I recently pulled my credit report from your Bureau and my attorneys and I had a chance to go over my credit report and in amazement, that you have decided to report me 30 days late on this account in XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. I immediately disputed this information with FIG TECH INC and the results of the investigation came back " verified ''. Not only was I never late on this account, but according to the Fair Credit Reporting Act ( FCRA ), the information furnisher is required to notify me of the insertion of negative listings. Since I have disputed the lates with the creditor, and you obviously " verified '' them, I am very curious as to what kinds of " records '' you may have for this alleged account. I am very confident that you are in violation of the ( FCRA ) and ( FCBA ) sections ( 1666, 1666a. 1666b., and 1666c. ) as stated below : 1666. Correction of billing errors ( b ) Billing error ( 4 ) The creditor 's failure to reflect properly on a statement, a payment made by the obligor or a credit issued to the obligor. Because I take my credit very seriously, I contacted every name and account that was listed on the report. I was again very shocked by the multiple names, account numbers and figures. Included with this letter, is every letter written to those who have hampered my ability to obtain credit. I believe that any judge that looks over the report would agree that it is a violation of both the FCRA, CCPA and FACTA. The following accounts were listed on your report and I have demanded from them a full accounting and five years worth of records to see if their accounts were in violation of the FAIR CREDIT BILLING ACT ( FCBA ). We also demanded signed contracts, agreements or any legal paperwork that would tie us to the following accounts. Under the FCRA, you are required to conduct an investigation on this account if I request it. I DEMAND to see all 100 % verifiable proof that I was indeed Verifiably late on these accounts and the creditor fulfilled its obligations under ( FCBA 1666 ( a ) ( 2 ) ), As I was never notified of a billing delinquency on my accounts, which the creditor must do under section ( FCBA1666 ( b ) ( 6 ). They had claim in their response that they saw my calls on their main phone, but did not have staffing available to take my call, as they normally respond within two hours. In regards to Fig Tech account XXXX. Fig Loans ( different from Fig Tech? ) began contacting me on XX/XX/XXXX asking me to make payments on a debt that I know nothing about, and does not belong to me. I responded to the text message " stop '', to which I got confirmation. Then, on XX/XX/XXXX, I got another identical text message from a different number, to which I replied " stop ''. Opt-out is to take effect immediately, and subsequent messages after confirmation of opting-out are a violation of the TCPA and subject to damages of $ XXXX {$1500.00} per text message. Fig Loans sent two additional messages. 1st Violation : TCPA via 47 USC 227 - supported by court case precedent of XXXX v. XXXX XXXX ( XXXX ) and others. I have never been contacted by Fig Loans before these messages, and FDCPA requires creditors : Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing -- ( 1 ) the amount of the debt ; ( 2 ) the name of the creditor to whom the debt is owed ; ( 3 ) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector ; ( 4 ) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector ; and ( 5 ) a statement that, upon the consumer 's written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor. I have received not other contact or details to date. 2nd Violation : FDCPA via 15 USC 1692g Upon further investigation in to my credit report, I see a " Fig Tech '', but I am being contacted by Fig Loans. This lends to question as to who the alleged creditor is. This is deceptive, and misleading. 3rd Violation : 15 USC 1692e Neither Fig Tech, nor Fig Loans has a surety bond in the state of Texas. 4th Violation : Section 392.101 of the Texas Finance Code prohibits a third-party debt collector or credit bureau from engaging in debt collection in Texas unless the third-party debt collector or credit bureau has obtained a surety bond and filed a copy of the bond with the Office of the Secretary of State. Fig Tech is not a Licensed Regulated Lender, nor a Credit Access Business in the State of Texas. 