The enclosed undersigned private man, one of the people, a natural resource and the full faith and credit of the United States, protected under Article III section II of the Constitution for the United States of America, with a legal identity known as a Consumer ( natural person ) pursuant to 1692a ( 3 ) of the Fair Debt Collection Practices Act, has received two unwarranted illegal communications from debt collector FENTON & McGARVEY LAWFIRM, P.S.C., specifically from a man named XXXX, dated XX/XX/2016. Together, XXXX & Fenton & McGarvey failed to obtain prior direct consent from the consumer or permission from the appropriate court of competent jurisdiction ( Federal ) to communicate with the Consumer in connection with the collection of any debt pursuant to 15 U.S.C. 1692c ( a ) .The debt collector is not within the United States [ UCC 9-307 ( h ) ] & attempts criminal theft of property against the federally protected Consumer by engaging in identity theft, having illegally obtained my private/confidential, personal, & protected identifying information for its own financial profit and gain. The Consumer has filed an identity theft report with the Federal Trade Commission under complaint # XXXX. The debt collectors communication constitutes theft of the Consumer 's intellectual property & serves as an invasion & trespass of the Consumer 's legally protected interests which are concrete, particularized, & injury in fact, pursuant to 15 U.S.C. 1692k ( a ) ( 1 ) and enough to invoke Consumers Article III standing & jurisdiction. Damages have been assessed against the debt collector in the amount of {$10000.00} per communication, ( x 's 2 ) totaling {$21000.00} for the debt collectors criminal, fraudulent, & deceptive debt collection practices agaInst the Consumer and the Consumers ' household members. In both of the communications advanced by the debt collector through the United States postal service, the debt collector has failed to identify any specific account that the alleged debt is an item of. The debt collector only provides a file number, the name of an alleged creditor, and an amount due, without reference to whom it is owed. The debt collector has clearly failed to obtain & provide to the Consumer pertinent, verifiable information, including a judgement, in regard to any alleged debt & account, prior to advancing both communications, which are meant to harass, oppress, confuse and abuse the Consumer. The Consumer and members of the Consumers ' household have undergone an immense amount of undue mental and emotional anguish in attempting to decipher this unintelligible, profane, obscene, & frivolous communication that has been advanced upon the Consumer. The debt collector is attempting to draft the Consumer ( a natural person ) for performance by giving the Consumer " 30 days '' to dispute, which is another word for argue or debate, the validity of the alleged debt in writing. The debt collector has notified the Consumer that failure to respond within the allotted time would allow for the collection firm to assume the validity of the non-existent alleged debt. Although the Consumer has no duty to, nor is the Consumer under any obligation to respond nor engage in any frivolous argument ( s ) with this attorney owned debt collection firm, the Consumer has been left without choice. To avoid any further injury to the consumer, and to protect the Consumers interests, the consumer has chosen to respond to the debt collector under threat, duress, & coercion for the purposes of notifying the debt collector of its illegal and damaging actions against the Consumer & Consumer 's household, & allow the debt collector one opportunity to verify and validate their allegations.

