RE : Attentively review my formal writ composed declaration of not proven complaint misinformation that is all or in part : deficient of the adequate current status in the fullness of TRUTH, ACCURACY, COMPLETENESS, TIMELINESS, documented OWNERSHIP, certifiable RESPONSIBILITY, or otherwise irrefutable, complaint obligatory, and regulatory requisite reporting thereby mandating your immediate actions to rectify and remedy and any infractions behavior ( s ) by retaining or returning to demonstrate TRUE, CORRECT, COMPLETE, and COMPLAINT XXXX XXXX data field formatted reporting!!! I am a victim of identity- theft, I am writing to request that you block all accounts disputed as fraudulent on my credit reports with XXXX XXXX XXXX XXXX and XXXX. This information does not relate to any transactions I have made. I did not give anyone authorization or consent to use my personal information. I hereby exercise my legal rights enacted by XXXX and The Federal Trade Commission, which explicitly states when a victim of identity-theft dispute a fraudulent account on his/her credit report it shall be honored by all credit bureaus and all fraudulent information should be blocked within 4 days and proper notification shall be given to all data furnishers pursuant to section 605b of The Federal Fair Credit Reporting Act. Failure to comply shall lead to complaints being filed with XXXX XXXX XXXX XXXX, Consumer Financial Protection Bureau, and Attorney General stating your companys unlawful collection practices, misrepresentation of creditworthiness, defamation of character, and noncompliance to abide by laws enacted by Congress to protect victims of identity-theft who's credit been impacted by acts of fraud. Because I know my rights under THE FAIR CREDIT REPORTING ACT, CONSUMER CREDIT PROTECTION ACT ( CCPA ), and FAIR and ACCURATE CREDIT TRANSACTION ACT of 2003 ( FACTA ). I will be taking action. I also know my rights under this paragraph of Section 312 of the FACTA LAW : SEC.312. Procedures to enhance the accuracy and integrity of information furnished to consumer reporting agencies. ( b ) duty of furnishers to provide accurate information. -- Section 623 ( a ) ( 1 ) of THE FAIR CREDIT REPORTING ACT ( 15 U.S.C . 1681s-2 ( a ) ( 1 ) is amended ( 1 ) in subparagraph ( A ), by striking " knows or consciously avoids knowing the information is inaccurate '' and inserting " knows or has reasonable cause to believe that the information is inaccurate '', and ( 2 ) by adding at the end of the following : ( D ) DEFINITION -- For purposes of subparagraph ( A ), the term 'reasonable cause to believe that the information is inaccurate ' means having specific knowledge, other than solely allegations by the consumer, that would cause a reasonable person to have substantial doubts about the accuracy of information. Policy states. According to the Fair Credit Reporting Act FCRA 611 ( 15 U.S.C 1681 ), Procedure In Case of Disputed Accuracy. ( a ) Reinvestigation ( 1 ) Reinvestigation ( a ) In general. Subject to Subsection ( f ), if the completeness or accuracy of any item of information contained in a consumers file at a consumer agency is disputed by the consumer and the consumer notifies the agency directly, or indirectly through a reseller, of such dispute, free of charge, conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate and record the current status of the disputed information, or delete the item from the file in accordance with paragraph ( 5 ), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer or reseller. Therefore, my position is being clearly stated, these accounts do not belong to me, meaning that you are reporting inaccurate account information within my credit file. The fact that these are inaccurate account information means that you, this credit-reporting agency, are reporting incorrect accounts. 1. EXPRESS RECOVERY SVCS & {$1500.00} I am well aware of my rights as a consumer. The Fair Credit Reporting Act requires that you, the credit-reporting agency report accurate and/or correct account information within my credit file. My credit issues are very specific, these accounts and/or items do not belong to me. This means that you are reporting incorrect account information within my credit report. It is this in mind that I request that these listed accounts and items be Blocked and Deleted. According to the Fair Credit Reporting Act FCRA, Section 1681c ( 2 ) Block of information resulting from identity theft. 1.Block. Except as otherwise provided in this section, a consumer reporting shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from alleged identity theft, not later than four ( 4 ) business days after the date receipt by such agency of 1. Appropriate proof of identity of the consumer ; 2. A copy of an identity theft report 3. The identification of such information by the consumer ; and 4. A statement by the consumer that the information relating to the transaction by the consumer. I have provided all of the above listed four ( 4 ) items within this package. Therefore, I expect these listed accounts to be deleted and blocked within ( 4 ) business days. This is clearly an identity theft issue. I am also entitled to receive a free copy of my credit report, so I am requesting a free credit report and that all of these accounts, public records items, and inquiries be permanently blocked and deleted. Re : Dispute Delinquency Reporting by Express Recovery Services ( XXXX XXXX XXXX XXXX XXXX XXXX XXXX, UT XXXX ) Im writing in regards to the delinquent reporting by Express Recovery Services ( ERS ) for the amount of {$140.00} and wish to have this reporting removed and an update sent to the credit bureaus to eliminate the negative reporting on my credit.

Summary of Events ERS has indicated that the amount of {$140.00} has been delinquent since XX/XX/XXXX, yet I have no record of receiving notification either through a mailed notice or phone messages. It wasnt until XXXX on XX/XX/XXXX, when I answered a call on my work cell phone from an unknown number, that I was connected to a phone representative asking for payment of the delinquent amount. When I inquired on what the amount was for, they informed me the amount was due for a medical procedure. I asked if they had sent me a notice and they indicated one was sent out in XXXX. I informed the call representative that I didnt receive the notice and asked if subsequent notices had been sent. The call representative informed me they are only required to send the initial notice. She informed me that they have attempted to reach me by phone and I informed her that I didnt have any messages to return any calls. The call representative informed me that they do not leave messages for call back. The call representative wanted my credit card information over the phone to satisfy the outstanding debt. Since the call was from an unknown number to me, the request was from an unknown person, and I was not aware of any pending debt, I opted not to provide her with this sensitive information. Instead, I asked for another statement to be sent to my address. The call representative asked for my mailing address, which I provided. She also informed me that this would be the only statement they would issue. Within a few days, the statement was received and I was able to confirm the debt was for a procedure that was completed in XX/XX/XXXX. My records indicated that this debt had been satisfied. However, upon my review of my financial records, I did not show a debit amount that equaled the unpaid balance. On XX/XX/XXXX at XXXX I received another call from ERS inquiring about the status of my payment. They informed me that they would waive the {$4.00} amount owning for interest. I asked the call representative that since I was unaware of the outstanding amount due that they remove the negative reporting to the credit bureaus. The call representative informed me that since their records did not indicate the statement from XXXX had been returned as undeliverable they wouldnt reverse the negative credit reporting. I asked the call representative to provide me with system records that indicate proof of mailing and phone calls, with dates and times, and she informed me that they didnt have to provide the information. I informed the call representative that I would mail in the payment. Later that day, the payment was put in the mail and the payment was debited from my account on XXXX Dispute There is negative reporting being sent to the credit bureaus by ERS for a debt that I was not aware of and my dispute is if I was made aware of this outstanding balance I would have paid it, as indicated by the payment sent after receiving a billing statement from ERS.

