I had recently agreed with FAMS to a payment deal on my student loanl, and had already begun paying the amount agreed upon. They assured the agreement was settled and nothing could void it. They also collected the payments I had submitted. When I went to pay this month, I could no longer login on the internet to pay through the account number they had given me. When I called to pay by phone, they had told me that XXXX took my debt back and sold it to another debt collector. I asked how that could be, and the man could not answer me. When I called XXXX they said FAMS had never disclosed to them about my payment plan. When I called back FAMS, they blamed XXXX and said they had told XXXX about my payment plan and XXXX still voided it. When I asked FAMS if XXXX and them are the same organization, they said no. Thus, why did XXXX take my payment plan away from FAMS, if they are not one entity? No response. When I asked if XXXX had the authority to do that, he curtly said no. When I asked if FAMS could fix it, he told me only XXXX could, which is why I called XXXX again, whom said only FAMS could. I continued to ask either party whether they were connected or under the same organization, they both denied the other, but XXXX could take away my student debt payment plan after I had agreed with FAMS. It made no sense, and neither party wished to make things clearer for me because both admitted a mistake had been committed but it was " the other 's fault ''. Moreover, all the money I had given to FAMS in monthly payments has vanished as not one person has told me where that money has gone or if it went towards my debt. No one was helping me undo a mistake they both had admitted to have been done. I have called both XXXX and FAMS, a few times, to try and figure what is happening and if they can help me, but, so as to not accept the wrong that has occurred, their customer service has grown meaner by each call. The first time I called each one apologized for the mix-up and blamed the other. When FAMS told me to call back because they would try to speak to XXXX to fix the issue or see what they could, the man began to speak aggressively towards me and tried to deny everything he had said previously, in terms of claiming, that XXXX was not supposed to cancel my payment plan from FAMS : a supposedly separate debt collection agency.Yet, he admitted that he had reported the mistake to XXXX as a managerial complaint, but XXXX was ignoring him. Now, I have a XXXX debt collection agency calling me about the same debt. I feel insecure, unsafe, and incredibly distressed by the fact that XXXX debt collection agencies are fighting over my XXXX debt that I began to pay, and no one can undo the supposed " mistake '' of cancelling my FAMS payment plan and taking the money I paid without even reimbursing me. I would like my payment plan back, and no one at FAMS, XXXX, or the XXXX collector has a clue how to help me, yet they all want me to pay on the same debt. Yet, I WAS! Each one has no idea how to proceed in this issue, and I am terrified that XXXX will take my debt from anyone after a few months pay, and that money will disappear, as it currently has, and I am stuck in limbo trying to figure out what is my payment deal going forward. It is absolutely devastating to feel like your economic load might be lightening, and you have gotten ahead on paying your debts, only to be misled and treated like trash by now XXXX debt collection companies. I repeat because of XXXX, with the assistance of FAMS, I have a total of XXXX debt collection agencies on me for the same student loan I was paying, and that money has not been reimbursed nor will anyone say if it has gone toward my debt. Sad, helpless, and anxious is how I feel because of how cruelly I have been spoken to, my missing money, and the lies.

Reference # : XXXX I received a letter dated XX/XX/2023, from Financial Asset Management Systems Inc. It incorrectly stated I owe three debts ( {$17000.00}, {$6700.00}, and {$2600.00} ) for a total of {$27000.00} to XXXX. This puts Financial Asset Management Systems IncXXXX in multiple violations of the Fair Debt Collection Practices Act ( FDCPA ) and Fair Credit Reporting Act ( FCRA ). I do not owe this debt. On XX/XX/2023, I disputed this debt with a certified mail letter ( XXXX XXXX # XXXX ). Financial Asset Management Systems XXXX received this letter on XX/XX/2023, but did not respond within the XXXX window. Please see the attached XXXX tracking. I do not owe a debt to XXXX. The Fair Debt Collection Practices Act ( FDCPA ) states debt collectors can't use false, deceptive, or misleading practices. This includes misrepresentations about the debt, including : * The amount owed * That the person is an attorney if they are not * False threats to have you arrested * Threats to do things that can not legally be done * Threats to do things that the debt collector has no intention of doing '' This is a debt I do not owe, is uncollectible, and Financial Asset Management Systems Inc. is making threats that legally can not be done and they don't have intent on doing. Financial Asset Management Systems Inc. has also committed a series of Fair Credit Reporting Act ( FCRA ) violations, mentioned below. I have attached their initial communications which clearly show the violations listed below. Violations : 15 U.S. Code 1692c ( a ) Communication with the consumer generally - Without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction, a debt collector may not communicate