FH Caan threatened to garnish my wages. FH Caan has been continually delaying the completion of my agreement letter to be sent to the US Department of Education. I need the assistance of your office to get FH Caan to force FH Caan to send my agreement letter for my rehabilitated student loan needs to be sent to the US Department of Education. I. BACKGROUND OF CASE I took out a student loan from the US Dept of Education in XX/XX/XXXX for {$40000.00}. I have made almost {$30000.00} in payments over the years including the funds hijacked by the department from my IRS refunds. The letter from FH Caan indicate that the principal is {$150000.00}. and with interest and collection it is over {>= $1,000,000}. Note that FH Caan collection charges are {$32000.00}. The collection agencies have shuffled my loan from collection agency to another agency and turned my {$40000.00} loan to over {$210000.00}. The IRS hijacked my IRS refund in XX/XX/XXXX. I called the US Dept of Education in XX/XX/XXXX and was told that the Loan was in collection and that I had to contact FH Cann. In XX/XX/XXXX, I called FH Caan who told me that they had sent a letter to my employer to start garnishment of my wages and the only way to stop it was to start a monthly payment plan toward my loan. The FH Caan associate did a financial calculation over the phone with me and started a {$140.00} per month payment plan which they have been deducting from my debit card every month. The FH Caan associate told me he was sending paperwork for me to sign and that I was to include 2 paystubs. I did sign the paperwork and sent 2 paystubs. In XX/XX/XXXX, XXXX XXXX informed me that my credit indicated that I was in default with my student loan. I called FH Caan who said the paystubs were not clear since I had taken a picture of the paystub on the computer. They sent me another set of forms for me to sign. When I looked at the forms, it was the same form that I had signed in XX/XX/XXXX, therefore I did not see the need for me to sign the forms and send it again. I also did not see the need to resend paystubs since the computer picture I had taken of my paystubs that I submitted inXX/XX/XXXX was the same clarity as the w2 stubs that I send to the IRS and if the IRS accepts the stubs then I did not see why FH Caan is saying that the stubs were not clear. In XX/XX/XXXX, the US Department of Education again hijacked my IRS refund for XX/XX/XXXX. I called the US Department of Education and they said that the agreement letter to rehabilitate the loan was not in my file. I called FH Caan and they said I had to fill out a new financial disclosure form which I filled out and sent by fax on XX/XX/XXXX. I also sent 2 copies of my XX/XX/XXXX paystubs since they said they needed recent paystubs. I sent the signed financial disclosure form that they said I had to fill out and the paystubs on XX/XX/XXXX. I called FH Caan the week of XX/XX/XXXX and XXXX said that the signed disclosure form was not legible and it had to be redone. XXXX did not even bother to read the writing as he could not even read the street address which had been printed. I told him that if he was refusing to even make a good faith effort in reading the form, then he should type it out and send it to me and I would sign the typed form and send it back. I again signed the new financial disclosure form and emailed it to them on XX/XX/XXXX. That week I again called FH Caan to make sure they got the form. XXXX then said that the medical and dental was incorrect since I stated that I was paying {$360.00} a month. I forwarded the email from the Dentist them with the patient ledger that the Dentist sent me. The ledger shows that my Dental bills were over {$4000.00} incurred in XX/XX/XXXX and XX/XX/XXXX. The Dentist is out of network with my insurance and it was required that I pay the amount at the time of the visits. As indicated on the ledger, the payment was made from my Visa Card. I told FH Caan that the {$360.00} per month that I am claiming that I am paying for dental bills go to pay off the Visa Card that the {$4000.00} Dental payment was made from. Once again, a copy of the Dentist patient ledger was sent to FH Caan the week of XX/XX/XXXX. FH Caan said my monthly payments would now be {$220.00} per month. I disagreed that the payments should be that high. I said their calculations were incorrect and they were not factoring the {$360.00} dental payments made monthly. They also said my monthly income net was over {$4800.00}. I disagreed as my biweekly take home pay is XXXX. I requested to speak to a supervisor and was connected to XXXX. XXXX said she would have the calculations include the dental payments. I received the new financial disclosure form ( attached paystubs ) on XX/XX/XXXX and I emailed it to them on XX/XX/XXXX. I called FH Caan on XX/XX/XXXX to confirm that they had received it. XXXX said they did receive it but now he said I needed to send 2 new paystubs since the XX/XX/XXXX paystubs were no longer current. I sent my XX/XX/XXXX paystubs on XX/XX/XXXX. I called on XX/XX/XXXX and left a message requesting XXXX to call me back to confirm that all documents were in order. I did not get a call back. I called again onXX/XX/XXXX and requested to speak to a supervisor. I spoke with XXXX and he said the paystubs were not in my file. I again emailed the paystubs while he was on the phone and he confirmed he received it. He started giving me this line that new calculations had to be done and that I was required to pay {$220.00} per month. I told him that that is not what XXXX had said as she said the inclusion of the {$360.00} dental payments per month brought the monthly payments to {$120.00} per month. He again said that calculations had to be done. I told him that they were going around in circles and they were intentionally missing deadlines as the paystubs and forms had to keep being redone. II. CONCLUSION FH Caan is not making any effort to get my loan out of default. I called the Department of Education and they said my file was missing the agreement letter, the letter that FH Caan is supposed to send them, to get my loan out of default. I have fulfilled my part of the requirements to get the student loan out of default and that they are preventing my loan from being out of default by their claims of insufficient documentation. FH Caan need to send the agreement letter to the US Department of Education to get my loan out of default. Please send me an email or call me if I can provide additional information.

