I spoke with XXXX XXXX who called on XX/XX/XXXX, and was told this debt was pending attorney review but wasn't told I still had time to respond. Please request to review the recorded calls from them. I was offered a settlement in payments and gave my debit card #, because right now more legal disputes is not what I am looking for. I called them on XX/XX/XXXX, because I mistakenly confused a 1099 I received ( and submitted with my tax returns ) with a similar amount of debt discharged, and an older credit bill that I mistakenly wrote 1099 on ( when I was verifying this information by calling the creditors I settled debts with ahead of preparing to file my XXXX tax returns ) and said I believed I paid the debt. I called back ( and received a call and voicemail from a credit repair agency called XXXX XXXX, not leaving their company name but only the representative name, who I hadn't called per my phone records but they confirmed the date and time I called when I actually dialed another phone # looking for the right agency relevant to my debts. ) I wrote back to the email address I was provided to send in the proof of payment/1099 after going through my files, finding the original debt showing I had until XXXX to respond with no mention of attorney review. Below is the copied/pasted email I sent on XXXX after realizing I was mistaken and they were too so I wanted to get clarification ( which I'll also send as an attachment along with a copy of the debt itself ). I never received a call or email back from anyone at XXXX XXXX, and emailed back on XXXX asking for receipt of this email. Today I received an email that there was an update to my XXXX credit report, and see that this debt was added to collections on XX/XX/XXXX by XXXX XXXX XXXX when the letter I asked to be acknowledged says they must stop collections if I write to them. I made a mistake and caused some confusion to myself and them, but I did my due diligence to clarify it and am not trying to get out of paying the debt which is rightfully mine. I settled several debts last year, and have every intention to pay what's rightfully owed as I can, key word.. rightfully. However I refuse to spend unnecessary time and energy on any creditor 's abuse tactics especially when this is not the only problematic debt I have with regards to the means in which there is an attempt to be collected and when I have to be careful about how I allocate the limited funds certain parties are attacking me for ( which I will be filing complaints on as well ). I'm not 100 % sure what their reasoning is for not replying to me, or calling me back but it also seems that debtors ( and people and companies in general ) dislike when one debt gets settled and theirs is left behind, or someone asks for their rights but seems to have the shorter end of the stick.. leading to retaliatory behavior, which is nothing new for myself or others in this subject unfortunately. Good evening XXXX XXXX, To summarize.. at XXXX XXXX I called the XXXX phone number given to me by XXXX XXXX who called me from the XXXX # on XXXX at XXXXXXXX XXXX to discuss this debt that had been given to him and was now pending attorney review, so he wanted to know my intentions. During today 's call I spoke with an agent named XXXX, who gave me this email address as I thought I realized while going through some papers and notes earlier that I already paid this debt ( through a different creditor ) and received a 1099, after making a payment arrangement. I also realize I was wrong in my confusion and haven't paid this debt yet, but received a 1099 for a discharge of {$780.00} from XXXX XXXX XXXX XXXX which has nothing to do with XXXX XXXX and mistakenly wrote a note of receiving a 1099 on the wrong debt document. I have piles of documents to go through and verify so this is my fault and I truly apologize for any inconvenience and confusion. I have the original debt document mailed to me by your agency, for your confirmation so please see attached. XXXX was very kind and understanding with my circumstances, and I don't want to blame your company for handling anything wrong especially when I understand debts are passed around and creditors/agents are just trying to do their job, but I just want to verify some things if you could please answer the below. 1. In that I had until the XXXX to write to you guys, and the original debt says nothing about attorney review being the next step, why was that even mentioned on the call on XX/XX/XXXX? 2. XXXX confirmed my payment installment was cancelled, but please confirm this in writing. I have intentions of eventually clearing this, when I can, but I won't be pressured into making payments when I'm not in a legal situation and obligated to. 3. I spoke with XXXX XXXX, who made the arrangement, and was told by XXXX that you are the supervisor. XXXX XXXX ' name is on the payment arrangement, and on the letter mailed to me. I just want to understand why I was reached out to by XXXX on the XXXX if XXXX XXXX is my account manager. 4. As I mentioned during today 's call, the IRS may still be reviewing my returns ( and is holding onto some of my refunds ) due to reasons which I'm not sure I'm obligated to disclose by law. As mentioned on the call with XXXX on the XXXX, my car was towed to a shop and unfortunately I wasn't approved for a payment plan. It's still in the shop despite having hefty amounts of money put into it this past year alone to have it repaired ( let alone being repaired just 2 months ago ), and I have serious housing issues, medical issues, galore to consider so I have no choice but to be choosy in where my limited funds are going at the moment. When I can, I will pay this and IF I can, in its entirety regardless of whether through your agency or another. If I rightfully owe it, I will eventually pay it. Circumstances have prevented me from keeping up with payments as I used to whether my accounts were open or charged off, which my records can clearly show despite whatever discrepancies may or may not show due to the ways the information is collected/reported. 5. There are several phone # 's connecting to your company, which makes it confusing to keep track of how to get in touch with your creditor. Just an FYI. You have this from me, in writing, so I would appreciate the answers in writing, please and thank you! XXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX NJ XXXX

