XXXX XXXX XXXX XXXX XXXX XXXX, FL XXXX XXXX XXXX To whom it may concern, I am writing this letter to have my student loans discharged due to attending XXXX from XX/XX/XXXX to XX/XX/XXXX due to fraudulent practices to deceive. I was lied to and deceived by the staff at XXXX XXXX ; The campus I attended was the XXXX, FL campus for the XXXX program. While taking the tour of the XXXX XXXX campus I asked if the school was accredited, due to working experience of XXXX XXXX XXXX for over a decade and understanding the weight of graduating from an accredited program. Ms. XXXX XXXX the Program Director and a XXXX herself, additionally a stated consultant for an attorney firm. With the above stated credentials, she represented herself as credible resource I chose to believe the information she presented to me as truthful. Ms. XXXX stated to me that XXXX XXXX school was in the process of becoming accredited with the XXXX XXXX XXXX XXXX ( XXXX ). The process would happen very quickly and once accredited they would retro back the accreditation to previous XXXX XXXX students that graduate from their program prior to actual Accreditation. THIS TURNED OUT TO BE A PROVABLE LIE as covered in the next couple paragraphs. With this information, I began the application process to enter the school. I passed all the tests for entrance into the program. Which they removed the science portion of the entrance testing 2 weeks later due to not enough people passing the exam. I met with the Financial office and signed the appropriate forms. It was never discussed or disclosed to me about a private loan that I would have to pay after graduation or leaving XXXX. Additionally, a {$2000.00} fee was due upon graduation or leaving which was also not discussed or disclosed to me. The financial representative did state I would sign over my Pell grants to offset the additional money owed above the Federal Student loans. It was stated to me by the Financial representative working for XXXX, that the only additional funds owed would be covered by my Pell Grants. This was not the truth I have an additional personnel student loan that I am currently paying to XXXX XXXX until XXXX. Again, THIS WAS ANOTHER LIE AND DECEPTIVE PRACTICE. While attending XXXX after my second round of financing ( 9-month cycles ). Many other students in my class started to question the accreditation status. Ms. XXXX XXXX Program Director stated a representative would be coming to the school from the XXXX to do an inspection for our application process for accreditation. A person came to the school and did a fake inspection of the facility. XXXX XXXX informed us we did wonderful on the inspection and the process was almost complete for the XXXX accreditation. After spending over a year with XXXX XXXX I could sense when she was lying ( the fake inspection ) seeming to be one of those moments which caused me to call the XXXX. I called the XXXX and it was verified by the XXXX, they did not send anyone to XXXX in XXXX to XXXX, Florida for an inspection. Additionally, the XXXX wanted to know who it was that went to XXXX and fraudulently represented the XXXX. No business cards were given at the time the lady represented herself as an auditor for the XXXX. The XXXX also stated the application process could only happen after a pass average from XXXX happened on national testing XXXX boards of 85 % and then it would be a 2-year process after the passing average to possible obtain accreditation. The representative stated that the XXXX will not retro back accreditation to previous graduates. IF THEY WERE TRUTHFUL I NEVER WOULD HAVE GONE TO XXXX. Due to the information from the XXXX I felt I had no other recourse but to leave XXXX and go to an accredited XXXX school which I went to State College of XXXX. Not a single credit from XXXX transferred to XXXX due to non-accreditation of any kind, not even general education course work transferred. It caused me to repeat 2 years of education that I wasted at XXXX. With the past and current litigation proving fraud and deceptive practices on XXXX behalf. This is a letter that I sent to the companies describing what happened : First Associates Loan Servicing XXXX XXXX XXXX XXXX CEO Legal Department CEO Legal Department XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX XXXX XXXX , XXXX XXXX XXXX Department XXXX XXXX XXXX XXXX, XXXX XXXX Re : XXXX Loan To Whom It May Concern : I am writing to you concerning my XXXX XXXX which seems to be lost in transition and I am not sure who hold this loan between your XXXX companies. In XX/XX/XXXX, I received two letters from First Associates ( enclosed ) stating my loan would be transferred to XXXX. I made my XX/XX/XXXX loan payment to First Associates are required. XX/XX/XXXX I called XXXX to ask if I could make an electronic payment to the address listed on the letter and if I had a new loan number because I did not receive any documentation from XXXX. XXXX representative stated that I could not make a payment to them yet because my file had not been transferred but would be after XXXX. In XX/XX/XXXX, I called XXXX because I still had not received any documents from XXXX. XXXX representative stated they could not take my payment because the files would not be transferred to its office until after XXXX XXXX. and that I should call back in XX/XX/XXXX. I then called First Associates to ask if I could make a payment to them and they stated no because my loan had been transferred. In XX/XX/XXXX, I called XXXX and the representative stated that First Associates calculated the interest wrong on the loans. XXXX was requiring XXXX to calculate all loans again before any payment could be made and it should be complete after XXXX XXXX. I called XXXX on XXXX XXXX and asked about the status of my loan. I specifically asked if I was being charged late fees and if the interest was accruing during this time period, since the problem was with the companies and because of nothing that I had done. I was told that information would be sent before XXXX XXXX to me and that no late fees or interest was accruing during this time period because XXXX was still calculating past interest that First Associates had not calculated correctly. On XXXX XXXX, I received a call from a XXXX XXXX from XXXX and XXXX stating that my loan is in default and was sent to their collection agency in XX/XX/XXXX. He stated that the company sent me a letter XX/XX/XXXX which I never received and sent another one on XXXX XXXX which is enclosed. I told XXXX XXXX about the phone conversations I had with both First Associates and XXXX. XXXX XXXX stated he would look into the problem and get back to me. After speaking with XXXX XXXX, I called XXXX to find out what was going on with my loan and why I was sent to collections. I gave XXXX representative my name ( who did n't even ask for the spelling of my last name ), he stated they do not have any record of my loan every being transferred. I then called First Associates who assured me that my loan had been transferred to XXXX and they could no longer assist me. After speaking with First Associates, I called XXXX XXXX back to ask for a copy of my promissory note. The representative said that I could not wait on hold, I could not leave a message, and I needed to call back. At this time, I have not received any information from XXXX nor have I heard back from XXXX and XXXX. I do not know who holds my XXXX XXXX. XXXX and XXXX said they received my XXXX XXXX in XX/XX/XXXX. At that time, I would have only been one month 's payment behind which seem very quick to send someone to collections who has been making all of their previous payments. Especially since I was told I could not make a payment to XXXX because First Associates did not calculate the interest correct and First Associates would not take the payment either.