I am filing a second complaint against FH Cann and Associates. I am doing so because I am appalled at the response they gave me on the first complaint I submitted through you the C.F.P.B. On the first complaint, I described how I had enrolled myself in the student loan rehabilitation program through FH Cann and Associates. I did so at the behest of the Department of Education because they informed me they had already assigned these student loans over to collections. FH Cann and Associates was the collector who the student loans were assigned to. I also described how the representative at FH Cann and Associates took me through the process of figuring out what the payment for the rehabilitation program would be based on my current living situation. At the time I was told my payment would only be {$5.00} a month. It was determined that because I was on maternity leave and I was not receiving any benefits either through work, unemployment, or XXXX, {$5.00} was all that was required of me. At the time of this enrollment phone call, never once was I told I would require financial documentation to " complete the enrollment '' as they claim. In fact, even if I was told financial documentation was required as claimed in FH Cann and Associates ' response to me in my first C.F.P.B. complaint against them, I already told them there is no documentation to provide nor would there be. Because I was on maternity leave without pay, wasn't receiving XXXX, and wasn't receiving unemployment benefits, I wouldn't have any financial information to give them above and beyond what was already provided to them over the phone. Does FH Cann and Associates expect me to conjure up paystubs or benefit documents that do not exist magically? If I needed to provide some sort of document in regards to income when there was none, why wouldn't they tell me that in the first phone call? Why did they wait until XX/XX/XXXX of XXXX to tell me this! By their own admission, they didn't even tell me this when we spoke on XXXX of XXXX and at that point I had already been enrolled in the program since XXXX of XXXX! You would think they would have known if there was missing documentation or an incomplete enrollment application by that point and would have notified me as such. Not notifying me of these requirements while keeping me " enrolled '' and making payments in the student loan rehabilitation program that would never be completed is deceptive, malicious, akin to a bait and switch tactic, and shows complete incompetence as well as improper servicing of this account at my expense. What am I supposed to do now? I can't get those nine months back. By the way, in reality its more like 16 months because while the CARES act is in place, I can't begin making payments that would count towards a rehabilitation program until XX/XX/XXXX. To respond to my initial complaint by saying " During on XX/XX/XXXX, our representative made you aware of the missing documentation and advised you on the status of your account. On XX/XX/XXXX, our representative attempted to reenroll you into the program, but you chose not to listen to the programs benefits and insisted that your previous payments be applied to your new enrollment, '' and then begin quoting rules and regulations to me, they are essentially telling me that I'm screwed and that they have no empathy nor sympathy for my plight of their mishandling of my account. They are also attempting to deflect blame to me even though they are the ones that never advised me properly nor instructed me of further requirements until AFTER I had completed my nine monthly payments. I'm not just griping about this for no reason, I have a newborn and need my credit to be able to provide things of necessity such as a new place to live or a safer vehicle that I can transport my child in. Now, my credit won't be ready to do these things at a reasonable or preferred rate until late XXXX! AND ALL BECAUSE FH CANN AND ASSOCIATES NEVER BOTHERED TO TELL ME I NEEDED TO PROVIDE DOCUMENTS THAT DIDN'T EXIST FOR ME UNTIL XXXX OF XXXX WHICH WAS 2 MONTHS AFTER I COMPLETED MAKING MY 9 MONTLY PAYMENTS! Again, I don't know what else to do. I completed my enrollment of this program. I followed the instructions provided to me by FH Cann and Associates. I made the 9 monthly payments on time as required by the department of education to satisfy the program. If I'm being told that I have to begin all over again and that I have to wait just to begin this much needed program after already completing it in XXXX of XXXX, then I will be forced to speak with counsel and set this matter for litigation. I'm not going to let FH Cann and Associate 's incompetency and deception to harm me without consequences.

I was shocked on the Morning of XX/XX/XXXX. The head of the Dept. stopped me in the hallway to discuss a garnishment email. Red flags went off in my mind ; as, payroll has a ethical and moral obligation not to share personal and financial information with other employees. Second, I had and still have n't been contacted with formal communication about the validity of this debt from XXXX XXXX or F.H.Cann & Associates, Inc. Third, all of my Student Loans are held by XXXX, I communicated with the payroll Dept. stating that this was not a legitimate debt. I was informed that it was valid and to contact F.H. Cann personally. Fourthly, the Garnishment paperwork is subpar. The paper work was emailed to my department head, not physically given to me, nor directly sent to me. Documentation it 's self is not legal in any way, it was created on a template each page has the exact same number on it plus the template is a 8 '' X11 '' not legal which is a industry standard. No seal and not notarized. The Writ it 's self contains no information about the original loan, no supporting documentation. This Writ is for the amount of {$34000.00}, one would think with that large of an amount that the payroll dept. would demand legal paperwork affirming the validity of the debt. I have been trying to mitigate my damages since XX/XX/XXXX I called XXXX, asked about the garnishment and how to stop it. XXXX informed me that all my loans were in good standing and that they are in deferment until XX/XX/XXXX My credit report reflects that statement. ( please see attached paperwork ) The supposed debt that I 'm being garnished was rebalanced on XX/XX/XXXX. The status is in collections, not garnishment. It was originally opened XX/XX/XXXXreported on my credit report XX/XX/XXXX and was put into collection statusXX/XX/XXXX. The original creditor is XXXX XXXX XXXX XXXX. The Company that reported it to my credit report is as follows : XXXX XXXX XXXX BOX XXXX XXXX IN XXXX NO CONTACT PHONE NUMBER XXXX have tried several times to contact XXXX XXXX to no avail. There are two loans on my credit report from XXXX XXXX XXXX XXXX : original amount {$12000.00} recent balance {$14000.00} as ofXX/XX/XXXX Date opened XX/XX/XXXX First reported XX/XX/XXXX. Second Loan : original amount {$14000.00}, recent balance {$17000.00} as of XX/XX/XXXX Date opened XX/XX/XXXX, First reported XX/XX/XXXX The red flags are as follows : *The Dept. of education would never originate two loans for the same student on the same day. ( Please see attached paperwork for normal Dept. of Education loan origination. ) *The Dept. of Education does not start collection proceedings 3 months after the Loan origination date. The Dept. of Education waits until after graduation to start collecting on student loans * I have not applied for any student loans or attended any school since XXXX. These XXXX XXXX loans were documented as being opened in XX/XX/XXXX My legitimate Student loans are reported correctly on my credit report. ( please see attached credit report ) I called F.H. Cann on XX/XX/XXXX. I questioned the validity of the paperwork and they transferred me to woman named XXXX XXXX, she informed me that she had the power to garnish my wages until the debt was paid in full. They never offered to send me the original loan paper work, and have been ignored when I 've asked for it. XXXX then informed me that if I enrolled in the rehab program ( which was 12 months of {$5.00} payments ) after 6 months of payments she