XX/XX/XXXX This is a complaint against FBC Mortgage alleging discriminatory practices and criminal Intent to violate privacy. Dear Sir/Madam, I originated a loan for a cash-out refinance with FBC Mortgage in XX/XX/XXXX with the XXXX, Florida office. After a period of gross incompetence by the first loan originator and sales manager XXXX the file was transferred to XXXX XXXX, a second loan originator. The loan is now being processed by a second loan processor after the first, XXXX XXXX was told to relinquish work on the file. The loan progressed to the conditional approval where it was stuck for several weeks. Background : On XX/XX/XXXX I sent an email with an attachment containing an Internal Revenue Service document that confirmed acceptance of the electronic filing of my XXXX tax returns.to satisfy a condition stipulated by FBC Mortgage. This condition was a prerequisite for approval of a mortgage loan. I requested an acknowledgement of receipt of said document. Instead, I receive a response that did not acknowledge my email but expressed a blatant act of unauthorized use of a U.S. Government System by FBC Mortgage. Offense1 : UNAUTHORIZED USE OF A U.S GOVERNMENT SYSTEM The Get Refund Status on the IRS.gov website explicitly states : Unauthorized use of this system is prohibited and subject to criminal and civil penalties, including all penalties applicable to willful unauthorized access ( UNAX ) OR inspection of taxpayer records ( under 18.U.S.C. 1030 and 26 U.S.C 7231A and 7431 ). The regional underwriting manager ( referenced in FBC email ) at FBC directed an FBC employee ( XXXX XXXX ) to violate the law cited above and use my name ( XXXX XXXX ), my social security number, and other personal information to access my tax records at the U.S. Treasury Department without my authorization. The unnamed regional underwriting manager declared his/her intent to commit a criminal offense as outlined in the email below. On XX/XX/XXXX an email from FBC Mortgage ( XXXX XXXX ) stated : XXXX, as directed by the regional underwriting manager, I will check the wheres my refund status for a {$0.00} refund in the next few days, as it will take a couple days to register. I will keep you posted An email was sent to FBC on XX/XX/XXXX seeking clarification of the intent to access my IRS records without authorization from me. There was no response from FBC. Offense 2 : Violation of Privacy Social Security Administration : The regional underwriting manager directed XXXX XXXX XXXX to gain access to my personal record and that of a minor child at the Social Security Administration ( SSA ) without my authorization XXXX XXXX called the Social Security Administration and provided in XX/XX/XXXX and used my name ( XXXX XXXX ), social security number, and other personal information and the information of a minor, XXXX XXXX to gather, review or otherwise access information about my social security payments. I did not authorize FBC Mortgage ( verbal or written ) personnel to access or attempt to access my file at the SSA. And more importantly, I did not authorize FBC to access information at the SSA about a minor. Social Security Award documents were already provided to XXXX XXXX two months prior. It was only after the agent at the Social Security Administration refuse to provide my personal financial information to XXXX XXXX that he contacted me to join a three-way call where he listened in to my answers to my security questions to verify my identity during the call- clear violations of ethical practice and an invasion of privacy. Offense 3 : On XX/XX/XXXX FBC transmitted an email to me with a list of 5 documents required for final approval for the loan. Item # 5 on the list requested 60 days of bank statements for all checking/savings accounts ( estimated ( $ XXXX total ). This request was highly irregular because it was not consistent with guidelines for reserves. Guidelines for reserves require two months of reserve funds. The above request required twenty times the amount indicated in lending guidelines. This appeared to be a deliberate attempt to thwart the approval of the loan. Violation of guidelines : An amended XXXX tax return was submitted to FBC in XXXX. The regional underwriting manager refused to accept the amended tax returns without providing lending guidelines to support the decision. Subsequently, FBC accepted XXXX tax returns ( unamended ) with similar rental income figures. Disturbing Patterns-Disclosure violations : Several attempts were made by me, XXXX XXXX, ascertain the final condition of the loan that needed to be satisfied to gain final approval. FBC has deliberately refused to provide a written requirement ( condition/stipulation ) to move the loan to the final approval stage. I left two messages with the Regional Sales Manager, XXXX XXXX but I did not receive a response. On XX/XX/XXXX, I spoke with XXXX XXXX and requested the additional information to satisfy the conditions of the file be provided to me in writing by XXXX XXXX. The information was not received. On XX/XX/XXXX I spoke with sales manager, XXXX XXXX who stated that there was only one condition that was required to be satisfied. He stated that FBC needed proof that XXXX tax returns were filed. He reiterated that proof of XXXX tax filing was the only condition left to be satisfied. He too failed to provide a written request of that condition required for final approval. Subsequent calls to XXXX XXXX met with no response even after leaving messages. On XX/XX/XXXX, I spoke with XXXX XXXX who had originally promised to provide a written account of the additional information ( required condition ) but failed to do so. Some information was disclosed after I threatened to file a complaint. Non-Compliance : Without the outstanding condition/s being satisfied the loan will never close. The outstanding condition will not be satisfied for underwriting to approve the loan because FBC refuses to disclose in writing what additional information ( condition/s ) must be satisfied to gain final approval. To compound the problem, FBC removed the file from the processor XXXX XXXX and left it without a processor to work on the file for approximately two weeks. Discrimination : The loan has been I process for five months with to two loan processors ( XXXX XXXX, XXXX XXXX ) and two loan originators ( XXXX XXXX, XXXX ). Yet the loan is still not approved. I do not believe that mere incompetence or inadvertence accounts for the violations outlined. The actions or lack thereof by personnel at FBC Mortgage are indicative of a more systemic problem of discrimination based on race, age, and national origin. Resolution : FBC Mortgage must cease and desist from persistent violations of privacy rights. FBC Mortgage must provide appropriate feedback in a timely manner to facilitate approval. FBC must provide written assurance that the discriminatory practices applied to my file will cease immediately. I await your response to this serious complaint. Our closing process was very stressful and the lack of communication almost made us not able to close on our home. We reached out repeatedly asking if we had everything needed and if we were clear to close. We got so many different mixed answers. Our loan officer was constantly out of the office including our week of closing so she was unavailable to help. We had to reach out to her supervisor multiple times due to lack of response throughout our process. We received our final closing disclosure on XX/XX/XXXX. Despite signing that and thinking we were done we were still confused because the processor kept reaching back out saying we were not. Our loan officer and her supervisor had said we were clear and notified our builder as well. During our process they forgot to verify 2 years of rental history, they said it was the last thing needed so the week before closing I provided all of my former apartments contact information including 3 years of payment history to ensure nothing further would be requested. We didnt hear anything else after that so we reached out to confirm we were set to close. Our processor said no your file is still being reviewed and I never said you were clear to close. We started to panic because at this point we were just 2 days out from closing. Closing was supposed to be at XXXX XXXX XXXXXX/XX/XXXX and we heard we still werent clear on XX/XX/XXXX. On XX/XX/XXXX the processor said she needed to know about an XXXX payment I made XX/XX/XXXX, she said it didnt show up on my credit as open credit. XX/XX/XXXX was my last payment on a 6 month term through XXXX. I provided the truth and lending disclosure and my full 6 month payment history. The morning of XX/XX/XXXX the day we were supposed to close I received a call from the credit company FBC utilizes who did a conference call with me and XXXX and confirmed I was paid off and all payments were on time. We reached out to make sure we were clear to close and that was the last thing needed. The processor still said things needed to be reviewed and wouldnt give a straight answer. Our builder was just as confused as us because they had already been notified we were good and they didnt understand why we were still being asked for items. I could have provided my rental history and XXXX payment history in early XXXX. They dropped the ball and waited until the very last minute to do things leaving our family stressed and worried. Our closing ended up being pushed to XX/XX/XXXX by our builder. We got an automated email from our loan officer saying we were clear to close. My husband emailed asking if this was correct and the processor still said no and said they needed a final inspection and appraisal pictures. This was confusing because we signed a final appraisal in early XXXX. So many times we were left confused and not understanding what was happening. We were terrified throughout our time working with FBC we wouldnt get our home. I reached out often reminding them I am a first time homebuyer and confused on what is going on. I would either be ignored or met with a rude, vague response. We received an updated final disclosure to sign 2 hours before closing and our closing costs went from XXXX to XXXX. This was a big unexpected change for us and we were in the process of packing to move. We called and were told we wouldnt be closing if we didnt come up with the new amount so I ran to the bank and got a second certified cashiers check. I already had one for the original amount we were told. We had to push our closing from XXXX to XXXX because of scrambling at the last minute to get the money. We never did get any confirmation from anyone at FBC that we were clear to close. We showed up at closing hoping for the best that everything was complete and worked out. We signed all of the documents at closing and afterwards the woman verified our closing costs were correct. She said we were short XXXX dollars. We double checked the math. Come to find out they said FBC sent the disclosure over to us prematurely before the HOA fees were calculated. Luckily they accommodated us and said I could bring the XXXX in cash on Tuesday XX/XX/XXXX due to it being late on Friday before the holiday. Our online portal still hasnt been updated and shows they need a task completed from XX/XX/2021 and account statements that were provided and are on file. We still do not show as clear to close even though we closed and we never heard directly from anyone there that we were able to move forward with closing. Our builder will no longer work with our mortgage loan officer due to the complaints received about her by us and others that used her. I am extremely disappointed at how we were treated, the misinformation and the lack of clear communication or communication at all in many instances. FBC ruined my experience buying a home. I cried so many times and felt sick from stress constantly. Even the title loan company was in shock at how things were handled and said our experience was horrifying. I do not want any further contact with XXXX XXXX or her team and I hate she received any commission from our home closing. It was not deserved and she did not work the file properly. If I had known prior I would have asked for her to be removed from the loan. A month before closing I did try to check into swapping lenders but was told that would delay our closing. XXXX XXXX, the processor was often rude or wouldnt answer my questions clearly in emails and never answered a single phone call from us in months or returned any of our messages. She left us confused up to the very last minute. I hate that our loan is with FBC and ideally Id like to deal with another mortgage company altogether but I cant until we refinance I am assuming. If I have any further questions about my new mortgage or need to make changes to our homeowners insurance I need a reliable point of contact at FBC. I refuse to speak to XXXX again and do not feel comfortable continuing to work with her or any of her team due to the mistakes made. Please assist any way possible!