1. The VRAP ( Veterans Readjustment Act Program ) was educational funding for unemployed veterans to attend a technical school. I applied for and was accepted at XXXX University, one of the most highly ranked technical universities in the country. The XXXX I enrolled in was a XXXX course XXXX course of study, culminating in a XXXX in Supply XXXX. 2. After I had submitted my acceptance information to the VA, the VA informed that VRAP funding was limited to two-year educational institutions. I appealed to the VA ( Veterans Administration ) regional office in XXXX, GA, and I had a face to face meeting with U.S. Representative XXXX, who at the time was running for office. In my appeal to the VA, I explained that I had an XXXX and XXXX and that my attending XXXX College ( A XXXX college ) was not the best utilization of limited resources designed to help me obtain employment. XXXX XXXX, now Rep. XXXX, agreed with me and had congressional staff contact me for additional information. That information was the center of an extended dialogue with the VA. All efforts at reason failed! 3. I enrolled at XXXX College as an unemployed veteran. The program I enrolled in was the XXXX XXXX XXXX Program ( XXXX ). VRAP provided veterans twelve months of educational benefits. Once the clock begins to toll, I had a twelve-month window during which VRAP funding paid for my classes. One of the requirements for the program was that I had to be a full-time student. I soon found establishing a class schedule an exercise in futility as XXXX never made available the classes I needed to complete the XXXX XXXX program. This dilemma was made known to the XXXX College 's VA office. To maintain full-time student status and funding I was forced to enroll in classes I could have taught. At XXXX, mine was a XXXX existence. During my time at XXXX, XXXX courses listed in XXXX 's course catalog, however, none of the core XXXX courses ever came to fruition. My enrollment at XXXX was a carnival of the incompetency. The VA forced me to enroll at XXXX because the school fits the criteria established by the VA, a two-year school, offering a particular course of study. It mattered not at all if the school would maximize the return on investment for the benefit eligible student trying to reenter the workforce. After I appealed for sound and logical reasoning on the part of VA, then had a U.S. Congressman intercede on by behalf, it was to no avail. I subsequently enrolled at XXXX College, and then XXXX College never offered the required classes. But for XXXX failure to offer advertised classes, courses that the VA and I thought would be offered, the debt at issue would not exist. To add insult to injury, at the end of the one-year time allowed to complete my studies under VRAP, XXXX College Staff, via my XXXX Student email sent me information about XXXX. After spending a year as a XXXX student, I wanted to have something in hand reflecting time spent at XXXX. I enrolled in an XXXX logistics program, completing that program in less than two weeks. None of the courses taken at XXXX during the previous year had any bearing on the XXXX certificate of completion I received. In essence, I spent a wasted year at XXXX College. After leaving XXXX as a student, I wrote XXXX and XXXX stating my dispute of any alleged debt levied against me by XXXX. The alleged debt was non-the-less sold to First Associates. Phone calls from First Associates started to come every day, multiple times a day, and the hang-ups became so unbearable I was forced to hired a lawyer to seek relief. Correspondence from that lawyer to XXXX was returned stating no such company found at the addressed.

I attended XXXX through XX/XX/XXXX - XX/XX/XXXX .

I went to XXXX XXXX to find information on what is involved in attending that school. I had already visited other " for-profit '' schools in the area including XXXX 's XXXX and University XXXX XXXX . While at XXXX XXXX , I was asked to sign some documents which they stated would only : a ) check my credit score and b ) my eligibility to obtain federal & private loans. Despite asking about grant eligibility, XXXX never gave me any information or help in searching, finding, or applying for grants. I was asked to return the next day when the information requested would arrive and to my surprise, I was told that I had already accepted the loans. I was not aware that I was accepting responsibility for, or taking on, any actual loans but despite telling them I had come in looking for information they told me I had already signed to take the loans and begin enrolling into the school. At this point, under pressure from both recruiters and financial aid employees I believed the only option was to accept enrollment and the loans. At this point, I was not aware of private student loans or how they function. This was not explained to me until I was half-way through th e 2-year progr am. In this situation, I was called into financial aid due to an issue with my funding. It was explained to me that federal student loans can only cover 90 % of my tuition and I would need to find another source of funding. I did n't have the money they were requesting me so they told me I am officially dropped out of the program and my loans are going to come due. Financial Aid then told me I may have a longshot chance at getting funding from a bank and gave me a list of a couple of them that I can apply for. I recognized one of th e companies ( XXXX -- a company I worked for previously but was a XXXX XXXX ) so I chose that one. XXXX had me sign some more documents but still told me I could not attend until the extra funding came in. To recap, I was told my student loans are going to be due and that I owed XXXX for extra tuition plus. At this point my parent helped me by making monthly payments to XXXX XXXX directly of {$200.00} for 2 months when XXXX called me and said that the rest of the funding is going to be covered by private student loans. I still did not receive any details about these loans until after I graduated.

Throughout my entire experience with XXXX XXXX I was never explained how federal student loans work, how FAFSA works, or how private student loans work. I have no idea what I paid for or why I had to make those payments and this does n't even cover the lies I was told about wages and employment I would be eligible for post-graduation. In short, I was promised XXXX - XXXX in XXXX XXXX & XXXX work but the only jobs I could get ( and the only jobs XXXX would refer me to ) were entry-level, XXXX XXXX jobs. I was the only person in those jobs that had a " XXXX XXXX '' degree.

