After seeking professional advice on how to best pay back my student loans during the summer of XX/XX/2018, it was recommended that I refinance my loans to a servicer with better interest rate and a better reputation than my current servicer, XXXX. After a thorough research process, discussions with customer service and a detailed evaluation of my financials, I was persuaded to refinance my student loan with Earnest. Earnest advertises features that bill it as a better alternative to " traditional '' and loan servicers such as XXXX. Features touted by Earnest included : - The ability to pay in bi-weekly installments, saving interest - Option to select a flexible payment date of my choice - Access to a modern, state-of-the-art online interface and mobile app to more easily manage payments. - Ability to control my payment amounts and see how extra payments or taking advantage of their " skip a payment '' feature would affect the life of my loan without having to arduously call a customer service representative to calculate, or use a less-specific outside calculator tool. Turns out, Earnest was bought-out by XXXX and, shortly after I refinanced ( XX/XX/2018 ) Earnest REMOVED all of the above attributes and more, becoming almost identical to XXXX in terms of user experience ( or lack thereof. ) Worst yet, they sold my loan right back to XXXX and charged me interest on the sale! Talk about shady ... and a borrower 's nightmare! I went through all that trouble to refinance -- try to do the right thing and set myself up for success -- only to end up back with a company that I never liked in the first place! How is this legal?! Further, the new Earnest-XXXX hybrid still, as of XX/XX/2018, has advertising and publicity out there boasting about these features and claiming to be better than the " alternative. '' Below are some examples. Screenshots are also attached. 1. Their XXXX profile, a review site, still advertises the above features as benefits 2. Their App ( which is no longer accessible ) is still being advertised on their website at https : //www.earnest.comXXXX with a visual rendering of their dashboard that no longer exists. Exact language being used : " Paying off your student loans is easy with our dashboard PAYMENT FLEXIBILITY, NO FEES, SMART DESIGN '' 3. Earnest is still using language that describes itself as offering a customized, personalized, flexible loan management experience -- which it no longer offers. From their current website : " ... we started Earnest to restore the trust that is sorely missing from the current system '' ; " ... a company that combines data science, streamlined design, and exceptional service to bring people a fast, low-cost, and hyper-personalized financial experience. '' ; " ... and allow them [ customers ] to customize their repayment plan to fit their needs. '' 3. Earnest has charged me interest on the sale of my loan back to XXXX. How can they make money off of borrowers by " switching '' their accounts to essentially the same company? Why was Earnest able to refinance XXXX loans in the first place if they knew the merger was taking place? I'm writing today to plead that the CFPB take the following actions : 1. Launch an official investigation into the merger between Earnest and XXXX to determine how it was designed to how it works against their customers 2. Enforce that Earnest either restore all functionality that was advertised to customers who refinanced with the company during the time that these features were offered -- or -- insist that they remove ALL mentions, instances, implications of their former features from their website, outside advertising, review sites, etc. to make their advertising more consistent with XXXX 's. 3. Refund myself and others who switched their loans from XXXX to Earnest ( only to have it switched back ) the interest that was charged for the loan sale. They should NOT be able to make money off of students who were baited & switched by these practices. Bottom line, Earnest has now sold out and now engages in the same corporate greed that is rampant in the student loan industry. It's a shady world out there when it comes to the student loan industry and the amount of abuse that student loan borrowers have endured when trying to pay back their loans in good faith is an abomination to the values of freedom and pursuit of happiness that this country stands for. It's my hope with submitting this complaint that those who have the power to do so will say ENOUGH IS ENOUGH and put an end to the corporate greed that has relentlessly burdened student loan borrowers.