Collection Company : Financial Recovery Services Inc. Phone : ( XXXX ) - XXXX - XXXX Address : Financial Recovery Services , Inc . XXXX XXXX XXXX XXXX, MN XXXX & XXXX XXXX XXXX XXXX, CA XXXX Complaint : I am requesting a formal escalation to the FTC to include a full investigation into the unlawful and deceptive business practices of Financial Recovery Services Inc., its executive management team, in house collection team and any affiliated collection service companies. Currently I ( and members of my family are being attacked regarding a debt tied to my SSN ) via harassment by Financial Recovery Services Inc. regarding a debt they currently hold under my SSN. Each of my creditors, on every account that is going unpaid due to my inability to pay approximately {$480000.00} dollars in debts to various creditors and the IRS. Each creditor was notified in writing that I will be filing for bankruptcy as soon as I have enough money to secure an affordable attorney and cover my filing fees. For each company I submitted and verified that they received my request for a cease and desist for no contact - with additional directions to require them to mark the account in a manner that if the debt was outsourced for collection that they would see the account notated for no contact as well. Financial Recovery Services Inc. has willfully engaged in a complete disregard for my request despite them receiving a SECONDARY cease and desist request with notice of intent to file bankruptcy delivered to : XXXX XXXX XXXX XXXX, MN XXXX & XXXX XXXX XXXX XXXX, CA XXXX Their company consistently operates outside of federal protections regarding debt collection and following their unsuccessful attempts to bully and harass me into paying a debt that I can not pay they have begun their persistent aggravated contact attempts to my family members and roommates including an onslaught of daily phone calls to my father ( same name ), who lives in a different time zone and they call him between the hours of XXXX and XXXX XXXX his local time. Financial Recovery Services Inc. is further advised for immediate notice in this escalation complaint addressed to the CFPB and FTC to cease and desist any and all communications with me, my employers ( past, present, future ) and to discontinue their harassment, intimidation, and contact with my relatives/roommates/associates. As well as to black list my social security number and bar any accounts past, present, or future from any kind of contact. I feel I am under extreme duress from their relentless refusal to cease their harassment and communications to 3rd parties disclosing my debt. Financial Recovery Services Inc. has received the separate notice advising that I am having to file a bankruptcy and Im getting together my filing fees. I dont have the funds at this time and although there are several legal firms who have offered to take up my harassment case against Financial Recovery Services Inc. in a class action claim at no cost upfront ; my bankruptcy filing is a different issue it takes time to get together the funding for that with my family providing assistance when they can. There is no confusion regarding my clear communication to Financial Recovery Services Inc.. In order to fraudulently obtain a default court judgement in their favor, they are consciously falsifying their contact records and will deny any receipt of my correspondence and continue to aggressively collect on a debt held by their offices. I am certain they have falsified their records. In the process of their aggressive collection efforts even after receiving my cease and desist requests with notification of bankruptcy intent ; they have exposed my private financial issues to my family members and my roommates. Their actions have put an agonizing amount of stress on me and ruined my mental health state. I have also escalated a formal complaint including documentation to the Virginia State Attorney Generals office for investigation into the business dealings of Financial Recovery Services Inc. in my state. Regarding my concerns, I am requesting a further investigation into Financial Recovery Services Inc. including a full review of their business practices and detailed audit of other consumer complaints like mine against their company. They can not be allowed to continue operating beyond the scope of required business practices for a debt collection agency. After consulting with a legal advocate attorney who is handling other complaints against Financial Recovery Services Inc., I intend to seek all options through class action or individual suit including any compensation available to me based on the array of evidence ; and their intimidation and blatant disregard for the protective laws in place by flat out refusing to abide by my cease and desist requests for no contact along with an additional refusal even after receiving notice of my intent to file bankruptcy. This notice of complaint to be filed with the CFPB and FTC as well as the Virginia State Attorney Generals office serves as notice of my grievances with this collection company.

This is in regards to a debt collection agency listed on my credit report as XXXX XXXX XXXX XXXX XXXX XXXX, SC XXXX Also doing business as XXXX XXXX XXXX out of Minnesota. The following is a letter that I sent to the company via certified mail in which I received a return receipt on XX/XX/XXXX. I sent this letter in the allotted time allowed to respond. This agency continued to report information to all three credit bureaus during the dispute and made no notations on the account that it was being disputed by me. It was reported on XX/XX/XXXX well after they received the letter requesting documentation validating and verifying the debt. I have not, to date ( XX/XX/XXXX ), received any of the information requested. I contacted XXXX to dispute the debt and after their investigation the debt was deleted from my XXXX account but appears on XXXX and XXXX. XX/XX/XXXX To Whom it may concern : This is in response to a letter I received concerning This is notice that your claim is being disputed and validation of the alleged debt is requested. I am requesting proof that I am the party you are asking to pay pursuant to 15 USC 1692g section809 ( b ) of the FDCPA. Please provide the following documentation : *Original credit application/written agreement signed by person that you say the alleged debt belongs to. *Please provide a copy of the executed contract in ( Credit Card Company ) possession setting forth the terms the alleged debtor agreed to in connection with the card at the beginning. *Please provide a copy of any modifications to those terms specifically agreed to by the alleged debtor *Please provide a copy of all original statements from the beginning of time the said contract was signed to the present *Please produce details regarding alleged charges by amount, type and date. Not just alleged owed total amount. *Please produce evidence of all payments received *Name and address of the alleged creditor By law, the collection agency is required to trace in his statement of claim the derivation of the cause of action from his assigner that the agency is in fact, the present owner of the cause of action so that I may dispute or challenge the alleged debt or claim against me. There has never been an exchange of money or items of value between me ( alleged debtor ) and your collection agency. I have never entered into any contractual or debtor/creditor arrangements. Please provide consideration that you have a valid, binding and enforceable agreement or contract to prove alleged debt. If your collection agency has made an agreement with the original collector of alleged debt, the alleged debtor ( I ) was not a party to those terms. Therefore, this is lack of privity. The law states that the debt collector can not collect any amount of money that is not permitted by law or by the agreement and because there has been not agreement between the alleged debtor and your collection agency, no collection can be sustained I respectfully request the above documentation within 30 days. Once all of the above documentation is received I will require 30 days to investigate this information and to consult with an attorney. Should your office fail to respond to this validation request all references to this account must be deleted and completely removed from my credit report and a copy of such deletion request shall be sent to me immediately. I will not consider the alleged debt if any portion of the above is not completed and returned with copies of all the requested documents. This is a request for debt validation made pursuant to the Fair Debt Collection Practices Act. Thank you,