Ive sent in 3 applications since late XX/XX/XXXX, most recent submission made was within the last 30 days (XX/XX/XXXX ). Ive had no communication regarding my filed application other than confirming it was received. From what I can tell, the application has seen no movement. I have enrolled in an Income-based repayment plan for my federal loans. XXXX XXXX employed high pressure recruitment and sales tactics. They misrepresented graduation success, job placement rates and salary figures that were misleading. I went to school there and was taught outdated material. They said I would be getting a better education for a better price than if I went to a state college or university. I now sit here with a poverty wage job and {$74000.00} in debt. There have been lawsuits against XXXX ( whom declared bankruptcy after losing federal financial aid funding in XX/XX/XXXX ) in regards to predatory and deceptive behavior. I have been defrauded by XXXX XXXX XXXX. I worked hard every day I went to that college and no one was interested in hiring me. Most jobs that were sent from the career services department at the college were entry level technical support jobs that offered XXXX XXXX an hour. They hardly spent any real time helping students. All they wanted to do was put me on their email blast mailing list for jobs. There has been several cases involving XXXX XXXX XXXX including a class action lawsuit that was settled in favor of the student borrowers behalf. In some of the supporting documents I have pertaining to this complaint. In sperate lawsuit, the PEAKs loans have been referred to as " akin '' to the " sub-prime mortgage loans '' in the XX/XX/XXXX financial crisis. I seek forgiveness from this debt. I believe XXXX XXXX XXXX must be held liable for the financial ruin they have brought to not only myself, other Oregonians and students around the nation. presently I am sending nearly half my monthly income to pay towards these loans. I can only afford to do minimum payments. If I dont miss any payment or go into default I may be forgiven from my loans over the course of a few decades. I attended XXXX XXXX from XX/XX/XXXX in the XXXX. They promised me competitive job wages, job placement and above all affordable loans. When i was about 6 months into the program i had acquired a decent job, and was unable to get anymore federal loans and decided i was just going to quit the program and cut my losses.. They informed me that if i dropped out i would be held responsible for the entire cost of the program without obtaining my XXXX degree, and not to worry because the loan payments were very affordable and kept urging me to apply. They were constantly pulling me out of class to discuss loan information. I didnt want to get kicked out liked they had threatened, so i continued to apply for these loans. They assured me they had other " affordable '' loan options thru a private company called XXXX, a.k.a., peaks loans. When i had to start paying back my loans, the payments were way too high to afford. The only options they gave me was 6 months deferment, and a graduated payment plan that only applied to XXXX out of the XXXX loans, and were still XXXX a month, with an increase every six months. I told them I couldnt afford that either, and they asked what i could afford. At the very most, XXXX a month was it, to which they replied id default on my loans. I asked what would happen if i just sent in payments, they told me it wasnt even enough to cover the interest and they would pursue collection action. They kept telling me the wages in this field were very competitive and that i would have no problem paying back my loans. Once i started getting phone calls from XXXX, they were rude and i felt like i was getting calls from a collection agency. When i tried to call the school and talked to the person that was in charge of my paperwork iwas always told they were unavailable and to leave a message. Of course, i never got a call back. I wanted to know why i had signed paperwork for loans that were supposed to be affordable but werent. The starting wages for this position were mostly at 10 dollars an hour, barely above minimum wage at the time! I have a family to provide for, I couldnt afford that let alone, make high payments with high interest rates. Ive read so many stories like mine and it makes me angry that they bullied me into something i could have and tried to avoid. Right now im trying to consolidate my federal loans because i cant even afford those either, If theyd been honest with me about dropping out i wouldnt be in this situation. Id also like to add that the schooling was mediocre at best. There were times in some classes when our teachers would tell us to just " XXXX '' something instead of actually teaching us. This school was a joke and has completely wasted my time and now ive thrown away XXXX dollars of my money im going to have to pay back.

I attended XXXX XXXX XXXX XXXX , XXXX through XXXX , XXXX and received my XXXX in XXXX XXXX XXXX XXXX with a GPA of XXXX . In talking with the recruiter, I feel I was wrongly advised to take on loans which I was not, and would not be after graduation, prepared to repay. When I was nearing graduation, I sought help with the job placement department and was told to wait until my final quarter until I could receive any help. I found the jobs I was offered to be very low in wages, nothing near the advertised salaries for graduates in my field. I was told that XXXX had a close relationship with employers, who had several training points that XXXX would train us on but upon entering the job market, I realized the technology I was taught was outdated and too broad to be considered useful in the real world. I took out federal as well as private loans. My private loan amount, with Peaks Private Loans, totals {$11000.00}. I have been trying to pay off my loan for the past four years since graduation, with some forbearances in between, but my payments are never enough to catch up to the interest that accrued during my forbearances. I no longer have any forbearance left to pay and my income-based payment amounts are not sufficient to pay off any of the principal. I am drowning in debt and contacted regularly by Peaks to repay this loan which I deeply regret taking out. The education I received was incredibly lacking and was catered for the students who were doing the bare minimum. All too often, when asking clarifying questions, the teacher would tell me they did not have the time to answer my question or that the curriculum did n't allow for such depth of knowledge. In class problem solving was not teaching me the way the technology worked, it was a controlled environment, meant for the laziest of students to find the obvious answers. When I asked the teachers for help with problem solving, I was told to confer with my peers, who were just as unprepared as myself. Our team would tirelessly work to solve the problem, unable to learn the principle. Other students, who chronically misbehaved and underperformed, were given a passing grade for doing much less work. We all received the common denominator level of education. My education was largely the result of my own efforts, reading the text book several times over, doing independent research online on the subjects. In class learning was a very base level education on outdated technologies, and in way too many fields of study. There was not sufficient time to learn any of the topics as the curriculum was constantly moving onto the next field with the very broad " computer and electronics engineering technology '' area of study. I requested to have a private student loan from XXXX /1st Associates Loan Servicing ( XXXX ) in the amount of {$1700.00} in order to take a XXXX XXXX XXXX class ( course code : XXXX ) through XXXX XXXX XXXX College. I was enrolled in the course on XX/XX/XXXX and approved for the loan through XXXX / 1st Associates ( XXXX ) on XX/XX/XXXX . On XX/XX/XXXX , a few days after being approved for the loan, I contacted XXXX / 1st Associates ( XXXX ) and advised them that I decided not to take the course through XXXX XXXX College and that I needed the course cancelled/dropped. I asked both the XXXX and 1st Associates ( XXXX ) representative to cancel the loan I was approved for through them, being that I had no need for the loan because I cancelled/ dropped the course ( which I never took or started ). I was told by both the XXXX and 1st Associates ( XXXX ) representatives that the loan would be cancelled. As of today, the loan has not been cancelled as promised and they are reporting a delinquent status each month on my credit report. I have tried numerous times to get this issue resolved with XXXX and 1st Associates ( XXXX ), but I keep getting the run around, both pointing the finger and referring me to the other. Neither has provided help in getting this debt removed from my credit report. Earlier this year around XX/XX/XXXX , I spoke to XXXX XXXX , Collections Supervisor at 1st Associates Loan Servicing about this issue. He told me that he see in their notes where I requested to have the loan cancelled, but he has done nothing to assist me in getting this debt cancelled and removed from my credit report. He keep referring me to XXXX . I spoke to XXXX XXXX , Admissions Representative with XXXX as instructed by XXXX XXXX . I explained to XXXX XXXX that I spoke to him in XX/XX/XXXX and asked to be dropped from the course and have the loan cancelled. He stated that he see in his notes where I made this request. During my conversation with XXXX XXXX in XX/XX/XXXX , I was told by XXXX XXXX that XXXX do not handle or finance loans, this is handled by 1st Associates Loan Servicing. I really need help with getting this issue resolved and having this debt removed from my credit report. Neither XXXX or 1st Associates is willing to make right on this issue. It seems as if XXXX and 1st Associates is operating under shady practices and they are fraudulently reporting incorrect information to my credit report each month and have refused to assist me in getting this resolved. I have recently tried to cont act 1st Associates Loan Servicing but th e phone number is no longer is service. I am not sure if they are out of business.

