Vice Pres XXXX and XXXX XXXX of Fidelity Direct Mortgage ( FDM ), LLC XXXX XXXX XXXX XXXX XXXX. XXXX XXXX - XXXX, MD XXXX AND - XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, OK XXXX This complaint is about origination issues and the servicing of FHA loan by FDM and XXXX XXXX XXXX ; and the telephone message threat by FDM attorney XXXX XXXX, to begin foreclosure proceedings on property on XX/XX/2018. These mortgage companies are federal contractors of HUD/FHA and representatives of federal standards and expectations of fairness. The FHA loan # XXXX ; and per the conversation with the XXXX FHA/HUD Office the case number indicates that the loan has been insured since XX/XX/2018. The loan was initially serviced by FDM and sold to XXXX XXXX ; and then sold back to FDM for re-servicing ; which ; appears to be very suspicous and highly questionable concerning unethical referrals and fee splitting. Senior VP of FDM, said XXXX required FDM to buy back loan because of incomplete paperwork. ( email : XXXX ) It has been since XX/XX/2018 that FDM has been saying that the loan is under review for foreclosure by HUD. The Senior VP of FDM, XXXX has intentionally misrepresented the truth to increase stress, pain and suffering ; intimidate and threaten with the following emails : 1. Mr. XXXX, HUD is NOT accepting the loan without confirming the deposit. XXXX will probably ask us to buy the loan back and we will ask you. Mr. XXXX, I am requesting that you avoid all that unnecessary back and forth and help us clear this and insure the loan with HUD. ( email dated XX/XX/XXXX ) 2. We need HUD to insure your loan ... They came back and asked us about a XXXX deposit and we requested that from you ... We are actually trying to stand by you and not have the loan go in to foreclosure due to HUD not insuring it because you refused to provide a requested document ..., HUD is requesting ( email dated XX/XX/XXXX ) 3. HUD has escalated the case and FDM underwriter is working with HUD ( email XX/XX/XXXX ) The XXXX agree, according to Article 8 of the Compliance Agreement - to fully cooperate in adjusting for clerical errors on any and all loan closing documentation deemed necessary or desirable in the reasonable discretion of the Lender to enable the Lender to sell, convey PLEASE NOTE that XXXX have complied to complete business of the closing and sell of the loan ; and that on XX/XX/XXXX FDM was given direct access to XXXX bank account. And without previous notice or approval FDM changed the XXXX Bank account password. Re : IP ADDRESS FDM appears to be attempting a cover up : Phone message XXXX FDM XXXX XXXX beginning of pressure and stress ; we would like to process another loan for you. Threat and intimidation by FDM Atty XXXX XXXX - Phone Message XXXX I will begin foreclosure proceedings on Monday XX/XX/XXXX ; if I dont hear from you by the end of today. Supported by email of Senior VP XXXX on XXXX Stating : Mr. XXXX we have your loan back. Your payments are going to be due to us now. Please confirm that you have received correspondence from XXXX. Accounting please advise (? ) the payments to FDM. Mr. XXXX, XXXX will be sending out letters to you as to what to expect next. Please note that this has happened because you decided to not respond to our request for explanation of large deposit. Please also note that you had agreed to do so when you signed the loan documents. Mr. XXXX, I have a better loan for you at this time for you and I can refinance out of this Please email or call back so we can help you get out of this. Supported by email of XXXX from SR. Vice Pres XXXX ; Mr. XXXX , Please call or email. All we are trying to do is make the situation better for you. Your payment will drop in Conventional refinancing and it will NOT cost you any closing costs. PLEASE NOTE : XXXX have not received a welcome package from FDM that includes the payment amount, date due and options to pay. While looking for homes I found what I believe was a perfect match for my family I put in a contract on the home based on what my lender at fidelity mortgage told me I could afford. My contract was accepted at XXXX. Then I was told to do inspection which costed me XXXX $ and later that same day was told I needed to pay for appraisal which was XXXX XXXX The seller now agreed to give me 6 % sellers help which at that time made me not able to get the grant help that I was receiving and I had to bring more money to the table but the deal was sealed. The day before I was scheduled to close on the property my realtor was sent preliminary atla and the figures where incorrect at that time I reached out to my lender and he assured me that was an error and it wont affect my closing for the next day. Boy was that furthest from the truth not only did he lie but now Im over the threshold for purchasing but he should have never approved me for that amount the deal was stopped in its tracks. Now Im out XXXX $ base on lies. Im stuck on a month to month lease paying XXXX $ base off of lies. The hardship that I endured from this mortgage company no one deserves please what can be done.

On XXXX XXXX, Fidelity Direct inquired about my credit with out authorization.

I need this inquiry removed from all three credit agency reporting systems.

Again, this inquiry was not authorized. I also, want a letter of deletion sent to me for my future records.
