I need your assistance to enforce the law that some organizations avoid and without conscience scamming and frauding the public. I am attaching the documents that I sent to Finance of America and yet to receive any answer From them. Please, I need your help in this delima. I can not sleep at night and my health is deteriorating thinking that I have been scammed and cheated and taken advantage of, this is illegal. What are the rules and laws good for? if they are NOT implemented! Companies and employees are taking advantage of individuals without any conscious or remorse. I truly hope that you can help me in this situation. Companies like Finance of America should understand that there are laws to follow and obey no matter how big and powerful the company is! Finance of America XX/XX/XXXX REVERSE XXXX XXXX XXXX XXXX, I am faxing you the document that started my loan. Please check on the interest rate and even the loan principal balance. If you recall our discussion and my request, at the time around XX/XX/XXXX, I stated that I would like to refinance out of the existing loan with XXXX XXXX to get a better FIXED interest rate and you agreed to help with that and XXXX XXXX, broker, was my witness. We were supposed to start this loan with 4.550 % ( see document ), then it was pushed to 5.00 % because of all the extensions of time that the loan took and the unreliable help from Finance of America due to XXXX that some transactions took to complete. It was a very slow frustrating process to have the process going. All the way to the end before closing, we were discussing 5.375 % Fixed Loan only. The loan took over a year to close. During the time, we had ups and downs with Finance of America employees. Due to XXXX, short on staff help, transactions took extra time to be taken care of and attended to! Then, it was very difficult to deal with the escrow agent XXXX XXXX to the point of ignoring phone calls and emails. XXXX XXXX, My Mortgage broker, had a lot of issues with XXXX XXXX to the point, he was refusing to communicate with him. Then, I was asked by XXXX XXXX to communicate with XXXX and he was unwilling to talk! The only time I have heard from XXXX was in the end after I called him numerous times and emailed him a few times to communicate with me. I received a phone call from XXXX XXXX telling me that he is changing the loan to a jumbo loan and he has to change the account number and the interest rate might be a little bit higher up to 5.5 %. You and XXXX XXXX never said or mentioned that he is going to change the structure of the loan from a fixed loan to anything other type of loan. Unfortunately, XXXX XXXX changed the loan structure without the client 's approval and knowledge. ( This is against the law ). Real Estate disclosures ( TILA-RESPA ) are a must in this situation and XXXX XXXX ignored the law and proceeded with closing with a loan that has been altered to fit his ego and time schedule to exit from Finance of America to his new hired job with a different company. This loan started in XX/XX/XXXX and closed in XX/XX/XXXX. You ( XXXX XXXX ) and XXXX XXXX had ample time to send me the loan disclosure to have my consent and approval. However, NO one had the decency and the professionalism to respect the law and forward me the disclosures based on TILA-RESPA. The loan structure was altered and changed from fixed to arm based on the recent document that you sent me in XXXX of XXXX. XXXX XXXX left the documents behind and rushed to his new position. However, before sending these documents to the notary to be signed, nobody checked on the documents for any accuracy, changes or mistakes!!, nor did I receive a copy to review before signinig! ( I believe this is sort of payback against you for whatever is between both of you ). At the time of signing with the notary, nobody advised me that the loan was changed. I was under the assumption and impression that everything was still the same! Everything was rushed in the end to close the loan with the impression the loan is still the same and there were NO changes. We had difficulties finding a notary that services homes. It was very difficult for us to accept a stranger into our home because of XXXX infections. The signing session was fast to limit our exposure to a stranger in our home. When we proceeded with the signing, the notary told me at that time you are getting about a 5.5 % interest rate, which is great. With that assumption, I proceeded with the signing! Unfortunately, I am not a mortgage officer and I do not have much knowledge about loans. I am a regular citizen and I go with whatever the professionals say and promise. Mortgage brokers have fiduciary duties like trust, loyalty, accounting and disclosures to the client which in this case was omitted and ignored. With all the alteration of the loan #, interest rate and structure, the different charges that were tagged to the loan? The loan balance as of today is close to a XXXX dollars from $ XXXX. In less than two years, This is OUTRAGOUS. Alteration of documents without disclosing the facts is against the law and it is considered FRAUD ''. There is definitely something not right in the loan documents and someone should be held accountable to all these changes without client 's knowledge, approval and full disclosures. Specially, from the beginning of this loan my request was A FIXED RATE LOAN. So basically, 1-The loan took one year to close 2- Finance of America was short handed because of XXXX and was very difficult to proceed. 3- I was never informed about any changes. 4- I was never given the chance to examine or approve any document before signing. 5- Loan disclosures were omitted and were never given to me. 6- TILA-RESPA disclosures were never honored and exercised, avoiding and ignoring the law. 7- Loan documents were altered and changed without my knowledge and approval. 8- I believe a FRAUD was committed in this situation. 9- Someone should be held accountable for all these alterations and fraudulent activities. 10- The law should not be ignored and avoided. 11- NO DISCLOSURES WHATSOEVER. THAT IS ILLEGAL. 12- I was SCAMMED!! My mortgage broker led me to believe that I am getting a 5.5 % fixed Interest rate! However, all these months from the closing of the loan my interest rate was Showing around 5.5 % interest till the month of XXXX of XXXX, my interest rate changed to. 6.98 %. I called finance of America to get the details and no one would give me the correct Information then, I called my mortgage broker and asked him to supply me with the missing Information and to my surprise, the loan is an arm adjustable loan that caps at 10.565 %. This is CRIMINAL. 13- To my understanding, this type of loan is protected under the HOME SAFE program. My Wife and I went thru counseling for the Home Safe and the Senior citizen protection to Assure us that we are getting the protection that is provided under the law for the Senior Citizens. Protection from scams, fraud and to get in good faith an honest loan estimate and In good faith disclosures. UNFORTUNATELY, WE ( My wife and I ) DID NOT GET ANY OF THE TOP, WE WERE LEFT IN THE DARK! IT WAS A TOTAL DISAPPOINTMENT AND FRAUD. 14- We have been scammed! This is a crime under the law. Finance of America should be Stopped and held accountable for all the illegal alterations and changes without the client Approval. They should know that there is something called loan disclosures that they have To provide, not ignore and not commit illegal activities. ! 5- I started this loan at the right time and interest rates were low! Now, interest rates are high And I am getting pinned with this fluctuating high interest rate because of the loan mortgage Officer negligence and alteration of the documents to fit their agenda. This is illegal. 16- I can not imagine that during the worst days of the United States of America XXXX during The Coronavirus infections, infecting and killing thousands of people, layoff from jobs and The total chaos that we passed through and still going through! Someone had the courage And will to cheat and take advantage of vulnerable senior citizens, scam and fraud them. This is considered a crime and it is NOT LEGAL AND IT IS PUNISHABLE BY LAW.. ***PS : Please see attached. Please, I am seeking your help and guidance in this matter. My loan monthly payments are going over the roof and I can not handle these outragous payments, I CAN NOT BEAR THE CONSEQUENCES OF SOMEONES BAD INTENTION BY IGNORING THE LAW, ALTERING DOCUMENTS AND AVOIDING THE LOAN DISCLOSURES. I believe FINANCE OF AMERICA should bear the consiquences and correct the mistake. I will not accept any fluctuations in my interest rate due to the fact from the begining, I asked for a FIXED RATE, EVEN AT THE END BEFORE CLOSING WE WERE DISCUSSING FIXED RATE AT 5.375 %. ** Why should I refinance from a Fixed 6.5 % to this outragous loan. It does not make any sence! ** The rules of the reverse mortgage! The client can refinance again within a six month or a year if the new loan shows a benefit to the client and is a better loan than the previous one. I am very disappointed and angry with Finance of America for allowing anyone to participate in this type of malicious acts and fraudulent avtivities specially, with all the problems and fraud we had in the year XXXX and XXXX with the mortgage industry. We did not learn and someone is still going around the bush to take advantage of the public and especially senior citizens. This situation is against the law and should be punishable by law and it should be corrected. It is a big burden on my finances and my health. My son and I purchased this house with a FHA XXXX loan. The loan is with XXXX XXXX XXXX. XXXX XXXX was my mortgage adviser, he recommended my Realtor XXXX XXXX who found the property I purchased which needed work. XXXX also recommended his contracting company, XXXX XXXX XXXX XXXX XXXX, who fraudulently under-bid the rehab. I filed a complaint with the XXXX XXXX XXXX and Attorney General Office to no avail. This whole transaction has been a conflict of interest from the beginning. The Realtor XXXX XXXX was recommended by the lender. XXXX XXXX. XXXX XXXX recommended his contracting company. XXXX XXXX XXXX XXXX XXXX, fraudulently under-bid the rehab just to get the contract, and is not registered with the Attorney General Office, but was vetted by XXXX XXXX Finance of America 's Renovation Draw Administrator. XXXX XXXX XXXX XXXX breached their contract. Then there is XXXX XXXX who was recommended by Finance of America 's HUD inspector XXXX XXXX. All having intention of defrauding us and all are a conflict of interest in one way or the other. There is a whole lot of fraud going on here with government funding and I have no recourse to alleviate all the wrong doing. I have spent in excess of $ XXXX out of pocket on this property. I have installed HVAC, solar, I purchased all the finishes, electrical supplies, appliances etc. If the bank forecloses now they will be unjustly enriched. XXXX XXXX XXXX XXXX XXXX, fraudulently under-bid the rehab for {$100.00} and then breached the contract. XXXX was paid $ XXXX for services rendered. The final payment should have been approximately {$4000.00}. XXXX XXXX XXXX XXXX submitted an invoice for $ XXXX, and Finance of America 's inspector XXXX XXXX wanted to pay this amount based on what was submitted. XXXX took pictures of other properties and submitted them as proof of work. When XXXX saw the pictures he agreed with XXXX, until he actually inspected the property. Now XXXX thinks I owe him XXXX and has filed a lawsuit. We had to plead with XXXX XXXX, FOA, Renovation Draw Administrator to allow us to deal with XXXX so that we could continue with renovation. Then we find out that XXXX XXXX XXXX XXXX XXXX is not registered with the Attorney General 's Office. XXXX XXXX was supposed to have vetted XXXX. Defrauded. In XXXX of XXXX we asked the bank for a forbearance, because we were paying mortgage and rent and all other household expenses times two. Within the mortgage payment we are paying interest on money that has not been used ( {$86000.00} ). We didn't get forbearance ; the bank gave us a reduction instead. We used the money we didn't use on the mortgage on finishes for the house trying to offset the renovation budget of $ XXXX left. Because this is when XXXX told us that XXXX XXXX XXXX XXXX grossly under-bid the job. But he approved the quote knowing it was not enough to complete the job. This bid was what the loan was based upon. We were set us up to fail from the beginning. Defrauded. We have spent in excess of $ XXXX out of pocket on this property. We have installed XXXX, solar, I purchased all the finishes, electrical supplies, appliances, cabinetry, flooring etc. If the bank forecloses now they will be unjustly enriched. We had no progress finding a XXXX with the budget we had left $ XXXX. After some time XXXX XXXX the HUD inspector for Finance of America recommended Aspect contracting. At this time there was $ XXXX left in the budget. We didn't get started with Aspect Contracting until XXXX of XXXX. Aspect has been misappropriating funds by adding unnecessary repairs and XXXX XXXX approved and paid for these repairs. XXXX and XXXX, XXXX XXXX general contractor, said that we needed roof vents. They said that Licenses & Inspection required roof vents to vent the third floor since it was considered an attic. When XXXX came to inspect the vents I was there and I asked why the vents were not installed near the bathroom because I thought that was where the vents were necessary to vent the bathroom that was added to the third floor. XXXX said " They had to put the vents in the front bedroom because there was no room on the roof where the bathroom is because of the solar panels. '' I ask " how is that vent supposed to vent the bathroom? '' He said " your plumber will have to run a flex line from the bathroom to the vent. '' That did not sit well with me so I called XXXX XXXX XXXX and was told by the inspector XXXX XXXX that I don't need a roof vent because I have windows, and he did not request vents be installed. When I brought this to XXXX 's attention he agreed that they were not needed, but he still authorized payment for vents. Gross misappropriation of fundsXXXX XXXX XXXX sheet-rockers wasted a ten foot wide in diameter by five foot high pile of sheetrock. When I inquired about it XXXX said that is not coming from my budget, however there was no deduction in price so I am paying for that wasted sheetrock. This is particularly disturbing to me because I did not get recessed lighting in my bedroom because it would be too much sheetrock added to the budget. Again misappropriation of funds. XXXX told me I did not have to make a plumbing access to the powder room and laundry because the access was already there. Aspect closed up existing access to create new access. More misappropriation of funds. XXXX upheld XXXXXXXX XXXX decision. Defrauded. XXXX XXXX signed a contract for the complete job. But then said he could not do plumbing for the $ XXXX allotted in the budget. This is a breach of contract. So I had to find a plumber. Triple M plumbing did the rough in plumbing. XXXX paid XXXX XXXX XXXX {$8100.00}, I said that he was not finished with the job and he should only be paid one third of $ XXXX. XXXX paid him anyway. XXXX lied saying plumbing had been inspected and closed up the walls. Aspect hired XXXX XXXX XXXX. XXXX paid XXXX $ XXXX. Keep in mind we purchased a thousand feet of electrical 500 feet of white and 500 feet of yellow, the 200 amp breaker box and all light fixtures. They were paid $ XXXX another gross misappropriation of funds. XXXX 's electrical install is sketchy. They put nineteen outlets, ten recessed lights, and three hardwired smoke detectors on one fifteen amp breaker. They had to have paid the inspector to pass them because there is no way they could have passed any other way with all the issues we are still enduring. We can't use the microwave without tripping the breaker. We can't use outlets in the living room without setting off the breaker. They installed a used outlet in the floor. None of the hardwired smoke detectors work. After wasting months of time not doing anything we had to move in. We moved in on XX/XX/XXXX. When the plumbing fixtures were installed every connection XXXX XXXX made leaked. XXXX said he paid XXXX XXXX for what he inspected and what he inspected was done correctly. But it all failed. Plumbing failed, Electric failed. Defrauded. When we moved in XX/XX/XXXX the plumbing was not working. We had to ask for another mortgage assistance plan because we had to get another plumber come in and do rough-in and yet another to complete the finishes. We paid out {$5400.00} to get to the bare minimum bathroom facilities. This time XXXX XXXX XXXX raised the mortgage to {$1500.00}, from {$1300.00}. I asked XXXX what happens to the remaining balance in the budget which is now $ XXXX. He said it goes back to the bank. So we have been paying interest on this money and I can't use it. We have been waiting for final report for last draw for over a month now. I asked for itemized bill because things that I have not mention such as double billing we caught in the past. I feel that they are trying to find a way of defrauding us yet again out of what is left in the budget. The bank is overly enriched and we are being defrauded/exploited by XXXX XXXX XXXX , XXXX XXXX , XXXXXXXX XXXX XXXXXXXX and the FHA. Re : CFPB Complaint number : XXXX-XXXX Date submitted to CFPB : XX/XX/XXXX Product : Mortgage -- Additional Info to previously filed complaint Last Week, XX/XX/2018 Mr. XXXX XXXX called to ask if I had any luck contacting my brother to pay the needed {$5000.00} to pay down credit card accts so the reverse mortgage could close. He stated without that lump sum, they could not continue with the process. I told Mr XXXX from the beginning the loan didn't involve my brothers and I did not want them to know about it. He brought them up out of the blue as a way to pay the {$5000.00} for payment on the credit card acct balances which are not overdue. Mr XXXX said he'd rather not run another credit report because additional charges would show up since the initial credit report was run. He said that would mean more than {$5000.00} needed to pay on the accts. He never said to whom the {$5000.00} would be paid. I assume it would be to the credit card companies. My concern is : How is the reverse mortgage company to know of the payment if they don't run another credit report to view the updated balances on the accts. Actually, the {$5000.00} or more was to pay off 2 accts. Again, if they don't run another credit report, how will they know those accts were paid off? Doesn't make sense. Also, he has never put anything in writing about this necessary {$5000.00} payment in order to continue processing the mortgage application. On the same day, he called asking about my brothers and if they were going to help pay this {$5000.00}, he mailed me an Good Faith Estimate which was revised due to an increase in the value of the property after Mr XXXX requested an appraisal and the report received by the mortgage company. No where did it mention this {$5000.00}. It gives a closing date for the mortgage as XX/XX/XXXX. Why send me this if he said they could not process the application until that {$5000.00} is paid? I have been on a roller coaster ride, emotionally, with this application. All seemed to be going well, all paper work going smoothly, notary hired for initial signatures, appraisal on the house, credit report, financial counseling, ... .from initial contact the first week in XXXX until early XXXX, a month, all was going well and I got my hopes up. Then he hit me with this {$5000.00} needed and mentioned bringing my brothers into the picture. I consider that an invasion of privacy. Mr XXXX was so gung-ho and stayed in constant contact until the subject of the {$5000.00} payment on credit card accts came up. The loan application is still on hold pending that {$5000.00}. I asked not to cancel at this time to see what transpires, if anything. He did state the mortgage company would pay the fees for the notary, appraisal, credit counseling ... .that is not in writing either. I don't trust them to pay those fees. They knew of the credit situation and my income from the first contact with them They were, in no way, blindsided by it and it shouldn't have come as a surprise ... .some 4 weeks later. It is beginning to sound rather fishy to me. Mr XXXX did admit he made a mistake but didn't seem to care about the emotional roller coaster he has sent me on. Something doesn't seem right to me. I am attaching the original complaint XX/XX/XXXX. Thank you. THIS BEGINS THE ORIGINAL COMPLAINT FILED XX/XX/XXXX -- -- -- -- -- -- -- -- - I contacted Finance of America Reverse on XXXX regarding a reverse mortgage. The agent was XXXX XXXX. Finance of America Reverse LLC ( XXXX ) XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX , CA XXXX Lender Case # XXXX As part of the process, they requested my credit report on day 1 of our discussions so they knew of my financial situation from the get go. They also knew that I am on Social Security retirement supplemented with SSI. They also knew my XXXX income from Social Security. There was nothing hidden from me. Mr XXXX never mentioned any problems and proceeded with the required credit counseling, followed by a notary to sign the the papers to continue the process. Also, an appraiser was sent to the house to get an up-to-date and accurate appraisal of the house. The appraisal was XX/XX/XXXX. Mr XXXX asked how much my raise with Social Security would be and said I was a few dollars short of the necessary income. I told him how much raise we were getting and estimated what my XXXX income would be. He said since it was so close, it would probably be no problem. So the process continued with the appraisal and notary to sign the necessary proposal papers. The fees for the professional services ( notary, appraiser and counselor ) was supposed to be paid at closing. I was given this rosy picture that I would have {$25000.00} at closing with more after a year. I heard no concern that it may all be in vain because of the info on the credit report which they had in front of them from the beginning. They also had my income and the expected raise by SS. I told them at the beginning I had no additional income. Knowing my financial situation ( Income and Credit Report ) they continued the reverse mortgage process. Two days ago I received a phone call from Mr XXXX saying due to my debt as stated on the credit report and income being so low, there wasn't much that could be done. He even told to call my brothers ( the only family I have left ) to pay down some of the debt I have and maybe that would help push the mortgage through ( {$5000.00} ). It's not that easy! Even if my brothers had that amount, it's doubtful they would hand that amount over to me. I've been stuggling along without anyone 's help and it's been rough. I have no one who really cares. That's right! I'm alone and this is how people take advantage of someone XXXX and alone in this world. Mr XXXX had no right to even bring my family in to the process. All families are not alike. With both my parents gone, they family is not as close as once was. Was Mr XXXX trying to get a feel as to their financial situation as well? Something doesn't seem right to me? I'm sitting with piles of paper and proposals. They had built up my hopes and now, I have XXXX XXXX XXXX XXXX XXXX. I struggle and will continue to struggle even more. ... and now, I have other worries on top of the mountain of worries I have now .... Who is going to pay the notary, credit counselor and appraiser that Mr XXXX ordered?? I can't and he is fully aware of that. Was all of this a way to take my house as a way to pay these services which he knew would not help me in any way whatsoever?? I feel as though I was conned by him or he just didn't know what he was doing. They knew everything from the beginning and still proceeded with the process and spoke frequently of the closing amount. I called 10 days or so ago and told him I wasn't sure I could make it financially to the end of the month and he said he was waiting on the appraisal which was due in that day. I had estimated the house using the amount set by the insurer. The actual appraisal came in higher so that wasn't the issue as to the quick refusal and being turned down. I'm at a loss now. They give me a ray of hope and now look at me. I can't buy groceries, one pair of shoes to my name and they are falling apart ... .no banks want to help ... I feel like I've been thrown away and not worth helping. How can someone like this company hurt people like they do?? Do they have a conscience whatsoever??? I've had a XXXX and afraid that's what will happen again. I have no one to take care of me. The people who treat folks like me so wrong should have to live my life with my worries. They'd never make it. Emotional duress is an understatement!!