5th Violation : FINANCE CODE TITLE 5. Sec. 393.101. FCRA requires that furnishers establish policies and procedures to ensure accuracy and integrity of information. Fig Tech is reporting this account as being opened on XX/XX/XXXX to XXXX, XX/XX/XXXX to XXXX, and XX/XX/XXXX to XXXX. In addition, the date of last activity is being reported as XX/XX/XXXX to XXXX, XX/XX/XXXX to XXXX, and XX/XX/XXXX to XXXX. Payment history is also being recklessly reported, showing no payment received to XXXX, payments received in XXXX and XX/XX/XXXX followed by late payments XXXX and charge off to XXXX, and payments in XXXX and XX/XX/XXXX with late payments XXXX to XXXX. Date of last payment is being reported to XXXX as XX/XX/XXXX, with no other last payment date. This is clearly predatory and deceptive, or negligent at best. 6th Violation : 12 CFR Appendix E to Part 1022 - Interagency Guidelines Concerning the Accuracy and Integrity of Information Furnished to Consumer Reporting Agencies 7th Violation : Prohibition on Reporting Inaccurate Information. Section 623 ( a ) of the FCRA Finally, considering that Fig Tech or Fig Loans is very clearly violating my rights, and this disputed information is inaccurate and can not possibly be verified, I kindly ask that this account is promptly deleted from my credit report, and that any collection efforts cease entirely. I find it comical that between figtech.com and figloans.com, I see a mission that touts eradication of predatory financial systems, but the other is offering loans that have an APR of 199 %. They clearly don't have proper documentation processes in place, and they don't seem to care who's credit their false reporting is ravaging. This company is straight GASLIGHTING the public. They did not send me any statement 's regarding this loan, I have not received any documentation pertaining to this loan, Yet fig is under the impression I OWE THEM FOR A DEBT they sent to some thief. 4. Fig Loan 's continues to FALSELY report the loan on to my credit report stating that the loan is deliquent and it increases each month. I never received any monetary benefit from this loan, and I refuse to pay something I didn't authorize. They never confirmed it was me applying for it. If they had I would have advised it wasn't me. My payment date for my loan was XX/XX/XXXX. I was unable to make a payment via XXXX and tried via debit card for a couple weeks as their website was not showing all images and buttons to continue to payment, preventing me from making the payment via debit card instead of XXXX. It wasnt until I received an email from Figloans on XX/XX/XXXX saying that I needed to make a payment that day to prevent my account being reported as 30-days late with the credit bureau via a link to the debit card screen was I able to finally make the payment via debit card instead of my bank account and I made the payment right away in full. Soon after I made the payment, the account was reported 30-days late to the credit bureaus. I then reached out to figloans gia email as they do not have a phone number to talk to anyone letting them know that an error was reported on my credit report and it needed to be fixed ASAP. The answer I received was that they only report accurate information to the credit bureaus and theres nothing I can do to change that. I then email back with my pay schedule showing that my due date of XX/XX/XXXX payment was late, but it was not late 30-days, so they were reporting inaccurate information to the credit bureaus. I also forwarded the email I received that advised me to make payment that day to prevent negative information from being reported to the credit bureau. They have gone silent since then. Im trying to buy a house and this has significantly impacted me and my familys lives as Im now at a stand still until this issue is rectified. In addition, under the cares act- creditor made an accommodation which prevents late reporting on any account 15 U.S. Code 1692C -communication in connection with debt collection PAYMENT EXTENSIONS WERE OFFERED PRIOR TO THE STATED DUE DATES therefore your company can not base any payment dates as late from their original due date when you agreed to extend or defer those due dates. This is why your reporting is not only erroneous but also fraudulent. You can not manipulate your own agreement in order to negatively and maliciously report false data. The minute an arrangement was made prevented any account to be reported as late. I contacted company to request that they not only correct the erroneous late reporting but to also update the balance on the prior paid off and closed account. I was offered a short term loan via email communication. I've dealt with them before, so took the loan. The monthly repayment was {$100.00}. My first payment was due in XXXX, which I made a double payment prior to the due date and was given a new due date of XX/XX/XXXX for my next payment. Fig Tech Inc ( XXXX ) is reporting derogatory information regarding a loan account to ALL XXXX of my credit bureaus. I mailed Fig Tech Inc certified letters requesting a signed contract for this account. When I did not receive a response I followed up and called Fig Tech Inc . Fig Tech Inc claims they never received my request even though the tracking number for each certified letter indicates both certified letters have been received. I have made both written & verbal request for a signed contract for the loan account account. Fig Tech Inc refuses to send me the request signed