My mortgage company sent me into foreclosure AFTER I notified them via email and phone of my participation in the HAF program while also working on my loss mitigation package to submit and be considered for assistance. ( I lost my job due to COVID and it took 15 months before I was able to solidify employment ) I burned through all of my savings and created XXXX XXXX in credit card debt. I notified Equity Resources via phone and email ( sending them the email from HAF that contained my application number ) that I had applied to HAF for assistance in reconciling my mortgage on XX/XX/XXXX. I explained on the phone that the government was strongly encouraging lenders to suspend foreclosure proceedings during this time. Additionally, I was working with my mortgage company 's Loss Mitigation department to apply for assistance to get my loan back on track. Equity Resources changed both the application and process for applying during the time I was submitting paperwork and it created a submission nightmare that delayed the process. I have verification that I was in constant contact with Equity Resources to ensure I was submitting the paperwork timely and thoroughly but unfortunately, it was difficult getting ahold of anyone with clear directions. In XXXX XXXX I spoke with an agent that informed me they changed their paperwork and gave me the correct page numbers in their packet that I was missing and needed to submit. Equity Resources decided to submit my property to foreclosure on XX/XX/XXXX, despite my working with their Loss Mitigation team and being considered for XXXX funds. On XX/XX/XXXX, Equity Resources acknowledged a complete Loss Mitigation package from me and halted Foreclosure proceedings. I was never served foreclosure paperwork and it is still in a suspended state. On XX/XX/XXXX, I was awarded funds from HAF both for the arrears on my mortgage and for 6 months ' future payments. I immediately notified Equity Resources. In XXXX of XXXX, HAF had not yet made my XX/XX/XXXX payments as scheduled and it was not applied to my mortgage until XX/XX/XXXX. In XX/XX/XXXX my mortgage statement showed me still owing nearly {$3000.00} in arrears but I was told that was not the final amount, and that I would need to request a reinstatement amount from them to get the actual amount, which turned out to be nearly {$4000.00}. Apparently, Equity Resources added almost {$4000.00} in lawyer foreclosure fees to my mortgage balance and this was not reflected in the amount to HAF when I was being considered for the program. Due to Equity Resources pulling the trigger on the foreclosure process during the timeframe HAF was reviewing my application, this resulted in unnecessary fees being added to an already desperate and dire situation. I was instructed in XX/XX/XXXX by Loss Mitigation to apply for assistance, which I did and my package was deemed complete on XX/XX/XXXX. I received an answer to my assistance application on XX/XX/XXXX, and I was denied any assistance and Equity Resources told me to pay the outstanding fees on my mortgage to reinstate it. I asked If I could continue making mortgage payments and I was told " NO '' I must reinstate the loan first. I could not afford to do this so Loss Mitigation instructed me to apply once again for assistance requesting a payment plan, which I did in XX/XX/XXXX. In the meantime, I received a letter from Equity Resources informing me that FHA had expanded assistance programs and I could request a stand-alone partial claim to bring my loan current. I immediately called but was told that might be considered double dipping. At this point, I requested a supervisor to call me. To this date, I have not been called by a supervisor. XX/XX/XXXX, Equity Resources called me and informed me that I am denied for any assistance and that I need to bring my loan current or they will send all funds paid by HAF back. I asked what the amount I owed is and they could not tell me. I again requested a supervisor, one was not available but I was told one would call me. At this point, I owe mortgage payments for the entire year plus lawyer/foreclosure fees as deemed by Equity Resources. Although I do not feel I should have to pay any fees as I did everything I was supposed to do and communicated with my mortgage lender on an almost weekly basis, I will agree to pay these fees. I only ask that Equity Resources works with me and either puts me on a payment plan or allows me to participate in the FHA stand along partial claim so that I can bring my loan current and resume monthly mortgage payments. I have attached 4 documents to this complaint : 1. Email to Equity Resources notifying them of my HAF application-contained the email from HAF with my application # 2. I am on a XXXX. I have had XXXX which is intended to give me a XXXX. Due to the high related medical expenses I tried to use the equity in my house to provide the funds to support those needs. I went through several mortgage companies with hopes of finding the right XXXX. During that process I got approvals for a conventional loan and an FHA from XXXX lender with the rank and file underwriters giving their blessing. Just before closing twice the upper management capriciously pull the loan thought to be a couple of days before closing. With both types of loans I met the credit score requirements [ greater than for XXXX for the middle score ]. With the shock of having the loan pulled at such a late stage of the process, I had to find a new lender and that process meant seeking out new lenders. As it turned out my credit scores suffered somewhat. I did find XXXX but they were very slow and although my health was quite good at the time, I got a recommendation from a friend of a friend that turned out to be lender that is the subject of this complaint. I talked to this lender 's rep for a period of about three weeks to make certain that she knew about any issues that may have caused problems with my previous lender so that history would n't repeat itself. She already knew that I was working with another lender but that I was n't happy with how that was going. She suggested I move my FHA claim number to her company as she was pretty certain that she could get a loan much faster than the other company. I informed her that I did n't want to make that move unless she was certain that their would be no sneak ups based on the info I had already given her. To put my mind at ease she stated that they could seek a preapproval of the loan. She did and the loan was preapproved. At which point I started dealing exclusively with her company. It was also at this point her responsiveness seem to change. She stressed to me that the communication between the lender was most important but she has yet to send me a copy of my appraisal. The credit score has become the most important thing in the completion of this loan. My score was consistently above XXXX throughout my early dealings with this lender and prior. However, I gave explanations for the lower scores in early XXXX. The lender sent me an email showing the interrogations by company and I responded that it was my attempts to acquire a replacement lender. The current lender accepted those explanations at that time and went on to preapproved my loan and encouraged me to change my FHA claim number to her company. This shows that this lender had no issues with the credit score at the time they brought me over. That XXXX credit score allows flexibility on various ratios and with it I my loan approval is certain for the maximum terms that were agreed to in the original application. To make certain that at the time approaching settlement the score is above XXXX the lender utilized a credit analyzer tool that suggests a pay down of certain card balances appearing on the credit report to get the desired credit score. This should have increased my credit by XXXX to XXXX points. In my case the change was minuscule. I looked a the lender 's website and saw the software used required manual input of balances which could allow errors and also at the time my rescore was taking place a once per year credit card charge occurred. Both of these events could have skew my outcome. I thought we were going to rerun the program with much tighter controls but the lender decided against doing so claiming that a new late charge entry had occurred. Thus, I did n't get the chance to prove that my current credit score would have improved appreciably. Thus, I 'm left having to rely on a propery tax credit. So infair.