The situation that started the default on our mortgage was with XXXX who has filed bankruptcy ( but basically the same company ) that is now our lender. They apparently paid a year of hazard insurance on our home as we have a reverse mortgage. However there are certain requirements they must follow before they are allowed to purchase & charge me for the insurance & it is my belief they did not follow those regulations : According to 12 CFR 1024.37 ( b ), ( c ), ( d ) Servicers may not assess charges or fees for force-placed insurance unless the servicer satisfies four requirements. I am not going to type out each of those requirements because I am sure you are familiar with each of those. Now, I received only one notice stating that they may place insurance on our home and it stated that the cost may be {$600.00} ( not an estimate close to XXXX I will attach that letter. ) and it states it was the second and final letter? XXXX XXXX has claimed previously that they sent a letter, and she attached it when she answered a prior complaint, but I only received that when I asked for something in an e mail and it was sent after the fact ( XXXX XX/XX/XXXX ). After this event was when they started paying property taxes without any prior notice and early even though the statute says that we have up to the day of to pay our property taxes.24 CFR 206.205 ( 2 ) Payment of the following property charges are obligations of the borrower and shall be made through the XXXX XXXX by the borrower, or by the mortgagee, in accordance with paragraphs ( b ) through ( e ) of this section on or before the due date : property taxes, including any special assessments levied by local or State law, hazard insurance premiums, and applicable flood insurance premiums. It is my contention that Finance of America did not meet their requirements to assess charges for force placed insurance. .they are continuing to pay our property taxes in violation of these regulations. I also do not want anyone violating our privacy. XXXX XXXX claimed that nobody came to our door but I will provide a letter that proves otherwise. A very ridiculous letter claiming that because we did not provide an ID they had the right to come two weekends in a row to our door and charge us two weekends in a row for inspections which they did which is also illegal. We had sent in our occupancy certificate and in fact had it on the website for XXXX. I don't want to hear it was XXXX and not them because they bought their loan and they are responsible. It is the same lender anyway... I know how that works. I will continue to investigate all of the things I have uncovered and not stop until it is all stopped after speaking to the ladies at the courthouse. There are over XXXX foreclosures this same attorney is working on with some of the same actors and situations in Indiana. I looked it up. Coincidences? I don't know. Like I have said before, they are going to fix the inflated balance of our loan. This never should have happened if they would have listened to me when all of this first happened and spoken to me instead of acting as if I did not know what I was talking about. I asked for balance information and proof of what they were claiming but they would not provide it. They could not even decide who had our loan. It was a real night mare speaking with their call center. XXXX XXXX also claimed that nobody came to our door but I will also include a letter that rebuts that claim. Those two inspections are illegal. I thought they were there to help us avoid foreclosure but not until this was filed in court did anyone ever mention any loss mitigation procedures. There are charges on the balance from the trustee and attorney but only being called attorney fees. I have also contacted the AG and HUD and a HUD counselor. This is going to be fixed. Yes, I missed some property tax payments but would have paid them before it got to this. It was during the pandemic and the county allowed extra time and the servicer did not have to do this. This was simply a way to make money... .that is my belief and it has about made two senior citizens lose their minds. The CFPB needs to address what all has happened. We are one of many. Finance of America did not meet the requirements to charge us for force placed hazard insurance and they are improperly paying our property taxes early after being asked time & time again to cease even though it is in direct violation of the regulations. They have changed our mailing of our tax bill so that we will not even receive it and the force placed insurance was the direct situation that caused this entire situation to begin with. XXXX XXXX has claimed there was nobody came to our door and this was not the only time. We have witnesses of other times also. The harassment has been never ending and the tax bill was more than XXXX could endure. The county employees knew he was hot and did not blame him one bit. They were quite empathetic and said it was a common problem around there.The final issue. On year to date for 2018 on our statement, it says we had an unscheduled loan advance of {$500.00} and we did not. The only thing we had was a LOC. Now, that better not be what I think it was because that means it was carried incorrectly for three years and I have not had time to go back and track it but please do so and I will as well. I have a feeling someone collected and charged interest on this and should not have. Geez.

XX/XX/2021 vs Finance of America Loan practices On XX/XX/2021, I contacted XXXX XXXX XXXX in XXXX, NC XXXX : XXXX via phone at XXXX. The owner, who was the representative, informed me that the home needed a new AC unit. The total quoted amount to complete the work is {$3800.00}. I asked if I could pay the amount in installments 30, 60, or 90 days same as cash payments. The representative stated I could do a loan via their company. The owner provided his office personnel phone number, who received my information. I provided XXXX XXXX my information, date of birth, ss #, my permanent address, salary etc. I received an email from XXXX XXXX Finance of America, the lending firm via XXXX XXXX, stated that the borrowing amount would be {$4100.00} vs. {$3800.00}. When I questioned the increased amount, Finance of America informed me that is the amount XXXX XXXX requested on my behalf. Immediately I contacted XXXX XXXX, the owner, to restate the quoted amount to complete the work. He stated {$3800.00}. After further discussions, he said that XXXX finance charges them an upfront origination fee to receive the loan payment, which increases the loan amount to {$4100.00}. XXXX XXXX, the owner texted me a screenshot that indicates the lender is XXXX. XXXX denied my loan and sent it to XXXX XXXX. To charge the receiver, in this case, XXXX XXXX origination fees. Demand that the borrower, me pay interest and origination fee is double charging. Is that legal? I then contacted XXXX XXXX for clarification. Their representative said that they charge a one-time Prepaid finance charge and interest to the loanee. They do not charge XXXX XXXX to receive the fees. They will send the lender {$3800.00} when you, the loanee, confirm that the work is complete and done to your satisfaction. Your loan amount is {$3800.00} plus {$110.00} prepaid finance amount equal {$3900.00}. She stated that she would send the discrepancy to upper management. XXXX XXXX called me, with my caller ID displayed call from XXXX XXXX. I asked XXXX XXXX why she did a 3-way with XXXX XXXX, for me to join a call where shes talked to XXXX XXXX initially. Their representative XXXX stated she would return my call after she talked with her manager. Later someone else called XXXX XXXX and then put me on a 3-way. Someone stating that she wanted to ask XXXX XXXX how much they charged me to complete the work. My concern as I stated to Finance of America, why would she contact XXXX XXXX. She didnt know if I paid them 1/3,, or half of the payment. And my loan amount discrepancy between the signed document and the document I was asked to release shouldve been discussed with me, not the 3rd party. My ask that Finance of America acknowledge my signed and agreed loan amount {$3800.00} and prepaid finance amount {$110.00} total of loan {$3900.00} via XXXX XXXX. Check into Finance of America loan practices. Charging the receiver of the loan who is not the loanee an origination fee, in addition to charging the lender origination fee and interest.

We filed a complaint on the mortgage servicer because of their unethical actions and apparently that company filed bankruptcy and then the loan was transferred to two other loan servicers and neither of them were any better. These reverse mortgage loan servicers are the most unethical people. Our property taxes were not paid for the fall installment of XXXX due in XXXX which was {$210.00} & we owed a penalty of {$36.00}. Our home was not in any way going to be in a tax sale or anything like that and as a matter of fact, the assessor was late getting the tax statements out that year and in XXXX, they did not charge us any late fees because of covid. We decided when we went to the courthouse to pay our XXXX spring installment, we would pay what we owed in late taxes for fall XXXX. They were not due until XX/XX/XXXX and we went up to pay them and the loan servicer for Finance of America Reverse had already paid not only the XXXX but also the XXXX that wasn't even due yet! They then tacked that onto our loan balance and we have been paying finance charges on it ever since. They paid it on XX/XX/XXXX. They also paid a years worth of hazard insurance that we had already paid and I sent them proof that we had paid it and they sent me a letter verifying that they received proof and would refund the amount off of our balance but when the new loan servicer received our loan, the balance still reflected not only the property taxes but the hazard insurance and all of the accrued interest. This was in XXXX and the interest just kept racking up. To top it off, they sent me a letter and said it was allowed because these items had caused our loan to be in default. I wrote a letter to Finance of America Reverse and both the old and new loan servicers and it was a nightmare as usual. Neither of them claimed responsibility and tried to say they had only paid late taxes although I can include an early e-mail from their customer service dept telling me they paid XXXX taxes not due until XX/XX/XXXX and I can get that from the county if necessary. I have discussed this with the county in great detail. They have now continued to pay our taxes ahead of time and my spouse and I normally do not have the funds to pay our property taxes ahead of time but often pay them the day they are due. I do not think it is right that they pay them ahead and then charge us interest. They sent us a letter to let them know if we had problems because of covid and we definitely did. XXXX XXXX lost her job and we were both very ill with XXXX but it had no impact on any of this. Our loan servicer has come to our home and sent people to our home asking for our ID 's. A lady called us and wanted to do an appraisal because she said she was instructed to put our home on the market and sell it. XXXX XXXX has had a XXXX XXXX and this has been extremely stressful. This is not right. We sent at least 10 e mails asking for proof of what amount we really owed with exact amounts and we could not get that. They kept saying we owed for two years of hazard insurance and we knew we did not. We knew we should not have to pay for taxes that they paid ahead of time ( at least not the interest ). They should not be doing that. We can provide proof of any of these things and we received a letter from their attorney and told them the same thing and send them proof. Why can't they send us a true bill. They are billing us service fees for these things that are not necessary and are just to inflate the bill when we offered to pay it a long time ago! We tried to pay it but they would not cooperate! We called them at least 15 times and we would get these people that would say the loan was in the process of being transferred and then they would say it was not in default and then twice they said they were having technical difficulties. I have probably 25 e-mails begging them to send me a list of what exactly I owe them because I was trying to get my tax return and wanted to pay them whatever it was when I got it but they kept saying they could not find my loan by the the loan number I was giving them and it was the loan number on my statement. I have never in my life worked with any company that had such terrible customer service and now they want to blame us and foreclose on our home over a tax payment they made early for XXXX and one year of hazard insurance. That is what this amounts to! The truth is, it is their loan servicers inept customer service and Finance of America 's lack of attention to the customer 's complaints! We have owned this home that was built by XXXX XXXX and we will not just hand it over because of less than XXXX and a company that does not want to do their job and treats senior citizens like second class citizens. They have no right to treat us the way they have treated us. When I had the money, I tried to get an reasonable bill from them but for some reason nobody could produce one and as a matter of fact, they still haven't. They are saying the amount is over XXXX that was the original amt and it was only XXXX and is still only XXXX. It seems they just are not being honest about anything and it is concerning me that they are so deceitful. Getting this reverse mortgage was the biggest mistake that we ever made! Finance of America Reverse is not honest and their loan servicers are the worst!