I sent a debt validation and proof of claim letter to XXXX XXXX XXXX pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g, whom another debt collection company ( XXXX XXXX XXXX ) responded to my inquiry that they manage referenced account for XXXX XXXX XXXX. I do not know this company, I had no knowledge that this company existed because I never received the initial notice from this company, and I have not given ANY company written consent unless otherwise through inquiry for debt validation. The initial letter that I sent to XXXX XXXX XXXX was for debt validation and proof of claim. XXXX XXXX XXXX has not responded to my request or validation. In responding to the debt collection letter from XXXX XXXX XXXX XXXX, it is very confusing and frustrating because I have since learned that there are 3 other companies besides XXXX that has collected or tried to collect on this debt that XXXX fully knew was a discharged debt in bankruptcy because XXXX has been reporting this debt as " being discharged in bankruptcy '' on my XXXX credit report since XX/XX/XXXX. My bankruptcy was discharged in XX/XX/XXXX. This debt is currently being claimed as a debt by multiple debt collectors as follows by comparing the debt collection notices that I have received : XXXX XXXX XXXX, XXXX. ( original creditor ) XXXX. XXXX XXXX XXXX ( reporting to credit reporting agency XXXX with status updated XX/XX/XXXX - month/year in which the bankruptcy was filed ) 2. XXXX XXXX XXXX, XXXX XX/XX/XXXX XXXX. XXXX XXXX XXXX XXXX XXXX XX/XX/XXXX XXXX. XXXX XXXX XXXX ( received 2 notices on XX/XX/XXXX ) I have XXXX XXXX mailed an Affidavit of Proof to XXXX XXXX XXXX and invoice of violations dated for XX/XX/XXXX. I have received 2 summons to appear for before XXXX XXXX on XXXX XXXX XXXX ; XXXX, XXXX XXXX on the XXXX day of XXXX, XXXX at XXXX A.M. in declaring that I owe {$620.00} plus {$81.00} in court costs. I have really been stressed out because now I have to miss work and attend a court proceeding in which I have contacted these debt collectors and in their responses back to me, not one debt collector stated that they were filing a lawsuit and that I need to respond to it. As a result of receiving the 2 summons, Summons # 1 was left on my doorstep for everyone or anyone who walked by my apartment that day ( defamation of character ). I have video showing where the person left it. There was no business card or anything, so I don't know who could've put it there. Summons # 2 was in my mail box on the day of XX/XX/XXXX. It was opened in my mailbox and appeared that the envelope was never sealed. And I am confused and frustrated because I am being contacted by a law firm ( XXXX XXXX XXXX XXXX ) that initially stated that they were a debt collector and now that same debt collector/law firm is representing XXXX XXXX XXXX XXXX XXXX court proceeding.

VALIDATION OF ACCOUNT Account # : XXXX To Whom It May Concern, I neither affirm, nor deny this purported debt. You claim I owe your company $ XXXX. This letter is being sent to you in response to an entry made on my Credit Report dated [ date ]. Please be advised that this is not a refusal to pay the debt, but a notice sent pursuant to the Fair Debt Collection Practices Act, 1 : USC 1692g Sec 809 ( b ) that your claim that I owe you money is disputed, and validation is requested. Under the Fair Debt Collections Practices Act, I have the right to request validation of the debt you say I owe you. I am requesting proof that I am the correct party, and there is some contractual obligation which is binding on me to pay this debt. This is NOT a request for verification via XXXX or proof of my mailing address, but a request for VALIDATION made pursuant to the above named Title and Section of the Fair Debt Collection Practices Act. Reporting inaccurate and unsubstantiated information to a credit reporting agency may constitute fraud under federal law. Compliance with this request is required under the laws of state and federal statutes. Debt validation includes the following : 1. Who was the original creditor on this account, and what was the account number? 2. What was the original amount owed? Please provide a complete payment history, starting with the original creditor. 3. Please provide me documentation that indicates that I agreed to pay someone this sum of money. 4. What was the original date of delinquency for this account? 5. Agreement that grants you the authority to collect on this alleged debt, or proof of acquisition by assignment. 6. What did you pay for this account, and how did you calculate the current amount owed? I require compliance with the terms and conditions of this letter within 30 days of your certified receipt, or a complete removal from my credit profile, in writing, of your claim. In the event of noncompliance, I reserve the right to file charges and/or complaints with the FTC, and appropriate county, state, and federal authorities. I also hereby reserve my right to take private civil action against your company to recover damages. In addition, the Fair Credit Reporting Act states that while this item is being investigated you must indicate to the bureau that the account is under dispute and will remove/cease from reporting this information to the Credit Reporting Agency until full validation has been completed. I have sent a copy of this request for validation to the XXXX national Credit Reporting Agencies to begin their 30-day investigational process concurrent with your investigation.

This is not an account that is owned by me and I did not authorize anyone to open this account in my name. I am a recovering victim of ID Theft which arose from a stolen wallet in XX/XX/XXXX and I have kept a vigilant eye on my credit so in XX/XX/XXXX I aquired my ( 3 ) credit reports from each of the bureaus and was horrified to find that there are ( 13 ) unknown accounts on my credit and numerous amounts of inquiries which I did not authorize therefore, I exercise my right to request validation for each of these accounts. On XX/XX/XXXX using the address and account number reported on my credit report I wrote my first letter to Financial Recovery Service , Inc account number XXXX who claim that I owe the amount of {$810.00}. On XX/XX/XXXX I received a response from the collection agent in the form of statements as proof of validation. On XX/XX/XXXX I wrote again mailing it by USPS certified mail. I informed them again that the account was unknown to me and to determine if this is an issue of identity theft or somebody with the same name I requested information verifying the transaction and details such as ; 1. was this account opened in person or on line 2. what identification was used to verify the customer opening the account my request was and still is for validation including competent evidence bearing my signature and a copy of the instrument used to secure a contractual agreement that now proves I am obligated to pay. I made it clear in my letters that the negative marks found on my credit report held by the ( 3 ) reporting bureaus and reported by their company or any other company that they represent for this debt that I do not owe IS a violation of the FCRA and FDCPA and I requested that if this debt can not not be validated this company must take steps to have all reporting bureaus delete this entry immediately. It is ridiculous that it is now over 8 months since my initial request for validation which is now well over the 30-45 day time frame as per law and this collection company is out of compliance. Under advise, I wish to informed Financial Recovery Services, Inc that I am prepared to take steps to file a small claim case in my county small claims court. I would like to make this one last good faith effort and ask for the assistance of the CFPB in obtaining one of two things 1. that this company provide me with full debt validation as per FCRA & FDCPA 2. deletion of this invalidated account from my credit reports