Statement ERS claims an initial statement was sent in XXXX, but I have no record of receipt and ERS refuses to provide proof of mailing when I requested it. When I requested a new statement to be mailed, one was received within days of my request. Im requesting proof of mailing and a response to why additional statements were not sent in an effort to collect the debt. Had I received any notification, this balance would have been resolved immediately.

Phone Contact ERS claims theyve made several call attempts to my phone, but did not leave a message. My work requires me to be in meetings all day and often times on the weekend. I receive several calls a day at my number from work clients, relatives, and solicitors. The call I answered on XX/XX/XXXX was from a different number than the call I answered onXX/XX/XXXX. The calling method of ERS does not allow the customer to know that a collection effort is being made and if the collection agency does not leave a message to return a call, Im can not be held accountable for delays in making a payment.

My proof of payment within days of receiving the notice, should be indicative that I was willing to resolve the debt and had ERS made more of a reasonable effort to contact me either through additional statements or messages for call backs this would have been resolved. However, they have failed to provide any proof that this occurred and now theres a negative record on my credit.

I have never had an account with XXXX XXXX XXXX. I received postal mail from XXXX XXXX XXXX, the XXXX XXXX XXXX XXXX XXXX XXXX/Attorney for Express Recovery Services , Inc . The mail falsely claimed {$130.00} balance for debt collection. They posted a contact person 's name - XXXX : XXXX on the letter, whose full name and credential are not even identified in order to chase people around for making up debts by misusing people 's identification. Please read the review as follows for XXXX XXXX XXXX Attorney for Express Recovery Services, inc : XXXX " Express Recovery Services Express Recovery Services Contacts & Information Posted : XXXX XXXX XXXX violating the law Complaint Rating : 100 % with 1 votes Contact information : Express Recovery Services United States Express Recovery Services, Inc, a collection agency, went after my daughter-in-law ( XXXX ) for a debt she did not owe. They went after her for a debt owed solely by her husband to his doctor. XXXX had never been a patient of this doctor. XXXX called the doctors office and they said they did NOT send her name to the collection agency ; that they sent her husbands name but definitely not hers. She called me very upset as her credit was being affected. In Utah, it is against the law to go after an individual for a personal debt owed by their spouse. Utah Code Ann. 30-2-5 ( 1 ), provides that neither spouse is responsible for the personal debts, liabilities and obligations of the other. I contacted Express Recovery Services and had the misfortune of talking to a rude bully. When I tried to explain that what they were doing was against the law, he interrupted and said they were very aware of that law. Having a conversation with this individual was not in the cards as he talked over me in a very loud arrogant voice and I quickly realized I was wasting my time. I called him a _______ bully and hung up. XXXX then wrote a letter to Express Recovery Services and sent a copy to the Utah Consumer Protection Agency. She was contacted by the Consumer Protection Agency and advised to file a complaint with the Federal Trade Commission. She asked if I could do that for her as she has her hands full with XXXX small children and I was the one who actually talked with the collection agency. Since Express Recovery Services admitted they know the law, it is clear they are knowingly breaking the law in the way they conduct their business, going after people, threatening them, harming their credit, for a debt Express Recovery Services knows the individual does not owe. It is baffling to me how companies get away with knowingly conducting their business in an illegal manner. Federal regulators say they are getting tired of complaints about debt collectors. Thousands of people say they 're being harassed for money they do n't owe. Many others complain of aggressive tactics that can include abusive language. Even if you 've fallen behind on payments, debt collection agencies must follow laws and rules, and you do have rights, as Utah resident XXXX XXXX discovered. He said he was surprised by a notice he got from a debt collection agency out of Florida saying he owed them {$120.00}. But a bigger surprise came a little later, when he called the agency to find out what it was about. Thats all he said it was, insurance. I asked him what kind of insurance and he didnt tell me, XXXX said. He said he wasnt about to pay someone {$120.00} without more details. I asked him a few questions and he got riled, started literally screaming over me, over the phone, he said. XXXX said the man 's screaming got louder as he threatened to send attorneys after him. XXXX hung up the phone when he could n't get a word in between the yells and threats. Now, XXXX wonders if he was dealing with a scammer. A legitimate, professional company, they certainly wouldnt act that way, he said. At least they shouldnt. But that 's exactly who XXXX was dealing with : a legitimate debt collection agency. XXXX contacted a professional debt collector to find out what they can and can not say to people who owe them money. You need to help the consumer, said XXXX XXXX, general manager of Express Recovery Services in XXXX XXXX XXXX. Youre not going to get anything resolved if you dont help the consumer. In XXXX my wife was encountered by an individual who asked if I resided at a residence and she stated yes. The lawyer XXXX XXXX then represented to the XXXX XXXX XXXX XXXX XXXX that I was served for court for a debt collection of the amount of {$560.00}. This is private investigator also states that he made four trips to my home but yet on the four trips to the home he had never left any information to say that he had ever been to my home are left any documents to my home about the court hearing art informed me about the debt. This private investigator charged a total of {$20.00} for each facet. This is one of the abnormalities of the cases why would XXXX XXXX just not use the XXXX XXXX XXXX XXXX Department to serve the summons. My wife and myself were never served a sentence for the court appearance. In addition under utah 's XXXX XXXX XXXX XXXX would have had to attempt to reach out to me in any form to attempt to settle the debt to even let me know what this debt would be about prior to filing a court action and XXXX XXXX did not do that. My wife and myself would sign an affidavit that we had never received anything from XXXX XXXX in attempt to settle this debt outer court are they even understand what this debt was about. Presently we do not know what this debt is about. I was never personally served for this court appearance. have resided at my residence at XXXX XXXX XXXX XXXX sentence XXXX of XXXX and I've had the same phone number for approximately 10 years. In addition my wife works from home Monday through Friday during business days and no summons except the visit from the unknow individual who did not say who was. In reading the rules of procedure for the state of Utah I am quite not sure how he is able to first file this motion because under the rules of procedure he did not even meet the rules for filing. Due to falsifying court documents and misrepresenting official service papers stating that I was served when my wife or myself were never notified of the debt or the proposed court hearing. In working on attempting to resolve this there was also other court actions a total of about XXXX actions that were filed and he fell to notify me on any of those actions one of those actions is which brought this about was filing with a garnishment with the current player that I am with as of now. I had been never notified there was a risk of garnishment or there would be a hearing for garnishment period prior to this garnishment I have not been notified there was a judgment to even collect debt from the attorney. In addition there was supposed to be several steps that were to be followed under the rules of procedure which XXXX XXXX negligently did not follow because then it increased that debt factor. When XXXX XXXX falsified these documents and withheld my knowledge of my legal representation within the court system he was able to obtain 11 % interest rate on the {$500.00} plus he is able to tack on these additional fees to where the total for this debt is now {$2200.00}. I am seeking relief with the court to have this debt set aside but as I've been working with several attorneys I am told that express recovery and XXXX XXXX this is a very all too common practice. Withholding a person knowledge to go to court and the purpose of their debt to increase their debt level to increase your revenue level should be criminal. This predatory action has ruined my credit, lost of faith in the court system, an feel victimized by this attorney