with a consumer in connection with the collection of any debt. 15 U.S. Code 1692b ( 2 ) Any debt collector communicating with any person other than the consumer for the purpose of acquiring location information about the consumer shall not state that such consumer owes any debt. 15 U.S. Code 1692b ( 5 ) Not use any language or symbol on any envelope or in the contents of any communication effected by the mails or telegram that indicates that the debt collector is in the debt collection business or that the communication relates to the collection of a debt. 15 U.S. Code 1692d ( 2 ) - The use of obscene or profane language or language the natural consequence of which is to abuse the hearer or reader. Impact of Financial Asset Management Errors : These errors have made it nearly impossible to obtain credit of any kind, including buying a house, car, or apartment. These errors have held me back in able to live a normal life as an American citizen. I am seeking the following : According to 15 USC 1681n ( a ) ( 1 ) any actual damages sustained by the customer as a result of the failure or damages of not less than {$100.00} and not more than {$1000.00} ; I want one thousand per violation ( {$4000.00} total ) or immediately stop all collection activities, stop reporting to all three credit bureaus and provide proof in writing. Please see attached invoice for immediate payment. Any continued pursuit of this debt not owed will be met by swift legal action to get it disassociated from my name. THIS IS NOT A DUPLICATE COMPLAINT. IT IS A NEW COMPLAINT. {$430.00} was deducted from my pay check on XX/XX/XXXX. I noticed adecline in my pay on that day. This amount has continuously be deductedfrom my pay check monthly as of XX/XX/XXXX. XXXX will be deducted soon. I called the payroll clerk the very same day and was told that I havebeen garnished. So, I ask for a copy of the forms that were given. After receiving the form and looking at the lender I told the clerkthat I have not borrowed from this lender. I have not borrowed moneyfrom this company and never heard of it. My job address was usedinstead of my current address. Also, what 's so fraudulent is that thebalance was {$9500.00}. Since this company is taking my money, the balance is less. I do not have student loan debt in that amount. Iwas not notified of this debt at all properly at all. I have been working with a very large and prominent XXXX for several years now as a valued XXXX. They have brought me almost 75 % of my business in the past three years. Yesterday, the Director of the organization sent me an email that I will copy and paste below : Hello XXXX, XXXX XXXX of XXXX ( XXXX XXXX XXXX XXXX ) called me trying to reach you. Her number is XXXX XXXX. When I inquired about why I was listed as a contact she told me that her records indicate that the XXXX is a partner for your XXXX XXXX? I dont mind being personally listed as a reference but it is false to claim that the XXXX is in partnership with your company. Please correct on your end making sure to clarify that information with XXXX XXXX and any others that may be under that impression. Best regards, XXXX She also told the director that she had " ... spoken with me a few days before and needed to have a follow-up conversation with me about the important business matter placed in her office ... '' for debt collections. This is a lie, as I never even knew I had a debt owed to this company. Even the more so, if they had spoken to me about my debt, why would they try to reach me on another number? This is a direct violation of The Family Educational Rights and Privacy Ac t of 1974 ( FERPA ) [ 20 USC 1232g ; 34 CFR 99 ], also known as the Buckley Amendment, which protects the privacy of student educational records, including financial aid application forms and other financial aid records pertaining to the student ( assuming they are calling for student loans ). This is also an indirect violation of The Fair Debt Collection Practices Act ( FDCPA ) [ 15 USC 1692 et seq ; P.L. 104-208 ] which sets rules that protect consumers from abusive debt collection practices. It also enables consumers to dispute debts, demand verification of the debt and to demand ( in writing ) that the debt collectors stop contacting the consumer ( other than to notify the consumer about specific actions the debt collector is taking, such as filing suit against the consumer ). I promptly notified the company and they refused to speak to me until I verified my account with my social security number and birthday or address. When I told them I had no clue who they were and felt uncomfortable giving them that information, she said she had nothing else to discuss with me. I asked her to simply tell me what she had mentioned to t he director of the organization, because she clearly could not verify my information to her, but she insisted that she did not share any of my information. I find that extremely hard to believe, based on the email and phone conversation I had with her about using their foundation as " a referral for debt collectors ... '' At the end of the call, I asked them not to contact my business line and left my number, as well as the Director of the organization that they spoke to in regards to my debt. They called again this morning. I would like to pursue whatever action necessary to hold this company responsible for their hostile and illegal debt collection practices. I hope this does not happen to anyone else. Please advise me on the next steps. Thank you.

