I 've received two phone calls from a gentlemen from a gentlemen from the office of Feldman and Stern. The first call was received approximately XXXX on Thursday, XXXX XXXX, 2015. It was received via my cell phone with no caller ID information attached to the phone call. I also received a phone call from my work, again with no caller ID information attached to the call. Later in the day, on Thursday, I received a phone call that appeared to be from my local area from again, XXXX representing Feldman and Stern out of Florida about a debt from XXXX XXXX regarding health club membership dues that were outstanding. I was advised that I could settle at that point or be served with papers in XXXX XXXX, Virginia XXXX location where the fitness facility is in ). He advised that I had until noon, Friday, XXXX XXXX to make up my mind and let him know what I wanted to do. I advised during the conversation on Thursday where he was calling from because the number appeared to be a local number. He said that he was calling from his corporate office in Florida. I advised to him that seemed suspicious and he advised that he had several regional offices. I contacted the office back on Friday morning, XXXX XXXX to XXXX and a call was answered by a lady who answered the call as " XXXX XXXX ''. Not Feldman and Stern as was told to me earlier. I asked the gentlemen, XXXX, after advising who I was, to send me a letter indicating the debt and all pertinent information. He advised that he had already done that. Up to this point, I 've yet to receive anything at the address of my home regarding a debt of this nature. I asked him to set up payment plans and he said that I was " worthless ' that " I did n't pay my membership on time, what makes him think that I would pay him monthly ''. He was very intimidating and was very " bullying ''. He said that he would now provide me until XXXX eastern time on Friday, XXXX XXXX to decide what I wanted to do. He said that I could borrow money from my boss as I did n't have the amount he stated that I owed. He also told me to go to a payday loan place to get the money or seek if from a family or friend and make payment arrangements with them, but he was n't going to set up a payment arrangement. The only thing he would do would be collect {$250.00} now and allow me to pay the remaining next month. I advised that I could n't do that and that I would be really pleased if we could set up payment plans. Again, he stated that would n't be an option. This time he stated that he had my credit bureau in front of him. I asked him who gave him authorization to pull my credit because neither did I give him verbal or written consent to do. His response to that question was " I do n't need authorization, that when I defaulted on the contract, it automatically gave them the ok to pull credit for business practices ''. I advised that does n't sound legal. He said it was. That authorization is n't written on the back of the contract, he said. I feel as though this company has purchased this debt for pennies on the dollar and going through bullying tactics to try and recoup their fees and make a commission on this. I am willing to set up payment arrangements but the collection agency will have no part of that. All they want to do is file for litigation. They have not proven to me a debt exists. They claim to have sent documentation to my home address, but nothing, at this time has been received by such agency. I have contacted the Better Business Bureau on this company and as of today, the BBB advised they have a C- rating. I am wishing to get this matter settled without the fear of having to be served at work or wages garnished. But, I do not appreciate the tactics in which this company is using to pursue such said debt. Thank you for your time and assistance.

This company called 4 times on Thursday XX/XX/XXXX leaving messages saying I needed to quit avoiding them. Never stated who " they '' were but that I owed a debt and I needed to call " the firm '' now " or else ''. When I was available I returned the call only to be sworn at and repeated yelling, not even allowing me to say anything but my name. The man, XXXX XXXX, told me he knew I owned a company and if I didn't pay in full ( kept yelling over the top of me ... can you pay?? can you pay?? I know you are just avoiding this and quit hiding ) he would take my company, our house, property, and he would send the police the very next day. I knew this was not legal and since he refused to give me an address for the company and the " secretary who answered the phone refused as well, I was unsure if this is a legitimate company/person. I tried telling him not to call me or my husband at work but since he was talking over me he was ignoring me/probably wasn't even listening. I tried explaining that we had been separated and I was not getting my mail and I was requesting he contact me in writing so I could take a look at what he was yelling at me about. He never acted like he even heard me. Then when he was done yelling at me, he hung up on me. On Friday ( next day ) he called again and it was a repeat of what happened the day before. I tried explain again that I needed him to listen to me that I wasn't avoiding anything but that I had not been at the address he continued yelling and was not responsive to anything I tried to say. He said his peace and hung up on me. I tried 4 more times to call back and then the secretary didn't even answer my calls. I left a message saying it was never my intention of not paying, that I had been into the office of the original debt and they didn't know how to operate the printer/computer to get me a receipt and after XX/XX/XXXX visit I figured they might call asking me to come in when they got the issue fixed. Then the separation and I lost track. The same day, they called my husband at work yelling at him with the same empty, illegal threats. He told them he would take care of it, but then they continued threats of police, using obscene, make false claims about me to my husband, taking even the kitchen sink and taking our home and business ( of which I have been not working since the accident that caused the issue to begin with ). My husband returned the call when he got home with me sitting beside him, the man yelled again and my husband just stayed quiet hoping for a time to say something. He finally let him but threatened if he didn't pay by the end of the week he would send the police and continue to harass him at work .This harassment has continued and is causing undue stress where there is already plenty from the medical issues from the car accident. When he hangs up he calls from a different number the next time repeating the whole process. My husband did miraculously get to talk to him the last time he called on Friday coming to an agreed upon amount for the debt even though it was more than we told him we had due to medical care. He told my husband he would give him a week to get the rest together. Then, he continued by calling me again today even though I told him not to several times last week. The XXXX person continued to ask for bank account information each time he called so we could pay the amount ( I refused without being able to verify he was even a real business ).