To Whom it May Concern, I am writing to you to express concern with my current student loan with Earnest ( now XXXX )- ( as of XX/XX/2023 ) : I owe {$26000.00} 4.72 % fixed interest {$350.00} monthly payment due the XXXX of each month I have been having trouble paying my student loan but I believe XXXX is engaging in predatory behavior and dishonest practices. On XX/XX/23, I spoke with XXXX employee XXXX XXXX about lowering my payments or seeing if there was anything they could be able to do because student loans were becoming unaffordable. They said no. I ended the call. On XX/XX/23, I spoke with Employee XXXX XXXX. By this time, my loan was 2 payments behind. My pay due date was the XXXX of every month. She offered me the following options : 1. Add 8 more years onto my loan and make it a 15-year loan, reducing my monthly payment to {$230.00}, 10.35 % interest rate ( unsure if fixed or variable ), and the new total cost of the loan would be {$41000.00} 2. Apply for a 3-month forbearance program to help get me back on track and make up for the missed payments. I decided to go for the 3-month forbearance program and was told by Spear that if she changed the payment date from the XXXX to the XXXX of the month ( when I could pay ), I could pay on XX/XX/2023, and not be 3 months behind on payments so it would not get reported to my credit score. I agreed to those conditions, paying {$360.00} on XX/XX/23, which were also sent to me by text. See in the conditions of forbearance section. XX/XX/2023- I logged onto my account and noticed there was no option to pay the {$360.00}. It said my next payment date was due on XX/XX/XXXX for the regular {$350.00} payment amount. It appeared no changes had been made at all to my account. XXXX also reported it to my credit file and my credit score dropped XXXX points. I called XXXX immediately and spoke to an employee who didnt know what was going on so she transferred me to XXXX XXXX who then looked back into my account and told me she never told me I had to pay on XX/XX/23 even though it is clearly stated in the terms. I told her it was reported to the credit bureaus, and that my credit score dropped XXXX points, and I believed it was a mistake. I asked if anyone else could look at it and she said her manager could but was at break and would call later or the next day. After over an hour, I didnt get a call back so I called XXXX and asked XXXX manager, XXXX XXXX . XXXX told me there probably was no mistake and that if something is due, I have to pay it on that day or it gets reported to the credit bureaus. I tried explaining what happened. She told me she knew already but would listen to the phone recording from XX/XX/2023. XXXX called back around an hour later and said she listened to the recording and that XXXX clearly stated I had to pay on the XXXX of XXXX. I asked to hear this recording. XXXX declined. I asked for a copy of the authorization texted to me that we agreed upon on XX/XX/2023 as stated in the text I would receive a copy. XXXX declined. I reminded XXXX that the terms and conditions were incorrect and that it says right in the message that my payment day is XX/XX/2023. XXXX said that didnt apply. I have also attached images of the website showing how I cant even pay the correct amount ( {$360.00} ) in the official terms I agreed to on XX/XX/2023. It was never updated in my portal. XXXX should be honest they made a mistake and retract the negative credit report to the credit bureaus because I have proof they changed my payment date in the terms and conditions. I was approved for private student loans for the XXXX school year with Earnest and received my first loan disbursements for the XXXX XXXX semester. On XX/XX/XXXX, I received email notices from Earnest that updates had been made to my student loans disbursements for the upcoming school terms. I spoke with my student account department at one of my schools and was informed that Earnest contact the financial aid department and provided false information to them about me. I was told that Earnest stated that I withdrew from all my courses after receiving refunds from my Fall disbursements from multiple schools. This false information caused my financial aid office to cancel my loan disbursement for the XXXX XXXX semester. The information they provided to the school was false because I had not withdrawn from my courses at all of my schools. I successfully completed some my courses and received A grades. I was hospitalized during the XXXX term and had to withdraw from some of my courses due to extenuating circumstances. They didn't speak with me prior to contacting my financial aid department and omitted information regarding my hospitalization which created an extenuating circumstance for me. I called Earnest and spoke with a representative regarding this the following Friday, XX/XX/XXXX and was told my XXXX XXXX loan disbursements for all of my schools were placed on hold. I requested to receive a call from a supervisor or XXXX regarding this and was told that I would be contacted within 24-48 hours. I never received the call that I request, instead I received an email stating that they would follow up with me when they could. I responded to that email and told them they didn't have the right to provide my financial aid office with misleading information and needed to rectify the problem. Following my response, I received another correspondence from Earnest informing me that all my XXXX XXXX loan disbursements were cancelled due to excessive loan debt. This reason for cancelling my loans was inadequate because I had the same loan debt at this time as I did when they approved me for each of my student loans. If they felt my loan debt was excessive, they shouldn't have approved my loan applications when they were initially submitted. They also stated that there were security concerns regarding my account and didn't provide any information regarding that. This decision to cancel my approved loans in the middle of the school year after providing disbursements for the XXXX XXXX term has put me in a compromising position that is directly affecting my ability to continue my degree programs. I didn't do anything that violated my loan contracts nor did my actions violate any of my school 's policies or guidelines. Earnest has adversely affected my educational pursuits by cancelling my loans and funding in the middle of the school year, which is preventing me from continuing my education and completing my degree programs. In addition to this, they approved me for an additional loan on XX/XX/XXXX for the upcoming school year, prior to them cancelling my XXXX disbursements. If my loan debt was too excessive for them to continue with my XXXX XXXX disbursements, they would not have approved me for an additional loan the day prior to sending me the notices on XX/XX/XXXX regarding updates made on my loan disbursements. My loan debt was reviewed during the application process when I approved the day prior to receiving those notices.