On XX/XX/XXXX I called FBC Mortgage and talked to a representative to let her know I had lost my job and explained to the representative that XXXX XXXX is going to pay my mortgage on my behalf. She said great and gave me the email address so I could send over the supporting documents. I emailed her the XXXX XXXX documents so they could start receiving mortgage payment from XXXX XXXX on my behalf. The representative sent me an email to show the documents was received and are now being sent to the department that will be singing the documents and getting them back to XXXX XXXX to start mortgage paments. The email the representative sent contained the attached documents from XXXX-XXXX XXXX that was supposed to be filled out and sent back in order to receive mortgage payment was being processed as was told to me. The email was sent by FBC Mortgage loan administration : [ XXXX ] subject : Re Loan number : XXXX XXXX XXXX, XX/XX/XXXX @ XXXX in attacked to this complaint document. I called FBM Mortgage about 2 weeks later to check and see if they had sent the Home-Safe Georgia documents back so they could start receiving mortgage payment on my behalf and the FBC Mortgage representative sent me over to another department that was supposed to be handling the documents. After speaking to the representative in that department, she told me after checking her notes the package was being sent over to XXXX XXXX as soon as possible and she apologized for the delay in doing so. I asked if she noted the account as the documents was being processed and sent she stated to me yes, it will be taken care of. She again represented the email that was sent to me on XX/XX/XXXX to show they were taking care of the document but again she apologized for not doing so immediately. After 5 weeks of waiting for FBC Mortgage to send back to XXXX XXXX documents, I called XXXX XXXX because I thought the documents would have been received and spoke with my representative XXXX XXXX and she said FBC Mortgage has not sent the signed documents back to them to start mortgage payments on my behalf. After my representative let me know that FBC Mortgage had not sent the documents back to XXXX XXXX, I called FBC Mortgage for the 3rd time and was transferred to the department that was handling the Home-Safe Georgia paperwork. I spoke the 3rd representative she looked over the file and took about 15 to 20 min in which I was on hold. When she came back to the phone I let her know I was requested to see when the Home-Safe Georgia package was sent and she said it was never sent back because they dont received payment from XXXX XXXX and I asked why and she said they are not approved to accept payment from them. I let her know if XXXX XXXX XXXX told me that over a month ago I would have tried to seek other means for trying to pay my mortgage. The Mortgage representative said she dont know why I was told that by the other representative that the package was being sent back to XXXX XXXX because thats not true. I let her know I even have the email to show that it was being handled back on XXXX XXXX, XXXX. At that point I became very upset and felt like FBC Mortgage representatives was leading me on and was giving me incorrect and different information. I let the Mortgage representative know other representatives from the Mortgage Company said the paperwork was being processed and now she is saying they dont accept from XXXX XXXX. I let her know, if I have known that moths ago I would have tried to used other means of trying to get my mortgage paid and that precious time has been wasted and I could possible lose my home because of this grave miscommunication with the Mortgage representatives. She apologized for the other FBC Mortgage misinformation and I let her know thats not good enough. The Mortgage representative said all of our conversations with the other representatives were noted in the system as well as them telling me the document was being processed and sent back to XXXX XXXX both times. The representative kept apologizing for the incorrect information that was told to me about the document. This was a horrible experience with my mortgage companys representatives and inexcusable and unacceptable because I may lose my home because of their incompetency. Thanks, XXXX XXXX

