On XX/XX/XXXX I started a cash advance transaction on my XXXXXXXX XXXX credit card at the XXXX XXXX XXXX XXXX XXXX XXXX. When advised of the approximately {$90.00} fee I declined continuing with the transaction and requested to cancel it. The cashier refused and called management. Management advised me that once started, a credit card transaction can not be stopped or cancelled? I DID NOT ACCEPT THE MONIES ( {$1800.00} ) AND LEFT THE PROPERTY WITH THE MONEY IN THE HANDS OF XXXXXXXX XXXX XXXX I immediately called XXXX XXXX and the rep. advised me, " of course it can be cancelled and do not worry about it. If you did not take the money they will not put it thru as a completed transaction '' She advised it was only showing as pending. I checked back with XXXXXXXX XXXX three days later and the charge was sent thru as a completed transaction and charged to my XXXX XXXX. Once again, the XXXX XXXX rep said it must have been an error and completed a dispute to have it reversed. I contacted XXXX XXXX and the XXXX manager had no knowledge of the situation. Several days later the XXXX manager called me back and advised that he found the {$1800.00} and it was in the possession of a XXXX XXXX employee! He then advised me to come and get it, and he will place it in " lost and found ''. I advised him it was a cancelled transaction and he said I completed the transaction and I had to come take the money. XXXXXXXX XXXX replied to my dispute and advised that XXXX XXXX card processing company sent a sworn affidavit that my transaction was a " normal transaction '' and that I " took the money ''! ( Copy available ) I again stated that this was totally false and XXXX took a second dispute from me. The second dispute received the same response from EVERI that I had the money and it was a normal transaction. XXXXXXXX XXXX advised me that they will unwind the transaction in their system for XXXX days whatever it takes for me to get this resolved. Furthermore, they acknowledged that if I declined or cancelled the transaction it should have never been presented to them by EVERI. It was clear that EVERI did anything and everything to retain the {$90.00} fee that they would lose if they properly cancelled the transaction. I sent a demand letter to XXXX XXXX which was ignored. I filed small claims against XXXX XXXX in XXXX. XXXX XXXX appeared in small claims and was represented by an outside attorney. He proceeded to advise the XXXX XXXX XXXX no longer had the {$1800.00} and they turned it over to EVERI Payments Inc so I no longer had a claim against XXXX XXXX. Shockingly, the judge agreed and advised me that I was pursuing the wrong party and it was EVERI I needed to file against. She further stated that I could not do it in small claims as credit card disputes were prohibited in that venue and must file in Justice Court. I then proceeded to send a demand to EVERI which was ignored. I then filed a civil action in Justice Court and EVERI filed a Motion to Dismiss which was heard on XX/XX/XXXX. EVERI was represented by outside counsel and I was XXXX. EVERI 's Motion to Dismiss was based on that the case was already heard by the Small Claims judge and I was prohibited from filing the same matter again. I explained to the Judge that at the time of filing the Small Claims case EVERI did not have possession of the monies and furthermore, I could not have named them in a Small Claims matter under Nevada law. The Judge sided with EVERI and granted the dismissal with prejudice. After the Court hearings EVERI 's attorney refused to respond on their intentions on the {$1800.00} that they hyad in possession for over a year. Finally, they advised they would only return it to me if I sign a blanket release of any and all liability against EVERI and all the management. I refused to sign, as that was not their money and the fact they want a blanket liability release confirms to me they did many things wrong here. On XX/XX/XXXX I received a certified letter with a check for {$1800.00} ( copies available ). EVERI had this money for over a year and a half and I was paying interest and fees the whole time to XXXXXXXX XXXX I guess EVERI won in the end and forced me to complete the transaction all so EVERI could keep their {$90.00} transaction fee. ( Letters, demands, check copies, court forms, all available. )

