Equity Prime Mortgage Fraud on the Consumer TILA Violations and Fraudulent Attempt to Foreclose with no rights. Equity Prime mortgage has violated my Rights in several ways 1 ) TILA Violations Failed to disclose required TILA information 2 ) Failed to Disclose that they in fact did not loan me any money 3 ) Sent presentments disguised as Bills soliciting payment for an Alleged Loan when they knew they never loaned any money as No real money exists. 4 ) Failed to acknowledge my rescission of Contract due to fraud and material misrepresentation on their part [ FRAUD VOIDS ALL CONTRACTS ] 5 ) Failed to acknowledge all Cease and Desist notices and continued to harass and defame consumer through credit reporting without responding to request for information 6 ) Equity Prime Mortgage received 2 Negotiable instruments sent registered mail that satisfied the alleged debt and failed to process or return them that immediately discharged any implied obligation. 7 ) Equity Prime Mortgage attempted to foreclose knowing they have no foreclosure rights as they are only a servicer and tried to implement XXXX tactics to fraudulently foreclose as the consumer resides in a Non Judicial state, they combined their efforts to get around their responsibility to prove their claim and steal consumers private property. 8 ) Equity prime mortgage and XXXX together fraudulently assigned the deed to themselves without any right to do so, since the Contract was rescinded, their rights were revoked and they were put on notice as such. 9 ) Equity Prime Mortgage purposely and with ill intent to deceive and defraud consumer sent mail to a prior address instead of consumers current address in order to delay their responses while they subsequently attempted to steal consumers property fraudulently, example : all foreclosure paperwork and documents from the foreclosure trustee came directly to consumer at his residence, while all required request for information went to an address consumer lived at 10months ago, as they were hoping to steal the property without ever having to comply with any of the request that would show their fraud. IE : RESPA request, BILLING ERROR notice, Cease and DESIST, BILL Of EXCHANGE, they defaulted on ALL requirements multiple times. 10 ) Equity Prime Mortgage failed to respond to Request For accounting 2x failed to respond to FOIA request 2x, failed to provide a TRUE BILL failed to provide a LEGAL BILL as they dont exist 11 ) Equity Prime Mortgage failed to acknowledge that all debts are prepaid per HJR 192 even when presented with the laws they continue to violate my rights. 12 ) Equity Prime Securitized the note and once that was done it became unsecured and they no longer has any rights 13 ) Under FAS ( Financing Accounting Standards ) 140, the original lender sold it to the REMIC and forever lost their rights to enforce the note. And heres why : The REMIC holds all the loans together into a pooling and servicing agreement. However, because they chose to avoid the IRS tax rules for double taxing, they pass on the real party of interest/ownership of the asset to the individual shareholders. So neither the REMIC nor the Trustee may foreclose. The Servicer is Not a Real Party of Interest. The S ervicer can only collect the money and pass it to the REMIC. Thats the extent of their job. Once a loan has been written off, it is discharged. Once a loan has been securitized, reattachment is impossible. Reattachment is impossible for the following reasons : 1 ) Permanent Conversion The promissory note had been converted into a stock as a permanent fixture. Its nature is forever changed. It is now and forever a stock. It is treated as a stock and governed as a stock under the SEC. Since the Deed of Trust secures the promissory note, once the promissory note is destroyed, the Deed of Trust secures nothing. Therefore, the Trust is invalid. 2 ) Asset has been written off. Once an asset is written off, the debt is discharged since the owner of the asset has received compensation for the discharge in the form of tax credits from the IRS. The debt has been settled. The servicer acts as a debt collector of an unsecured note. The servicer is deceiving the court, the county, and the borrower when it tries to re-attach the note to the Deed of Trust as if nothing has happened. Its called adhesion. 3 ) Broken Chain of Assignment under Uniform Commercial Code ( UCC ). The promissory note is a one of a kind instrument. All assignments ( much like endorsements on the back of a check ) have to be done as a permanent fixture onto the original promissory note. The original promissory note has the only legally binding chain of title. Without a proper chain of title, the instrument is faulty. 4 ) The note and the stock can not exist at the same time.