Hello, On XX/XX/XXXX my family and I had to go on a forbearance period due to hurricane Irma with our mortgage loan with FBC Mortgage , LLC. At this time we were advised that we would not have to make any payments during this period and that we would be contacted by FBC at the end of the forbearance period to XXXX our financial situation and give us the options we had to get back on track. On XX/XX/XXXX since I had not received any letters or calls from the company, I contacted them to inquire about what we had to do to start making payments again, I spoke to a representative by the name XXXX XXXX who advised me that I was approved for a new lower payment and a new interest rate. Since I had not received any paperwork stating this new amount ( till this date I still have not received anything regarding this ) I was very happy to hear it would be a lower amount. In the conversation he stated that I would be receiving paperwork in 7-10 days that I had to sign and return. He asked if I had made the a payment for XX/XX/XXXX to which I said no because I didn't know when or what I had to pay. I stress the fact that I have not received any paperwork regarding this new arrangement, but I was willing to pay to which he said don't worry about the XX/XX/XXXX payment because your first payment would be due in XX/XX/XXXX as part of the mitigation process. I asked him if he was sure he stated that he was and that he regretted not speaking to me at an earlier time so I would have not been worried. I allocated those funds into other debts and waited for the paperwork to arrive by mail. On XX/XX/XXXX I contacted FBC again because I had not yet received anything by mail and spoke to XXXX XXXX who apologized and advised me that not every customer received paperwork to sign and return and that I must have been one of those customers but not to worry because I was all setup for my new payments and if I wanted to make my first payment for XX/XX/XXXX. I explained to him what I was told on XX/XX/XXXX and he spoke to his team lead which agreed to pull my call and review as if what I was saying was true they would have to adjust my account accordingly because it was not my fault. By Tuesday of the following week I had not received a call back and I called again to find out the status of my previous call and was told that everything was OK and was told again don't worry ma'am you are setup for your payment for XX/XX/XXXX. After this I called on XX/XX/XXXX to try to make my payment as their online service referred me to contact them by phone. On this call again I was confirmed i was making my XX/XX/XXXX payment and i scheduled it for XX/XX/XXXX. Now i keep getting calls and correspondence saying that I am late and that they are trying to collect a debt and I need to contact them. Since XX/XX/XXXX when I received one of these collection calls I have spent time trying to have them review all of my calls, and continue to get the run around and no answer by a supervisor or anybody that can fix my account according to what I was told time and time again since XX/XX/XXXX. Every time I inquire about the calls being reviewed the conversation is changed and they go back to saying I am late and need to make my XX/XX/XXXX payment. At this time I want to be back to being in good status with my account and continue making my payments as I was told. This has caused me so much XXXX and XXXX because this being our first home and due to a natural disaster feel we could be losing everything we have worked so hard to achieve. I do not want this to affect my credit or my history of good payment. Please help me.

We purchased our new home for {$240000.00} in XX/XX/XXXX in XXXX XXXX FL with my VA loan eligibility. The mortgage payment was {$1500.00} with a 4.125 % interest rate. In XX/XX/XXXX we were in a declared disaster zone due to Hurricane Irma. -- We were notified of an assistance program called forbearance. When I asked about it, I was offered the program without any paperwork and informed that I would not have to make my next three payments. We could have continued making our regular payments but this promised to make our recovery from Irma much smoother. -- I asked about what happens at the conclusion of the program and was given vague answers about a variety of options including extending the forbearance and " other '' assistance programs. I was under the impression that the payments would be added to the end of the loan. -- - In XX/XX/XXXX approx. 2 weeks before my expected XX/XX/XXXX payment, I was informed that I would be responsible for all three payments plus the XX/XX/XXXX payment or {$6000.00}. We had used the money as " relief '' funds for the expenses we incurred, even helping extended family who didn't have the option we did. I was told they would check what " programs ' they had available for us. I was less than pleased. -- - I paid {$1500.00} on XX/XX/XXXX but didn't make the missed payments. I waited to see what they would say. Some time near the middle of XX/XX/XXXX I was told I didn't qualify for a repayment plan, which I wasn't inclined to do because it added significantly to my monthly payment. My expectation had been that the payments would be added at the end and adding a burden now wasn't what I " signed up for ''. -- - I was told my loan was being considered for a modification, which I again understood as adding the missed payments to the end and rewriting the loan. I was given a figure of {$1300.00} as my payment for XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX. I was also told that after I made the three " trial '' payments my loan would become permanent at this amount. There was never any paperwork other than receipts for the payments. My monthly statement continued to show the past due amount. -- - I had already paid XX/XX/XXXX as mentioned. I paid {$1300.00} on XX/XX/XXXX, and XX/XX/XXXX. They didn't give me a date within the month and payments had to be made via phone as the web payment portal was suspended for my account. -- - On XX/XX/XXXX I received a letter from the U.S. Dept. of Veterans Affairs informing me that my loan was in danger of default. I immediately called and was told a dispute would be filed immediately and the problem would be fixed. I took the occasion to make my third " trial '' payment. -- - I inquired regarding the permanent solution where I was told my modification was accepted and my new payment would be {$1500.00} +/-. This wasn't what I had been told to expect so I pressed for more information. I learned that my interest rate is set to increase from 4.125 % to 4.5 %. Over the life of the loan this adds approx. {$21000.00} to my loan for a {$4500.00} " Assistance Program '' that I would have managed without had I known. -- - I was misled and drawn into a modification that would cost me significantly. I'm faced with either losing my lower rate, which I obtained by paying an additional {$2500.00} at closing, or borrowing enough funds to bring the loan current. If that's possible since they torpedoed my credit score by posting my missed payments as past due after assuring me at every step would not happen.