My identity theft began in XX/XX/XXXX with a fraudulent mail forward request. My apartment leasing office claimed I had moved and changed my mailbox lock. Many of my account statements were forwarded to a new, unknown address for XXXX months. After this was corrected I thought nothing more of the incident. In XX/XX/XXXX I moved to another state and began being denied new credit XX/XX/XXXX. I joined XXXX and enrolled my entire family ; I also requested copies of all XXXX credit reports. XX/XX/XXXX I was served a court summons for a {$19000.00} credit card delinquency which was not mine. I immediately filed a police report and began to thoroughly review my credit reports. I was shocked to see numerous names, addresses, ssn 's, and accounts/debts which I did not recognize. I filed an affidavit with the FTC and began the time consuming process of preparing and sending debt validation letters via certified mail to all erroneous accounts requesting validation. XX/XX/XXXX I received another court summons and hired an attorney to assist me. In addition I disputed all inaccurate entries on my credit reports with the XXXX agencies. By XX/XX/XXXX I began to see an improvement in my credit reports and credit scores. My attorney was able to have both of my court cases dismissed for lack of evidence and validation. XX/XX/XXXX I was once again served a court summons. I appeared in court that Summer and was given a new court date, XX/XX/XXXX. I questioned the collection agency rep about the date since I thought it would be very odd for the courthouse to be open on a federal holiday. He assured me that was the correct date. I gathered all of my identity theft documentation and requested validation of the debt via certified mail. I never received validation nor did I manage to speak to an anyone at the collection agency to once again question the next court date. On XX/XX/XXXX, my husband and I drove to the courthouse only to find the doors locked and a sign reading that the courthouse was closed due to XXXX. I did not receive any further communication from the collection agency and I did not see any further evidence of the debt on my credit reports. I was quite surprised last year to discover that a judgement had been filed for the debt while I was refinancing my home. I sent the mortgage lender my identity theft documents and the judgement was dismissed, or so I thought. A month ago we decided to buy a new house and this same judgement, which has never appeared on any of my credit reports, was discovered by the title company. I have once again forwarded all of my identity theft documents and the attorney for the title company and the creditor have advised the creditor to file for removal of the judgement from my record due to the evidence of fraud I have provided. Almost two weeks later, the creditor has still not filed to remove the judgement or provide a payoff statement/amount. I have looked at the court proceedings online and of course the collection agency gave me the wrong date to return to court. I was supposed to appear on XX/XX/XXXX, not XX/XX/XXXX. Since I did not know the correct date and did not appear a default judgement was issued. I can not close on the new house until this matter is cleared and so far the creditor/collection agency is not responding to the attorneys request for dismissal or providing any justification for their lack of cooperation. I am living in a hotel with my family and pets because my other home was rented earlier this month and I am still waiting to close on the new home.

This is regarding a collection account with the collector XXXX XXXX. The original creditor was XXXX XXXX XXXX They have sent me a letter through Fenton Law Firm from XXXX XXXX.
I received a civil summons from Fenton Law Firm on behalf of XXXX XXXX months ago. There were no instructions on how to respond to it or who I could respond to. I sent an email to the law firms email address that was listed on the paperwork. They did not respond to me after many attempts to email them and follow up over a period of weeks and weeks. I then received a notice that a civil judgment had been filed against me with my local court. I had no idea how I was supposed to prevent this from happening and the law firm did not respond to my requests for assistance in settling this " debt ''.
The debt they are collecting is not fair. I paid more to XXXX XXXX in payments while that credit account was open than I ever charged to the card. The " balance '' they are claiming I owe consists of only unfair and excessive fees imposed on the account by XXXX XXXX. None of that balance is reflective of money I had actually charged to the account. The ridiculous fees they added to my account was the only reason there was any " balance '' remaining at all. They had me in a vicious cycle of repaying fees month after month and I was n't even paying for anything I had charged at all. This should not be allowed. I paid them much more than I ever truly owed them. I can document this with statements if needed.
Fenton Law Firm sent me a letter last month requesting a settlement amount of XXXX. It was sent from XXXX XXXX and listed her email address. I attempted to email her directly to explain what I have explained about but did not get a response. I have emailed her XXXX times. I do not wish to have any communication with them that is not in writing so that it can all be documented. I feel like they did not respond to my initial emails on purpose so they would automatically win against me and have the judgment lien placed. I offered them in my email to settle this for XXXX just to have it taken care of, even though I feel this debt is completely unfair and unfounded. This collection account has been detrimental to my credit for years now and I ca n't repair my credit until I get this taken care of. They have not appropriately communicated with me so that we could come to an agreement.