At the very beginning of our Mortgage loan, while my wife was on the phone with Equity Prime Mortgages ( EPM ) Representative, she was helping my wife set up the account and enter our banking information so that we could process our mortgage payments. At that point the account number that was entered by the representative was missing the final digit. This caused our first payment to be returned on XX/XX/2022 ( XXXX days after we initiated the payment ). We were able to catch it in time and also were able to correct the account number online. At that time My wife initiated another payment in the system on XX/XX/2022. That payment went through and was credited properly to my account. The company also did not assess a late fee for this transaction as they recognized that the clerical error had been on their part. In XXXX, my wife initiated the payment on XX/XX/2022, however the payment account had defaulted back to the bad account number entered into the system by their service rep. By the time we realized that the payment had been returned it was the beginning of XXXX and our payment was already 30 days past due. As soon as we realized there was an issue, my wife made the payment on XX/XX/2022. Part of the reason she was unaware of this issue was that when you initiate a payment through EPMs payment portal online the screen says Payment Confirmation at the top. ( Picture attached ). By this we assumed that our payment had gone through. We have disputed these facts, the fact that it is not due to lack of funds or refusal to pay, it was simply a clerical error on the part of the company ( which they now deny ) to both the 3 major credit bureaus and also with the company directly. The late payment has been removed from my wife 's XXXX report, but it has remained on her XXXX and XXXX as well as remained on my 3 credit reports. Most recently when I was on the phone with the Credit Bureaus, they told me to contact EPM directly. When my wife did that, the supervisor that she ended up speaking to said that it had all been cleared up on their end and that it should have been removed back in XXXX. However, in a subsequent call they contradicted this supervisor and said that they can not remove the 30 day late reporting because it shows in their system that my wife is the one who entered the account number incorrectly. She did in fact enter the correct account number after we realized that the rep had originally entered the account number but had omitted the final digit. Now Im left to wonder if this is the account number that their system shows that my wife entered. Recently my wife and I got denied for refinancing our car loan to a much better interest rate and the bank cited this late payment as one of the main reasons we were denied credit. We have been working desperately since XXXX to recover from some delinquencies and derrogatories on our credit report and are simply trying to build our credit. This is really hurting our progress and holding our family back. Had we been approved for the car refinance the payment would have gone down over {$100.00} a month, which would provide us with some needed relief. All we are asking is that the 30 day late is removed, we have made every payment before and since and this is a simple clerical error that should be understood as a reason to remove this negative item from our credit reports once we brought it to their attention. A recent check of my wife 's credit report shows a 30-day late in XXXX of Last year on XXXX, but in XXXX on XXXX. A recent check of my XXXX reports shows it's late in XXXX on XXXX, in XXXX on XXXX, and in XXXX on XXXX. None if this information coincides and needs to be removed. After hours of time on the phone and trying to get this company to help us out, we turned to the CFPB for help. Please help!

