I am writing in regards to my XXXX lien account holder. I 'm participating in a HAFA short sale and I have obtained the HAFA short sale approval by the XXXX lien, XXXX XXXX XXXX , XXXX ( enclosed ). The approval letter was provided to XXXX XXXX XXXX, from Eltman Law, PC. ; representative of the second lien holder. We also provided him with copy of the HUD showing {$12000.00} toward the second lien. We received a counter offer from a XXXX XXXX for the amount of {$45000.00} and they are refusing to accept the first lien offer of XXXX this is causing me delay and a possible cancellation of my settlement. My closing and Relocation Assistance is in jeopardy as they are not collaborating, forcing me to go to foreclosure, exit the property and end on the streets without a place to live. I have a buyer ready to purchase the property and the second lien is not collaborating with my short sale. I hope you can look into this as I have done everything possible to make this closing happens and to avoid foreclosure. Under HAFA guidelines the second can collect up to XXXX and the first lien is offering this amount to them. {$45000.00} is not available neither allow.

In XX/XX/XXXX I responded to a wage garnishment. I went to the court and filed the necessary response. The officer informed me that the company had 30 days to send a response. The 30 days came and went. Since I had asked for a copy of my application and the amount owed at the time of write off I assumed this information could not be found. I then called XXXX and was told to contact the agency that had my account. I spoke to a rep who was located in New Jersey about my account. He started to ask my information like address, ss #. I decided that if this company was suing me they should have this information. When I asked this question I was " disconnected ''. I did n't hear from the agency again. XX/XX/XXXX I was informed by my payroll department that my wages would be garnished again I tried to get information. This time I found that the agency is in XXXX XXXX. The practices of this company are sneaky and unfair. I feel I did respond within the time frame. I was also told by the sheriff that I had correctly responded to the order. Why was there no response? The company then waits a year to garnish me without any further notification?

I was contacted by mail and received XXXX of the same letters on the same day. This is regarding some type of collection matter with XXXX XXXX and I had never had an account with them. This notice is deceptive in the sense that it has the letterhead of the law firm Eltman Law P.C., however it continues state " no attorney in the firm has personally reviewed the particular circumstances of your account ''. I believe this law firm in in violation of several state and federal laws. Particularly the FDCPA, OCSPA, FCRA and possibly the TCPA should any fraudulent calls to my telephone be made since I listed it with this complaint. I have not received any documents bearing my signature and believe this is fraud. I would like to also put them on notice that I do not wish to be contacted except by mail. The letter also states that the firm has been retained, however no due diligence has been made by XXXX XXXX to determine the validity of the false demand for the collection of the so called debt.

In XX/XX/XXXX, my bank account was placed on a hold and showed a XXXX balance. After contacting the bank and getting more info, a collection agency who I guess is a law firm stated I had to enter into a payment agreement in order for my bank account to be released. I entered into an agreement and have been paying ever since. I received a letter dated XX/XX/XXXX from the law firm stating I need to make a payment. I went online to make the payment and it failed. I called the lawfirm and they stated they are closing and sent the account back to the original collection agency. I called the collection agency, they then sold it to another agency. I have been paying since end of XX/XX/XXXX on this account and now the I have no paper work stating the changes that have taken place and I have no idea what happens with all the money I have already paid. I still have not received anything on paper showing any of these changes. What should I do now?

I received a Notice of Writ on Garnishment & a Continuing Writ of Garnishment Against Salary or Wages. The final judgment against me was obtained on XXXX XXXX, 2004. I am in Florida and the Statute of Limitations is 7 years. To protect myself I am filing a Head of Household Claim of Exemption & Request for Hearing in XXXX County Court today. I have done research on the Plaintiff, XXXX XXXX and have found many complaints and class action lawsuits against them for illegal and unethical practices. I am very concerned about this as I am supporting a XXXX year old child on less than {$XXXX} a week net and my employer has begun withholding 25 % of my net pay until the hearing is held and my exemption is ruled on. This company at XXXX time froze a bank account that received direct deposit for child support and my minor child 's XXXX, while I was unemployed and a student, which is illegal!!!