would stop the garnishment. In the quest to mitigate my damages, I agreed. F.H. Cann would not accept my XXXX they had to have my tax return. ( Which I refused to send ) The rehab paper work states that XXXX 's are acceptable to validate income. Under this program that I agreed to said I would make 6, {$5.00} payments and that my garnishment would end on my last paycheck in XXXX. Against my better judgment of letting a company finically double dip, I agreed. My first paycheck in XXXX was garnished. I called XXXX. XXXX and was informed that my last payment was not posted. At this point I informed them that I have strong reasons to think what they are doing is illegal and that I would be contacting the FTC. Which leads me to file this complaint. As of XX/XX/XXXXthis organization has stolen {$2100.00} from me. This is money that I labor for. I have XXXX XXXX boys that I have to say no to because almost {$600.00} of my monthly income is being stolen from me. That include saying no to basic things like shoes, going out to eat, cell phones. Student loan reference # XXXX Principal : XXXX Interest : XXXX Collection Fees : XXXX Total Due : XXXX Violations of consumer rights : 1 ) I nvasion of privacy by using social media accounts to identify persons and organizations connected to the debtor, and 2 ) I ndependently contacting those persons and organizations, requesting private information about debtor and the organizations. 3 ) Threatening to continue sending debt collection related communications to 3rd parties that are not employers or relevant collection targets. Statu te : 15 U.S. Code 1692b - Acquisitio n of location information. Statute : 15 U.S. Code 1692c - Communication in connection with debt collection. These XXXX behaviors are a direct threat to the debtors ability to professionally network and move towards viable employment. [ BEGIN COMPLAINT ] My student loan, serviced by " XXXX XXXX XXXX XXXX XXXX XXXX '' is in default due to an inability to make regular payments, due to challenges related to homelessness and unemployment. On Monday, XXXX XXXX , the apparent collections agency, " F.H. Cann & Associates '', contacted at least XXXX organizations that I have been engaged with in the last 8 months. In their communications, they identified themselves as a law firm requesting employment verification. They asked each organization for information not related to me, such as EIN and information about the organization 's whereabouts. One of the organizations is a nonprofit organization I volunteer for, the other a company that I have taken sporadic interim projects for as a contractor. Neither organization employed me. I have not been employed since XXXX XXXX , XXXX . I notifie d F.H. Cann & Associates that th ey were violating my privacy and my rights pursuant to the FDCPA. In response, I received a secure email fro m F.H. Cann ask ing if I would communicate with " XXXX XXXX or another representative ''. I replied the same day that I would be happy to speak with anyone other than XXXX XXXX , who is the collections agent that invaded my privacy to begin with by contacting organizations listed in my XXXX profile, and as long as I would not be inappropriately threatened. I received no response to my offer to communicate. Then on XXXX XXXX , XXXX , I received a letter from XXXX . Cann stating that they would commence wage withholding from my " employer '', listing the company that most recently contracted me on an interim consulting project. On XXXX XXXX F.H. Cann & Associates issued a " Notice Prior To Wage Whithholding '' that lists, despite knowledge to the contrary, a company that does not employ me as my employer. The contents of this notice are standard and legally binding, however the persistence in communicating with a third party that is not my employer with a debt-related communication ( in this place a wage garnishment letter ) constitutes ongoing harassment and a 2nd communication, specifically violating rules associated with 3rd party communications as stated in 15 U.S. Code 1692c of t he FDCPA. Furthermore the situation is aggravated by a failure on the part of F.H. Cann & Associates to res pect the communicated issues related to this debt : 1 ) That I have been discharged fro m employment in the last 12 month s 2 ) Th at I was legally homeless in the last 12 months and own no assets including vehicle 3 ) That I would be willing to make a smaller payment, but not sign into a legally binding payment agreement while unable to certify regular income 4 ) That I have been denied unemployment benefits by the State of North Carolina and have evidence of this denial Since XXXX of XXXX , when I was terminated by my last employer, I have been working odd jobs and contract work while seeking employment again. By using social media to identify organizations I have volunteered for and completed interim contract work for, and then repeatedly contacting those organizations knowing that neither is an employer, F.H. Cann & Associates has violated my rights as a citizen and I ask that they halt this activity immediately.

I need assistance with school loan collections matter concerning the companies XXXX XXXX and F. H. Cann and Associates. A ) I consolidated with XXXX XXXX in XXXX, payments towards the loan balance were automatically withdrawn from my checking account monthly. This occurred from the start of the consolidation until XXXX when I became unemployed, consecutive payments were receives from me to XXXX XXXX from XXXX to XXXX. In XXXX, I questioned the remaining balance because the stated balance did not appear to be accurate ( it was {$3000.00} less than I started with ). During the 5 years of repayment ( from XXXX to XXXX ) I did not receive a single statement of payment applied and/or remaining balances. I made multiple requests for an explanation of balance from XXXX to XXXX, this was only provided to me two week ago from a claimed XXXX XXXX ombudsman XXXX at XXXX XXXX XXXX XXXX. See attachment for Payment History Letter. What the payment history letter showed was astounding, payments where applied towards interest and none or mere minimal were applied toward the loan principal ( for example : with a payment of {$100.00}, all {$100.00} was applied to the interest and {$0.00} to the principal. The very next months with another payment of {$100.00}, {$99.00} was applied toward interest {$2.00} towards the principal ). How were they applying payments??? And if {$0.00} is applied towards principal - would I ever finish? {$0.00} one month then {$2.00} the next. According to XXXX, it was a simple interest loan. This was never explained to me before because I would not have consolidated my loans with XXXX XXXX had I understood that I would only be paying interest. Also, there were at least XXXX different interest rates - 5.75 % and 5.25 %. This does not make any sense - is n't the point of consolidating that there would be XXXX balance and XXXX rate?? The prior loan holders prior to XXXX XXXX were XXXX and XXXX. The interest rates were 4.5 %, XXXX and 5.3 % for these loans. When I consolidated the loan, I was told the interest would have been less. Why would I have consolidate at a higher rate that I as paying prior????? This is a practice of Usury. When I graduated from school, I had XXXX single unsubsidized loan, looking at the statements now, which I repaid prior to the consolidation with XXXX XXXX, now I see where there are XXXX unsubsidized loans. They have sliced, diced, divided, flipped and transferred the loan to this and that servicer that I do n't know what 's up and what 's down anymore or how they have the figure that they have. What I know is that I faithfully repaid the loan for 5 years in what I only understood to be graduated payments, not simple interest payments, I asked for payments to be increased twice in the 5 years - now I am not sure if that was done. I was told that interest rate would be lower - it was n't. I was told that if I did direct checking withdrawal, interest rate would even further be reduced - not sure if that was done either. I was and still am being taken advantage of by XXXX XXXX. I would not have consolidated with this company had I been told or understood