Emergent Business Group is deliberating and diligently violating federal laws. I reached out to them via my last CFPB complaint to resolve this issue swiftly. However, they have chosen to delay and furnish deceptive information with a false timeline of events in their last response to my CFPB complaint. Emergent Business Group has admitted to illegally obtaining details this alleged account from XXXX XXXX, XXXX. Not only is this a violation of my right to privacy which I own as the federally protected consumer and natural person. But also Emergent Business Group has flagrantly broken several federal laws which are outlined in my Affidavit of Truth attached below which they received and signed for on XX/XX/2021. This alleged debt is not owed and Emergent Business Group is implicating themselves in a matter that has nothing to do with them. Emergent claims they are only a " third-party servicer '' in possession of this account which makes them the current " furnishers '' of this inaccurate and illegal information on my consumer reports and files. XXXX XXXX, XXXX who illegally gave them this information has confirmed this exact point in their last response to my CFPB response by stating that Emergent who is their alleged " servicer '' is responsible for any furnishment of said account to my consumer reports and files ( XXXX ). Emergent Business Group blatantly continues to violate federal laws by sharing details of said alleged debt and false account with XXXX and XXXX monthly. These actions violate countless federal laws which are all outlined in my first Affidavit of Truth attached below. Emergent Business Group and XXXX XXXX, XXXX 's illegal collusion to undermine me the consumer directly violates 15 USC 1681 ( a ). As the original creditor I have demanded pursuant to 15 USC 1692c ( c ) ( 2 ) that XXXX XXXX XXXX immediately instruct Emergent to delete this account of my consumer reports and do so themselves. The finger pointing which is a delay tactic between these two companies as to who is responsible for this inaccurate account furnishment on my consumer reports must end with this CFPB complaint. As the federally protected consumer and natural person pursuant to Title 15 Chapter 41, I have also made my demands known to XXXX XXXX, XXXX as is my right under federal law. All of my outlined remedy are demands and NOT requests. I advise whoever receives this complaint and Affidavit of Truth at your company to forward it to your executive leadership and legal team. This is my first step in my private administrative process and your legal team will understand what this means. Included in my attached Affidavit already your possession is my invoice which Emergent Business Group must pay to resolve all outlined issues XXXX federal law violations XXXX. This is also a demand pursuant to federal law as is outlined in the attached document. Failure to resolve this matter swiftly only causes me more injury and will have much more of an adverse effect for Emergent Business Group as I advance in my private administrative process in the near future.

Today my wife received a call from a man " XXXX '' on what he said was a recorded line. He called her at her job. He stated to her that he was calling in regards to a debt I owed of {$7000.00}. When she proceeded to tell him that she would let me know that he called and I would call him back he stated to her " that she was just as responsible for this loan since I am his wife '' she again repeated to him that she would give me the message and please not call her again at work and he said " I can call you where ever I want '' " why wont you talk to me about his debt '' " you need to resolve this debt '' " you live in a state where you are just as responsible '' when she said I don't know about this he said " yes you do '' He then proceeded to tell her " I have already contacted our landlord and I am aware of the assets you own in our home and that I have pictures of our 2 black cars in the driveway ''. He stated that if she does not speak to him about this debit he would be coming next week to seize our assets and that would include both cars, any jewelry she owned and TVs and furniture and also our payroll. She began to tell him that we still had loans on our cars and he said " no you don't, you own a XXXX XXXX its not worth that much and what did you do take out a 20 year loan? '' I few months ago he called threatening the same thing,. now the only difference is today that he stated he has taken pictures of our cars in the driveway. We have asked him to send us documents of this alleged debt in the mail on prior conversations but his response is " i am not going to do that because all you will do is state it was lost in the mail '' This is very threatening to my family and I don't accept the fact that we are being harassed and threatened and feel that a man is showing up at my home where my family sleeps taking pictures of my cars and him stating he will coming inside to take my assets. Another big concern for me is that he calls my wife and begins to give her all details of this alleged loan. The last time she spoke with him she stated to him that why was he giving details on a loan that was not even hers and he stated because it was owed debt he could give out information to anyone he called to try and collect. Does this mean he is giving the information to my landlord when he calls his to " find out about what assets i might have in the home ''?

