I purchased a home in XX/XX/XXXX in XXXX, California, using an FHA mortgage, FirstCal as the lender, and XXXX XXXX as the appraiser.

InXX/XX/XXXX, I was applying for a refi to simply shift to a conventional mortgage while rates were still low so I could lower my PMI. At the time of purchase, I did n't understand that the PMI on the FHA loan was for the life of the loan. I wanted a conventional loan prior to predicted increases in interest rates. During the process, I was notified by various banks ( XXXX, XXXX, and XXXX ) that the original appraisal appeared fraudulent and the lender backing of such an appraisal should have created red flags and concerns during the appraisal review.

My home is a half-plex two bedroom/two bath home. The XXXX noted 2-3 bedroom ; however, it is clearly two bedroom - there is no den, but there is basically an enclosed porch surrounded by windows with no closet and a tile floor - not a bedroom. The original inspection noted 3 bedroom and only 3 bed comparables were used in the appraisal - no two bedroom equivalents. In addition, the original appraisal noted the square footage at 1538 sq ft whereas the actual square footage is 1495 sq ft, this difference at the cost per sq ft equals approximately a {$13000.00} increase in value compared to the correct square footage of 1495. The most recent refi attempt was halted due to it accurately being appraised as a two bedroom with 1495 sq ft and thus a lower value. XXXX County Accessor documents reveal a floor plan with 2 bedrooms and an addition of a 'sewing room ' ( built in XX/XX/XXXX ). The VP at FirstCal has verbally acknowledged to my father that it appears to be a 2 bedroom, but also noted that they have no responsibility as I am not a current client ( they sold my loan ) and that the appraisal matches tax records ( bedrooms - yes, square footage - no ). They did not review the provided material during the first loan process and at this time refuse to aid in resolution other than offering to refi at a higher than market interest rate.

I 've attempted to work with FirstCal and XXXX XXXX. On XX/XX/XXXX the FirstCal compliance ( XXXX XXXX ) office noted in a letter that they would issue a ruling within 30 days. During those 30 days, I 've talked to a VP ( XXXX XXXX ) and the President ( XXXX XXXX ) of FirstCal. I 've never received a formal response as promised. Their approach was to refi the home at a higher than market interest rate and the VP assured me that the home would appraise as a 3 bed. This response also seemed fraudulent in nature as he is making assurances without seeing the property and after verbally acknowledging that the floor plan clearly shows a 2-bed home. The floor plans that they have seen from the county accesor clearly show 2-bed with an addition built 16 years ago that is classified a 'sewing room '.

I lost my home purchase due to lender completely ignoring my loan. My loan went into underwriting on XX/XX/XXXX and was suspended due to my XX/XX/XXXX income was lower. Underwriter asked for a letter of explanation regarding my income. Underwriter got to my file again on XX/XX/XXXX. According to her since my income dropped over XXXX % I need to meet an extenuating circumstances, which according to her HUD did n't see XXXX leave as an extenuating circumstances. So, she moved my file to her manager pending on denial. Once I new she was not taking the letter, I called HUD and per Hud they see maternity leave as hospitalization. Now this happened in XX/XX/XXXX, I 'm applying for a loan in XX/XX/XXXX. I have not filed XX/XX/XXXX yet because I wait till XX/XX/XXXX. So after calling, emailing from XX/XX/XXXX, the Broker was able to talk to the underwriter manager XX/XX/XXXX, turns out underwriter never put my file in her managers pipeline and she was able to review it briefly and said I never needed an extenuating circumstances and she should just do a manual underwrite. Send the file back to the original underwriter. At this point they new I had a notice to perform and only had 2 days. This was a Friday. Not even because she dropped the ball and never put in the managers pipeline and and never need e to meet an extenuating circumstances she bother to rush my loan. Monday came and nothing, no emails no calls no status at all, as if I never existed. Seller cancelled on Tuesday and I finally request for a loan cancelation. I tried multiple times to explain the maternity leave was the reason why my income dropped and she should not suspend my loan for that. Till this day I never heard back from anyone around FirstCal wholesale, I 'm not sure why they decided to ignore my loan without any explanation after manager had agreed the the letter of explanation may sense and she should conditioned accordingly. I 'm not sure how to take this, I ca n't help but take this personal I 'm not sure if I should be looking at this as discrimination. All I know is that I lost the home, I lost some money I the process, my kids are broken hearted. It 's tuff getting an offer accept now a days with a low inventory and prices rising up. I would like someone to look into this, because it feels awful that no one bother to prioritize my loan, as if my loan did n't matte ; so I can meet my the deadlines in my contract. I can tell you that this for sure was not a fair lending at all, it was extremely XXXX a day frustrating.