I am writing about a billing from the Public Defender 's Office dated XXXX/XXXX/XXXX. To date, TWELVE YEARS LATER, I still have not been provided with a detailed itemized bill listing the services rendered. I XXXX requested an itemized bill on XXXX XXXX, XXXX. That request went unanswered. My XXXX notice of the {$2400.00} billing was a XXXX XXXX, XXXX notice from XXXX XXXX XXXX advising me that the Office of the Public Defender referred my account to them for collection. I wrote again on XXXX XXXX, XXXX indicating I had not received any documentation, requested the detailed time sheets and asked what recourse I had regarding the gross professional negligence regarding the " service '' I received. No one in the office, responded to my letter. On XXXX XXXX, XXXX I received another notice, this time from Financial Asset Management Systems, indicating they represent New Jersey 's Office of the Public Defender for collection of the balance I owe. Again, on XXXX XXXX, XXXX I wrote still another letter, attached my previous request and asking for detailed information on the services rendered by the Public Defender on my behalf. The New Jersey XXXX XXXX XXXX XXXX XXXX sent me a printout dated XXXX XXXX, XXXX from XXXX omitting any contact information for any further inquiries. In addition, there was no reference to what recourse there is for any disputed charges, just long-worded reminders about their authorization and powers to collect through whatever means possible. I have serious issues with the billing and wrote XXXX XXXX XXXX from the NJ Office of Dispute Settlement on XXXX XXXX, XXXX. Unfortunately, many of those represented by the OPD do n't have the resources to do so and may very well be unfairly charged and financially victimized. I was referred to XXXX XXXX XXXX, Chief Fiscal Officer of the NJ Office of the Public Defender, who sent me an itemized billing and offered me a settlement of {$750.00}. I refused any settlement because I disputed the services provided in detail and XXXX XXXX said he referred my entire matter to the NJ Public Defender Management for a decision on XXXX XXXX, XXXX. As of XXXX XXXX, XXXX, according to XXXX XXXX, my matter was still under review. I have not heard a word from NJ Office of the Public Defender Management on my dispute nor an answer to my questions which I have been asking sinceNow, for the XXXX time ( XXXX, XXXX, XXXX, XXXX ) I am receiving collection notices, this time from XXXX of Michigan. I have not received the documentation I have requested for over TEN YEARS from the NJ Office of the Public Defender, but am receiving collection notices for a debt which is invalid. I can and will provide documentation, names, dates, etc. to support my statements.

Since I did not receive a final bill from Financial Asset Management Systems , Inc., since XX/XX/XXXX, I decided to contact them about my collection account with them since I was under the impression that I was almost finish paying XXXX in full. Next, I contacted FAMS to confirm my payment history and their representative confirmed my payment history of 21 payments out of the 31 payments that I have made thus far. In XXXX, one of the bills that I generated from XXXX XXXX XXXX in XX/XX/XXXX in the amount of {$250.00}. I contacted XXXX XXXX to resolve the issue because I was told initially that {$60.00} would cover everything. Then within 30 days I received surprised multiple bills from XXXX XXXX XXXX. That issue was never resolved. Then I decided to make arrangements for {$10.00} which I have made. During the inquiry, I discovered that my payments were not being properly posted to my collection account with FAMS. After, I brought FAMS accounting errors to their attention then they decided to close the account and send it back to XXXX XXXX XXXX XXXX. Therefore, I contacted XXXX XXXX XXXX XXXX and spoke with XXXX XXXX XXXX, and she provided confirmation that I made 24 payments and stated that FAMS send them the payments every 2 to 3 months. However, both companies are violating the Fair Debt Collection Practice Act when they are intentionally collecting an amount greater than I owe. From my perspective all accounts should be verified when they are sold or received. Also, consumers should be provided a receipt of their new and final balance before and after paying their final bill. Consumers should not have to do collection agencies accounting discrepancies. In addition, the way both companies posted my monthly payments made it appear, as if, I am in the rear when I am not. For example, the dates of the money orders are for that particular month, and they should not be carried over to another month. Instead, they are just posting my payments, and some of the payments are not in sequential order with those dates on the money orders that have been posted to my account. As a consumer, I find it very odd that both companies would implement the same practices and refuse to forward payments over to the collection company that they hired. Also, this is a clear indication that the billing information is not properly verified, and names or detailed notes are not kept on accounts for verification. To resolve this issue, I am requesting that these practices be fully investigated so this can be prevented from happening to someone else and my overpayments to FAM. I have attached some of the communications between XXXX to XXXX and their contact information is on their bills and communications.

