied again around XX/XX/XXXX And my home been foreclosed on XX/XX/XXXX. I filled all new VA Loan modification application and provide all information requested. There is a fraud, scandal and corruptions on my VA Loan with XXXX XXXX of XXXX, Texas and XXXX XXXX XXXX of Texas. XXXX XXXX sold my VA Loan to First Continental and XXXX in XX/XX/XXXX. Also VA Home purchase and appraisal was inflated to sell my new construction home on XX/XX/XXXX for {$240000.00}. No homes was sold for $ XXXX before XX/XX/XXXX.After XXXX XXXX made their profit of $ XXXX than after XX/XX/XXXX some homes was sold around $ 240k, etc. I provide evidence to Federal Government on XXXX, Texas comps sales of XX/XX/XXXX a home that was much bigger than mine sold for $ XXXX. My husband and I put an offer on a new construction home by XXXX. They have an affiliate lender Advisa Mortgage. I did a pre-qualification on their website while I was rate shopping to find out what their interest rate was. When we decided that they had the favorable loan term I did a joint loan application that included my husband 's information. Advisa Mortgage had sent loan document for me to sign based on the pre-qualification I had done. I initially refused to sign the documents because the application information on there was preliminary and not a complete picture of my debt situation. The Loan officer however sent me an email stating that by signing the documents I was not agreeing to what was on there I was just acknowledging that I got the documents and he needed it signed to unlock the loan record. So I signed. After he looked at our joint application he decided that our debt to income was too high for us to be able afford the house and to be approved. We told him that if that is the case then we do n't want the loan. We proceeded to tell the seller that our debt to income was too high and we ca n't get approved for the loan. Advisa proceeded to tell the seller that because most of the debts were in my husband 's name they can approve the loan if they take my husband off the loan and do the loan just in my name.they can approve it that way. The seller then stated that we would forfeit our earnest money if we do not get the loan that is just in my name as was being offered by Advisa. We feel like this is predatory lending on Advisa 's part because they clearly know that there is these debts that are in my husband 's name that I am still responsible for but they are forcing us to remove my husband from the loan as a way to hide my debts and approve a loan so they can get commission from the loan as well as collude with the seller.

I put my home for sale with a XXXX XXXX Real Estate Agent on XX/XX/XXXX and reduced the sale price from {$340000.00}, {$280000.00} and {$270000.00} because the sluggish sales market and Real Estate home sales downgrading to 12 percent in the areas of XXXX XXXX. I have attempted for over 1 year to get my escrow account removed since First Continental Mortgage 100 % completely messed up my escrow account since they did not properly do an assessment in early XXXX.
