This letter is a statement of Unethical practices of finance of America, including XXXX XXXX and XXXX XXXX XXXX XXXX Location XXXX NMLS # XXXX Finance of America Mortgage LLC, NMLS # XXXX XXXX XXXX XXXX XXXX I applied for a mortgage loan on XXXX from Finance of America on the XXXX XXXX was XXXX XXXX . When I first talk with XXXX explain to me how I was approved for a down payment assistance program for {$12000.00}. I was told by tomorrow I could use that money for closing in my down payment. I asked tomorrow to send me the paperwork I needed to go forward with the home-buying process. After looking at a few houses with night homes I was ready to sign a contract with XXXX XXXX or XXXX XXXX XXXX XXXX Georgia XXXX . XXXX XXXX I I applied for a mortgage loan with Finance of America XXXX XXXX because I was approved for a XXXX NHF program. On XXXX XXXX I signed a contract for property XXXX XXXX XXXX XXXX Georgia XXXX . My close date was set for XXXX XXXX . XXXX XXXX XXXX XXXX loan processor requested all my info needed for closing. XXXX XXXX I sent it to XXXX XXXX . XXXX XXXX XXXX sent me the loan estimate. XXXX XXXX XXXX had a walk through confirmation with the property. XXXX XXXX XXXX stated my loan paperwork was submitted to underwriting. XXXX XXXX XXXX stated I was n't approved for the nhf program he previously told me I was approved for. XXXX XXXX XXXX stated my ratio is too high at 50.99 %. XXXX XXXX XXXX stated I could not close until I refinance a car that I was a joint owner on to lower my debt to income ratio. On XXXX XXXX are signed extended contract with my new clothes date now XXXX XXXX XXXX . From XXXX XXXX to XXXX XXXX XXXX XXXX was very vague on my closing date. After I refinance a car out of my name and sent his company all the necessary paperwork needed to close on the loan Finance of America still was not ready. On XXXX XXXX I was told by XXXX XXXX I was not going to close because they had to work out numbers so I had to sign another extension to my contract. I was never contacted a week before or XXXX weeks before from Finance of America. Finance America never communicated with me correctly. I signed three extensions to my contract and finance of America still was not ready. During the process from the first closing date all the way to the XXXX closing date tomorrow XXXX vaguely corresponding with me on the things I needed for closing I 'll called and texted, I even responded back to his processor the try at least get all the paperwork I needed to close. When I did n't have the necessary pick for ready for finance of America to go ahead and close on my loan I was told by the processor I had to wait another 30 days and pay {$1000.00} just to lock in my rate. XXXX XXXX XXXX XXXX of finance of America has been very terrible with their unethical processes. Finance of America XXXX XXXX and have a cold has cost me thousands of dollars that I have lost and rent my kids taking vacations when they knew I was n't going to close stress and more. I would like for finance of America to please return my monies that I have lost during the process of their unethical practices of approving me for my loan. 1. XXXX of XXXX XXXX XXXX and XXXX XXXX made me wait for interest to go up without locking my rate after I requested. 2. Finance of Americas XXXX XXXX and XXXX XXXX continued to lie to me about closing on my property but never put forth the effort. 3. Finance of Americas XXXX XXXX and XXXX XXXX wanted me to pay for a rate lock and due to the lost conversation between there business and myself. 4. Finance of Americas XXXX XXXX and XXXX XXXX used and wasted my time vacation time XXXX based on the agreed dates to close. 5. Finance of Americas XXXX XXXX and XXXX XXXX has put me thru so much mental stress and anguish I almost lost my family. In XXXX 2015, I applied for a HARP XXXX refinance mortgage with XXXX with a 3.625 % no cost, locked interest rate. I was told I was approved and XXXX DID NOT require an appraisal for my home.When it came to funding, XXXX said that they would not fund my HARP XXXX Plus without an appraisal ( XXXX Plus XXXX did not require an appraisal ). I told them this to no avail. They said that they still would require an appraisal even though this is not what I was told originally. Nothing had changed concerning my home since my last XXXX refinance with XXXX XX/XX/XXXX. I believe this act was against the full intent of the Harp loan. XX/XX/XXXX the rates where much lower for a conventional loan 3.25 % with points ( more money to XXXX ), so the loan officer told me he would switch the loan to a conventional loan since XXXX was forcing me to have an appraisal anyway, even though it is not in the XXXX guidelines. If I still wanted the loan I had to agree to the appraisal. I agreed, not knowing what else I could do since the interest rates on the open market rose dramatically. My lock was for XXXX days. After waiting XXXX weeks for XXXX to send over their approved appraiser, I was already smelling a skunk in the room. Then I received an email that the appraiser sent to XXXX that stated he was not qualified to do the appraisal!! Then XXXX said they would send another appraiser but they wanted more money to extend the loan lock even though it was their fault. Then after one week of me calling XXXX ( with no response ) because no appraiser had called me yet, I received an email stating that the new appraisal co. XXXX wanted more money for my appraisal {$640.00} instead of {$440.00} that I was originally quoted. I checked out XXXX reviews and they had negative XXXX stars so I requested a different appraisal company. XXXX told me that there was only one approved appraisal co. that they had that would do my appraisal. I was forced to agree if I wanted the refi. so I did. One more week passed without a call from XXXX new appraiser. No one returned my calls that the appraiser had not called yet. I finally received a call from an appraiser but he said he could not do the appraisal for XXXX weeks. I told him that I needed someone sooner. He said he would notify XXXX and they would call me or XXXX would call me to get an appraiser immediately. I did not here back from anyone. I called and emailed XXXX for XXXX more week with no answer. I finally received an email that was for more points to extend the lock again ( more money for XXXX ) .and that the appraiser was the only one approved to do my appraisal, there was n't anyone else that they had approved. I was frantic at this point so I called a few local independent appraisers, just to see if it was normal to take a month and a half to get an appraiser to ones home. I received a call back from a local appraiser the same day and was told that the mortgage co was obviously trying to delay out of lock to get a higher interest rate and that the {$640.00} was very high cost. XXXX more week later, I finally received a call from the appraiser that had originally requested an expedited appraiser. He was frustrated to hear no one else had been sent to contact me. I set an appointment with him the soonest he could do it, one week later, XXXX days before my XXXX lock would expire. I still kept calling and emailing XXXX requesting a return phone call ( XXXX weeks now with no call back ). I finally contacted someone at XXXX. They stated they would not extend the lock even thou it was their fault and when funded the loan cost would be at the current higher interest rates plus an additional out of lock points fee added on! 1 ) XXXX did not require an appraisal. 2 ) Unreasonable hardship requiring their unqualified overpriced appraisal co3 ) Unreasonable delays causing financial hardship

I received a refinance quote from XXXX when I started hunting for a refinance for my primary residence. They increased the rate from the base rate to pay for upfront mortgage insurance and to allow a XXXX dollar credit. Effectively paying for all the closing costs except the prepaid items for escrow. We moved along with the application on XXXX XXXX, and locked in that rate. Over the next several weeks I was very prompt about providing docs that were requested ( I had everything on file because I had just purchased the home a little less than a year ago, so all the old mortgage docs were ready to go. ) I began to get worried in the middle of XXXX when I started to realize that I wa n't hearing from the company as much as I am accustomed to when processing a Mortgage. I made a call sometime around a week before the end of XXXX to see what was going on, because I had a mortgage payment coming due. Throughout the whole process I found it difficult to get phone calls returned, but when I finally got a call back this time, the processor said something to the effect of " uh-oh looks like your rate lock is going to expire on XXXX XXXX, we better get moving. '' I made my payment and continued to try and be patient. I was n't receiving any requests for any documentation or anything so I just figured everything was ok. Finally I called back again after the weekend of XXXX XXXX on XXXX XXXX to ask what was going on with my loan, and that is the first time they asked me to sign a rate lock extension. This would have been fine, but they were asking me to accept a reduction in my Lender credit from XXXX to XXXX to pay for the rate lock extension. After volleying back and forth for several days I reluctantly agreed to reduce my credit to XXXX to help share the cost of the rate lock extension on XXXX XXXX. I assumed we were good to go since they were n't requesting any more info from me, and it sounded like the loan was approved and pending. Again i sat back trying to be patient, but I received no communication from XXXX until XXXX XXXX when they asked for a copy of my HUD from when I bought the house. They had that info the same day and the next day they sent out another rate lock extension for me to sign. There was no sheet showing that I was paying for this so I signed and returned it. Finally my loan was cleared to close Tuesday XXXX XXXX, but less than XXXX hours before scheduled closing I got yet another rate lock extension to sign, this time it showed that my lender credit was again being reduced to pay for the extension- down to just under 500 dollars. Immediately I told my loan officer to stop to closing and cancel everything if they could n't honor the deal I had agreed to with the {$1700.00} credit. After a tense Monday i finally heard back from my loan officer that they were going to honor the deal I had agreed to with the manager two weeks before. Finally on Wednesday a lawyer came out to my house to close the loan. Unfortunately they had not honored the agreement though, and on the final HUD it was showing that my credit had been reduced to XXXX dollars. On the final HUD they compared the HUD statement to a Good Faith Estimate that I had never even received showing only a 500 dollar credit, so it looked like my credit was supposedly increasing. I called the Loan officer during closing and he and his manager convinced me to sign the loan agreement promising that they would work out the difference in the Lender credit. However today they finally admitted to me that they were not going to reimburse me, and said that my loan was " closed. '' Luckily I am still within the three day rescission period, and have sent them a signed notice to cancel the loan. But the entire experience was demoralizing and degrading. Plus I am out the cost of the appraisal and all the time I have invested.