Your company was told at the time that the agreement was contingent upon my receiving the agreed settlement terms in writing within 24 hours. After I did not receive a copy of the receipt detailing my telephonic payment or a settlement agreement as promised, I called back the next day to inquire about when I could expect to receive the settlement agreement and a copy of my transaction receipt. I provided both an email and a fax number. I still have not received a copy of my transaction receipt for the {$100.00} I paid towards consideration of the settlement agreement. I also have not received the settlement agreement as promised. At this time, because of your companys deceptive and unfair debt collection practices and because you have breached the terms of our verbal agreement by not providing terms in writing as requested or a copy of my receipt, I do not feel comfortable proceeding with any payment arrangements made with your company. As a result, I am hereby rescinding any agreements made with your company to settle this debt and hereby revoke any promises of future payments made as a result of this verbal agreement, effective immediately. The company FAMS has withheld my XXXX Benefit formerly known as the NJ XXXX rebate as well as my New Jersey tax return. I was contacted by the fore mentioned collection company with a letter dated XX/XX/XXXX regarding an outstanding balance of {$16000.00}. The letter specified that I agreed to make payment arrangements with this company. I never agreed verbally or written notice to make any scheduled payments to this company and immediately notified my lawyer to contact the collection company on my behalf. Since my lawyer 's XX/XX/XXXX letter to this company, FAMS has not made an attempt to verify the debt as requested by the law firm. This year the Division of taxation mailed XXXX notices dated XX/XX/XXXX which indicates the collection agency has withheld my state refunds. I immediately contacted my lawyer regarding the matter and the law firm sent a second notice dated XX/XX/XXXX to the collection agency requesting they verify the debt. FAMS was in receipt of the law office 's letter on XX/XX/XXXX. To date FAMS has refused to respond to the XXXX and XXXX notifications sent to their office. I contacted the XXXX XXXX XXXX XXXX XXXX New Jersey on XX/XX/XXXX to inquire if any judgements were filed against me due to changing residence in XXXX of XXXX and possibly unaware of any notifications due to the move. The court clerk confirmed there was no " XXXX XXXX XXXX '' found in their system against me from FAMS. The court clerk also completed a state wide search and nothing was found. She also explained their database could confirm information from several years prior and there was nothing found in their database from XX/XX/XXXX to the present date. I also contacted the XXXX XXXX XXXX XXXX ( current county of residence ) immediately after contacting the XXXX XXXX XXXX XXXX and they as well confirmed there were no " Money Judgement Suits '' filed against me. FAMS is in clear violation of the Fair Debt Collection Practices Act ( FDCPA ) due to falsely indicating that I agreed to set up a payment arrangement with them in their XX/XX/XXXX letter. The collection company is also in violation due to not responding to notifications sent to them to attempt to resolve the matter. Lastly the collection company is in violation due to withholding monies due to me such as my State Income Tax Refund and XXXX Benefit without properly filing judgement with the Superior Court of New Jersey. I am requesting this company 's practices as well as this matter be investigated and action be taken against this collection company to receive monies due to me as well as their payment to me in the amount of {$1000.00} for violation of the FDCPA.

I have received several calls from XXXX, on behalf XXXX, regarding a student loan that I cosigned on behalf of a younger sibling. They had called several times throughout the day and weeks from various numbers including ( XXXX ) XXXX. When I finally answered, XXXX, the first representative, didnt identify herself or the agency. Instead, she began to ask me for my ssn. I asked for information before providing any personal info and eventually felt comfortable enough to provide the last 4 digits of my ssn. XXXX indicated that there was an opportunity to remove my name from the loan altogether through a settlement of about {$8000.00}. When I asked for written documentation regarding that settlement she refused to send anything in the mail or by email. After several requests to send written documentation of the settlement offer by email or mail, the representative indicated that failure to pay would have implications on my mortgage and other financial obligations. At that point, I explained to her that I understand my rights under state and federal law and that I believe her communication was inappropriate and may be in violation of those rights. The representative continued to speak over me and would not listen. She refused to provide any written documentation to me. The representative continued to indicate that certain actions will be taken if I had not provided payment account information to preserve the settlement offer. Once again, I asked her to provide written documentation regarding the settlement offer and possible payment plan but she refused. At that point, I told her that because she could not provide any additional written information I would hang up and would file a complaint. Within about an 1hr, I called the number again to get the full name of the representative and a mailing address. The second representative, XXXX, told me that she had no record of my previous call. When I pressed her for information, she said that she overheard the call. Because she lied about the recording of the previous call, I ended the call. I do want to remove my name as co-signer of the loan and, depending on the terms and other factors, am willing to enter into a settlement and/or payment plan. But the representatives withheld information, made threats, and several misrepresentations. These calls were around XXXX and XXXX on XX/XX/2018. On XX/XX/2020, I received a letter from Financial Asset Management Systems Inc. ( FAMS ). FAMS was requesting money from student loan account that has been paid off. I contacted the company via phone on XX/XX/XXXX to discuss this request. I spoke to XXXX XXXX on this day. XXXX stated that FAMS acquired this account from XXXX XXXX XXXX and that they report to XXXX XXXX XXXX about money collection. FAMS stated that they had attempted to contact me. ( My address hasn't changed in years. My phone number has been the same for over a decade. ) She stated that she would make sure a copy of the master promissory note was sent to me via mail as confirmation of the requested money. I requested to speak to a manager so I could have peace of mind about the proof being sent to me. I spoke to XXXX XXXX, she stated that she would request a master promissory note from XXXX XXXX XXXX and then send it to me. I sent a letter to FAMS requesting validity of the requested money. I sent this letter on XX/XX/2020 with a certified mail receipt. I contacted the XXXX XXXX XXXX XXXX XXXX ( XXXX ) to verify this debt. The XXXX stated that XXXX XXXX XXXX ( XXXX ) has that account and that it was no longer in the XXXX possession. I called XXXX to get proof of the account. XXXX has not ever serviced this account. I asked XXXX to search for me through social security number. They were not able to provide me with any reference to an account. FAMS never sent documentation of proof for the requested money. I requested proof via phone and via letter. On XX/XX/2020, my credit account was flagged because FAMS submitted the account as a collection. On XX/XX/2020, my credit score decreased 103 points. On XX/XX/2020, I disputed this on my credit report. On XX/XX/2020, the agency reported that the information was accurate. I contacted FAMS on XX/XX/2020 about them reporting this account to the credit bureau. Also, I told them I did not receive the proof of the account. I spoke with XXXX XXXX. She wasn't able to assist me so I requested to speak to a manager. I then spoke with Mrs. XXXX. Mrs. XXXX stated that she didn't know what happened to it being mailed to me. She stated client services will send the documentation of proof. I haven't spoken to FAMS or received any documentation from them.