An individual from Feldman & Stern , LLC named XXXX XXXX has called me numerous times from an unknown number, leaving threatening emails about suing me for debt. He never provides his business name on the voicemails. He ask that I call him at an 800 number. I was finally able to find the number and spoke with XXXX XXXX. He said that he was going to sue me today if I did not pay debt owed to XXXX XXXX. He stated that he was collecting a collection account. I told him that I had not received documentation that I owed money as required under the FDCPA. I informed him that I had the right to receive written notice and 30 days to request verification of the debt. He responded by saying he sent notice to my email address. I have the phone call recorded. He then pressed me to pay the debt today or I would be sued immediately. The individual has also contacted my mother twice and father in law once. In all three calls, XXXX XXXX stated that he needed to know where I live because I owe a collection account and he is going to sue me if they do not disclose where I reside. My mother informed him that he could not call her again after the first call, but he called anyways with threatening language. I informed XXXX XXXX that he was violation of the FDCPA by disclosing this information to a third-party during my phone call with him. He said stated that he did not speak to my mother twice and only left a voicemail once. I told him that the second call was recorded as I informed my mother to record any calls from him going forward. XXXX XXXX has also called my employer and disclosed that he is a debt collector looking to collect debt owed by me. This is again in violation of the FDCPA. I recorded the phone call between me and XXXX XXXX which can validate all claims stated above. I also have the recorded call with my mother and XXXX XXXX where he told her that he was collecting debt and was going to sue me. This again was after he was told not to contact her again. He was very hostile. Note that XXXX & XXXX was sued in 2018 for violating the FDCPA and the Plaintiff 's were awarded a summary judgment to include punitive damages. Additionally, the Florida Attorney General issued a written warning to Feldman & Stern in September 2020 for failing to provide written verification of debts and orally representing themselves as attorneys. The business address for Feldman & Stern is XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX XXXX This address is a XXXX XXXX. The blocked phone number that I was able to unmask is XXXX. The number that XXXX XXXX tells me to call him at is XXXX. He leaves very threatening voicemails. I again have not received written verification of the debt he asked me to pay over the phone and, even after informing him of this and that not providing such is a violation of the FDCPA, he still tried to collect by stating that he sent an email.

On XX/XX/XXXX oXXXX XXXX, I received a phone call from an " unknown caller '' at XXXX XXXX A voicemail was left simply stating that I needed to call a person back named XXXX XXXX immediately. In addition, my spouse received the same phone call and voicemail at XXXX XXXX. I called Mr. XXXX back at XXXX XXXX, to inquire about the reason for his call. He stated that he was collecting a debt from XXXX XXXX, a total of {$210.00}, and that this needed to be paid by XX/XX/2021, in order to not go have a bad mark on my credit score. This was stated via phone call. I proceeded to ask about the amount and if I could get an itemized report of where this amount of money came from. He said that it is too late and that I can not receive this information. He stated that he was calling on behalf of XXXX XXXX and that my account came to them after being delinquent at XXXX XXXX. He also claimed that I was 90 days delinquent, however I have never received any notice of this before today, XX/XX/2021. In addition, he would not provide me with a number to call so that I could receive any more information about this debt that he stated that I owed. I requested on the phone that he send me an email outlining the debt that I supposedly owed. This is attached below. My last communication with XXXX XXXX owner, XXXX XXXX, was on XX/XX/XXXX, when I cancelled my account via postal mail, where I included my key fob that gives access to the gym. I have not received any further communication with Mr. XXXX regarding any further debts or charges, until today, XX/XX/2021, from Mr. XXXX.