I applied for a refinance of my home mortgage with XXXX XX/XX/2016 with a loan being processed by Finance of America LLC. Approximately two weeks in the process, after I had submitted all my documents, I paid {$440.00} for an appraisal. I submitted all additional documents, received weekly updates until XX/XX/XXXX when I was told that my loan processor was getting my loan ready for closing and needed me to sign and return XXXX documents which I did upload through their secure link that very weekend. I sent the information but nothing happened. I called the loan processor, XXXX XXXX, the loan agent but no response. I finally reached the loan processor on XX/XX/XXXX and she said she had not received the XXXX signed documents but if I sent them right then, she would rush the final loan approval through and I reminded her that my loan lock was expiring on XX/XX/2016 and with XXXX coming, we were running out of time to close this loan. I sent emails, left phone messages for both the loan agent and the loan processor. I was trying to make sure my loan lock did not expire and asked for my loan lock to be extended. No Response from anyone. I finally got a XXXX line message from the loan agent on XX/XX/XXXX stating that he was out of town and my income to expense ratio was too high and he would work on it when he got back. I called and emailed and finally tried to reach out to someone at corporate in Finance of America. No answer from anyone. Then on XX/XX/XXXX, my loan agent sent an email to state that my debt to income ratio was too high and there was nothing he could do. After I wrote him back, XXXX XXXX, my loan agent, called me and told me to stop calling corporate and there was nothing I could do and the loan was no longer being processed. I asked for his figures for my income to expense ratio and he said he could not provide me with that information. I told him that he had never inquired if I had any other source of income that could have resolved the gap such as my retirement funds, etc. He was very belligerent and stated that there was nothing to be done since the loan lock had expired even though I had requested that it be extended in my emails, and my loan had been cancelled. He sent me a final XXXX liner on XX/XX/2016, stating " that the loan had been cancelled due to my debt to income being too high. I do n't know what else you want from me. '' I responded that I wanted my {$440.00} appraisal fee refunded to me. Never heard back from him. When I applied for this loan, I had been told that the entire loan process would take 30-45 days and my rate lock was for 60 days. This means that 60 days into the loan process, my loan had not been approved? This makes no sense whatsoever. In any event, my loan refinance would have allowed me to reduce my mortgage payment from $ XXXX/month to $ XXXX/month. This is no longer an option since the interest rates have gone up. I had several lenders calling and offering to meet their quotes but, since it looked like my loan was ready for closing, I told them I already had a loan in process. So now my anticipated savings of {$320.00} per month have been taken from me by an inept organization. Being a XXXX, this would have helped me tremendously in the future. Please let me know what you can do to help me. By the way, my sister had XXXX loans being processed at the same time by this organization and they mishandled both of those and she also missed her window of opportunity to refinance XXXX of her properties. Verbally I was told since I was on title of XXXX additional properties for which I have no indebtedness or net losses but that they still have to make me liable for all the taxes and insurance and yet not apply any of the revenues to offset them. I can prove that my sister is paying for all of it.

This complaint is regarding a faulty appraisal of my home located at XXXX XXXX XXXX, XXXX, MD XXXX which was performed by XXXX XXXX from XXXX XXXX XXXX XXXX XXXX XXXX XXXX company as part of my home loan refinancing process from Lender ( Finance of American Mortgage LLC ). I strongly believe the appraisal which was performed was not fair and way off from the market value of my home in comparison to my previous appraisal. Lender point of contact ( XXXX XXXX ) also has agreed that this appraisal was inappropriate after review. I am very sure appraiser has used inaccurate data points and did not include appropriate comparable sales in the last 6months based on the appraisal provided. New appraisal depreciated the home value which would force PMI to be included as part of my refinancing loan. My home is located in prime area which has shown steady and strong growth in past few years. My home was appraised in XX/XX/XXXX ( attached appraisal ) at a value of {$460000.00} and the new appraisal ( attached ) has depreciated the value to {$450000.00} using inaccurate comparable sales and data points. In addition to this my home also has energy efficient appliances, bay window, upgraded appliances, kitchen cabinets, carpet, bathrooms, master bedroom dropped ceiling, deck, in-wall entertainment system built, security system wired, and installed. I have paid {$470.00} for appraisal of my home as part of this refinancing process and when discussed with the lender they are asking me for an additional {$170.00} to appeal the appraisal which they agree is inaccurate based on the facts mentioned below. I have attached my comparison of both the appraisals and inaccurate data points used which lead to very low appraisal resulting in PMI for refinancing loan and additional cash down payment. All this process is unfair and inappropriately valued appraisal is putting me and my family under tremendous financial stress and enforcing additional PMI in the new refinancing loan. Below are the comparison data points and inaccurate details used in current appraisal. 1. My Home ( Maxwell model ) is an end unit town home which is a comparable home with similar square footage as Finley model from the builder XXXX XXXX in my community. ( refer the same in attached difference document ) S. No House Address Sold On House Price Distance from home 1 XXXX XXXX XXXX XX/XX/XXXX {$490000.00} 0.6mile 2 XXXX XXXX XXXX XX/XX/XXXX {$460000.00} 0.6mile 3 XXXX XXXX XXXX XX/XX/XXXX {$470000.00} 0.7mile 4 XXXX XXXX XXXX XX/XX/XXXX {$470000.00} 0.7mile 2. My house consists of 7rooms in total with 3 bed rooms, 3 full baths and 1 half bath but the appraiser used only 6rooms counting 3 bedrooms, 2 full baths and 1 half bath to find comparable sales but this inaccurate room count resulted in lower square footage area. 3. Cost Approach to value has been inaccurately calculated in the appraisal in comparison with previous appraisal XX/XX/XXXX and the $ /Sq. Ft value is too low as compared to market value. Example : XXXX XXXX XXXX XXXX, MD XXXX which was used in the new appraisal has a 2358 Sq. Ft sold at {$450000.00} which means the value is $ 191/Sq. Ft. Based on this measure, my home with an area of 2452 Sq.ft at $ 191/Sq. Ft should be valued at a minimum of {$460000.00}. I sincerely request CFPB team to help in rectifying the faulty appraisal by taking necessary actions to address the concerns and correct the appraisal which would fairly avoid the PMI being enforced.

Through online correspondence on XX/XX/2019 and XX/XX/2019 with XXXX XXXX XXXX # XXXX ( aka XXXX XXXX XXXX XXXX ) Mortgage Loan Originator/Mortgage Advisor with Finance of America Mortgage LLC XXXX XXXX XXXX, XXXX XXXX XXXX, CA XXXX, I am obligated to report said violations in correspondence with the TILA/RESPA Integrated Disclosure Rule ( TRID ). The self-admitted violations is that regarding the timely and required information triggering the need for a financial institution to issue a mortgage Loan Estimate ( LE ) to a consumer in a residential mortgage transaction. The specifics are regarding 12 CFR Part 1026 - Truth in Lending ( Regulation Z ). More specifically Part 1026-19 ( e ) ( 2 ) ( iii ) Verification of information, 1026-19 ( e ) ( 1 ) ( i ) Provisions of disclosures, 1026-19 ( e ) ( 1 ) ( iii ) Timing. Through our conversation Mr XXXX makes several concerning statements regarding the above violations. See attachment for complete record of back and forth conversation. Below are highlights which are also highlighted in the attachment. Concerning statements : 1 ) " ... because the LE is a binding legal document, lenders dont issue them to borrowers until they have a complete application. No lender I am familiar with will give someone who is shopping that document. '' - XXXX 2 ) " Although Loan Application is a term of art in that it theoretically gives enough information for a lender to render a decision ( it doesnt ), I dont know of any lenderbroker or bankerwho will issue an LE without a complete loan application. At a minimum, that typically includes income and asset documentation, photo ID and employment information. '' - XXXX 3 ) " If someone were to call me asking for an LE, Id give them one only with a complete applicationwhich means Id get all the documentation needed to submit the loan to underwriting. '' - XXXX 4 ) " ... I wont issue the LE until and unless I have a reasonable idea that the prospective client is serious. That means that, at a minimum, theyll send me enough documentation from which to create an application. They can not force me to generate and issue a Loan Estimate without giving me that documentation. And yes, I know that strictly speaking the six items of data can be communicated orally, but try to make that one stick with a CFPB complaint if a lender refused to issue an LE simply because a consumer demanded it on oral representation. '' - XXXX It is most uneasy that Mr XXXX has decades of mortgage experience and knowledge of others in the industry who may be in violation. This may be of even greater concern due to his position and representation of Finance of America Mortgage LLC. Even after several explanations of the mortgage regulations Mr XXXX stood by his own standards of disclosing a mortgage Loan Estimate. If such self-admitted violations are factual then there has been mortgage consumers who have had their rights to a timely Loan Estimate disclosure violated. These violations can impact mortgage consumers greatly when it comes to making the best financial decision regarding their mortgage. In spite of XXXX and I conversation being almost childish in nature, per the fiduciary responsibility nature of my business along with the severity nature of impacting consumers financially, ( Mr XXXX said refusal to issue Loan Estimates and knowledge of others concerning Regulation Z ), is why this claim is being filed.

