Today, Each of my Family members received phone calls on each of their phones and on each call 's message, they ask for my son but then say if he does not call them back by today 's end, they will take out litigation against him. They left this message on each of our phone numbers, mine, my husbands, my daughters and so forth. This all took place within a 30 minute window and then they called my son twice within 3 minutes of each other and left two messages also threatening litigation against him on the message. I have asked everyone to save these calls for a Record. Each call came from a number listed UNKNOWN except one to our home which came from a name XXXX XXXX who left the same message. Each of us became alarmed and contacted my son who said he was already working on it. We also contacted our Family Attorney who said these calls violate FTC Laws as a Debt Collection Company can not call a Third Party and threaten a lawsuit on a Voicemail about someone else in regard to a debt. I let my son know this and he then looked up the number which is listed for a Candle Company in Missouri online but whomever answered was who had called each of us. He then was transferred to different individuals before getting on a call with a gentleman named XXXX XXXX. Mr. XXXX then explained about a debt that my son had and then my son began asking more information as he did not recollect this debt. XXXX then said this was paid to a bank account owned by my son via XXXX XXXX in South Dakota. My son explained he has never had a XXXX XXXX account nor any affiliation with South Dakota. Mr. XXXX did have an old e-mail address from 3 years ago correctly and my son 's social security number but he then said who my son does or had worked for as his employer and it was with a company he had never heard of. My son then began to ask questions as we have instructed him to do so in the past with these types of calls as he has been down on his luck and at times receives calls and so we have instructed him how to handle them and my son was then given the XXXX XXXX account number and routing number supposedly associated with this debt and he then also asked for who owned this debt and the company XXXX worked for. Mr. XXXX stated he worked for F & M Capital in association with XXXX XXXX and the debt was owned by XXXX XXXX XXXX. My son then told XXXX it was illegal to call Third Parties with the threat of Litigation against him about a debt. XXXX said that they did not have to follow FTC guidelines because of how old the debt was, it was supposedly from XX/XX/2016. My son then stated that he would like to do a three way call with XXXX XXXX to verify this account and the call with Mr. XXXX was then disconnected. My son then called XXXX XXXX himself and the call was escalated to a supervisor whom after the discussion, they said they were going to have their Case Management division investigate this as they do not recognize this account number or my son 's name as he has never been a customer. They and our attorney instructed my son to call back the number he had been in communication with via XXXX XXXX and F & M Capital and was transferred to a voicemail and he left a message providing the feedback from XXXX XXXX and to Cease and Desist any further calls threatening legal/litigation against him to all family members and himself. These calls really unnerved my son as it did us. We are passing all of this on to our Family Attorney in addition a Case File has been opened at XXXX XXXX to assist in investigating and also if these debt collectors are going to call, we want them to follow the FTC laws even if they say it does not apply to them, for in our contacting the FTC, the law does apply to all debt collection institutions.

I received a call from F & M Capital in XX/XX/XXXX stating that they were attempting to collect debt from unpaid student loans from XXXX University. I let them know that was inaccurate because my student loans are in deferment through XXXX XXXX because they are under investigation by XXXX to be forgiven since I submitted proof that XXXX University was mishandling my student loan money. To this day they are still in deferment and I am in good standing with XXXX. They did not let me explain this in detail because their paralegal was screaming at me and telling me they didn't care what XXXX did or said that I still owed them money. I told them I was not going to pay anything to them when I know I am in good standing with XXXX who manages the loans. They stated they were going to sue me and take legal action against me. I hung up because they continue to harrass me and scream at me to the point where I could not speak. Today XX/XX/XXXX I received a call again and they stated they were looking for a XXXX XXXX and calling about a XXXX account and they were with F & M Capital. I told them I didn't know who F & M Capital was because it has been a few months since they called and at the moment I didn't recollect the name. He repeated my information, but did not mention what debt they were trying to collect. Not to mention this person did not mention his name and called me from an Unknown number. So I told him again sir I don't know who F & M Capital is and I need more information before I give any information or can help you. He said I can transfer you to our paralegal. I said no if you can't give me any information I don't need to be transferred to anyone from an unknown number. His response was WOW we have in our system that you were difficult last time we spoke to you and from this conversation I can see you difficult to work with and from there he began to scream at me and I had to pull my phone away from my ear. I told him sir you're an attorney and he continue to scream. So I had to speak over him with my phone away from my ear and tell him if you are an attorney as you claim you should know that no one is going to give someone from an unknown number any confidential personal information. He continued to scream over me, I repeated myself again and hung up. He immediately called me again and it was an unknown number again and rejected the call. I tried to go on their website XXXX XXXX XXXX and they do not have an email that I can send them a cease and desist letter to leave me alone. The XXXX account with my ex husband has been closed since our divorce as it was part of our divorce decree and XXXX has told me that I am in good standing and my loans are being investigated and are deferred until a decision has been reached. I don't have proof because they are calling me from unknown numbers and don't have email address to be able to respond with trackable information.