these terms. Let me go on to explain that I entered into deferment from XXXX to XXXX due to unemployment, then XXXX to XXXX while I was a full time student. In XXXX, I again tried to resolve the balance and also obtain history of payment and explanation with XXXX XXXX / XXXX XXXX ( a new company the entered the picture sometime around XXXX or XXXX ) - they simply referred me to their company web site that had none of the information I was looking for. I was basically given no right to question the account. B ) F. H. Cann and Associates started contacting me approximately a month ago. I have tried and tried to resolve or get a resolve on these loans. I KNOW FOR A FACT that I did not BORROW XXXX dollars. My loan has been turned over TONS of times to MANY different companies and it steadily goes up, up, up and up with fees and interest. My checks where being ganished, and taxes offset. Also, my taxes were offsest last year. I lost my job XX/XX/XXXX and FINALLY GOT A SMALL part time job lost that, and got a temporary job and they offset my taxes and I was XXXX steps from being evicted. All I had was food stamps and NO INCOME. Now XX/XX/XXXX I get YET another letter saying my loan has changed hands and is now with F.H. Cann & Associates Inc. When I called last year when my taxes were offset, everytime I called the IRS they said they did n't see where my taxes were going to be offset. I tried to find out what I needed to know then. They said this literally everyday. Then all of a sudden they offset it. I called and spoke to XXXX people and each one gave me a different number and company to call. This time I started calling on Saturday and no help. I called today XX/XX/XXXX and the lady gave me another number to call. I called them today XXXX and she said I qualify for the {$5.00} a month but interest, ganishments, tax offsets ALL WOULD still happen until 9 months. So I said okay so if I borrow XXXX and pay it now today, will that help them NOT offset my taxes, ganish me and resolve or at least stop the loan from the interest growing faster than I can get a resolve. She said no. I said so, if I pay the {$5.00} a month for 9 months, pay XXXX, you are telling me that they still will offset my taxes, and ganish my checks and still collection interest, and the loan still may change hands and companies? She said yes. So I said it does n't matter what I do, I will still not get a resolve. She said no. She said in order to settle your loan you can pay, ( she gave me an amount over XXXX ) to settle. Now if I am having such hardship and STILL do not have a permanant job how in God 's dear earth can I pay XXXX In addition to that, I told her I DID NOT UNDER ANY CIRCUMSTANCES BORROW XXXX Not only that at the time I had just started college at XXXX University and all they said was file out the Financial aid form then sign here. The only thing they said was this is what you have been awarded. This is predatory lending. When a student have a deadline all they know is I have been rewarded sign the loan. Then next thing you know you are being sent a letter saying consolidate. Seconds after that you recieve a letter saying you defaulted. And unless there is a miracle out of nowhere you will owe that until you are XXXX feet under. And the interest collects on it so fast there is no way in the world you will EVER pay it off. How is this fair? How is it that if you try to resolve and make effort THEY STILL add and tack on XXXX 's of dollars in interest so fast there is no way you will EVER be able to pay it off. HOw is this different from predatory lending in the housing industry!? This is insanity to infinity and beyond. They are NO HELP they will not listen and all they want to do is coherce you into signing papers to pay {$5.00} a month WHILE they ware still adding interest. Then she tells me EVEN IF I borrow and pay XXXX that will not help either. So what will? If XXXX will not help how is {$5.00} going to help? MY TAXES are STILL BEING TAKEN, which puts me on skid row, with a temporary job, no benefits, struggling to make ends meet and having to hunt down and pray I have food to eat everyday. Please note for the question below, perhaps there needs to be an option where you can choose more than XXXX + add a description, because I ca n't repay my loan & after paying {$5.00} a month which doesnt help according to the rep I spoke with I cant repay after the 9 months either & dealing w/lender

US Department of Education attempted to collect a debt for a student Loan in XXXX that originated through XXXX XXXX loan # XXXX which then turned into XXXX. The original loan was {$42000.00}. of which I paid {$25000.00}. After several attempts to reduce the promise payment of {$160.00} monthly moved to nearly {$500.00} monthly. I felt like this was literally extortion. I moved the then {$54000.00}. ( loan that has {$37000.00}. in interest added since I took it out ) to a Federal loan. I made several calls to lower my payments as I was divorced in XXXX every time I asked for a lower payment, I was told I would find out when I got my next statement, however the payments kept getting higher although my home income had decreased by {$1600.00} monthly. I also inquired several times regarding how to request loan forgiveness as XXXX XXXX was all over the new regarding a potential class action lawsuit against XXXX XXXX as the student loans were predatory and overcharges students by 44 % between XXXX. My son attended XXXX XXXX, I was the parent who took out this loan in I believe the summer of XXXX. I never received any information of how to follow through with loan forgiveness. I couldn't afford the payments, couldn't get forgiveness information. News broke in XX/XX/XXXX that a settlement was reached for XXXX XXXX XXXX XXXX. The company agreed to forgo collections on approx $ XXXX in old accounts receivable in the last 30 years at over 100 campuses and they will write off $ XXXX in accounts receivable. XXXX XXXX took advantage of students and parents. XXXX XXXX closed over 100 campuses including the campus in XXXX where my son attended. On XX/XX/XXXX my XXXX XXXX # XXXX balance was {$60000.00}. The statement I opened late by myself on XX/XX/XXXX included a request for review and verbiage regarding US Department of Education Application for Borrower Defense to Loan Repayment and that if I did not reply collections activities would begin. I immediately downloaded and completed the request for review and sent all paperwork and news articles regarding XXXX XXXX via USPS on XX/XX/XXXX as I should not have to continue to fight to repay a loan of a school that closed due to predatory loans. I have included the USPS certified mail receipts. Three days later, yesterday, XX/XX/XXXX I received a letter from F.H. Cann & Associates indicating my account had gone to collections and now my balance is {$83000.00} adding " interests and costs '' of an additional {$22000.00} on a disputed loan that should have never gone to collections. The application for borrower defense to loan repayment was sent to US Department of Education - Borrower Defense to Repayment at XXXX XXXX XXXX, XXXX KY XXXX and US Department of Education XXXX XXXX XXXX XXXX XXXX XXXX XXXX, TX XXXX. I should not have to pay the remainder of the original {$42000.00}. loan, of which {$25000.00}. was initially paid to XXXX XXXX, nor the now {$66000.00} in interest and fees attached by XXXX XXXX, XXXX, US Department of Education and F.H.Cann & Associates ( located at XXXX XXXX XXXX XXXX XXXX XXXX XXXX. MA XXXX ). The remaining balance in full should be forgiven.The remaining balance if full should be forgiven. If I was originally charged {$42000.00} which court documents indicate was an overcharge by 44 % I should have only paid {$23000.00}. I already paid XXXX. This nightmare has been going on for nearly a decade. It is my understanding that when a debt is in dispute the debt can not be sent to collections. This debt has been in dispute since XXXX. Lastly, let it be know that at no time was I contact to participate in a Class Action lawsuit regarding this matter nor have I received any relief of any kind toward this not in for form of monies nor reduction in balance, interest or fees.