Lender : Finance of America , LLC, XXXX Contact Person : XXXX XXXX, XXXX ( XXXX ) XXXX On XX/XX/XXXX I secured a commercial line of credit from Finance Of America , LLC in the amount of {$390000.00}. I bought land on the line of credit for {$82000.00}. I paid {$49000.00} down and the balance on the land was {$340000.00}. I would use approximately {$100000.00} of my own money to complete this project. My intention was to buy the land and build a home on the property, then sell it off. The credit line was set up where I would have a year to finish the project and remove it off of the credit line. Unfortunately, the world shut down right after I closed the loan in XX/XX/XXXX due to COVD-19, and I was unable to secure a building permit for this property until XX/XX/XXXX. I received my first draw on XX/XX/XXXX, as I had to break ground first and show work in progress in order to obtain a draw. The first draw was only {$18000.00}, which was not enough to get to the next phase. As a result, I submitted a rebuttal to the first draw on XX/XX/XXXX to get more money, and on XX/XX/XXXX I received {$19000.00} due to submitting the rebuttal. The agreement was that I was to make monthly interest payments on the loan until completion of the project, which I did. I stayed current ; I was never late with the loan payments. However, after granting me two extensions, Finance of America ( FOA ) stated that they could not give me any more extensions because I had not completed enough work on the project to substantiate another draw. Which was not true because I had cleared and graded the land, brought in dirt, installed plumbing, paid for the electrical rough-in and built the foundation. I used my own money for most of it. After XX/XX/XXXX I did not receive anymore money from FOA, but I continued to pay the interest. I spoke to them several times about the fact that my timeline on the project was completely thrown off due to COVID-19 and I asked if they could give me some type of consideration. After going back and forth, they did not offer anything. The company that serviced my loan, initially, was XXXX XXXX XXXX XXXX in XXXX, IL. The loan was sold to XXXX XXXX XXXX ( XXXX ) in XXXX, PA sometime in XXXX, XXXX. I paid my XX/XX/XXXX interest payment to XXXX on XX/XX/XXXX and they accepted it. I called XXXX on XX/XX/XXXX to make my XX/XX/XXXX payment and they informed me that my loan was {$4000.00} plus in arrears and I had to make those payments before I could become current and make the XX/XX/XXXX payment. As I stated, I paid XXXX on XX/XX/XXXX for the XX/XX/XXXX payment due and they had no record of that. In fact, the phone representative told me that my loan was not set up with them until XX/XX/XXXX. I called XXXX and explained the discrepancy to her on XX/XX/XXXX. She told me to submit to her my proof of payments and she would correct the situation. I submitted the proof of payments on XX/XX/XXXX via email and I asked her for a payoff on the line of credit in writing. I received a letter from XXXX on XX/XX/XXXX, which was dated XX/XX/XXXX stating they had no evidence of builder 's risk insurance on the property. The letter also stated that I had 52 days to obtain insurance and after that time they would buy the insurance and bill me. I renewed the builder 's risk insurance on this property on XX/XX/XXXX. I then called XXXX to followup on securing the payoff and I told her that I renewed the builder 's risk insurance. She informed me that XXXX had already obtained insurance and that was delaying the payoff process because they had to get their money back. I followed up with XXXX again via email and requested a payoff on XX/XX/XXXX. On XXXX/XXXX/XXXX XXXX responded via email and stated that that all the changes had been applied to the account and a payoff had been requested through XX/XX/XXXX. I responded right back to her and asked how long it would take to obtain a payoff since the account had been updated. Her response was that I needed to allow five business days, but it should only take about two more days. Today is XX/XX/XXXX and I have not received a payoff. I called XXXX to request a payoff since they were the last servicer on the loan ; however, I was informed by their agent that the loan was sold on XX/XX/XXXX to " XXXX. '' I asked if they had the address and phone number to XXXX. She stated that that was all she had. There was nothing else in her file. I XXXX XXXX and found that it was an investment company that built condos in XXXX. I called all numbers today and there was no answer. I would like to pay this loan off as quickly as possible. This has been very difficult for me. If you can help me secure a payoff amount from Finance of America so that I can close out this relationship I would be forever grateful. Please advise. First, Finance of America holdings , LLC has committed unfair acts and/or practices by failing to accurately review, process, track, and communicate to me, the borrowers heir, information regarding the application for loss mitigation options. Second, Finance of America Holdings, LLC has committed deceptive acts or practices by sending loss mitigation application acknowledgment notices that misrepresented the status of borrower application documents as received or missing and provided inaccurate due dates for submission of requested application documents. Third, finance of America holdings, LLC has violated the provisions relating to loss mitigation procedures in Regulation X, 12 C.F.R. {$1000.00}, the implementing regulation of the XXXX Real Estate Settlement Procedures Act ( RESPA ), 12 U.S.C. {$2600.00}, et seq., by ( XXXX ) sending acknowledgment notices that failed to state the additional documents and information that I needed to submit to complete the loss mitigation applications ; ( XXXX ) failing to provide a reasonable due date for submission of borrower documents ; ( XXXX ) failing to exercise reasonable diligence in obtaining documents and information necessary to complete borrowers ' loss mitigation applications ; ( XXXX ) failing to properly evaluate borrowers who submitted complete loss mitigation applications for all loss mitigation options available to the borrower; and ( XXXX ) failing to treat certain applications as " facially complete '' when required under Regulation X. FAR sent me a letter of intent and the instructions detailing the reverse mortgage default options available. On XXXX, XXXX, XXXX I emailed a completed letter of intent, the entire trust agreement for the living trust and a copy of the death certificate that had just been received from the mortuary. A confirmation of the receiving the docs was emailed to me, ser attached. Then approximately a week later, I spoke with a representative about my intent to sell the property. She instructed me to send in a copy of the XXXX sign which I did. On XX/XX/XXXX I received s letter from FAR stating they needed an updated more legible copy of the XXXX. This documentation was required in order to request an extension to defer the inherited reverse mortgages loan balance of approximately {$420.00}. XXXX letter clearly stated the updated documentation was die by XX/XX/XXXX. The updated XXXX sign was resubmitted XX/XX/XXXXXXXX via email. A confirmation of was received was emailed See attached confirmation of receiving the email. On XX/XX/XXXX, I contacted customer service with questions about charges on the statement, After speaking with customer service I was notified that the foreclosure procedures on the reverse mortgage, were initiated XX/XX/XXXX. Finding this news to be shocking and surprising, I asked to speak with a supervisor. The lead supervisor Bill advised me that the death certificate had never been received. I advised Bill that this was a falsehood and I sent him proof of that document being received XX/XX/XXXXXXXX Bill also stated initially that the extension documentation the XXXX by owner sign Was never received. I also sent him proof of The documents being received on XX/XX/XXXX. Bill then he stated the email was received too late and that foreclosure proceedings begin two days prior to that on XX/XX/XXXX. This company failed to notify me of any such proceedings. I was never notified of the deadline of XX/XX/XXXX. I was never assigned a point of contact person. The only correspondence received was the initial letter of intent forms to fill out. And a letter dated XX/XX/XXXXXXXX requesting additional documentation due by XX/XX/XXXX. FAR has been negligent and has acted with malicious intent to foreclose on this property. As a result, the loan has wrongfully been referred to an attorney for foreclosure. And I am unfairly being assessed attorney fees, penalties daily. The resolution for this serious matter is to immediately reverse and credit, the loan balance with unfair attorney fees and penalties, etc.. FAR and FAR HOLDINGS LLC have over 200 complaints and this warrants an investigation by the CFPB

Good Afternoon, I have recently been working with XXXX XXXX, who is employed by Finance of America, XXXX XXXX XXXX out of XXXX XXXX We signed a contract on a property XX/XX/XXXX. Loan commitment was due on XX/XX/XXXX as requested by XXXX for the time frame. Closing was scheduled for XX/XX/XXXX. XXXX XXXX has been very unresponsive to myself and my realtor. Her voicemail has been full since the beginning of this process in XXXX. and her answers to our questions when we do communicate, are everything but what we need to hear. The loan Commitment date came and went, with no communication from XXXX. I needed to know where I stood as far as being approved and moving forward. When I finally was able to reach her, she stated that I needed to take care of a few things to get my score where she said it needed to be. I did exactly what she asked me to do, within a 24hr period of time. Withthat being said, we had to extend the commitment date out, which caused us to almost lose the contract all together, BUT the seller was understanding and agreed to the extension. My realtor, XXXX XXXX with XXXX XXXX XXXX, put me in contact with another lender. Before speaking with the other lender, I contacted XXXX XXXX, and asked her not to pull my credit anymore. That call was made on XX/XX/XXXX. I then reached out to the lender my realtor had communicated with me about. I gave her permission to pull my credit, just to find out that XXXX... Finance of America, had pulled my credit XXXX times since XXXX!!!! I was baffled, angry, and very aggravated. She also informed me that XXXX XXXX had me do some unnecessary work to my credit that could potentially hurt my score. This was on XXXX XX/XX/XXXX. The very next evening, I recieve an email stating that a lender had requested a copy of my credit report, it was late, and I did not look into it at that time. THe very next afternoon, XX/XX/XXXX, I pulled up my credit report on XXXX XXXX, and there has been another inquiry. It was XXXX... Finance of America XXXX, both days. I was extremely upset, so I sent XXXX XXXX a text message asking her why she pulled my credit 2 days in a row, after I specifically asked her NOT to?! She responded that one was a rescore inquiry, and unsure of the other one. She stated she would look into it and let me know. I have yet to hear anything from her, and it's been two days!!! I contacted XXXX, who then contacted customer care with Finance of America, for them to tell us that it would take 10 days to hear anything back. I do NOT have 10 days. My credit score is dropping because of all the pulls from XXXX, and I need it to be fixed asap. The way they have conducted business, I will not be working with this company ever again!!!! I want the hard inquiries that have been placed on my credit report from XXXX doing the unnecessary pulls on my report to be removed promptly, as it was not my fault that they're there to begin with. I am wanting to purchase this home that I have been trying to do, and my patience is wearing thin! I have recently spoken with some of my friends who have worked with XXXX XXXX as well, and they have stated that she had done the same thing to them. I contacted Finance of America Reverse on XX/XX/XXXX regarding a reverse mortgage. The agent was XXXX XXXX. Finance of America Reverse LLC ( XXXX ) XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX , CA XXXX Lender Case # XXXX As part of the process, they requested my credit report on day 1 of our discussions so they knew of my financial situation from the get go. They also knew that I am on Social Security retirement supplemented with XXXX. They also knew my XX/XX/XXXX income from Social Security. There was nothing hidden from me. Mr XXXX never mentioned any problems and proceeded with the required credit counseling, followed by a notary to sign the the papers to continue the process. Also, an appraiser was sent to the house to get an up-to-date and accurate appraisal of the house. The appraisal was XX/XX/XXXX. Mr XXXX asked how much my raise with Social Security would be and said I was a few dollars short of the necessary income. I told him how much raise we were getting and estimated what my XX/XX/XXXX income would be. He said since it was so close, it would probably be no problem. So the process continued with the appraisal and notary to sign the necessary proposal papers. The fees for the professional services ( notary, appraiser and counselor ) was supposed to be paid at closing. I was given this rosy picture that I would have {$25000.00} at closing with more after a year. I heard no concern that it may all be in vain because of the info on the credit report which they had in front of them from the beginning. They also had my income and the expected raise by SS. I told them at the beginning I had no additional income. Knowing my financial situation ( Income and Credit Report ) they continued the reverse mortgage process. Two days ago I received a phone call from Mr XXXX saying due to my debt as stated on the credit report and income being so low, there wasn't much that could be done. He even told to call my brothers ( the only family I have left ) to pay down some of the debt I have and maybe that would help push the mortgage through ( {$5000.00} ). It's not that easy! Even if my brothers had that amount, it's doubtful they would hand that amount over to me. I've been stuggling along without anyone 's help and it's been rough. I have no one who really cares. That's right! I'm alone and this is how people take advantage of someone XXXX and alone in this world. Mr XXXX had no right to even bring my family in to the process. All families are not alike. With both my parents gone, they family is not as close as once was. Was Mr XXXX trying to get a feel as to their financial situation as well? Something doesn't seem right to me? I'm sitting with piles of paper and proposals. They had built up my hopes and now, I have no reason XXXX XXXX XXXX. I struggle and will continue to struggle even more. ... and now, I have other worries on top of the mountain of worries I have now .... Who is going to pay the notary, credit counselor and appraiser that Mr XXXX ordered?? I can't and he is fully aware of that. Was all of this a way to take my house as a way to pay these services which he knew would not help me in any way whatsoever?? I feel as though I was conned by him or he just didn't know what he was doing. They knew everything from the beginning and still proceeded with the process and spoke frequently of the closing amount. I called 10 days or so ago and told him I wasn't sure I could make it financially to the end of the month and he said he was waiting on the appraisal which was due in that day. I had estimated the house using the amount set by the insurer. The actual appraisal came in higher so that wasn't the issue as to the quick refusal and being turned down. I'm at a loss now. They give me a ray of hope and now look at me. I can't buy groceries, one pair of shoes to my name and they are falling apart ... .no banks want to help ... I feel like I've been thrown away and not worth helping. How can someone like this company hurt people like they do?? Do they have a conscience whatsoever??? I've had a XXXX and afraid that's what will happen again. I have no one to take care of me. The people who treat folks like me so wrong should have to live my life with my worries. XX/XX/18 -From XXXX I called XXXX-the number on the Account statements. We tried calling over ten times and the number was " non working '' and " all circuits busy. '' -did a XXXX search and found another phone number ( XXXX XXXX ) for an employee of XXXX, XXXX XXXX. Left message for him @ XXXX-He never called back -I searched the borrower copy and found that Finance of America was the lender. I called their number ( XXXX XXXX ) -I spoke with XXXX asking how to pay the loan and for balance info and why XXXX wasn't available. She said that XXXX is their subservice and they she " didn't know '' the phones were down and " hadn't heard anything ''. She then went on to say that XXXX is supposed to " notify '' them when this happens. Stating that this does happen regularily. I asked for a manager. She told me speak with XXXX XXXX and have him call me. -She called me back saying that my name wasn't on the account so I needed to prove I was the beneficiary named in the Trust. I said I had the trust and would provide it. She told me to email XXXX. She said they'd be in touch 24-48 hours. XX/XX/18 I hadn't heard back from XXXX so I called and spoke with XXXX. Their number was working now. He said they have 72 hours to respond and I told him Finance of America said 48 hours and he said he didn't know why they said that. He said he couldn't see my name on the account. I pushed it further and he said that it " may not have been filed, '' but " I see your name listed as a contact, '' " but not on the account. '' This was why no one would help me the first day. He then found the email I sent with the Trust and he said he " received trust and noted it '' in the account file. He said he sent it to his supervisor " XXXX. '' XXXX aslso said once my name is on the account I could pay it off. He said closing cost would be a " few hundred dollars, '' and the " possible recording fee '' would be " no more than a few dollars. '' He said someone would contact me by MONDAY XX/XX/18. No one called. ( I was also then asked to email XXXX with the account number, name of borrower and state in writing that I wanted to payoff by check. Which I did. I have copied myself on all emails as well. XXXX called XXXX back I asked for a manager. The woman refused to transfer me to a manager multiple times by deflecting. She said they were not informed that my Father died and that they needed the death certificate. ( I informed Finance of America on XX/XX/18 of his passing and they didn't make note of it ). She then said they had 5-7 business days to replay. After over 20 minutes of arguing with this woman, and being put on hold about 2 times, she said she'd transfer me to a manager in the " loan officer '' department where a supervisor would help. I waited on hold for over 30 minutes. ( i have supporting screens shots from my cell phone to prove ) A woman named XXXX answered. She was not a manager as I asked for and was promised. She then said they needed the death certificate, a signed letter of intent and proof of intent. She said they would " mail '' me the form for signed letter of intent and I protested that I wanted an email as " snail mail '' takes too long. I protested more and she then told me I only had to send an email with one sentence saying I intended on paying by check. She then said I needed to prove I had the money and provide them with a bank statement. She then said they were going to charge me for " mandatory HUD '' inspections but they would issue a refund if I paid off before the inspections were completed. I then needed to send another email to XXXX. I sent all three required documents. I emailed XXXX via their customer service form online asking for official documents of the process to payoff a loan. I wanted it in writing. XX/XX/18. @ XXXX I called Finance of America again and asked for XXXX XXXX . I was transferred and left a message. He never called back. Neither Finance of America or XXXX will let me pay it off, they keep diverting me and saying I didn't provide all the necessary information. The woman on XX/XX/18 told me it " wasn't their job '' to contact us if we haven't provided all of the information necessary to close an account. They are delaying this for gains in interest money. -