I bought a house. In XXXX XXXX for my XXXX XXXX. I was living in XXXX at the time. Of purchasing my home. So I packed up my wife, dogs and furnishings and clothing.Left our home in XXXX on XX/XX/XXXX.Drove all the way down from XXXX XXXX XXXX XXXX XXXX To XXXX because I was told closing was on XX/XX/2021. I was told the home was ready to move into on the day of closing. XX/XX/2021. XXXX XXXX From FBC Mortgage LLC. Is who did my XXXX XXXX This house is not suitable for a veteran. I was told that There wouldn't be anything that needed to do any kind. Of repairs to the home. I was lied to. I am a XXXX XXXX XXXX veteran this house is not safe for me to live in. I can not secure my back doors. They are on backwards. I have to use ratchet straps to secure them. Because I can not lock them at all. Windows are cracked some of them are falling out. No chimney cap on the chimney. For the fireplaces. Broken duc work and exposed wires through out the house. Hardly any insulation in the attic. Dead tree branches that should have been removed. I told XXXX and the realtors. That all this stuff needs to be fixed before I close. I was informed that they were having it all fixed. They didn't have anything fixed. They had me pay for all these inspections that. XXXX said needed to be done. To be able to process my XXXX XXXX. She also had me pay for an appraisal that she said she needed for the loan. Then at closing I had to pay closing cost.For After the closing was done. I went to the house. Nothing was done none of. The repairs were done. I Feel XXXX took advantage of me seeing. I am a XXXX Veteran this house is not safe. I have asked her for appraisal she still has not sent it to me. I have asked her about getting all these things fixed. That should have been fixed. Before I moved in. I was never informed that. To get the power transferred into my name. Was going to cost me XXXX. Water was XXXX have it transferred into our names. I was not informed that house I bought was a squatters house. Finally yesterday I after a month. Of trying to get the inspection reports. My realtor was able to get copies and send them to me. He is still trying to get the appraisal. In the inspection reports it even. States that these repairs need to be done. That it shows that ppl are squatting stay in the house. Only door I can lock is the front door. 3 back doors I can't lock at all. There is no weather stripping around any of the doors. I can't sleep due to being afraid of someone coming into. House to harm me or my wife. All I want is for XXXX and whoever to make this right. Fix the doors and windows. So I can feel safe in my house. I feel that XXXX from FBC Mortgage rushed and pushed this loan through. That she took advantage of me and my realtor. I want everyone to be aware of what hapoen to me. By XXXX XXXX From FBC Mortgage LLC. Before She Doese This To Another XXXX Veteran. All I want is for Her To Have This Stuff Fixed and Made Right. So I can Feel Safe In My Home. As It is right now. In XX/XX/XXXX Hurricane Irma came through Florida. We had a 30ft tall oak tree fall on our house. It was XXXX to have it removed. Insurance wouldn't cover it. We did a 90 Day mortgage forbearance with FBC Mortgage so we could pay to have the tree removed. In XX/XX/XXXX, I called several times and spent hours on hold only to be told someone from the loss mitigation would call me back. It was XX/XX/XXXX before I could get a hold of someone who would actually talk to me. We talked about options for that 3 months of payments and started the Loan Modification process. I received a Letter from FBC stating that they had received my information and it was sent to the underwriters and I would have a decision 30 days from XX/XX/XXXX. It is now XX/XX/XXXX. I call them every week to find out what's going on. All I ever get is it is still with the underwriters and that's all they can tell me. We are way past the 30 day mark, by months. In XX/XX/XXXX they made me resubmit all of my paperwork because the batch I sent over in XX/XX/XXXX had expired. I resumed my normal payments every month, by having to call them because they suspended my online and automated payments. But in the time they have been stalling, they have been reporting me late to the credit bureaus and charging me late fees on the 3 months that is supposed to be modified back into the loan that they were supposed to complete months ago. If they had completed it, there would be no late anything. I am being penalized because they are stalling and I don't know why. I did everything they asked and followed all of their rules. No one will tell me what ; s going on. They are ruining my credit and I don't know if they are going to take away my house. I can't find anyone from FBC to help or give me actual answers. I don't know what to do. I need someone to help me. All I can get from them is that my account is in underwriting where it has been since XX/XX/XXXX and that there is no one there I can be transferred to that can help me. They give me the run around every time and avoid giving me any information. Making payments is hit or miss. Some of the people who answer will take a payment and others tell me to wait until the modification is complete. I just keep calling back until someone takes a payment but I shouldn't have to do that. I shouldn't be treated this way. I have attached the documents I have received. After the letter in XX/XX/XXXX I have received no further paperwork regarding the modification, only many many upset phone calls I have made.

XXXX XXXX - I made a sales agreement on the brand new house where I live in now. XXXX XXXX - When I mad the agreement, I also made an agent agreement with my realtor, and the agreement included that I will get {$1000.00} credit on the closing.!! XXXX XXXX - I started a mortgage loan after I got a pre-approval. ( This was right after the day of the sales agreement ). The mortgage company was recommended by the home builder. And I paid the XXXX of earnest money. XXXX XXXX - After several days, they told me I had to switch to FHA loan with other mortgage company referred by the XXXX XXXX XXXX, because I have a XXXX XXXX XXXX XXXX - I asked the home builder if I can get the earnest money back, and they said " no '' because it 's been approved on conditions. I did n't fully accept the situations and already got a lot of stress at this point, because I felt I had to keep going because the earnest money. XXXX XXXX, XXXX - I had a closing for my current house. XXXX XXXX, XXXX - I noticed that I did n't get {$1000.00} credit, and asked my realtor right away. XXXX XXXX, XXXX - The realtor finally answer this via text : " XXXX, I spoke with XXXX my Broker-in-charge at XXXX this morning. He said because your XXXX credit was n't on your closing statement & disclosed to your lender prior to closing we wo n't be able to pay you XXXX after closing. It 's also a violation of NC license law to pay anyone without a NC realtors license. I apologize for this error & promise to make it up to you on our next transaction. I feel the need to put this in front of the powers that be. I am a mortgage loan originator for XXXX XXXX in XXXX Florida. I have made it my goal to help my clients in everyway possible for there home purchases and refinances. I have encounter a lot of hiccups lately with dealing on new home purchases. In particular XXXX XXXX in XXXX XXXX XXXX. I have now had XXXX clients that have purchased there new homes and I have to say that even though there homes are great quality there business practices are appalling. I have to say what they do seems and sounds like Steering to me. Here 's why : When you enter an XXXX home you can clearly see signs about using there preferred lender for No Closing costs ( which is already a lie ) And than after telling a rep of XXXX homes that your financing has been secured they pass your information on to there preferred lender who proceeds to barrage the borrower with emails ... even after telling them there is no interest in dealing with them. It is clear that steering is taking place because it is written in there contracts and told to the borrower that if you do not use our finance company than you will incur all the closing costs as opposed to paying none of them. If XXXX homes has no financial benefit from using there preferred lender than why force the fees that are traditionally covered in our area? Why penalize the borrower thousands of dollar 's? XXXX of there preferred lenders is FBC Mortgage from XXXX Florida. They call the client after a {$1000.00}. deposit is made and ask a couple of questions. They do not run the credit of the borrower, but still send them an approval for a loan. If the home is being built than XXXX can pocket the {$1000.00}. deposit and claim the borrower no longer qualifies and puts the home on the market. This leaves the initial person after months of waiting out of his money and a home! I have read numerous complaints online of this act. It seems criminal and I am surprised to see it continue to happen over the years with no investigation to the process. I do n't know if you receive the complaints on this or if this is the right place for it, but I feel enough is enough with this practice and felt compelled to write about it

