I am not the borrower. I am the VA real estate appraiser involved in a VA mortgage refinance ( VA Case Number XXXX ) by Equihome Mortgage XXXX mortgage broker ) / XXXX XXXX ( owner ) that closed in XX/XX/2022 in XXXX XXXX XXXX XXXX XXXX Unfortunately, the VA Appraisal Invoice remains unpaid though the originating lender, Equihome Mortgage, has promised to pay multiple times including to myself, VA staff, and the funding lender. Colorado Revised Statute 12-10-713 requires the appraiser to be within 90 days of report delivery or within 30 days of the loan closing, whichever is first. The VA Lenders Handbook requires the VA Appraiser to be paid within 45 days of the XXXX being issued. The 1805 VA Appraisal request contains the following certification for submission to VA : On receipt of " Notice of Value '' or upon advice from the Department of Veterans Affairs that a " Notice of Value '' will not be issued, we agree to forward to the XXXX the approved fee which we are holding for this purpose. The following is the case timeline : XXXX : VA XXXX requested XXXX : VA XXXX delivered to the VA portal. XXXX : Notice Of Value issued based on my appraisal report. XXXX : Per the Assessor record, the VA mortgage was recorded. XXXX : Equihome Mortgage / XXXX XXXX promised to pay the outstanding VA appraisal invoice after I contacted them for payment. " Vice-President of Operations '' XXXX XXXX was CC 'd on this email. XXXX : Equihome Mortgage / XXXX XXXX again promised to pay ( " checks in the mail '' ) to a VA senior staff member. XXXX XXXX asked for my bank account number, which I declined to provide for obvious reasons. XXXX : Payment not received. I filed a complaint with the XXXX XXXX XXXX XXXX XXXX for possible violation of CRS 12-10-713. XXXX : Payment not received. The wholesale funding Lender, XXXX XXXX XXXX upon my request for payment, contacted Equihome Mortgage for the status of payment. Equihome Mortgage / XXXX XXXX reported the " checks in the mail '' as of XXXX. XXXX : Payment not received. I contacted the XXXX XXXX XXXX XXXX XXXX XXXX Equihome is based in Utah ) to inform them of the situation ( sent them the email chain regarding requests for invoice payment ) and the fact that Equihome Mortgage has an expired license. They responded with an invitation to file a complaint through their online portal, which I did. XXXX : The XXXX XXXX responded with a letter indicating an investigation of Equihome Mortgage has been started. I also emailed the funding lender, XXXX XXXX XXXX, advising them that payment has not been received. XXXX : Payment not received. I filed a complaint with the Consumer Finance Protection Bureau.
