I called First Choice Loan Services and asked for a forbearance at the onset of the shutdown and corvid-19 episode. I stated that we thought we were fine financially, but as we didn't know what was going to happen, we wanted to do the forbearance as a precaution as we were looking at the long term implications of the crisis. That was late XXXX or early XXXX. I was told at that time that they would give us a forbearance for 3 months and that we didn't need to fill out an application. After not hearing from the company into mid XXXX, I called again. I was asked for our application number and I said I was told we didn't need to do an application, but I was happy to do one now. I was told I didn't need an application and I would be contacted as our forbearance was going through and we would receive a letter with details. At the beginning of XXXX we received the Approved Forbearance Agreement. That agreement stated what First Choice Forbearance was based on these facts under the heading of " Factual Information and Recitals ''. 1. Lender has made a loan to Mortgagor ( s ) that is in imminent danger of becoming delinquent on XX/XX/2020. That is untrue. We never made any indication that being delinquent on our loan was a problem. 2. This was the amount of the loan that I won't list here. 3. Mortgagor ( s ) are in imminent danger of not making the monthly payment due XX/XX/2020 and all subsequent amounts due thereafter. That is untrue. We never made any statements to the effect that we could not make the payments and that we wouldn't be able to make the payments in the future. 4. The parties hereto desire to enter into an agreement, which after the plan expires, the Mortgagor ( s ) will need to either : 1 ) bring the loan current, 2 ) work with the lender to obtain another workout plan, or 3 ) Pay the loan in full. Options 1 states you have to then pay 3 months of payments at once. That is a financial trap. Where I can not state First Choices intent, it can easily be construed as an attempt purposefully to put us in a position of financial hardship at the end of the 3 months. Option 3 Pay off the loan in full. This is not a real option and First Mortgage knows that. We will dismiss it. Option 2 Work with the lender to obtain another workout plan. This is so vague as to be useless. It puts the Mortgagor in the position to have to work out a deal that has no safeguards or leverage for the mortgagor if that mortgagor can't meet options 1 & 3. This is financial entrapment. First Choice can now force the Mortgagor to agree to any conditions they choose. A verbal agreement was made to do a good faith forbearance on our mortgage for 3 months, in order to help the mortgagors, in case the financial crisis being created by the government in response to covid-19 became a future problem for us. We stated we did not currently have a problem and were just trying to be proactive and we were told they " understood and it wasn't a problem ''. On the cover letter that accompanied the Approved Forbearance Agreement, is written : This forbearance plan offer was based on an evaluation of an incomplete loss mitigation application. Other loss mitigation options may be available and, regardless of whether you accept the enclosed forbearance offer, you have the option to submit a complete loss mitigation application and receive an evaluation for all loss mitigation options that may be available to you. I called First Choice today, XX/XX/XXXX, to fill out an application and was told I could not. I asked how to resolve this as we can not sign an agreement that has fraudulent information in it and is against our best financial interests. I was told that I could speak to another person. I missed the name of that person. I was transferred to that person and then put on hold and they never picked up. I was denied the ability to file an application 3 times. The Factual information on the document sent to us was false. The verbal agreement was broken. The agreement purposed was, in my opinion, a blatant attempt at financial entrapment in order to put us at financial risk when the opposite was promised. I will attach documents. We are current on our mortgage including the XXXX payment.

I wish to raise an official complaints in respect to these Corporation : First Choice Loan Services Inc. Corporation, XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX. 1.Notes in loan file suggest borrower pushed for a quick closing when in fact First Choice Loan Services Inc . Corporation Lender XXXX XXXX XXXX and Realtor XXXX XXXX XXXX rush my husband XXXX XXXX through the application and loan process. 2.Property has been transferred and sold within less than 90 days of the purchase date XX/XX/2014 Original Loan from First Choice Loan Services Corporation sold the loan without notice to us and without letting us know where our first payment went that was not applied to the mortgage to XXXX XXXX XXXX XXXX resold to XXXX XXXX XXXX XXXX . 3. The Property was advertised as is condition to purchase but yet Lender forced my husband XXXX XXXX after the purchase was finalized that he cant make repairs or move into the Property and he is liable for the mortgage even if he has n't move in. Lender forced my husband to apply for a XXXX loan on top of the Property loan in which he was approve quickly. 4. The value of the Property has notably increased with no improvements or improvement are not insufficient to justify the increase. The XXXX loan did only partial of improvement thereto the Property and my husband XXXX XXXX add-on his own improvement but not to justify an increase. My husband was never told by the Realtor or the Lender that the Property was worth less then the asking price XXXX and was sold to him for less than the asking price of {$110000.00} but more than the value of the Property. 5. Seller is an entity/ Corporation My husband XXXX XXXX XXXX told that the Property owner die 2 years ago and the Property was bank own when in fact the owner of the Property was a corporation rushing to sell because the seller purchase the Property for only {$1100.00} and had the Property for 2 months and did n't do repairs on the Property. XXXX. Basement : Never was told that the Property had an existence open tube sticking out the basement wall that it was a condemn water well. Realtor XXXX XXXX XXXX advised my husband XXXX XXXX to initial all inspection except the XXXX inspection. 7. Structural Problems : Never was told about any structural damages or problems in where the cracks of the outside to the inside were coming from or of any addition, remodeling, structural changes. To make it this letter short my husband die XXXX and when he purchase this Property the Realtor did n't give him details about the Property or the possibilities of XXXX ... Even the mortgage made lots of errors in the mortgage statement and we always had wonder where did our first mortgage payment go to. And First Choice Loan Services Inc. Corporation had set there own personal hazard homeowner insurance with Farmers Hazard Homeowner 's Insurance XXXX XXXX XXXX that was paid up at settlement then sent us a bill after we paid the bill he cancel after 2 month keeping the money and not providing us with coverage breaking the agreement. Thereafter come to found out that after my husband XXXX XXXX pass away I his wife come to find out that Farmers Hazard Homeowner 's Insurance was getting paid all long by XXXX XXXX XXXX XXXX without us knowing about it after they did n't fill their agreement to give us coverage for the year and with no declaration forms.