The complaint is against FBC Mortage, LLC XXXX XXXX from the start it was impossible to get a hold of XXXX or get replies back form vm and emails. First it was misleading we were told that our payments would be XXXX or lower a month. Are initial loan document had all the wrong numbers and when I pointed it out he told me not to worry about it. The application was just to get started. I sent them all the docs they requested that same day requested. They never confirmed received and they they lose some of them I had to resend them. Throughout the process I kept asking if they had everything no reply and days later they would reply and say yes. Well 3 months before closing I asked are we all set they go oh no we need some more docs, its like when did you plan on calling me. Two weeks before closing which was set to be XX/XX/2018 I kept asking when do we lock interest rate when do we get the final loan documents so I can review and make sure everything is correct. XXXX XXXX kept making excuses and putting me off. Three days before closing he finally locked interest ( and not because I was late on getting docs back he delayed I have no reason why ) and emailed us the docs rushing us that we needed to sign that night he emailed it to us around XXXX XXXX. When I saw the interest rate I asked why is it higher over 1. percent he goes to me it went up this week. So what you are telling me because you waited so long on locking the rate we now have to pay more mortgage payment. When I was asking for the documents the week before closing XX/XX/2018 it was at 4.85 and he locked it in the next week at I believe over 5. Because of this we could no longer afford the payment they wanted over {$1800.00} a month and we kept telling them we can't afford more then {$1600.00} they kept telling us and misleading us telling us they would be low. We could not go into a new home deal knowing we would loose the house and had to walk away. Because of that we lost the {$3000.00} deposit.

I applied for a loan with FBC Mortgage , LLC as the preferred lender for XXXX XXXX. My contract with XXXX XXXX has a contingency clause regarding financing since they do not do contingency based on the sale of my current home. My loan is conditionally approved with a substantial down payment of almost 80K which is to come from the proceeds of selling my current home. I was never approved or qualified for the full purchase price of the new home. I have not found a buyer for my house and XXXX XXXX stated that per the conditions and terms of my contract, I have to close on this home this month. I requested a letter from XXXX XXXX with FBC Mortgage stating that I can not close due to financing and the lack of the down payment required as a condition of my loan. He has refused to give this to me and stated I needed to work it out with XXXX XXXX. Now I am being told that since I have a conditional approval, this voids the financing contingency. I have a {$5000.00} deposit that I want returned. XXXX XXXX did not put this money in an Escrow account and I was strongly discouraged from doing this because " they never keep anyone 's deposit ''. I feel like there is collusion between the builder and the FBC Mortgage and the lender is not acting in my best interest. They have encouraged me to rent my house, get someone to sign as co-borrower, etc. This is encouraging high risk financing & I feel like in light of the mortgage collapse back in 2008, this should not be done. I am being bullied by the mortgage company and the builder to continue this contract. I just want to invoke my cancellation due to financing ; however, FBC is partially owned by XXXX XXXX so I am not able to get this documentation. I feel other consumers should be warned about the unfair practices of this mortgage company and builder. I would never have signed a contract with a company that would use a conditional approval as a means to keep my deposit.

I XXXX XXXX, am a overseas contractor. I been overseas for two years now. I applied for a V. A loan with FBC MORTGAGE LLC out of Florida XXXX I am suppose to transfer home to the XXXX Florida area. Under V.A guildlines I am suppose to occupy the home within 60 days but there are exceptions. While waiting to be transferred my dependent will be ocupping the home. XXXX XXXX, 2023 I was told I need to prove three years of future income. That didn't sound right so I was sent a clause from XXXX from one of their loan officers. I called the V.A and was instructed how to find the complete chapter 4 and was told that section 2. R doesn't pertain to me if I did show a full two or more years of consistent income. I tried explaining that and I wasn't being heard. XXXX kept saying my underwriting has a few friends at the VA that gave her the information she sent via email. I feel like I am being discriminated against and the company is making their own rules towards me when my V.A loan is backed and showing all the requirements they need. ( XXXX XXXX, XXXX ) My realtor and I called the VA regional office. I told them my situation and read and email from a XXXX XXXX. XXXX ( VA rep ) first informs us that the VA doesn't send email and that a V.A loan does not require a three year work foresee. Nicole does explain that the lender can require this information and the VA can not tell them not to. XXXX did tell me to ask would my initial offer letter will work if my contract was taken out but if that doesn't work what exactly does my employer needs to say with the corrrcy letterhead. I emailed the lender XXXX and let her know thst and I didn't get an response. XXXX did reply to my realtor ( XXXX ) when she informed that I will be trying again with my employer in the morning. In connection with regards to the above mention capture, a contract agreement was enter and agreed upon on into ( XX/XX/XXXX ) date, for the sale of this property in the amount of ( {$180000.00} ) due the appraisal value coming in {$2000.00} more I believe the sales price was increase and an amendment to the contract of sale was done in which I never signed, nor did I agree to pay the revised sales price. As a result of this my loan with FBC Mortgage was suspended for the following issues, having less a two employment history, in which I provide supporting documentation for supporting I had a two year work history. ( I was hurt on the job and was out on workmen compensation ) and the owner 's wife who is the bookkeeper put the incorrect dates on my verification of employment. The other was my debt to income ratio but I am really not sure why this was an issue as I could have paid off and closed any debt to reduce my ratios. ( Our income is {$5100.00} and our proposed housing payment would have been {$1300.00} making our front ratio 27 ). My credit has been ran multiple times and the report was n't even 120 days old. Why was my credit ran after the application ( XX/XX/XXXX )? This is very disturbing, my wife and I are very disappointed in how are our mortgage was mishandled, misled, Totally lack of communication at times with the loan orginator XXXX XXXX, professionalism and respect. I thought FBC Mortgage was a reputable organization referred through XXXX XXXX as we were looking forward to being homeowners. What FBC Mortgage did was not right and if I could get my message across to help someone else who may have experienced what I went through it could mean a lot. Everyone deserves a fair opportunity to become homeowners.