FAMS called friends and family members that I had not disclosed their personal numbers to inform them of my debt. What is eerie is how they acquired this information because XXXX family member they called, in particular, was my grandmother whom lives in a geriatric community. They called her house phone ( land-line ) when she does not even live in the states. She had no idea of my student loan because I did not want her involvement, and she has a XXXX XXXX. She called me crying and nervous because FAMS had called her saying I was in trouble and she needed to confirm my address and cell number. She asked what they wanted with me, and they told her that I was in trouble and she needed to help them help me. My grandmother was called three hours after my uncle, whom also was not informed of my debt, and was phoned on his private cell. XXXX do not live in the states, of which FAMS knew, because they sent operators to speak in XXXX. In addition, my uncle, whom does speak English, had confirmed to them my information, to which they disclosed my debt. Hence, why did they call my grandmother three hours after they had illicitly spoken to my uncle, whom confirmed the information they supposedly did not have? Those are only XXXX, atrocious examples go the violation of privacy and dignity FAMS caused against me. They called my family, whom did not know, and suspiciously acquired their information. Absolutely none of the information they have on me uttered these family members names or information, particularly because my " uncle '' is actually a third cousin of my mom, whom I call " uncle '' out of love. When I confronted FAMS on this situation they lied, and claimed that these people were listed as " recommenders '' for my loan. My XXXX grandma with XXXX and poor XXXX did not write me a student loan recommendation. In addition, I would never tell my family of my student debt, especially my uncle. It made no sense. They then proceeded to apologize, but never to told me how they got the information. FAMS is supposed to be in association with XXXX, which had my loan prior. Thus, they already had my number, email address, and address. They did not need to call anyone and did so to embarrass me through cruelty.

FAMS contacted my placed of employment and informed my co-worker personal information about me and that I have unpaid loans. My co-worker informed the caller these types of calls are not allowed and gave the caller with my permission my personal cell phone number. On another occasion a FAMS employee pretended to call to verify my employment and personal information about me for an " application I submitted ''. When my co-worker became suspicious because the caller was becoming rude she transferred them to my supervisor. My supervisor did not feel comfortable giving the caller the information they wanted after the caller would n't verify who they were so he referred the caller to our company supervisor. Then I received a call from our HR department informing me they received wage garnishment papers from this company for XXXX % of my paycheck. I got the company name and number from the paperwork. I called and was transferred to a man who was rude from the beginning. He stated they have called me numerous times on my cell and have not made contact. Which I have never received a single call or mail from this company. I informed him the address he has is incorrect and I have not lived there in over 5 years and that the name he is using is my maiden name. He argued it is my fault my wages are being garnished and that I should 've kept my name, address and phone number up-to-date with them. And since they never received a returned letter that it 's my fault they did n't have current contact information for me. He stated he does n't know the original debtor but that the loan from 2003 came from XXXX and is now at {$9000.00} due to interest but he ca n't tell me the original amount owed due to the loan being consolidated at some point in the past. He had no interest in updating my contact information, resolving matters with me or helping me get the correct forms that verify the debt owed and debtor owed. He very smugly stated several times that all will be resolved now that my wages will be garnished. How can a company who wo n't verify a debt or debtor? Wo n't communicate with me? And violates third party disclosure now garnish my wages for an unverified " owed debt ''?

On XX/XX/XXXX, at approximately XXXX XXXX, I received a voicemail from someone identifying herself as working for XXXX XXXX XXXX XXXX XXXX I called back and spoke to XXXX XXXX. She told me I was in collection for a debt of roughly {$200.00} to XXXX XXXX. I told her I did not recognize the amount and had received no bill from XXXX. She attempted at that point to get me to pay the amount, and I asked her what exactly it was for. At that point, she identified herself as a debt collector. I interrupted her and told her I believed she was in violation of the Fair Debt Collection Practices Act by not having first identified herself as a debt collector, despite discussing the debt with me and attempting to collect information. As soon as I told her this, she became irate, started yelling at me, and the hung up. I called back immediately and asked the person who answered to our a supervisor on the line. I was told the supervisor was busy but would call me back in XXXX minutes. No one ever called. Two weeks later, on XX/XX/2022, I received a call from FAMS at roundly XXXXXXXX XXXX, seeking to collect the debt. I explained that I had already requested verification, had not received any, and also had not received a call back from the supervisor. I was told one would call me back. Indeed, shortly later, I received a call. The supervisor apologized for XXXX XXXX 's violation of the statute and then began arguing with me about why I had not paid. I explained, repeatedly, that I had received no bill. She gave me dates of bills being sent to me. I explained to her I had moved months earlier, that my mail was forwarded, but that no bill or notice from FAMS had come to me. She said that as not their problem, and that she was entitled to continue collecting the debt. I told her I want no further communication from FAMS. I called XXXX after that call and received verification of the charges and paid the amount. They apologized for the behavior of FAMS. I am not satisfied with apologies. FAMS should be punished for the illegal behavior. I seek some kind of administrative remedy. If none can be made, I plan to bring a suit to seek {$1000.00} in statutory damages.