on XX/XX/XXXX XXXX XXXX credit card collection agency-XXXX settled the debit owed by me along with my lawyer to {$12000.00}. see attached settlement letter. Since then I have regularly paid the said amount to the debit collector. later this debit collection was taken over by Fenton McGarvey Law firm. The payments were made to this debit collector. The final payment was made on XX/XX/XXXX. a total amount of {$12.00}, XXXX was paid to the debit collector ( see attached bill payment statement from XXXX XXXX XXXX ). I have paid an excess of {$80.00}. since XX/XX/XXXX after the final payment was made i called XXXX office many times and requested a XXXX balance letter, refund of my excess payment, and report to credit bureaus as fully paid. NONE OF THIS HAPPENED FOR THE PAST MONTHS. I have called XXXX debit collector and emailed XXXX and Fenton Mcgarvey several times more than 20 times with the attached settlement agreement sent by XXXX and the total amount of payment made to the new debit collector. See attachment of email from me and my attorney. XXXX sent me a credit report which states that there is one negative report on my report. I disputed it with XXXX. but they came back with the same resolution that I still owe {$3700.00} as of XX/XX/XXXX. THIS IS INCORRECT. XXXX XXXX CC IS ROGUISH FINANCIAL COMPANY THAT PREYS ON POOR PEOPLE AND MAKE UP FRADULENT CHARGES. THEY MUST BE TAKEN TO TASK AND MADE TO PAYBACK MY EXCESS PAYMENT, and fix my credit report immediately. I am applying for a home mortgage to refinance my home which is going under foreclosure. but this negative report and dishonest loan balance reported by XXXX XXXX is severely affecting my mortgage loan application. I humbly request the CFPB staff to take immediate action and order XXXX XXXX to remove the inaccurate credit reporting. see attached files from XXXX report on XXXX XXXX CC and supporting evidence that I have paid the loan as per settlement agreement.

I had opened an account with XXXX XXXX and had charged over {$1000.00} roughly a few years back and I had contacted them and worked out a payment arrangement for {$400.00}. Last year when I checked the credit bureaus as we were going to refinance for a better rate. The account was closed and charged off. No I failed to get proof. Three weeks ago on XXXX, I was served with a Civil Summons as I was named as a defendant in a suit for the amount of {$740.00} as the account was bought by a debt collector. I received no notice, only served with a court date on XXXX. I am XXXX with a XXXX XXXX injury and will go to court as my name is on the affidavit, and I abide by the law. As I was preparing rides, times, and documents I read the Civil Warrant that I was served with and they are also seeking Court Costs. I am on a fixed income and due to the XXXX in XX/XX/XXXX at an early age in which I had just started my career after spending years getting a college degree and was ordered by a judge XXXX XXXX XXXX despite my pleas. My medical bills take more than I draw. However, I noticed that the Attorneys for the Plaintiff, one in XXXX KY and the other stamped on the court document is with a PO Box in XXXX. I also noticed on the attached Affidavit that is from the State of Texas County of XXXX and the Custodian of Records for the Plaintiff, a XXXX XXXX XXXX employee assigned to the Account who does business at XXXX XXXX XXXX in XXXX Virginia under penalty of law attests that I Owe the company she works for the sum of {$770.00} as of XXXX but claims the sum of {$740.00} is due as of the date of the affidavit. Her name is stamped in 2 places in the state of Virginia and Notarized in Texas that the Signatures were signed under no duress by the company who employed her. The court I have to go to is in Tennessee also. This is the 2nd time I have had to go for these bogus charges and the last one that the date was set by the attorney did not bother showing up and the judge called them to rescheduled and said they had forgot. They set the date. I am so tired, stressed and honestly sick and tired of the games these people play unfairly!