For background, I have worked in the XXXX XXXX for over 12 years, and I currently work for one of the three XXXX XXXX ( XXXX ), building credit scores and helping national lenders set underwriting strategies in all industries. I do not expect any special consideration with my complaint, just explaining why I have extensive knowledge of this issue compared to the average consumer. I have student loans serviced by XXXX since XXXX, and I was interested in a XXXX loan ( underwritten by Earnest LLC ) as those were exclusive to XXXX customers. Per the application disclosures, the best possible rate was 3.73 % for a fixed-rate loan, likely assuming the minimum loan amount of {$5000.00} and the shortest term of 5 years. I applied for the loan on XX/XX/XXXX, and given an interest rate of 4.3 %. This did not make sense to me as I 1 ) was applying for the lowest loan amount of {$5000.00} ; 2 ) was applying for the shortest term of 5 years ; 3 ) had an XXXX FICO score of XXXX ( from the disclosure from XXXX ) ; my overall credit file is spotless, as reflected by the score ; and 4 ) had a debt-to-income ratio ~4 % - 5 %. I called XXXX on XX/XX/XXXX around XXXX XXXX. CST and spoke with a representative named XXXX, to get an explanation of why I did not qualify for the best rate when it would seem my application was generally pristine. I was told that my XXXX credit score, while excellent, still was not good enough to qualify for the best rate. I was offered a call-back from a supervisor, which I received on XX/XX/XXXX around XXXX XXXX. from XXXX. She reiterated that while XXXX was a great score and just " a few points away, '' it was still not good enough to qualify for the best rate. I was told they could not reveal the cutoff since it was proprietary, but with only a 15-point range left, that's a questionable response. I believe this constitutes a UDAAP violation. While I understand each lender can set various underwriting criteria, it seems highly questionable to tell a consumer who has an XXXX credit score with other low-risk application factors ( loan amount, term, DTI , etc. ) that they do not qualify for the best terms, much less an XXXX being only 15 points away from the maximum. I was given no adverse action reasons, just that " your score wasn't high enough. '' I believe this is a UDAAP violation because it should be investigated as to how many, if any consumers, could qualify for the best rate if they are supposed to have $ XXXX in student loans but also have an XXXXother high credit score ( since most consumers with a large enough loan needing to refinance would have low-to-moderate credit scores ). It should be investigated as to how many of XXXX 's applicants ever qualified for the best rates, and whether that's a reasonable percentage of all applicants, even 1 % -2 %. If the criteria is so set so high that virtually nobody can qualify, it amounts to false advertising of an interest rate that is not attainable with a reasonably qualified application like mine ( if in fact the reason for the adverse action was my credit score and not some other undisclosed factor ). Again, based on my decade-plus of national industry experience, I have never experienced a lender that set a best-rate-cutoff of more than maybe 800 or 820.