I attempted to find a company to help build me a new home this year. I went to XXXX XXXX XXXX in XXXX, FL. After filling out the application and spending 2 wseeks going over options and home builds. I was told I needed to apply with FBC Mortgage in XXXX, FL in order for XXXX XXXX XXXX to continue to set up plans to fully qualify me for my home build. I mentioned that I would use my own bank or my previous mortgage broker who helped me a few years ago, and they said No! I was told that I had to go through FBC Mortgage first in order to see if my credit and income qualified. I was told that I would receive a better rate and lower paynent by going through this mortgage company. I called them even though I felt the whole situation was being monopolized and I was being steered towards an affiliate of theirs only. I spoke with a young guy who had very little knowledge about my situation but kept making promises. He said that if I used them they offer a discount on the appraisal because i was referred by XXXX XXXX XXXX. When I tried to insist I would use my own mortgage company I had XXXX phone calls from various managers from both FBC and XXXX XXXX. After about a month of being harassed with calls and rude managers telling me I had to do it a certain way i decided that neither company was for me. I read the negative reviews online and they all seem to have the same problem. As a business owner and a consumer i feel that the CFPB should look into this relationship and how it is affecting consumers and alos possibly violating the Dodd/Frank and or other regulations that cover steering, affiliate business, and customer options. Also why is it that they only advertise ( 1 ) lender on their website and not other local options?

My XXXX report notified me that my previous mortgage lender showed me with a 30 day late payment as shown below. However, my account was paid current and never late and was actually being transferred to another lender three months after FBC originated the loan with me. I was then sent a letter from the lender stating that I was protected from any late payments under Federal law for 60 days while the loan was being transferred on XX/XX/XXXX. I made my XXXX mortgage payment to FBC on time and their records will show the same. They then had to send that payment to the new lender since the new lender took over the account and was not showing a payment made to FBC XX/XX/XXXX. FBC then transferred my XXXX payment to them to get it current and for some reason they reported the payment as being 30 days late. Not only is this fraudulent, but they violated my Federal protection during the 60 day transfer window. I have contacted FBC via phone XX/XX/XXXX and they said I have to wait 60 days for it to update. This is not acceptable and is fraudulent reporting on their behalf. On XX/XX/2018 I was alerted through XXXX that a negative item was placed on my credit report and needed to be reviewed. Upon logging into the XXXX XXXX XXXX portal, I was alerted that FBC Mortgage has reported a account as 30 days past due. FBC sold my previous account to XXXX XXXX in XX/XX/2018. All payments prior to the sale of the loan were made on time or before schedule. I contacted FBC today and spoke to a customer services representative who informed me that yes, in fact FBC did report inaccurate information to the 603p bureaus. I asked for this to be corrected as it is the duty of the furnisher to ensure accurate information is reported to the bureaus. I do understand that FBC has 30 days to perform a re investigation as to the inaccurate reporting. However, I was told that I needed to provide complete copies of my personal credit report to FBC so they can do the re investigation. I should not have to provide proof to the lender if they reported the information inaccurately and they are the ones who have a contractual business relationship with that bureau ( s ). The customer service representative stated on a recorded line that in fact it was FBC 's mistake and was reported incorrectly. If I sent my complete credit report to them via fax or mail, once they received it, they would review my claim. My concern is that if I needed to apply with a lender and they saw a possible " 30 days past due '' on a real estate loan, that I would be considered high risk when in fact I am NOT and NEVER WAS past due on that loan.

New home consultant, Lender ( FBC mortgage ) and myself began to Converse about purchasing my first home ( conventional loan ) I wanted to move forward I filled out a loan application, signed a contract and my credit was pulled I was advised by lender to get with his credit repair company he works closely with to get my credit up for a better interest rate down payment was made ( XX/XX/XXXX ) I never received an approval letter or a denial letter. Lender pulled my credit several times without notify me or communicating with me for five months. My credit is going down paid credit repair company emailed me in XX/XX/XXXX stating he needs 4 more months to work on my credit I canceled repair service. Notify the lender and builder of my cancellation once I did that home is complete in XX/XX/XXXX they schedule closing date XX/XX/XXXX I was not able to close due to my credit score builder ( 13 floors ) said I 'm in default and they are keeping my down payment ( {$19000.00} ) Builder 's attorney sent me a default letter with an extension for XX/XX/XXXX with penalties {$170.00} per day starting from XX/XX/XXXX up until XX/XX/XXXX. Because I did n't let them pull my credit on XX/XX/XXXX due to me getting a new Lender and attorney I received a letter stating my deposit will be disbursed to the seller directly and the property has been placed back on the market for sale.

I have tried for six weeks to get XXXX to endorse and send checks from Insurance company to pay for work done. XX/XX/XXXX Roof Damage XXXX XXXX issued half payment check to get work started. I mailed to XXXX XXXX they endorsed and Work started. Work was completed XX/XX/XXXX. Insurance company inspected and approved Issued checks for final payment County inspected and signed off on the work as well. I mailed insurance checks again to Mortgage company and they returned them UNENDORSED. They claim they needed to see the estimate and W9 for the roofers and a list of documents. I mailed the documents and check AND ALSO faxed them as requested. I was told they do NOT correspond through Email. I then received a letter stating that they understand that I have had damage. Which makes no sense since they endorsed the checks to start the work. I called and was then told that the roofer needed to fill out one of their special forms. I requested it sent to me as well as a call back from a supervisor. Six weeks have passed and they are still holding the checks from the Insurance Company. I am not able to pay the roofers who did the work. As far as the insurance company is concerned the work is done and the claim is finished. Each time I call they are rude and I feel as if they are being unreasonable when I only want to be able to pay the workers for what they did. My insurance company provided the check payment. This is just a simple endorsement.