After discussing situation with XXXX XXXX, he asked what I would be willing to pay and that he would go back to XXXX XXXX to negotiate. I said I would be willing to pay the {$18.00} for the items I purchased and in good faith, I am also willing to pay one late fee charge of {$37.00}. Total of {$55.00}. In the meantime, I also wrote a letter ( and sent copies of the billing statements ) to the President of XXXX XXXX, XXXX XXXX XXXX, asking assistance with regards to the situation. ( copy of letter enclosed ). On XX/XX/XXXX I called XXXX XXXX at F.H.Cann & Associates to follow up on the situation. He told me he had been trying to call me. ( Note, I received one call from F.H. Cann & Associates phone number ( XXXX ) XXXX and no message was left. ) He told me that XXXX XXXX did not agree to the {$55.00}, but agreed to a settlement of {$110.00}. My understanding that if I agree to the settlement ( and not pay the full amount of {$250.00} ) it will negatively impact my credit report for 7 years.

I entered into a income based repayment agreement with F.H. Cann & Associates , Inc. on XX/XX/2016 for a monthly voluntary payment of {$38.00}. To date, I have honored this agreement and have been " on time '' every month in paying by the XXXX day of each month directly from a specific business bank account, as it is reasonable and affordable for me. All pre-authorized payments to date except the XX/XX/XXXX payment have been processed - which I noticed said usual amounts have not been debited as they had in the past. I have not received a written notice of changes to our agreement, and, have now been sought on my mobile phone [ which I use for work ], and, the main line phone number to my business during regular business hours by agents of F.H. Cann & Associates, Inc. This practice now begins to adversely effect my state of mind at work and the business flow of approximately 5 other individuals. More specifically, the agents calling my employer have asked for me at times I am conducting important tasks or timely projects and speak to others without regards to my privacy as to where they might fax, email or send a wage reduction form. In the initial contact period with F.H. Cann & Associates , Inc., I did have faith they may be able to assist me in rehabilitating my federal student loans. They convinced me my affairs would be handled on a professional level with my best interest in mind. Two months ago they began to apply pressure for me to sign a separate and new terms and conditions agreement with language referring to " collection of fee up to 16.0 % of the outstanding principal and interest balance then due on my loan ( s ) will be added up on conclusion of this Agreement and purchase of my rehabilitated loan ( s ) by an eligible lender. '' I have yet to determine what more I can do to comply honor my responsibility to what I 've agreed but know my original federal student loans have rates under a 5 % interest. I have advised F.H. Cann & Associates , Inc. of my on-going involvement in debt counseling through my Attorney, XXXX XXXX. And, they are well aware I am considering personal bankruptcy only because of outstanding medical bills due to a XXXX, whereby financial constraints within the past 10 years were compounded by a long-term employment lay-off. This episode of my life rendered my personal financial affairs a disaster that also caused me to cash in a 401K to care for myself and a dependent child. I have asked F.H. The remaining balance on my student loans ( roughly 36,000 in XXXX ) was discharged in XXXX due to XXXX XXXX. The Social Security Department indicated in the initial paperwork that my case was not subject to any three year reviews. That and other documents were submitted to XXXX/DEPT of ED in the initial application and have been resubmitted to them along with other documents several times since XX/XX/XXXX when I first learned that they and FH Cann were reporting over six months of delinquency to the three bureaus. None of the agencies had ever sent me notice of any alleged debt. Nor had any of them ever sent any notice of required payment. When I questioned supervisors about this fact they claimed they didn't have any of my contact information. My contact information has been the same since XXXX when I was granted full discharge due to the severity of my XXXX. I have loads of old emails, mailed documents to prove that they did have all of my contact information. There is also no excuse for their failure to look at my credit report and/or public records to find my contact information if indeed they had any confusion. The XXXX staff at the Dept of Education told me it was clear that I had a XXXX balance in XX/XX/XXXX. The agent advised me to resubmit a XXXX discharge application because of the bureaucracy involved in making corrections and my emergency situation which all parties have been made aware of. ( The situation which I've explained to all is that I'm facing homelessness as a direct result of the false reporting on my account. I've been turned down for every application that I've made for housing due to the inaccurate reporting. ) The gentleman at the agency also suggested that I file a request for a settlement agreement despite the fact that I have a XXXX balance. On XX/XX/XXXX XXXX from FHCANN & Associates contacted me in XXXX of XXXX and made me aware of a debt that I had for student loans. Prior to him contacting me I was not aware of an amount, or that I was in default. After XXXX spoke with me he and I made an agreement to set up an arrangement to get back in good standing with my student loans on an IBR program. The program that he advised me to get on was only {$5.00} a month for which he specifically stated would be a duration of 8 months. In the midst of our conversation I made XXXX aware that I would be filing taxes and specifically asked him, verbatim, if I had any kinds of garnishments against me with my student loans that I needed to be aware of. XXXX specifically told me no, that I did not have any garnishments. He also did not make me aware that I could " possibly '' be offset either if I did file my taxes. On XX/XX/XXXX I made my second payment and revisited the prior conversation in order to be sure that I would not be offset once I did file my taxes. On XX/XX/XXXX I was offset for the US Department of Education. I called FHCANN & Associates and asked to speak with a supervisor, and was given XXXX XXXX. He stated that there was nothing that could be done. I called again at XXXX PM the same day, and spoke with XXXX another supervisor, who stated that the call had been reviewed by XXXX and XXXX had came to the conclusion that nothing was said off script and that XXXX `` did '' make me aware that I would be offset, and that XXXX never confirmed that I would NOT be garnished. As I told XXXX, this is incorrect, and I wanted the call reviewed again. I also requested transcripts to which XXXX told me that FHCANN is not required to give me, however he stated that the call would be reviewed by a manager and that he would follow up with me in 1-2 business days. I would like to make a complaint based on the misrepresentation that XXXX made. From my understanding, XXXX is NOT a tax consultant, and therefore should not be answering tax related questions with definitive answers. I, the consumer, was also not made aware of the " possible '' offset which is a clear violation of FHCANN & Associates contract with the Dept. of Education.