I was seen by Dr XXXX XXXX on XX/XX/2018. And when I was seen I was told billing wanted to speak with me. I promptly went back and spoke to someone in billing. They told me that they had just sent the account to collections but because of the holiday they wanted to see if they could still accept the payment at the office. I guess once it gets reported to Express Recovery, I then have to go through them, and billing wouldnt be able to accept a payment. Which is understandable. We tried and my card went through. XXXX XXXX accepted my payment of XXXX on XX/XX/2018. And I was told the collection company would no longer have access to collect on that account and it would be noted the account was paid. Fast forward to XX/XX/2018. When I get a notification that Express Recovery has listed new collection of XXXX dollars on my account. I call billing and they say I have no accounts in collections and they will call Express Recovery and find out whats happening. I called back a few days later and spoke to someone else. They said they had no idea what was going on or why Express Recovery would be collecting on an account thats not in collections and they will take care of it. In XXXX I pull my reports again to find Express Recovery is still actively updating the collection account for XXXX dollars. In XXXX, I pull my reports again. Guess what? Express Recovery is still reporting a collection account on behalf of XXXX XXXX for XXXX ( which is not even the correct amount!! ) so at this point, I come into the office and talk to someone face to face. Im showing them my receipt from XXXX, that I paid this amount, {$180.00}, on XX/XX/2018. Everyone is dumbfounded. Which I can understand. I just wanted to get to the bottom of it. So after they told me they would call Express Recovery again and take care of it, I decided that I would dispute this account myself because now Express Recovery is not only screwing with my Credit Scores and affecting my ability to get a decent percentage rate on a car loan or new mortgage, they are now breaking federal laws. And after 3 people in the billing office tried to get Express Recovery to update the account and delete the inaccurate information that they are reporting to the Credit Bureaus, I decided I was going to take Express Recovery on myself. And if that means taking them to court to delete the false information then I would do so. Express Recovery has falsely reported inaccurate information for months on my credit reports and I have the proof below. This account didnt sit in their office for 5 months As they reported. They never received a dime from me. Or received payment on behalf of the doctors office for this account like they reported. Its done nothing but hurt my credit and I have tried my best to stay on top of paying all my bills on time and in a timely manner. I have taken this up with Express Recovery and they refuse to follow FEDERAL LAWS. They continue reporting inaccuracies to the Credit Bureaus and have continued to damage my credit report. The thing that baffles me the most is the fact that this bill was take care of in the very beginning of XX/XX/XXXX. And it wasnt until XX/XX/XXXX that they decided to start reporting the collection to the Credit Bureaus for an unpaid debt. And continued to report on an unpaid debt that they didnt have in their procession.

Express recovery debt collection is trying to collect XXXX in debt they say I owe in past medical bills to the University of Utah. They have provided me with any invoices only a screen shot from their computer which does not show the original amount of the debt only their companies amounts that they have listed. I called the University of Utah billing department and they told me my debt was discharged. They also stated in an email that they did not sell my debt to express recovery company. If the hospital has discharged my debt and sent me copies of my invoices showing a XXXX balance how can this debt collector continue to say I owe them those old debts? I have more recent debts with their company that I have currently requested they start applying my debts to. I started making payments on my own to their company 3 months ago of {$200.00} dollars a month. An attorney in their company called me a few weeks ago and we came to a payment agreement of {$400.00} dollars a month ; which I am paying and have held up my end of the bargain. I have asked them repeatedly to send me a copy of this payment arrangement which they have denied me and stated they do not provide payment agreements. How is that possible? During my last call with them he said my payment agreement only applied to the debt that was pending a lawsuit and that it was not to include my more recent debt that is reflected on my credit rating. After denying me a payment agreement I reminded him that It is my right to request which debts they apply my funds to. After some debate we came to an agreement that XXXX a month would go to old debt and XXXX a month could go to the newer debt. Again, I requested a copy of my payment agreement with their company and again he stated that they do not provide that documentation. How can they conduct business without providing a written copy of a payment agreement? XXXX XXXX was the original attorney managing my debt collection. I may need to go back and check my records for actual dates but I was continually XXXX by him since his company received my debts for collection. He threatened to sell my property to satisfy the debt. He came to my house and said I could go to jail for not paying my debt and asked me what the value of my car was so he could confiscate it to sell and satisfy payment. Express Recovery has continually garnished me rather than attempt to work out a payment arrangement. At my prior place of employment I had XXXX XXXX XXXX and was going to be on FMLA for 2 months. I called them to let them know that I would not be getting a paycheck for a couple of months and asked them if I could set up a payment plan for the next two months. The person said Ill have to talk to my manager and call you back. He did not call me back and when I called him back to follow up he told me I could not make a payment plan and that I was irresponsible for not calling him back sooner to follow up on my original phone call when I requested a payment plan. I can provide documentation and additional information if needed. I have attached some documentation but it was hard to see the invoices that I attached and Im not sure they are all of the invoices I needed to attach. Is there a way I can add additional documentation?

My wife incurred a medical bill from XXXX Specialists, for which XXXX Specialists never sent any billing out for, nor did they attempt to contact us to let us know there was an amount owing. Our first notification that there was any amount due was when we received the collections notice from Express Recovery Services. Attempting to pay XXXX online through their portal, they want to charge a " convenience fee '' for paying online. So I figured that talking to a representative they would be able to waive that fee. In conversation with their representative and explaining the situation, I noted that we never received any billing from XXXX Specialists but that I just wanted to be done with this and move on. They also attempted to make me arrange payments for my step child 's bill as well, even though that billing is supposed to be paid by their father whom XXXX Specialists has information on. They added on other collections accounts they stated were in my wife 's name and wanted me to pay on those as well, to which I replied that I knew nothing about them, that they weren't my responsibility, and that even if they were able to provide any information about them they were likely too old to be collected on. There was some discussion from their representative about a deadline to pay before they reported it on my credit that would cause damage to my credit score. I told them I just wanted to pay and requested we move forward with the payment. As I was about to make payment, they also asked other information about me that I was not comfortable sharing, nor was it any of their business. I told them as much and requested that we move forward with payment. As they stated a final amount, they wanted to tack on a " convenience fee '' again, to which I stated that they were not entitled to it, that their " convenience fee '' was illegal, and that by attempting to charge more than the actual collection amount they were breaking the law. They asked for my checking information, to which I replied " I will not provide that information to you, you can accept my proffered payment method or state your refusal to accept my payment '' They again stated that I needed to make the payment, plus the " convenience fee '' or they would report this negatively to my credit. I hung up the phone. They have my number, they can call me back if they care to discuss further. Because I didn't want my credit damaged as they threatened to do, I went to their website later and made the payment. Their payment website has a " print '' button, it does not provide receipts that are printable. They come out blank. I ended up screen capturing the receipt so I would have proof of payment beyond my credit card receipt. ( screen capture of payment receipt attached states " cancelling '' as their website locked up while trying to print and then would not cancel the printing either ) This company discussed the debts of other people with me and attempted to collect more money than the debt that was owed. They attempted to bully and harass me into paying the debts of other people, and threatened to post negative marks on my credit report if I didn't comply with their demands immediately.

