I have experience tough and egregious hardships because someone has stolen my identity. I can not get credit anywhere. This has ruined my life. I lost my job last year and tried to refinance my house and car, I was told sorry, we can not help you. I filed a police report last year on ( XX/XX/XXXX2020 ) ( report XXXX XXXX ) with ( XXXX XXXX Police Department. Ive also mailed in certified letters to XXXXTracking number ( XXXX XXXX XXXX XXXX XXXX XXXX ) I received nothing. The thieves even went as far as filing fraudulent income taxes on my behalf! The thieves are continuing to use my credit. Ive faxed all 3 bureaus, as well as called them, At this point I have hired a Consumer lawyer to assist me in this matter ( XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX PA XXXX ) He notice several instances where XXXX are in non-compliance with the FCRA. Im a victim but Im treated as if Im nothing. XXXX continues to report Fraudulent accounts and inquiries to my credit report and I want it to stop Immediately! Please note that I have already opted out of arbitration and have supporting documents and proof to support all my claims. I am sure that XXXX did not go through the original furnisher to verify these accounts are mine and they must do so under the FCRA.If they did verify, they would have realized immediately that I have no clue of these accounts and they do not belong to me. The Fair Credit Reporting Act requires that you, the credit reporting agency, report accurate and/or correct account information within my credit file. My credit issues are very specific, these accounts and/or items do not belong to me. This means that you are reporting incorrect account information within my credit report. It is with this in mind that I request that these listed accounts and items be BLOCKED and DELETED! Policy states According to the FAIR CREDIT REPORTING ACT FCRA, Section 1681c ( 2 ) Block of information resulting from identity theft. 1. Block. Except as otherwise provided in this section, a consumer reporting agency shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identity theft, not later than four ( 4 ) business days after the date of receipt by such agency of 1. Appropriate proof of identity of the consumer ; 2. A copy of an identity theft report 3. The identification of such information by the consumer ; and 4. A statement by the consumer that the information relating to transaction by the consumer. All furnishers of information to consumer reporting agencies must comply with all applicable regulations. Information about applicable regulations currently in effect can be found at the Consumer Financial Protection Bureaus website, www.consumerfinance.gov/learnmore. NOTICE TO FURNISHERS OF INFORMATION : OBLIGATIONS OF FURNISHERS UNDER THE FCRA The federal Fair Credit Reporting Act ( FCRA ), 15 U.S.C 1681-1681y, imposes responsibilities on all persons who furnish information to consumer reporting agencies ( CRAs ). These responsibilities are found in Section 623 of the FCRA, 15 U.S.C 1681s-2. State law may impose additional requirements on furnishers. All furnishers of information to CRAs should become familiar with the applicable laws and may want to consult with their counsel to ensure that they are in compliance. The text of the FCRA is available at the website of the Consumer Financial Protection Bureau ( CFPB ) : www.consumerfinance.gov/learnmore. A list of tile sections of tile FCRA cross referenced to the .U.S Code is at the end of this document.Section 623 imposes the following duties upon furnishers : Accuracy Guidelines. The FCRA requires furnishers to comply with federal guidelines and regulations dealing with the accuracy of information provided to CRAs by furnishers. Federal regulations and guidelines are available at www.consumerfinance.gov/learnmore. Section 623 ( e ). General Prohibition on Reporting Inaccurate Information The FCRA prohibits information furnishers from providing information to a CRA that they know or have reasonable cause to believe is inaccurate. However, the furnisher is not subject to this general prohibition if it clearly and conspicuously specifies an address to which consumers may write to notify the furnisher that certain information is inaccurate. Sections 623 ( a ) ( 1 ) ( A ) and ( a ) ( 1 ) ( C ). Duty to Correct and Update Information If at any time a person who regularly and in the ordinary course of business furnishes information to one or more CRAs determines that the information provided is not complete or accurate, the furnisher must promptly provide complete and accurate information to the CRA. In addition, the furnisher must notify all CRAs that received the information of any corrections, and must thereafter report only the complete and accurate information. Section 623 ( a ) ( 2 ). Duties After Notice of Dispute from Consumer If a consumer notifies a furnisher, at an address specified for the furnisher for such notices, that specific information is inaccurate, and the information is, in fact, inaccurate, the furnisher must thereafter report the correct information to CRAs. Section 623 ( a ) ( 1 ) ( B ). If a consumer notifies a furnisher that the consumer disputes the completeness or accuracy of any information reported by the furnisher, the furnisher may not subsequently report that information to a CRA without providing notice of the dispute. Section 623 ( a ) ( 3 ). Furnishers must comply with federal regulations that identify when an information furnisher must investigate a dispute made directly to the furnisher by a consumer. Under these regulations, furnishers must complete an investigation within 30 days ( or 45 days, if the consumer later provides relevant additional information ) unless the dispute is frivolous or irrelevant or comes from a credit repair organization. Section 623 ( a ) ( 8 ). Federal regulations are available atwww.consumerfinance.gov/learnmore. Section 623 ( a ) ( 8 ) Duties After Notice of Dispute from Consumer Reporting Agency If a CRA notifies a furnisher that a consumer disputes the completeness or accuracy of information provided by the furnisher, the furnisher has a duty to follow certain procedures. The furnisher must : Conduct an investigation and review all relevant information provided by the CRA, including information given to the CRA by the consumer. Sections 623 ( b ) ( 1 ) ( A ) and ( b ) ( l ) ( B ). Report the results to the CRA that referred the dispute and, if the investigation establishes that the information was in fact, incomplete or inaccurate, report the results to all CRAs to which the furnisher provided the information that compile and maintain files on a nationwide basis. Section 623 ( b ) ( 1 ) ( C ) and ( b ) ( 1 ) ( D ). Complete the above steps within 30 days from the date the CRA receives the dispute ( or 45 days, if the consumer later provides relevant additional information to the CRA ). Section 623 ( b ) ( 2 ). Promptly modify or delete the information, or block its reporting. Section 623 ( b ) ( 1 ) ( E ), Duty to Report Voluntary Closing of Credit Accounts If a consumer voluntarily closes a credit account, any person who regularly and in the ordinary course of business furnished information to one or more CRAs must report this fact when .it provides information to CRAs for the time period in