To refinance my property to a lower mortgage rate I applied for a conventional $ XXXX loan at 3.99 % with an {$800.00} credit from eRates. The loan officer locked it with a 45 day close on XXXX XXXXOn XXXX XXXX I provided all required documentation, and the appraisal was completed by XXXX XXXX. The underwriter processing the loan did not contact me until XXXX XXXX. And I was provided a list of XXXX items to provide, including all mortgage info, taxes, HOAs and insurance information for a secondary property I sold earlier in XXXX. Upon providing all of this information, the underwriter would reply days later and require new items. The problem : she requested the earlier items from the wrong property address. She actually wanted my home address. From there on the process was a disaster. The underwriter connected the HOA dues to my current home, which has none. I wrote XXXX letters to explain that I did not owe HOA duesThen on my XXXX taxes there was a mistake listing me as the owner of a home business instead of my wife. Even though I provided a CPA letter and my XXXX taxes showed the problem corrected, I had to provide proof of an amended return that had to be received by the IRS. I complied with request after request for over 15 days. Concerned by how many errors and requests the processor was making, I called, wrote, and left multiple messages stating I was concerned with the timing of the loan, and that I needed to talk with someone to make sure things were being processed correctly. I would normally receive no response back, and I would have to call repeatedly until I could get someone on the phone. My processor also took a 5 day break over the holiday weekend. After over XXXX responses to conditions I reached what was supposed to be the last on XXXX XXXX. Then another was issued because my XXXX return was amended to address a discrepancy with income reported by my wife 's business. Who is not even on this loan. I was told there would not be a problem passing the lock period, and that I had fulfilled all requirements by clearing up my XXXX tax return. Then not until XXXX XXXX, I received no correspondence. Where I received another notice from the lender that they discovered a XXXX report ID as active from XXXX listing the house I mentioned as sold earlier. To clear up this issue I provided proof the loan was paid off, I contacted XXXX mortgage companies as the loan was sold from XXXX to the next. But erates still refused to clear the loan through their Fraud department. I finally had to track down the XXXX company itself and file a claim to remove the record. Which takes 30 days just for them to look into the inquiry. Given the extreme mishandling of my documents, the requests for incorrect information, and the lack of timeliness from this lender I finally lost the loan. And I refused to pay close to {$3000.00} which eRates wanted to charge me to extend the loan lock to 60 days. Now Rates are up, and I can not get this loan again. I have close to an XXXX credit score, and make enough income alone to far exceed any debt to income ratio. And in the past few weeks I 've obtained financing for a different home priced at $ XXXX. There is no reason this loan should not have been issued to me. And it 's cost me {$900.00} in appraisal costs and CPA fees. Plus the chance to lower my mortgage rate over XXXX of a point.

My wife and I decided to refinance our mortgage this XXXX. I checked with a number of mortgage lenders, including our existing XXXX, and chose XXXX Mortgage, a division of Gateway Funding XXXX due to their offering the best rate and assuring good service. The originator I dealt with was XXXX XXXX XXXX, NMLS # XXXX ( his phone number is ( XXXX ) XXXX and his email is XXXX ). We locked in a refinance rate on or right around XXXX XXXX, 2015. This was for a very standard 30-year fixed rate mortgage that was eligible to be resold to XXXX of the big gov't agencies. We had just taken out this mortgage in conjunction with buying our home a few months prior, and had absolutely no issues or delays in doing so, based on our credit, income, assets, etc. We locked in the rate for the standard term and the rate was to expire on XXXX XXXX, 2015. This left us plenty of time to complete the refinance. Based on the rate we chose, Gateway agreed to provide us a lender 's credit of {$4100.00}. Rates started increasing right after we locked in our rate, so we were quite happy with the rate we got. However, through no fault of our own, Gateway took an extremely long time during this process. It took them a full week just to order the appraisal, which then took another couple weeks, and at every step, the folks at Gateway were very slow and unresponsive. We provided them all the information they requested without delay at every step of the process. I called them many times to ask them to hurry and they did n't even reply to my messages most of the time. Towards the very end of the rate lock period, when rates were much higher, they came up with yet another issue for delaying the process. This issue was a credit check that was done by some other mortgage company at the time I was checking rates in early to mid XXXX, and Gateway admitted it had been on my credit record all that time. Yet, they only checked my credit again right before the rate lock was ending. It course turned out not to be an issue, but now our rate lock had expired and Gateway said they would have to charge an extension fee, so they reduced our credit by {$920.00}. I complained multiple times about this. Gateway admitted it was n't their fault but they refused to do anything about it. Finally, they said the best they could do was to knock off {$250.00} from the extension fee. So they reduced our credit by {$670.00}. At this point, rates were much higher and I felt I had no choice but to take this deal. I believe this is outrageous as well as highly suspicious. I know how these finance companies work, and that they hedge their interest rate risk on such rate locks by shorting Treasuries and those sorts of transactions, but that by delaying the process when rates have risen and recutting the terms, they can benefit themselves at the cost of consumers. I think CFPB should investigate Gateway and see how many times their underwriting processes go over the rate lock period during times when rates have gone up vs. times when rates have gone down. I applied for a refinance XXXX fixed loan through eratesmortgage. Their broker XXXX XXXX XXXX has worked with me and we locked the rates at 2.75 % with lender credit {$2200.00}. After that, a man named " XXXX XXXX '' from the Finance of America Mortgage LLC started to process my files and coordinated all the process. During the process, I submitted all their required materials in a very short turn around time ( submitted in the same day or next day ). And I kept checking with XXXX and XXXX to make sure my process was going well. However, due to their low efficiency, they told me on XXXX/XXXX/2016 that my rates lock period has been expired. If I want to continue the process, I have to sign a contract that they will change my lender credits to {$1700.00}. Every time when I checked with them about the process, I made it very clear in several emails that " please speed up your process and make sure I can close on time ''. Also, I stated in a handful of emails that " I will not accept any change of the rates and lenders credit I have locked ''. In addition, I have already paid them {$490.00} for the appraisal. My credit have got pulled by them as well. Not to mention the time and effort I have spent on this case. After they changed my rates ( lender credits ), I have asked them to fix it right. Because as a business, you can not let your customers pay for your faults. But things turned out to be very disappointing. First, XXXX never replied my emails. Second, XXXX told me it 's not his job to make my closing on time. XXXX also listed reasons like appraisal company, title company, and etc are not working for us. He sent me a timeline and told me that he thought he did everything on a timely manner, unfortunately my rates lock was still expired. All these unreasonable arguments make me very confused. I thought XXXX was suggesting that his company offered me a good rates and lender credits within a time window that the customer for sure could not be able to close the deal on time. Even though the rates they offered were very attractive, but they know it from the very beginning that I have no way to get it. Then they can let me to sign a contract with much higher rates! If I did not ask them, they will never tell me that my rates already changed from the documentations. I am very disappointed of there companies and I feel that I have been tricked. Besides pointing figures, they never offer any solutions to solve the problem. It 's the business ' responsibility to make the customer get what he quoted provided the customer finished his due diligence.In addition, XXXX is the one who coordinated all the process. And the process got delayed and as a customer I suffered financial losses, who should be responsible for it? I am also curious that is it planned at the very beginning for all their business? i.e. offer you a good rates to get your business ( then you will not do business with other companies ), but after 45 days they will let the rates lock expired and then ask you to sign for a higher rates??! I urge for justifications and clarity, especially for the compensations of my financial losses.