To whom it may concern : Finance of America handles my mortgage and mortgage servicing. I escrow my property taxes and home insurance payment with them. My loan # is XXXX. Ive never had an issue in the past with making my mortgage payment or with secure home owners insurance coverage. I refinanced my mortgage through Finance of America in XXXX of XXXX. Everything appeared to moving forward nicely. I make my payment electronically each month, always sending in my payment at least a few days in advance. I actually make an additional payment each month towards my principle. A small amount around {$110.00}. I switched my mortgage to a 15-year term. The refi increased my payment slightly but not that much. My new rate was reduced to 2.75 % which made me happy. Fast forward to XX/XX/XXXX. I received my escrow analysis and notice a massive short fall. I couldnt understand where this short fall came from so I called Loan Servicing and asked for assistance. I was told the reason for the short fall was because in XXXX of XXXX the insurance department of Finance of America implemented force placed insurance on my home. I asked why they would do that without notifying me first. I never had a problem with my insurance provider XXXX. Ive been with XXXX for several years. My policy for the last 2 years was around {$1600.00}, which I though was very reasonable. The forced placed insurance which I didnt authorized was {$4000.00}. Yes, more than twice the policy I secured. I was flabbergasted when I heard this. I was certain there had to be a mistake. How can a company that you pay to escrow and mortgage service your loan, force place your insurance without any notification? This has to be illegal. I would think they would call me, email me or send me something in writing alerting me of this situation. But nothing came... the only way I figured this out was 6 months after the fact. I would think they would have had to send me a copy of the policy they force placed. I would have thought XXXX would sent me something showing cancellation as well. But no, I received nothing. I receive every piece of marketing junk mail they send me but no notification of forced placed insurance which I surely would have cancelled. Over the month of XXXX, XXXX, Ive made countless phone calls, spent at least 10 hours on hold based on my last count, attempting to get this issue resolved. No one seems to want to assist me. I repeatedly asked XXXX to provide me with the amounts that they say we owe to bring the property taxes up to date because I explained to them that we did not owe the amounts that the previous loan servicer ( XXXX ) said we owed and that I had provided Hazard Insurance receipts to them and property receipts to show we had paid. Finally they refunded the Hazard insurance payment ( a year later ) but not all of it because they said the insurance company would not refund them all of the insurance. That is not our fault. we provided the receipt right away. The prior servicer should never have paid it. They did not follow protocol. They should have never called the loan due and payable. We were never behind on our property taxes or hazard insurance and we continued to say that but nobody would listen. When the loan was transferred to XXXX, they just assumed we were and then they started paying property taxes before they were due because they said they could because they said the loan was in default. When I asked for copies of receipts for what had been paid, they said they did not have receipts because they were all electronic and I should go to my county and get that. I asked 100 times for an itemized copy of what we owed so I could get it paid & finally today they sent me a copy of what the prior loan servicer said we owed and I am shocked!! They are trying to make us pay line of credit advances we received and loan set up fees and inspection fees and they still have the hazard insurance that we provided receipts for on here as well!! No wonder the charges were so high and interest has been adding up as well! There is property charges on here that were not paid on XX/XX/XXXX that were not due until XX/XX/XXXX. I tried to tell them that they paid them early and they kept saying they did not. We were still willing to pay them because we have to pay property taxes but for heaven sakes they needed to quit paying them early and surely not call our loan due and payable because they choose to pay property taxes early. They are so deceitful. Why would they try to make us pay by a LoC payment we got or a loan setup fee from our initial loan in XXXX? I tried to talk to HUD about this but they were no help at all. They were so suspicious acting and seemed to take XXXX 's side and kept saying so what if they pay taxes early. They have already filed a foreclosure in court and are ruining our credit. They did not even have reason to file a foreclosure action because we were not even late on our taxes or hazard insurance. XXXX just bought this loan and assumed that what XXXX told them was true and XXXX just started paying our taxes early. I am going to attach the itemization they sent me and they just sent this to me. I have been asking for this since they sent me a letter and said we were in default and that was in XXXX. No wonder they would not send it to me! They knew they could not charge us for these things! Why would they think they could make us pay back our line of credit? They are charging for an inspection fee because they came to our house harassing us because they said we didnt show our ID when they came to our house two weekends in a row to collect an occupancy certificate that we had already sent in!! We signed another one for them but would not give them an ID. I wasnt going to show a perfect stranger an ID! Then they charged us XXXX for the inspection! I am not paying these bogus charges! I will hire an attorney and countersue. I feel sorry for other senior citizens that fall prey to their predatory lending! This is crazy that these people do these things and HUD allows it... they don't care! I went to them and the lady at HUD was worthless. She gave me wrong callback numbers and didn't even know the policies or laws. It was ridiculous. I want to open a non profit to help senior citizens in similar citizens so these awful loan servicers can't do this to anyone else... this makes me so angry!!

I need help from a predatory lender ; I believe they " loan to own ''. I am a XXXX XXXX of an XXXX, which is a XXXX-owned business and Im in my XXXX. In XX/XX/XXXX I closed on a blanket mortgage with XXXX XXXX XXXX XXXX ( XXXX ). I used XXXX XXXX as the mortgage broker to close this loan, which was for 15 properties at $ XXXX. The properties are in XXXX, XXXX, XXXX, XXXX, XXXX, and XXXX- all properties are in Maine . I was verbally told that this was a 30-year fixed-rate mortgage at 6.5 % but a few days before closing was told that it was going to be 6.9 %. At that point I had to agree to the increase because of commitments I had already made on the proceeds from closing. I was also told that my mortgage payments would be principal, interest, taxes, and insurance- the monthly payments would be between $ XXXX {$12000.00} per month. My payments were NEVER that and started around {$13000.00}, then went up to {$14000.00} and then {$16000.00} and by XX/XX/XXXX the payments rose to move than {$18000.00}. per month. I signed SIGNATURE PAGES ONLY at XXXX XXXX in XXXX. It was almost a year later before I got a copy of my mortgage. I asked for a copy when things were not adding up. I was making payments, but my principal was not going down. XXXX hired a company to oversee my mortgage and we started with XXXX. I was sending my quarterly reports as agreed. By XXXX of XXXX the monitoring company switched to XXXX and this is where my mortgage increased HUGE. When I questioned this, now my payments were not being applied to my mortgage and XXXX used my XXXX ( escrow funds ) to make mortgage payments. I was not going to send payments if they werent being applied. There is {$75000.00} that Ive paid to them thats not showing up anywhere. In XX/XX/XXXX they now had XXXX overseeing my mortgage. When Ive called them for a pay-out, they told me to send them {$5000.00} as a good-faith effort that I was going to refinance I sent them {$5000.00} and they sent it back to me. I can refinance out with another bank but I shouldn't have to pay {$200000.00} more for my loan than what I borrowed over 2 years ago. None of my payments went to the principal. I am now in pre-foreclosure and cant even get a pay-out. I supposedly owe almost $ XXXX now. I am selling the properties to pay them off, but Im sure that this was their plan all along as theres no reason for my payments to have jumped up and payments not being applied. Im having to sell them because of XXXX! This is going to be loss of income for me as I built these properties as my XXXX plan with passive income. I can not get clarity and Ive hired an attorney to help me with XXXX and XXXX. My attorney has also called them, and shes not being called back or given any answers either. I am being taken to the cleaners with these companies when I had been making my payments, they werent applying them. Since summer of XX/XX/XXXX, the insurance and the real estate taxes are being paid by me, directly to the towns and my insurance agent. I want out of this mortgage. I have the properties up for sale. I have two other banks that will work with me to get out from underneath XXXX. My credit scores are in the mid 700s. I pay my bills. But this company is out to take me and my properties. The changing of all the mortgage overseers, refusal to respond, payments not being applied, and I believe this was their plan all along- was to force me to sell these properties to pay them and they've charged exuberant mortgage interest rates of now 15 %. Since Covid19 - I have tenants not paying rent ; eviction moratoriums and eviction lawyer fees have increased my inability to make the mortgage payments since summer XX/XX/XXXX. This is my second complaint because I am not satisfied with the solution you have given for complaint number : XXXX This is to expose Finance of America for the predatory lender that they are ; hoping that someone would at least look into their fraudulent business practices as I am sure I am not their only victim. I would like for your office to help me get some sort of fairness in my situation. I want my mortgage to go back to {$1300.00}, at 4 % interest rate as it was when we asked for the first loan modification. The first modification was due to Finance of America 's HUD inspector XXXX XXXX approving a budget that he said was not adequate for the job that was required. So we asked for modification to off-set the budget. Then XXXX XXXX recommended a contractor who he has paid for things that were unnecessary and incomplete. We were given a completion date of XX/XX/XXXX. The contractor stopped communicating at the end of XXXX. Therefore we decided to move in under construction on XX/XX/XXXX. When we moved in, all the plumbing leaked. We asked for another loan modification again so we can pay to resolve the issues. The HUD inspector had paid the plumber and said he was justified in doing so. He also paid the electrician who has wired everything wrong. There are XXXX outlets, XXXX LED lights and XXXX smoke detectors on ONE XXXX amp breaker. We are having too many electrical issues to have spent $ XXXX, and then the electrician will not come back without a service fee. And this is ok with the bank 's inspector because he agreed to pay the fee. We paid interest on $ XXXX for a year that we were not able to use. Now we are paying interest on $ XXXX that has been put on hold by Finance of America because I filed a complaint with the Consumer Financial Protection Bureau. As it stands we have only used {$210000.00} out of the {$240000.00} loan. I am asking that my modification allowance be restored to zero as we are only allotted two modifications throughout the lifetime of the loan, and it was of no fault of our own that we had to exhaust the modification opportunity. I also want my mortgage to return to {$1300.00} @ 4 % interest as it was in the first modification. The reason I feel I am a victim of predatory a lender : My daughter purchased a house in XXXX. She gave me Finance of America 's XXXX XXXX information, he recommended the realtor XXXX XXXX Realtor. Who recommended XXXX XXXX XXXX XXXX who grossly under bid the contract, and breached the same contract Then Finance of America 's HUD inspector XXXX XXXX recommended XXXX Contractor, who he has paid for unnecessary and incomplete work When talking with XXXX XXXX I told him I only wanted to spend $ XXXX. When his realtor was " unable '' to find anything I liked XXXX XXXX said " you can go up to $ XXXX ''. Then XXXX XXXX found this property, but it would take more than $ XXXX to purchase and complete the project. Then the loan amount soared to $ XXXX. It has become very clear to me that I have been victimized by predatory lending. XXXX XXXX did not diclose that there was a XXXX XXXX XXXX XXXX XXXX XXXX in this property, and when I found out I had already given a $ XXXX deposit and was told if I pull out on the purchase I would not get my deposit back. XXXX. The broker recommended the realtor. XXXX. The realtor found the house and the XXXX, who breached his contract XXXX. The HUD inspector recommended the second XXXX who has not completed the work but has been paid This has predatory tendencies all over it and a whole lot of conflict of interest, nepotism, and fraud.

I applied for a mortgage XX/XX/XXXX with Finance of America. I received an approval within days. All was moving along smoothly, we locked an interest rate. All that was required of me to submit I did and I submitted it promptly and I was told I had an approval from Underwriting and we were simply awaiting the appraisal. We waited a month and a half for an appraisal to be performed. The report finally came in approx XX/XX/XXXX I was told my file was going to underwriting and all was fine as I had submitted all pending conditions. After waiting 2 and a half months to close on this refinance at the last minute the underwriting department states that a " XXXX debt '' needed to be included in my debt ratio despite the fact that the trade line was 100 % business has been paid out of the business account and NOT on my credit report. This is a Secured debt and secured to two properties with twice the equity needed to satisfy the debt. They stated they could approve a substantially less amount and that I would need to pay all of my accounts off in full on my personal credit report to qualify. I asked thrice for the income worksheet on how my income was being calculated as they refused to remove the business loan monthly payment amount from my DTI. They refused to remove the business debt as they stated that I would have needed to show it was paid 12 months from the business account. I explained that this was in forbearance due to Covid as ALL SBA loans and I did not need to pay until XX/XX/XXXX. I stated I would not mind paying 12 months of such payments immediately and they rejected this as well. Furthermore, they refused to send me my income worksheet calculations because had it been performed correctly including the SBA loan payment I would still more than qualify. They intentionally omitted my Short Term Rental income on my Schedule of E of my tax return. Recent XXXX guidelines I am attaching here clearly states that IF the short term income is from another property OTHER than the subject it CAN and SHOULD be included in my income calculation to assist me with my DTI. It is in fact true income, on my schedule E for XXXX along with all other rental properties and on my Profit and Loss and I can also gladly send proof of all income received through the Proof of Income for directly from XXXX and it is on ALL bank statements the lender requested. It is over a year in consistent cash flow and " Likely to continue '' as I have the next two months booked solid and will continue. They told me today my loan was canceled at my request yet I never stated to cancel my loan, I requested my appraisal so that I could obtain another opinion from another lender and I stated I needed the proof of income worksheet and asked why this was done incorrectly? After constant rejection and wasting 2 1/2 months of my precious time they negligently refuse to calculate my income correctly, wanted to leave out my child support income that I requested be used and refuse to acknowledge the monthly business debt as such. Calculating my short term rental income correctly is a complete violation and discrimination. They have yet to send me an adverse letter electronically like the rest of the documents and today they refuse to make such corrections! I would like to know how not only to file a complaint with Finance of America, but to a loan originator specific to this loan.