The following timeline of actions documents the attempted purchase of a property for {$730000.00} beginning XX/XX/XXXX - XX/XX/XXXX. Stress/Tension is maxed out on both Buyer and Seller and deal has fallen through. There is most definitely fault on either Broker and or Lender for the fallout of this deal. XX/XX/XXXX - Requested/Received Pre-Qualification Letter for $ XXXX XX/XX/XXXX - Informed Broker on successful contract with seller XX/XX/XXXX - Provided Broker all requested financial documents XX/XX/XXXX - XX/XX/XXXX - Completed Electronic consents XX/XX/XXXX - Provided location of funds ( institutions and accounts ) to be used for down payment ( went unchanged for remainder of process ) XX/XX/XXXX - Sent all requested rental lease agreements XX/XX/XXXX - Requested Rate Lock match from alternate lender ( XXXX XXXX ) XX/XX/XXXX - Rate match approved ( Broker using XXXX XXXX ) XX/XX/XXXX - Appraisal Completed XX/XX/XXXX - Lender requested additional financial statements XX/XX/XXXX - Received approval letter with contingencies XX/XX/XXXX - Signed commitment letter and appraisal acceptance XX/XX/XXXX - Received Closing disclosure document XX/XX/XXXX - Final financial transaction to move funds to final account ( where funds will be withdrawn for closing ) XX/XX/XXXX - XX/XX/XXXX - Requested and provided financial transactions XX/XX/XXXX - Informed XXXX would like to perform it 's own underwriting and required 72 hours. Buyer/Seller decided to postpone closing till Wednesday. According to broker XXXX had two concerns 1 ) XX/XX/XXXX records indicated partial rent in that year on certain rental properties ( they were purchased in that year ). Brokers response was to now include XX/XX/XXXX and XX/XX/XXXX records which do show full rental history throughout each year. 2 ) My primary residence has also had a room rented out for the last 4 years and now that it 's switching to a full rental it needs 25 % equity in the property, it has less than 20 %. Broker strongly believes we will be granted an exception and we wait ... XX/XX/XXXX - Requested status from broker and routinely heard that XXXX is working on it. XX/XX/XXXX - Tensions very much rising between buyer/seller. Seller agrees to extend closing to Friday but requests rent free Friday through Monday and requests adjustment to original deal to compensate for their losses. XX/XX/XXXX - At XXXX XXXX did not grant the 25 % exception XX/XX/XXXX - At XXXX XXXX allowed buyers existing primary home to NOT be considered a rental, it was determined that buyer 's debt/income ratio can support both the existing home and the new home without the rent. XXXX approves loan pending any outstanding conditions. XX/XX/XXXX - Broker explains, XXXX requests buyers start up business XX/XX/XXXX YTD Profit/Loss & Balance Sheet. Buyer provided requested documents at XXXX, broker supplied to XXXX 's file in early morning. XX/XX/XXXX - Broker explains, it 's in XXXX 's hands we expect clear to close at any moment. Agents inform Broker that deal with fall through if not completed same day. XX/XX/XXXX - Broker receives call from XXXX at XXXX that XXXX XXXX XXXX ownership documents required to prove she is the sole owner ; capable of gifting all commission, XXXX XXXX XXXX provides articles of incorporation, broker provides XXXX documents. I purchased a home and feel as though not only did my realtor nor did the preferred lender were and did n't act in my best interest. I applied and was approved for a USDA loan and desperately needed to move as I was in a bad situation. Both parties were aware of the situation and knew I had a XXXX son I needed to purchase a place ASAP. I was originally approved for a USDA loan and searched to find a property in the zones specified. I did so after hunting for a couple months. I only have XXXX for my son and my self. My son was XXXX at the time and any child support if received would end XXXX. My application started in XXXX and the closing finally happened on the XXXX of XXXX. Through out the process and half way through the closing process I was good for the USDA loan. I did n't have the funds or means for much more. For some reason I was told that I made to much money however was never able to get an explanation on that. I was told I had to obtain a FHA loan which I qualified for and come up with money down. this was after the process had started and inspections as well as {$2000.00} escrow deposit was required. I was basically forced to go through with the FHA loan in order to not loos what money I had put out and to be able to move ASAP. I went through and had several questions and all went unanswered. I submitted all the paperwork requested to include divorce decrees, social security statements, bank statemetns, and any thing else. The underwriter even demanded divorce decree from 20 years ago. The underwriter that wouldnt explain to me why I didnt qualify for the USDA loan demanded so much paperwork and held up the process. The closing was changed several times and the last XXXX it was done with out notice and cost me {$1000.00} and them some due to lost moving deposits and such. On the day of closing I was never given a number to close and through out the process it changed so variously with out explination as well as the night before I was told a little more than {$4000.00} would be needed. I had to start borrowing when I found out I had to obtain an FHA loan already. The day of closing with out an amount to have at closing I was told to wire what I had in my account and if over paid would get it back at closing. Closing that was set for XXXX happened at XXXX and the amount for closing was the exact amount I wired. I questioned it but was told I would get answers. After closing I left and the only time I heard form either party was when they needed more papers that were forgotten during closing. My monthly payment per the USDA is over 40 % of my income when it should have only qualified for up to 29 %. I was advised to contact CFPB to obtain assistance. I have all the documents and emails as well as any correspondences and will upload as much as I can. I did notice on my application that the loan officer filled out there is an amount I dont know where he obtain it from. I dont know how they justified the {$120000.00} pre approval amount and I only ended up obtaining a {$90000.00} home. I have a payment and HOA fees of {$150.00} a month. I cant even get documents I requested about items that were supposed to be fixed. I have attempted to contact the lender and realtor. the realtor signed a contract that if you are not happy they will resell your home with out cost to you if its with in 6 months and I attempted to enforce that but was unsuccessful. I am out deposits, down payments, inspections, moving cost, and repairs that were n't notated in the inspection. I have emailed and called supervisors but to no avail.