Received a from a blocked number on XX/XX/2019 at XXXX XXXX caller left a message on my voicemail. Transcription of the message : Good morning this message is intended to reach out to XXXX XXXX XXXX my name is XXXX contact you on behalf of FM capital reaching out to you today in regards to a pending complaint in your name and Social Security number before any decisions or recommendations are rendered we do proceed forward we're looking to get in touch with either you directly or your legal counsel a statement can be provided by contacting XXXX we will be notifying the appropriate parties as to whether not he's contacted and cooperating on a voluntary basis this call has been documented and recorded thank you and have a good day My mother XXXX XXXX received a call immediately after this message was left on my voicemail. The person identified herself as XXXX with FM Capital My mother asked what this was pertaining to and XXXX responded " Bad Checks across state lines '' This is a clear violation of the FDCPA Section XXXX. Acquisition of location information Any debt collector communicating with any person other than the consumer for the purpose of acquiring location information about the consumer shall -- ( 1 ) identify himself, state that he is confirming or correcting location information concerning the consumer, and, only if expressly requested, identify his employer ; ( 2 ) not state that such consumer owes any debt ; and 805 ( b ) Communication with third parties Except as provided in section 1692b of this title, without the prior consent of the consumer given directly to the debt collector, or the express permission of a court of competent jurisdiction, or as reasonably necessary to effectuate a postjudgment judicial remedy, a debt collector may not communicate, in connection with the collection of any debt, with any person other than the consumer, his attorney, a consumer reporting agency if otherwise permitted by law, the creditor, the attorney of the creditor, or the attorney of the debt collector.

A person called my x-father-in-law 's home several times looking for me. They left a message on his home phone stating that it was very important that they speak with me and would he give me the message. They said they were calling from " XXXX XXXXXXXX XXXX '' and to call them back at XXXX. They also left a number, an account number maybe, of XXXX. The person who left the message was very bad English and it was difficult to get this information. Please note that I have never given my x-father-in-laws name or number to anyone as a reference so they had to look me up online to see people associated with me in my lifetime. I called on the weekend with no-answer. I just called again and the person who answered the phone didn't even give the name of the company, I had to ask him for it. The way that he answered the phone and conducted himself was very suspicious ; not like a legitimate company. He said it was XXXX XXXXXXXX. Then I asked him who was XXXX XXXXXXXX and he said it's a compliance company. Then I asked what kind of company it was and he said it was a legal firm and that one of their legal representatives must have tried to contact me. He did have my date of birth on record and didn't ask for my social security number - I wouldn't have given it to them anyway. He then said he would get someone to speak with me and left me on hold for quite some time so since I'm at work, I hung up. I see online that many people have been contacted by an F & M Capital and they have used abusive language and/or tried to collect what appears to be fraudulent funds from individuals. I think may be linked to a previous complaint of mine to CFPB for XXXX who stopped calling me after you got involved. If this company says that they are attempting to collect on behalf of XXXX XXXX XXXX, who I placed with a debt settlement company several years ago, that is a lie because I've contact XXXX twice and they are not collecting anything from me, do not know who these other people are and do not care.

On XX/XX/XXXX my brother received a voicemail from XXXX XXXX who stayed that she was with F & M Capital in the bad checks division. She said she had a formal complaint against my name and social security number, regarding a series of bad checks that were passed across state lines. She then called the store that I work at and spoke with the pharmacist who passed her off to the front end ( the department that I work in ). She started immediately asking a supervisor ( who actually works under me ) how she could go about garnishing my wages. She stated that she could not leave a voicemail because my mailbox was full. I verified that my mailbox was empty and then I called XXXX XXXX and asked her to provide me with a validation of this debt. She said that she had already sent mail, email, etc and I verified that she does have the correct information for me, however I have received nothing regarding this from them. She said that I owe {$2600.00} to XXXX XXXX XXXX from XX/XX/XXXX. I explained to her that I believe that this debt had already been paid and she told me that is the most ridiculous thing Ive ever heard! You need a lawyer because they are going to nail you to the wall! When I asked about her calling my place of employment she stated that she was simply verifying my employment so that she could move forward with the wage garnishment process. I explained to her that there is no HR Dept at the store level, only at corporate level and she said that she would be calling back to speak with my store manager at XXXX tomorrow. After our phone call, I signed into my XXXX account and it said there were no active accounts. I do believe this debt was paid years ago and I do not appreciate F and M capital calling myself, my family, and my work divulging personal information and making threats regarding a debt that I have yet to see validation for.