I purchased a home and received financing through XXXX XXXX XXXX in XXXX of XXXX. My mortgage was then sold to FBC Mortgage , LLC at the end of XX/XX/XXXX. Then, without me knowing, FBC Mortgage LLC sold or transferred my mortgage to XXXX XXXX XXXX and Reporting. I NEVER received anything in writing that my loan was transferred from either FBC Mortgage LLC or XXXX. Furthermore, I qualified for a 3 month deferral on my mortgage payment because I live in a federal disaster qualified area ( Hurricane Irma ). I called in and spoke to who I thought was FBC Mortgage LLC, but who I have now determined to be XXXX, and was told on XX/XX/XXXX by a rep at XXXX that I qualified to have the 3 months of payments added on to my loan, and that I would not have to make those 3 payments after the 3 month deferral period. I then received a letter in early XXXX of XX/XX/XXXXstating that I did not qualify for a loan modification and would need to bring my balance now in full ( pay for the 3 months of deferred payments, plus present month 's payment ). There are a number of issues with what has taken place here. FBC never notified me, and by law are required to. And the rep at XXXX flat out lied to me on the phone. I thought that I was all clear on the 3 months of deferred payments and would not need to pay those now, and as a result, based on what the rep told me, i used that money to pay down other debts. On XX/XX/2020 we signed a contract with XXXX XXXX, with the obligation to do business with FBC/XXXX mortgage company. If we didnt get the loan FBC/XXXX we will not get the house. Or so we thought. We were harassed into selling the house and paying off the car. We supplied all the paperwork. We believed that they will honor a FHA loan but they are not interested in complying with it and all they have done since XXXX is prolong the process, hindering, lying, deceiving, a XXXX score credit is not good enough. We had spent about {$20000.00} that no one is going to give back!! We believe them! They DONT give FHA loans!!! Even though they offer them!! They harassed us, pushed us, laughed at us, because they knew that they were going to be able to get away with it. And that NO ONE in this XXXX forgotten Country was going to do anything to stop them!!! We are homeless, my childrens college money down the drain, just because we believed. I feel like the jelly bean test again, where no matter the answer, no matter how many times you try, you still a loser!!! XXXX XXXX, FBC loans, and XXXX Homes are to blame! Pulling the credit until is useless!! XXXX credit score takes you nowhere, and to bring it back up take decades!! But they know the game and how to play it, because while their greed is controlling them ; we, my family and I are homeless. Shame on you USA!

I talked to a loan officer in Florida where I am trying to relocate to. He advised me that the only way to buy a house there before moving was to buy it as a second home. He knew from the beginning that the intent was for it to be a primary home. He advised us to give all the money we had saved to a XXXX party to " gift '' to us, as no funds would have to come from our account. Every thing was going as he said it should until 2 weeks before closing. Underwriting told him that 5 % of the funds had to come from our account, But we had already gave all the money to the XXXX party as he told us to. We told him we could put the money in there but it would be cash, Then he advised that I sell a vehicle or other valuable item so the money we need could be sourced. He admitted that it was his mistake and when it seemed he could not fix the problem he found another item underwriting had an issue with to try and blame his mistake on. Lost all the money we had invested for appraisal, inspectors ect. We even had yard sale and sold half our belongings on the assumption we could close on the house and move in a few months. My wife who is pregnant is seeing a doctor for all the stress that was created from the situation of losing the home and loan. As I was filling out this form tried to get copies of good faith estimate and other documents the website wont allow me to veiw them.

My financial institution mailed a check on XX/XX/XXXX. FBC Mortgage LLC mishandled my payment. They assigned a late fee on XX/XX/XXXX of {$53.00}. They cashed the check sent by my financial institution on XX/XX/XXXX on XX/XX/XXXX. I then wrote a letter explaining the situation to FBC Mortgage LLC on XX/XX/XXXX and asking for a refund of the late fee. To date I have recieved no response and recieved no credit on my account. It seems a questionable financial practice to take 20 calendar days to process a payment. It seems unfair to assess a late fee when payment was received within the required timeframe. It seems a calloused practice to ignore my written request for a refund of an unfair fee. To make matters worse I also called the payment processing dept. of this company on XX/XX/XXXX. I was offered an online payment service. I asked the representative if my payment delay would have been avoided by use of an online payment service. I was told by the rep. the company often mishandles automated payments. They are in need of an upgraded payment system but are unwilling to upgrade the system. I would like my mortgage sold and transferred to a financial institution that will treat me with the respect and dignity I deserve. I make my payments on time and have done so for over 16 years of homeownership with institutions like XXXX, XXXX XXXX and XXXX.

In XXXX XXXX, I filed a complaint on FBC [ Case number : XXXX ] due to the miscalculations for a loan modification. FBC did reply the complaint and admit fault and since I 've re-sent documentations for a loan modification to FBC. On a weekly basis, I call and check on my loan modification but it seems no update has occurred. For example, I called on XXXX XXXX, XXXX and spoke with XXXX XXXX rep # XXXX and she informed me they received all my documents and the opener has 5 business days to review the documents before sent to the underwriter or the consumer is contacted if further documents are needed. XXXX XXXX informed me the day I called, XXXX XXXX, XXXX, was the final business day and there will be an update by tomorrow. So, I called FBC on XXXX XXXX, XXXX and spoke with the same rep XXXX XXXX who informed me she will check with the opener again and will escalate my case. Such " run around '' is frustrating, unacceptable, and unprofessional. My intent is to keep my home yet I feel FBC is dragging the process with the intent to take my home away from me. I faithfully follow-up with FBC and give any requested documents in a timely fashion yet FBC is not working with me. Please look into this matter as my intent to reinstate our mortgage and keep our home.

My home was in a federally declared disaster area as a result of hurricane Irma. This natural disaster caused my family to incur additional, unplanned expenses. I was made aware of forbearance opportunity for people like myself who are in a federally declared disaster area and requested this from my lender, FBC Mortgage. FBC was corporative in providing this forbearance and gave me 3 months with no mortgage payment. I did not need the entire 3 months that was provided and only took 2 months ( XXXX and XXXX ), paying XXXX plus some additional monies to catch up, in a timely manor. Now I expected, as my interpretation of the federal law that the 2 months that I missed would be added to the back end of the loan. FBC is not allowing that. I would then expect to be able to increase my normal mortgage payment for a few months to catch up on the payments that I missed. FBC mortgage has denied me a repayment plan. In fact, the extra amount included with XXXX mortgage payment was " unapplied ''. FBC has declared me delinquent and is insisting on a Modification. I believe you will find FBC Mortgage is in violation of federal law. FBC Mortgage is not looking out for their customers and not allowing reasonable accommodations to settle up after a natural disaster.

From XXXX XXXX I was contacted by FBC Mortgage , LLC Underwriter XXXX XXXX and she was disrespectful and Call me to verify a credit card that was paid off and was at a XXXX balance. She had me call XXXX on the phone with her on the line to verify that it was a XXXX balance. I had to state my password and other personal information and once I completed the call I called XXXX and changed my information. I submitted documentation showing my credit card had XXXX balance and credit in my favor. I also submit the document for my XXXX XXXX as well. She went on to ask me why I purchase grocery at the military base and why did I withdraw {$140.00} from the ATM. She stated are you sure that was your XXXX XXXX money and that is when I stop speaking to her. When I requested FBC mortgage for her information and that I will like to file a formal complaint against her for her unethical and disrespectful behavior. I feel she was discriminatory towards me because of my veteran status. FBC gave me only an email to file the complaint and no one has contacted me. FBC refused to give me her information or reprimand her or even apologize for your behavior. This is no way to treat a veteran and a XX/XX/11 survivor. This underwriter is biased towards veterans.