I began the process of refinancing XXXX of my properties with XXXX XXXX on XX/XX/2015. I signed and agreed to a 2.99 % interest rate, fixed, 0 points and a {$480.00} lender credit at closing. My rate lock date was XX/XX/2015. Due to circumstances beyond my control, the underwriter continued to delay the closing such that my rate lock period expired. On XX/XX/2015 XXXX sent me a new rate lock agreement. On this new agreement they added points ( 0.125 % or {$240.00} ) and took away my lender credit of {$480.00}. My husband and I declined to sign this agreement and asked that XXXX honor their original obligation to us as we signed on XX/XX/2015. The delay in closing supposedly was due to the underwriter having a problem with my husband and I refinancing another property at the same time. I explained to them that the other refinance was simply improving the terms of existing debt and involved no new debt. The underwriter supposedly insisted that the refinance with XXXX Mortgage had to close on the same day as the refinance with XXXX XXXX. They would not agree to close sooner even though my husband and I have been willing to close at any point and could have easily closed by the original rate lock date. I asked XXXX XXXX if they could give me an earlier closing date but they told me XX/XX/2015 was their earliest. I made XXXX aware of this. As a result of the underwriter refusing to close on any date other than the date of the XXXX refiance closing, the rate lock date expired. Of note, the next rate lock date sent to me by XXXX XXXX was XX/XX/2015 even though they had already told me that I would have to close on the same day as the XXXX refinance XX/XX/2015. I communicated with XXXX XXXX XXXX by email and expressed to her that XXXX should pick up any costs associated with the delay or ask the underwriter to pick up the costs but that my husband and I should not be responsible for additional costs as we were not in control of the closing date. She indicated to me that she would discuss with management. After I continued to ask her for a corrected rate lock agreement and loan estimate paperwork she finally gave me information which revealed that they were offering me even higher points ( .375 or {$720.00} ) on my 2.99 % interest and no lender credit of {$480.00}. So now, my additional closing costs have been increased to {$1200.00}. This is wrong on every level. It is morally wrong. It is likely illegal. I ca n't believe that consumers can be charged fees for delayed closings when they have no control over the closing date. My husband and I provided timely provision of their documents requests, signatures, etc. The closing was delayed by the underwriters because of their concern about another refinance which added no additional debt to our situation. XXXX in now trying to " close my case ''. I do n't want to close my case. I want to close the refinance loan upon the original terms. They refuse to do the right thing and seem to be enjoying making matters worse by continuing to make the terms of the loan worse and worse for me and my husband. Do I have any recourse or protection as a consumer?

My wife and I began the refinance process on our home, signing a loan estimate on XXXX XXXX, 2016 with XXXX Mortgage ( Finance of America Mortgage, LLC ) through XXXX XXXX, XXXX XXXX. The loan for {$270000.00} had an interest rate of 3.5 % with 0.125 % in points ( {$340.00} ). The rate was locked to XXXX/XXXX/2016. On the same date, we are also informed we could choose our own title company because we could get a better rate than the lender preferred company having used the title company recently. On XXXX/XXXX/2016, we provided the lender XXXX XXXX XXXX the name ( XXXX ) and contact information for the title company to be used. On XXXX/XXXX/2016, we received our Closing Disclosure which listed the title company as XXXX and the higher rates we wanted to avoid by using University. We immediately informed the lender XXXX XXXX XXXX that day of the error and requested for the title company to be changed. On XXXX/XXXX/2016, we received a revised Closing Disclosure which did change the title company to University and the lower rates, but the discount points were increased 0.125 % to 0.25 % ( {$680.00} ). We immediately contacted the lender XXXX XXXX XXXX that day and inquired as to the increase in points. He said it was due to the rate lock expiring on XXXX/XXXX/2016, they had to charge an additional 0.125 % in order to keep the same interest rate of 3.5 %. We told them that was unacceptable because the only reason we were closing later was due to their title company error. XXXX informed us that day that he submitted an underage request to his manager for us to get a credit back, that it would be approved in 1 day, saying " OK, looks like we are good with this, '' and also asking us to " SO please move forward with anything else ... '' XXXX also verbally told me over the phone that it would be taken care of. On XXXX/XXXX/2016, we received another revised CD, and again it listed the points at 0.25 %. We again immediately contacted the lender XXXX XXXX XXXX that day of the problem. XXXX did not respond. We received our final revised CD on XXXX/XXXX/2016 ( closing day ), and it still had the problem. We again informed them of the error and they said : " I have requested it last week, will get with upper management again ... '' We decided to close in order to avoid any further issues ( and charges for not closing ) with the lender but in reliance that we would get a credit for the additional points in the amount of {$340.00}. Having closed and received no refund and no word, we contacted the lender XXXX XXXX XXXX on XXXX/XXXX/2016. All we got was that they were working on it with their management. Again we inquired on XXXX/XXXX/2016, and again were given the excuse that the request was submitted and they were waiting for management. Again, on XXXX/XXXX/2016 we inquired and were finally told that we were not going to receive the refund and that they essentially knew that was the case all the way back to closing, but finally made it clear to us.

I applied for a cashout refinance mortgage loan with lending.com, through Finance of America Mortgage LLC on XX/XX/2019, promptly submitting all requested documentation. My husband and I have successfully finalized approximately 30 mortgage applications, 2 within the last 5 years, so we are very experienced with this process. This is the first consumer complaint I have filed in my lifetime. I complied with the stated request from the prospective lender : Here is what we need you to do for uswith the IRA asset in your name., we need you to set up a distribution of so we can get an approval. Once you close and this has funded, you can discontinue to the IRS ( sic ) distribution at your convenience. Once that was done, the prospective lender issued a Closing Disclosure, issued XX/XX/2019 with a closing date of XX/XX/2019, with a loan amount of {$270000.00}, interest rate of 4.125 %, with points at .375 %. A few days later, I received an email which said I did not qualify for the loan specified in the Closing Disclosure after all ( which had been offered to me if I set up the IRA distribution ). Rather, I qualified for a significantly smaller loan. Additionally, I was offered 4 other loan options from which I could select. I called the president of lending.com, and discussed the numerous errors made by the lending staff throughout the application/closing process, most of which are documented by approximately 200 emails. Among the many errors are a {$700.00} appraisal fee as opposed to the {$470.00} signature-authorized VISA payment. Additionally, when a {$33000.00} closing cost was challenged by me, the lender explained it was only a typo. I told the president of XXXX that I believe I am a victim of age/sex discrimination in this transaction since I am a XXXX year old woman sole applicant. He said he would have two senior officers review my file. A few days later, I received yet another Closing Disclosure, issued XX/XX/XXXX with a closing date of XX/XX/XXXX, with the same loan amount, same interest rate, with points now at .5 % ( an increase of {$350.00} ) which I signed and submitted, pleased that the lender was honoring the companys previous commitment. The lender responded to my approval regarding the Closing Disclosure ofXX/XX/19 by stating : That was simply a redisclosure. We need you to choose one of the 3 options that I gave you to move forward. ( 1 of the 4 options seems to be no longer available. ) We extended it for a short amount of time as a favor to youlikelihoodthere will be a significant cost to you to extend again ( He made no mention of the increased cost of {$350.00} ).

I was closing out my loan and I had to close later than schedule because of my wire transfer not coming in on time as of XX/XX/XXXX. So, I was already stressed out. On XX/XX/XXXX, I receive a phone call from XXXX XXXX stating that I never submitted docs for XXXX XXXX. However, I submitted the bank account activity in XX/XX/XXXX. XXXX admitted in her e-mail that she assumed that I was going to use my XXXX account because I had enough funds. But, the thing is I had more funds in my XXXX account. Why would she not assume that the funds would come from XXXX account? So, now, I had to drop everything to close on XX/XX/XXXX. I was faxing documents to XXXX like crazy, even into my lunch break! XXXX didn't even know that I had two accounts with XXXX XXXX. One account was closed. She didn't even know that and was asking for statement on the closed account when there was another account that was opened. I had to tell her that! She just asked for all the documents even the ones that I already submitted in XX/XX/XXXX! When I told her that I already submitted that she responded in her e-mail, " Okay, maybe we don't need that. '' She was asking for documents that I submitted in XX/XX/XXXX and XX/XX/XXXX in XX/XX/XXXX! It was terrible working with her! So, I contacted the cooperate office and XXXX XXXX responded. She said she was going to do an investigation. She e-mailed me saying that she was concluding that I closed on XX/XX/XXXX because my wire transfer did not come in on time. However, I did not make a statement that I closed on XX/XX/XXXX because of XXXX. I was talking about XXXX being unorganized that she caused me more unnecessary stress. Secondly, granted that my wire transfer came in late, however, had I not dropped everything and jump on it to fax everything over to XXXX, I would not have been able to close even on XX/XX/XXXX either. Also, why does my wire transfer coming in late have anything to do with XXXX not being on top of her job and asking for documents that I submitted nine months ago? I believe had XXXX done her investigation properly, she should have known that XXXX only received the docs on XX/XX/XXXX which continued into my lunch break ; and she would have found out that XXXX did not have my XXXX XXXX information which means, even if my wire transfer happened on XX/XX/XXXX, I still had to go through this process! How does XXXX not being able to provide proper customer service because she was not on top of her job have anything to do with my wire transfer not coming in on time? I would never want to work with Fiance of America Mortgage.