Went to 2 casinos. XXXX XXXX and XXXX XXXX. used ATM to remove cash. During the use of the ATM my husband and myself selected checking account to withdraw {$200.00} and during the transaction at the end said this ATM charges a {$4.00} fee do you want to continue. Clicked yes. Then when the charge shows up at the bank they removed the {$200.00} plus the {$4.00} but they also removed {$2.00} for our checking and savings accounts saying that I requested a balance inquiry. This is a pattern for this company and it is fraud on a grand scale. I am looking for and attorney to see about starting a class action law suit. This company is making millions off this scam and say it is in the computer programming of the ATM. The Casinos are aware of it also and do noting to stop it. On XX/XX/2023 I visited XXXX XXXX XXXX in XXXX, OK Address XXXX XXXX XXXX XXXX, Ok XXXX I used the Everi ATM machine I entered my debit card and requested a balance inquiry. The " ATM '' machine errored out and prompted me with a message that says, " unable to complete transaction '' We can not process your request at this time. The machine charged me on XX/XX/2023 {$640.00}. XXXX says this was to purchase a gaming ticket, yet I was doing a balance inquiry. When they looked back it said note presented not collectable. I filed a claim to the XXXX, but they told me not to worry that Everi will credit my money back. On the Following day on XX/XX/2023 I was charged again! {$680.00} from the SAME MERCHANT, I did not make another balance inquiry, and I went and spoke to the representative of management and they told me that EVERI WOULD REFUND MY MONEY. I waited a week a nothing happened, waited a couple more weeks nothing happened. So, I called my bank and file a claim on XX/XX/2023 my bank did not credit my account. So now I need you help since your machine stole my money and the casino crew is clueless. Kindly contact me and provide a solution. Everi does not have an easy number for any consumers to contact them. I have tried calling the XXXX number and keep getting told my case will be escalated and nothing happens. This is money I actually need, and I know for certain nothing was dispensed. Even XXXX confirmed to me that they don't see a gaming ticket was presented. That I need to contact Everi so that is what I am doing. Again these were charged to my debit card, no gaming ticket was received. When I contacted XXXX again they told me that they show a gaming ticket was redeemed twice, but they stated that they can see it says printer error and the transaction cancelled. Yet XXXX says they are not responsible and that I need to contact Everi, These charges are both to my account ending in XXXX. Debit card ending in XXXX. I should not be held responsible for something I did not do. Especially when I simply was requesting to check my balance, and WHY WAS I CHARGED TWO TIMES FOR GAMING TICKETS for 1 balance inquiry. That really doesn't make sense especially since I waited at the machine for 15 minutes, and nothing printed. The transaction CANCELLED. Regardless if it was redeemed who redeemed it? It wasn't me and the XXXX confirmed it didn't print.

My wallet was stolen from my vehicle on XX/XX/XXXX and illegal / fraudulent charges were made. Theft was reported to both XXXX XXXX XXXX and XXXX XXXX XXXX XXXX. I notified all credit cards companies and disputed transactions. All were verified as fraudulent ( and there is video surveillance of all transactions ) and money returned to my account/ cards. One charge from XXXX XXXX was initiated at a casino as a cash advance. XXXX XXXX contacted the merchant ( Everi XXXX ) and notified them that this was fraud. They provided merchant with police report, and Everi did not fight or dispute chargeback. On XX/XX/XXXX I was notified by my private banker that a negative collection hit my credit reports ( resulting in a XXXX point drop ) from company called XXXX XXXX XXXX. Upon contacting them I was told it originated from the fraudulent credit card transaction at XXXX XXXX that that EVERI XXXX was the reporting company for collection. I contacted XXXX XXXX, who verified that this was verified as fraud and charged back. They also said this was between XXXX XXXX and Everi- not me the consumer. Everi did not fight or dispute the fraudulent transaction / chargeback, but sent my information to collections knowing full well that this was identity theft / fraud.

On XX/XX/2022 I visited XXXX XXXX and XXXX XXXX Ok. I attempted to visit one of the Everi ATMs. I selected purchase gaming ticket which requires putting in a pin. Upon doing so the transaction said and prompted this transaction could not be completed please contact your financial institution. My card was promptly ejected and it went back to the please insert card. After it cancelled I checked my online banking and I was INDEED CHARGED This was a transaction, In the amount of {$2000.00}. I promptly told security they reviewed the atm and assured me I was not charged. I showed them I was, and the guy told me that the transaction will fall off in two business days. The transaction never fell off. Then I disputed it with my bank, everi sent a response stamping it with a stamp twice saying REDEEMED. I didnt even get a print receipt and their cashier told me there was nothing they could do I should call everi which I did. However Everi because they marked that stamp told my bank someone received and redeemed it and it wasnt me. This has caused my account to overdraft because of something I never received.

On XX/XX/XXXX I used two separate ATMs, and both times my card did not eject from the machine and had to be manually retrieved. Both times the screen on the ATM read : " error/card not taken, account with not be charged ''. I've used these same machines several times with the same card in the past with no issues. My checking account was debited both times, each amount was {$500.00}, for a total of {$1100.00}. I never received any money. I've contacted the ATM provider, EVERI, provided the location, date, exact time, first 6 and last 4 of the card number, and amount of transactions. I was told they couldn't find anything that matched and I needed to give them my card number in it's entirety. I don't feel this is necessary, Im not comfortable giving them this information. My card issuer, cash app, has started a dispute, but tell me it could be 55 days before it's resolved. I've received a provisional credit of {$5.00} for the ATM fees and that's it. I need my money back!

The company involved XXXX XXXX XXXX XXXX located at XXXX XXXXMy main complaint is cash withdrawal fees.The fee that was supposedly charged was {$4.00} but when I got my statement on XX/XX/XXXX & XXXX XXXX the charged me extra fees of {$2.00} five times for each withdrawal. I made 3 withdrawal which come out to {$35.00} extra charged without me making a balance inquiry 15 times.I contacted my bank but he are unable to reverse charges.Everi is the name of the ATM machine which is run by XXXX XXXXI think this ATM exist in all casinos in Oklahoma, Louisiana & Mississippi.I did try to contact the company online but never got any response.This charges never existed before but I was wondering if it is common business practice.