contract. The only thing Fig Tech Inc has provided to me were outstanding monthly bills & a general Customer Agreement not specific to the loan account they are reporting to my credit file. In fact it is the same general Customer service agreement they have listed on Fig Tech Inc 's website, the website also makes reference to there being a loan agreement for " your accounts '', which I am assuming that there should be specific terms agreed upon for each account specifically. I spoke with a customer service agent & she stated not all accounts have signed contracts & she could not provide me with one for the reported loan account. I asked " if there is no signed contract outlining the specific terms to either account how did a agree to something blindly? A scam artist came across my social media profile online. His name is XXXX XXXX. He works for the United States Military and demanded my information after I declined several times he sent me pictures of him holding military graft firearms. He asked for my drivers license, address, school, bank information, and social security number. He began applying for credit cards to use at his discretion under my name. When I saw text messages from some of the companies I told him to stop applying under my name but he refused. He even went so far as to forge my signature and tried to provide them with copies of my personal documents such as drivers license, etc to make the companies think it was actually me applying for the accounts. I was charged for an amount by Fig Loans that later reported the fraudulent credit late on my credit report. This lowered my score along with all of the credit card company applications that fraudulently applied for by identity theft. Fig loans also billed my personal bank account and never refunded me the amount. I tried calling the company but they never answer. I also tried emailing them but when I did they stated they did not have my information in their system. This is contradictory to them reporting late payments in my credit report with my information.

During the course of this loan, communications from the company were being supplied via two different emails causing important notifications to be sent into my junk/spam folder and missed. The dates of my repayments were modified and set without my review or approval. In my attempt to pay a day before my payment was due, it would not allow me to as it was already processing. Another time it said I was passed due. Making it difficult to actually make payments. But the real and what I consider the biggest issue, is that when I was unable to make my payment because their system wouldnt allow me to ( and it would have been paid a day early ) ; it was after that they issued an email stating WE LEGALLY CAN NOT PULL THIS PAYMENT FROM THE ACCOUNT ON FILE. ( We can pull future payments. ) needing my authorization to withdraw the funds! An authorization I NEVER gave!! However, 2 days after that email they took the money out. I took out a loan in XXXX with fig loans. It had four payments due, which I made all of the payments. They claim I still owe {$130.00} and have been reporting this is past due and charged off on my credit report cents. I have contacted all three credit bureaus, XXXX XXXX and XXXX XXXX to dispute this. When they investigated it fig loans continued to verify that I was past due and did not make the last payment. I have disputed this directly with big loans as well and provided proof through my bank statements that for payments in the amounts due were paid. They continue to try collection efforts on me, and tell me that their verification shows that one check was not cleared and bounced. Obviously through my bank statements it shows for withdraws from my checking account over four months, and this proves that I do not owe them any money. On the morning of XX/XX/XXXX I got a notification that fig loans reported a late payment to my credit report dropping it XXXX points. I contacted them to be told no payment is due till XX/XX/2021. Then on XX/XX/2021 the same thing happened again. Another late payment was reported to my credit report. I reached out to fig again to be told that Im not due until XX/XX/2021. Then I demanded that fig XXXX remove the late payment off my credit report and they refuse then after I told them I will be contacting CFPB, XXXX and my attorney if this wasnt fixed. Then they emailed me back saying my payments are late and that once its paid off they will remove it from my credit report. All the information is the complete opposite of what I was told previously and today. Fig loans still refuses to remove the late payments off my credit report.

Back in XXXX of 2021, Fig loans dispersed a loan in the amout of {$400.00}. I get an email stating my account numbers for paying said loan were incorrect. I informed them at that time that I didnt take out the loan, and thats why the numbers were incorrect, and obviously it was fraud.