On XXXX XXXX of 2016, I called Fenton and McGarvey Law Firm, hereafter known as " the company '', and asked for assistance in figuring the final payment amount for my account. The representative told me the payoff amount and provided me instructions for how to pay the account off online as I was not in a position to provide payment information at that moment. Before the contact on XXXX/XXXX/2016, I had a payment arrangement with the company that consisted of a monthly payment of {$64.00}. When speaking to the representative, she confirmed that my monthly payment arrangement would automatically cease when the account was closed out. However, on XXXX XXXX, 2016, a check was sent to my bank for cashing from the company in the amount of {$64.00}. I called the company on XXXX/XXXX/2016 and was told by the representative that I spoke that they were aware of the error but would not return payment until XXXX. When I asked to speak to the supervisor, the representative told me he was unavailable and that it was " my fault '' that payment was taken. She informed me that due to the fact that I paid it off online, they were not able to cancel the monthly arrangement. This was after being on hold and listening to their IVR inform me " For faster service, please pay online '' I told the representative that it was unacceptable for them to place blame on me and demanded to speak to a supervisor. After being place on hold, I was routed to a XXXX XXXX and placed on hold for 10 minutes. When he returned, he said they needed proof that the additional funds had been removed from my account ( after the previous rep confirmed that they knew there was a payment overage and would be resolving it ) I offered to send a copy of the electronic check and the line from my bank statement to resolve the matter before XXXX. It feels incredibly invasive to be asked to provide this information when they were able to confirm an over payment had been made. The company has violated the FDCPA by engaging in unfair collection practices by removing an amount more than what was owed.

I originally obtained a loan through XXXX for a XXXX on my home. I went into collections and my loan was given to the law office of XXXX XX/XX/XXXX. I have been making payments to Farrell & Seldin for years and within the last few years, they changed to Fenton & McGarvey. XXXX was bought out by XXXX and I have been communicating with them but it is short as they tell me the law firm handles everything. My husbands name and mine are on the original loan with XXXX and XXXX however, only my name is on the loan with XXXX/XXXX XXXX XXXX. Every month we make a payment we ask for a breakdown of all that has been paid and all that has been charged along with details ... we still have not received this and the law office keeps telling me that my husband is not on the loan ... it is a second on our home, he has to be. On XX/XX/XXXX I had a detailed half an hour conversation with XXXX at the law office and I stated that it is my right to receive a complete breakdown of my payments and charges. I requested this again on XX/XX/XXXX ( when I made my payment ) and I still have not received what I have asked for. Each month, I get a verbal amount that is different than my calculations ( and I verified with XXXX that my payments are all going to principal ). XX/XX/XXXX, my husband was able to get a verbal figure from XXXX ( at the law office ) and at that time it was {$2800.00}. I make a XXXX dollar payment every month and have for years and as of my last payment, I still owed just under XXXX dollars ( XXXX ). I do not want to give them any more money until I have the complete history from them on my account.

I was told to send in my bank statement so they can see that I check did clear. I sent my information on XX/XX/18. I was told that they were going to garnish my bank due to a returned check on XX/XX/18 and I made a payment on XX/XX/18 to make up for that payment. So I was sending my statement to avoid garnishment. I called XX/XX/18 to check on the status of not having a garnishment because of this returned payment because I sent a cleared one. XXXX a representative stated that I had a garnishment on my bank account since XXXX of XXXX. Because I made a payment of XXXX and another one for XXXX. I have been sending in payments. I did not know of any garnishment until XX/XX/18. I told XXXX she did not know her job. I wanted to avoid a garnishment so who can I send the payment to? She stated that my bank is going to be garnished anyway so no point to send a payment. XXXX than called me right after I hung up because she felt the need to harass me at XXXX XXXX pm. After I hung up on her. Why garnish my check when I have been making monthly payments. I know it is unfair. I was served to appear to respond to a credit card debt owed.
I never received a failure to appear from the court in a amount that was incorrect. I was informed by a Law firm that a judgement was rendered in the incorrect amount and I authorized them to with draw from my checking account a amount that I could only handle for seven months. The law firm would not accept a lesser monthly amount. The original loan was {$1900.00}. I paid to XXXX XXXX {$700.00}.
XXXX sued me for the arbitrary amount of {$3200.00}. I paid the Law firm {$700.00}, which brings my amount to {$2200.00}. Despite paying {$1400.00} on a original loan of {$1900.00}. This is my second complaint concerning this practice of playing loose and fast with the process.
Last week I called XXXX XXXX XXXX XXXX. They had no knowledge of any of my dollar amounts and told me to call, Fenton & McGarvey Law Firm, P.S.C. Each of those collectors told me too call the other collector. No one would offer any advice other than wait for my bank to contact me.