I attempted to contact Law office of XXXX XXXX in XXXX and then again in XXXX. I am attaching what they responded. Prior to that I had called and asked to work out a payment plan. The representative wasn't abusive but was rude and did not try and answer my questions. I asked what the next step was and she did not respond or address it. When I emailed, I asked them to listen to the call ... no response. I sent a second response in XXXX and all they responded after that, is that they don't communicate through email. received a bill XX/XX/XXXX stating i owed {$500.00} dollars, no explanation of charges or what services were rendered or who originated them, i sent a couple of notes back to this person asking what the charges were for, no answer, finally i wrote on the bill if i didn't receive any information what the {$500.00} was for i would consider it a fraudulent bill, or more likely a scam, and don't send any more bills, they kept coming no explanation of what the charges were for, later received a communications from a collection agency sayin i now owed them {$500.00} no explanation of what the charges were for or who originated them, collection company was " express recovery services '' i then wrote them back stating i considered ti to be an invalid bill but would would be happy to pay the {$500.00} if they provided me the following information,, an itemized bill including the following : -service or merchandise that was provided -exact procedure that was performed -who performed the procedure -location of procedure -date and time of the procedure -reason for procedure i received no information whatsoever concerning this request later I received a letter from a so call attorney stating he was representing express recovery services, i again asked for the above information and received nothing. Concerning what the charges were for, enclosed with a second letter was a partial statement from some one unidentified showing i had paid them {$500.00} plus my insurance had paid them {$620.00} on the front of this statement they had written in paid {$400.00} in addition to that already paid, but nowhere was there any reference to me owing them {$500.00} i finally figured out who the originator of the debt was " XXXX XXXX XXXX '' where i had XXXX XXXX done in XXXX of XXXX, but i had never received a bill from them and verified everything had been paid, shortly there after i got a summons from the court i was being sued for the {$500.00} plus some additional charges the lawyer had arbitrarily added, i still was not told what the charges were for, i Don't know why they wouldn't explain the charges but i suspect they didn't know possibly because there was no record. i did pay the {$500.00} plus another {$120.00} for whatever because i was afraid of having a judgment against me, this has now effected my credit score. i didn't even know they were reporting this to them, i feel this whole thing has at best been a misunderstanding but more likely a way to use intimidation to get me to pay, as an XXXX XXXX XXXX i feel this is an attempt at elder abuse and should be treated as such i can provide added documentation if required

I received a threat to sue me from a debt collector named Express Recovery Inc. located in XXXX XXXX XXXX, UT. The threat was over a utility bill that was past due to the gas company, then known as XXXX XXXX, now known as XXXX XXXX. The trouble all started when I went online and closed my account due to moving to a new location. I was informed that a final bill would be sent via mail. When we moved onXX/XX/XXXX we had placed a change of address with the USPS. They said it would take about a week before the mail would be rerouted. XXXX XXXX sent the final bill to the wrong address and we never received the final bill so naturally, it slipped my mind over time. Then on XX/XX/XXXX I received a threat notice from Express Recovery Inc. claiming they were going to sue me if I didn't pay the debt. So I contacted XXXX XXXX ( the gas company ) and paid them the negative balance of XXXX which was owed. I explained the situation to them about not receiving the final bill and how it had slipped my mind. After paying the debt directly to XXXX XXXX ( the gas company ) I called Express Recovery Inc. and told them that the debt to the gas company was paid. They transferred me immediately over to the law office of the guy who owns Express Recovery Inc. When the lady answered the phone she asks me if I was calling in to pay the balance owed which she claimed was XXXX. I said no I paid the {$200.00} directly to the gas company and I wasn't paying it twice. Then she said well, we are going to pursue the lawsuit then. XXXX XXXX ( the gas company ) confirmed to me on XX/XX/XXXX, that they notified Express Recovery Inc. on XX/XX/XXXXthat the debt was no longer owed. The lawsuit was still filed against me on XX/XX/XXXX in the amount of {$350.00} and some change which still includes the original debt of {$200.00} according to the court when I spoke with them on XX/XX/XXXX. Express Recovery Inc. and the owner whose name I will not mention here has committed fraud by filing a lawsuit on XX/XX/XXXX when they were notified directly by XXXX XXXX ( the gas company ) on XX/XX/XXXX that the debt was no longer owed. This debt is also still on my credit report and both Express Recovery Inc. and the owner ( the lawyer ) have refused to have this removed off my credit report even though the original debt doesn't exist. Express Recovery Inc. has committed fraud by filing a fictitious lawsuit to collect the original debt owed which no longer exist and at this point is also falsely reporting a collection and/or debt still owed that doesn't exist.

On XX/XX/XXXX my son XXXX XXXX XXXX. I took him to XXXX XXXX XXXX located in XXXX Wyoming. He was seen there by doctors and received treatment. Some time in XXXX of XXXX, I received a bill from XXXX XXXX XXXX. Since I was employed at work for XXXX XXXX I took care of the bill. I provided XXXX XXXX with both my sons insurance cards. My son had two insurance at time. He had XXXX and XXXX XXXX. However in XXXX of XXXX, I then received a bill on a XXXX XXXX XXXXletter head with its logo displayed and a contact number for Express recovery a debt collection agency. Very shocked and concerned, I called the number and spoke with a lady by the name of XXXX. I explain to her that I believe that someone made a mistake and that my son had insurances that covered the medical bills both XXXX and XXXX. I was put on hold while XXXX stated that she would look into things. After being placed on hold XXXX stated for me not to worry and that both insurance XXXX and XXXX was billed and that the problem was resolved. This month XX/XX/XXXX, I checked my credit report and came across two bills that were sent to my credit report back in XXXX. I then went to XXXX XXXXXXXX XXXX 's financial office and spoke with them regarding the matter. I was told that everything was paid off by both insurance companies and that I owed nothing. I then showed them that two bills were sent to collections and now on my credit report. I then learned that the physicians billed separately. They provided me with the physician office phone number and I called and was told that they have one bill for the date of service for XX/XX/XXXX. I was then told that they never billed XXXX. I told them I spoke with XXXX from express recovery and she told me that they did bill XXXX and XXXX. Again they confirmed that they only billed one insurance. I then contacted Express recovery and informed them of what I had learned and informed them that someone was not telling the truth and that the problem needed to be addressed. I then informed that if they could not fix the mistake and remove it from my credit report then I would be filing a complaint. In conclusion I am very upset over this and should not have had to suffer damages to my credit report because of incompetency and someone not doing their due diligence. I was deliberately lied to and false reported debts were placed on my credit report. This is not right at all. I strongly feel that whoever was responsible for sending the bills to be placed in collections should face stiff penalties for such misconduct.