Dear Madame/Sir : I am writing to you in regards to a recent student loan refinance application I submitted to Earnest Operations, LLC, XXXX XXXX XXXX, XXXX XXXX, CA. XXXX NMLS # XXXX, operating at the following internet address : www.XXXX.com. I submitted an application on their website on XXXX XXXX, 2015, and uploaded all required information and additional documents to refinance the current balance of my student loans ( $ XXXX ) and lower my current interest rate from 7 % to what XXXX is currently offering ( 1.90 % ) for a variable rate. I received an email from " XXXX '' who advised me to explain why I had taken out a $ XXXX loan with XXXX XXXX in XXXX 2015. I responded that I was considering investing in rental property, but had recently changed my mind and decided to focus on paying off my student loan before investing. XXXX XXXX, 2015, I provided proof by uploading a copy of the statement showing that this loan was paid in full. On XXXX XXXX, 2015, I woke up to an email stating that I my loan request was denied, and the reason was due to " high debt to income ratio, '' which is inaccurate. I believe I am more than qualified. Other than my mortgage payment of {$1500.00} per month and the student loan, I do not have any debt. I pay off all credit cards in full each month. I make $ XXXX annually and have been employed with the City of XXXX XXXX for XXXX years. I am a career employee with stable income, I have an excellent credit history with high credit scores, averaging in the XXXX 's, and I have substantial savings and investments. Earnest ' reason for the denial of my application is unsubstantiated. The matter I would like for you to investigate is that during the application process I was required to upload a copy of my California Driver 's License. I am a XXXX male, and all things being equal, I do not believe my " white '' counterpart would have been denied. This was the first time I had to show identification for credit over the internet. Therefore, I humbly request you to investigate this matter and determine if Earnest Operations, LLC, is violating the Federal Equal Opportunity Act. On XXXX XXXX, 2015, I called and spoke to " XXXX '' a customer service representative. He advised me ( without retrieving my application information ) that there is no reconsideration. The decision made is final unless something has changed, and that there is no one else I could speak with. He was very casual and unprofessional. He advised that they do not have the " bandwith '' to allow me to discuss their conclusions that I have " high debt to income ''. The telephone call had a very weird feeling to it. His attitude was the decision is what it is and that 's final. He was very unprofessional and uncourteous. In conclusion, I have recently taken a closer look at their website and all of the photos are of XXXX people, mostly listed as attending XXXX XXXX type colleges. I believe that I have been the victim of XXXX. Please investigate this company.

The federal Equal Credit Opportunity Act prohibits creditors from discriminating against credit applicants on the basis of race, color, religion, national origin, sex, marital status, age. However, this is exactly what this company is doing because of not being properly qualified and being unprofessional, relying on automated systems vs. dealing with each lender personally, not doing due diligence in checking for all required documentation and discriminating consumers purely due to their misunderstanding. First they harassed me with constant marketing mailers claiming that I'm pre-approved for the loan ( XXXX credit score, extremely healthy credit, no derogatory marks at all ). They then denied my application not based on my credit worthiness, but because they discriminate me based on my origin and because they don't have professional services in place to understand my immigration documents and moreover, failed to contact me prior to decision to ask for additional supporting documents. They claimed that my green card expired, even though at the time of application I attached the official stamped extension letter ( form I-797- notice of action of the petition I-795 ) received from the USCIS , stating that my green card and immigration status are in order. I also additionally attached form I-795 ( which is previous step prior to getting extension letter- form I-797 ). My immigration status is already set, and I already even got the approval for green card extension, and their automated system was asking for some other irrelevant form I-90 ( which in only requested after you had a card for 10 years. I had mine for 2 years only, which was shown on the card submitted, and in that case form I-I-795 is requested, not form I-90 ). That made me eligible to receive any type of loan in this country. They however failed to research into this ; didn't contact me to correct it ( never e-mailed me with specifics of question, never called me ; just updated status in the system rejecting my application ) ; thus illegally basing decision on incorrect information. I would not authorize a credit inquiry had I known that the company doesn't understand requirements for the documentation. Nowhere in their marketing attempts or rules do they state anything related to required documents, number of attempts they will make and their ways of handling such cases. And their lack of professionalism caused me damage ; created inconvenience, and made me waste my time while I was waiting for response for more than 3 weeks, not even talking about damaging my credit score. Even after that, they failed to communicate with me and call me to correct their mistake. Incredibly bad service. I'd like consumers and financial administration to be aware of that. They don't perform a due diligence prior to making decisions on loans, they fail and thus fail consumers and government.