My Aunt passed away and her " Will '' designated me as the " Executor '' of her Estate. While collecting my Aunt 's personal documents and daily mail, I discovered that she had acquired a " Reverse Mortgage Loan '' in the amount of approximately {$80000.00} dollars. A few months after my Aunt 's death, I called the " Reverse Mortgage '' company to iquire about paying off the loan my Aunt had received and informed the " Reverse Mortgage '' company that my Aunt 's " Will '' had designated me as the " Executor '' or her Estate, and that I was aware of her loan and that I wanted to payoff the loan in order to settle that aspect of her Estate. I also informed the " Finance of America Reverse , LLC, that my Aunt 's " Will '' was in the " Probate Court '' and that it would take an undetermined amount of time before I was officially recognized by the " Probate Court '' as the owner of the property. I informed " Finance of America Reverse , LLC, that I wanted to know if I could payoff her " Reverse Mortgage Loan '' and what the procedure would entail. " Finance of America Reverse , LLC, informed me that I should send them a copy of my Aunt 's Will, her " Death Certificate '' and a letter stating what my intentions were in regards to my Aunt 's Estate. " Finance of America Reverse , LLC, informed me that once I sent them the requested legal documents, they would recognize me as the reponsible party for the property, accept payment of my Aunt 's loan and put the " Deed '' to my Aunt 's property in my name. After I sent the documents that " Finance of America Reverse LLC, had requested, I no longer received any further correspondence from " Finance of America Reverse LLC, for approximately three months. When I obtained a lawyer, I had my lawyer contact " Finance of American Reverse LLC, and request a " Payoff Letter '' for my Aunt 's " Reverse Mortgage loan. '' When my lawyer received the " Payoff Letter '' from " Finance of America Reverse LLC, '' the amount of the loan had increased to " {$100000.00} dollars. I was directed by my attorney not to pay " Finance of America Reverse LLC, '' because they had intentionally misled me from the beginning by stating they would recognize me as the responsible party for my Aunt 's Estate, and that once I paid the loan they would put the " Deed '' for my Aunt 's Estate in my name. " Finance of America Reverse LLC, '' was well aware of the fact that I couldn't legally payoff my Aunt 's Reverse Mortgage loan until I was recognized as the " Executor '' of my Aunt 's Estate by the " Probate Court. '' And, that the loan would continue to accrue intrest until it was paid. When I refused to make any arrangements to pay my Aunt 's Reverse Mortgage Loan, " Finance of America Reverse LLC, '' initiated " Foreclosure '' proceedings against my Aunt 's Estate in an illegal attempt to gain control of my Aunt 's Estate and sell the property. It was my professional observation that " Finance of America Reverse LLC, intentionally misled me in a fraudulent manner and sought to obtain my Aunt 's property by filing " Foreclosure '' proceedings falsely stating that I had defaulted on the payment of my Aunt 's Reverse Mortgage Loan.

First of all, I am a XXXX XXXX. I've owned my company for 14 years, and I have been in the industry for over 17 years. As I XXXX, I send quite a few loans to Finance of America Mortgage. Their servicing company is XXXX XXXX XXXX. I recently refinanced my OWN mortgage, and my XXXX used Finance of AmericaXXXX as the lender for the loan. During the loan process, obviously, one of the loan conditions was to provide proof of insurance IN FINANCE OF AMERICA/XXXX 'S NAME. My insurance agent updated my insurance policy. And Finance of America/Loancare had a copy of my current XXXX Page UPDATED INTO THEIR NAME AS LOSS PAYEE before the loan even closed. Shortly after funding, XXXX sent me a threatening letter : " let up insurance and provide us proof of insurance or we'll force place lender coverage onto you. '' I sent them an email, TO THEIR SPECIFIED EMAIL ADDRESS. I notified them of several things : 1. First, that other clients of mine have been complaining about XXXX improperly handling their escrow accounts post funding. 2. I, now a client with my own mortgage, was seeing that even though XXXX/Finance of America had my Evidence of Insurance IN THEIR NAME, as a condition of FUNDING A LOAN WITH THEM, they were sending me threatening letters improperly. They should have a modicum of competence, see the proof of insurance in their file, and act like a professional servicing company. 3. I notified them on XX/XX/2022 by email, at their specified email address, that if they continued to send me threatening emails improperly that I would file a complaint with the CFPB. I've attached a copy of that email. 4. That email also included, AGAIN, the evidence of insurance that we had submitted during the loan process PROVING that the insurance is already in XXXXFinance of America 's name. My company is actually good at what it does, so this was a condition that we supplied properly during the refinance process. 5. Because I anticipated XXXX 's incompetence and inability to handle simple tasks, I also FAXED, on XXXX, a copy of my evidence of insurance. After all of this ADDITIONAL work and due diligence on my behalf, guess what? XXXX sent me ANOTHER threatening letter stating that they don't have my insurance and will be force placing coverage. I received that letter on XX/XX/2022. For the CFPB 's edification and to show that XXXX is unable to handle a simple task of looking at a PDF document, I'm supplying the original Evidence of Insurance, that matches exactly what Finance of America wanted and what XXXX wanted that we submitted DURING THE LOAN PROCESS AND BEFORE FUNDING. If XXXX is so incompetent that they can not handle simple tasks like this, they should get out of the servicing business. Unfortunately, this incompetence is also part-and-parcel of what we've experienced with Finance of America. Guess which company doesn't get our loan submissions any longer? Nonetheless, XXXX needs to be monitored by the CFPB because they are not handling their fiduciary duty properly, and it's causing distress and financial damage to their clients. In the year XXXX, my husband and his colleague forced me into a reverse mortgage against my will. This loan was orchestrated under severe duress for fear of divorce. Both my husband and the loan officer knew of my objections and the fact that I did not want to sign the loan documents. I had repeatedly expressed my fear and duress about this type of loan. My duress was in emails as well as phone conversations. Under direct threat of divorce, I was required to close the loan. It was not until months later that I discovered they were planning another reverse mortgage however, this time, a jumbo reverse loan whereby I would have to sign a quit claim deed and hand over my trust fund as a " gift '' deposit. This was a carefully orchestrated plan to protect my husband. Again, I was given the ultimatum to sign the quit claim deed, remove all marital interest and turn my deposit into a " gift '' or my husband would file divorce papers. When I asked for different type of loan that had spousal protections, I was refused by my husband and told this was the only type of loan he could secure. After speaking to my trust attorney, I ultimately declined because of the risk. My husband filed for divorce within weeks of cancelling the loan. It was not until I found a letter detailing out how the reverse mortgage would benefit my husband in the event of divorce since I am the younger spouse. Both my husband and his loan officer knew this and orchestrated this loan with the intent to give him leverage to retain our marital home as well as the purchase of a new home. Through further investigation with my accountant, it was also discovered that my husband was paying this loan officer money outside of their mortgage company. These were large sums. Both my husband and this loan officer worked for the same finance company at the time and paying someone under the table for working on his loans while both were employed by the same company would be a breach in fiduciary duties as well as non reporting of overtime. This was not the only time my spouse and this loan officer committed mortgage fraud. In XXXX Both my husband and his loan officer knowingly closed loans as owner occupied for my husband 's son with the intent to gain a lower interest rate on a purchase. This property was never intended to be owner occupied. The house was already rented prior to closing the escrow. I was again under fear of divorce and physical harm if I exposed any of this information. Now that I have protection and legal representation, I can request an investigation. I have a reverse mortgage that should have never been consummated. I never agreed to the terms. I have emails and direct conversations with his loan officer as well as my husband which she would and could testify to my duress of the loan and my objection to signing the loan documents. The notary can also testify to my objections and duress I faced during the signing. I was under threat to sign the loan documents. It was not of my own free will. The lender was Finance of America and Finance of America Reverse.

On XX/XX/XXXX, I initiated a request for refinance, with the assistance of my son, from Finance of America via XXXX XXXX, with XXXX XXXX as Loan Officer. Over a number of weeks, I complied with every document and information request, giving access to the whole of my financial identity, as well as payments to XXXX XXXX XXXX XXXX and XXXX XXXX, XXXX as I was instructed. Those payments, {$750.00} and {$200.00}, respectively, were confirmed as received by XXXX XXXX of XXXX XXXX XXXX on XX/XX/XXXX. Awaiting appraisal of my property at the end of XXXX, we expressed concern about my rate lock. XXXX reassured us, stating that she had spoken with XXXX and he said FOA would abide by the originally stated rate of 2.99 %. The appraisal was completed on XX/XX/XXXX with my copy received XX/XX/XXXX, and all requested requirements to move to close were met. Six weeks later no further information or updates provided, except for duplicates of the same appraisal report, so I expressed my anger and concern, and requested the status update from the 3 FOA employees involved ( listed above under initial filing ) on XX/XX/XXXX. No response. After numerous phone calls to XXXX XXXX she advised my son on XX/XX/XXXX that she just required my updated paystubs and we would move to close in XXXX. I submitted the next day and nothing. XX/XX/XXXX, XXXX months after initiating this refinance, I sent another email as a precursor to initiating more formal and legal action. This time XXXX XXXX responded that he was reassigning my file to XXXX XXXX. However, it is now apparent that this was a deceptive and fraudulent exercise on his part as he obviously had no intention of abiding by the original terms and was perpetuating the illusion that this was just a further extension of the initial processing. He continued, along with XXXX XXXX, to solicit duplicated documents and another credit check in spite of my stated concerns. Part of the process to update I was told. After 2 more months of paperwork and signatures, XXXX XXXX who was anxious to discuss on the phone before committing in writing finally unveiled his offers to accommodate the failure of his processing which essentially exceed my current rate by .5 % to 1.25 % with other nonconsequential gestures listed. How arrogant to put his self-interest based nonsense before me after all my wasted time and opportunity. No effort to address my costs and losses due to Finance of America employees. My current mortgage is at 4.375 %, my credit score in the very good to excellent range, and my home appraisal over double the amount owed on it. This refinance was never due to need, could have been transacted with any other lender, and was initiated to take advantage of optimal rates which were still available well after my paperwork was completed

On XX/XX/XXXX I received a notice in the mail from Finance Of America reverse that my deceased mothers reverse mortgage was going to go into foreclosure unless I contacted them. I called them on XX/XX/XXXX and they instructed me to send an email to them stating that my deceased mothers estate had not yet gone to probate due to being held up in the courts due to Covid. I told them I could not apply for a mortgage in order to pay off their balance until my mothers estate and probate were settled in the courts. I got a response to my email generated from Finance Of America reverse that they would respond to me in 10 to 15 business days. They never responded to me. Instead they want ahead with foreclosure without my knowledge without notifying me via mail or email. I had to find out that the property went into foreclosure when I received two phone calls from realtors wanting to purchase the foreclosed property. My attorney states they applied for for closure through the courts on XX/XX/XXXX. On XX/XX/XXXX my refinance from XXXX XXXX paid off Finance Of America reverse the full amount. That same day I received a phone call voicemail asking me to call Finance Of America reverse. I returned their call XX/XX/XXXX only to find out that I owed attorneys fees in the amount of {$1500.00} and I needed to pay it that day XX/XX/XXXX by XXXX XXXX East Coast time or they threatened that my entire XXXX XXXX payment that had been posted to the reverse mortgage account would be sent back to XXXX XXXX and I would have to start the entire XXXX XXXX refinance process all over again. I scrambled that day XX/XX/XXXX to get to a bank that could make an appointment to do a wire transfer for me. Had I not paid the {$1500.00} they threatened me that they would return my XXXX XXXX payment back to XXXX XXXX and I would have to start the entire XXXX XXXX process all over again. I do not think I was given proper notice by Finance Of America reverse that this property was going into foreclosure. The only notice I got was on XX/XX/XXXX via US mail that I had to take action which I did at that time by calling them up and sending them that email I described above. I feel I should get a refund of the {$1500.00} attorney fees returned to me. My attorney states I should not have had to pay the {$1500.00} attorney fees. My attorney states I should track down the attorney at Finance Of America reverse and report them to the state bar association. The Finance Of America reversess company I dealt with was out of XXXX Michigan. The attorney for them is listed as XXXX XXXX XXXX XXXX. Here 's just a little background. Starting about XXXX Mom was is very bad health with XXXX and other issues. She went into the hospital 3 times when a XXXX ( that she was prone to ) went XXXX. This had us on an emotional roller coaster as each time it happened it was a little worse. The second time she was in an induced come for 6 weeks and in the hospital for 12. The third time she never recovered. She passed away shortly after XXXX of last year. Myself, my sister, and my brother in California were labelled as executors on the will. Here 's the situation. I've been working with XXXX XXXX XXXX and XXXX XXXX to get financing to pay off Mom 's reverse mortgage with XXXX XXXX and take ownership of the house. I planned on living there as it is close to my sister. I had planned on moving there from XXXX XXXX for years. I had to move into the house since my apartment complex will not do a month to month lease. For the last 6 months I've been providing XXXX 's XXXX with all the documentation they required. I've had the foundation repaired and the fence replaced. I spent {$1000.00} on plumbing. All together, I've spent over $ XXXX XXXX dollars getting to this point. I've also payed for a Survey and inspections. We were supposed to sign the closing paperwork Tuesday XX/XX/XXXX. I received a call saying that somehow my name got on the title without my consent. This is news to me because I am not aware of a Transfer on Death Deed. I have also not signed anything that would give me ownership. What XXXX 's XXXX told me that due to a Texas Law they could no longer finance me. As you can imagine, I was shocked, disappointed, and discouraged. I called XXXX XXXX and they said that they could not either. I think they mentioned a lien against the house. I am not really sure because I was still in shock at the time from the news. If there is, it would probably be by the reverse mortgage company XXXX XXXX. I'm just not sure. Right now I just do not know what to do. I'm working with XXXX XXXX, but it's hard to be positive since XXXX XXXX said they couldn't help. I'm really angry because I did everything that they asked of me. This is regarding the Reverse Mortgage that we have tried and tried to resolve. We were never notified that they were paying any property charges but they paid them ahead of time. Now, they have filed a foreclosure action in the county court and we have asked and asked how much we need to pay to cure the default and nobody can tell us! Every time we call, XXXX tells us that it is under review. They first tried to tell us that we owed {$3800.00} but I looked at the itemized statement that we have tried to get since they first told us we were in default and that was in 2018 and I argued it then. However, nobody would send me the itemized list. Now that I finally got the itemized list, I was right. The items are things like a line of credit and loan set up fee. One item is property tax that we were not notified they were paying. Then the next loan servicer just picked up where they left off and started paying property taxes early with no notices or anything. I asked for an itemized list of those with receipts. They told me to go get the receipts myself and of course their itemized list is not correct. I call them and they say it is under review. The debt collector is aware of the problem as we filed a motion to dismiss in court. They have charged attorney fees and inspection fees to our balance and nobody responds to our requests to information so we can cure the default. They have not followed the HUD guidelines in any way and we are not getting any assistance at all. How can we pay off something that they don't even know how much it is. It should have never been called due and payable. They have put us through XXXX for nothing. Nobody would listen when I tried to tell them the previous servicer was incorrect when they said we did not pay our hazard insurance. The new servicer refunded our hazard insurance a year later but still called our loan due and payable. Wouldn't they see then that it was not due and payable? Why would they not then tell us the balance we owed so we could cure the default but instead kept doing drive by inspections and charging us. I even wrote the debt collectors a letter and told them that XXXX XXXX lost her job because of covid and they did not even respond or tell us we had a moratorium or anything. They just did not answer at all. We never heard from anyone. There was no attempt for a face to face meeting or anything. They just keep trying to have a foreclosure court date and make us pay the whole amount in court without giving us the ability to cure the default because they can ; t tell us what the default amount is. I have called many many times and sent numerous e mails.