Up until that point I had paid $ 20,000+ of my {$16000.00} loan. So I had paid {$4000.00} in interest at that point. After a certain amount of time not being able to perform on my loan, it went into collections. Though XXXX never mailed me the bills, or informed me they were sending the debt to a collection agency. They claim they sent me e-mails, though they did not. They never sent snail mail either. Now the collections agency, FH CANN is attempting to charge 24.34 % for collection costs. Luckily I only owe > {$2000.00}. What if I owed {$100000.00}?! Thats a {$24000.00} Collection fee! It equates to 4 years worth of interest in one charge. All because I couldnt perform on the loan. This is way too much money for a collection fee. To make matters worse, they then send the agreement that says, they will only charge 16 % collection fee if I sign and perform on the collection agreements, otherwise its 18 %. The kicker is, they then choose who they want to sell the note too, and then the new company reserves the right to charge a collection cost on top of it! This has to be illegal! If you, as a an owner of a bank, are offering student loans, you are investing in a generation of people and a job market. The risk of the investment is lack of job opportunity, yielding limited repayment. Either way, as a world leader, the fringe benefit of your infrastructural investment is the educating of your population. The first chance you get, you dont sell the paper to a shell company, then charge outrageous fees once that person or people fall on hard times?!?! This is not how this business plan was originally built. It needs reform! What is the cap on collection costs? What are the rules for selling the debt? What does transparency in servicing options look like. No Deception! Please contact me with proactive or already in place regulations that will assist me with this companies attempt to collect a nearly paid off debt that they are trying to stock pile one-time insurmountable fees on top of.

I was contacted by XXXX XXXX of F.H. Cann on XX/XX/XXXX. I was advised that they are the current debtor that owned my student loan debt, which was defaulted on. She then advised me of a loan rehabilitation program, in which I would make payments for 9 months ( which had to be automatically paid from my checking account ), and after that time, my student loans would come out of default and I would be able to set up additional payments to keep them paid and in good standing every month. I advised that due to my employment status, I was not able to make any substantial monthly payments. After going through several questions about my life, she determined that I could make small monthly " hardship '' payments via their student loan rehabilitation program. I consented and she took my checking account information and emailed me some documents to e-sign sign, which I emailed back that same evening ( XX/XX/XXXX ). Starting on XX/XX/XXXX my checking account was charged this monthly payment. I was charged every single month on the XXXX day of every month. Since that time, I have made numerous attempts to contact this company and have all but failed. I was able to speak to someone on the phone in XX/XX/XXXX who advised me that I had one payment left in XX/XX/XXXX ( which was successfully made ), and after that payment I would receive something from them in the mail stating my loans were out of default. I received nothing. I have since tried making contact with them, only to be transferred to several other companies who they now claim hold my debt. If another company owned the debt, they were required by law to advise me of that, which never happened. I made monthly payments to them and they failed to deliver on their promises. I now have a student loan that I have been paying on which is still in default and I have no idea if any of the money I paid actually even went towards my loans. This is deceptive as well as illegal.

Six months ago I got in contact with the collection agency that has my student loans that are currently in default because I wanted to improve my credit and start repaying my loans. The collection agency is called FHCann & Associates and this is the worst company I have EVER dealt with. The process to start paying my loans back took many, many, many phone calls while I was trying to work. They needed paperwork after paper work. I was having to fax them and that wasn't good enough so I had to email them and that still wasn't good enough. This went on and on to the point that it was absolutely ridiculous. We had settled for {$100.00} a month so I had direct deposit set up for them to take it out my account and they have every month without fail. They had tried to go up on my payments to {$150.00} and then they actually tried to go down on my payments to I think it was {$55.00}. I told them that we would keep it at {$100.00} and they agreed. I was also told that after I make 9 payments on time that my loan would come out of default status and I would be able to make my payments to the Department of Education instead of them. Finally I was told that the papers I had sent were good but they had already taken I think 2 payments and I thought we were all set. All of a sudden I get my statement in the mail and it looks different so I called them. They stated that even though I had been making payments every month on time through direct deposit that it was not qualifying payments and I would basically have to start all over again and they needed a new income statement and pay stubs. I am currently in the busiest time of the year so I have been pulling 60 plus hours every week since the beginning of the year so when I send them my financial statement my payments will be outrageous and because I won't be able to afford those payments so then any payments I make would be non-qualifying payments therefore my loan would never come out of default. I am trying to do what I can to make payments on time every month, they are the ones who set the amount to come out my account. I feel that I have done my part and this is harassment and unfair.

Initial communication with FH Cann & Assoc. was after a wage garnishment was implemented with my employer. I informed FH Cann representative that I had received no written notice and was unable to verify amounts. They replied it was sent, but offered no proof of receipt. I also explored a rehabilitation at this point but was told I could not enter the rehabilitation at that time, then again that I would have concurrent paycheck debits of XXXX % each for a total of XXXX %. As this is clearly unaffordable, and I was not in a position to pay this debt by credit card as counselled by FH Cann, I resolved to continue with the garnishment payment. I made several attempts to contact FH Cann and request an account balance and a monthly statement. I was told by seperate FH Cann reps that these are sent monthly via mail. They must use the same mail service for the statements as their initial disclosure of debt, I have yet to receive either via paper mail. I did receive 1 statement and balance after to speaking to XXXX XXXX for the second time. I recently filed a complaint with the XXXX and FH Cann General Counsil repsonded that they do not send monthly statments and that I may determine my " payment '' by reviewing my paystub. While the Esquire is correct, my paystub shows a debit amount, it does not provide a running balance, associated interest and fees. I have contacted the origional debtor for this information and was informed I must deal with FH Cann. I believe as a consumer I have the right to the disclosure of debt ; not provided. I have a right to see where and to what and how such garnishments are being applied. If they are not required by law to provide these statements, how is consumer to know when such debt is satisfied? How is the consumer to know if the fees are within allowable legal limits? If this is not illegal it most assuredly is poor business practice and poor customer communications. Thank you