On XX/XX/XXXX I was contacted by a company called F & M Capital who said I owed money to a payday loan company from XX/XX/XXXX. The name of the Payday Loan Company was through an XXXX XXXX named XXXX XXXX XXXX. I was going through a divorce in XX/XX/XXXX, and needed money to pay for my attorney to keep the custody of my children. I thought I had paid all of my debts, and transferred them when I moved, but I somehow missed this one. I was threatened by someone named XXXX with legal repercussions to include my not being allowed to open bank accounts in the future and said I committed fraud. I did not know the amount I borrowed, and he said I had made payments at first, but stopped. I explained that I moved, and did not know all of the debts did not move with me. I asked how much I owed and he said {$1500.00} was the original loan amount. I asked if I could pay that amount, and he said no- that I now had to pay {$7800.00}. I asked him to mail me paperwork showing me this loan, and he said he couldn't. I told him I was willing to pay them the entire amount in full, as I was unaware of the debt, but needed to see how much I borrowed. He said he couldn't but he would settle with me for {$3100.00}, as he " understood my situation ''. Again I asked for paperwork. I received an email in which they told me I needed to call the loan company directly to get the paperwork through a " chain of title ''. I don't have a record of this loan. It doesn't show up on my credit report, and I feel like they are illegally threatening me. I also don't know how they could possibly charge me now so much more money even after I offered to pay the amount of the original loan. Can you please help me? He calls a few times a week and has reached out to my family members as well.

I was contacted by my father today, XX/XX/XXXX and told that a " XXXX XXXX '' from the Bad Check Division was attempting to reach me about bad checks I wrote from my checking account. I called this company ( F & M Capital ) and spoke to this XXXX XXXX who told me I wrote 17 bad checks to XXXX XXXX XXXX in late XXXX XXXX and told me that action was being filed against me. I asked for any sort of proof or documentation, and he said that because of the type of loan it is, and because he wasn't the original office where the debt was held, he could not provide me the information. When I asked again, they said they send one Dunning notice and that's it, because " people use certified letters to dodge their debts ''. He emailed me a settlement offer as well. I asked him why he disclosed information to my father, which he initially lied, then admitted to. This is not the first company that has contacted me, there was another company from upstate NY that billed as : XXXX XXXX XXXX XXXX XXXX XXXX, XXXX, New York XXXX, United States ( XXXX ) XXXX They threatened legal action, made vague personal threats and said they would come to my job, so I paid them a small payment to get the harassment to stop. That payment was XXXX, but I made no others due to that company providing no documentation. This company today said they had no records from the previous collector, but knew about that amount paid and has an address that is similar. I would like this harassment to stop. They contact my brother and parents and tell them personal info, and it is inappropriate.

I received several voice mails from F & M Capital in the past few weeks discussing a debt they claim I owe and threatening that legal action would be taken. I have never received any written communication from them and my voice mail greeting does not state my name. Today I received a voice mail from them claiming that I had been writing bad checks and threatening me with jail time. I do not write checks and again, my voicemail greeting does not reveal my name in any way. Today they also called my father and left him the same voicemail, claiming that I wrote bad checks and could serve jail time and to have my attorney contact them. I have not contacted them or answered their calls because of the legal threats. If they intend to take me to court for some debt, they need to contact me in writing and not discuss private business through voice mail and with third parties. The number they called from this time was XXXX.

I keep getting phone calls from someone saying his name is XXXX XXXX using a very abusive and brash tone saying I have to call him back so he can notified the creditor of my " willing participation '' before a certain time or legal papers will be filed. He claims mail has been sent and returned to him as undelivered, however I have had the same address for almost 5 years and he was able to find a newer cell phone number for me. He notes the phone conversation/phone call has been noted and recorded. Leaves a phone number of XXXX with no other information. I do not know whom this person is, where he is calling from, who he claims he represents, I don't know if it is a legitimate debt, old debt pass the time of collections, if it is a scam.

A company called FM Capital and a XXXX XXXX called me saying I had a bad check written out of state under my name and social, which I do not. She threatened legal action and said she had not heard from me after repeated attempts. I've never heard from this person before and I have definitely not received any notices in the mail about a collections item. She called from XXXX. Worse, this person left the same message with third-parties, including relatives. This made me look horrible. I also know this to be illegal. They asked me to call her back at XXXX. I received a phone call on Tuesday from F & M capital stating that I owe a past due amount to XXXX University in XX/XX/2014. They stated XXXX XXXX paid for my tuition and I had to pay either a lump sum of {$3500.00} or the Full amount {$5100.00} in monthly payments. I wasn't comfortable giving them my information.