I had them remove auto pay as their is no use having auto payment if the full amount owed isn't covered and have since paid the amount owed, I was not charged any late fees or penalties, however I think this is a rather deceiving practice and needs to be looked into. Note that this was the first e-mail that I received that the amount that I owed would be going up.

This account XXXX was open on XX/XX/XXXX and is inaccurate because this account was open without my authorization, when I attended XXXX XXXX XXXX XX/XX/XXXX-XX/XX/XXXX for the only loan the I was aware of was for the financial aid offer thru department of education. The financial aid staff fill out my application for my financial aid the whole process was done in a rush and everything was done e-sing thru the application on the computer. My understanding was the I was signing my financial aid application. I send a letter on XX/XX/XXXX to first associate requesting the removal of this loan for the reason the I didnt authorize this loan. I would like to request an investigation be launched into the lending practices of Peaks Private Loans. I submitted a complaint with the CFPB on XXXX XXXX, 2017 and received a denial reply from Peaks Private Loans. I was misled by XXXX XXXX XXXX to apply for loans which I was not, and never will be, able to pay off, due to the level of education and resources given to me by XXXX XXXX XXXX. Due to my income level, I have accrued an overwhelming amount interest on my loan and my loan is becoming increasing improbable to be paid off. Peaks Loan refuses to work with me to pay off my loans in a reasonable way. I have exhausted my forbearance allowances with them and my income-based payments will never pay even the interest accrued on my account. I have been trying to make the minimum payment each month but it is only going toward my interest. I now owe much more money than I borrowed and the principle balance has gone down very little, with the interest being thousands of dollars. I have paid Peaks Loan thousands of dollars over the last few years and have nothing to show for it. I borrowed this money in hopes of bettering my future and becoming a useful member of the job force but I am not working in the field I studied for, due to the lack of education given to me by XXXX. I have spent thousands of dollars in paying back the interest accrued on my loans for a degree from which I have not benefitted. I am in debt for a degree which is not very helpful in getting me jobs, from a school that was shut down because of predatory lending practices, and have ever-increasing interest from a company that lent me money knowing I wouldnt be able to pay them back on time. I contacted Peaks Loan through CFPB, bringing to their attention the sneaky ways in which they lent me money, and was sent a firm denial in return. I ask that your organization investigate their lending practices and refusal to work with my balance due, in light of the recent exposure to XXXX predatory lending practices, with whom Peaks Private Loans was involved. The education I received from XXXX was not sufficient to prepare me for the job market, the market which would afford me the salary to pay off my loans, that they promised. I called around the XX/XX/XXXX, to start making payments since I was unable to finish the course. I spoke with XXXX and explained to him that I could only pay XXXX dollars a month, and I would continue paying that amount until it 's fully paid. What XXXX, XXXX XXXX XXXX, XXXX XXXX XXXX did not realize was that because of their mistake my XXXX credit card was cancelled because each time they attempted to collect their payment it was not there because of the aftermath of their mistake. My cellphone has to be paid in cash only because their payment was rejected so many times. I have went on their website to make a payment but a statement explains that I need to use the mail in method. I have also shown proof to the credit bureau that i was paying and had them removed from my credit report, only to have them placed back on their in two days with no warning or 5 day notice. XX/XX/XXXX : received letter stating XXXX XXXXl , XXXX was willing to settle debt at 50 % of balance owed. XX/XX/XXXX : called XXXX XXXX to settle for the 50 % XX/XX/XXXX : received another letter demanding final payment for the remaining 50 %, called XXXX XXXX to resolve issue and informed them that if i continued to receive any sort of correspondence from them I would report them and have the payment made recovered from my bank. I was informed that they would notate my account and I would no longer receive any correspondence from them in regards to said debt. XX/XX/XXXX : received call in which the person on the other end refused to inform me as to what the call was in regards to unless I provided him personal information to verify my identity. I refused to supply the person with any information as he would not give me any information and I wasn't giving out personal information until he verified why he was calling or who he was with. Did a phone number search and found that it was XXXX XXXX. Called back spoke with a woman who said that her supervisor would be notating my account to show that the account was closed, I would no longer receive any correspondence from the company and that after 28 days of making said payment the account should have been closed. I feel that they are using harassing tactics to scare people into paying the entire amount even after offering a settlement. They refuse to verify who they are and what the call is in regards to. If I hadn't gone through this with a similar company I wouldn't know that this is unacceptable behavior, other people may not know that this is not ok and end up paying XXXX XXXX more money because they're scared that it won't be resolved unless they make another payment. If a settlement is offered and you accept that you should no longer be receiving any correspondence from XXXX XXXX other than a letter stating account is settled.

In conjunction with unsatisfactory education, educators, equipment, and communication, I am requesting full acquittal of the account. Education was poor quality and was limited to partial demonstration of real world application. The educators were not equipped to teach the classes they were teaching for in majority cases. Equipment was outdated, running on older systems, including the need to save files to previous versions so compatibility issues did not occur. The institution promised a continuing education in game design upon completion of the XXXX XXXX program. Less than one month prior to the completion of the XXXX program, I was informed the school was no longer continuing that academic direction and dropped the classes they prepared me for. There were no alternative options provided to me for that academic plan of study.