which the account was closed. Section 623 ( a ) ( 4 ). Duty to Report Dates of Delinquencies -If a furnisher reports information concerning a delinquent account placed for collection, charged to profit or loss, or subject to any similar action, the furnisher must, within 90 days after reporting the information, provide the CRA with the month and the year of the commencement of the delinquency that immediately preceded the action, so that the agency will know how long to keep the information in the consumers file. Section 623 ( a ) ( 5 ). Any person, such as a debt collector, that has acquired or is responsible for collecting delinquent accounts and that reports information to CRAs may comply with the requirements of Section 623 ( a ) ( 5 ) ( until there is a consumer dispute ) by reporting the slime delinquency date previously reported by the creditor. If the creditor did not report this date, they may comply with the FCRA by establishing reasonable procedures to obtain and report delinquency dates, or, if a delinquency date can not be reasonably obtained, by following reasonable procedures to ensure that the date reported precedes the date when the account was placed for collection charged to profit or loss, or subjected to any similar action. Section 623 ( a ) ( 5 ). Duties of Financial Institutions When Reporting Negative Information Financial institutions that furnish information to " nationwide '' consumer reporting agencies, as defined in Section 603 ( p ), must notify consumers in writing if they may furnish or have furnished negative information to a CRA. Section 623 ( a ) ( 7 ). The CFPB has prescribed model disclosures, 12 CFR Part 1022, App. B. Duties When Furnishing Medical Information A furnisher whose primary business is providing medical services, products, or devices ( and such furnisher 's agents or assignees ) is a medical information furnisher for the purposes of the FCRA and must notify all CRAs to which it reports of this fact. Section 623 ( a ) ( 9 ). This notice will enable CRAs to comply with their duties under Section 604 ( g ) when reporting medical information. Duties When ID Theft Occurs All furnishers must have in place reasonable procedures to respond to notifications from CRAs that information furnished is the result of identity theft, and to prevent refurnishing the information in the future. A furnisher may not furnish information that a consumer has identified as resulting from identity theft unless the furnisher subsequently knows or is informed by the consumer that the information is correct. Section 623 ( a ) ( 6 ). If a furnisher learns that it has furnished inaccurate information due to identity theft, it must notify each CRA of the correct information and must thereafter report only complete and accurate information. Section 623 ( a ) ( 2 ). When any : furnisher of information is notified pursuant to the procedures set forth in Section 605B that a debt has resulted from identity theft, the furnisher many not sell, transfer, or place for collection the debt except in certain limited circumstances. Section 615 ( f ). They continue to report late payments, which is affecting my credit worthiness and my ability to get a home. XXXX XXXX and FCC Finance continue to report incorrect information to my credit report. Ive sent in verifying documents such as, police report, sign affidavit, dispute letters, even called XXXX and spoke to the special handling department and was told my social security number and personal information did not match and my XXXX account was going into maintenance to correct errors that XXXX has reported. I spoke with XXXX XXXX XXXX XXXX XXXX of FCC who ensured me that the fraudulent account would be removed immediately from there system due to fraud but yet it still continues to report. If this account is not removed with in 24 hours. I will be filing a lawsuit against FCC Finance LCC and XXXX. For violating my consumer laws and violating the FCRA. I also believe that FCC Financial has violated the ( The federal Fair Debt Collection Practices Act ( FDCPA ) after countless times of me letting them know that the debt was not mines. They still called and harassed me concerning the account. Under the FDCPA, lawsuits alleging violations of the FDCPA must be brought " within one year from the date on which the violation occurs. '' ( 15 U.S.C. 1692k ( d ) ). In the case of Rotkiske v. Klemm, 589 U.S. ___ ( 2019 ), the U.S. Supreme Court clarified that the one-year statute of limitations for an FDCPA violation begins to run when the alleged violation occurs, not when the offense is discovered, absent the application of an equitable doctrine. Ive also contacted the FTC with FDCPA concerns. Ive also contacted the states attorney general concern this matter. I had an account with XXXX XXXX which I paid faithfully. When I was preparing to move, I reached out to XXXX to give them my new address. By that time, they had gone out of business, so I could not contact them. A company named FCC Finance shows up on my credit report a few years later and claims that they have the XXXX XXXX debt. They never sent the information to my address. I have requested validation, as permitted by law, such as amount owed, last payment received, when the debt was supposedly transferred. I do not owe a debt to this company. I sent them a letter asking them to verify the debt. They DO NOT EVEN READ THE LETTERS! They just send back a letter saying it's verified. There's no way it can be verified because the original company is out of business. They are reporting me as120+ days late for more than two years! This is wrecking my credit score. All of my other accounts are current and this is affecting my ability to get a mortgage and I have been denied for credit several times recently. I sent them a certified letter requesting the validation. I waited 60 days to hear back and got no response. At this point, the debt should have been removed from my credit profile. About 75 days later, they responded with the same standard letter saying the debt was valid. They are not adhering to the law and it is having an adverse effect on my personal credit profile. I need to see when they supposedly took over, how much I owed at that point, how payments were applied to my balance. The information they are reporting has to be incorrect because it can not be verified. I am suffering irreparable harm from this inaccurate reporting. I have reach out to them several times and it seems like they ignore my request and just send the standard form letter verifying the debt. Also, XXXX has not been any help. I tried to get their assistance and they sent back a form letter saying they didn't know " the nature of my request or that my request was illegible. '' This is because they use a computer to review the information. The letter was typed and we certainly legible. I need a human to read the letter to see the nature of what I am requesting and remove the negative information. I implore you to advocate on my behalf to get the negative information removed from my profile so I can move on with my life. I have a history of good paying accounts and I am trying to launch a business during an uncertain economy. I need to have my personal credit in good shape and this unfortunate discrepancy is making that very difficult.