I applied for a mortgage loan in XXXX of 2016. Considering I had credit issues, I was asked to explain and provide information. After the issues were addressed and reviewed by an underwriter ( so I was told ), I was issued a preapproval. I went shopping for a house, placed an offer, paid for a home inspection and paid for an appraisal. When the sales contract was completed, the loan processor started asking for the same loan stipulations during the application process which I submitted immediately after the email. My Close of Escrow was scheduled for XXXX XXXX, 2016. Email was sent back and forth between me, my real estate agent and the loan officer. On Friday, XXXX/XXXX/2016, the loan officer claims we are good to close the following week but may be a delay for a day or XXXX since they were waiting on a credit supplement to gather remaining balances on a couple of accounts that were in collections and showing duplicates. On Monday, XXXX/XXXX/2016 ( COE date ), I received an email from the loan officer asking me to call her back. She told me that I am no longer qualified for the loan due to the credit issues that were addressed in the very beginning of this loan application. I was devastated. She lead me to believe from all her emails that those issues were addressed and I will be able to get this loan. I have spent money, time and effort to get this loan. Had I known in the beginning that the credit issues may be a problem during the underwriting process, I would not have gone shopping for house, placing offers, paying for a home inspection and appraisal. Since I worked for a bank as well, I consulted with my colleagues regarding the decline. I had asked the loan officer to have her branch manager contact me. The branch manager was completely rude to me and my colleagues. He was unprofessional and I felt that I was being belittled for having derogatory information on my credit report, for using a XXXX grant that my employer offers in helping pay for the down payment as well as the XXXX Nevada down payment assistance. He asks why didnt I go with my employer instead of going to them for financing. In addition to the above information, I was not given any type of disclosures after my application and I am still awaiting a decline letter be emailed or sent to me to provide detailed information.

After providing all my paperwork, I was approved for right around {$240.00} on a Conventional Mortgage Loan. I began working with an agent names XXXX XXXX , who assisted me with finding a property. The home we found was listed for {$240000.00} but we needed our closing costs paid so we offered {$240000.00}. This was a push on my file and debt ratios and I barely qualified. When my wife and I saw the monthly payment, we immediately expressed grave concerns to ou r Loan Officer and Real Estate Broker and said we werent comfortable with it. Regardless, they continued forward with the process and ordered the appraisal while assuring us that we would be fine with the payment. After attending the required class for Homebuyers using down payment assistance programs, I learned more about mortgage loans and the importance of not putting yourself in a position where youre house poor. After much consideration, I reached out to XXXX and XXXX and told them that if the payment could not be reduced I was not comfortable going forward. Instead of working with me on it, they sent me a form to sign and said I would not be getting my Earnest Money back. My wife and I feel it is unfair that we lost our Earnest Money of over {$2700.00} because we tried hard to let our Loan Officer and Real Estate Broker know ( multiple times ) that the payment was too high. In addition, after signing the recession form and forfeiting my Earnest Money, I realized that the lender didnt include the child support payment I am obligated to pay and therefore I should not have qualified for the loan to start with. We strongly feel that we were coerced into buying a home that we explicitly stated was too expensive for our budget. We feel that our Loan Offer and Agent were both using extreme force and ignoring our concerns to get our loan closed and get paid. If you can please address our concern at your earliest convenience we would greatly appreciate it. The loss our Earnest Money has been truly devastating to us and we feel it was not warranted. It is our hope that you can assist us in getting it back.

I closed on my mortgage on XX/XX/XXXX with Finance of America, LLC ( FOA ) for the loan amount of {$400000.00}. I confirmed with my lender that I can make a principal payment at any time after XX/XX/XXXX with no penalty, even if it is before the first payment was made. On XX/XX/2018 I received a letter from FOA informing me that my loan has been transferred effective XX/XX/2018 and they will stop accepting payments from me on XX/XX/2018. On XX/XX/2018 I called FOA to inquire about making a {$200000.00} payment via wire transfer. They told me that they could not process my payment and advised me to wait until XXXX and send it to the new company. I told them that XXXX was three weeks away and that interest for {$200000.00} over 3 weeks at 5.25 % was a significant amount and that I wanted to pay now so I would have to pay that interest over three weeks. They told me that my account was inactive so they had no way of processing my check and advised me to hold onto it because that is all they would do with it if they received it ; they would hold onto it and send it to the new loan company at the end of the month. I told them that this was unacceptable.That my contract says I can pay a principal amount at any time. It does not say that there could be a three week waiting period in which you no longer will have a active account with any loan provider and thus will be without service during this time. I also believe that it is against the law to do this. They basically disabled my account and are refusing to service me, which will end up costing me hundreds of dollars in interest. They should have to process my payment because that's what my contract says. And if they can not do it -- or are unwilling to do it -- then they at the very least they should compensate me for the interest that I will be paying because of their negligent service. I would also expect to get some compensation for having to take hours out of my day to try to deal with this. so far I have spent three hours on the phone with them three times ( trying to get someone who could help me ), an hour on this page and XXXX page filing complaints, and probably more lots more time until I get this rectified.

I entered into an agreement with XXXX Mortgage to refinance my home at an interest rate of 3.625 %, and they were going to provide me with a {$2200.00} credit. An issue occurred with the appraisal they ordered, and an appraiser was not sent out for three weeks later than originally intended. I spoke with individual who sold me the product XXXX XXXX XXXX XXXX who informed me that as a result of the delay, a rate lock extension would be required, but because I was not at fault that XXXX would incur that cost and it would not be passed along to me. A new Good Faith Estimate was sent to me to confirm the rate lock extension, but this document indicated that the lender credit had been reduced because of the cost of the rate lock extension. I immediately asked my loan processor ( XXXX XXXX XXXX who advised me not to worry, and to sign the document for the sake of time, and the credit would be restored at a later date. XXXX more extensions were later required and I had the same concerns when the documents sent to me to sign, indicating that I would be paying, and each time I was given the same explanation as the first time. I sent XXXX emails in an attempt to confirm the original {$2200.00} credit, and although both XXXX and XXXX confirmed with me over the phone, they never responded to my emails, despite sending me other communications via email. Then, XXXX days before closing I was told that the absolute best they could do was provide a credit of XXXX {$1000.00}, and the justification was I could n't get a better deal elsewhere ( because interest rates had risen significantly XXXX and XXXX was not at fault, and the third party appraisal company was at fault. However, neither of those justifications hold any bearing, it is unethical to change the terms of an agreement last minute based upon market changes. I signed and closed on the deal because it was true, I could n't get a better price elsewhere after months had passed and interest rates had risen, but that does not make it okay to essentially lie and steal from customers. As for XXXX not being at fault, if that was the case, they should not have told me throughout the process that they were going to incur the cost.

XXXX company did not process the refinancing for XXXX mortgages in compliance with the Truth and Lending Act. As a results, I lost the opportunity to save thousands of dollars in savings. I also paid for {$900.00} for the appraisal fees that were not used. On XX/XX/2016, I applied with XXXX to refinance my personal residence and a rental property. After I submitted all the required documentation, the lender approved my application and promised to close within 60 days. The lender provided the disclosure documents on XX/XX/XXXX and the locked in interest rate agreements at interest rate of 2.875 % with XXXX discount ( {$2600.00} credit ) point for the principal residence and 3.375 % ( no discount points ) for the rental property. During next months, despite many phone calls, messages and emails, the lender did not do anything to reach the closing of the XXXX refinances. On XX/XX/XXXX, the lender called me and asked to renegotiate the interest terms since the initial lock-in agreements were expired. He offered new rates and I requested to lock-in 2.75 % ( no points ) for the residence and 3.375 % ( no points ) for the rental property. These new rates were significantly higher making the loans a lot more costlier. On this occasion the lender did not provide the disclosure forms, good faith estimates, and the lock-in agreements. Few days later I contacted the Lender to obtain the status and the lender responded that lock-in agreements. He mentioned having problems with this commitment desk. He also said that the interest rate are a lot higher. I believe that the Lender intentionally delayed processing the loan in order to let the lock-in agreement to expire and then offered hire interest rates that were not beneficial for consumer. The loans applications were not rejected I conclusion, I feel that the lender was negligent and discriminated against me when processing the loans applications and as a result I lost the opportunity to save ten thousands of dollars.