I was not denied the mortgage loan but it is my position that the mortgage company-lender 's employees working on my loan used discriminatory practices and went through extreme unfair measures designed to discourage me from purchasing. I am a XXXX woman and met all the requirements for a FHA loan. The lender had no other option but to pre-approved my loan, in turn made this experience one of my worst experiences in life. Fair Housing Act protects fair lending rights but this experience has demonstrated another 's ability to try and circumvent the law by providing inferior service to discourage protected class buyers. After my earnest money was secured, the disrespect began. My application was passed between three different persons working in the lender 's office. I requested to speak to that one person handling and appraising my file and was told that person do not speak to potential buyers. In less than 30 days, I was bombarded with close to a hundred of emails from those three different individuals ; none protecting my personal or financial information which has landed on the Dark Web. My information has never been on the Dark Web until now. Mid way into the process, I was told to have my home owner insurance agent send over the homeowner policy. My insurance agent did but the lender decided they wanted to give my business to a local insurance business owner associated with them and had a policy created by their choice insurance company without my permission. They contacted the new insurance company themselves, got a quote, added it onto my loan documents then emailed me asking if I mind after the fact. I have never spoken to this insurance company and have no idea who they really are.There were so many aggressive solicitations of adverse terms that let me know for sure I was being discriminated against but the one that stood out the more that all others was the DAY BEFORE closing. The lender called me and asked me to provide a copy of my college transcript. It was shocking to believe the lender was still ( working on approving my application ) and still trying to disqualify me all the way up to the last day. I was openly offended. The lender insisted that it was important that I provide my college transcript immediately if I wanted to close the next day. The lender said they had contacted the university before contacting me. The lender asked for my university log in information and said they would log in for me to get my transcript. I did not give my log in information to the lender but I was able to get the transcript myself and email it to them before their cut off time of XXXX. Ironically with all the calls, voice mails and emails, the lender failed to provide me with anything fair or beneficial causing the closing attorney to issue me a refund check at the closing table after wiring {$16000.00}. The lender told me '' just wire {$16000.00} '' which was {$1300.00} more than the actual amount. What would have been fair, impartial and respectful is the lender take the same time, effort and energy, they had used to try and disqualify me, to provide me with information beneficial to me. Instead I got inflated closing costs, forced to provide my credit card information ( that they failed to protect ), additional cost charged to my credit card and on the day of closing presented with loan terms that was changed without my consent.

If I could give 0 stars I would. I am so appalled by the practices of this mortgage company. We are the seller of a house and the buyer got a preapproval from them. Needless to say after 55 days under contract and 5 extensions they realized they never should have pre approved the buyer as he did n't qualify for the loan he was requesting. We did n't start getting communication from them until a week before the first closing date. They decided to extend the first closing date less than 24 hours before. During the whole process they would not return emails or phone calls unless numerous attempts where made. Who they have working for them are completely incompetent, rude, and unprofessional in every sense. XXXX XXXX and XXXX XXXX were horrible and hold no accountability for their delays and all the parties involved. They are very rude and unprofessional in what they would communicate to my realitor as well as to us. They consistently lied about where they were at in the process and would say things like " we are all set to close tomorrow. '' Then come tomorrow and another excuse and delay would come up. At one point they were asking for something on the house that had nothing to do with our house. They were searching for an excuse and reason they ( other than the obvious that they should never have preapproved him in the first place ) to come up with to blame the house and not their XXXX poor business approach of approving people who ca n't afford the loan. They stoup as low as they then became deceitful in who we are speaking with via text message. XXXX XXXX gave us his cell phone and is supposedly the Manager of this branch and he assured us when he took over the file that it would be handled better and accordingly. Needless to say it did n't get much better. He was rude and made false promises as well. When I called to get an update on the cell phone he provided us, one of his associates answered and had been responding to our texts not XXXX, whom we thought was. When I confronted them about being deceitful who we were communicating too they became very threatening and even more rude, that I caught them lying. This process should not have taken 55 days costing the buyer an inspection fee and other associated costs on a house HE COULD NEVER AFFORD!!!! We also had to pay over {$200.00} to have the HOA send over paperwork to them. Not to mention we informed our renters we were under contract and they had to vacate, assuming we would sell the house since the buyer had a PRE-APPROVAL FROM THEM!!! Un beknown to us that it was a falsified approval. This company holds no accountability for their actions and the deadline of a closing date. They cost us thousands of dollars and I do n't want to know what they costs the buyer. I would be even more XXXX if I was the buyer. I am reviewing the laws and policies on accountability of Mortgage loan companies and filing whatever I can so they can be held accountable for the money they cost buyers and sellers during this process. THIS IS UNACCEPTABLE AND WILL NOT BE TOLERATED! They Buyers name is XXXX XXXX.

