Complaint against First Colony Mortgage Dear Consumer Financial Protection Bureau, I am writing to file a formal complaint against First Colony Mortgage regarding my mortgage adjustment. I believe that the actions of this company have violated my rights as a consumer and require your attention and intervention. Below are the details of the complaint : For the past two years, starting in XXXX, I've been going through a tough time due to XXXX. Ending this hardship has been a nightmare from the beginning. I have clearly met their requirements for the hardship since they granted it to me. Going through XXXX and having a child with XXXX has been a huge strain on our family and the hardship relief was a huge help but getting out of it has been more than difficult. In XX/XX/XXXX, I started the application process for the flex mortgage modification. I submitted the application multiple times, and every time I followed up, they claimed that some documents were missing, even though they weren't. I kept resubmitting the same documents they said were wrong, and it took them until XXXX to finally process everything. They put me on a three-month trial for the loan modification, which ended in XXXX. I made all three payments, but because it was over a weekend and they don't have an online payment option, I had to make the last payment over the phone with a representative first thing on XX/XX/XXXX. However, they didn't process the payment until XX/XX/XXXX because they were really backed up. Shockingly, despite making all the payments, they've put my house into foreclosure. I've tried reaching out to them multiple times, but they just keep redirecting me to different people or departments who have no information to give me. I've even resubmitted the application three times through them and sent a letter of intent, which they told me about a month after I submitted the application. I sent that letter of intent via email, but the email address they provided was wrong, and my emails keep bouncing back. It's gotten to the point where I'm being bombarded with offers from buyers, and they're even contacting my family members about buying my home while it's in foreclosure. It's incredibly embarrassing, and I've done everything they asked for, but I don't feel like they're responding or willing to help me. It is very clear that First Colony Mortgage does not care about me as a customer and is not willing to help. I know they are trying to give me the constant run around so they can foreclose on my house. I have not seen any attempt from them to actually help. I kindly request that the Consumer Financial Protection Bureau investigate this matter promptly and take appropriate action to resolve this issue. I also request that you keep me informed of any progress made regarding my complaint. Thank you for your attention to this matter. I trust that the Consumer Financial Protection Bureau will thoroughly investigate my complaint and take the necessary steps to ensure a fair resolution. Sincerely,

In XXXX of XXXX we were approved for a 3 month COVID Forbearance from our mortgage company. The forbearance granted suspended monthly payments from XX/XX/XXXX through XX/XX/XXXX. We used 2 months of the forbearance and resumed our normal mortgage payments 1 month early on XX/XX/XXXX of XXXX. Somehow we have ended up with late payments, missed payments, and most disturbing, negative marks on our credit report. I called our mortgage company at the end of XXXX XXXX and reported that my husband was working again and we would like to end the forbearance early and have the 2 suspended payments deferred to the end of the loan. We were told to make the XXXX payment and then call back once the payment was made to start the deferment process, we did just that. On XX/XX/XXXX we initiated the deferment process via phone call with the lender. We were told that we would receive the deferment. On XXXX we received a letter from the lender that we were approved for a payment deferral and as of XXXX our mortgage would be brought current. On XXXX we received a voice mail from the lender stating that we were behind in our payments. I called the next day and after being transferred to 3 different departments, learned that they did not have record of our deferment. I have two different letters from the lender that state " You are approved for a payment deferral ''. I was told that they had to send it to some one via email and I would be contacted in 3 to 5 days. It is my understanding that under the Cares ACT that it is illegal to report a negative report to the credit agencies. The paperwork that I received from my lender states " The status of the account at the start of the forbearance will be preserved throughout the forbearance period. If your account was current at the time the forbearance began, we will continue to report your account as current throughout the forbearance period ''. My credit report shows late and missing mortgage payments since XXXX XXXX. This has negatively impacted my credit score.

I built my home with XXXX XXXX. In Utah, the owners policy is paid for by the seller. When doing a new build, standard practice is that as long as you use the same title company as the builder, they will pay for the owners policy. In my contract I signed, it stated that if I don't use their title company AND their lender, than they will make me pay for the owners policy ( which is a seller 's closing costs in Utah ). I understand having builder incentives for using their lender, but in this case they are actually charging me more to be able to select my own lender. This doesn't make me feel free to choose who I want to work with for my financing. Essentially they are charging me {$970.00} more in closing costs if I don't use who they want me to use. How is the fair lending? My loan officer, XXXX XXXX with XXXX XXXX, called and spoke to the owner of XXXX XXXX ( XXXX XXXX ) on XX/XX/2018, to see if he could waive this in the contract and he disclosed to her that his preferred lender ( XXXX XXXX - First colony Mortgage ) pays him for the owners policy if he sends his customers to him. This really frustrates me because I am told that the lender can't give anything of monetary value for referrals and yet this is what they are doing and I am paying the price for this.

I put an investment property under contract w/XXXX XXXX, in XXXX Utah, on XX/XX/2019. Even though I was pre qualified through a lender, XXXX XXXX has it in their contract that I have to be pre qualified through their " preferred lender '' First Colony Mortgage. So, I submitted my financials to them. XXXX XXXX, First Colony Representative, quoted me rates/fees, then said oh we can't do that for this property. Then she " locked '' me into rates/fees. Going through initial disclosure, I noticed that she had it listed as owner occupied, & not investment. So, I pointed out that to her. She said she can't do those rates/fees & offered me other rates/fees. I brought this up with XXXX XXXX, XXXX XXXX, VP of Sales & they backed XXXX. But they offered to let me out of the contract, so I took them up on their offer. When my REALTOR submitted the paperwork to get my earnst money back, they sent a no fault non-disclosure agreement they want me to sign before giving me my earnst money back. I refused to sign it.

Several times during this transaction this lender asked me if I would be legally using my property. Although I informed him I would live in my property as my primary residence. He kept asking over and over again. He threw out comments like : " The lender will drop by unannounced to check if you live there in the year after you close. '' Etc. etc. He advised I could use XXXX XXXX XXXX as a down payment and then altered what he said and even required me to update my commission used as a down payment in addendum in order to move the transaction forward. I believe he was discriminating again me based upon my race and a bias he had against me from the beginning of the transaction. He refused to order the appraisal until I updated my commission percentage received. He then-without my permission over two weeks later ordered the appraisal on rush and tried to push the fee to me without even confirming I wanted it ordered-stripping me of the negotiation power with the seller.

I have second hand knowledge of this. This conversation came from someone at the top of XXXX XXXX. Please. This is confidential information but I have been made aware of fraudulent activity between XXXX and their preferred lender, First Colony Mortgage to incentivize home sales since the market has shifted. XXXX has contributed a substantial amount of money to First Colony to allow a rate buy down. They are essentially double dipping and exceeding industry tolerances for an interested party in order to sell more homes I work in the mortgage industry and am close to the source on this so I cant be involved.

On XX/XX/2021 I received an alert through XXXX that a hard copy Mortgage inquiry from First Colony Mortgage. I first called XXXX XXXX that confirmed the inquires, they said it was showing on all 3 of my Credit Reports. I then called First Colony Mortgage ( XXXX ) and was told they didn't show any inquiry pulled. I tried unsuccessfully to put a freeze on my XXXX & XXXX accounts. I called The Consumer Financial Protection Bureau & they told me to contact you to place a complaint against First Colony Mortgage to get this hard inquiry that I didn't initiate removed!

The person is accounted for paying the XXXX from SSI and Welfare and the Direct Deposit Abduction Law is not neglected.
