Due to extreme inflation, not being paid XXXX XXXX in child support and tax law changed which greatly affect my refunds for the last 2 years, I was unable to continue paying credit cards. This allowed XXXX XXXX XXXX to send Its Lawyers, Evan and Mullinix, after me in court. I live in XXXX XXXX, Mo and they are located in XXXX XXXXXXXX XXXX I believe I originally opened the account online but I did shop in store. All items were delivered to my residence in Missouri. They won in court uncontested XX/XX/23 as I only had 4 days notice when they taped the service to my front door. I could not afford any payments as I am behind on my mortgage. I am a single parent and live paycheck to paycheck. I notified the law office of this fact. The Kansas court then approved a garnishment of my XXXX XXXX XXXX XXXX account on XX/XX/23 and was garnished on XX/XX/23. There are several issues with this. Kansas can not issue a garnishment of Missouri property. Kansas Supreme Court has ruled that wages are still wages in a bank account. I had notified the law firm of my money status and they still went after my account. They have been notified in court of the status and refuse to release. Lawyer had admitted he was still liable to only 25 % but I pointed out that in Missouri it is only 10 % due to head of household and hardship and that the wages were from before his order was granted. The judge immediately granted a court date. I believe this law firm is preying on the poor and unfortunate by circumventing the spirit of the wage garnishment laws in ways that require lawyers who they can not afford or else they would have just paid their bills originally. On XX/XX/23 I contacted XXXX XXXX XXXX and informed them that they can not withhold the money for an out of state order as I live in Missouri, the bank account is a Missouri account and was opened as such. I explained that they already was fined for this prior. I waited on hold for a long while as they referred with the legal dept. All they would say is they believed it a lawful order. They also denied holding the funds and said the lawyer had it till I confronted them. The rep checked with legal again and admitted they were still holding. I am also on workers comp from a recent accident and wanted to be able to protect my ungarnishable workers comp payments and they said they can not protect them and they could be garnished.