Tree days ago on XX/XX/XXXX, I notice a change in my credit score. It when down about 30 points due to a new account posted with 120 days past due payment. The company is FCC Finance after I call them, I found out that FCC Finance just acquired a loan company by the name of XXXX XXXX. I did have a loan with XXXX XXXX back in XXXX. It was my understanding that my loan with XXXX XXXX was fully paid after I completed all payments. After that, I move to Florida and never hear anything from XXXX XXXX. In 6 years XXXX XXXX never showed up on my credit report or reported a collection on by behave. Now, this company FCC Finance ruined my credit for a fee that apparently I did not pay, a fee of {$180.00}. Because of this {$180.00} we are going to lose our house. You see, we are about a month away from the closing date on our mortgage they are currently building our house here in XXXX Florida, and with this late payment posted by FCC Finance, my loan officer told me we have very little change in getting the house and we will lose all the money we already paid. I begged FCC Finance to remove that late payment form my record, I explain I did not new about the {$180.00}, but they did not care they even got angry and annoyed at me. And then I ask why no one try to contact me before they posted this on my credit report. They said they try to send an email and when I ask what day they could not give a straight answer. You see there is no way I will put in jeopardy my family 's future for {$180.00} if I knew I owe this money I will have paid it 6 years ago. I did pay the {$180.00} the same day I contacted FCC Finance despite the anger and powerlessness I felt and still feel. I am very desperate and disappointed on how this company behaved towards me and how much I will lose for a XXXX year old late fee that no one had the dignity of trying to contact me before posting this on my credit report. I am not a law expert but I am counting on you to help in any way you can. This type of behavior forms a company is not right in any way. FCC Finance LLC is illegally trying to collect on a debt I originally had with XXXX XXXX. This debt was in collection with XXXX in XXXX. I received a call from FCC Finance around XXXX of XXXX saying they were working with XXXX XXXX to collect the debt. I offered them a settlement at that time not knowing they had purchased the debt from XXXX. A month letter, I get a credit update saying I owned FCC Finance a loan balance from XX/XX/XXXX. FCC Finance is claiming I have an open loan with their company. I have never filed any request or signed up for any loan with FFC Finance. They purchased a debt and turned it into an open loan with payments due. This is illegal. This debt was in collection for 4 years and now they are saying it is a current loan with missing payments. I reached out to the company and they refuse to adjust my credit report. This has caused me financial problems and a personal hardship. I have contacted the FBI and an Attorney to investigate the matter.