Hello, My husband and I refinanced on our mortgage with FBC on XX/XX/XXXX. We went from FHA loan to Conventional loan. Everything went well. We've had several mortgages with this lender. Our first payment was due on XX/XX/XXXX for {$1900.00}. We made our payment on XX/XX/XXXX. The end of XXXX we received an letter from FBC stating they sold or loan to XXXX XXXX- XXXX XXXX.I contacted XXXX XXXX the lender and was told that my paperwork and statement will be mailed to us within the next few business days. I called XXXX XXXX again the third week of XXXX and finally was able to get an account number to set up our account online to make a payment on XX/XX/XXXX we made our XXXX payment for {$1900.00} which was deducted from my account on XX/XX/XXXX. I've recently checked my credit report and saw that for the month of XX/XX/XXXX my husband and I were reported negatively that we were 30-90 days late with FBC Bank. This is inaccurate and we will like this matter to be rectified and immediately. We are doing another refinance and not only it's hindering our approval it's impacting our credit scores.

In the summer of 2015 XXXX XXXX XXXX of FCB Mortgage, XXXX XXXX XXXX XXXX XXXX, XXXX XXXX, Florida XXXX verbally approved a mortgage for my family to purchase a newly constructed XXXX XXXX in XXXX XXXX. While in the presence of the XXXX sales team he advised us we were good and asked us to provide a deposit of {$19000.00}, in which we did. During the ensuing XXXX8 months when the house was being built we were called by XXXX inviting us to visit the house when it was near completion. XXXX gave us an access code for entry and invited us to a XXXX XXXX meeting for new residents. We completed their final walk through with XXXX and was provided with a final XXXX to close the loan. When we began the process of wiring the closing costs through the title company, FCB Mortgage called to say the loan could n't close. Suddenly on the day of closing, FCB changes programs and requires additional insurmountable conditions. Now we are being told we can not get our deposit back. XXXX XXXX was aware of the approval as they contacted us with closing dates.

Hello CFPB : I closed my mortgage with FBC mortgage , LLC, in XXXX, FL, loan number XXXX, back in XX/XX/2016, first payment was done on XX/XX/2016, since then I have been a good customer and have paid my mortgage in time. Today, I have another company sending me an email, yes, an email, not a formal letter, no official request, but an email stating that it is time to pay my mortgage to this new company, apparently my mortgage was sold to a " XXXX XXXX '' without being notified by either part except via email. With all the issues with identity theft, these crooks make business between them without notifying the most important link here who is the consumer, while believing an email will suffice to collect a mortgage payment. There is a binding agreement between customers and loan companies and it works both ways. As customers, we can expect a loan to be transferred/sold, but we should be notified in advance of this not via email.

FBC Mortgage ( serviced through XXXX ) is taking my home away through a foreclosure sale on XX/XX/2019, even though they have failed to review my loan for retention options. I am a XXXX veteran on a fixed income who fell behind on my mortgage when I lost some of my benefits. When I contacted FBC Mortgage/XXXX, they said there was nothing I could do except to pay the full past due amount. This is impossible and I thought that they had to help me keep my home. They are short and rude with me on the phone and there isnt anything I can do to change their minds. I have never had a single point of contact and I need some help with them to stop the sale date and initiate a review for mortgage assistance. I did not survive my combat tours in XXXX to become a homeless veteran. I am hoping your agency can help turn things around and get them to work with me instead of taking my home away.

On XX/XX/2022 got the notification of the HAF department that I was approved for mortgage assistance for past due payments and an additional 6 months of forward payments. The approval letter has been sent to my mortgage company which is FBC Mortgage. My loan number is XXXX. The amount past due that was sent out to the mortgage company is {$10000.00}. This amount was sent out to FBC Mortgage in XX/XX/2022 and they still have not posted it on my account. I have been calling FBC Mortgage every week since XXXX and they always give me the same answer : they dont have it. I called the HAF department and they show the mortgage company has cashed their check. I dont understand how this could be possible. Its very unfair for them to be holding a check for more than 30 days now and having my loan to accrue more money in interests.

FBC Mortgage purchase an insurance using my escrow account money without my permission. My previous lender sold my loan to FBC Mortgage on XX/XX/XXXX. When this loan was transferred, I did have an active insurance policy, which covers from XX/XX/XXXX to XX/XX/XXXX. This insurance policy covers sufficiently already. There is not much difference within the two policies. The new policy is just more expensive. Moreover, FBC Mortgage asked me to cancel my old policy. I want to stay with my choice of insurance policy. I have tried to contact FBC Mortgage and the insurance agent XXXX. There is no one answers the phone or replies the emails. I have looked the website and people are saying FBC Mortgage can get kickbacks from insurance agent by doing this. This is illegal.

We applied for a loan mitigation with FBC Mortgage. We were denied twice ( 2x ) due to ( according to FBC ) our income being to low and debt ratio being too high. I was approved for the loan on my income alone and was with the same job with increase in salary. After the 2nd denial, I added my husband 's income ( $ XXXX monthly ) and still was denied. My wife applied for a loan estimate on my behalf at FBC Mortgage , LLC. They demanded additional documentation ( pay stubs, XXXX, tax returns, drivers license, bank statements, college diploma, educational transcripts ). She provided all documentation, and finally 2 weeks later, they sent an unofficial estimate ( " Pre-Application Worksheet '' ) that states : " Your actual rate, payment and costs could be higher. On XXXX XXXX, 2017, I received a 3rd denial letter from FBC stating I am ineligible due " income is insufficient to qualify for any foreclosure alternative programs at this time. '' I submitted a complaint about FBC not properly calculating my income and they admitted fault and I had to resubmitted paperwork to once again prove income. For 14 months, I 've been fighting with FBC by sending the requested documents and waiting the allotted time for an approval only to be denied again. I 'm building a new home XXXX. We have had little issues here and there since day one. A major issue we are having is with the lending company that XXXX uses. There has been several discrepancies to the point where we decide to seek out our own lender to get a better rate. I paid my mortgage twice on accident so when I called they told me they would be able to refund my money back. I talked to them XX/XX/XXXX and today is XX/XX/XXXX. I make bi-weekly payments with the belief that early payment is being applied to the principal of the loan. Mortgage company however does not apply partial payments until due date. Therefore, I get no benefit from early payment. I also make an extra payment each year. I am under the impression that all early payments are to be applied to the principle as I do not have a prepayment penalty clause on the contract.