Attending XXXX from XX/XX/XXXX XX/XX/XXXX. This was the first time I had ever attended college. It came down to the last quarter of my XXXX degree and was told had no student loan funds available. Next thing, all of sudden funds were available if I signed to continue degree. The peaks amounts were due immediately upon graduating. And when I went back to school at XXXX University were not deferrable unless I returned to XXXX. They can not be consolidated with all my other student loans. In addition, they require that I send separate payments for each loan in separate envelopes. When I try sending them together as XXXX check the payment only gets applied to XXXX loan even though I have the invoice stubs enclosed with the amounts indicated for each loan, and the one they did n't apply it to I 'm hit with a late fee of {$10.00}. When I called about it that was when I was told had to be separate check / separate envelopes. After Graduation XXXX repeatedly called me wanting to know where I was working, even though I have worked in the same job as when I started school. The many times I went to the school Career Counselor, for potential job prospects my information was filed in a cabinet and never received a call on anything. Several times they called and wanted to take credit for my position at XXXX which I had long before even starting school. As a friend still works for XXXX, a couple of times she has overheard the Career Counselor state to potential students that she got me the position at XXXX. I received a loan from XXXX to take the NY XXXX XXXX XX/XX/XXXX. Thereafter, I spoke with XXXX XXXX about monthly payments and they informed me that I could pay whatever I could afford. I paid {$30.00} through direct debit monthly. No other information was given to me except that these payments were fine. XX/XX/XXXX I received a letter from First Associates, a loan company I had never heard of, stating that my payment was late. I called them and they said they now owned my XXXX loan and they did n't have my debit information so my account was late. This put up a red flag as I received no other info from them and it was not my fault that they did n't have my account info. I gave it to them and continued to pay $ XXXX monthly. Nothing whatsoever was said to me about increasing my payments, interest, etc. I did n't receive any paperwork from First Associates. Now I received a bill XX/XX/XXXX XXXX so presumably I did n't receive it until XXXX XXXX stating that I am 15 days past due for almost {$1000.00}. I do n't understand how I can be past due when I 've been making payments and no bill was sent to me about this amount in XXXX. I spoke with someone named XXXX who said " they tried to email me once. '' Apparently my loan has re-amortized and now I owe exorbitant amounts and have late fees even though a bill was never sent to me in time to pay. I believe First Associates has wrongfully failed to provide me with any information about my loan and who the company is and they are now attempting to force me to pay obscene amounts compared to what I was paying, charging late fees, and threatening my credit. In addition, their interest rate is usury at 17.19 %. After working for 3 full years to obtain XXXX, this was the only loan I was able to get in order to pay XXXX so I was forced to take a loan from a disreputable company at this horrifying interest rate, and now they are going to ruin my credit without any warning or paperwork regarding the status of my loan.

I took out numerous loans for XXXX school from XX/XX/XXXX to XX/XX/XXXX. This is in addition for loans for my XXXX and XXXX education. I received only an e-mail notifying me of this transfer, with no hard copies or attached documents. I completed forbearance paperwork while completing my fellowship, but the loan came into repayment in XX/XX/XXXX. I made a request to go to interest only payments in XX/XX/XXXX, and I was told I would be mailed the paperwork to complete this request. It never arrived, and I continued to pay my bill. I then noted that my interest rate was rising quickly, now 9.22 %. I decided to transfer the loan to a more reputable company who requested my master promissory note. I called 1st Associates to request this document, but instead got a letter in the mail stating, " Unfortunately, due to administrative error, we do not have a copy of your original agreement. Original contract terms are digitally uploaded into fields of our servicing database at account onboarding, guaranteeing a permanent record of the account details. '' This statement seems to contradict itself ensure presence of a document that they can not provide. I called again to request the documents and was told a request had to be sent through " Upper Management. '' I tried to find any contact information for XXXX XXXX ( which I think stands for XXXX XXXX ), but only find links to legal aid related to this company. So I checked my bank account and searched it and found that 1 off my loans went up XXXX in 18 months. I have a 2nd loan with them that also went up XXXX in 18 months. I need some advice or to find out if this is legal. If this keeps happening I dont see know way to pay this off because it keeps growing. I will call them and they will probably tell me the same thing they told me last time and I will request a copy of my contract and will never get it so maybe I will have to go see a Lawyer about this. This is my 2nd complaint to be filed by me for the Peaks Loan. My first was for the fact that I did n't know who the heck they were or what they were since I signed an agreement with XXXX XXXX to service my temporary school credit. After establishing that peaks was the new servicer and paying 3 years of {$220.00} payments my balance never went down. I have tried to secure a means of refinance but due to Peaks over zealous reporting habits, my credit score took a huge hit. I was no longer able to refinance the loan and could not get anyone to loan me the {$9000.00} dollars they said I still owed after 4 years. My famly has since fallen apart and have been going through a really tough divorce that has lasted a year now. During that time I was no longer able to pay on the loan due to high childsupport payments and attorney 's fees. The company was contacted and told the situation but was not willing to help. A few months later during their investigation period with the SEC, they contacted me and tried to inform me about refinance options which were even at a higher rate eventually than the existing rate. I declined and asked for forbearance and in the past that was usually handled over the phone, well this time I was told that I would receive an email with the form to apply for forbearance, that I would have to fill out on my own. That email never came and now I get a letter from them in XXXX XXXX that my Peaks Loan is now in Default. Outraged, I have chosen to not return the single call, from the company, to me since that letter. My credit report shows that the Peaks loan was started XX/XX/XXXX. I had never heard of Peaks until after graduation in XX/XX/XXXX.

I am in the process of trying to purchase a home, I spoke with a mortgage representative on XX/XX/XXXX and they pulled my credit, on XX/XX/XXXX, I spoke with a credit repair specialist that deals with the mortgage company, after looking at all of my credit reports advised me of what I would need to take care off. I noticed that on my payment activity there was an account listed as First Associates, student loans and that I was past due over 180 days and that I owed over {$3700.00}. I contacted the company and they advised me this was a student loan from XX/XX/XXXX and that the original loan was in the amount of {$1500.00}. I asked what the additional amount was and I was told late fees and interest. I explained to them that I was not aware of this loan and that I never took an online certificate class. They advised me that this loan was correct and that it needed to be taken care of. Because I am trying to purchase a home, I asked if they could give me a settlement, even take off the late charges and interest and that I would be willing to pay the {$1500.00}, they advised me no and that the interest and late charges would continue to accrue. I asked them if I could make payment arrangements so that the fees could stop and so that I can pay it off and they advised that I can make payments, however, the fees will not stop and that they will continue to add up. I have paid {$700.00} since my conversation with them 1 month ago which should put my account at {$3000.00} instead, my account is listed at {$3100.00} and on my credit report it is still showing 34 missed payments and it is not reflecting that the balance is decreasing.