XXXX XXXX XXXX took over XXXX several years ago and began mailing payments back to consumers, including myself. In the process, I did a short sale of the property and FCC Finance, LLC agreed to a payoff balance along with releasing the lien on the property. The title company facilitated the payoff balance with a wire transfer being sent to FCC Finance, LLC. FCC Finance, LLC continues to harass and demand payment for the loan that they agreed to settle with payment wired on XXXX/XXXX/2013. They have submitted a bad debt report to XXXX and are continuing their attempts to collect what is not owed to them. I have spoken previously to FCC Finance, LLC and they insist that I owe them. This company has pretended to be the district attorney 's office on one instance that they called. On another instance, they pretended to be XXXX and was given my personal cell phone number to further harass me. They have called my work and harassed me over the last 3 1/2 years.

I have been trying to pay more on the payment each month and FCC Finance is stealing my money and applying more to their interest instead of my principle. I've tried to reach out and work this out with FCC Finance and question why they are taking more than their interest of 15.99 %. This was in XXXX, XXXX, XXXX, and XX/XX/2021. They make me call them and have them reapply any over payments I make to be applied to principle and not their interest. They would not answer me as to why they are taking more than the agreement of 15.99 %. I have emails that I've sent and never get a proper answer. they are fraud back and stealing money. I've tried to go to the XXXX and got nowhere with this except a letter from 2 of their attorneys that wouldn't answer my questions of misapplying and stealing more from me. I want this resolved. I'm trying to get a loan to pay them off and transfer the amount over to a real bank. Please help fix what these criminals are doing.

i am reporting that FCC Finance remove the debt owed from my XXXX credit report. I have tried disputing this with XXXX directly and they recommended. According to their website they are a home improvement loan company. I have never owned a home and I have requested several backup documentation on how they obtained this loan from XXXX XXXX. This company has failed to provide me with requested information such as proof on how they obtained the loan, if they are a debt collector and if in fact they own the loan the reporting of the loan does not follow federal debt collection procedures that a personal loan is charged off in 120 days for non payment. They have provided me with an allonge document that does not state FCC Finance as the purchaser or receiver of the loan. This inaccurate reporting has been determintal to my personal finances since it shows that it is past due for over 3 years with excess fees added.

Today I received a phone call from a number listed as " XXXX '' at XXXX XXXX on XXXX/XXXX/XXXX. The caller was from XXXX XXXX XXXX ( FCC Finance , LLC ) and they usually call from XXXX. However today they spoofed their number to show up as " XXXX '' ( XXXX ) on my caller ID. The representative from FCC called and asked me to make a payment with my debit card when I had already made a payment this month. It was taken by them from my bank account on XXXX/XXXX/XXXX. I am absolutely sure that this company spoofed their number. In XXXX, a home improvement loan was taken under my name fraudulently from a property i have never owned!!!. In XXXX XXXX FCC Finance reported a debt without even contacting me first or trying to reach out to validate this debt. I disputed with XXXX and submitted a police report, identity theft reports and etc. To this day, my credit score has been significantly lowered and in result of that i have had losses ( credit limits lowered ). FCC finance is not sending me the original contract. I hired legal services and intend to file a lawsuit to all parties involved for my damages and tarnishing my good name. FCC Finance should have not reported a fraudulent debt to XXXX. How could a loan be issued for a property i never owned? Why was this loan never reported for 7 years?????

I am a former employee and witnessed daily violations while employed at FCC Finance and a lot of the consumer complaints are valid. Management was made aware of these violations on many occasions and either failed to address them or only address them when a complaint was filed. I witnessed FCC threaten to sue a customer for an old debt after the customer called in to settle his debt in good faith. While employed we were constantly told to call the customers several times a day and sometimes several times an hour. The goal was to wear the customer down into paying us. This is just a small sample of the FDCPA, SCRA and FCRA violations I witnessed while employed at FCC Finance.

I received a letter in the mail RE : What Does FCC FINANCE , LLC DO WITH YOUR PERSONAL INFORMATION. I called to let the company know that I do not want any of my personal information shared for any reason. I then asked the rep why did I receive the notice and asked did I have an account with them. Agent told me that the company has an open account in my name with a balance that should not be open. She advised me to send an email to request closing of the account.