We are filing a complaint against both of the following : 1. Equity Prime Mortgage LLC - XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Our date of application was XX/XX/2021 Our Loan Number is XXXX XXXX Phone Number is ( XXXX ) XXXX Our complaints are as follows : XXXX. There was no NET TANGIBLE BENEFIT to this refinance done by XXXX XXXX XXXX Equity Prime Mortgage LLC ; He did the opposite ; he WORSENED our financial situation. Taking us from a XXXX XXXX to an XXXX XXXX in ANY SITUATION IS NOT FINANCIALLY BENEFICIAL EVER. XXXX has much higher mortgage insurance monthly payments than a XXXX XXXX does. XXXX XXXX CLEARLY took advantage of us. 2. Our loan did not pass the 3 % maximum fees tolerance. Our Loan Amount was XXXX and there is a 3 % cap on what a lender can charge. That means the maximum lender fees we could incur by the XXXX XXXX and XXXX Laws should have been {$9000.00}. We were instead charged {$8700.00}, plus a {$340.00} administration fee, plus a {$500.00} processing fee, plus {$1100.00} in underwriting fees, totaling {$10000.00}. We were charged {$1700.00} OVER THE MAXIMUM LIMIT ALLOWED BY LAW. 3. We never received a copy of our appraisal. Per Federal Law, we should have received a copy of the appraisal AT LEAST 3 DAYS PRIOR TO CLOSING. 4. This has caused tremendous financial hardship on us. We were looking to use our equity to get cash out to consolidate our debts, that was the only goal from the very beginning. We never received any cash out to pay off our bills with that we were supposed to get. XXXX kept feeding us a lie that we would get cash back in our Taxes. We filed our taxes and did not receive the cash payouts he had said we would receive. We signed the closing documents because we believed XXXX was being honest, and that we simply needed to file our XXXX XXXX with the Federal Government and we would get our payout in our Tax Refund. Plain and simple, we never got ANY CASH OUT, so we would like the lender to rectify and pay restitution for the financial hardship he has caused us. 5. We also believe the Title Company who closed our loan should also be held accountable for closing a loan that DID NOT MEET THE XXXX XXXX MAXIMUM RULE. XXXX XXXX XXXX XXXX, XXXX should be held accountable for closing this.

I am opening a new complaint. This lenders response was not accurate and I would like this to be re-investigated. We are filing a complaint against the following : 1. They charged : Points if XXXX = {$8700.00} Admin fee = {$340.00} Processing= {$500.00} Underwriting = {$1100.00} Deed Prep = {$70.00} Credit = {$120.00} Digital closing fee $ {$60.00} Totals = {$11000.00} They charged {$1900.00} over the 3 % threshold not including the cost of the appraisal!!!! 3. ) Although they are indicating the appraisal was emailed on XX/XX/XXXX. We have no record of receiving it on our end. So, I want this lender to be held accountable for taking advantage of clients and making our overall financial situation worse. This is textbook PREDATOR LENDING. We were taken advantage of because of our financial situation. This refi put us in a worse financial position. We needed cash back to pay off and consolidate debt, but ended up coming to closing with cash and getting XXXX cash out! This refinance has been reviewed by many licensed mortgage brokers and everyone has replied the same exact way ; they wouldve never have submitted this loan if they truly were looking out for the clients best interests.

My complaint deals with several deceptive business practices by Equity Prime Mortgage ( EPM ) : 1. Wrongful credit reporting ; 2. Misleading online information on their website regarding forbearance which was accessible on XX/XX/XXXX ; 3. EPM representative misleading information by telephone on XX/XX/XXXX and XX/XX/XXXX ; 4. Entrapment into becoming further financially distressed and indigent. I was actively in the process of refinancing my mortgage with the underwriter of a different lender who gave me a very small window to lock in a rate comparable to what I already had since EPM denied to refinance my loan initially back in XXXX of XXXX. The mission was to pay off all my debts since I was currently being hammered with financial debts incurred from Hurricane Ian 's damages. As such while the other lender underwriter was in the final stages of approving my refinance, EPM mortgage wrongfully reported to the credit agencies that I was 30 day late following a conversation on XX/XX/XXXX and XX/XX/XXXX that they would not. EPM error cost me the only opportunity to refinance under the rate that was comfortable for me. So now I'm at their mercy with an application for a six ( 6 ) month forbearance to allow me time to pay for the natural disaster damages from Ian and regain my financial stability. My situation is comparable to a {$63.00} XXXX dollar FTC-CFPB suite which was recently settled the issues were : FTC and CFPB allege that XXXX XXXX XXXX XXXX According to the lawsuit, when homeowners were even just one day late with their payments, XXXX XXXX XXXX often unleashed a barrage of phone calls. When borrowers sought options like loan modifications or short sales, XXXX XXXX allegedly mishandled many of those requests, leaving consumers in even worse straits. For example, some homeowners were in the process of finalizing loan modifications with other servicers when their mortgages were suddenly transferred to XXXX XXXX. Rather than honoring those arrangements, XXXX XXXX often yanked that lifeline from people struggling to stay afloat. Others were told theyd have to pony up payment before they could even be considered for certain loan modification programs an illogical ( and often illegal ) requirement for folks who had already sent out a financial SOS.