XX/XX/XXXX : I submitted my documentation and my loan was approved, confirmed the money should be sent to XXXX XXXX XXXX servicer for private loans and NOT to XXXX for federal loans, made sure documents showed where to send check to, confirmed check should be sent to : XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XX/XX/XXXX : received an email that loan payoff was sent to XXXX, not XXXX. Contacted them via chat and Earnest said XXXX is serviced by XXXX, so the check would need to be sent there XX/XX/XXXX : {$15000.00}, check was disbursed and sent to servicer XXXX XX/XX/XXXX : reached out to Earnest via email to let them know that XXXX is not serviced by XXXX and they sent the check to the wrong place, I confirmed this with XXXX Between XXXX XXXX I chatted and emailed with many people who told me they would cancel the check and reissue to the right address and servicerXXXX XXXX XX/XX/XXXX : XXXX said check was sent to XXXX at XXXX XXXX XXXX, XXXX XXXX XXXX, I replied to the email and said XXXX is not the servicer and payment should have been sent to XXXX but got no reply XX/XX/XXXX : chatted with virtual assistant who said to chat back during the week XX/XX/XXXX : email from XXXX who spoke with XXXX, a rep I was previously working with, She said XXXX would be returning the check so they could reissue the check to XXXX, she also acknowledged I submitted my documentation showing the XXXX loan details and payment address XX/XX/XXXX : XXXX reached out to me via email saying she confirmed her treasury team did send the check out incorrectly and it is their mistake, they are working on a resolution and will defer my payments, confirmed it may take some time, she will be my point of contact until this issue is resolved XX/XX/XXXX : sent XXXX an email stating that XXXX applied the check that Earnest sent them to my account so the payment is probably not being returned, I emailed XXXX to ask them to return funds as well XXXX later replied to my email letting me know she escalated the issue and they are still waiting for the funds to be returned, said once they have the funds back they will disburse it to XXXX XXXXXX/XX/XXXX : emailed to thank XXXX for her help XX/XX/XXXX : XXXX emailed with no updates and money had not been returned XX/XX/XXXX : I emailed XXXX asking for an update and asking if they can issue a check to XXXX in the meantime, as this was not my fault, XXXX said she'd reach out to her leadership team about a resolution XX/XX/XXXX : I emailed XXXX asking for an update and expressing I no longer want to work with them because their mistake has taken 2 months and is still not fixed

I have been having issues now Earnest Student Loans now for several months. Starting XX/XX/2021 as my emails show, I contacted Earnest about canceling the {$7000.00} biweekly payment that I did initially set up/schedule several months prior. However, my financial situation changed, and therefore I wanted this canceled. I have numerous e-mails from XXXX stating that this has been taken care of, but unfortunately, on 4 separate occasions, they ATTEMPTED to take this out of my account. 1 time they were successful ( despite my being told that this was remedied, and set at {$2000.00} biweekly, per my request ) in taking this money out, leading to insufficient funds fees from my bank ; these were ultimately refunded by Earnest. I also recently ( XX/XX/XXXX ) was forced to make a {$30.00} stop payment against any future withdrawals, as yet again XXXX XXXX at XXXX ), well after the servicing manager confirmed with XXXX that {$7000.00} would not be taken from my account, it was still set to take that money from me. And, I was told in that same e-mail/sentence, that {$2000.00} would be taken out biweekly, beginning XXXX ( but this didn't happen! ). So, now I'm paying more interest, because yet again Earnest can't figure this out. There were also exactly 14 days where I had {$7000.00} taken out of my account ( unlawfully ) by Earnest, despite my repeated attempts to stop this ( and confirmation by Earnest that it was stopped/would NOT happen ). I did not receive interest in my bank account ( 3 % ), and did not receive a reduction in interest from Earnest ; they simply held this money for 14 days. I also have not received another {$15.00} in insuffiicient funds fees " return '' from Earnest that this caused ( they refunded the initial one ). I have spent well over 6 hours on the phone with Earnest, e-mailing them, keeping close track of my account, talking to my bank, etc, dealing with this. I asked Earnest to credit me the lost interest on the {$7000.00} for 14 days, but they said regulations prevented them from doing this. But how were they " allowed '' ( against my well-documented will! ) to take money from me without my consent, and in fact my direct lack of consent??!! No regulations at play there ; they simply did what they wanted, but then when the little consumer asked them to make things right, they boldly started talking about regulations! But no regulations were ever mentioned regarding protected the little consumer from being taken advantage of, as they clearly did.