Loan was taken out for my grandson in XX/XX/XXXX in which I was the co-signor. Over the course of 10 years I have made payments on the loan and am now being told that I owe over {$2000.00}. I noticed that the loan number that I had been paying on is not the same number that I am being contacted about now and have inquired why the number changed. So therefore my payments are not accounted for. My grandson had other loans and it is my belief that payments were applied to the wrong account. I am being charged intrest and late fees but no one has responded to my request to validate the debt. The original loan was for {$5000.00} in my calculation this should be paid in full at this point and if not paid in full my balance should be no more than {$200.00}. I have gone to my bank to request copies of my cancelled checks which the cost of having them to provide copies is more than I can afford for such history. XXXX hired Financial Asset Management Systems ( " FAMS '' ) to collect on a private student loan. FAMS flagrantly lied under CFPB complaint number XXXX. In their response they stated that they received a verbal cease and desist in XXXX 2015, and that they called me once on XXXX XXXX, 2015. FAMS conveniently did n't mention CFPB complaint number XXXX, in their response, which was submitted by me on XXXX XXXX, 2015, and FAMS responded to the complaint on XXXX XXXX, 2015. Under CFPB complaint number XXXX, I stated in writing that I wanted absolutely no communication from FAMS. However, FAMS called me on XXXX XXXX, 2015, even after receiving a written cease and desist from me on XXXX XXXX, 2015 under complaint number XXXX. I have their phone call as a records log on my phone. In addition, under CFPB complaint number XXXX, FAMS alleges that they called me on XXXX XXXX, 2015, because of settlement negotiations. However, when I called FAMS on XXXX XXXX, 2015, I specifically told them that I wanted absolutely no phone calls from them regarding the settlement negotiations. I recorded the phone conversation during the phone call. I have the phone call recorded in my phone logs. Under the FDCPA, a debt collector is not allowed to contact a person after receiving a written cease and desist letter, which was sent under CFPB complaint number XXXX. The exception is a debt collector stating that they are ending communications which was done in FAMS ' response on XXXX XXXX, 2015, under complaint number XXXX. As a result FAMS flagrantly violated the FDCPA by calling me on XXXX XXXX, 2015, which caused me severe emotional distress and health issues. There is no exception in the FDCPA to call someone regarding settlement negotiations after receiving a written cease and desist letter. FAMS has flagrantly lied in their responses regarding their violations of the FDCPA and their refusal to adhere to written cease and desist letters.

I do not remember contesting to agreeing for this company to email me. I told him to send me a letter in the mail. I just moved and I never provided them my new address but they have all my information obtained not by me. I believe my debt collector has provided this third party this information. I lived at XXXX Apartments back in XX/XX/XXXX. When I got ready to move I spoke with XXXX the rental manager at that time. I gave them proper notice before I moved. I also was granted to move before my lease expired. The agreement was for me to clean the apartment and they would keep my deposit and I would not owe the apartment complex any rent. This was verbal agreement that XXXX the apartment manager gave me. After I'd vacated the premises several months later I started receiving collection notices that I owed {$730.00}. I left voice mail messages to XXXX who was the regional manager, I finally spoke with her and she stated that they kept my deposit, but I still owed money. I disagreed with her regarding any monies owed because what XXXX who was the Manager at the time advised me before I left that I didn't owe the apartment complex any money. I still didn't agree to what had taken place. I was still receiving collection notices until I decided to pay this money, because it would affect my credit and me not being able to rent another apartment. Before I agreed to pay the collection, I phoned XXXX XXXX XXXX, I believe I spoke with XXXX XXXX, I wanted to know if I paid this collection would it be deleted off my credit and she advised that it would be in a few months. Well a few months has turned into years. I've been disputing this item for several years, and they refused to delete off my XXXX Credit report. I'm writing to your agency to see if this item can be deleted from my report. I've paid the item, but the collection agency didn't remove it like they told me. Over a period of a year the following occurred: Dishonestly told me they could not establish a payment plan unless I made a down payment and committed to a monthly payment I couldn't afford. Threatened that if I didn't begin. Along these payments they would garnish my wages. Omitted multiple requests to change my address, leading to never receiving ability to dispute an administrative wage garnishment. Placed administrative wage garnishment while not allowing my fair right to dispute. Despite their unlawful methods of implementing my garnishment, I attempted to set up loan rehab and on XXXX) occasions of providing the requested info, I was told they never received it. And after (6) months of compliance, I was told these payments were not considered adequate since they "never" received my documentation. They would consider restarting the program after I finally requested I would no longer comply unless all contact was in writing and requested verification of what my balance was based on, since it doesn't match my loan info. They claimed this was a cease and desist, and would no longer deal with me or provide me with any additional information. Despite $XXXX in the funds they've recovered my balance has not gone down. To date they still reflect me owing the, a balance of $XXXX. They have yet to provide adequate information breaking down the costs my debt they claim I owe. The info that was provided to me, only accounts for approx 30% ($XXXX) of the balance they claim I owe them ($XXXX). Finally after months of attempting to dispute the garnishment they finally rescinded it after I filed a complaint the myeddebt website. I provided hardship paperwork, however FAMS, nor their "special accounts" will discuss my account. I was directed to contact my Ed debt, Whom directed me back to FAMS, despite explaining their refusal.