When I had the chance to call back he was vary rude and used bad language for a professional and stated I waited to long to call back. I tried calling 3 days later and no recordings or answering system. Called next day and got him. He stated he could not accept me paying the bill in full in two weeks it had to be right this minute or he was turning me over to the courts and garnishing my wages or throwing me in jail. My husband called him and he did the same to him as well. Our bill was for XXXX and since I would not pay now then it would go to court and be over 1,500 with all of the fee 's involved. I mailed in a check for XXXX to the company they are getting the collections from and he said they would mail it back. He would not accept XXXX this week and the rest in 2 weeks. I contacted the company and they said they would cash it. Had to call XXXX XXXX to get the firms office to confirm the guy did work for them bc of how he went about it and how he threatens to do his collections. Debt collector called my cell phone on Tuesday and told me he was collecting on a medical bill I had never heard about. I explained I had not ever recieved a bill and that I was going to call the Dr office to find out what the bill was for and why they never mailed me anything. He told me he 'd just sue me and I could see the bill in court and then I could also pay all his additional fees he was going to add for court costs. I told him I 'd pay what I owed but I wanted to confirm with my insurance company and the Dr office first to see what I owed. He again threatened to sue me and my {$300.00} bill would significantly increase if he had to waste his time. He then called my Father Wednesday, the next day, and told him about the bill and that he was going to sue me and make me come back to XXXX to go to court since I recently moved to XXXX XXXX. I found out that same day ( Wednesday ) that he also called my employer saying he needed to talk to me about " our recent work together '' which is a lie. He 's using multiple names and calling from what appears to be fake numbers because they wo n't let me return the call directly.

Repeated calls from RESTRICTED phone number. I have not answered these calls. Caller leaves a voicemail purporting to be " XXXX XXXX '' and insisting that I call his [ unnamed ] firm immediately at XXXX. I received calls on XX/XX/21 at XXXX and again at XXXX. Immediately following the second call, the restricted number called my husband 's phone number and left a similar message that I needed to contact unnamed firm immediately. On XX/XX/21, I received calls at XXXX. Followed immediately by another all to my husband 's phone line as well. Similar message. That I " needed to clear time this morning to call him back ''. On the afternoon of XX/XX/21, at XXXX RESTRICTED number called again and left similar message. Then immediately after, the RESTRICTED number called and left a similar voicemail with my brother who lives in another state. Researching the phone number XXXX online reveals numerous reports of harrassment connected to that number. Reports reveal that the person behind these calls will often contact other family members and even employers.

I am being told that I owe a debt of slightly over {$200.00} for services not rendered by XXXX XXXX. When I call the owner of the local company ( XXXX ) he was unable to give me any records of me owing debt and did not have the paperwork of me closing the account, as he did not get them from the previous owner. I signed up for a 1 year membership and on the 11th month I notified them I would not be renewing. This was with an old owner that apparently did not keep records. I noticed that I was still being charged in XXXX of 2020, contacted them that this was incorrect and they ( XXXX XXXX ) told me to issue a chargeback through my bank, which I did. There is a new owner of XXXX XXXX and I called him to see why I was in collections, he said it was out of his hands and there was nothing he could do about it? But he also had no paperwork for me at all? So I called the collections company - Feldman and Stern and told them I would not be discussing any debt until I received a Validation Notice which they said they did not need to do and I was hung up on.

A gentleman from this company called me in an extremely threatening manner saying he was filing a lawsuit on me tonight for a balance from a XXXX for {$190.00}. This debt is 5 years old and they had been sending me notices to an address I have not lived at for 5 years. I explained that I do not have that kind of money at the time, but would be willing to set up a payment plan. He said no, either you 're paying the balance or I 'm filing a judgement and you are paying court costs, too, in a VERY threatening and hateful tone. This man scared me, quite frankly!! I want something done about this, as I am in tears now!

This debt collector is calling my family as well as people outside my family making menacing comments saying they need to tell me to call their law firm immediately. Attempting to portray my situation as a legal or criminal bind. It is embarrassing the amount of people they've contacted over this matter. Also at one point made comments stating how would it look working at a bank and them knowing I have this debt. As if to threaten my work if I don't communicate with them about this debt.

Feldman and Stern has repeatedly called my phone, even going as far as to call MY WORK phone ( i work at XXXX XXXXXXXX ) and leaving voicemails talking about my debt owed. I am not sure that this is appropriate and I have called a law office that said that this company is a scam and has been sued many times with no response from the company itself.