I recently noticed that Earnest had been applying debits and credit to my account labeled " adjustments ''. The credited amounts always equalled the debited amounts, they cancelled each other out, so it didn't raise any red flags to me. But then I noticed a debited " adjustment '' to my loan account in the amount of {$87.00} -- and there was no credit to offset it, so I called Earnest in XX/XX/XXXX to flag this. I auto-pay my student loan monthly and have a fixed interest rate so there's no reason for my account to be charged a fee of any kind. The explanation I received from the Earnest customer service representative was that the " adjustment '' charges were the result of me overpaying interest, and that in XX/XX/XXXX my account started being refunded/ credited back for those overpayments. The representative also said that I should have received a check in the mail in XX/XX/XXXX for {$3.00} which represented another refund " adjustment ''. Once I pointed out that I saw no evidence of my account being refunded at all in XXXX or XXXX, nor had I received any checks in the mail from Earnest, they backtracked on their explanation ( email excerpts below ). Unfortunately Earnest 's explanation was very vague given loan repayment is a process that should be carefully documented. Especially given Earnest is servicing a student loan that is valued at close to $ XXXX. It doesnt make sense to me that when I have a fixed interest rate Earnest cant properly calculate the interest payment each month. -- - ( email excerpts ) Earnest on XX/XX/XXXX at XXXX PT : " Hi XXXX, I have actually just received a correction from our team processing the refund. It seems that they were actually able to apply it to your principal balance. I apologize for all of the confusion, I was not aware that they could do this. Please let us know if you have any further questions. '' Me on XX/XX/XXXX at XXXX PT : " When was that done? I dont see it as an adjustment anywhere in my loan history. Thanks, '' Earnest on XX/XX/XXXX at XXXX PT : " Hi XXXX, The original refund was initiated back on XX/XX/XXXX. You will then see the adjustments to make the refund the correct amount in the adjustments that were done between XXXX and XXXX. I refinanced my student loan with Earnest on XX/XX/2019. The first issue I had was that they over paid my previous lender and immediately starting charging interest on that principal, even though it stated in the documents that I am to continue making payments with my original servicer ( obviously ) and that if my actual payoff balance was different than I originally claimed in the application, that it would be adjusted properly. Earnest did not adjust the loan origination amount. Secondly, I received my first statement on XX/XX/2019 and immediately arranged auto-pay through the Earnest website. I elected for bi-weekly payments, every other thursday, to start on XX/XX/2019. The first payment on XX/XX/XXXX came out promptly and without issue. However, the payment on XX/XX/XXXX did not process. I noticed over the weekend and called them on XX/XX/XXXX to find out why. They stated it was a newly realized problem that hadn't yet been solved. I asked them if they had any intention of notifying me that there was a problem and they said they were still trying to identify everyone who was being affected. The rep then told me it appeared to only be an issue with the second bi-weekly payment and that the first bi-weekly payment of the cycle was processing with no issue. They offered to process my payment same day and make it effective on XX/XX/XXXX and that the interest would be recalculated. Now, the XXXX of XXXX rolls around and my payment does not process for that date either. Their website states that I am enrolled in bi-weekly auto-pay. My billing statement states on page 1 that I am enrolled in bi-weekly auto-pay. Additionally, I elected for the overpayment billing instruction to bill me for my full monthly payment regardless of how much I pay throughout the month. I have yet to receive any communication via email or snail-mail that there is an issue processing auto-payments and I am horrified to think about how many people they are charging interest to for unpaid principal when they have a payment agreement already in place. Please help!