The mortgage company filed the foreclosure in court and were unable to provide me an itemized statement of how much we owed. I filed a complaint at that time and they provided me an itemized statement that had bogus items on it like a line of credit and and loan set up fee and then XXXX XXXX tried to justify that list by saying you agreed to pay that back ... of course but that is not something that would be on an itemized list to pay back in order to cure a default and either would a line of credit. So, I called and pushed back on that list. It took you about 45 to 60 days to come up with a list that matched the default amount you had been quoting me. I told you that I had applied for assistance with XXXX even though you have said I did not. Of course they came back and said we were not behind on our property taxes because you have hired a third party in California to pay our property taxes and your attorney has arranged for her to receive our property tax bill of us and the county tax office says that even if we pay our taxes, she will too. We are going to get that stopped tomorrow but anyway, The balance of {$3800.00} that you have used to claim in court will cure the default and given us is an error as I told you before... and I am not referring to the fact that you did not follow regulations to assess force placed hazard insurance. As you will see, You state that on XXXX XXXX XXXX property taxes were paid and the amount is {$520.00}. You have included the receipt for that payment as check no. XXXXXXXX and recorded that as the Spring installment. However, that is the Fall installment. You failed to include the Spring installment paid on XXXX XXXX XXXX by credit card by your 3rd party vendor. I know, hard to believe that it is being paid that early. However, I have done some research and that it not uncommon for this company that randomly pays property taxes on Reverse mortgages. I can attach proof of this for you. Please get this straightened out with the trust attorney ( after you look into the insurance regs, please ) that had the numbers when we had our settlement conference in court and I told him I did not think they were correct but he insisted. I feel like things should be correct before you start foreclosure proceedings. I knew they were not and this is what I kept trying to tell everyone but NOBODY wanted to listen to me. BTW, your monthly statements can not be considered a borrower 's notice of anything. Many of the ones I received you can barely read because the printer was out of ink and they are the most difficult to read statements I have ever received. Clear as mud.

I had 2 refinances with two single family home properties in XXXX. Upon signing closing docs, I was given a first payment doc from FofA, which included the loan/account number. After the close of escrow on these two properties, I made 2 payments ( 1 for each property - {$900.00} and {$670.00} ) on XX/XX/2021. Unfortunately, I received a call from FofA ( around XX/XX/2021 ) to return their call. I returned their call, same day and the rep didn't know why they called. However, at this time, she showed that there was a late payment. I told her that I paid the mortgage payment and she said to give it a few days to process. A week later, I received 2 more calls. I returned their call and was told they never received the payments. I told them I did make the payments to the account numbers that were on my first payment doc I received from closing ( FofA ). She told me my new account number and said FofA changed the numbers after the close of escrow. FofA never notified me. I told her that I paid both payments to the original account number. She said she'll note the files they will start an investigation, but not to do anything. A week later, I received another call from FofA and wanted to know where my payment was for XXXX. I again explained and she said to email the cashed checks to the support team and that it will take 5 days to respond, but they will not report any late payments to the credit bureaus since it's under investigation. I emailed the cashed checks to both properties, to the support center and called them to confirm they received it. They indicated it will take another 5 days to process, again told me they will not report to the credit bureaus. Last Sunday, I find out FofA reported both property accounts as 30 days past due to all 3 credit bureaus. I called first thing on Monday morning, asking what happened. They assured me they didn't do anything. I spoke with 2 supervisors and they, too, indicated they don't show that it was reported. However, I have my credit report as proof and both checks were cashed XX/XX/2021 by FofA. They still claimed my account is still under investigation. I tried disputing both accounts through the credit bureaus with proof of the cashed checks and XXXX came back indicating FofA confirmed the 30 day late report. So FofA isn't even looking at the proof that I'm sending to them. To this date, my credit has been destroyed by these horrific actions. I want my accounts corrected AND all 3 credit bureaus corrected to show no late payments.

After refusing to take any responsibility and falsely claiming that they had not delayed or cancelled the appraisal, without apology, they eventually agreed to honor only the original loan application terms -- even though they caused the 120 day HUD terms and rates lock to expire. The exact words from the manager XXXX via email were, We will honor the terms executed when the application was signed. However, not surprisingly, the closing paperwork that we were presented and signed had completely different terms than the application, with a different rate, added fees, etc. Even after mentioning the above bait and switch tactics, they still refused to correct their shady behavior, selectively ignoring numerous emails asking for clarification. While they eventually responded, they did not answer all of our specific questions. We have evidence indicating that they did delay and affected the cancellation of the appraisal, despite their fabrications made to the contrary. Furthermore, the last quote they agreed to was for better terms, including a fixed rate, which they refused to honor. Trust- They also improperly refused to accept our Certification of Trust, instead demanding the entire trust. This action unambiguously violated California Probate code 18100.5., stating that ( a ) The trustee may present a certification of trust to any person in lieu of providing a copy of the trust instrument to establish the existence or terms of the trust. I provided numerous opportunities to provide transparency, but it is clear that they have been getting away with these and other tactics for a long time and think that they are above the law. While they are nice salesman in the beginning, they showed their true colors after they got us hooked. Rates went up, so they want to lend at the higher rates. It also seems obvious that they do not have sufficient staff, including having a resolutions team to solve problems, as most other direct lenders. But it is the lack of truthfulness that is really problematic.

We closed on our loan with Finance of America in XXXX. Our first payment was due XXXX XXXX On XX/XX/XXXX, we decided to make a principal curtailment payment in the amount of {$1400.00}. Before making the payment, I called Finance of America to make sure the account was set up and ready to accept the payment. I offered to pay over the phone through a representative to avoid any mis-allocations of the funds. The customer service representative informed me that if I did that she would charge me a fee. Therefore, I requested that notes be made in the account stating that I would be sending in a principal curtailment payment electronically. The same day, XX/XX/XXXX, I made an electronic payment on which I indicated that the funds were for principal curtailment. Finance of America processed the funds on XX/XX/XXXX. In spite of my best efforts at communication, part of the funds were applied to XXXX 's payment instead of reducing the principle as requested. I received a statement stating that no payment was due until XXXX. I was surprised. On XX/XX/XXXX, I called Finance of America and requested the funds be allocated according to my wishes. Please recall no payment was due until XXXX first. This time the representative informed me that until I made XXXX 's payment, they could not make a principle curtailment payment. I made a second payment on XX/XX/XXXX in order for them to process said principal curtailment. A ticket was created and sent to the 'appropriate ' department. I followed up with Finance of America on XX/XX/XXXX or XXXX to see if the issue was resolved. I was informed that they would be completing the ticket on XX/XX/XXXX. Today, XXXX XXXX I received a statement from Finance of America stating that no payment was due until XXXX XXXX. Thus indicating that all my attempts at having funds allocated appropriately were in vain. I tried to call customer service and requested to speak with a manager, before the transfer, I requested that if the call dropped to please call me back. I also contacted our loan officer, who is trying to be very helpful and gave us the information needed to contact you. As of this writing, no-one from Finance of America customer service nor the servicing department has called me back. We are not happy with how they have handled a new customer!!!

In early XX/XX/2020, I contacted XXXX XXXX of XXXX to ask about a reverse mortgage. He informed me that he could not help as the current mortgage was too high. He referred me to XXXX XXXX XXXX XXXX XXXX XXXX ( not XXXX XXXX XXXX ), with whom he was previously associated. XXXX XXXX stated he could help me and the application process began for a reverse mortgage with Finance of America Reverse ( FAR ). The property is currently owned by XXXX XXXX, my daughter with whom I reside, XXXX XXXX, my grandson and nephew of XXXX, and myself. XXXX and XXXX were prepared to gift the property to me, so that I could apply for a reverse mortgage. The mortgage is only in the name of XXXX XXXX. There was a 36 % equity in the property and I had funds to bring to closing for any shortfall in the equity requirement, which was over 37 %. I signed the application on XX/XX/2020. All requirements for documentation, income verification, credit report, bank accounts, etc. were supplied as requested. There was a delay in the appraisal of the property due to FAR 's tardiness. The appraisal was received at the end of XXXX for {$600000.00}, the amount stated on the application. FAR asked for a second appraisal, which also stated the amount as on the application. After continuous requests for further information and documentation, all of which was supplied, I was old by XXXX XXXX in XXXX that I had been approved but a few more items were required. These were supplied. I then heard nothing from XXXX XXXX and he would not respond to voice mails or emails so in XXXX I tried to contact FAR. I called the telephone number on the contract to get voice mail. I went on line and sent a message on the FAR site. I signed up on a XXXX advertising Campaign. I tried every telephone number that I could find and received no responses to emails or voice mails and no one could help me. Intermittently, XXXX XXXX would call and say it is going to happen but the underwriters just need more or updated information. There have been 4 requests for us to get payoff amounts from XXXX to XXXX. The last communication with XXXX XXXX was on XX/XX/XXXX, when he was supposed to find out about errors on an estimated settlement statement. There is a loan # XXXX on this statement as attached. Since then I have heard nothing.

We have applied for assistance with XXXX and a HUD counselor has assisted us with that and we are about to complete that process and remedy the foreclosure problem. However, we are trying to be able to keep the lender /servicer from early paying our property taxes as they always do! This is a vicious circle you can not escape because they choose to do this to reverse mortgage borrowers. Our HUD counselor said this is not right and that in INdiana property taxes taxes are due in XXXX and XXXX! This lender has a third party paying both installments as early in the year as they can! Last year they paid one in XXXX and the other in XXXX! We are on a fixed income and we have to pay in XXXX and XXXX. They do this and then tack interest onto our balance and now when XXXX pays the mortgage reinstatement, we will still owe them another {$1000.00} & they can keep up the same routine of paying our property taxes and inflating our balance! We will never get out from under them! How can this be right to pay it this early? The HUD counselor says it is not legal! We can not compete with this. I went online to see if this years property taxes were out yet & they were not but noticed they had changed out tax bill to go to the lenders third party instead of us!! What!? We arent even going to get our tax bill!? We still have the deed to our property! Went to the county tax office and was told the attorney for the lender set it up to go to the lender & that we wont get a property tax statement and they were told if we pay our taxes the lenders third party will too! WT heck is going on? The lady in the tax office said everyone with reverse mortgages is experiencing this and senior citizens are being targeted! This is our home and we will get a tax bill and the third party will not! I dont know who has done this or why but they have no right nor does the lender have the right to pay these property taxes that are due in XXXX and XXXX in XXXX. The lady in the tax office said they called in XXXX trying to pay 2023 taxes already! I will attach proof of all of this! I have also sent all of this to the AG but the HUD said the CFPB should be doing something about this!

I applied for a reverse mortgage refinance with Finance of America Reverse, aka FAR, on XXXX with XXXX Mortgage. The intention was to obtain lower interest and receive money from refinancing. Important to note that I went with FAR because they already had my original 2017 reverse mortgage, which was taken over from XXXX, and I was assured by their in-house agent ( FAR ) that refinancing would take from 30 to 65 days. I was vigilant regarding the amount of time it would take to fund the refinance because I was almost completely out of personal funds due to COVID-19 and being evacuated from my home in XXXX XXXX XXXX XXXX CA due to the XXXX fire XXXX Throughout those, unfortunate situations, I provided support for my grandson who had been living with me for over 5 years. I have a timeline of every document I was asked to be provided. Received my XXXX counseling on XXXX FAR requested 2 appraisals ; the first was provided on XXXX with all necessary elements of the appraisal provided, the second appraisal was not requested until XXXX, in the middle of winter, and a great snowpack which prevented the second appraiser from taking a picture under the house. Which extended the time, I have pictures of snow and ice on XXXX which I provided to FAR and my grandson took pictures of the crawl space on XXXX when we finally got it accessible and I still had not received a call from the 2nd appraiser to come back out and in which far insisted we needed to compensate her even though it was her choice to come back. FAR challenged anything and everything they possibly could to put off funding this refinance, weeks would go by and then another request would be made, often for documentation they had already been provided with. FAR would not cooperate with my loan representatives on anything requested of them. This refinance was completed by me and my representatives in a timely and professional manner and in good faith. FAR, representation has been less than professional and should be held accountable for their lack of action and professionalism with regard to my refinance.

My mortgage servicer is deliberately thwarting my efforts to bring my reverse mortgage current. A XX/XX/2022 sale date has been posted. The mortgage was called because XXXX XXXX funds assessed as property taxes on my home became delinquent. I could not pay {$28000.00} per year, especially after my job with XXXX ended. I was told that XXXX XXXX funding was not appropriate for reverse mortgage holders, and should not have been offered to me or the other reverse mortgage holders. There have been real problems, not just for me, because of this. My home is in a prime area of XXXX XXXX ; there is significant equity in the property. In XX/XX/2022, I applied for assistance from the XXXX XXXX XXXX XXXX. I was told I could qualify for as much as {$80000.00} ( a little more than half of the tax debt owed ). Because I monitored my application carefully, I learned XXXXXXXX XXXX that there was a specific program focused on reverse mortgages and that I should apply for that program. I did so immediately. That new application is now in an inactive status. I was told by XXXX XXXX XXXX XXXX representatives that my mortgage servicer, Finance of America Reverse, has never set up a mechanism to receive payment from the program. The Finance of America Reverse representatives I have spoken to since have individually and collectively referred me to XXXX, the funding source for all states ' mortgage relief program. Evidently Finance of America Reverse is not aware that the connection exists. I was told by several representatives for Finance of America Reverse that I was to send the money, without any further effort by the mortgage servicer. The company appears to refuse to acknowledge their clients in California need any assistance whatsoever, and are deliberately thwarting the benefits the XXXX program offers to all citizens. I have less than 17 days to stop foreclosure of my home of XXXX years. I want the sale date stopped. I will also appreciate fair reconsideration of my current mortgage.

I own 2 properties, a XXXX and a parking spot under 1 mortgage. I refinanced in XX/XX/XXXX. In XXXX of XXXX my servicing and escrow was moved to XXXX In early XX/XX/XXXX I received a final notice on unpaid property taxes on my parking spot, and was notified I could lose the property in 30 days if not paid. I paid the tax bill and penalty on my own. Today I saw the property taxes for this property were removed from my account XX/XX/XXXX. When I inquired with XXXX customer service insisted they were paid correctly. I then got on the phone with the city of XXXX treasurer customer service who confirmed they received my payment but not from XXXX. Then after a second phone call XXXX customer service agreed they had not made the payment with the funds made from my account. Another payment was made from my escrow XX/XX/XXXX for property taxes due XX/XX/XXXX but I have no way to confirm if its being made correctly until its too late. I found customer service to be evasive and unable to remedy in an appropriate time frame. It is unclear why these payments were not made to begin with but I would guess it has to do with when my account was moved. Additionally my monthly payment has moved from XXXX to XXXX dollars this month. Between XX/XX/XXXX and XX/XX/XXXX my XXXX dispersion has moved from XXXX to XXXX, with the additional dispersements in new line items that can not be explained by customer service after I spoke on the phone with them this afternoon. This may be correct ( I don't think so but I'm not certain ) but they are unable to explain the increase and given previous errors i must now insist on full explanations for all these projections There have been other issues with XXXX that I am bringing up now. To Whom It May Concern : We initiated a mortgage application via XXXX. The lender we initially pursued the loan with was Lending.com ( aka Finance of America Mortgage, LLC ). XX/XX/2020 ; approximately XXXX XXXX MDT : When I initially spoke with the Loan Officer, XXXX XXXX XXXX, the subject of title companies came up. He was quoting me approximately {$1800.00} for title costs. I specifically asked if we could choose a different title company because I thought it had been cheaper during our last refinance. Mr. XXXX clearly indicated that if we did not use a title company of the lenders choosing, they would not want to pursue the deal. He offered a reason that because of the ongoing COVID-19 pandemic, their preferred title companies would be most useful to facilitate remote closing. However, when viewing the initial loan disclosures, which I have saved, there is clearly a form for me to sign indicating that I can choose whichever title company I prefer. Furthermore, the form indicates that one of the lenders title companies shares 100 % common ownership with the lender. XX/XX/2020 : I reached out via email to Mr. XXXX because I wished to put him on the record and keep the correspondence in writing. At this point I wanted clarification and was not averse to still using his company for our loan purposes. However, and I saved the email thread, he tried to say that he specifically told me on the phone we could use a title company of our choosing. This was a blatant lie and It is my belief that he only changed his statements regarding title companies once I put him on the record by putting the correspondence in writing. I realize there is no way to prove the contents of our phone call. The best I can do is provide timely documentation of such things thus creating a time stamp. A reverse mortgage company solicited a mortgage from my XXXX Mother. She lives on the west coast the loan company is on the east coast. She had XXXX some time in the past and was hard to converse with in person and nearly impossible on the phone. The loan company sent appraisers and estimators to her house but no loan agents. She was given a list of repairs that would have to be made to her house as well as an estimate to have the work done. Although I was not in favor of the reverse mortgage it was not my decision. I was shown the estimates for the repairs and new that they were significantly lower than they should be and suspected the loan company of intending to submit a final invoice much larger than the estimates. Therefore performed all the repairs at my expense which the loan company did not like at all. They did there best to discredit the work but their inspectors had to acknowledge that all the repairs were complete and correct. Non the less it appears that the loan company added their original estimates to the costs of the reverse mortgage even though they did non of the work. My mother passed away from another XXXX. In the course of trying to sort out the mortgage and other affairs I found a document on her computer. It was a form stating that she had met with a re [ presentative of the loan company in person and that all aspects of the transaction were explained to her and under stood. I believe this document was a legal requirement and that it was e-mailed to her with instructions to print it out, sign it and mail it to them even though no agent and met with her in person. These are only some of the issues I 'm having trouble with. I 'm not sure what qualifies as a " predatory loan '' but my mother was pressured and misled. She would never had agreed, nor would any rational person agree to borrow XX/XX/XXXX dollars for three years in exchange for a house worth over XXXX.