Equity Prime mortgage, materially misrepresented themselves as a lender and that they " loaned '' me money, which they did not as my research determined, they actually took the promissory note which secured the funds for my home purchase and sold it to investors after they first mad me believe the had made a loan to me- this is called securitization and is illegal, once i realized this i rescinded the contract and revoked their power of attorney, as i am aware my loan was already paid from my own credit,, they further evaded any attempt to provide documentation because in fact they can not, only a contract which is null and void due to TILA violations and non disclosures, they further tried to get me to recontract with them by sending statements under the guise of " Bills '' in order to mislead me into paying them twice, when in fact these presentments or statements are actually interest on the funds held in escrow due to me,, this is a violation of the RICO act, as i declined to re-contract with them, as i am clearly aware of my standing and the violations they committed and perpetrated against me. All 1099 filings have been completed, I even sent them a promissory note to discharge the alleged debt in full debt in full and the declined it /chose not to accept it under terms of the BIll of exchange act and the postal rule my debt is disharged, they further attempted to mislead me by responding to my inquiries and requests for information by sending their responses to an old address i lived at 9 months ago, they violated a cease and desist order and revocation of power of attorney and proceeded to damage my credit which is a violation of the Gramm -leach - blilley act which protects consumers from creditors reporting payment history and utilization... All was well, budget payment ( auto pay-2 half payments a month ) until our mortgage got sold to XXXX XXXX XXXX XXXX XXXX ) a few months later/end of XXXX. Since our escrow account at XXXX has been at a negative status. XXXX said it was related to insufficient escrow amount, when we paid more than the full amount of taxtes to be due at closing, and during scheduled payments afterwards and to current date. Upon escalating at XXXX ( XXXX ) to no resolve, we reached out to EPM ( XXXX ). EPM after weeks and many follow up calls by us said someone paid our property taxes twice with the county. EPM then said they reached out to our XXXX XXXX FL property tax department obtained a check ( # XXXX for {$4800.00} ) that was mailed out to XXXX via USPS tracking USPS XXXX XXXX XXXX XXXX XXXX. However, our concerns are still not resolved now months later. Turns out XXXX does not have the " overage check ''. Per our call to USPS ( XXXX ) per tracking # XXXX XXXX XXXX XXXX XXXX the package was sent from EPM ( XXXX, CT XXXX ) to wrong city and wrong zip for XXXX, the XXXX XXXX XXXX was correct though. Sent to XXXX at XXXX XXXX XXXX, XXXX, NJ XXXX, instead of to XXXX XXXX XXXX XXXX, XXXX NJ XXXX. One of the EPM escalation contacts is at XXXX at XXXX, ext. XXXX has still to no resolve. XXXX contact XXXX, spoken to XXXX, XXXX ( id CRD ) said there are no direct supervisor, that we could submit a written request, she would look into it and call us back.

I applied for mortgage in XX/XX/2020 with equity prime mortgage and have been told varying closing dates. Each time we are set to close the lender stalls and asks for more information that they could have requested a month ago. Initially, no one in the process was notifying the real estate agent of what was happening so she had to file an extension on the contract and explain to the seller what is going on. The seller has other contingencies based on the sale of the property I am trying to buy. The lack of communication between the lender and the processor and loan officer has been atrocious. The loan processor keeps telling me we are closing and then the lender goes MIA ( missing in action ). They won't respond to anyone. Something isn't right with this company. They need to be investigated to see if they are going out of business or a fraudulent company or something. Something is shady. Why would they stall for so long and go MIA? I am going to lose the inspection and appraisal money on this property because the seller won't wait another few months for the lender to stall. I obviously will lose the property as well. This is unacceptable. I have provided everything they have asked for promptly, usually the same day. There is no need for them to not communicate for weeks on end when the loan officer, processor and I send multiple emails on a daily basis in an attempt to keep the lines of communication open. No one from equity prime mortgage has bothered to call, email, text or snail mail me any type of communication. I am just sitting in limbo. This level of unprofessionalism will not be tolerated.

I signed a purchase agreement for the property at XXXX XXXX XXXX XXXX XXXX with mortgage equity prime. I sent in a plathera of documents and signed many documents to become the owner of this property. The seller and I agreed that I would put up {$1500.00} in earnest money. We negotiated a contingency giving me 21 days to back out and terminate the deal. Enough time for me to get my contractor to inspect the property and get the bid etc. However I would get the earnest money back if I discovered any unforeseen problems with the property. Because this was going to be a rehab property, the lender required me to get a home consultant to manage the renovations. They offered me a list of consultants to pick from. I paid the home consultant {$400.00} up front for his services and was told I would be reimbursed at closing. After several months finally we set a closing date in late XX/XX/XXXX. The day Im supposed to close at XXXX, I get a call from a person that works with mortgage equity prime. Saying there was a compliance issue and between the processor and underwriter they didnt properly put the 15 % reserve in the official closing documents. I was told the company will take {$12000.00} hit if they insisted to close the loan. I was told everything was completed perfectly on my part, however they just made a very bad error. Also the people In place working on my file were merging over to a company called XXXX. I was advised strongly from someone in the company to switch over To the new company or else my loan would definitely not close. I was out another {$1500.00}.