Hello- I'd like to submit a formal complaint against XXXX XXXX XXXX and against First Choice Loan Services/ XXXX XXXX ( mortgage broker ). We closed on our house in XX/XX/XXXX, and the mortgage broker quoted our total payment including escrow impounds of like $ XXXX-ish. In XX/XX/XXXX, our escrow analysis jumped up a little to $ XXXX/ month. But then, in XX/XX/XXXX it jumped up almost $ XXXX/ month because according to XXXX we were short {$4900.00} in back property taxes, which put us in a financial bind with XXXX little kids in day care ( now XXXX because we just had another baby in XXXX, praise God! : ) We called XXXX and XXXX ( he never returned my call ) and XXXX helped us finance the deficiency over 24 months so that brought our payment down to {$2200.00} ish from {$2500.00} ( where it was going ), which is where it is now almost $ XXXX/month more that what we were paying. I understand that taxes and insurance are imperative, but I'd like to log a formal complaint against both XXXX and First Choice that they should have caught this at the onset of the mortgage when we closed in XX/XX/XXXX versus almost 2 years later in XX/XX/XXXX. I'd like to request that they investigate to see what went wrong and I'd like some sort of compensation to help pay off this crazy deficiency to bring this payment back down to normalcy, or at least to where it should be, which should be around $ XXXX/ month. Please see my attachments and please be sure to let these entities know that they need to do a better job with their internal audits with analyzing their consumers ' escrow analysis. XXXX seemed to be a veteran in the mortgage business as our mortgage broker, and I speculate that he may have artificially deflated the final payment number on the Closing Disclosure in order to entice us to be wowed by his " prowess '' and not to shop with anyone else. Don't get me wrong, he's a good guy- God bless him, but he seemed to know way too much about the mortgage business to make such an egregious, rookie blunder. Hence, my theory is that he intentionally misled us. And as far as XXXX is concerned, MERS audits XXXX XXXX and they should be audited about why they didn't catch this at the onset of the mortgage let alone during the first escrow analysis in XX/XX/XXXX. I'd like some justice and compensation for this matter as it has created a financial conundrum for my family 's budget especially now since we have XXXX kiddos in day care, which costs around $ XXXX/ month. We received the final closing disclosure from the lender prior to close stating we would need {$3200.00} to close. The day the notary showed up he had a paper saying we 'd need {$3900.00} to close. I showed him our disclosure and he said that ours must be right and they must have made a mistake on his end and accepted our certified check for the lower amount. Today ( the following week ) the lender called and said we could n't close on the loan because we were short {$680.00}, having only provided a check for the lower amount, and we 'd need to drive XXXX miles to the title company with the extra funds today to prevent the loan from falling through. I feel it is deceptive for this " bait and switch '' demanding nearly {$700.00} extra at the last second in clear discrepancy with the closing disclosure we were provided.

Please see attached documentation. My complaint is for First Choice Loan Services and all 3 Credit Agencies. I have been trying to resolve a known issue with incorrect " Past Due/Payment History '' that First Choice Loan Services for XXXX XXXX XXXX. First Choice agreed that the Past Due/Payment History is wrong, and that they would correct it by sending corrections to all 3 Credit Agencies. Since XX/XX/2020, I have documented repeated attempts to get my credit history corrected. It is XX/XX/2020, and still do not have my Credit Reports corrected. BEWARE of First Choice Loan Services.

I am in the process of obtaining a renovation loan with First Choice Loan Services Inc. I have paid for my appraisal and provided all of my financial documents for closing. They are now requiring me to pay {$490.00} for a Feasibility Study, this cost was not disclosed in my Settlement Statement I was told that it is an FDIC requirement, I told my loan officer that it was not in the settlement statement. But paid it anyways to not hold up the process.