XXXX PST XX/XX/21 Spoke to a lady who would not respect the aspect of PII. Gave enough information to verify myself to include my name, states of residence ( to match on file ) and the like. I asked for verification of debt and was informed she wouldnt do that without verifying personal information ( which I already did ). Asked to be transferred to a supervisor. 2nd lady did the same thing. Asked for a verification of debt denied asked to be transferred. Spoke to a 3rd individual, male, same issue, and then transferred to a woman named XXXX. XXXX stated she could not proceed with anything unless verifying information. She read off my address and I told her that I have resided in this residence for 2 years almost 3 years now. I again, asked for a verification of debt/business matter in writing and she said okay I am ending this call after. My FDCA rights have been violated for verification of debt in writing. Additionally, nothing is on my credit report with XXXX in any shape/form/way. XX/XX/21 - missed their call at XXXX ( no voice mail left ) XX/XX/21 - same situation occurred at XXXX when asked about myself and was hung up on XX/XX/21 - no voicemail given on their call at XXXX PST XX/XX/21 - no voicemail given on their call at XXXX PST XX/XX/21 - no voicemail given on their call at XXXX PST XX/XX/21 - no voicemail given on their call at XXXX PST If it was " such '' of an important business matter, then a voicemail would be left and these practices of " DENYING '' a written/printed letter of verification without " attempting '' to obtain PII such as social security numbers, DOB and the like ( which can all be used to fraudulently obtain someones identity and the like ). Ex-military, well versed in these laws/regulations and prior experience in this industry as well. Based on the laws, first phone call received XX/XX/21 have 30 days from this date to request. Being XX/XX/21 ( 7 days ), this is within that time frame. Being denied and refused to do so to verify this matter is a violation of said law thus should be removed/denied any adverse affects to me to include my credit report/history. I received a letter from a debt collection company by the name of Financial Recovery Services INC dated XX/XX/XXXX - which states that the current creditor is XXXX XXXX who is in affiliation with XXXX XXXX. The letter they sent me clearly violates the FDCPA 807 ( 10 ) " False or misleading representations '' in which the preclude to the letter states " Assigned as a Pre-Legal Account ''. The letter continues on with multiple misleading and confusing statements cited as : If we can not resolve this account, our client will place the account with a law firm and in the same paragraph goes on to state We do not make any decision whether to place any account with a law firm as that decision rests solely with our client. No decision will be made regarding whether to place any account with a law firm until after the end of time frame described below. This is clearly misleading as in one sentence they tell me it WILL be placed with a law firm and a few sentences later it is inferred that it may or may not be sent to a law firm by the beginning sentence of No decision will be made regarding whether to place. This is an illegal practice under FDCPA in which the debt collector is threatening legal action that has no proven intent and is also violation committed by Financial Recovery Services under FDCPA 807 ( G ) ( 5 ). Any letter from a debt collector or creditor has to be clear and concise and be able to be understood by the least sophisticated consumer. The materiality element of the Least Sophisticated Debtor Standard does not hinge on what an ordinary individual might reasonably interpret from a debtors communication, but rather, a material statement is one that has a natural tendency to influence or has the capability of influencing the decision of the decisionmaking body to which it was addressed. Id. Here, the relevant decisionmaking body is the least sophisticated debtor. Id. ( citing XXXX v. XXXX XXXX, XXXX XXXX XXXX, XXXX ( XXXX Cir. XXXX ). Furthermore, Financial Recovery Services states that the " current creditor '' is XXXX XXXX. Under the FDCPA the term " creditor '' is defined as anyone who extends or offers credit. Financial Recovery Services nor XXXX XXXX ( XXXX XXXX ) has ever extended or offered any credit to me.

I am filing this report because, at last, Financial Recovery Services , Inc. and XXXX XXXX XXXX XXXX responded to my requests when I informed them that I'd been an identity theft victim. They sent me the record of the application I requested, with an early bank statement of the fraudulent account opened years ago. I informed them that the account was subject to identity theft and fraud because I had never opened the account and used it. I have looked at the record of application because when a bank opens an account, an application is filed for it. The record of the application states information that is not mine, and the original card was sent elsewhere and not to where I resided. In addition, it has an email that I'm unaware of and never used before. The application is entirely frivolous because I never filed such a credit application. I have never used any XXXX XXXX XXXX XXXX or been a customer. This account resulted from identity theft, and the account is not mine. Collections being on a fraudulent account is illegal. XXXX XXXX XXXX must remove this frivolous account because it resulted from identity theft, and they are harming my financial credit report. However, XXXX XXXX XXXX claims that the account is mine despite the identity thieves ' fraudulent information. I am highly disappointed that they didn't even investigate this matter. They sent me a letter dated XXXX that stated, " We are unable to approve your fraud claim because they concluded that the charges were made by you or someone who had authority to use the account. '' I never had access to this account, and I do not know who had access to it because it resulted from identity theft. I do not know if these banks understand what " identity theft '' means. Identity thieves used my social security number, date of birth, and name to open an account and benefit from them without my knowledge or consent. The information I examined in the application record was never part of my personal information. XXXX XXXX XXXX insists that this fraudulent account resulting from identity theft is mine. The account is not mine ; the account was never mine. I never opened this account, applied to this account, received a card for this account, and I never used this account.