It started back when I applied to become a student at XXXX of XXXX XXXX. Not fully understanding the process and looking for a way to apply and advance myself in the world I did whatever it took. I was never fully explained the loan process and how the federal vs. private loan system worked. I felt like they just wanted me to sign and move on and get into their system. I went to XXXX for over a year only to be removed from the school basically because I was unemployed. I lost my job during my 2nd year and was unable to make it to classes. After begging with them ( the XXXX admin ) to understand my situation I was forced to drop out, and not like me saying sorry I can no longer make it to class, more like " if you cant make it to class you can not be a student here. '' Being unemployed you have to make smart decisions with your money, and I had to make choices. Every penny counted and when I was unable to physically make it to the campus to attend classes due to budget restrictions I was shunned! So I found myself with a pile of debt in federal and private loans, no job and a partially finished degree. I was a student at XXXX XXXX in 2009, I was never informed that I would have to begin paying back the loan to Peaks if I stopped attending XXXX. After graduation I was unemployed so I exhausted my deferment, after that I used their other program where I was only paying towards the interest rate of the loan. I graduated from XXXX XXXX in XXXX, 2014. In XXXX, 2014, I received a letter from PEAKS Private Student Loans stating that I was nearing a default status on this loan. I was completely unaware that I had taken out this loan, as this was the first correspondence I had received from this agency. When I began attending XXXX XXXX, I was coerced into taking this loan because if I had n't, I was informed I would have to either pay out of pocket or drop out of school. Additionally, I was not informed about the terms and conditions of this loan, the high interest rate, nor the fact that this loan can not be consolidated into my Federal Loans. I called the agency, and they stated that they only contacted lendee 's via e-mail. I began the dispute process with a credit repair agency, and PEAKS refused to accept the dispute. My credit score dropped, which prompted me to dig further into this agency. It was brought to my attention that there are lawsuits being processed with XXXX XXXX. I again contacted PEAKS student loans so we could discuss possible repayment options, and they informed me that I am XXXX days delinquent, and I have not received notice to that effect. This lender will not allow me to consolidate this loan with my Federal Loans. They are also requesting that I pay a monthly payment that is more than 400 % of what my Federal monthly payment is. I am a single mother who is simply trying to make a better life for my daughter, and each paycheck is carefully accounted for. I just want this loan to be more manageable, and I wish this agency would have contacted me prior to my loans reaching default.

I have checked my credit report and I see that this company is reporting occasional on-time payments on both accounts. I believe that this is fraudulent act and they are attempting to circumvent my rights. They are trying to not let the accounts age so that they will not reach 7 years. They will be able to keep reporting these bogus accounts indefinitely. I also believe that they are trying to circumvent my rights under statutes of limitations afforded me under laws in my state. I enrolled at XXXX XXXX, under the premise of a better opportunity and advanced learning. Once enrolled I quickly saw how the institution was a joke. Teachers passed you with no problem as long as you showed up for class. I did not want a free ride, I actually wanted to learn a skill that I could utilize in the work field. Once I saw this I began to look elsewhere for schooling and then learned the bulk of my credits were non transferable, and that most employers do not consider XXXX an accredited school. This is not the message I was given when I enrolled. I was told how employers consider graduates the cream of the crop and finding a job would be no problem. Once I left I then could not enroll in another school due to the fact I now had tremendous debt from my time at XXXX. The loans taken out were predatory with outrageous interests rates, which I learned most of the students end up in default on. My credit has been largely affected due to delinquent payments and I see no clear way out in sight. XXXX is very corrupt and dishonest with the facts stated in order to coerce students into enrolling. Exaggerated graduation and job placement rates, as well as knowingly convincing students to take on huge debts that they will more than likely not be able to repay. These actions should be criminal. Now I am constantly being called and harassed by XXXX Private loan, the agent assigned to my loans with exasperated demands of payment. I have a personal loan through XXXX XXXX. I called them on XX/XX/XXXX to get an address to send a check to payoff the account. On XX/XX/XXXX I sent the check XXXX to the address I was given over the phone. On XX/XX/XXXX it came to my attention that the loan balance had not been paid off. I contacted XX/XX/XXXX who told me that the address I sent it to was an old service provider. I was told to contact First Associates to see if they had received my check. I called and was told that they hadn't received the check. I then contacted the bank that wrote the check and received a copy of the canceled check with First Associates bank information on it dated XX/XX/XXXX. I called Loan Depot back and asked them to contact First Associates to get their funds ; I also faxed them a copy of the canceled check. On XX/XX/XXXX, XXXX from XXXX XXXX called and told me that First Associates would not return their calls. I called First Associates again. I asked to speak with the president, XXXX XXXX, or the manager, XXXX XXXX but was denied that request. I first spoke with XXXX who repeatedly transferred my call to XXXX XXXX. Through conversations with XXXX, XXXX, and supervisor XXXX XXXX, we received several different stories of what had happened to the check. They mailed it back to the bank before they cashed it. Sometimes they cash it first. And finally they put a stop payment in and were mailing a new check. However with each story we were denied any documentation or check numbers to support the claim. I owe nearly {$60000.00} in student loans for an XXXX XXXX. Not to mention, this private loan they conned me into. This company, XXXX XXXX, which one of it's services I found is debt collection, keeps contacting me. On the first call, they asked to speak to me by asking my specific name, and then asked the procedural identity questions such as what my Date of Birth, Home address and Last four of my social security were. They then proced to say, " they can not establish '' my identity, and to email their technical support. They also say they, '' are unable to discuss anythign further due to privacy and security concerns. '' To this statement I replied first, to send me written information to the nature of the call to my home address, and second, if they have established I am not the correct person they need to speak to, then they need to discontinue calling my number. They would not discuss anything further, and told me that they will keep calling until I " straigten things out with their support '' I have not, since the first phone call on the XX/XX/XXXX, received anything written from XXXX XXXX, and they continue to call me. They have called me on the XX/XX/XXXX, and on the 4th, 7th and XX/XX/XXXX, despite my telling them repeatedly to not call me and to send me written information as to what the call entails. They do not want to discuss the nature of the call, nor send any written information. I called them back, and instead of sending me to their website, XXXX, they told me to go to XXXX NOTE : I asked them for a mailing address to put into a complaint form, and they refused to give it to me.

My PEAKS loan ( 1st Associates collects on the loan ) is in default. I have made an agreement to pay {$80.00} a month but havent been able to due to other debts. Now that I have cleared smaller debts I 've attempted to keep good on my word and make my first payment. Instead of talking to someone I attempted to pay online with my debt card. That option was unavilible for me. Next I tried calling in and paying over the phone. After putting in my information I was " directed to a customer service rep '' 3 times but instead of talking to anyone I was sent to the main menu. I defaulted on my loans due to unemployment and only recently found a job. Had PEAKS or 1st Associated helpped me when I was unemployed and not just during my grace period I may not of defaulted. This is my 2nd complaint reguarding this company. I still till this day do not know who owns this debt and am frustrated when attempted. I do not want my wages garnishedI just want to bring my account current and stick to the $ XXXX monthly plan we agreed on. Not be fooled with when I attempt to pay or get the run around. I dont need a rep telling me what I owe. I already know! I want to and need to pay what I can and pay it either other phone through the automated system or online. I have a loan currently through XXXXXXXX XXXX XXXX that I got during my schooling through XXXX XXXX. I was never aware that I even signed up for this loan until my loans started to come in. From my understanding I only had Federal loans, so I have no idea when this loan even came into being. My current interest rate is far to high and the payments are unreasonable. When the payments started coming in it was a repayment of about {$430.00} at a 16.5 % interest rate. I was unable to afford this, so I tried to defer which was only allowed for 3 months. This did not help me at all, because my income at that time was not enough to juggle that, food, and other necessity for my kids and myself. This means my only option was to allow it to hit my credit because they would not work with me. The payments still remain at {$430.00} even after paying and trying to reduce my payments, my interest rate has now risen to 17 % even with paying my bills on time for the last 6+ months, and my credit is poor due to them hitting it because I was unable to afford the payments before so I am unable to refinance the loan to get lower payments and interest rates through another company. They have made it near impossible for me to be able to actually ever pay back my loan or even stay on top of it so that I can rebuild my credit. I am looking for any sort of help or suggestions I can get on how to move forward so that this is not a constant burden to my financial well being.