I consolidated my only two existing student loans, in the amounts of {$4000.00} and {$3500.00}, respectively. This amount was paid in full shortly after by credit card. I have the credit card number. The account was held by my mother, now deceased. However, the Department of Education and their collections agency, FH Canns & Associates are reporting that I owe {$26000.00}. The US Department of Education reports that they do show the consolidation and have further stated they can not confirm payment because the approved consolidation provider, XXXX was restructured while it held my loan. Please note that prior to today, I have never seen any reporting to the credit bureaus of this debt, nor have I ever received any collections contact. It is only upon qualifying for an FHA loan did this matter arise. This invalid, unconfirmed, inaccurate account balance is preventing my family and me from buying our first home. This is severely negatively impacting our future. This not to mention The agents on the phone from the Department of Education failed to disclose that XXXX was censured and " XXXX has been dealing with problems related to its handling of student loans as far back as 2012. Due to complaints about their handling of student loans, the Department of Education transferred many of their loans to other servicers. You see, the Department of Education owns the Direct Loans, so they can decide who your loan servicer will be and there are many others. Since XXXX was having so many problems, the Department of Education cut ties. '' I need this matter resolved ASAP and will exhaust every regulatory, consumer advocacy, and legal resource at my disposal to do so. I paid my loans and I paid every other of my bills without fail so I'd have good credit when I needed it. F H Cann and Associates Incorporated XXXX XXXX XXXX # XXXX, XXXX XXXX, MA XXXX has an abusive call policy : they record all calls and do not allow consumers to request not to be recorded -- their policy is to hang up on those calls, creating a harmful environment for consumers that want want to verify their legitimacy while not being recorded. Agents refused to answer company information that is public knowledge like their physical address which created me harm when thinking they were a scam. Their agents and supervisors make it seem like this scenario is the consumer 's problem and use language that felt like I was to blame. I heard phrases like, " Whatever you ask me, I don't know '' ( XXXX XXXXXXXX ) which makes them feel like a scam. I heard, " Are you done? '' ( XXXX XXXX ) in an aggressive tone from a supervisor which belittled my legitimate concern. On XX/XX/XXXX i received my first letter regarding the current collections on this debt from the Dept of Ed. This first letter was the FINAL NOTICE OF WAGE GARBISHMENT FOR DEBT OWED TO US GOVERNMENT. When i called the Dept of Ed on XX/XX/XXXX i was redirected to FH Cann. Prior to this XX/XX/XXXX letter I have had no contact from a collector about this student loan debt when another company tried but after I sent a written request for verification of the debt, the collector never supplied verification and stopped contacting me. So, in several phonecalls on XX/XX/XXXX I immediately questioned FH Cann as to how this FINAL NOTICE was the only notice I've received and all they said was everything was sent to the same address. On this call I was instructed of several repayment options, of which were slight variations of paying the debt off in full. Not until ending the intial phonecall and doing some research and learn about loan rehabilitation. Upon calling back on XX/XX/XXXX and mentioning the rehab program FH Cann then said that was an option. They then proceeded to pressure me and question me about expenses regardless of how many times I stated I'd like time to review my finances to provide these numbers. FH Cann provided an estimate based on these inaccurate numbers and persisted in trying to get me to agree to these terms. Several times I repeated I would like to review my finances and was ignored I said I would not agree to terms until I could do a financial review to provide accurate numbers and that I also needed verification of this debt before I could do so. I was told this information was to be sent to me. The only documents I received after this call was a prefilled out loan rehab income and expense form using all the unreviewed numbers from the phone call. No verification on the debt as of XX/XX/XXXX. I will now be following up with a written request of verification.

I contacted the company the weeks of XX/XX/XXXX - XX/XX/XXXX in regards to a debt that was in collections. Speaking with several agents over a week period I countered their settlement agreement and was advised that it was not accepted. I advised them that I was not able to accept the offer they provided and asked them to send me a letter in writing stating that my offer was not accepted. I was advised that they would not be able to send me no such letter. Speaking with a supervisor he advised the same thing and told me they would be able to send me a letter with the offer they provided. On XX/XX/XXXX I received two letter in the mail from the debt collector, one stating the amount they would accept and the other advising the binding payment agreement we agreed upon which never happened. I contacted the debt collector on XX/XX/XXXX advising one of the agents of the letters I received and advised her that I never agreed to payment arrangement. She stated that she was able to see in the notes where I did. I advised her that I did not I offered an amount that was not accepted but I never agreed not accepted they over they provided, let alone made a binding agreement. She then placed me on hold to get a supervisor. The male supervisor came on the line and advised me that the letter I received was not an agreement letter it was an offer letter stating what they would accept. I told him that I received two letters one with the offer and another stating that I came to a binding agreement and it had the terms and conditions. He advised me that I could ignore the letter throw it away and I do not have to pay it if I don't want. I advised him that was not the problem and that I never made an agreement and that was false/fraud. I told him that I would be filing several complaints and ended the call.

I Have been paying my monthly payment as I have been requested to each month for nine months to get my loan back in good standings and out of default, Fh cann asked me to fax over paper work back in XXXX after I found out my taxes were taken and I could set up payment to be back in good standings and off off the offset list. I was asked to fax over tax forms and pay stubs alone with employer info which I did along with my terms and condition form ( I have fax confirmations and emails. ) Without this form i will not be able to go back to good standing within 9 months, I have been contacted several time throughout the year stating they did not receive the form. But they received all other forms? I have faxed emailed and mail this letter nemours times in hopes that this would be settled. Only to get a call back months later to say they still have not received all the paper work but yet still taking payment from my bank account. She never stated where she was calling from nor who she represents and every time I asked her who she was she just stated she is calling in regards XXXX XXXX. I received a letter dated XX/XX/XXXX from F.H. Cann & Associates , Inc from XXXX, NH phone ( XXXX ) XXXX. The letter identified this company as a debt collector. The verbiage of the letter indicated that I owed {$610.00} to XXXX XXXX XXXXXXXX XXXX. All my credit cards are locked with each of the credit bureaus. It was not until I filed my takes in XXXX that I discovered my identity had been stolen. I am retired living in FL and I do not do any online courses. My identity has been compromised. The IRS has indicated that someone filed taxes using my XXXX and XXXX at my address. What was missing on the IRS tax form was my full name. I filed an identity theft report with the IRS. I called the debt collector phone # and a someone answered, then hung up. I called back and the same person answered but did not hang up. I explained the debt was not mine. On XXXX the XXXX, 2020, I received a phone call from thee number XXXX. I asked what it was in regards to and they refused to answer. I asked what company she was calling from and she mumbled it out. She refused to spell it to me. I asked what kind of company it was and she refused to tell me without giving her my name. I had withheld my name at that point. I asked her again and I told her that the FCC laws ask that she disclosed this information to me or it could be construed as an unsolicited call. At this point it was an unsolicited call because she did not tell me who she was or why she was calling or what kind of company she was calling from. I called the party back and I requested this information once more and she hung up on me. Her name is XXXX. They called me earlier this month several times under different spoofed numbers. I object to the amount owed to the Department of Education. My original loan amount was {$53000.00}. {$17000.00} of that amount was forgiven through the XXXX XXXX XXXX Loan Forgiveness Program. Upon