To Whom It May Concern, I received a notice from Financial Recovery Services , Inc. ( FRS ) maybe a month ago about a debt from a XXXX card I had not used in a long time. I had previously stopped using this card and aggressively paid the debt off. I do not think I've purchased anything on the card in years. The debt was paid and I pretty much put the card out of my mind. I called the collector and explained this but they said I owed {$6300.00} on the card. I attempted to log into my XXXX XXXX app but could not. I couldn't log in online either, I called XXXX and was told in so many words that the account had been closed and sent to collections and they couldn't do anything with the account anymore. I asked what the charges had been for but they couldn't tell me. They told me that I would have to make a request through the collection agency. So I had FRS request copies of the statements from XXXX who then mailed them to me and I received them this week. The statements start with a XX/XX/XXXX - XX/XX/XXXX period and is filled with charges made all in Ohio. The charges range from restaurants in XXXX to gas stations to movie theatres. I live in Washington State and haven't spent any time in Ohio. This continues to the end of a period that ends on XX/XX/XXXX. Then there are some more statements where late fees are applied and interest but I don't see anymore charges. It seems like this fraud predates these statements though since the first statement has a previous balance of {$1900.00}. I requested earlier statements from FRS yesterday ( XX/XX/XXXX ) but was told that whatever was sent to me was more than they had and it wouldn't be possible to get more. I was told I had to file a police report on the identity theft and add that to my dispute claim with them. When I contacted my local police here they got back to me and said that I should file a claim with the FBI since it happened out of WA state the likelihood of them catching anyone was XXXX. The FBI site then redirected me here. Please let me know of anything else I can do to help resolve this matter. Thank you for your time and help.

The original debt was charged off in XXXX, and is not even on any of my credit reports. How can a charged off debt over 10 years old be purchased? It was not purchased and this collection post is a complete fraud perpetuated against XXXX, and an abuse of my rights under FCRA and FDCPA. The attached post on my credit bureau claims that a debt was purchased by a third party. At no time from my initial dispute was a debt validated. Under Federal Trade Commission guidelines, a debt must be proved, showing actual hard copy transfer. That does not mean a letter of transfer, but an actual transfer with signature backup. The debt purchase industry is the largest scam ongoing against the American consumer. Both the collection agency/debt purchaser are in violation of their subscriber agreement with every credit reporting agency. At no time was the debt validated, and the initial timeline from the original creditor has been cut off, and thus the debt is illegally being re-aged to benefit both the original creditor and the illegal debt collection process. Both the original trade line must be removed along with the invalid collection process. This problem will continue to exist since the XXXX XXXX XXXX XXXX XXXX Supreme Court decision of XX/XX/XXXX, whereas the third party purchase voids the individuals rights under the Fair Debt Collection Practices Act. Since there is no proof of true hard copy transfer and ownership, the collection is VOID and the collection process must cease and my file for both accounts must purge. These items must be deleted permanently and my files need to be purged. My information was obtained through a debt pooling process that should be terminated by the Federal Trade Commission. XXXX XXXX has committed a fraudulent act by even posting my antiquated information and there should be sanctions taken against this company. Now XXXX XXXX is extending the fraudulent activity to a fourth party collection service called Financial Recovery Services Inc. There is absolutely no connection to a valid debt, and my name must be deleted immediately from all corresponding files.

According the FCRA AND FDCPA, XXXX XXXX and Financial recovery services are in violation of my consumer rights. They have sent me several collections letters of accounts that I don't have knowledge on, and that I have requested investigations on for unfair and deceptive practices. They have not performed any proper investigations, and instead have " Assigned '' their debt to other entities that they own or are affiliated with, with the goal of re inserting this file into my credit reports under a different debt collectors name. I believe they are engaging in unfair and deceptive practices by definition of the FCRA and FDCPA. The accounts are listed below : XXXX XXXX XXXX 15 US.C 1681 section 602 A. States I have the right to privacy. 15 U.S.C 1681 Section 604 A Section 2 : It also states a consumer reporting agency can not furnish a account without my written instructions 15 U.S.C 1681c. I have no idea who this caller is but I've blocked MULTIPLE numbers from " XXXX XXXX '' all of the employees use alliterations and fake names so another I spoke to was XXXX XXXX for example. They've called from XXXX starting XX/XX/XXXX Then from XXXX from XX/XX/XXXX Then it was XXXX from XX/XX/XXXX Now its XXXX which called today Didn't know who it was other than a " recorded line '' and they refused to say who they were with other than XXXX. I called XXXX times and finally after breaking down and getting upset about the situation did the fourth time they finally say " financial recovery services ''. XXXX of them VERY aggressively said " sir, we are a COMPANY '' which doesn't mean anything. I could find no details on the numbers that were calling other than when calling the other phone numbers, the voice clearly being " XXXX XXXX '' on all of the other examples online of calls recorded from those previous numbers. Have no idea who these people are, they refuse to tell me and only after I tell them how badly they've stalked me for months do they tell me. I look it up and find that failure to disclose your company is in violation of the Fair Debt Collection Practices Act listed on their website. https : XXXX Specifically ; Section XXXX of the Fdcpa under False or Misleading Representations : " use any other name than the true name of the debt XXXX business, company, or organization '' Bluntly, when I said I didn't know who XXXX was and I needed more clarification, that failed to disclose the true name of their business multiple times on a " recorded line ''. This lead to me feeling harassed and threatened for months as I had unknown calls swarming me. This is illegal given they claim to adhere to the FDCPA but do not disclose the true name of the business which a deceptive practice. Lastly, all numbers I've given are not found on " Financial Recovery Services '' website, so ultimately, I still don't know who is calling. If it is XXXX XXXX XXXX, they are violating the law under FDCPA.