I XXXX XXXX have been requesting and writing for the proof of judgment concerning the debt that I 've been paying for the past year and eight months stating that this debt belongs to me. In XXXX and XXXX of 2015 I have been in contact with your office requesting said judgment with the understanding that the judgment would be sent and I have yet to hear anything from your office concerning this matter. I checked my credit report and the debt was not on the report so how can i be in debt and paying something i have no knowledge of or any proof. Therefore, I am now requesting that my money be refunded in full back to me within 10 business days of receipt of this letter. If this office does not refund my money I will be forced to file a complaint with the Customer Financial Protection Bureau and the Attorney General Office.

Who is XXXX? This company attempted to sue, garnish bank account and is now taking my money. They claim they purchased this debt from XXXX but will not provide proof. I need copy of proof that I owe these people. I need a copy of the transfer of debt from XXXX to XXXX. I am uploading copies of documentation where are companies sent me letters regarding this debt. Why are there so many different companies attempting to collect on the so claim debt purchased from XXXX but refuse to provide proof. They all are in violation of FDRCA and FCRA. Please help to rectify this problem. They also tried to garnish my bank accounts ( see attachment and contact my bank for proof ).

Eltham Law Pc ( XXXX XXXX ) filed judgement against me on a debt with XXXX third party debt that I did not sign a note with them. She attempted to garnish my bank account which is not allowed in Texas. My bank called me and took care of it. At the time I did not know the law sof I got an attorney name XXXX XXXX XXXX he advised me to negotiate and I did paying {$100.00} a month for 3 years on time. Then on XX/XX/XXXX - XX/XX/XXXX they did not cash my checks. No call no letter no nothing. I tried to call no answer. I sent letters no reply. They breached the contract that was entered XX/XX/XXXX. I want my money back and judgement removed.

I have fling another complaint against Eltman Law and XXXX. They are cashing my checks for the month of XX/XX/XXXX and XX/XX/XXXX. I tried to call them and a recorded message came on the are not accepting calls. These people are violating the law and commuting fraud. There are too many attorneys and companies involved with inaccurate information. Some company by the name of XXXX claim to be affiliated with XXXX state I owe over {$40000.00} that is incorrect this was settled in XX/XX/XXXX for {$10000.00} and i have paid every month. I plan on filing FDCPA Violations against all that is involved.

I recently was having my wages garnished by a debt collection agency ( Eltman Law, PC ) they were garnishing my wages for more than XXXX moths. Once I noticed and realized what was happening I contacted ( Eltman Law, PC ) they sent my a letter stating the ( Creditor ) and the ( Amount owed ) and ( Account # ) they said the account was opened on the year ( 2000 ). This account does not belong to me. Also if this account is from the year ( 2000 ) its been more that XXXX years that this debt has been outstanding. It is ILLEGAL for ( Eltman Law, PC ) to collect.

I received a letter from XXXX claiming that I owed a large debt to them and they obtained a court levy to garnish my wages. I sent a request to them asking for proof of the debt and all I received were court papers and a listing with my name and a judgement dated back almost 20 years. They did reply with the original creditor name but no proof as to what the debt pertained to or was for no details for me to verify. And the paperwork from the court said there was a court date that I did not show up to but I never received any notice of a hearing.

I received correspondence from Eltman Law PC on XX/XX/XXXX stating that I need to fill out a form of interrogatories. It is in regards to a debt that I won a judgment on XXXX. I was the defendant in the case and there was a judgment for the defendant entered. the plaintiff filed a civil appeal that I never received any notice of the appeal. Eltman law is trying to collect on an invalid debt by representing and threatening to take legal action on the case.

Back in XXXX of 2007 my bank account was levied. At first I thought it was because of my child support that was just put into arrears. I filed a motion to have it vacated because the arrears were being paid out of my pay check. When I received all the proper information it was for this debt that I do n't not owe.