pulling my credit report, I noticed that The US Department of Education reported two accounts in the amount of {$5800.00} and {$3500.00}. I asked them for proof of verification and to remove the account for inaccuracies, but I did not get either request fulfilled. These are the inaccuracies that I reported : -The payment history from my XXXX report shows that I was on time in XX/XX/XXXX, but 120 days late a month later in XXXX. That is logically and statistically impossible. -My XXXX report is incomplete and they have completely removed the payment history instead of removing the account as requested. - My XXXX report is inaccurate and the data doesn't have the same information as XXXX. -On the Department of Edu website it states that a payment was made in XXXX of XXXX, but I never paid anything to them or knew anything about this account until I pulled my credit report in XXXX of XXXX. They state that the student loan was assigned to them by XXXX but the data from XXXX showed late payments in XXXX while The US Department of Education states everything was on time that year on my XXXX report. How is this even possible or allowed to come back as being verified if their information doesn't match the original creditor, XXXX?! The representative who answered the call stated, I couldn't make arrangements to pay my student loans because I had made arrangements in the past with the past servicer. He then asked if I could pay XXXX to pay my loans off. I informed the gentleman that I didn't have XXXX. The gentleman said we'll I didn't qualify for any other program, I could only do the program 1 time. My only options were to pay over XXXX a month or settle for XXXX. He stated his computer shut down and he could no longer assist me. I hung up and called again at XXXX, spoke to another representative he stated again I didn't qualify for any programs and I can only do the program once and he could settle for XXXX and close the account. I asked could I apply for financial assistance and originally he said I couldn't. He then stated that he'll mail the form to me. I received a letter from F. H. Conn & Associates informing me my student loan was in default and that I must repay them a balance of over {$60000.00}. I have never had any student loans. I informed F.H. Conn that I had no student loans, and after sever letters and months i received a copy of a XXXX XXXX XXXX XXXX XXXX and Promissory Note. The form they sent was hand written and full of errors. I explained to the representatives that I had never seen, nor signed the XXXX XXXX XXXX XXXX XXXX and Promissory Note they sent to me. There are several errors, it is hand written by someone other than me and with my alleged signature, something I would not do. It does not identify who filled out the form, and there is no witness or approval signature. The form has a date stamp of XXXX XXXX, XXXX across the top but the form notes its expiration date as XXXX/XXXX/XXXX. There are several other errors including using my Social Security # as my Drivers License #. I asked for a review of this loan, but have been threatened with wage and tax garnishment and seizure of my property to pay this loan. I have never had a loan. This is an error or a fake. I had a checking account with XXXX XXXX. Few months ago, approximately around early XXXX, I received a message saying my bank account is in negative and I owe them money. I agreed to a payment plan with FH Cann and Associates. After my first 2 payments were charged, I had to get a replacement bank card, which has a new number. For 17 days ( XX/XX/XXXX until XX/XX/XXXX ) of trying to reach FH Cann in order to notify them of my new account and update my payment information, I was unable to reach anyone at the company. They do not respond to emails. Their phone numbers typically go unanswered. One of their two publicly posted phone numbers simply cycles its introductory message with the notice that they are a debt collector, over and over, and does not allow the caller to speak to a live person, leave a voicemail, enter an employee 's extension, nor " press buttons for more options. '' There was no way to reach anyone at FH Cann in order to update my payment method on time, so my automated charge did not go through on my payment date. On XX/XX/XXXX I was finally able to reach a person via phone and resolved the immediate issue. However I still want to register a complaint about this, because it is terrible that we can not reliably reach this company to update our payment information or make arrangements.

I received a consolidated student loan during my years as a student at XXXX. I repaid the loan balance in XX/XX/XXXX or XX/XX/XXXX. In XXXX I received a notification from a debt collector saying I owe XXXX {$200.00} for a Perkins loan. I had not ever received a notification of this debt prior to XX/XX/XXXX, plus they had added interest to it. I sent a letter to that debt collector and said this is not my debt. My loan was turned over to FH Cann and Associates when it went into default due to monthly payments of over {$1500.00}. I sent them income information and was told I could consolidate and get back on track. I called to find out what else they needed in the process and was told that it was to late ; they had sent paperwork for garnishment to my employer. They used my income verification paperwork to obtain my employers information. I was not informed ahead of time, although they claim to have mailed notice. I never received it. Although I asked to be set up with a voluntary payment, they stated there was nothing to be done about the garnishment. I was then told that my garnishment would not even be enough to apply to my principal, it does not even cover the interest of my loan of over {$160000.00}. Im afraid that I will be stuck in this never ending cycle of debt for the rest of my life. On XX/XX/19 I received an email saying my check was being garnished XXXX by a company named FH Cann & Associates I was immediately concerned because I have never contracted with this company and I was concerned some type of fraudulent activity on my SSN so I gave them a call and had come to find out that they were garnishing my check for a federal loan that I hadnt received any correspondence from in years and in fact have sent out numerous letters to to try and verify that de debt existed without any response and on my credit report it was noted to be Charged off. Anyways they informed me that they sent mail to an address that I havent lived at in over 5 years and that they can me an opportunity to respond which is a lie. No I have to file a complaint in court for improper service and hope this ends the garnishment and I can negotiate to manage the debt. My student loan is in default. My monthly social security check payment has been garnished ( 15 % of net income ), and income tax refunds for the last several years as well. Prior to being eligible for Social Security, my wages were garnished through my employer. For some unknown reason, F.H. Cann and Associates ( collection agency for XXXX ) began calling me at work through the school office ( I'm a part-time teacher ), and to date they have also phoned 3 co-workers at my school via their cell phones. I have written and mailed a letter to both F.H. Cann and Assoc., and XXXX asking them cease and desist from calling my place of employment and co-workers, yet they continue to harass me. They have my current address and phone number, yet have not attempted to phone me or send me written correspondence. The school that I attended, XXXX XXXX XXXX XXXX, has blocked me from ordering my official transcripts. They are saying I owe a debt from 2007 for a private University loan that was received. The total a little over {$3000.00}. However, when I went to go and check and verify the debt, the University has sold this debt to a debt collection agency. Emailed documentation was bounced back with mailbox is full I explained this to customer service and was told we can still receive documents when that happens. First off I have never ever received any type of letters for my wage garnishment of 25 %. Also they took my entire tax return on XX/XX/XXXX and no one has any idea why I did not receive a letter 60 days before. The amount of my loans have not changed since XXXX. I have been audited by the IRS a few years ago and they confirmed that I had paid off all my student loans with the Department of Education in which they sent me my remaining federal income tax check after paying off remainder federal balances. I have also already applied again for another student loan and was approved, which if I did still have an outstanding balance I would have been denied.