I XXXX XXXX have made several requests for proof that a creditor once originated with a national financial institution that has FDIC insurance can sell off a debt that is part of a securitized trust. Then these same debt buyers that used to be known as collection agencies could re-assign the debt to a fourth party for collection enforcement. This process of stating that debts are being purchased by a third party and then enforced by a fourth party is the larges scam in America. The U. S. Supreme Court decision in XX/XX/2017 known as XXXX XXXX XXXX XXXX XXXX XXXX is responsible for this scam. This decision basically states that since a third party purchases the debt, that my rights under the Fair Debt Collection Practices Act is VOID. The problem is that almost all unsecured debts are sold off to XXXX XXXX in various traunces in securitized trusts. There simply is no resolution where the debt can be purchased, only that the debt can be assigned for collection purposes. Each financial institution must file a 10Q filing quarterly with the Securities and Exchange Commission. The rules on debts being charged off is with the Federal Deposit Insurance Corporation through the FDIC Act, Code 5000. A debt can be classified either standard or sub-standard. Debts over 180 days late must go into the sub-standard category and written off on a quarterly 10Q SEC filing. These charge 0ffs usually are submitted in the tens of millions of dollars. So its virtually for these debts to be sold..period. Accordingly, I request full validation proving the debt purchase. Secondly, I will entertain a very low settlement agreement to put my dispute to rest. All of the settlements can be submitted through the CFPB portal email address submitted. I am still within my rights under the FDCPA since proof of a purchase to a third party has never been established.

I open a credit card in the store with XXXX two years ago I have not received a statement since. Then I received a letter from a collection agency stating I owed {$290.00}. I explained to XXXX that I never received any statements the representative stated that the statements were coming back to XXXX return to sender. XXXX had the wrong address that was why I never received the statements. However instead of calling me two years ago to correct the situation they just ignored the problem. When I called XXXX they told me the account was no longer with them to call the collections agency I called the collections agency and they staid to call XXXX back and forth for days with no results. The last person I spoke to was XXXX employee id XXXX she told me there is not anything she could do that I had to pay the total amount I feel this is a bank error and I should only have to pay what the original charge was {$44.00} not {$290.00} Also XXXX was rude and did not try to assist me in anyway. XXXX said over and over again that XXXX will not settle the amount that I had to called the collection agency who already told me to call XXXX for XXXX to waive the {$250.00} because it was a bank error The account was open in XX/XX/2015 agreed however the cashier entered my information and I was not able to confirm the address from the register therefore because I never received the card I forgot about the original charge of {$44.00} I did not receive a call from XXXX on XX/XX/2015 my question to XXXX is if you receive returned mailed from me why did n't anyone reach out to me why was all the late fees allowed to accumulate? This seems to be unfair, deceptive and fraudulent charges due to XXXX not following up or doing the proper due diligence for the customer XXXX is just trying to take advantage of a senior citiz

Good Evening ; I was going through my credit report after receiving several aggressive calls from a debt collector company about an alleged debt. I went ahead and paid, but I keep reviewing my credit report it shows on my credit with a balance of over {$200.00} ... .I 've asked them and the credit bureaus to please clarify the payment status, comments, balance and account number as they might be erroneous. Also I have disputed this item with the credit reporting agency and they reported you confirmed the account as valid. I honestly do not believe to ever have any relationship with this collection agency or original creditor. Also there are several inaccuracies with this account the way it's reporting and that's a total violation of FCRA and FDCPA laws and regulations. In a good faith effort to resolve the matter amicably, I must demand proof of this debt, specifically the alleged contract or other instrument bearing my signature, as well as proof of your authority in this matter. Absent such proof, you must correct any erroneous reports of this past debt as mine. I am writing to request that you please provide the following information : 1. Please evidence your authorization under 15 USC 1692 ( e ) and 15 USC 1692 ( f ) in this alleged matter. 2. What is your authorization of law for your collection of information? 3. What is your authorization of law for your collection of this alleged debt? 4. Please evidence your authorization to do business or operate in this state. 5. Please evidence proof of the alleged debt, including the alleged contract or other instrument bearing my signature. 6. Please provide a complete account history, including any charges added for collection activity

Started receiving calls from phone number XXXX Caller ID XXXX XXXX on XX/XX/2022 at XXXX, XXXX, XXXX & today at XXXX, & XXXX XXXX The caller each time was a man 's voice telling me that they are trying to collect a XXXX credit card debt in the amount of {$18.00}?? XXXX. When I try to explain that the debt has been resolved, I'm told that they are taking me to court and I can explain it to a judge. They are rude and talk over me and threaten to have a lien put on my income or bank account. As I try to inform them that I am on XXXX and the account has been satisfied. I'm told by one caller, " I better get my money back because I am going to court '', the other caller, '' It doesn't matter what i say because I'm being sued, and I can tell it to a judge, good luck in court, then the call is abruptly ended. I tied to research the company and discovered there is no such collection company by that name and that the number is a cell phone number without any identifying contact. The number does come up as a medium risk on my caller ID, however, I have received call ID as a risk, and they were legit. I therefore was and am concerned about receiving a call from anyone purposefully trying to fraudulently scam me or any other XXXX XXXX person. Please look into this matter and put a stop to these frauds who seek to take advantage of vulnerable citizens. Something that eventually made me suspicious of this caller was one of the callers told me that XXXX no loner exist, which is completely a lie. XXXX does in fact exist and their XXXX credit card division was sold to XXXX XXXX whom I settled the final part of my debt with.

Received a call on XXXX XX/XX/XXXX from an agent from Financial Recovery Services, a debt collector, claiming that I owed {$810.00} for a " XXXX '' account that was charged off in XX/XX/XXXX and now owned by a company called XXXX XXXX XXXX. I stated to the agent that the debt was not mine and stated that I needed a debt verification as the agent could not even tell me what address I was living at during the time this debt or account was supposedly applied for. I have not received any documentation from the company other than a standard debt letter which I am also taking action to dispute ( see attached ) and request all documentation on this account such as completed applications forms or promissory notes, emails and email addresses, addresses, phone numbers, names, SSN # s, etc. It is also suspect that out of the blue, a debt collector would try to collect on debt that is at least XXXX years old ( based on the phone call and letter I received ) as I have never been contacted about this account previously. XXXX XXXX XXXX XXXX reveals very little as I could find any contact information or website for them except that it is a foreign limited liability company and appears to have been incorporated in multiple states throughout the XXXX calendar year. I believe that XXXX XXXX XXXX is running a scam where they may take fraudulent or time barred debt and misrepresent it to debt collectors as " owed '' and debt collectors attempt to collect the debt without confirming the validity of the debt. This an evil practice that preys upon vulnerable people to take what may be the last dollars in their bank account.