Company is Express Recovery Services. Trying to get facilities bill for ed visit ( hospital tried to charge insurance but had wrong birth date and also had wrong address for me due to typos so never got notices so went to collections ). XX/XX/XXXX call while i am at work, try to collect. I say I want to talk to hospital and say specifically I can't do this and have to pay through them XXXX, I call hospital billing department multiple time and they give me different answers regarding releasing bill from collections ranging from " need to talk to supervisor '' to on XX/XX/XXXX having three way call with express recovery who say bill is being " disputed '' but it being " released from collections '' is not possible. Also on XX/XX/XXXX, speak with original representative from express recovery services that spoke to on XX/XX/XXXX and insinuate that " releasing debt from collections '' is actually possible but unlikely. XX/XX/XXXX : Ask my insurance to call the hospital billing on the XXXX. They call and tell me that the hospital will " release bill from collections '' and charge insurance. Given my arguing about this for 7 days and them getting this done easily ask them to call in a 3 way fashion so I can confirm and here ( change birth date to correct one with hospital as well ) and confirm XX/XX/XXXX : call collections agency, hospital and have insurance call hospital, all who confirm debt is " released '' from collectors and my insurance is being charged. My concern is the collectors misleading me telling me I couldn't talk to the hospital or have my debt released so my insurance could pay for it. My insurance would not pay the collectors directly because no line item bill which would force me to pay cash for something that I actually had coverage for. I'm a physician and I hope my patients do not got get tricked into this type of financial hardship because they are told they can't use their insurance since they can't have their " debts released from collectors. '' Of note the letter sent by Express Recovery Services says " Pay this office only '' further making it seem as their staff did that I can not half the hospital billers " release the debt from collections '' so I can actually use my insurance as opposed to be forced to pay cash to collectors since insurance doesn't pay collectors since they need to see line item type bill that only comes from hospital.

Somehow I owed approximately {$94.00} to an old electric company. I have not been with the company for almost 3 years and was not notified of the amount still owed. I had payment arrangements with Express Recovery Services and stopped paying them regularly when they notified me of the additional charge from the XXXX XXXX power company. On XX/XX/2019 I contacted them concerning my bill and the extra charge and requested on two separate occasions that I be sent a statement on this bill and where it came from and for when the charges had occurred. I did not receive any imformation. On XX/XX/XXXX I received a bill for the above mentioned electric bill AND for another charge for XXXX XXXX XXXX for which I have no records of even having a bill with them. I still have not received the statements for the power bill. Prior to the incident in XXXX I had been paying on a medical bill from the XXXX XXXX XXXX Hospital that I was not able to pay prior. However, once I began receiving these additional bills I stopped the auto-payments and have not made additional payments to the account as I am still waiting for a detailed payment statement to arrive. All I receive in writing from them concerning the amounts that I owe are the companies they are claiming they bought my debt from and the amount and interest. There is no further information to protect me so that I know these payments are legitimate. No account numbers, no dates, nothing. I am also not getting accurate information from the individuals I am speaking with on the phone and they are clearly not taking accurate notes and not sending me the proper information. Today I received a threatening letter from the XXXX XXXX of XXXX XXXX XXXX stating if this was not disputed and paid they would send this to have a judgement placed. The ONLY written correspondence that I have received from the company are the attached documents. None of which answer my questions as to what I owe and why. My daughter was in XXXX XXXX XXXX XXXX XXXX XXXX XXXX XX/XX/XXXX ( XXXX XXXX XXXX XXXX Utah ) for a major health event. I cover her health insurance and made sure to contact the billing department early and provide documentation that myself and her dad ( who are separated ) are both legally responsible to pay XXXX of all her bills. As such, billing was split accordingly- although this took repeated effort. I maxed my out-of-pocket and paid all bills owed on my account for her. XXXX XXXX Billing office has record of this and confirmed this recently. They also noted that I was paid in full and the balance remaining was due from my daughter 's father. I have received no medical bills since XXXXXXXX XXXX XXXX I received XXXX individual bills from a collection agency, Express Recovery Services XXXX Inc. in my name for what appeared to be my daughter 's dads ' bills. I called XXXX XXXX billing and they noted that I was paid up and they weren't sure why the credit agency had sent me the bills. The notes that they had access to ( Express Recovery Services ) showed that I had paid my balance back in XXXX. The credit agency had been unable to collect from my daughter 's dad and so decided, I guess, to go after me - despite knowing, having written documentation from the hospital billing office, that I had already paid my balance. This is completely unethical. I called the credit agency right away and explained that I didn't owe anything, had paid in full, and would be contacting XXXX XXXX billing to discuss the matter. I also noted that I intended to reach out to my attorney about the matter because I was so tired of dealing with the issue. To date, since that initial conversation back in XXXX, I have not heard from them ( credit agency ). However, given the egregious nature of this action by Express Recovery Services, who sought me out on their own and not at the request of XXXX XXXX, I strongly believe there should be some action against them. This was an effort to intimidate me into paying for my ex 's bills probably because they knew I did pay my bills. I suspect they've done this to other people who are divorced/separated from their former partners. If I had the funds, I would sue them.