I took out a loan for {$1900.00} on XX/XX/XXXX from XXXX. It was supposed to be a payback every other Friday on my pay date. Instead my payments were set up for every Wednesday. I contacted them by email to get it changed and also asked for automatic payments to be turned off. They did get it turned off. I was struggling with payments so I asked for a different payment plan. We were not able to come up with a plan so it got further and further behind. The last communication I had with them was an email on XX/XX/XXXX asking for payment. On XX/XX/XXXX, I received an email letting me know that my account was transferred to Emergent Servicing with a balance of {$3100.00} due. On XX/XX/XXXX, I took out a lease-to-own agreement with XXXX for a purchase. This is a completely different division than XXXX. I received the agreement and payments began for every Friday as agreed. On XX/XX/XXXX, I received an email from XXXX stating the following : Congratulations on your loan. Please be advised you have entered into a loan agreement with XXXX weekly payments at 164.55 % APR. Unlike the lease-to-own program, XXXX same as cash is not an option however you can pay off your loan at any time without penalty by calling XXXX & XXXX Technologies XXXX XXXX XXXX Payment frequency can not be adjusted with the loan program the payments are set to the date and day of your loan agreement. If you have questions regarding payments or balance please contact XXXX the servicers of your loan. I was confused because that was not the agreement. I called the number listed and they put me over to XXXX XXXX. I called XXXX and spoke to XXXX who was very aggressive and told me I needed to pay my loan from XXXX. She wanted me to pay it immediately on the phone. When I asked for details, she said that she would not honor any agreement after we got off the phone that day but would send me details. I am extremely upset with this deceptive practice of them making it sound like my lease-to-own through XXXX was now changed XXXX a loan through XXXX. And then when I called and was confused, I felt that I was being forced to do something without being able to review the documentation. I have since received an encrypted email message from them but it wants me to set up an account with them to view it.

On XX/XX/2023 I received a phone call from Emergent Servicing regarding a debt that I did not recognize. I spoke with XXXX, upon attempting to tell her I did not know this debt she began to tell me that they emailed me and started rattling off several dates and an email that I do not use. I asked her how old this debt was? she replied that it was from XXXX somewhere in that time frame. She then violated the FDCPA by telling me she was giving me a chance to " voluntarily pay it '' which of course unless you intent to take legal action or have the ability to do so, this is a violation of the FDCPA. When I told her I was not paying something I did not have knowledge of she began to use abusive language towards me such as " you're just mad because you got yourself in debt and don't want to pay your bill '', she also told me she gave me a chance to talk ( which she didn't ) and she was talking now. She was yelling over me, insulting me and my intelligence and using rude and abusive tactics all because I did not agree to pay a bill I know nothing about. I advised her to Cease and Desist at this point because she was continuing to yell over me in which she completely ignored! I asked to speak with a supervisor or manager she refused and continued to yell. I had to end the call due to this. I did call back and speak with a nice gentleman named XXXX, he apologized for the behavior and agreed to remove my phone number and review the collection call. I would like for this company to be looked into for their abusive tactics, if they are doing this to me they are doing this to others that may not be so educated in debt collection laws.

On XX/XX/XXXX at XXXX MST I received a call from an employee of Emergent Services. He identified himself and his organization and indicated that I had been sent a letter last XXXX. He refused to disclose the subject of the letter or the nature of his organization. When I asked, " Is this an attempt to collect a debt? '' he became quite aggressive, saying things like " If you don't want to work with us ... '', notwithstanding the fact that he made no substantive response to my questions " Who are you and what do you want? '' " What was the letter about? '' " Is this an attempt to collect a debt? '' ( I asked that twice, and he hung up on me when I asked it the second time. ) It is my understanding that debt collectors are required to identify themselves as such and to disclose that communications that they initiate are attempts to collect a debt. In the present case, neither requirement was satisfied. I believe that this matter related to an auto loan for a new XXXX XXXX for which I cosigned several years ago. The borrower was XXXX XXXX aka XXXX XXXX aka XXXX XXXX, a predator who defrauded me of several XXXX XXXX dollars and who is subject to an Order of Protection issued on XXXX XX/XX/XXXX by a judge of the 13th District Court ( XXXX County ) of New Mexico. She made no payments despite assuring me that I would make none. She ran the car into the ground in a year, such that on repossession it fetched {$850.00} at auction. The original lender was XXXX XXXX.