On XXXX XXXX, 2015, I contacted XXXX XXXX, who is a Branch Manager ( XXXX # XXXX ) with GATEWAY FUNDING, and learned I can lower my mortgage monthly payment from approximately {$2400.00} to {$2000.00}. I contacted XXXX XXXX about my additional expense to which he stated, GATEWAY FUNDING will refund {$290.00} back to me after I send in the money to complete the escrow process. I am complaining about XXXX issues : I learned my mortgage monthly payment was not {$2000.00} as promised by XXXX XXXX, but instead {$2200.00}, and I have not received my refund in the amount of {$290.00}, as promised by XXXX XXXX on XXXX XXXX. When I contacted him via telephone on XXXX XXXX about the monthly payment, he stated he made a mistake. I have contacted XXXX XXXX on XXXX occasions about the refund check. I contacted him via telephone on XXXX XXXX, which he stated he will issue the check on XXXX XXXX, the Friday after the application process was completed. I contacted him on XXXX XXXX, and he stated he would authorize the refund check. When I last contacted him on XXXX XXXX, I was told I should have already received it, then later verified by XXXX XXXX that he check has not been issued or delivered. It is my belief XXXX XXXX is taking advantage of my lack of knowledge in the loan application process by informing me of his many years of outstanding services and a promise of lower month mortgage payment only to deceit me to benefit himself.

Hello, I want to address an issue I had with XXXX mortgage company ( finance if America ) and my loan agent. When I started the process of finding a loan, the loan agent was extremely accessible and professional. However, once I had my loan rate locked in, problems started arising. The loan agent became extremely rude and difficult to get a hold of. He kept telling my realtor via email that he is in a meeting or training and never returned mine or my realtors calls. I was told 3 days before the close of escrow that my loan will not be approved since I did not make enough money last year, due to being on XXXX XXXX. The loan agent told me he has to add points to approve my loan, which was an additional {$1700.00} that I did not anticipate paying. This also delayed my escrow and I closed late. I do not understand how this happened, as I had sent all my documentation and income statements before I signed the original loan rate contract. This should have been verified from day one, not 3 days before close of escrow. At that point, it was to late to change mortgage companies. When I find out they were changing my locked rate 3 days before close of escrow, I was so disappointed, I emailed the loan agent and demanded to speak to his supervisor. The loan agent told me that he forwarded my email to his supervisor and if his supervisor chooses to call me back, then he will. I of course never heard back from any supervisor. The tactics used were unethical and unprofessional. They forced me into a situation that left me with no options. Either accept the terms or lose my {$17000.00} deposit and then not have an immediate home for me and my XXXX children. I did my research and this mortgage company had good ratings. However, my loan agent used substandard practices with deceptive techniques. This company reduced my chances of acquiring a new home.

We locked up the mortgage rate for a mortgage application in XXXX XXXX. The locked-in rate was valid for 45 days. XXXX requests many documents separately over numerous times. Our turn-around time for all the requested documents was less than XXXX hours. Many of the requested documents were redundant. eg. request a copy of passport and work visa. The mortgage application process took so long that our 45 days lock-in period has expired on XXXX XXXX. Due to the upward trend of the mortgage, we end up paying extra penalty {$1500.00} to buy points in order to get the same mortgage rate. When we asked XXXX why the application process took that long. XXXX blamed the long delay on getting ready for the title report. Then, we asked for the name of the title company, that we deal with our application, two times. XXXX did not provide us with the name of the company. Therefore, we can not verify the long process was caused by the title company. From our previous 20 mortgage applications experience with mortgage application, the earliest title report which was ready within the same day ; the longest title report was ready within the same week. There are many title company out there. When one title company fail to provide the title report within a week, mortgage broker should choose another tittle company. We were forced to pay a late mortgage penalty for our previous mortgage company. We were promised our mortgage application would be funded XX/XX/XXXX. Therefore, we thought we did not need to pay our XX/XX/XXXX mortgage payment, in our previous mortgage. We received phone calls from collection agency threatening us our house would be foreclosure within weeks if we did n't pay our XX/XX/XXXX mortgage. Debt collectors also threatened to report our late payment to all three credit bureau.

My boyfriend and I applied for a mortgage pre-approval with XXXX from Finance of America Mortgage LLC on XXXX XXXX, 2016. After speaking with XXXX, he said we were good to go and we put an offer on the house ( XXXX XXXX XXXX ). They accepted our offer and we sent them a check for the deposit of {$1000.00}. On XX/XX/XXXX, I received an email saying we had to place a stop payment on the check, which I did. We had to resign our Agreement on XX/XX/XXXX and send out a different check. Once this was completed, we ordered our home inspection. Post inspection, the purchase price was dropped based on outcome and we went through the negotiations. We then received a settlement date of XXXX XXXX, 2016. Everything was going great and smooth. The appraisal was ordered and we were told we were good to go. On XXXX XXXX, 2016 we received a call from XXXX telling us that the loan was not going to go through due to XXXX 's employment history not being long enough. We had disclosed this information at the beginning of the pre approval process and had inquired if this was going to be an issue. It had been explained to us that this was not going to pose any problems later in the process. All of the information regarding issues with our loan was not brought to our attention until a week before our scheduled settlement date and after we had paid {$1200.00} for various fees involved ( ie. appraisal and inspection ). We feel that had it not been for a lack of proper communication on XXXX 's part that this financial loss could have been avoided all together. I have requested my appraisal fee back from Finance of America Mortgage. We were not properly notified that this mortgage was not going to be approved and feel as though all fees involved are due to be paid in full back to me.

I negotiated the purchase of a new home for {$430000.00}. I submitted the original purchase contract, stating a purchase price of {$370000.00}, as well as all amendments to my lender as requested with the final agreed upon purchase price of {$430000.00}. The appraisal was ordered on XXXX XXXX, 2016 and performed on XXXX XXXX, 2016. On XXXX XXXX, 2016 I received the appraisal directly from the vendor electronically referencing a Contract Price of {$370000.00} and an appraised value of {$410000.00}. Unfortunately for me, the Contract Price was actually {$430000.00}. The appraisal even stated that the property appeared to be selling at a discount due to 'pressure to sell '. The appraiser used XXXX relocation properties and XXXX foreclosure for comparable. The appraiser appeared to be 'trying ' to get the appraised value lower and closer to the Contract Price based on several factors. I informed my lender at the time of the error and they contacted the appraisal vendor. I did not hear anything for a few days and eventually received a 'corrected ' appraisal reflecting the correct Contract Price of {$430000.00} but still stating an appraised value of {$410000.00}. The 'corrected ' appraisal also detailed in the addendum that they WERE NOT provided the amendments to the original contract price until XXXX XXXX, 2016 and that was the reason the {$430000.00} Contract Price was not utilized for the appraisal. As well, it was noted that the appraised value could not be changed. The lender was negligent by not performing the industry standard expectation of presenting the appraiser with ALL of the contract paperwork including all contract amendments. Ultimately, this appraisal could not be used for the purchase of my home due to the negligence of the lender.

One month later we received a paper from a company called state bridge its a company that is a collector we called because it was a bill on the amount of XXXX. we were told that its a loan that we took out for the house. we told them that we never asked for a loan for the house we were told that we only need so much down. But the XX/XX/XXXX said that finance of america mortgage does not tell the people that they need more money for the down payment so they go ahead and take out a loan in are name with out telling us.. we were never told about anything in the prepossess of the house. we think this is a fraud of this company to take out a loan with out are consent. that's why i think this company should be investigated we are not the only one that finance of america mortgage does this to us its been done to other people and they have to pay for a loan that they never asked for. the day of settlement we were not explained anything on the papers that we signed or why we had two mortgages. everything was a go go and never explained any paper worker that we signed. and they also threat you that if you don't give them information so that they can do their closing by such time that they will proceed with that if you don't give them the documents they have the option to pull the note meaning that your loan will be due in full. this company is a fraud and i think it need to be investigated.

I was approved for a loan and received the good faith estimate. The loan terms subsequently changed XXXX days before the close, but we were past the scheduled close date, my seller was anxious, and my family was staying in a hotel because our house had been sold, we continued to close. We completed the soft close at the escrow company on XXXX XXXX, 2015, and the final close was supposed to be completed on XXXX XXXX XXXX. PMAC lending services failed to fund the loan at this time. They claimed that they were waiting for receipt of an IRS transcript. This document was subsequently received but they still have n't funded the loan. I have been strung along for over a month with excuses and as of yesterday, I learned that they has decided not to fund the loan because they are having difficulty selling the loan. It seems that they have been " stalling '' on the loan close while they tried to sell my loan. It seems that the investor originally slated to purchase the loan decided they did n't like the property for their portfolio ( XXXX condo ), even though this has been known since the appraisal in XXXX. The property appraised above the purchase price and my 20 % down money is fully documented. My seller is obviously as frustrated as I am, and I am now forced to close on a inferior loan immediately because my seller has run out of patience. I will be forced to pay extra finance charges until I can complete a refi which most companies require a XXXX wait period after loan close. I am looking for information on specific protections in place to protect against fraudulent behavior like this.