My wages were garnished. I called XXXX to dsicuss the account as I was unaware of this action. The debt is from 2008. I was told that if I paid it in full that day on the phone, that they would return the XXXX back to my employer and that the garnishment would be released. They took my XXXX payment in full electronically from my account on XXXX. They have steadfastly refused to return the XXXX taken on XXXX and on XXXX another deduction was take from my check. This company will not release the XXXX funds to me for 21 days, and then stated they will hold the second issued to them ON XXXX for an additional 21 days despite the fact the account is paid in full. They are hold XXXX of my money causing me financial and mental duress.
It is important to note- XXXX told me on XXXX that if I paid this in full that the XXXX would be returned to my payroll department and given back to me. They have recorded lines. He lied, they did n't return they cashed it, and now have cashed another and are holding the funds.

Never received correspondence from XXXX, XXXX XXXX? ( Thats what I recently learned it was called ), didnt receive correspondence from XXXX XXXX. I received no notice of anything until all of a sudden I received a letter from Fenton law firm asking for payments, I sent in a little here and there, not even two weeks later I receive a letter in the mail that I have a court date in XXXX and am being sued. I called Fenton to straighten it out and figure it out outside of court and made a {$50.00} payment on XX/XX/2017 because they said I had to to avoid going to court. I still have not received any sort of any information on this balance and why its there and where it came from and I dont understand why I had no option to dispute the debt, yet when it was time to send me letters from attorneys to sue, THATS when I began to receive correspondence.

I had originally filed a complaint in XXXX of last year, complaint number XXXX. I did not know that I would not be able to challenge all of the information I received back and when I spoke to a CFPB rep they informed me that I could fax in my new information, which I did on XXXX however, I have not seen anything on this yet so I decided to open a new XXXX. The response from my original complaint brought up additional questions and that is why I am opening this one. Fenton & McGarvey state that my pre-judgement interest was in the amount of {$17000.00} however, in XXXX 2007 my pre-judgement interest was only {$900.00}. I have asked for an explanation of this discrepancy and have yet to receive a response. I would like a breakdown of these charges and not just a lump sum. This is what I have been asking for all along.

I was in a lease in 2001, I turned the vehicle in and XXXX XXXX bank signed off that nothing was owed and everything was in good repair. Now they are trying to come after me for money, {$1700.00} when I never even owned a debt in the first place. This has been over 14 years ago, I do not even owe it and they are trying to garnish my wages and charging over 200 % interest. This is illegal. XXXX XXXX bank has no record of it, obviously this is fraud. I believe they constantly harass me because I am a woman as well, this is not even a debt, they brought this from the woodwork and cannto provide me documentation of it, nor can XXXX XXXX, it is fraud.

I have a auto loan with XXXX XXXX. The repo 'd my car and left a balance of. This attorney Mapother & Mapother sued me and garnished my wages. I been paying on it for 3 years and I showed it was paid XXXX 2015. I have called them 3 times along with XXXX XXXX And sent them certifified letters to get this resolved. Still nothing from either of them. Under the fair credit act I have a right to this information. I received a letter from a out of state Law Firm about a so called debt. I live in Pennsylvania so I requested information in to this firm and its practices and licenses that give them a right to collect a debt in Pennsylvania. I 've fought over this " debt '' for 3 years. The previous collectors filed suit. I disputed it through the local courts, and I heard nothing else. A year later I get a second notice of filing by a different office, starting the whole process all over again. They are wanting me to sign something I do not agree with and have not supplied any information about the debt, or a right to dispute notice.