The company stated that I owed the {$1900.00} after taking a {$1200.00} loan and paying them approximately {$1300.00}. The debt collector sent a settlement of {$730.00} to close and then called with another offer of {$950.00}. I requested some information from the condo-any to have a paper trail but they refuse to provide the details and was being very rude on the call. Another agent took over the call and got very loud and I felt very much violated. They also advised me that this was the last offer before they take legal action or damage my credit. I politely refused their offer until I have some paper trail but they were not very happy with me. These are the information I requested : 1. Proof that your company owns my debt or that you have been authorized to collect it from me by the original creditor. Note : Please send this proof of authorization 2. Who is the original creditor? What was the original amount owed? How much of what you are attempting to collect is fees and interest accrued since your company took possession of this debt? 3 What is the debt collectors name, the name and mailing address of your company and the name and phone number of your supervisor. 4. Are my offers for balance reduction reported to the Credit Bureaus? If so, how these will be reported to the credit bureaus?

Received first letter from XXXX XXXX XXXX dated XX/XX/2020 requesting payment for a debt from original Creditor : XXXX XXXX For the amount of {$1600.00}. this is not my debt and I have had no contact with XXXX. I then sent within 30 days a letter to them stating that this is not my debt. # 1-I asked for full name and mailing address from the original creditor for alleged debt. # 2-i request documentation showing you have information that i am responsible for this debt. # 3-Documentation showing you are licensed to collect debts in my state. The address of the original purchase does not belong to me. The Bank account associated with this clam does not belong to me. I have been working with XXXX XXXX XXXX on different loans since XXXX and have been making payments to them for help repaying my payday loan at a lower cost. A Cease and Desist letter was sent to XXXX on my behalf, and a payment agreement was reached between XXXX XXXX XXXX and XXXX Payments were completed, and my debt was paid off by XXXX XXXX Around XXXX of XXXX, I started receiving nonstop calls from I have been receiving non stop phone calls from Emergent Services which claims they have purchased this debt. Ive had to turn my phone to silent so as to not disrupt my work day. Below is the number they have left voicemails from to call XXXX. Numbers also include XXXX ( XXXX ) XXXX, XXXX ( XXXX ) XXXX, and emails from XXXX. They have also contacted my workplace, along with friends and family, repeatedly. As of today, XX/XX/XXXX, I am still receiving multiple phone calls. I have worked with XXXX XXXX XXXX to reduce the debt I owe and make sure that I am repaying what is owed. Harassing phone calls will not make me get money any faster it may cause me to lose my job and wages.

Some time in XX/XX/XXXX, after I pulled my Credit report from credit engine XXXX, I discovered accounts on my credit report that did not belong to me. About a year later, On XX/XX/XXXX after spoken with a friend, he recommend me to file a Police Report, so I did. On XX/XX/XXXX, I started disputing the wrong information on my credit report, I sent my first dispute to the Credit Bureaus. A company would spoof phone numbers and call me at all times never leaving a message. I answered one call and they wanted me to verify who I was but I was not comfortable. They then informed it was a debt collector trying to collect a loan that I am not sure of. When I said I would need more info and will not pay. The agent got angry and said they will now destroy my credit and I can't keep putting this off and to be responsible for my debt and kept talking over me. I advised I would not be talked to that way and will not be paying at this time. She said they will " note '' my file as non responsive and increase collection action. On XX/XX/2023 I received a phone call at work from Emergent Services about a payday loan that I owed, I requested to have all information mailed to my physical address. Gave them my actual phone number and address, They said no problem and would be in touch the following week. I never received any such letter, also didnt receive any follow up phone calls on my personal line. Then on XX/XX/2023 they called me work again asking me to pay this debt. I received a letter dated XX/XX/2022 indicating that I owed an amount that is not mine. The letter only provides the name of the creditor and the amount owed, along with a message that requires a dispute of the claim. Their website requires you to provide your phone number and email address to dispute the claim. I should be able to dispute the claim WITHOUT providing additional personal information. The whole reason someone was able to impersonate me is because they have my personal information. I have no idea who this collection agency is or whether it is legitimate. I received a letter from Emergent Servicing which has several negative reviews online so I do not want to call them and request debt validation. The letter says the current creditor is XXXX XXXX, whom I have never heard of or heard from. Emergent Servicing have also been calling and threatening with attempts to deliver documents to my address. This letter is vague and to my knowledge, I no longer have any outstanding debts as I have paid off everything outstanding on my credit report over the past 2 years and have a much better handle on my finances now.

Emergent Servicing failed to send a written notification of the debt that was allegedly owed to XXXX. They did not send anything in writing, they keep going back to " we sent it by email. '' I have a right to dispute this debt, this was NOT sent to me in writing. My contract is NOT with Emergent Servicing, it is with XXXX. A company called Emergent Services continues to spam call me and keeps calling my work after they have been advised not to contact me at my place of employment. Today XX/XX/23 they have called me 14 times in less than 2 minutes on my personal phone number. They also tried calling my place of employment.