Below is my statement ; however, a short summary is that I was promised a Mortgage Credit Certificate, paid the application fee, have an email from XXXX XXXX saying she had applied for the MCC and it was good to go, and ultimately XXXX XXXX forgot to process the MCC. This mistake will costs me tens of thousands in tax credits. I have tried to negotiate with XXXX, XXXX, and XXXX XXXX to no avail. I was never informed that the MCC was not included. I was deceived and misled with the loan and the lack of the MCC greatly alters the financial aspects of this loan. Toward the end of XXXX, I contacted XXXX and XXXX XXXX, with XXXX Equity Resources, regarding a potential USDA loan with a Mortgage Credit Certificate ( MCC ) for the state of North Carolina. XXXX had stated that they are extremely familiar with both products. We discussed both products in detail and I decided to move forward with securing a loan through XXXX Equity Resources. On XX/XX/XXXX, XXXX XXXX contacted me via email stating that she had applied for the MCC. She then called to state that I would be receiving revised disclosures to reflect the {$470.00} MCC application fee. Every disclosure from XX/XX/XXXX onward included the MCC Fee. On XX/XX/XXXX, XXXX contacted me regarding difficulty obtaining an appraiser who could provide an appraisal before XXXX. Even though my closing date was for XX/XX/XXXX, I agreed to an increased rushed appraisal fee to receive the appraisal before XXXX. After not hearing from XXXX or XXXX, I reached out on XX/XX/XXXX to inquire about the appraisal. On XX/XX/XXXX, exactly three weeks before the scheduled closing date, XXXX informed me that the appraisal was never completed. XXXX stated : " I sincerely suggest that you talk to another Lender. XXXX is on a 2 day turn time so you should have no problem closing on time. You are fully approved with us, and Im glad to forward your documents. '' I did not find this acceptable, so myself and my realtor were able to find an appraiser to complete the task. Due to the appraisal being delayed by over a month, the closing was delayed by less than a week. Closing was changed from XX/XX/XXXX to XX/XX/XXXX, not even a week past the original date. A few hours following the closing, I emailed XXXX to inquire about the MCC paperwork and the logistics of that process. XXXX then told me that she had forgotten the MCC due to the change in closing, but she could refund the {$470.00} MCC Fee. This mistake will costs me tens of thousands in tax credits. I have tried to negotiate with XXXX, XXXX, and XXXX XXXX to no avail. I was never informed that the MCC was not included. I was deceived and misled with the loan and the lack of the MCC greatly alters the financial aspects of this loan. XXXX Equity is an approved lender for MCC through the XXXX. The only reason I worked with this company was due to the MCXXXX. I look forward to your help,