I received a summons from XXXX the attorney for Express Recovery Services in regards to an outstanding medical debt of {$77.00}. The summons stated that with collection and attorney fees, I owed {$350.00}. When I called the office of XXXX today, XX/XX/2017, to discuss settling the matter prior to judgment, I was told by XXXX that to halt the judgment the full balance had to be paid today. The amount XXXX said had to be paid to halt the judgment was over {$400.00}. I was driving at the time so was unable to write down the exact amount but the amount he said would be required to halt the judgment was well over the amount listed in the summons. I stated that amount was more than 4 times the amount of the outstanding medical debt. I asked if the amount could be settled on and was told no. XXXX also stated that payment had to be made today to halt judgment. I stated that I would n't be able to remit payment until the XXXX and XXXX told me that if payment was n't made today the judgment would be submitted. I again stated that I would n't be able to remit payment for 2 weeks, and asked if he was unable to accept the arrangement if that was n't someone there who could. I was placed on hold and when XXXX returned he stated that he could n't accept an arrangement because I 'd refused information on the call. When I stated that I had n't refused to provide anything I 'd simply stated what my intention of calling was when he 'd answered the call 5 minutes prior. I stated that if he 's telling me that I ca n't work out a payment arrangement because of a question he 'd asked over 5 minutes ago that seemed pretty catty. I told him that if additional information is required to work out an arrangement is required, then I can simply provide that information. XXXX stated that this call was n't going anywhere and disconnected the call. I called back and asked to speak to someone else where I was transferred to someone 's voicemail, and have yet to receive a returned phone call. The amount that XXXX demanded to halt legal action was inconsistent with the amount listed on the summons and legal action was threatened if that amount was n't paid in full today. I was made aware of an alleged debt of {$77.00} when I saw it on my credit report XXXX XX/XX/2022 under Collections. I have never received written correspondence or phone calls from Express Recovery Services, XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX UT XXXX. When I saw it, I immediately contacted my estranged wife and asked if she knew anything about it. I did not know if the collection was due to identity theft, her debt or mine and did not know what Express Recovery Services was until I googled it after seeing the collection on my credit report. What I have learned since is that Express Recovery was contacted by my estranged wife on XXXX XX/XX/2022. She spoke with an individual named XXXX from Express Recovery Services , Inc. During this conversation, XXXX violated the Fair Debt Collection Practices Act ( FDCPA ) by discussing this debt her.My debt is none of my estranged wifes concern. Our credit is separate but regardless, I believe XXXX violated the FDCPAs policy. XXXX discussion of this debt with my wife was a gross violation of my privacy. Furthermore, XXXX discussed the original debtor as Utah XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX # XXXX, XXXX XXXX XXXX, UT XXXX. For XXXX to report that I had a debt with this medical facility implies that I have used this medical facility and therefore she violated the Health Insurance Portability and Accountability Act ( HIPAA ), and my right to privacy. HIPAA violations 4 and 5 specifically. In my opinion, XXXX discussion with my estranged wife are criminal and should absolutely come with penalties. I phoned XXXX XXXX on XXXX XXXX and found that the debt was mine from nearly two years ago, but they were using an outdated address. Ive been in my current home for nearly 24 years and they were using an address prior to that. However, I did pay the debt directly to XXXX XXXX over the phone. In a further conversation is the XXXX XXXX Office Manager, XXXX XXXX XXXX, he stated that he would inform Express Recovery to remove this collection by Thursday, XXXX XXXX. To date, the collection remains. While he made apologies for the error, the fact remains, my privacy was violated.

Firstly, I would like to submit a complaint towards XXXXXXXX XXXX XXXX for selling my information to a third party company, Express recovery services, without my knowledge and Authorization. This can surely be classified as identity theft. I received a mail on XX/XX/2022 from Express Recovery Services, A Debt collection Agency at the amount of {$220.00} without explanation or reason. A breakdown Stating ; Client name : XXXX XXXX XXXX, amount owing {$210.00}, interest {$9.00}. XXXX XXXX XXXX is our electric company. I say 'Our ' because I share a house with three other females and we all pay utilities under one account number. The account was under my name up until XX/XX/XXXX. I was leaving the country for a few months, so it was only smart to switch the account over to one of the other roommates name, in order to avoid any mishaps. All bills prior to this were paid and paid on time. XXXX XXXX XXXX can testify this. I was not aware of any other payments due, because it would've carried over to the name on the account after me. I made a call to XXXX XXXX XXXX to inquire about the situation and gain some clarification as to why I had a collection report on my credit. They explained that there was a closing cost/bill which was unpaid. I explained to them that the account was never closed, and its still active till this day, it just got switched over to a different name because I was leaving the country and won't have had access to make payments. I tried to come up with a way to resolve the situation by making any payment claimed to them directly, to avoid further deterioration towards my credit, but i was turned down. The representative let me know there was nothing she could do and the only thing to do was to call the debt collector and make the payment. This has caused extreme damages to my credit score and has put me at high risk of not being able to obtain any future assets which has caused me mental anguish. Lastly, I would like to add that I do not owe Express Recovery Services any debts or payments because I didn't not sign nor have any contract with them.

I was served papers for a RECENT debt from XXXX XXXX, ( ie Express Recovery Services ), shortly after disputing it with a credit reporting agency. In order to verify this debt I need the itemization and PROOF that the debt is in fact valid. Many of these debts are too recent for the paperwork to have processed due to the slowing down of IRS paperwork, by the coronavirus. Getting the information is the only way I can properly reply. On XXXX, their hours are Monday-Friday and Saturday _XXXX to XXXX XXXX. When I showed up at XXXX on Saturday, I discovered that EXPRESS RECOVERY SERVICES is in the same building as XXXX XXXX XXXX. But XXXX XXXX XXXXXXXX isnt posted on the door anywhere ... I walked around looking for a separate door :,, nothing. Furthermore, when I called because the front desk area wasnt open, I was told that law office of XXXXXXXX XXXX XXXXXXXX was open just on the other side of the door, she had the paperwork, but she wouldnt give me the papers because the receptionist was their client, express recovery services ... and they werent open. I was upset about this and am now delayed further as I dont have a car to drive there all the time. Im an unemployed individual living through this pandemic. A lawsuit on recent unresolved debts, currently in dispute, is anything but compassionate and should be a crime. I told them this to which I was told everything is moving forward, businesses are still running and the world is moving forward. I am not able to be employed as I am on the CDC list of vulnerable populations right now. Express Recovery is garnishing my wages for amounts that I do not owe to them. The summons they served me had no information such as date of service I owed these said companies just that I owed them money without any proper documentation one of which is XXXX XXXX and their billing department who has now locked our accounts for an amount of {$140.00} dollars which is preventing me and my wife from getting our medications refilled which are medications that could without them could cause serious harm to our health. Per Express Recovery, they say I owe money to them but on the summons it says no dollar amount as to what I owe. I am being garnished through Express Recovery and they will not separate the medical part from the other I believe are false so with them not being separated, I can not get the mediation I need to help me with my illness which I would consider on not only Express Recovery but also the XXXX XXXX as some sort of Malpractice because my health has the potential to bad without mine or my wifes medication and if that happens then that would be a type of malpractice. With that being most important, my wages are being garnished and they have gotten away with the garnishment although no evidence or paperwork adding as to any dollar amounts. I was with XXXX for XXXX+ years. I decided to not renew because I was not satisfied with them. I was on a month to month contract, but, to simplify my life I just paid it annually in advance each year. The last renewal bill I did not pay. I switched alarm companies in XXXX. That same month I got a call from XXXX XXXX asking why I did not renew. I told the supervisor why and he stated he was sorry and asked what he could do to keep me as a customer. I told him I already switched XXXX and there was nothing. He said he would get back to me with a proposal anyway, I said fine, just email it to me. I never got that email and therefore did not even think about it. Sine that phone call I sold my home, purchased another and never gave this issue another thought until early this year, I noticed a collections on my credit report. They are claiming I owe {$330.00} for alarm services. Then I got to thinking about what happened. I had some questions. 1 ) Why are they charging me for almost a full year of service? 2 ) Why did n't the supervisor tell me this on the phone in XXXX when he knew I was with another company? 3 ) How long does it take to cancel a service for non payment? I called XXXX XXXX and they said they do not have the records anymore I have to deal with the collections company. I sent certified letters to the collection agency ( attached ) trying to resolve this and they are refusing my offer. I offered paying up to the time in XXXX that I spoke with the supervisor even though I feel I owe nothing. I think it is more than fair. I now understand that they require an advanced written notice to cancel. I think the supervisor had an obligation to notify me of this when I spoke to him on the phone. There was no way for me to know or remember this procedure from XXXX years ago.