I and my brother/partner applied to a mortgage company to refinance our property. We provided information in a timely manner, and responded quickly to follow-up requests for information. The mortgage company said they were having trouble researching title. I repeatedly offered my help if they would describe when the problem was. The mortgage company took weeks and weeks to resolve their issue. Meanwhile our interest rate lock expired and the interest went up and up. I tried repeatedly to offer my assistance. Finally, they agreed to share the issue with me and I was able to make a few phone calls and share a few emails to resolve the issue. There is something very wrong with the process and what happened. Whether outright dishonesty or ineptitude, my brother and I had to pay a huge price due to very avoidable delays ( as I demonstrated in resolving the problem ). We had refinanced the property more than once before, quickly, without any trouble. We were told by other lenders that it would take only a short time to refinance due our excellent credit ratings, solid income and assets, and our long ownership of the property ( 30 years ). We request government help to look into this issue to determine if we were treated in an unfair manner. It is hard for us to reconcile this as a fair business transaction. We feel that we have been served poorly, and possibly, treated criminally. The mortgage and escrow people were all very courteous, but we ca n't understand why the process stretched out so long and we thus were severely financially penalized.

On XX/XX/2019 my husband and I applied for a loan to buy a house with an FHA XXXX loan through XXXX XXXX at Finance of America. At that initial meeting, I was told I was pre-approved and to start looking for homes. On XX/XX/XXXX, a pre-approval letter was sent to my realtor and we received an accepted offer to purchase a home. On XX/XX/XXXX, XXXX was sent a copy of the accepted offer with a close date of XX/XX/2019. Over the next few weeks I stopped by XXXX office numerous times to check in and I was assured all was on track and he had what he needed to complete the transaction. On XX/XX/XXXX XXXX sent an email out to the realtors asking for a 45-day extension as he was unable to complete the loan and he needed to switch financing for our loan. on XX/XX/2019 we received our first set of disclosures from Finance of America dated XX/XX/19 there were two sets of the same paperwork sent to us. This set of disclosures was for a standard FHA loan not the FHA rehabilitation loan we applied for. There was no communication or explanation of what was going on with our loan. Looking back on our pre-approval letter the information doesn't match the loan we applied for either. We now have had to seek financing elsewhere and hope that we can get an extension and not lose this house or the earnest money we put down. This has caused us a great deal of stress and we are now rushing to get a loan for our family, when we started this process back in XXXX of this year. I am filing this complaint because, through absolutely no fault of my own, I lost out on a chance to refinance my mortgage on the terms I agreed to when I applied for the loan two months ago. The process was progressing smoothly until the appraisal. When the appraiser came to my home, he hostilely challenged the representation in my loan application that my property is a " single family '' dwelling. He insisted it was not. His position was that it is a " XXXX unit income '' property and, as such, he was owed a higher fee for doing the appraisal. I objected. Two days later, I provided the appraiser, as well as the lender, real estate records showing that the District of Columbia classifies my property as a single family dwelling. I asked to be provided something similarly official or authoritative that substantiates the appraiser 's contrary view. I was met with silence. My loan stalled for more than two weeks, because the appraiser was demanding additional money to submit his report. The lender was seemingly incapable of figuring out how to break the impasse. For weeks, I was repeatedly told ( upon inquiry ) that the matter would be clarified " tomorrow, '' but tomorrow never came. When I finally did hear from the lender, I was informed that another appraisal would have to be arranged, but there was now no time to close on the loan before the expiration of the rate " lock in. '' I was further advised that, in order to move forward with the loan, I would have to pay a special fee to the lender. I refused.

After 3 days the case number still had not be released I spoke back with the loan officer and sent him a copy of the form I had signed on XXXX XXXX still nothing was done. On the XXXX of XXXX I sent an email to the loan officer again This email is to inform you that I will be filling a complaint with the CFPB for your failure to comply with the Law on my right to cancel with your company and you to release my case number in a timely manner. I notified you by phone on XXXX XXXX 2016 that I was canceling and going with another company by XXXX XXXX the case number was still not released then you were sent an email letter dated XX/XX/2016 requesting that the case number be transferred to the new company and still nothing is done. I was Approved for a mortgage by Finance of America Mortgage at 5.125 % went through enormous amounts of paperwork for underwriting to complete loan process only to have lender to come back over and over again with requests of paperwork.. Changed closing costs several times told me I had two choices on what to pay depending on if I get a letter from my lawyer will determine what my closing costs will be and my interest rate will be ( raised my interest rate ). My loan is approved with conditions that what I signed was not a contract and closing is on XX/XX/XXXX and now its impossible to close because I dont have my XX/XX/XXXX taxes that I filed which I didnt file because I did not work. He argued that I have to have a letter from someone stating I didnt have to file taxes in XX/XX/XXXX I receive XXXX and Alimony he already aware of this. I signed a form 3 weeks ago pertaining to the taxes so why this is coming up now before closing I dont know? My realtor and several other people cant make sense out of what hes doing ..in the meantime Im going to lose the house of my dreams. He never mentioned closing costs from the beginning of this process in the amount of {$8700.00}. I was told I had to pay {$3100.00}. If I argue with him the interest rate will go up or he makes it hard on me. Hes played the Bait and Switch tactic the entire time of the loan process. I am trying to refinance my home mortgage for a better rate. Found this lender ( XXXX ) through XXXX website ( XXXX XXXX XXXX ). They dropped the ball hard. XXXX XXXX was our loan officer and after getting us into the refinancing process, he acted completely differently. The rate was locked on XX/XX/2019. I'll keep this brief but my experience echoes a lot of what other 1-star reviews out there on XXXX website say - he didn't answer the phone on time and called back late in the evening, he ignored emails, when he did respond via email it was with partial and obscure answers. There is almost no communication about the loan and I ended up sending email constantly for the status update. In the end, we missed our close date on XX/XX/2019 completely due to the circus that is XXXX and XXXX XXXX. I agreed to pay extra fees for rate lock extension penalty in order to keep the process moving. Then the lender missed the deadline again! Received the updated Loan estimate on XX/XX/2019 and they charged for even more of penalty. I refused to pay any further extra fees due to their incompetence. It definitely wasn't worth the headache or stress. They don't even know their own programs and asked for unreasonable requirement in the process just to hose me and slow things down so that they can collect extra fees. This is very frustrating and disappointing. This is definitely a scam to bring people into the process. They wait for the rates to go up and come back to charge you more using all sorts of excuses.

On XX/XX/2018 i was approached by XXXX XXXX and XXXX XXXX from XXXX XXXX XXXX XXXX and XXXX XXXX XXXX to refinance my home. After providing them all of my financial information and documents, they were offered me a better deal on my current mortgage so we proceeded with the formal application. They also told me I had to pay for 2 appraisals ( {$720.00} ) each for a total of {$1400.00}. I gave them my credit card info and they ordered the 2 appraisals from 2 appraisers of their choice. Both independent appraisals came back at approximately at {>= $1,000,000} which is what i paid for the house a year earlier. I don't hear back from them for over a month and then i finally heard back from them and learned that the lender they picked did not " approve '' the appraisals and decide to come up with their own valuation at $ XXXX without setting a foot in my property. Since they didn't use or approve the appraisals they made me pay for, i asked for a refund on them. After a lot of arguing, back and forth, they agreed to refund me only one appraisals. I involved the president of the company, XXXX XXXX and he stopped responding to my emails despite several attempts. The company refused to refund me for the second appraisal and i honestly think it's absurd. They approached me, made me pay for the appraisals and then don't use the appraisals. What type of accountability process do they have in place? I have emails of everything mentioned in this report.

The refi was to close on XX/XX/XXXX. All along it has taken back steps to process the a bunch of delays the most recent delay was that because the underwriter say that I had a different name on a document they insisted to know information about my divorce that occurred in XXXX even though my ex-husband is deceased. even after I have provided the death certificate ( which stats divorced ) they insisted that their staff would research the divorce and search for a final decree. In the meantime I think that I have been put through a process of delays to put me into a dire need to sign whatever the produce using the excuse that the found evidence that I did not disclose or whatever excuse the come up with for a bait and switch scam. The most recent problem today was that XXXX XXXX insisted that I provide homeowners insurance for my house in his co name, while my house is insured through My XXXX XXXX XXXX. The new insurance is in effect at XXXX XXXX tonight listed with Finance of America as ben, while my XXXX XXXX XXXX is held with California Department of Veteran Affairs and is fully insured with XXXX XXXX. I have been appoved for refinancing my primary residence from FHA loan to Conventional loan. I was in a mortgage refinance process with Finance of America, LLC. Near the end of the process, a separate company offered me a much better interest rate and significantly lower closing costs on a same term ( 30 yr. fixed ) loan. I asked my loan officer, XXXX XXXX, if there were any penalties or policies against me terminating my process with Finance of America. He assured me there were no fees and no laws against cancelling the process. As a result, I decided to end my process with Finance of America. During the initial loan process with Finance of America, I made a payment to Finance of America for {$440.00} for an appraisal of my house. Finance of America refuses to transfer this appraisal to my new lender company. All that is required of them is to email a release on company letterhead to my new lender, which has been requested several times by myself and my new lender. Requests were made to XXXX XXXX, XXXX XXXX, and XXXX XXXX. There are no laws, rules, or regulations in the mortgage industry preventing this and after some research I learned that nearly all lenders will perform this service when requested. As a result of Finance of America not transferring my home appraisal to my new lender, I am required to purchase another home appraisal at an additional {$440.00} cost to me.