I live in XXXX, Florida and in early XXXX XXXX, we were hit by hurricane XXXX. The area in which I live was declared a FEMA disaster area. I was advised that I could call my mortgage company XXXX Equity Resources , Inc XXXX and that I could have 90 days worth of payments deferred. I called equity resources and they confirmed that this was the case and that I would not receive collection calls and that before my next payment was due on XXXX/XXXX/XXXX that I would get a call from someone to check in and see if I needed an extension. I then received a letter in the mail stating I was in a forbearance period and it sounded as though I was going to have to pay the last 3 months of payments when the forbearance period ended. I called equity resources and was advised I was previously given the wrong information and that my payments were not being deferred. I was advised a guy named XXXX was handling my case and would need to call me back because he was not in the office. He advised me that I was in forbearance and my payments had not been deferred and that I could complete the paperwork I had received via email to see if I qualified for deferment or I could wait to be contacted before the 90 day period was up to further discuss. At XXXX roughly on XXXX XXXX, XXXX, I received a collection call, the collector never read the mini-Miranda and was wanting to know what I could pay. I advised her that I had been advised my loan would be deferred and that I would make my XXXX/XXXX/XXXX payment as planned. The call was made to my cell phone via an auto dialer. On XXXX XXXX, XXXX, I received a call where the person was checking into see if my forbearance period needed to be extended, I also told her I was under the impression my payments were deferred and that I would be making a payment on XXXX/XXXX/XXXX. She said she would submit the request for deferral and that I would hear back from someone in mid XXXX. Later that day I received another collection call from an auto dialer to my cell phone. I advised them of the conversation earlier in the day and they apologized and we ended the call. I also received auto-dialer collection calls on XXXX and XXXX where I once again advised the people of the situation and asked them to stop calling. On XXXX, I spoke with XXXX XXXX XXXX supervisor ) who said my account was never put in the right status and that I would no longer receive calls. She said on the call that the notes indicated that I had told each collector this each time they called. On XXXX/XXXX/XXXX, I received another auto dialer call to my cell phone from the same number ( XXXX ). This time, like every other time, when I answered the phone rang back to someone, this time, no one responded and after a few seconds the call was disconnected without the caller saying anything.

Equity Resources XXXX put our mortgage in forbearance without any notification or our consent in XX/XX/XXXX. We were not aware they had done so until we attempted to refinance two of our homes in the second week of XXXX. We had been making monthly payments and when an ER representative reached out to us in XXXX, asking if we would like forbearance, we made it very clear that we did not. Not only did they indicate the loan was in forbearance, they reported it over 30 days late to the credit bureaus this month. We have since not been able to refinance our properties and we have been denied financing for other purchases. After calling Equity Resources again on XX/XX/XXXX, I was informed they were legally allowed to put our home in forbearance because its a XXXX XXXX loan. Then I was told it was put into forbearance, because we missed an XXXX payment which triggered the forbearance. I asked why the didnt call or inform us XXXX was missed because we would have paid it immediately ( which we did in XXXX as soon as we were made aware ) and they said it was already in forbearance at that point. When we asked to remove the forbearance in XXXX because we had never requested it, they reported late payments. On XX/XX/XXXX, they reported the loan 30-60 days late. Please see the attached XX/XX/XXXX statement indicating {$0.00} past due when the forbearance was reversed. Please also see the attached letter from ER dated XX/XX/XXXX. Its states either 1. We opted out of forbearance ( which, according to the CARES Act, means no late payments since XXXX should be reported late ) or 2. The loan is in current status with no missed payments ( which means no late payments should be reported ). They have acknowledged we did not ask for forbearance and assured me it would not cause a financial burden. The representative provided me with this information on XXXX and said the lender can call her at her personal extension so she could inform them that we didnt request a forbearance. XXXX XXXX XXXX XXXX XXXX ; XXXX Every potential lender has refused to call. Equity Resources has damaged my credit by reporting our mortgage in forbearance AND 30-60 days late, they have created a financial hardship and put our life on hold as we invest personal time struggling to fix their mess when we have been continuing to make payments and have been under the impression the account was in good standing.