After purchasing my first house 6 years ago I started receiving debt notices for debt that was not mine. I've never had a problem with credit card debt and have no student loans. After calling the original creditor I discovered that I shared the exact same name as the person who owed the debt, but they understood and removed me from their system. For 4 years I would receive notices randomly from different debt collection agencies. My assumption was that this debt had been sold to several other debt collectors. Whenever I called to explain they had the wrong person and address each one stopped sending notices. About 3 years ago my wife got a call from a Sheriff 's officer. The man with my exact same name had died and the system listed my wife 's phone number as contact. Luckily I was at the house when she received this call and the Sheriff was very apologetic for the mistake. After this the debt notices stopped. To my recollection maybe one or two more came in the mail but as soon as I called the number listed, the collector could easily XXXX the man 's name, find his obituary, and remove me from their system. Two weeks ago FAMS INC started sending me notices in the mail, but whenever I call to explain the situation they will not listen. They continue to send me notices and offering settlements even though I can point them to this man 's obituary. After sharing that information with them they claim there is nothing they can do. They continually send me notices and treat me as if I'm lying if I call the number listed. They've asked for my social security number and date of birth multiple times. I have never shared that because I fear they are trying to burden me with this now deceased man 's debt whom I have no relation to at all aside from sharing a very common name.

Over the course of the last month, a variety of individuals from Financial Asset Management Systems based in XXXX, Georgia have called my cellular telephone number more than 100 times from a variety of masked telephone numbers identified as potential spam calls. Each time I have answered, they inform me they are calling to discuss a personal business matter and advise me that before they tell me what the personal business matter is I must confirm for them Personally Identifiable Information ( PII ) such as my date of birth or residence address. When I advise the callers that I will not confirm the PII, they tell me that they will send a letter but can not discuss any information without me first providing the PII. I am filing this complaint now because the frequency and insulting nature of these calls continues to increase. First, as of this date I have never received any written correspondence from Financial Asset Management Systems, despite their repeated statements that they have sent such. Today, I received a call from a Financial Asset Management Systems employee who identified herself as XXXX XXXX, who followed the same script as her colleagues in asking that I provide ( confirm ) PII. I advised her I would not and told her that I have repeatedly asked their representatives to send me written correspondence if they believe there is a legitimate matter to discuss with me. She insisted they have, and told me they sent an initial letter that she was looking at in the file. When I told her that I had never received anything and questioned the legitimacy of their inquiry, she decided to add an unwarranted insult by saying that, If youd take care of your personal business matters we wouldnt have to call you every day before hanging up on me.

By XX/XX/XXXX, I call them back around XXXX PST and I am speaking to an unprofessional, rude, and ignorant agent of FAMS. He goes off telling me he is representing XXXX and they want to settle for a certain amount, asked if I had it, and went off asking how I make my living. There was no discussion that they sent a notification or anything. Or that I am able to go online with account number to check out any notification from them. Then, I am asked for my banking information and told they will be deducting {$250.00} for 4 months and the interest will stop. From all of this, I am not sure who these people are because I never received any written information and will not be giving any information over the phone. After that conversation, I asked if I can start in XX/XX/XXXX. The rude boy gets upset and say well I just have to. Let XXXX know you are not able to do it. The approach was very rude and in a attacking matter where no options were given. After the conversation with this rude individual, I receive 3 more calls with the numbers listed above. I need to see written information and options for me to believe this is what is going on. Being rude and ignorant will not help these people get a reaction or settlement from anyone. To make it worse, there was no notification what so ever. This can be a company out of a basement collecting from individuals. Nothing else was explained. The harassment continues with them on the daily with 4 or 5 calls a day.