I was lied to and told that I could transfer credits, I would be placed in a high paying position and I was told if I didn't sign up asap, the cost of the program was going to sky rocket. They had subpar equipment, subpar teachers and they told me they were accredited. I am not responsible for this loan ... I also did not finish the program, so how in the world did they manage to get {$52000.00} from me??? I have also contacted XXXX regarding the lawsuit that was filed against XXXX XXXX XXXX - XXXX XXXX XXXX XXXX. Back in late fall of 2017 I had worked out a pay-off arrangement with Student CU Connect. I had 4 loans with them and paid {$6000.00} on the 1st loan. {$2100.00} on the 2nd loan. {$2500.00} on the 3rd loan, and {$11000.00} on the 4th loan. I thought it was all satisfied until a couple months I answered a call from them to find it was Student Connect 's collections department trying to get the remaining amount of each loan. After multiply calls and different individuals I finally found out that the paper work never got back to them signed. Now understand that it was electronic signature and i had thought it went through no problem, especially since they didn't hesitate to take my money in the grand total of {$22000.00}. Furthermore they told me they had the agreement in front of them as we spoke but it was not signed and they would no longer honor it. Ethically why would they not honor it??? They got their money when requested for the amount requested. Also why would it be in collections if I paid that amount. That amount I would have thought would have carried me for years anywhere. I wont even go into the interest rates that were associated with these loans. Unfortunately I do not have much email back up as my work computer deletes after a set amount of days and I thought these loans had be satisfied. One last thing this has now shown up on my Credit Report which will severely hurt my chances at future credit applications.