I received a few calls to my work phone on XX/XX/XXXX. They were confusing messages with a website left. I looked for the website and company name, they do not exist. They mentioned XXXX XXXX, so I spoke to them and was told no debt was owed. Then, I called the phone number to straighten things out. This is not allowed to be reported onto my credit report or tried to gain recovery for this unknown, unproven debt. It is time barred. It is up to them to prove that I owe this debt. They have not done so in over 4 years. I am also not required to update my information with them. I also informed them via phone not to contact my work phone anymore, and received several text messages from them AFTER speaking to them. The company is : Express Recovery Services XXXX XXXX XXXX XXXX XXXX XXXX, UT XXXX ( XXXX ) XXXX I never received letters from the company to validate the debt or to allow me to dispute the debt. I only found out about the debt being in collections by checking my credit report in XX/XX/XXXX. After that, in XX/XX/XXXX, I did contact them to try and work with them and they would not work with me. Months later they filed a judgment, again, I was not properly notified of the court dates so it was awarded to them by default. I received a call in XX/XX/XXXX from them telling me that they had won by default and proceeded to tell me all of the things they were going to do to recover the money for the hospital bill ; such as seizing my assets, credit damage, and wage garnishment. They inexplicably withdrew the judgment and then renewed the collection accounts. Yet again, I found this out by looking at my credit not from them or the courts. From the beginning, this company founded on punishing people for wanting to stay alive, has been despicable on every level. They were uncooperative, condescending, and just disgustingly proud of their loop-hole navigation. They exist only to contribute to or be the cause of human suffering. They represent the worst qualities of corporations, Americans, and human beings in general. These are fundamental truths, not opinions. Regardless of these impassioned statements, this company did not properly notify me as required by law. I would include these documents in my complaint, however, they do not exist.

XXXX XXXX I was notified that I was being sued for a medical debt from XXXX XXXX. I called the lawyer attempting to find out what was owed. He would not send me a detailed bill and said it was owed to express recovery services. Express had contacted me on the phone in XXXX and said I had a bill due with XXXX XXXX. I was never provided any written validation of debt or communication after the phone call. I attempted to go to XXXX XXXX in XXXX And they said I had a past due balance. I asked for the total and paid it promptly. I assumed this was the original debt referred to by express recovery services. I contacted them again a week later and they still had not seen the payment so I tried to pay again but my card was denied due to having already paid the week before ( we only had enough to pay the original amount ). We were never informed that there were actually two charges of debt from XXXX XXXX and that we still owed {$210.00}. They are now suing us for {$750.00} to cover attorney fees for a debt we were never notified of. Only after our response to the lawsuit did we finally see a bill outlining what the original charges were for. After seeing the bill we would like to pay the charges that are owed but now they won't accept it without exorbitant legal fees. This is obviously just a way for the lawyer to make money. Express Recovery is reporting erroneously on my credit file. I had recently checked my credit and noticed these debts. I never received any notices, calls, or letters about this debt. I called and paid this debt. When i called and spoke with them I requested the collection accounts be removed from my credit file since i was not made aware of these collections and they denied my request. I have now disputed it multiple times with the creditor directly and with the credit bureaus and the accounts remains on my credit file. I have called back and requested they remove this debt and have been denied every time. This is now getting in the way of me obtaining financing and i don't know how else to get this item deleted off of my credit file. I never received any notice of the debt or else I would have paid it before it even went to my credit file and ruined my credit. I have now paid and it is still ruining my credit. How can they even do this? I know that they have the power to add and remove items from credit and i do not owe them anything and it is not fair that they can continue to ruin my credit by reporting this collection THAT I DIDNT EVEN KNOW EXSISTED. A disputed medical bill from u of u was given to express recovery services. We explained that it was, and still is disputed to express recovery. We explained there are inaccurate charges and credits and will not pay more until it gets straightened out. They did nothing to straighten it out, threatened us with extra fees, and just filed a legal suit against us. First of all they put this on our credit report and did not mark it as a disputed issue as they are required. Second, they have ignored the judge XXXX XXXX XXXX 's instructions to not charge interest or fees and are still pursuing the inflated amount from us. We have sent them a check but they wo n't cash it. They have do not conduct business to obtain accurate payments on bills. They will not research issues to be accurate. They will not follow the judges direction. They report to credit agencies unlawfully by not explaining the issue is disputed. I also noticed they deceitfully collect collection information at the courthouse without explaining what any why it is going on. Their employees are allowing themselves to be misrepresented as officers of the court in order to get descriptions of assets so they can collect against them. Those people called into court assume the people in the courthouse telling them to fill out paperwork are court officers. That is a deceptive business practice.