I received an email from our current mortgage provider on XX/XX/XXXX with some small detail of what savings I could obtain with a possible refinance. I asked questions via email and asked to see an application for more detail on how the process works. I viewed an electronic application with only my husband 's name XXXX on it and I did not like the information so I rejected the application. I was asked to reconsider and have my husband call the finance company. I did not respond. On XX/XX/XXXX we received a letter from the mortgage company dated XXXX XXXX XXXX stating an application was submitted and denied. The letter has my husbands credit score from all three credit bureas dated XX/XX/XXXX. I called the mortgage company to speak with XXXX the name on the notice. He is telling me that we submitted an application or inquiry and that the letter is simply an update to how it concluded. I asked why we were getting this now, and he said we get it 90 days after the inquiry. This letter is dated nearly 10 months later. In short : I 've been bait-and-switched by e-rates mortgage. I applied for a mortgage refinance with e-rates in XXXX and was offered a XXXX rate. I was told in XXXX that the only pending matters were final balances and an appraisal. On XXXX XXXX I received a refund on my credit card from an appraisal company, with no word from e-rates. I tried to reach the XXXX people I had worked with, by email and by phone, and neither returned my call until I left a voice message saying I would being going to regulators. I received a Tuesday call but when I had heard nothing by Thursday, I posted on the XXXX page of XXXX, through which I first had contacted e-rates. Although XXXX promises to " act as ombudsman '' on all loan through its site, there is zero contact information on its site. Since then I have received a " not-to-worry '' email from XXXX and a call from e-rates offering me " market rate, '' which is currently .1+ percent higher than I was quoted in XXXX. If this is not a bait and switch, I 'll eat my XXXX XXXX diploma. Thanks for your help in shutting down scammers, of which I know this is hardly the worst -- but I bet they 're making a big cash in at the margins.

This complaint is about finance of America. They purposely held onto my loan documents & refused to send them to the escrow/title company. I was forced extend the closing date from XXXX/XXXX/2019 to XXXX/XXXX/2019. Which was done on XXXX/XXXX/2019. This left me homeless with no address. I'm a single mom with XXXX year old son. Unable to get a hold the loan officer handling my case, he refusing to return any of calls/text messages/emails. Leaves his office early sometimes doesnt show up at his office at all. The realtor involved has lied & made excuses as to why the process is being delayed. I have tried to work with the office manager for finance of America, but felt I was being told a story. I feel like this is fraudulent scam & im being taken advantage of, as I have paid for earnest money {$2500.00} cleared my bank on XX/XX/XXXX. Inspector was paid in cash on XX/XX/XXXX. Paid appraisal {$700.00} cleared my bank on XX/XX/XXXX. Now I'm being told that I can't get any of that money back. I was supposed to sign & get my keys on XX/XX//2019. With the lack of communication from the loan officer, this has left me homeless with no money, no address.

I started my loan application with XXXX about 2 weeks ago. After putting a rate review on there website I received a call from XXXX XXXX XXXX. The reason I went to their listing was because they were boosting a XXXX closing cost refi for my situation. After speaking with XXXX he assured me that it was indeed a zero closing cost loan. All I would have to pay was for the appraisal {$450.00} and have money at closing to cover my escrow for the year. After 2 weeks of sending the required paperwork in, they then notify me that I would have to bring {$2800.00} to closing. This includes my escrow and which is right around {$1000.00}. So they are hitting me with {$1800.00} with fees after their site and XXXX said there would be none. In my eyes this is the definition of bait and switch. Since locking in my rate the rates have gone up so if I were to go with another lender I would not get the 3.25 % rate on my 15 year loan. So not am was I charged for an appraisal that is squandered if I do not continue and pay their fees that they did not disclose and assured me I would not be paying, it will cost me thousands in the long run if I do not pay up ...

This is a classic bait-and-switch scheme. Finance of America gave me an Estimated Prequalification Cost Analysis on XXXX XXXX, 2016, quoting a 3.75 % interest rate, 0 % points, and {$440.00} Lender Credit ( please see attached. ) I signed a Loan Commitment with Finance of America on XXXX XXXX, 2016, locking in an interest rate of 3.75 % and total points of 0 % ( please see the attached ). The lock was set to expire on XXXX XXXX, 2016. After paying {$430.00} for my appraisal and going through a long underwriting process, I was informed that " circumstances have changed. '' On XXXX XXXX, 2016, I received a Changed Circumstance Cover Letter asking me to sign a new loan estimate with additional {$1200.00} in origination charges ( 0.725 % in Points and the loss of the {$440.00} Lender Credit. ) Even though my loan amount went down from {$160000.00} to {$140000.00}, my Loan Costs, net of Lender Credit, went up from {$1300.00} to {$2800.00} ( please see the calculation sheet attached ). I have reached out to XXXX XXXX, the branch manager in XXXX, NC for resolution, but he is unwilling to honor the Loan Commitment. Please help.

While under contract to Sell a home, the Buyer 's lender repeated lied to me about the Buyer 's ( who is also a licensed Real Estate Agent ) ability to obtain a loan on the home. I am the listing agent. This lie cost many months of aggravation, thousands of dollars, hours of work to me, the Sellers and the Sellers of the replacement homes involved. The Sellers had every intention of filing a complaint ... but decided they did n't want to add to their stress and aggravation. That is why I am filing instead. I was told the Buyers were " clear to close '' with the exception of their contingency to sell their current home. In the end, I found out they had been denied the loan by the in-house lender, then denied the loan by an outside investor. Just days before the final 'closing ' date, I was told everything was good to go and that they were just waiting on final numbers ... it turns out the lender was submitting the loan package to a third investor. They were ultimately denied that loan as well.

I obtain a mortgage loan from Finance of America in XX/XX/2015 and I send all my payments every month electronically from my bank. In XXXX someone from XXXX calls me to inform that they dis not receive a payment in XXXX and in a threat matter they said if I do n't pay by the end of the day that they will report me to the credit bureau and that I need to proved to them proof of payments. The person on the phone became some what hostile and repeated again that I must send them proof or they will report. She put our information through the automated system and said we were approved in XX/XX/XXXX. Contacted finance of America numerous times about my two mortgages with them. Informed them the credit report states I owe $ 200ish and confirmed I do not owe them any outstanding balance. My report continues to show account is delinquent. I have called as well as initiated email threads confirming I do not have a balance and the loan has been sold. However, my credit report and score are perpetually impacted. As of now the lenders have informed me they forgot to wire excess funds nearly {$6000.00} to my transfer lender. The taxes and insurance were included in the loan so that we wouldn't have any major lump sums due. Hello, There is a newer mortgage company in the XXXX XXXX area called 'Finance America ' that is now advertising targeting the XXXX market through radio adds in the radio station XXXX, they have had several adds this last week ( XX/XX/XXXX - XX/XX/XXXX ) through the same spoke person XXXX XXXX ' that used to do the advertising for the former well known predatory lender XXXX ' , they are again misrepresenting loan programs and launching un compliant and unfair adds, there is no XXXX information disclosure and no mention of being and Illinois licensee, nor an equal housing lender ; this group of loan officers/ lenders committed multiple cases of fraud before they were put out of business a few years back.

I just refinanced my mortgage with Finance of America Mortgage. The first payment was due XXXX XXXX, 2016. I mailed the payment in XXXX. They applied the payment INTO SUSPENSE on XXXX/XXXX/2016. They notified me that there would be a new lender effective XXXX/XXXX/2016. They refuse to apply the payment to the loan even through they show they received the payment on XXXX/XXXX/2016. They are telling me that they plan to send the payment to the new lender, but they are CURRENTLY my lender and servicer. My mortgage contract stipulated in what order the payment will be applied. There is NO ESCROW account, so the only choices for a early payment would be P & I. There is no option for SUSPENSE.

Finance of America deliberately let the rate lock expire ignoring my numerous follow ups about their failure to contact the appraisal company to get it expedited. After my appraisal was completed 6 days before lock they wasted more time to add more Originate fee to my leaving me with no option but to pay. Basically forcing me pay the fee with no option. Looking at other reviews this seems to be the loophole they are using to let lock expire so they can charge more fee. According with my Purchase contract, seller agreed to pay for the escrow fee, owner 's title insurance, transfer taxes. I received a supposed line of credit from finance of america and the changed the terms from XXXX % to XXXX %, the origination fee was to be prorated as money was pulled, they changed it to a hard loan with paying interest on the full loan amount, not money being used.