I re-financed my home through Equity Prime mortgage ( NMLS # XXXX XXXX. I borrowed some additional funds in the loan to do repairs on my home. It was an FHA loan. An appraiser evaluated my home and made the appraisal contingent on some repairs being done on the house ( peeling paint removed ). Equity Prime stipulated in the loan agreement that some funds would be held back to ensure the repairs would get done. Once the repairs were completed, they would release those funds to me. After getting an estimate for the repairs, it was determined that XXXX dollars would be held back. The loan closed in XXXX. On XX/XX/XXXX, I emailed my contact at Equity Prime and informed them that the repairs had been completed. On XX/XX/XXXX Equity Prime received the final inspection report. I informed Equity Prime that I had already paid the contractor out of the initial funds I had been issued. I attached a receipt from the contractor that showed I paid for the repairs in full. Over the next 4 months I contacted the company numerous times through email and telephone asking why I have not received the held back funds. The answer was always " We don't know why this is taking so long, we are sorry, we will look in to it. '' Finally, on XX/XX/XXXX, they sent me an email stating the accounting department wanted documentation that showed I paid the contractor. I sent copies of two checks and a printout of a cashier 's check, all made out to my contractor. I have heard nothing since.

I bought a house recently but had serious issues with the mortgage lender/loan officer I did business with. XXXX XXXX XXXX is his name. He was previously with Equity Prime Mortgage but is no longer employed by them. Equity Prime was very helpful with this complaint. XXXX XXXX, during the process, advised me that his company pays the up front fee for the appraisal ( {$550.00} ) and he has already paid the company for that fee. He then asked me for a personal check to reimburse him ( {$550.00} ) to which I agreed. He was supposed to credit this money at closing. About a month later, I got an email from the appraisal company asking to pay the appraisal fee. XXXX XXXX then told me there was a mix up and the company did not pay for the appraisal and told me to pay it to them and he would credit both fees at closing. I unfortunately agreed. At the end of the process, XXXX XXXX attempted to have me sign a mortgage at 4.25 %. I did n't agree with the terms and was able to procure a rate of 3.75 % the same day with another company. Therefore, I did not close with Equity Prime or XXXX XXXX. I asked him then to repay the {$550.00} I personally gave him and he stated he would when he got it back from the company. I have since learned that he is no longer employed by Equity Prime and they did n't know about the money as they never ask for personal checks or money. On XX/XX/XXXX, my realtor has given me XXXX XXXX at Equity Prime Mortgage to apply for a loan. Knowing that the interest rates are on the rise, after the pre-approval process which happened exactly on the same day, I have repeatedly asked her to lock in the interest rate through phone calls, messages, emails. I even spoke with her realtor friend and the loan processor to lock in the rate. She completely ignored my requests. On XX/XX/XXXX, just 10 days from closing on the loan. She contacted me that in order to lock in the promised rate I have to pay over {$14000.00} in " points '' purchase. I still have every single message and proof that I have contacted her to lock in the rate. Needless to say I walked away and decided to go with another company that charged me half the price but at a higher interest rate. When I logged in to get the disclosure documents I electronically signed I found documents that I have never seen before. When I started the process things started off great, but as the process continued the communication was inconsistent with Equity Prime Mortgage. I would submit paperwork in a timely fashion and would not get a reaponse back or they would say they never received certain paperwork then they would search for it and say it was mixed up with other paperwork. We were suppose to close on the XX/XX/2018 and I did a final walk thru with the builder and heard nothing from Equity Prime until I showed up to the title office to sign the paperwork were the title officer informed me to call Equity Prime. Then I was told I needed more paperwork. At this time I already hired movers and gave my former landlord the date I was leaving XXXX XXXX to XXXX. With this whole miscomunication my family is stuck in a hotel for a week because now I have to delay delivery of my furniture to find a back up or rental property. I was solicited by Equity Prime Mortgage for a refinance on my home after doing a search on line. I finally decided to refinance but had a modification 1.5 years ago. It was clearly on my credit report. The loan officer insisted I was qualified and charged me {$500.00} for an appraisal. I ask him numerous times, are you sure I qualify I had no money to waste. He assured me I did. So I had an appraisal and then I had to have the appraiser come back for a couple of small item which cost another {$150.00}. The it was going back and forth with under writing before XXXX of their employees realized it was a federal law I could not get a refinance until a 2 year waiting period. I ask for money back because I was miss informed and got an appraisal for a loan I would have never gotten had they know the policy. EPM mortgages purposely sabotage my efforts to refinance my mortgage with another lender and due to the damage by EPM to my credit it has force me into applying for an request for 6 months forbearance. In fact, since my respectful submission to EPM for their mortgage assistance on XX/XX/23, they purposely even delayed marking my application as completed until XX/XX/23, to provide their underwriter unusual extensive processing time. Also following my completed application EPM notify me by telephone that the processing time would take up to 30 - 45 days to complete for an answer by the underwriter! However, on today XX/XX/23, EPM 's repXXXX XXXX advised me that now it would be 60 or more days before EPM would complete my application for mortgage assistance! It's evident that EPM are NOT in the business of providing any assistance to their customers but rather force customers into a foreclosure arena before assisting them. Thank you.