I feel that I was a victim of discrimination. Around XXXX/XXXX/2014, I purchased a house and was financed by First California Mortgage Company ( XXXX XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX, Nevada XXXX ). My loan number is # XXXX. First reason why I feel I was discriminated, I feel because we are XXXX, First California Mortgage Company allowed its brokers to charge us higher fees for mortgage loans. Second reason is that I had clearly stated I was giving 15 % of down payment to avoid paying a PMI ( Private Mortgage Insurance ) when I signed the closing documents, they had put 10 % down payment. I called to tell I wanted to give 15 % down and I was convinced by the broker to leave it at 10 % telling me that my PMI would only be {$49.00} a month. I would like to ask if can start an investigation to see if other XXXX or XXXX customers were discriminated by First California Mortgage Company? This company should have recorded conversation when I called the agent to argue the amount of Down Payment. I think First California Mortgage Company only wanted to charge me the PMI of {$49.00} each month reason why they claimed they made the mistake of going with 10 % down and convinced me to leave it like that. I am sure there is more victims like me.

I applied for a mortgage loan with First Cal mortgage phone # XXXX was approved the escrow went through and we moved in and my first payment was due XX/XX/XXXX, ,I received a letter XX/XX/XXXX ( dated XX/XX/XXXX ) that a new servicer XXXX/XXXX XXXX will be accepting my payments so I called the provided phone numbers from each company and verified that I have to make the payment to new company with a new loan number, XX/XX/XXXX I made my first payment with a check draft out of my checking account, on XX/XX/XXXX I received a statement from First Cal demanding payment for XX/XX/XXXX and XX/XX/XXXX so I called them to verify and they said it 's probably a clerical mistake I asked them please to correct their statement and this is causing a great deal of XXXX for me and my family the lady on the phone promised it wo n't happen again,, on XX/XX/XXXX late in the afternoon I had a message left on my voice mail from First Cal collection department which I tried to call back but because of Hollidays could not get hold of no one this has turned into a nightmare, I have followed instructions from First Cal whom to make my payments to and now they are demanding payments again I need some help please.

Refinanced our home loan with First California Mortgage and they changed the terms of the loan after closing escrow. They were supposed to include XXXX supplemental property tax payments with the refi. When we were at closing the out of pocket amount to be wired was incorrect at {$1700.00}. Was told by loan officer that it was a mistake the next day and the amount that was needed to close was {$1200.00}. Figured out that the amount we ended up wiring is the amount you get when you subtract the XXXX tax payment. Was never told that the terms of the loan were changed. We did not think anything of it until I checked on line and noticed that the second tax payment was not made. I checked with the Escrow company and they were the ones that told me the loan was for only XXXX tax payment. They changed the borrower statement after we technically closed escrow. Had to scramble to make the second tax payment which caused a financial burden. Desired resolution would be to honor the original agreement and reimburse us for the second tax payment. This should be considered deceptive loan practices.

I submitted a refinance application with FirstCal bank in XXXX. I paid for the home inspection, submitted my paper work ( tax forms, XXXX, current loan statement etc ). I became suspicious of the process when they asked me for information that I had previously provided them multiple times but I really did n't know why they would try to delay the process. My wife and I have impeccable credit ( each & gt ; 760 ) and great debt to income ratio. On XX/XX/XXXX I was informed by the XXXX, the sales manager that the interest rate that I was offered ( 3.75 % ) was not going to be honored by the company. I asked him if my understanding of the loan agreement is that rate is locked in, if the rates went down I would still be locked in at 3.75 %, if the rates went up that I would get the 3.75 %. He affirmed that understanding is correct. However he said they were no longer willing to honor it. I contacted the bank 's President and CEO who says he will look into it. I am contacted by various people within the bank 's management who all agree that they will not honor the 3.75 %.