I'm writing this letter because I believe I have been taken advantage of .I was ble to purchase a home but was a difficult process. Copious documents and letters were requested throughout the process which I supplied. I was still being asked to render documents that were already submitted to the loan officer. I eventually had to seek legal counsel to craft a letter on XXXX XXXX, explaining my divorcee decree was legal and all economic issues were resolved. Eventually I was told I was approved XX/XX/XXXX, I went to settlement. I was told everything was a go. The day of settlement I was there for 3-4 hours waiting Eventually i was told a settlement would not take place today. No explination was given to me nor my realator. I was told they don't know what went wrong. I called them on XX/XX/XXXX, Monday and was told that XXXX XXXX updated the system and they didn't know how to get around it. In the meantime the loan officer XXXX XXXX from Equity Resources spoke with the owner of Equity Resources Inc. I was quoted me a number of 5.25 % interest which was significantly higher that the original 3.5 % and PMI I asked why was the rate so high? I was told because they are going to finance the loan since they couldn't get it via XXXX XXXX and becase, " he is the owner and he can do what he wants '' Yes, I had choices but I already gave up my apartment and was stressed from this process. If I didn't take it I would have to start the process over again which was night mare or I could take the deal which wouldn't take place until XX/XX/XXXX. I was also told in 6 months I could refinance .Which brings me to today. On XX/XX/XXXX, I received a phone call from Equity Resources, XXXX XXXX another loan officer from the XXXX PA office explained he was given my file an told to call me .Mr. Kiss told me my current rate was to high 5.25 % and I would be doing them a favor by refinancing my loan. Equity Resources knew this rate for the loan ws to high to begin with but tld take it or leave it. I was trying to get a lower rate at the beginning of this process which caused me to craft this letter. I would appreciate advice on how to proceed in this matter, but also want this to be noted in the files. Thank you

I am a XXXX woman who worked very hard to purchase my first home. I also worked very hard to qualify for my interest rate of 2.5 %. I made all of my payments on time for over a year including extra until XXXX. I found myself with my job 's hours reduced and thus struggling to make my monthly payments. I never fell behind. I applied and was approved for XXXX XXXX XXXX program through the state of Ohio. They agreed to pay my mortgage from XX/XX/XXXX through XX/XX/XXXX. Around the first part of XX/XX/XXXX, I contacted my mortgage company to inquire about the payment and mentioned if that payment was not made, I wanted to make it because I did not want my credit to be impacted. The mortgage company assured me that while I am in the program the mortgage company is not able to report late payments to the credit bureaus. Since I have been placed in this program, I am unable to view my account online, I am no longer able to make any payments on my account to protect my credit and the mortgage company has been reporting my mortgage as late for the last 3 months. My credit score, that I worked very hard to maintain, has tanked XXXX points. If I had known that this was going to be the outcome, I would have just worked more jobs and not asked for help. At the end of the program my credit is going to be shot. I would like some help in getting my credit report corrected. I have asked the mortgage company to do the things they say they are going to do and correct my credit report. I have gone through the credit bureaus and disputed the late payments, and the mortgage company is obviously stating they are accurately reported because they are never removed or updated. Please help me correct this situation.