My taxes have been reassessed for the new year as the house is a new construction. My taxes dropped by {$5300.00} a year. The old tax amount was {$13000.00} and the new tax amount is {$8600.00} and EPM Mortgage company has submitted that my new taxes are {$19000.00} a year. I have requested for EPM to view the tax documents received from the town and to update our tax amount. This has been ongoing since XXXX. Everytime I call EPM no one knows what they are talking about. They have raised my monthly mortgage payment well over {$5.00}, ooo when it should in fact be a lot lower than what I was originally paying since my taxes went down about {$5300.00} a year. On XX/XX/XXXX I called in to make a payment on my mortgage though Equity Prime Mortgage ( EPM ) because there was a problem with my automatic withdrawal. I asked if a late fee would be assessed and I was assured there would not be XXXX assessed ( this can be verified by the recorded call that XXXX has on file ( XX/XX/2022 ). On XX/XX/XXXX, my loan was sold to XXXX XXXX. However, a late fee ( {$89.00} ) was assessed by XXXX and never removed. Now XXXX wants me to go through several different steps to get it removed since they do not service the loan anymore. XXXX ( Equity Prime Mortgage ) mortgage transfered. Imposed higher monthly payments of {$1200.00} from original contract payments of {$980.00}. XXXX notified me in XX/XX/XXXX. That they made an error of not posting escrow funds ( monies ) therefore, my monthly payments increase to {$1200.00} ( a {$200.00} ) monthly increase now after they transfered my Mortgage to XXXXXXXX XXXX on late XX/XX/XXXX. I have made the {$1.00} XXXX payment already. But want to dispute why XXXX did not inform me way in advance that my payments were going to increase, and why their transfered letter stated no changes in the transfered to XXXX XXXX. I'm very displeased with this situation.

Today I received a credit score, but in the meantime, I am talking on the phone with XXXX XXXX Mortgage Loan Originator. She mentioned in a phone conversation that I have the recordings that are due to the debt-income ratio. When I have already spent {$8000.00} thru this process. At the time of denial, I had a credit score that exceeded the minimum requirement to obtain their product. DTI ratio requirement met. Proof of income, and proof of ability to repay. Subject property also met financing guidelines.The company did not provide the reason for the denial nor attempted to advise on how to obtain approval. I felt discriminated against because I met all minimum requirements to obtain a loan. The company may have changed names during this period.

Equity Prime sold our mortgage to XXXX XXXX with a negative escrow amount that is erroneous and illegal in the state of Texas. We are 100 % XXXX property tax exempt from the day our mortgage papers were signed. I have called EPM and can get no where as they do not have a single person i can call that is in the United States. They admit they charged us over XXXX in taxes and sold the loan with it. Due to their issues we are being charged now XXXX by the new mortgage servicer and being told we have to get the money and or resolution ourselves. We can not do anything and we have tried.

My mortgage company : Equity Prime Mortgage bounced a {$40000.00} check in my XXXX XXXX Account on XX/XX/2021. They advised that the original check issued from my insurance company : XXXX XXXX XXXX XXXX was not endorsed properly and was returned in THEIR bank. In XXXX of this year we contacted equity prime mortgage About refinancing ourchome. I was advised ( and I have maybe 500 Emails ) to get appraisal and stop paying mortgage. On XX/XX/XXXXhe XXXX told me we had issues with appraisal and to pay mortgage for XXXX. Which I did and it was considered late as it was n't received until XX/XX/XXXX. My homeowners insurance double so my monthly payment went up. I was {$78.00} and some change short due to this in XXXX. I made the short fall good by XX/XX/XXXX. The company misapplied my loan payment hit me with a late penalty even though I was not technically late so I gave them another {$50.00} to make them leave me alone. They acknowledged the mistake and said they would stop calling. They have not. I have told them many times to leave me alone. They start calling at 8 am and continue throughout the day.

After my loan closing, XXXX did not fund my escrow accounts the amount from the HUD. They eventually paid the amount that was due for hazard insurance and property taxes but that put the escrow account into a negative balance then the escrows were reanalyzed and this increased my monthly payment by around {$200.00}.