I have been paying Financial Asset Management Systems ( FAMS ) for two years on a student loan debt that is owned by XXXX. FAMS has been miscalculating my payments and not applying my payments correctly to the alleged balance which is a flagrant violation of the Fair Debt Collections Practices Act. During the past 4 years I have filed multiple written complaints and have copies of, against XXXX and their debt collectors for flagrant violations of the Fair Debt Collections Practices Act. Financial Assets Management repeatedly violated my consumer rights by doing the following : I let them know the best time they can call me, NOT between XXXX-XXXX, which means they are legally prohibited from calling me at that time and they continue to do so. They continue to harass and be abusive over the phone which is against the The Fair Debt Collection Practices Act. They have called at the times they are legally prohibited from calling during three consecutive days in a row, multiple times during those days and have acknowledge that the notes reflect that I have told them that they can not call during those times. They use unfair and threatening practices such as stating that my employment has scofflaws and because of that I have a moral obligation to pay the debt. However, that policy does not pertain to private student loans. Filed Chapter XXXX Bankruptcy XXXX XXXX for 5 years. Student Loan included in Bankruptcy, balance {$27000.00}. Bankruptcy paid {$7000.00} over 5 years. Balance was {$20000.00}, XXXX XXXX. FAMS started calling me 1 week after discharge, saying I owe a total of {$30000.00}. I said could not be right Bankruptcy paid {$7000.00}. They said since they had it its finance and interest, so the Bankruptcy payments vanished, was not applied to the balance or they added money to the balance to bring it back up. XXXX from FAMS stated if I get in their payback program they will waive the finance and service charges. I have to pay a certain amount each month for 9 months. I had the payment come out of my bank account on the last day of the month, each month. XXXX XXXX I get a call from them stating my payments are not clearing that I will be put out the program and they would have to garnish my wages. I said NO NO that 's not possible, my statements show each month you received my payments. I had to send them a copy of my statement showing where the payments were going to FAMS. I did that but it was n't good enough. Talk to a Supervisor, she said she use to the banking world and she would need to see my entire bank statement. No you do n't, you do n't need to see my other transactions only the transaction that pertains to you showing where payment was made and cleared. Financial Asset Management has reported this collection to my XXXX credit report with the current balance of {$4300.00} and an original balance of {$3300.00} and original creditor being XXXX XXXX. I contacted the company months ago to request a mailed written verification of debt along with the original date the loan was opened, the loan amount, the university the loan was used at, and the school year ( s ) the loan was submitted for since this student loan is unknown to me. The representative I spoke with at the time advised me that she would mail out verification of debt along with the open date for the loan, loan amount, the university the loan was used at, and the school year ( s ) the loan was submitted for. I had setup an automatic payment using FAMS ' own online payment system for XXXX 2016. Under CFPB complaint number XXXX, XXXX alleges that XXXX and/or Financial Asset Management Systems can run my credit report anytime they want. That statement is false. In addition, whoever wrote the response from XXXX to CFPB complaint number XXXX, does not know what they are talking about because they cited the wrong applicable law. I called FAMS about my payments after speaking with Department of Eduaction and them telling me that FAMS is a fraudulent company. I asked Dept of Ed. to stay on the line while I called FAMS. When we called the representative from FAMS was very hostile when I explained I wanted to get answers regarding my account and was belligerent with Dept of Ed. rep. Dept of Ed told me to contact XXXX and told me this company probably was not reputable and to do further investigation. The XXXX company contacted me at my job and made repeated calls from XXXX - XXXX on a two hour cycle. The phone calls began XXXX XXXX, XXXX and are still occurring today. XXXX calls my office phone literally every two hours every day averaging six calls within one day and they do this Monday - Friday. I asked them not to contact me at work but to use my cell phone number that they have on file and on record and they never honored this request, which means I can not make payment arrangements because I am not in a position to discuss my financial affairs at work. I signed up with the .001 % loan rehabilitation program with Financial Asset Management System ( FAMS ) and XXXX for my student loans. When I started the program I was told that my credit report would be updated after XXXX payments of {$250.00} per month to reflect the new rehabilitation program. In XXXX I got a letter from FAMS Collection Agency stating that i owe an hospital bill for the year of 2013, that year my state tax refund was taken by FAMS {$290.00}. My day began here at work on Tuesday XXXX XXXX, 2015. I got a call where I work not sure at what time exactly but it was an early part of my day. The receptionist contacted me and said it was an emergency call with urgency, making me think XXXX of my family members were in trouble or something. Financial Asset Management System contacted me in XX/XX/XXXX with a letter stating that I owe more than {$2000.00} for a student loan that originated with the University XXXX XXXX XXXX in XXXX. I was told that I had to take out loans until my GI BILL started by the schools VA rep. The VA Rep miss handled my paper work for my GI bill and was n't turned in on time. I was told the school was accredited and I could transfer, that was not the case and was forced to finish my schooling. once I graduated I found out that I owed XXXX in student loans, which was the first XXXX that the VA rep never turned in paper work for. The company has been reporting to the New Jersey Division of Taxation that I owe money for something that is incorrect.