I attended XXXX XXXX online for XX/XX/XXXX - XX/XX/XXXX and while attending the school i had issues and after I graduated due to them shutting down and them being unable to provide the services they promised me. From using there School Cost Estimate Calculator, I gathered they also charged me the same rate as a person who physically attended the school which was approximately {$250.00} per credit hour over what I was original told and ended up paying exactly the same as a person that went to class there including room and board.I was not told until after i signed up, because the admissions representative said they handle the paperwork to make it more convenient for me, that some loans were private at a ridiculous interest rate and made it seem that they would all be Federal Loans. Also, I was promised that i would get aid in finding a job but all that was provided was the same leads that I found on XXXX, XXXX, XXXX, etc but originally was told that had " unique sources to find the perfect job suited for a career in XXXX XXXX '' which came from XXXX XXXX ( Director of Career Services ). The experience i had with XXXX infuriated me and now it seems that my hard earned degree is virtually worth nothing except the paper my diploma was printed on and the fact that despite much effort, I still do not work in the XXXX XXXX field. I am submitting this information about Student Credit Union Connect in which was a private student loan from the school of XXXX XXXX XXXX in which I attended from XXXX to XXXX. I received this loan with this company that is affiliated with XXXX XXXX XXXX and I declared a chapter XXXX bankruptcy XXXX of XXXX and I was also discharged in XXXX. This loan was transferred to another division of this company or either the company had moved in which the attorneys tried to inform them of my bankruptcy in XXXX. I informed this company about my chapter XXXX discharged and they refuse to refund me my payments that I made in XXXX all the way until XXXX. They continued to bill me and send me threats of putting negative information on my credit while I was struggling to pay them. I have attempted to contact Peaks Private Loan over the years. They have wanted me to pay {$350.00} a month which I could not afford and the time and I still can not as I have XXXX other loans that I am trying to pay back to the best of my ability. At first they told me that they are not able to decrease my monthly payment. As time when on I was told that nothing can be done now as I owe a {$5000.00} Balance to bring the loan current. Last time I reached out to them they said that there was nothing that they can do because that private loan was sent to a collections agency. I have looked back into this from the paperwork I have. I have never signed for this loan it appears that XXXX took it out with out telling me that it would be a separate loan from my Federal Loan. I am sure that you have received XXXX these for student loans, private and federal, but I 'm not greedy. I understand that I signed the paperwork and agreed to the loans, but when you 're signing paperwork for a student loan program that was invented by XXXX XXXX to pull itself out of the proverbial boiling pot because it lied to the government and its investors, well then I think personal responsibility can then go out the proverbial window. No one signing you up for a loan is going to tell you that the loan is bogus and that it was created for the sole purpose of covering up XXXX 's accounting fraud. Filed Chapter XXXX bankruptcy 2016 and was discharged. XXXX XXXX was included and was aware. XXXX XXXX continued to contact me regarding making payments to the loan included to the bankruptcy. They have been receiving payments out of my account every month for {$50.00} and should not have been receiving it. Today, I spoke with XXXX, XXXX, and XXXX ( 2x ). XXXX would not transfer the call to the credit department. XXXX stated there wasnt a credit department, then once he got my information then he stated he would transfer me to the credit department. In which, I spoke with XXXX. Who stated that I still owed and that he received information from the US Bankruptcy Court that it was dismissed. At first XXXX acted as if he didnt know about the bankruptcy. He stated that they still illegally continue to collect the funds from my account. So I asked to be transferred to his supervisor and they had me on hold for 10 minutes. Then they sent me to a survey not the supervisor. I called right back, same process. I chose to go to XXXX XXXX XXXX. When I applied for my student loans, it happened so quickly that I was n't even sure of what I signed. I was also told that through an XXXX program XXXX credit- I would have some, if not all, of my tuition reimbursed if I kept a grade level above XXXX which I did. That program then magically disappeared once I got in the door. I was told that ny student loans would go to XXXX XXXX and then they would be split between federal loan institutions. That did n't happen. Some of my loan when to XXXX XXXX, and the other part went to XXXX XXXX - a collection agency and private lender. Since they are a private lender, my interest rate is above 10 % and they refuse to work with you on lowering payments. This was a HUGE issue when I graduated. I called and asked when my first payment was due, and was originally told XXXX. a month later I received a call that my loan was in default and I had n't made my first payment that was due in XXXX. I explained that I had called and was told my payments were due in XXXX. They refused to listen to me, or work with me. XXXX has been reporting the Peaks private loan on my credit report for a number of years. I filed a dispute claim in XX/XX/XXXX and was never made aware of the results. At which time I reached out to Peaks by phone and by email trying to get the loan off my credit because of the scandal they were involved in with XXXX XXXX XXXX. I never received an email or call back concerning this matter. Their reporting almost did not allow me to purchase a home for my family. Now I am being relocated for my job and I have to deal with this again. XXXX keeps reporting the Peaks loan. I disputed the loan in XX/XX/XXXX and they reported the findings as accurate and that was all that was said. I tried to contact Peaks again with no response to inquiry about my account. Included in my loan agreement is a provision ( found in sectio n ( E ) ( 9 ) ) th at states I am eligible for a three percent ( 3 % ) reduction in the Margin of my Loan if I satisfy certain requirements. Attended XXXX. Was basically told on my last year of school that i had exhausted my Federal Loans, and the only way to continue school would be to pay out of pocket ( which I could not do ) or receive one of their Peaks Private student Loans. At the time i believed that this was for the remaining {$12000.00} of my tuition. This loan was filled out in my name for now over {$25000.00} with an absolutely outrageous interest rate. Received communication from XXXX XXXX XXXX ( XXXX ) stating I owed them for a defaulted private student loan through Peaks for attendance at XXXX XXXX, XXXX, SC. I requested debt validation because I never applied for a private student loan while attending XXXX. ERS provided me with a copy of an application/loan agreement that was e signed on XX/XX/XXXX. The enrollment period for the loan was XX/XX/XXXX to XX/XX/XXXX as listed on application. My last day at the school was XXXX/XXXX/2010. I provided an official letter from the school 's registrar that certified my dates of attendance from XX/XX/XXXX to XX/XX/XXXX. It is apparent that someone fraudulently applied for a loan for a periods of time when I was not enrolled at XXXX. These negative actions have ruined my credit as they are reporting as a defaulted loan in collections that continues to update monthly. I had no knowledge of this loan or its collections status until contacted by ERS. My private lender has no information about discharge of debt with their finical institution. They also have no information available loan forgiveness. They have also reported all interaction to all major credit agency. In XX/XX/XXXX, I enrolled and began classes at XXXX XXXX in XXXX XXXX, La. after a few weeks of classes, I began having difficulties with my instructors, such as inability to understand her speech, as she was from another country, and substituted many words and phrases with her native tongue. So, after requesting a change of courses, I switched from drafting and design, where i originally had issues, to criminal justice where id hoped to continue my education, only to receive an inaccurate attendance record, despite having all assignments and any homework from the " missing '' days. I was experiencing financial hardship two years ago, due to being unable to secure employment, when I tried explaining this over the phone several times to the Agency ( PEAKS ), they kept threatening my credit and telling me I had to pay it in full, or they would send it to collections. Since I was n't employed at the time ( with no Government assistance, Unemployment, or assistance from family ), I could n't make the payments, and they sent my debt to collections. At the time I did not realize I was not given the option to decline the Peaks private loan or use all my Federal loans before taking out a private loan. PEAKS private loan is the company XXXX tech has signed me up for and they have loans that are nowhere as big as the federal loans, total amount of private and federal is over XXXX, but cost almost double what the federal loans do. When checking the interest I found it was much higher than the other federal loans I have and was never told that Peaks was the company that they went through and was not even aware until I got a notice that my student loans were all consolidated for me even though I do not have a copy of any paperwork stating that I wanted them to do it. I was rushed through signing every student loan document in the school and most of the time they had already filled them out for me without me even seeing stating that I would be expelled if I did not sign it that day right then. An agreement was reached or at least that was what I thought, the company withdrew the amount I agreed to pay five times within three days. Since this time I have not been able to reach any type of agreement with this company. Now they are reporting on my credit report as an open account in the name of First Associates, and reporting late payments every month since XXXX. I attended XXXX AL location from XXXX and took out a PEAKS private loan with the school as they made it seem that was my only option to receive financial clearance in addition to my federal student loans. The school electronically signed most of our financial aid documents without our knowledge. They would call us into the office and tell us everything was already filled out and to agree to terms etc. I am still struggling to pass my XXXX graduation nearly 2 years ago now. I never did trust the school with my financial aide because it was all so under the table and pre-filled out. Received a notice that the company purchased the account and turned it over for collection. The letter states that the the last payment was made on XX/XX/2006. There is no judgment against me for this. The statute of limitations has run out. They have had 13 years to contact me and this letter does not seem legitimate. XXXX sold this loan to First Associates. First Associates is effectively a shell company where it is impossible to have any type of discussion with someone. I called First Associates and have emailed them. They have confirmed that I have never missed a payment. They sent me an email reply confirming as such and a file which I can't interpret. It appears to be something meant to send to the credit bureaus. However, what they are reporting as a late payment with XXXX is from late XX/XX/XXXX. I was wowed and tricked into attending this school by unfair practices the recruiters made. They painted this picture of state of the art equipment and other " bells and whistles '' the school allegedly had. Once there I was told I needed loans to pay for tuition. I have a loan with First Associates from back in XX/XX/2013 but I never took the course. I tried with no avail over the years to get it resolved and they are unwilling to resolve it. Was tricked into applying for a private loan with peaks under the guise that it would be a part of my existing loans with XXXX XXXX. Peaks offers no provisions for a deferment and refuses to offer me any assistance with repayment, I 'm XXXX dollars in dept and XXXX dollars behind, since I was not able to make my payment, my account is now XXXX days delinquent. If they had offered a forebearence option or an income based repayment like XXXX XXXX does, I would not be in this situation. Their collectors are calling multiple times a day. I opened this loan in XX/XX/2016 to pay for a education program. I had times of hardships, and kept in contact with the company for payment arrangements. I had automatic payments come out of my account and they are not showing up or being acknowledged by the company. When I try to call the company to pay the rest of my account off and figure out where my money was going they hang up or leave me on hold for extended periods of time until I hang up. I was forced into a loan situation using Peaks Loans instead of the XXXX loans i wanted to use while attending XXXX. I would like to get out of these loans but i can not get a loan to consolidate the payments at a lower rate than the 11 % i am being charged now. This company has alos reported that my loans were past due at times that they were n't and would randomly report that i was 90 days past due and then the next month state that i was current. After hearing the settlement that was reached by the CFPB and XXXX/Peaks it is my understanding that the remaining balances owed to these private lenders is now discharged. I have reached out to Peaks numerous times to have the amount roughly ($10,000) reimbursed to me but they will disagree. It is only fair that students that paid their debt off in full receive the same treatment that other students received by getting their loans discharged.

I first got into trouble with making student loan after receiving a forbearance or deferment from First Associates of a few months.