I am writing this letter due to the actions that Financial Recovery Services , Inc has taken that have completely disregarded my rights under the FCRA, and FDCPA in which they have a legal duty to comply to. I have recently sent them another letter on XX/XX/2022 after carefully scrutinizing my credit report. They have failed to validate a debt at my request, which is a FDCPA violation and they continued to report a disputed debt to the Credit Bureaus : another FCRA violation. It is incumbent upon them under the law they prove that they have the legal right to collect this debt from me, and that they are allowed to do so in the state of North Carolina. What they have provided me with is a statement with the original creditors details, as well as information stating that they are attempting to collect a debt that XXXX XXXX, LLC is also claiming that I owe to them as well. This is not a validation of debt letter containing a contract bearing my personal wet signature as proof that I hold this contract with their company or with XXXX XXXX, XXXX. They are using unfair and deceptive practices in order to collect a debt for which I did not have a contractual obligation with Financial Recovery Services , Inc., and that they have purchased from the original creditor. For the above reasons, I have decided to file a complaint with Consumer Financial Protection Bureau for the immediate removal of this inaccurate information from my credit report. Sincerely yours, XXXX XXXX

The issue is that this debt collection company, Financial Recovery Services , Inc., is attempting to collect a debt on a credit card that resulted from an identity theft. As shown on the credit report, the original creditor was stated as XXXX XXXX XXXX. I contacted XXXX XXXX XXXX and informed them the account or card is not mine because I've been an identity theft victim, and the report is not mine. They should close whatever budget is under my name, remove my information from their records, and delete the entire history because it's not mine. XXXX XXXX Delaware representative asked for an FTC report, which I drafted and sent to them. They told me they would immediately close and remove the account from the credit bureau, and I don't have to worry about this account again. However, now it continuously reports, and I keep getting harassed by a collection agency attempting to collect a debt on a credit card that was opened through identity theft. I informed them that the account or credit card originating from XXXX XXXX XXXX was not mine. They needed to stop attempting to collect a debt under a fraudulent account because it was against the law. However, they refuse to understand and continuously harass me by claiming that this account belongs to me. The report is not mine ; the debt collection is not mine. This fraudulent account was supposed to be removed from the records long ago because it resulted from identity theft, and they refused to remove it.

She stated XXXX services for the amount of {$4900.00}. I told her that I live in a rural farming community and XXXX isnt accessible. Furthermore I have my own vehicles and don't need XXXX services. She asked if I had ever used XXXX ever. I stated I had in XXXX one weekend and in XXXX, but my XXXX account is only connected to my personal bank account. We went back and forth. She asked me if I thought this was fraud. I stated yes. I never heard back until XXXX of XXXX. I again explained the situation. I was asked if I would be willing to fill out an affidavit and I said yes. I did that, had it notorized and returned it. I never heard another word until XXXX of XXXX from Financial Recovery services. At that time I forwarded the affidavit. I followed that up with a letter from an attorney and they have never replied. I would like to get this issue resolved. I would like my credit cleared and I am getting no where.

I had a credit line with XXXX XXXX XXXX ( XXXX XXXX XXXX ). I contacted XXXX XXXX same day but they refused to act on my behalf due to my graduation of the program and no longer being a client of theirs. They supplemented me with the settlement letter as an evidence. Shortly after, Financial Recovery Services called my cellphone in an attempt to collect the full outstanding balance ( pre-settlement agreement amount ) on behalf of XXXX. I explained the situation and they provided me with an email to which they asked to send the settlement letter ( XXXX ) which I have done on XX/XX/XXXX more than a month ago with no response. The derogatory remark and the incorrect outstanding balance are still reflected on my credit reports and significantly impacting my score negatively.

There were not options for me to pick the correct complaint. I had a debt charged off XX/XX/2019 for XXXX Visa, The Bank of XX/XX/XXXX. It was reporting as such on my credit report and I have been slowly working with creditors to get any charge offs settled. The creditor wrote the debt off in XX/XX/XXXXand apparently it went to XXXX XX/XX/XXXX, then in turn sent it to Financial Recovery Services. This last company decided to re-age the account putting it on as a NEW collection account thereby dropping my score 45 points! A collection is before a charge off how can these companies ruin peoples credit and make a buck off a charged off debt and report it as if you went delinquent on a new account recently? There is so much compliance and regulation in every other industry and why are these creditors not regulated, constantly hurting consumers, selling debts over and over and even when they paid NEVER updating the credit? Here I am trying to fix my credit and they can just do what they want and ruin it again. I have disputed this over and over and nothing has changed. I want them to put it back to a charge off and I will settle with them but if I do that now it looks like I just paid a new collection again hurting my credit more. Please advised on any recourse. Thank you

This company continues to call for a debt I have no knowledge of, nor is valid. I advised several very aggressive phone collectors to send me a letter stating specifically what is owed and who the original creditor is and validation of this alleged debt. They state they don't send letters and several just hung up. They also asked me to confirm my information, and try to verify the last four digits of my social security number and date of birth. Any attempt to collect a debt without validating it violates the FDCPA. This company has repeatedly sent mail communications indicating that they are acting on a date for another creditor threatening that it may be placed with a law firm. Further, this company does not have permission to contact me, they don't have my permission to have any information I have asked them repeatedly to cease all communication and to only contact me by mail. I ask there address and they wont give that information, I asked to speak to a supervisor and they hang up. They even hang up as soon as I try to ask a question. Regardless of whether or not you properly validate this debt, all communications concerning this alleged debt shall forever cease and should be removed from my consumer report pursuant to 15 USC 1681a ( 2 ) ( B ).