I went to the emergency room at XXXX XXXX XXXX in XXXX, Wy ( I dont know the dates of service as I have not been told ) At the hospital they never asked me for any demographic information or to verify my information. The only thing they asked for was my name and date of birth. Then back in XX/XX/2020 I received a call from a debt collector at Express Recovery Services. Today,XX/XX/XXXX at XXXX Utah time, I recieved a summons from Express Recovery Services of XXXX XXXX, UT. At some point unknown to me, XXXX XXXX XXXX XXXX XXXX UT, hired Express Recovery Services to collect a medical bill debt from my wife that happened on either XX/XX/XXXXor XX/XX/XXXX. The problem is that we did not know Express Recovery Services or XXXX XXXX XXXX were trying to collect for a bill due to my wife and I never recieved any kind of notice about the bill. Also, after some research of my own, I discovered that Express Recovery Services violated the " Notifying the Debtor '' clause of the FDCPA ( Fair Debt Collection Policies Act ) by not giving us a 30-day notice that there was a debt to be paid, the amount of debt, and ways to resolve it. Express Recovery Services, is suing my wife for {$520.00} plus fees and myself for {$220.00} plus fees. I believe that they are asking for more than the original amount and why I am included is wrong because I did not receive any medical services from XXXX XXXX XXXX. My wife was fully covered by medical insurance at the time of the service and the bill was most likely paid, but XXXX XXXX XXXX sent us to collections anyway. Express Recovery Services has received numerous validation debt letters over the years and request to verify 100 % proof and 100 % accuracy of a debt I have no knowledge of. They have sent printed screenshots of an account a few years ago which violates the FDCPA and I immediately sent another letter requesting 100 % verifiable proof 100 % accuracy of a written contract, signed documents to verify the debt and all my letters have been ignored by ERS. I sent them a cease and desist letter two years ago from calling me. Yet, I received a call at my mobile number from an unauthorized person from ERS named XXXX XX/XX/2017 stating she was attempting to collect a debt. They are aware of a cease and desist being in effect for the last two years. I called her back and left her message to cease and desist contacting my cellphone I never requested to speak to her. I received a letter from the XXXX XXXX XXXX XXXX XXXX. This letter said I owed a debt and so I called the office to figure out what this was about. I recieved this letter XX/XX/2021 First I spoke to a XXXX ( something like that ) and told him that the debt wasn't mine on XX/XX/2021. I needed proof so I could look at it. EXPRESS RECOVERY SERVICES is listed on my credit report as the business that is certifying that I owe a debt. However, I requested documentation as to the validity of the debt to which the company did not respond. I then disputed the debt requesting validity of a debt owed to EXPRESS RECOVERY SERVICES which had/has my signature permitting the debt to be sold to or transferred to EXPRESS RECOVERY SERVICES. My debt collection is with XXXX XXXX which I never received anything from them, it just went straight to a law firm. Originally they were claiming {$1300.00}, I had called XXXX XXXX XXXX to make payment arrangements, they were unwilling to work with me. In XXXX XXXX, my wife and I discovered that Express Recovery Services , Inc. in XXXX XXXX XXXX, UT was reporting negative credit information to our credit files with the XXXX XXXX credit bureaus. Was sent over by doctor from XXXX XXXX XXXX XXXX XXXX to have test done. They were in the same XXXX XXXX building and used the same receptionist and front desk. Was never told that they were not under my insurance. Disputed bill with XXXX XXXX multiple times and was never responded to. We had XXXX XXXX come to our house and offer to do in blown attic insulation for free to us as long as we applied for XXXX credits, XXXX through our natural gas company and XXXX through the federal government on our taxes. We filled out our natural gas company XXXX and received the check and sent it to them. When it came time to do our taxes we found out that the credit that they claimed was still valid was not valid, we spoke to a representative of the Internal Revenue Service to find out that the credit they wanted us to apply to our taxes had expired 2 years before their service. On the form we signed it specifically states " In the event that i have complied with the above terms and done all I can, and I do not qualify to receive any part of the rebate check ( s ) I will not owe Penguin Insulation that portion of the Total Amount Financed. '' I think I did all I could to try to get the rebate but I am not going to cheat on my taxes to do it. I received a gas bill collection notice from a recovery company stating I owed over {$2400.00} for a past due account. When I called the recovery company they told me it was for an address related to my husbands business. When I told them of their error the man on the phone told me that I was liable for the account under the Family Necessities Act. Basically that I am liable for anything that relates to the household. He then told me that I would need to call an attorney as they were moving the account to a judgment against me. We receive a phone call from this collection company EXPRESS RECOVERY SERVICES Attorney XXXX XXXX XXXX ( who is the attorney for plaintiff ), trying to collect a debt from the University of XXXX XXXX XXXX, and we try to arranged payments and explaining our situation being XXXX XXXX XXXX with XXXX, the lady representative was not willing to negotiate and toll us that we needed to pay the full amount right away over the phone and that there was anything to do, adding that not paying will have bad consequences, and the next day we received the lawsuit from the Court ( which even was pre-dated : not having the date of delivery but an upcoming date/day ), the paper was deliver by a man rather than post office and given to our minor son, without requesting an adult. Express Recovery was reporting an amount on my credit report, which I have never received any information on. I sent a validation request initially a few months ago, asking for them to validate this amount, if this is a medical bill which member of my family it was for, dates of service etc. They never responded to the initial request, so I second one was sent on XXXX XXXX, 2017. Both requests for validation and verification contained all of my contact information so they could provide the requested documents and get a hold of me easily. In regards to Complaint XXXX, Express Recovery states that they sent a deletion request, however, both are marked " Draft '' clearly and the item is showing on my credit report. Express Recovery has had multiple opportunities to solve this issue, but has continued to not follow through or have the item removed. This shows complete disregard to the law and their promise that it was going to be removed. I have again, attached the original complaint and the " Draft '' request from Express. This item needs deleted today and compensation given to me for their violation and cost of me not being able to obtain credit because of their not getting the item removed as promised and in a timely manner. My medical account was allegedly transferred to a collection company. The medical company says they sent me a letter, but I have not received it. The collection company has refused to provide proof that they have been hired to collect the debt and claim no such proof exists. My husband was served my judgement paperwork on XX/XX/23 while I was at XXXX classes. The collection agency never sent me any written notice of debt being in collections, never tried calling me to discuss the debt. I only got the information when I was served. The collection agency has refused to supply me with the requested documentary evidence bearing my signature that I have some contractual obligation to pay them. I was not aware that I had an outstanding debt because the medical facility sent the bill to the wrong address. Eventually, I was contacted by a collections agency about this oustanding debt I knew nothing about. Apparently, after several failed attempts to contact me via mail ( because they had the wrong address ), the medical facility sold the debt to a collections agency, who then contacted me by phone. I provided the collections agency with the correct address and they agreed to send me some information about the bill. Today XX/XX/2020 I received in the mail from Express recovery services, INC that they got a Motion for disclosure order of judgment debtor 's employment information, when on XX/XX/2020 I told them that I have been unemployed scents XX/XX/XXXX. Not only did I not know of any judgments they never told me of any. I told them I was unemployed and I was starting a new job in a few weeks, they then proceed to ask me how am I paying my other bills. I do not know who that collections is for. Upon first request to verify dept, Dept collector did not send anything other than who the dept was owed to. A second request was made asking for a copy of the original signed contract with which I could verify the debt. I started getting garnishment for a debt from 7 years ago that I would not remember anything about, I wish these debt lawyers would try to contact costumers before just out of the blue start garnishment especially if its a debt you dont even know you owe. I dont see it on my credit report so how would someone know. I called espress recovery and the woman was curt with me and told me if I dont owe it it will eventually show paid but will not come off my credit reports.