In XXXX, I was behind on my mortgage payments because of temporary unemployment. At the end of XX/XX/XXXX, I complete a FHA partial loss claim, it was processed on XX/XX/XXXX. The partial loss claim provided a way to receive a " loan '' for the amount of {$34000.00} the amount of my I owed my mortgage comapy ( Equity Resources Inc. ). The due date of this " loan '' is the year XXXX. This process was supposed to bring my account current with my lender " Equity Resources, Inc. According to this new agreement I was to resume making my monthly mortgage company in XX/XX/XXXX. I have complied with the agreement and have made monthly payments to Equity Resources , Inc for XXXX, XXXX, XXXX, XXXX, XXXX and XXXX. The problem is that my monthly mortgage statements continue to indicate my account is in arrears. I have tried over XXXX times to get my account updated in the last 6 months but nothing has been done. My monthly mortgage statements are inaccurate and do not subtract my payments form the outstanding balance. The balance owed grows every month although I am making my payments and have fulfilled my monthly obligation. I have checked my name and property address with my state propery tax office and district court. Both places reflect the changes to my mortgage account as of XX/XX/XXXX. The end of the year is fast approaching and I fear my tax documents will not contain the correct information. Also, I feel ill-at-ease and in financial/housing limbo every month when I see the rising balance on my account. Please help!!!!!

Our mortgage is with Equity Resources , Inc. In XX/XX/XXXX, I contacted them as our tax bill was incorrect due to a delayed filing for the homestead tax exemption which was lost and corrected. I told them not to pay the {$7100.00} as that was incorrect and the corrected amount was the original {$1800.00}. Equity Resources , Inc paid the {$7100.00} anyway to XXXX XXXX XXXX. The tax refund was returned to Equity Resources on XX/XX/XXXX. I contacted Equity Resources on XX/XX/XXXX, as I discovered an escrow analysis for XXXX online with the analysis of our tax bill at {$7100.00} vs {$1800.00}. In addition, our tax bill for XXXX will be lower as we applied for elder over 65 tax exemption for my husband and I am legally XXXX. I have the email correspondence attached. Equity Resources , Inc. stated on their email dated XX/XX/XXXX, our account is scheduled to complete an annual analysis in XX/XX/XXXX. This did not occur, and we received a payment change on XX/XX/XXXX, of {$3600.00} vs our XXXX payment of {$2500.00}. We can not afford this payment and it is not the correct amount we owe as the tax monies were refunded. We do not owe a tax bill of {$7100.00} and Equity Resources , Inc is fully aware of this fact. This is not an amount we qualified for and places us in jeopardy of making our mortgage payments.

In XXXX of 2022, I started the application process for XXXXXXXX XXXX XXXX XXXX It is funded through COVID relief funds and applied from the Ohio Housing Finance Agency. I made a payment of my own on XX/XX/2022 and I have the statement from my bank showing it cleared my account. I also have documentation from XXXX XXXX XXXXXXXX where they have sent payments to my mortgage company. However, when I sign into my mortgage service website, it shows no payments for XXXX, XXXX or XXXX. It did finally show two in XXXX. However, due to the mortgage servicer and or the mortgage company failing to properly apply the payments received, my mortgage now shows late, and they have placed several derogatory marks on my credit report.

I have told the mortgagee company many times that I am no longer in Bankruptcy. Ive called multiple times. My Bankruptcy was voluntarily dismissed in XX/XX/XXXX. The mortgage company will not acknowledge this and continues to prevent me from logging online to pay my account, view my balance etc. Im making payments to avoid collection ; however, I just received a notice XX/XX/XXXX stating my loan is in default because I havent made a payment since XX/XX/XXXX. However, I receive statements each month with my payment showing being made. They need to update my loan and take me out of bankruptcy.

I have been paying the monthly mortgage on time every month, as per the mortgage origination document. Due to a gap in home insurance, I had to pay an additional {$2100.00} in XX/XX/2022. During that time of mutual communications for proper explanation, the mortgage company added {$95.00} as late fee for every month. Now, they are asking more than {$2300.00} as additional payment to make the account current. Their explanation for this amount is NOT transparent and looks fishy procedures.

I have contacted this company many times to get this situation resolved. I was in Bankruptcy, got out of Bankruptcytried to work with them and they put in default of my mortgage as soon as they released my Bankruptcy. Now, I continue to call to speak with someone and I cant get in touch with anyone to answer the phone! I need to know if they have received the payment of XXXX I sent to cure the loan and bring it out of default.
