Fairway Collections LLC and XXXX XXXX, Attorney at Law in XXXX WA have been attempting to collect a debt from a former employee of my small business. XXXX I received and returned paperwork asking me to garnish her wages. It was clear in the papers that she was not eligible for wage garnishment as her salary was too low. I hand delivered those papers to Fairway Collections.
Awhile later, I received a collection notice telling me I had been turned into collections for {$1400.00} as the agency had been to court and got a judgment against me and my husband ( which will be on our credit report for 10 years. ) We never received any notice of a hearing, so we were n't able to defend ourselves. We have now been summoned to a hearing on XXXX/XXXX/XXXX to appear in court to " answer questions concerning their/his/her property. '' They are requiring us to bring 5 years of tax returns, an itemized list of records of all accounts receivable, earnest money receipts, deeds, mortgages, appraisals of any property we own, bills, cancelled checks, bank statements, and savings programs, certificates of stocks, financial statements delivered in the last 5 years, and evidence of any credit cards of lines of credit.
They have also said if we do n't appear they will issue warrants for our arrest.
Keep in mind this is not, nor never was our debt. It was incurred by an employee that does n't even work for us anymore! Also, she incurred this debt years ago, long before she was our employee. Further more, she was not ever eligible for wage garnishment the entire time she worked for us. I have been clear with Fairway Collections Agency about all of those things, and yet they are coming after us and threatening us with court and jail time. It 's ludicrous.
I have had to seek help from my accountant and attorney to fight this unfair and irresponsible collection effort. I ca n't believe it could possibly be legal. I feel they have been very intentional about keeping information from us. The first request for information came certified mail and I returned it. Now they claim to have sent a second request for our employee 's wages and a hearing notice, but by their admission, neither the second request or court papers came certified. Also, they send everything in unmarked envelopes. IF they sent them, they would have been delivered to whichever XXXX was working. I never saw anything. I would like to see some action taken against this company as I have heard from several people in my community who have had similar experiences with this agency after going through it myself.
Also, in researching XXXX XXXX 's ( Fairway Collection Agency 's attorney ) address online, I discovered he has already been disciplined by a state licensing agency.

Fairway Collections is suing me for a debt incurred XX/XX/XXXX. The debt was for {$160.00}. They garnished my husband 's wages and collected {$230.00}. They did n't garnish anymore and thought the debt was paid. Then, in XX/XX/XXXX they attempted to garnish again and we made a payment agreement paying another {$150.00}. ( at that time I was suffering from the effects of XXXX XXXX XXXX ) Again, we thought our obligation was finished. Now they are attempting to garnish my husband 's wages again for the same debt and this time have tacked on interest, court fees, etc. for a grand total of {$1500.00}! That is 12 times the amount of the original debt! We offered them our entire income tax return of {$400.00} and they refused! Please help us. My husband just got a new job because his company is closing. The new medical insurance is unaffordable for me and being a XXXX XXXX survivor it is very important for me to have insurance. We were in the process of purchasing insurance for me but the collection agency will take XXXX % of my husband 's paycheck.

I hired an lawyer for a legal matter, she when on maternity leave after taking the case and handed it off to another lawyer. However I was still being billed for XXXX lawyers. I was charged from the lawyer that went on maternity leave the day after she had her baby for a court hearing to which she was not there at. I did not sign a retainer document for the second lawyer but they demanded that I pay XXXX retainers. XXXX lawyers charged me for the same items, and not the credit collection company is telling me that they are going to take me to court. They faxed me the " proof of debt '' and their own ledger does not support the amount of money being asked for.

On XXXX XXXX FAIRWAY COLLECTION added a derogatory mark on my credit report to XXXX & XXXX. Upon further research, this account was transferred/sold and I am no longer responsible for the account. debtor creditor did not verify this collection, also there was no written form of communication, contract or signature for this accused debt at all. A bill without a signature does not validate the debt and anybody can send a bill and say its mines. according to the FCRA FAIRWAY COLLECTION has violated my rights as a consumer and I am requesting legal action to remove this account immediately

After requesting " proof of contract '' from collection agency " FAIRWAY COLLECTIONS '' on XX/XX/2017, I have not received a response. Lack of response to my request thus constituted a tactic agreement that FAIRWAY COLLECTIONS is not entitled to enforce a collections claim against me, due to FAIRWAY COLLECTIONS inability to provide proof of contract.
Despite this fact, FAIRWAY COLLECTIONS continues to report a collection claim against me to the credit reporting bureaus, thus causing damage to my credit profile.

Hello on XX/XX/2020 Fairway collection debt collector, filed a writ of garnishment. Before the garnishment, my balance with them was around XXXX. My bank account was put on hold because of writ. Once I found out that they couldn't garnish my unemployment my only income. I filed a appeal the bank release my money. Now fairway wants me to pay for legal fees that makes a new balance of {$4500.00}. I feel that I shouldn't have to pay this amount for the mistake they made.

Fairway collections refuses to supply me with an opt out disclosure letter.they are refusing to allow me to opt off of sharing personal information. When I asked them to furnish letter I was yelled at by three different people telling me that they do not have to furnish the opt out disclosure and told me to XXXX information because I was not familiar with the law