On XX/XX/2021 a mortgage application was completed with Finance of America LLC, a mortgage lender, for a property located in XXXX, NJ ( XXXX XXXX XXXX, XXXX, NJ XXXX ). All underwriting conditions were completed within the same business day of the request. The lender made the initial guarantee to close in XXXX. The lender then requested the appraisal company take photos and appraise the comparable properties despite having no authority to trespass onto other properties nor the relevant to the mortgage application for the property. An appeal was made from our attorney as the condition is not relevant given the appraisal amount for the property in question far exceeding the XXXX amount and the property noted in good condition as per appraisal and inspection. Further, the mortgage lender waited until the date of the lock expiration to " find '' another condition as an excuse to charge more closing costs for the purchase. The mortgage broker ( XXXX XXXX, XXXX, NMLS XXXX ) handled business with the male applicant, and only would communicate the same information to the female applicant if directly requested by the male applicant as clear form a discrimination. The company is now requesting business records for any company with which either applicant is involved for the last three years despite business income not claimed as part of the transaction and K-1 forms already provided. Both applicants DTI, income, and credit far exceed the minimum requirement for this and any lender yet are met with poor communication, interrogations, and never ending unreasonable requests. The lender misrepresented and misled the borrowers about their ability to obtain a mortgage with the company, dragging the process out more than 45 days and preventing the borrowers from finding another mortgage company and costing the borrowers undue hardship for time, cost ( appraisal, inspection, lawyer ).

Under Florida Statute 673.3081 ( 1 ), a homeowner has the right to challenge any signatures on the promissory note. The company failed to acknowledge receipt of the document within the statutory time set forth under RESPA Law. Before sending the Qualified Written request, we contacted the company and communicated the reason for the Qualified Written request, the company responded by providing the HR department fax number and stated that HR would be the responding to the RESPA request. As a consumer of Finance of America Reverse I understand it is my obligation to maintain my home in good condition. XXXX XXXX of XX/XX/XXXX caused extreme damage through flooding. To prevent mold wet drywall had to be removed immediately. Unable to get response from general contractors to work on my thousand-square-foot, XXXX home, with the help of my family and friends the house was dried out in time. Work repairing damage continued with me as homeowner acting as my own general contractor with tremendous help from my family. A flood claim was filed, {$20000.00} advance was received from FEMA within days. The endorsed check was sent to Finance of America where funds were withheld for weeks. Denied the use of the {$20000.00} advance in making repairs, I borrowed on my mortgage, thereby incurring interest and fees. And I continued to borrow as repair expenses mounted. The balance of claim {$74000.00} was sent by FEMA to me XX/XX/XXXX. I sent the endorsed check to Finance of America. Scanned receipts of expenses in two batches totaling over {$60000.00} have been sent to Finance of America. Two days ago I received release of funds {$27000.00}, {$47000.00} being withheld. In my obligation to maintain my home in good repair, I have had to borrow thousands, after having paid for flood insurance, my claim having been honored by FEMA, incurring interest and fees while Finance of America keeps my funds. They have made it extremely difficult for me to maintain my home in good repair. This is unfair business practice, an undue burden, adding unnecessary stress in a catastrophe. In the case of reverse mortgages, reasonable to assume users are elderly and therefore even more burdensome. This practice should not be allowed.

Finance of America Reverse, Loss Draft Department continues to hold my insurance disaster claim check in the amount of {$11000.00} without cause for well over 30 days and never processed an initial dispersement for my home to get repair. Finance of Am have already confirmed receipt of check on XX/XX/XXXX and that no other info is needed. They have continuously informed me that they will process the funds to me each time I called and as of date no receipt of funds. I called on XX/XX/XXXX for status, XXXX XXXX stated Finance Of America notes in file receipt of check on XX/XX/XXXX as requested and contract, receipts, and invoices of contractors was also received and confirmed by Finance of America and no other info needed for initial dispersement. I called again XXXX, funds, not processed, again on XXXX, XXXX XXXX ( Rep ), funds not processed but stated she was sending urgent message to Processor to release funds; called again on XX/XX/XXXX, XXXX XXXX who again confirmed no other info needed and again stated he will send urgent request for release of funds. Because of their continuous neglect and disregard of devastation of damages, I had to borrow and use my own limited funds to get my entire roof replaced as I have rained in damage to my home. My ceiling is sloped and cracked from rain in and Finance of America have been notified over and over again. I am a XXXX XXXX on XXXX and need the funds ASAP. Damages to my home is still progressing to worst results and I have no more personal funds to get these repairs completed and I should not have to when Finance Of America is holding my money or worst have stolen my insurance disaster funds. On XXXX I closed on a refinance of my mortgage with Finance of America Mortgage Company. My mortgage was assigned to a company called XXXX XXXX for servicing. Problem : The amount that XXXX XXXX deducts from my monthly mortgage payment is XXXX ( {$3600.00} annually ). On XXXX I received a letter from the XXXX County Tax Commissioner 's office that my homeowner 's taxes would be reduced from {$3600.00} to {$1200.00}. Based upon this reduction, the amount that XXXX XXXX should be deducting from my monthly mortgage payment should be approximately {$100.00} per month as opposed to {$300.00} per month. I have contacted XXXX XXXX on 3 occassions via their website and via phone regarding this situation. I submitted the attached documentation provided to me from the XXXX County Tax Commissioner 's office, however Loan Care has not made the correction, instead, I received the attached document from them called Annual Escrow Account Disclosure Statement dated XXXX which indicated that the correction was not made. Today I looked at my account on the XXXX website. The escrow and insurance page reflects that my escrow amount is now {$1200.00} annually. However the on the Payment Information page it reflects that my the escrow tax amount deducted from my monthly mortgage payment is still XXXX ( {$3600.00} annually ). This is an obvious discrepancy and XXXX XXXX is still deducting the wrong amount from my mortgage payment and is charging me the wrong amount for my mortgage payment. I would like my escrown payment to be corrected, my mortgage payment amount to be adjusted accordingly and XXXX XXXX to send me any overage that I am due. Thank You

Finance of American Reverse ( FAR ) have been holding my insurance proceeds for devastated home repairs for over a year whereas my home had to be gutted to the extent of no walls, no ceilings, no floors from rain water damages. My family and I are still residing at hotel while I have to use my own personal money and loans to get as much repairs done from limited funds. I previously filed a complaint for this same issue involving the same processor ( XXXX XXXX ) at FAR Loss Draft Dept. who is very negligent in processing funds and appears to be stealing funds for keep. The supervisor previously had to overnight some of my reimbursement of approx {$7800.00} after my complaint in XX/XX/2021 to CFPB. As of date no more funds has been released. I have sent in numerous paid receipts and have not yet not only received reimbursement of my personal funds but no money for emergency repairs. I have lost many contractors for FAR 's neglect to release insurance claim funds. I have called to inquire and I am either hunged up on when connected to processor XXXX or given a message from her that she will call me back but she never does.. My home is in serious need of repairs and I do not understand why these people are refusing release other than civil rights violation, retaliation or they are stealing. I am exhausted from begging and pleading for my own funds to be released. This complaint concerns two mortgage servicers, both attempting to collect mortgage payments from me for the same mortgage. I have repeatedly spoken to both companies over the last two weeks and both companies insist the other company is in error. My mortgage is due in three days and I am at a loss for how to proceed. Here are the facts : My partner and I entered into a mortgage agreement for a home in California in XX/XX/2021 Finance of America C/O XXXX sent us our first mortgage statement, which we paid on or around XX/XX/2021. However, a company called XXXX XXXX XXXX ( XXXX ) issued us a welcome letter stating that as of XX/XX/2021, XXXX was now servicing our mortgage. Finance of America, however insisted that it was still servicing our mortgage. In the last two weeks of XXXX I contacted both mortgage servicers repeatedly. Finance of America and XXXX ordered us to make payments through XXXX while XXXX ordered us to make payments through XXXX. After getting nowhere with phone calls, on XX/XX/2021, I sent an email to both companies demanding that they resolve this issue by communicating with each other. Neither company has yet responded to the email. Importantly, XXXX has all of my financial information, including our mortgage application and agreement, and Social Security numbers. We are unable to tell which company is our true loan servicer. Regardless, one of the companies is falsely attempting to collect our mortgage payments. We believe we have given them sufficient time to resolve this and at least one of the companies appears grossly negligent in handling this matter.

After speaking to Finance of America Mortgage LLC about refinancing my current mortgage that I have with XXXX XXXX I was asked what I thought my home was worth. I told XXXX XXXX that my new insurance just insured me for XXXX as my value and then he asked me what I owed ( XXXX ) and he said those numbers were enough to refinance form an FHA to a Conventional loan to remove the PMI and lower our monthly payment going forward. He never told me that the apprasial could come in much lower and to be prepared for different numbers if it did. He advised that he would run the numbers and gave us 3 options, all where would get around 7 to 10 thousand dollars back at closing. He advised that I needed to sigh a rate lock form and give him a CC for an appraisal that would cost {$470.00}. I said I would not do that without seeing final numbers and he said not to worry about any of that the {$470.00} would be reimbursed at the closing cost and I would not have to pay that out of pocket. it would only be held on my card until closing. The appraisal came back at XXXX and they told me that I would now have to pay at closing and I was losing my {$470.00} as well. I said I was never explained that and I wanted my {$470.00} back as promised and I was not going to pay them anything. They told me how to cancel or how to get into a different loan that were not the numbers that we discussed and have now stopped communication with me. We purchased this house with a FHA XXXX loan. The total loan amount is $ XXXX. The property purchase price is $ XXXX leaving $ XXXX for renovations. We have only used $ XXXX leaving a ballance of $ XXXX. We do not need the $ XXXX remaining. I want my mortgage to refect that amount ( $ XXXX ). We needed this modification because the banks HUD Inspector approved the contractors bid that the inspector knew could not be done for the amount quoted. The inspector told us this in XX/XX/XXXX. That why we needed the first modification. We supplied all finishing materials which made rehab fit the remaining budget. When we moved in on XX/XX/XXXX, all the plumbing had to be redone, everything leaked. The inspector approved and paid for faulty plumbing. We asked for a second modification to cover the cost to make repairs. All modifications were necessary because the inspector failed to do his job. Finance of America 's XXXX XXXX recommended the realtor XXXX XXXX XXXX. Who recommended XXXX XXXX XXXX XXXX who grossly under bid the contract, and breached the same contract. Then Finance of America 's HUD inspector XXXX XXXX recommended XXXX XXXX, who he has paid for unnecessary and incomplete work XXXX. The broker recommended the realtor. XXXX. The realtor found the house and the contractor, who breached his contract XXXX. The HUD inspector recommended the second contractor who has not completed the work but has been paid.This has predatory tendencies all over it and a whole lot of conflict of interest, nepotism, and fraud.

The company is Finance of America commercial and loan number is XXXX. I have had a loan with FACO since XX/XX/XXXX approximately and never had a late payment till XXXX because of Covid 19. I lost my rental income and a huge chunk of investment income and to add to it, a worker working on my home XXXX XXXX XXXX caught Covid 19 and work was suspended for a month and a half with the lock ups. I applied for loss mitigation and had a few questions regarding what was needed and the rep I was working with XXXX XXXX did not respond. The next thing I got was a letter saying I did not meet the guidelines. I was late in XXXX payment and had to pay the late fee of {$360.00} to get a draw. I had money for XXXX which i borrowed and attempted several times to make the payment but I was unaware that my XXXX account was hacked and bill pay was suspended. I kept going back and forth with XXXX until i figured this out and had to do a wire instead. XXXX, I did my best and only still secured payment later on. My whole purpose of this email is to ask if it's too much for FACO to give consideration to its customers who were hit by Covid 19. Isn't it a bit extreme to expect payment on time when there's lost income and sick workers working on the fix and flip? I really thought a company with values like yours would at least try and work with the customers? It's quite unfortunate what I have experience. I owe {$790.00} in my account, I can't get a draw, I don't have that money. I don't know what else to do.

In XX/XX/2021, Finance of America stated they didn't receive my payment and then they reported me late. In the end, My LO who doesn't even work at FOA any longer figured out what happened and they reversed the negative reporting after 65 days of frustration. They were horrible in regards to communication and didn't seem to take me seriously or even care about my anxiety regarding the issue. My credit is excellent and I always pay my bills on time so this issue was really frustrating. In the end, they applied my payment to the wrong account which I proved to them by getting the cancelled check which was suggested by my LO. My issue is their communication and then they also stated they wouldn't report it to my credit until the investigation was complete. I understand mistakes happen, however the way they approached the situation was very unprofessional and unethical. Had my XXXX not stepped in, I find it to believe that they would've resolved the issue. I'm making this complaint for the next person they are treating like this and maybe they'll be more professional next time. I find it very unbelievable that they would blatantly lie to me about reporting the late payment to the credit bureaus. Thanks you in advance for reviewing my complaint. My grandfather 's XXXX insured reverse mortgage seems to be apart of predatory lending and fraudulent mortgage practices. After reviewing documents sent from what I thought was a mortgage servicer XXXX, I discovered that the HUD insured reverse mortgage my grandfather took out had multiple loan numbers attached to it and reverse mortgage foreclosure documents that do not match the terms from the recorded deed of trust. XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX, XXXX, XXXX XXXX XXXX XXXX XXXX, XXXX, and XXXX XXXX XXXX are listed on these documents. Mortgage documents appear to have been merged together and recorded documents are not signed under penalty of perjury ; and are inaccurate ; incomplete ; and unverified. The recording of a Notice of Default and Notice of Trustee 's Sale, in a XXXX initiation of foreclosure took place under this reverse mortgage while : I was under a HUD foreclosure preventative alternative until XXXX XXXX and discovered that this entity was in a forfeited status and was not allowed to do business in the State of California. It was a trustee 's sale foreclosure of a lien not the Property and a foreclosure with no lender. In addition, in XXXX, I received documents at my home that I shared with my grandfather that reference a fake living trust and a fake Estate, which were used on documents pertaining to several fraudulent sales, transfers, transactions, and conveyances.