On XX/XX/XXXX, Financial Recovery Service mailed a letter stating I owe XXXX on a past due account from XXXX XXXX XXXX XXXX Acct ending in XXXX. Date of last payment XXXX. Charge off XXXX. According to XXXX credit report, this account was opened on XXXX, legally paid in full for less than the full balance. Status was updated on XX/XX/XXXX with credit limit of XXXX. On XXXX report, it shows credit limit of XXXX, high balance of XXXX, and paid in settlement, account paid in full for less than full balance with XXXX written off. Date opened XX/XX/XXXX ; date of status XX/XX/XXXX. On XXXX report it shows high balance of XXXX with credit limit of XXXX. Shows as charged off. Last payment made was XXXX ; date updated XXXX. Account was sold to another lender. Now FRS is asking for payment on this debt that was settled in full according to 2 credit bureaus. They have called my cell number 2 to 3 times daily with a disguised phone number to try and get funds out of me. I was willing to work out a settlement offer as trying to clean up the credit reports, however, this is inexcusable being this debt has already been paid and none of the numbers add up correctly for what they are claiming.

I received letter from Financial Recovery Services Inc. that I owe a debt to XXXX now XXXX XXXX XXXX that I never incurred. The first I heard of this was in a letter that I received on XXXX XXXX XXXX. Apparently this transaction occurred in XXXX of XXXX. Besides not ever using the above mentioned services, the time frame was also suspicious in that they would not have contacted me directly but waited a year and an half to send to a collection agency to try to receive payment. I assured them that this was not my debt but they said they would need a copy of a police report to resolve this issue. I contacted the police, made a report and they suggested I come here and file a report. XXXX could or would not tell me what the debt was for or when it occurred just saying i made a small payment in XXXX of XXXX and if I checked my records it would refresh my memory. Well I did just that and no payment of the amount they stated was ever made from any account or credit card I own. I then called the credit bureaus as the police suggested and none of them had any record of any activity on my credit. I do not know the validity of XXXX but all signs point to this being a shakedown.

I sent a validation letter to Financial Recovery Services Inc., asking them to validate the debt that they are claiming that I owe to them, I dont know who these people are, I have never done business with this company before, I do not have a signed contract with this company that says that I agreed to pay them anything. The response that I got from this collection company is 4 copies of a card statement and on 2 of the statements, the due dates are 2 different due dates on the same month, copies of statements of an account, do not prove that this debt belongs to me, I asked this company to provide me with all of the information that I asked them for and they just decided not to, the FCRA is clear when it states that I have a right to dispute this debt and that is what Im doing. I want this company to provide me with the signed contract that says that I have to pay them the amount that they are asking for, if they dont have the contract, I want them to stop asking me to pay them money that I do not owe to them.

Both these companies have just ignored the Fair Credit Reporting Act and decided that I do not matter! Can your company please help me with this?

since your credit bureau has not been able to work directly with the creditor to solve this issue, I am now requesting that you personally verify this account that you are reporting. Section 609 of the FCRA requires that you, upon request, verify any accounts that you are reporting. And I am talking physical verification. I want a copy of the original signed contract. You can not legally report an account that you can not verify. I am asking that you send me copies of the documents that you have in your files as of this date that you used to verify the accuracy of the accounts listed below and if you can not I expect these accounts to be removed from my file immediately. I want to see the original contract with MY signature on it. I do not want a computer printout. If it does not have my signature, its not valid. Your failure to properly verify these accounts has put me in a bind and stopped me from obtain a line of credit.

I recently received a letter from Financial Recovery Services , Inc., XXXX. XXXX XXXX XXXX, MN XXXX XXXX The letter is claiming that they are collecting a debt for a company I never had debts with. They are claiming I owe {$4700.00}, and the original credit is XXXX. I've never heard of that bank in my life. They say in the letter if I even attempt to dispute the debt they will obtain a judgement against me. This is my first time hearing from Financial Recovery, and first time hearing of " my original creditor '' XXXX. I feat to communicate with this company effectively because they immedaitely threaten with a judgement prior to communicating. The letter is worded in a way that says I can file a dispute but the office of Financial Recovery Services will immediately file a judgement against me which is frighting. I am unsure that this debt it mine as I have never had any credit with whomever XXXX is. Thanks

There was not appropriate info for me to pick the right reason for the complaint. I have another complaint against this company for the exact same issue. This is a debt that was CHARGED OFF XX/XX/2020 and this company Financial Recovery XXXX is now reported it as a NEW RECENT COLLECTION ACCOUNT How does it go from a charge off to a collection account. This is re-aging an account which to my knowledge is illegal. These companies are crooked and constantly selling loans and ruining peoples credit. I know I owe the money and I am willing to settle BUT i am not going to unless they report back to a charge off with the correct charged off date and then I settle the charge off My score has dropped significantly because they reported this as a NEW account. How does it go from a right off - charge off to a collection? Its a collection first then a charge off we dont go backwards

I explained the debt is not mine. They sent me some billing info with incorrect addresses and explained are not mines. I was also told by the credit bureaus that my personal data was breached from the credit bureaus and i am still fighting that. I hired a credit repair company to help me with these disputes, as i am new to this. They are not coorporating and states that they are willing to take a settlement. I don't know what else to do so I am finally coming to you guys for some guidance please. They sent me a notice for an obligation to pay. This is the third agency that contacted me in regards to this fraudulent debt.

I was told time and time again that the negative remark and balance would be removed from my account as they would not accept a payment. This negative remark has not been removed. The numbers they call from are slightly different, but I assure you that the XXXX area code numbers are all FRS.

None of the choices really applied so the closest to the problem were selected. Claims from different Collection Agencies regarding their ownership of the same debt. Correspondence back with them did not resolve the situation. The dates of correspondence overlap. Since I do not know who to respond to, I am filing this complaint. My understanding is that only one can have an active, collection authority.