Finance of America Mortgage LLC started servicing my conforming mortgage in XX/XX/XXXX, including escrow of tax and insurance. In summer XXXX my insurance was due and they contacted me to update my insurance information with them. I did, but they never made the premium payment. I contacted them to ask them to pay and they assured me it would be taken care of but it never was. On XX/XX/XXXX I made a {$2100.00} payment directly to the insurance company, at that point it was past due and coverage was 2 days from lapsing which would have left me exposed to significant risk. From fall XXXX to spring XXXX I have been trying to get Finance of America to perform return the excess funds in my escrow account that should have been paid to my insurer. I have made multiple requests by both phone and digital messaging feature on their website but they have still not taken action. In fact, they have NEVER done an escrow analysis since they started servicing in XX/XX/XXXX. I've attached a printout from their website showing last escrow analysis was XX/XX/XXXX, a copy of my most recent written request for reimbursement, and my latest mortgage statement. I'd like to be reimbursed the ~ {$2100.00} in excess escrow balance that should have been used to pay my insurance premium in XX/XX/XXXX. Better yet, I'd like to cancel my escrow on this mortgage so I never have to deal with them again.

XXXX, XXXX Mortgagee got Judgment against me for RE taxes paid by them. Sheriff 's Sale set for XXXX, XXXX but cancelled by agreement for " Tax Default Repayment Plan '' booked on XXXX. Typo on doc said first payment due XXXX, 15 days before XXXX went into effect = 15 days Past Due on Day 1. I paid XXXX payment XXXX which I was told was to prepay the XXXX XXXX payment ( see their report ). I paid my next payment on XX/XX/XXXX and the first week of every month thereafter in the first week when I received my Social Security ( I am XXXX ). I called at the beginning of XXXX, XXXX and made my monthly payment by debit card. Two weeks later, I received a check back saying my loan was in default and they would not accept any future payments. I called and asked to speak with a Supervisor and was refused. Every month I had asked to have a Supervisor review my payment status but was always told no one was available. ( They say they record every call so I can back up my request ). This could all have been avoided by a simple one-sentence agreement revising the date the first payment was due. On XX/XX/XXXX, I received a notice of a Sheriff 's Sale on XX/XX/XXXX, XXXX 2 weeks notice. There was NO SUMMONS, COMPLAINT, HEARING ON JUDGMENT .based on my delinquency on payments they REFUSED to accept. Mortgagee was high bidder. I am now Objecting to court approval of the sale on XXXX.

I am having serious issues surrounding my rights after the death of a borrower with my fathers reverse mortgage The property has a reverse mortgage. The mortgage has sold/be assigned multiple times since XXXX. I XXXX XXXX am the trustee, estate representative. XX/XX/XXXX I notified Finance of America Reverse of my dads passing. I was informed of the death of a borrower process. I was informed I was allowed up to 12 months to satisfy debt and the extension process was explained. I have a buyer. The property is currently under water damage claim/repair that affected half of the 1st floor kitchen and the 2nd bathroom plumbing. This process is being monitored by the reverse mortgage servicer. The foreclosure never should have started but at this point all I was trying to do was get an extension until the monitored repairs are complete and the sale can continue with an appropriate appraisal. In XX/XX/XXXX I started getting Foreclosure letters from XXXX XXXX, NO COMMUNICATION from my servicer/lender. ***I spoke with XXXX XXXX XXXX XXXX XXXX as advised by Finance of America to get assistance. I applied to Finance America Reverse to refinance my reverse mortgage. I was ask what is the fair market value of my home. I estimated {$290000.00} based on similar homes in my neighborhood. I completed an application based on {$290000.00}. I was told IF the appraisal came in at {$290000.00} It should be approved and I should be able to receive {$28000.00}. ( This would help me pay Taxes, Ins, & HOA fees-and remain in my home for years OR until COVID19 gets me ). The appraisal came in at {$230000.00}. My home value was based on Comparisons to homes in other neighborhoods in XXXX XXXX where homes sell for ~ {$50000.00} less. NOT XXXX XXXX XXXX XXXX. Finance America Reverse ask the appraiser to consider comparisons in XXXX XXXX. The Appraiser said none were appropriate due to old sales dates, Square ft differences, & other differences. This is wrong. Several similar home sales in XXXX were for homes in XXXX XXXX for over {$300000.00}. There are about 100 homes in XXXX XXXX. Two are identical to mine. One ( with a pool ) sold for {$320000.00} in XXXX and the other is estimated at {$280000.00} online. Home values in XXXX XXXX are increasing $ XXXX to $ XXXX per year. My appraisal was {$50000.00} to {$60000.00} LOW. Florida Regulators of appraisers allow complaints for standards or independence violations only NOT for doing a bad job.

On XX/XX/2019, I respectfully submitted complaint no. XXXX. The lender stated that will not furnish any other information claiming i was not authorize on the account. Attached please see court Order. The Court order reflects i am the legal representative to the Deed and therefore have every authority vested in me by a Circuit Judge to challenge the foreclosure action. Also see Lis Pendens where i am named party to the lawsuit and have every right under Florida Statute 673.3081 ( 1 ) to challenge the note and its endorsements. Upon receipt of the Qualified Written Request, the lender responded and stated that XXXX XXXX was a former employee of FAR. We will like to know who is FAR and what is the relevance between FAR and Urban Financial Group Inc? Can you provide power of attorney authorizing XXXX XXXX to have executed the endorsement for Urban Financial Group Inc, since her name is not listed on XXXX. In fact the names of every officer will appear on Floridas site. The reason we made the inquiry is because XXXX XXXX is not found in any documents pertaining to Urban Financial Group Inc. We believe XXXX XXXX does not even exist and is the reason the lender does not want to comply. It appears on its face that the lender have engaged in Floridas Deceptive Business Practices.

I wanted to report this suspicious lender I found via XXXX. They have XXXX star rating in XXXX and it looks like they didn't post my XXXX Star review. Story : I found the lender named XXXX from XXXX and though it was legit lender to get my VA XXXX loan refinanced. They offered me 0.75 % Interest rate while my current interest rates are XXXX. I did not know about the 0.5 % IRRRL rule until my current lender XXXX called me and told me about it. By this time, I had already completed application, me and my wife 's credit was run and I had already submitted all the documentation to this lender named XXXX XXXX. After I found out about the 0.5 % rule, I asked him why he locked me at 2.75 % rate while its not at least 0.5 % less than my existing rate and how was he going to get this approved from VA, his answer was " His system was showing everything fine and our credit was good enough to bring the rate to XXXX if necessary ''. I asked him if he can lock my rate at XXXX, he said he couldn't. Moral : He knew that this was not going to get approved before I even put the application and he didn't tell me. Please make other veterans aware of the lenders like this and don't process anything that comes from this lender for me.

I have asked for validation and verification of debt. I have asked for a Request of XXXX per the FDCPA. All they can send me is a statement of account and a copy of my note and mortgage which they are nowhere to be found in my paperwork. Notice, it is a fact, affiant is aware the term identity theft as described in 15 U.S. Code 1681a ( q ) ( 3 ) and Regulation V 12 CFR 1022.3 is a fraud committed or attempted using the identifying information of another person without authority. Per Credit Karma it states that my account with XXXX XXXX XXXX began on XX/XX/XXXX. I don't know how that is possible when it was FINANCE OF AMERICA MORTGAGE. Who then in XXXX of XXXX sold my information to XXXX XXXX XXXX who then in XXXX of XXXX sold my information to XXXX XXXX XXXX who then in XXXX of XXXX sold my information to XXXX XXXX XXXX. The only one I have a contract with is FINANCE OF AMERICA MORTGAGE. They are not able to produce any wet ink contract between myself and XXXX XXXX XXXX. In late XX/XX/2017 I applied for a Reverse Mortgage. Everything went smoothly, counseling, in-home Mortgage Review, etc., until the Appraiser took note of the power lines running beside my property. Photo Attached. They wanted a letter from XXXX XXXX XXXX XXXX of the lines stating they were safe and were not a danger. XXXX letter attached. I spoke with a different Lender and they provided the actual Underwriting verbiage that pertains to the lines. " If the dwelling or related property improvements are located within the XXXX area, the Mortgagee must obtain a certification from the appropriate utility company or local regulatory agency stating that the relationship between the improvements and Local Distribution Lines conforms to local standards and is safe. '' These transmission lines have been here for over 50 years and run thru densely populated areas. I am sure all of the homes were financed. After a long silence from the Lender I received a form letter stating insufficient collateral. Copy attached. My home is paid for? I have talked with Local, State, and Federal Utility Regulators and no one can understand the reason for denial.

My Mother passed-away onXX/XX/2023. I communicated with XXXX XXXX company and told them I had to refurbish my Mom 's home before we sell it because she was a smoker who smoked in her home. They agreed, we were all on the same page. On XX/XX/2023 my brother-in-law received a text message that they wanted to by his foreclosure house in XXXX, CA. What?!?! I immedately called the XXXX XXXX Co ( XXXX ) and they advised me that they had foreclosed on the home as of XX/XX/2023. I felt as though they were rude and not concerned about helping me, they saw no urgency. On XX/XX/XXXX I called on a three-way call with my Attorney on the phone. They did not want to give my attorney the balance, the attorney contact info, nothing. Uncooperative. On Saturday XX/XX/XXXX I went to my mailbox and there were 20 " packets '' of information all with foreclosure/default filings from the court. Each and every packet is post-marked XX/XX/2023 - two weeks after foreclosure was filed. I feel as though they are trying to swindle me. They have all my contact information, yet no one ever reached out to me in regards to foreclosure. They have ALL my contact info.

Finance of America loan # XXXX for XXXX XXXX My Father passed away on XX/XX/2021. We have been trying to contact these people for over 1 month, only to be put on hold. and no one answers. We have emailed them the death certificate, affidavidat of heirship. listing agreement, and Letter off intent, etc. per their certified letter stating we have 30 days from XX/XX/XXXX, ( XXXX XXXX ) to cure the default, or foreclosure. I was working on getting approval for a reverse mortgage on my condo from Finance of America-Reverse ( FAR ), when they introduced a new document to be signed and notarized by my neighbor, who has no interest in helping me to get a reverse mortgage and would not sign such a document. Essentially, FAR gave my neighbor the power to deny me a reverse mortgage. I dont believe FAR was acting on some hidden reason and deliberately trying to deny me a reverse mortgage by introducing this new requirement. They explain their reasons for it in the attached email, given the situation where my condo is one unit of a 2-unit condominium building, and my neighbor owns the other unit. Nevertheless, the way it worked resulted in denial of a reverse mortgage for me, based upon nothing but the whims of a disinterested outside party, my neighbor. Further, FARs new document was superfluous. My neighbor was already bound to everything in it by the XXXX XXXX XXXX of the condominium, a copy of which FAR had been given, plus a separate agreement regarding a split of utility costs, which was forthcoming.

I have a hard inquiry on my XXXX account from XXXX XXXX on XX/XX/XXXX which I called them back in XX/XX/XXXX, They said they are a third party and the company that told them to pull is Finance of America LLC, and gave me their phone number and the representative to speak with. I called the number and the business said they would have the representative give me a call back to discuss. No one ever called me back. Today, XX/XX/XXXX I have tried calling XXXX XXXX again and their phone number is no longer in service, I called the number they gave me for Finance of America LLC and the calls go straight to voicemail. I look on my XXXX account and see a hard inquiry for the same date, XX/XX/XXXX under a different third party, XXXX, so I called them and they said again they are a third party for the same company, Finance of America LLC. I told them about my XXXX inquiry for the same thing and that I DID NOT authorize this inquiry. XXXX said I could file a dispute through their email but that is only for the inquiry on the XXXX account and not for the XXXX inquiry.

Through our divorce filing an audit of our prior tax returns and personal files, it was discovered that there were several refinances and purchases to gain additional commission and compensation that affect our joint tax returns. These included refinances for his brother and other children. On XX/XX/2016, my husband and his loan officer were involved in mortgage fraud by closing a loan for his son that was intended to be an investment property and not owner occupied. There is documented proof that the purchase loan given to his son was intended to gain a lower interest rate by submitting the loan was owner occupied when in fact the family member never intended to live in the subject property and was living out of the country. There are documents which show the property was listed for rent on XXXX XXXX List 30 days prior to closing the loan and tenants were moved in on the day of closing. I am bringing this to your attention in hopes a full investigation will be conducted with the FBI.

XX/XX/19 letter from reverse mortgage company that they need wind/hurricane coverage for our property. They already have a copy of the homeowner 's insurance as part of the loan process, which covers this. XX/XX/19 letter from reverse mortgage company they will charge us {$5600.00} for wind and hurricane coverage. XX/XX/19 XXXX 's XXXX sends another copy of our homeowner insurance with confirmation that it covers wind and hurricane damage. Finance of America has not sent confirmation that they received the insurance information and that it is acceptable, so we do not know if we are going to be charged {$5600.00}. My concern is this is a scam to charge a horrendous amount for coverage that already exists. They are taking advantage of old people who might not be fully able to wade through all of the details, and bing, {$5600.00} gets charged!! The entire homeowner insurance only costs us {$3600.00} and that covers much more than wind and hurricane damage.

Informed them I had good credit however, my identity was stolen after I retired. I submitted every document to prove this horrible experience. There are stacks and stacks of paperwork I have received from Urban Financial. I have been patient with this company since XX/XX/2015, but they are still stringing me along. I have been upfront with since Urban Financial, they contacted ME for my business. When I was looking for a reverse mortgage and guarantee this was not a problem and have me APPROVED in a few weeks. In 2011 my husband took out a reverse mortgage with Urban Financial Group. We had 2 residences on one piece of property and it was recommended that we sub-divide the property so that each residence was separate. We did this and after completion, closed on the mortgage. The second residence was put up for sale last year and when the buyer did a title search it was found that the wrong property was on the mortgage. This was last XXXX. During the course of the loan with Finance of America Mortgage, when gathering documents, the loan agent would repeatedly not respond for days at a time and then rush us to gather certain documents. One particular item was mortgage statements for a rental property that I own that she wasted a whole week going back and forth about documents on. On the date we were supposed to close the loan after our second extension, the same loan agent deliberately lied when we told her we needed to close and sign that day, which she knew because she was provided with all of our extension deadlines. She claimed we had an additional extension from the seller which was 100 % false ( the seller even said so in an email ) to further delay the close of our loan which would cause us to lose our deposit for not closing the loan in time.

Lender at Finance of America approved a loan for a buyer of my property. Lender inspected property and stated only contingency was putting in a railing before settlement date. Two weeks after the inspection and three weeks prior to settlement the lender determined the buyer 's credit was not suitable for the loan. Loan officer - NMLS # XXXX had mis-represented the buyer and lied to the seller. Credit history had not changed since the sale agreement. The loan officer should not have approved the mortage at the time the sale agreement was signed. Several real estate agents stated the lender did not understand the Mortage process and was the worst loan office they have ever dealt with in their 20 years in the Real Estate business. We negotiated a reverse mortgage with Finance of America. The specialist we dealt with was XXXX XXXX. After agreeing to terms, we signed the necessary documents and were given a 3-day grace period to change our mind, after which the initial payment would be wired to our bank account. Although we signed everything as requested, the money was never transferred. Instead, we received an email from the company indicating that they made an error with the application and that they could no longer fund the loan. The error was a very simple arithmetical error on their part ( not ours ) and we were unaware of it ( it was not included anywhere in the documents we signed ). We are now in limbo and may face significant financial hardship as a result, with outstanding bills due.

Im looking to buy a house and have been working with a lending company. In XXXX they pulled my credit with my consent and provided me with a pre approval.