I was pre-qualified for a loan from this company in the amount of {$110000.00} on XX/XX/2023, for a XXXX fixed paying {$1000.00} per month. Once prequalified, I submitted an official application and officially approved for the XXXX fixed previously mentioned. I proceeded to finish the application process until I reached the page where I choose my loan. On this page I was only allowed to choose a XXXX fixed at a much higher monthly payment. I stopped and called the company on XX/XX/2023 to get the rate that I was approved for. When bringing this to the associate 's attention he acknowledged that this was an ongoing issue with their online system and that he could see my XXXX fixed on his system. But I could not access it on my end. I was told that I should wait to see if the system updates on its own. The associate also told me that he would work on his side and everything should be resolved in a couple of days. I received no follow-ups and no resolution by XX/XX/2023 so I emailed the associate who I was working with and told him I would be submitting a complaint to the CFPB. No response. I had to call the company on XX/XX/2023 to receive a follow-up. They told me the same thing that I needed to wait for the system to update and that they will work on their end. I waited until XX/XX/2023 before emailing again and reiterating my frustrations and that I will be submitting a complaint. No response. At this point I had to go with a loan that I did not desire because my credit had already been pulled and the due dates for my XXXX loans is approaching. Now, I may not get the funds in time and will have to make a higher payment than I planned for this month because this company did not abide by what they approved me for. They did not resolve the issue after submitted two formal complaints and have caused me financial hardship in a time that I can not afford it. This is deceptive and predatory. Complete lack of competence and consideration for customers. I will be following up with a lawyer.

I refinanced my student loans with Earnest. Today they sent out an email that they are changing how auto payments can be scheduled. According to them : " Starting on XX/XX/XXXX, biweekly Auto Pay will not be available. '' To top it off, changes to Auto Pay now have to go through contacting customer service instead of being managed directly online. Effectively Earnest is going to make loans harder for everyone to pay. I enjoy my biweekly auto payments because it helps me pay everything off faster. The email reads : " Moving forward, Auto Pay can only be scheduled for the XXXX of any given monthother days will not be supported. If your current Auto Pay date falls within that range, no action is required. If it falls outside this range, please sign in to your Earnest account by XX/XX/XXXX to choose your desired payment date between the XXXX and XXXX. If your XXXX Auto Pay date is outside the supported range on XX/XX/XXXX, your payment will be automatically pushed to XX/XX/XXXX. After XX/XX/XXXX, changes to your Auto Pay dates must be made directly with our XXXX XXXX team, rather than through your client dashboard. Well keep you posted once you can do so through your dashboard. Starting on XX/XX/XXXX, biweekly Auto Pay will not be available. Any clients paying twice per month are requested to sign in to their Earnest account to select a new monthly payment schedule. Working with Earnest on my XXXX XXXX XXXX, I've had autopay setup for some time. I changed the pay-from account and noticed autopay was turned off, and it adjusted my rate without telling me. After noticing that the account was now off autopay, and the payments had fallen behind, I called on XX/XX/XXXX, Customer Service to reinstate autopay, and my interest rate would adjust back. I went through the process, approved them to pull from the account, verifying through contract signing again, and supposedly autopay was reestablished, and I moved on. I received a letter after long travel and saw they sent me a note that the account was past due, and to avoid further action, to pay. I went online and paid it after opening the letter same day, noticing the previous amount was never autopayed. In a prior call in early XXXX, I was told by their agent that they try to resolve and do not report to an agency, that being my chief concern as we fixed this issue in their system. Logging back in, it said " rejected '', but no reason for that - it certainly wasn't for insufficient funds, etc. It must have been a setup issue on their end, as I paid the full outstanding balance on my end with the same pay-from account. I woke up this morning to a credit alert. They reported me to the credit agency on the XXXX ( I paid in full on the XXXX ), destroying my perfect credit score by more than 90 points. They were unhelpful, you're not allowed to setup reoccurring payments and even autopay can't be trusted. I can only surmise this is a tactic to charge a lot more interested, and fees to generate revenue. They've now harmed me deeply, even though this is their fault. I'm tremendously disappointed and disputing with the credit agencies, but their service is meant to scam and prevent those from paying their loans. They also call from different numbers, which many phones identify as spam to cover themselves and say they called.

I loved Earnest at first when I refinanced and consolidated my private student loans. The rate was good and experience fine. The bad parts come after my in-school ( for grad school ) deferment. My deferment extension was denied ( due to being in a business PhD and not law or medical school ). This should tell you XXXX things : XXXX ) the company has very poor risk management ( they are not able to deal with risk on a more granular level than if you will be a doctor or lawyer - making no use of publicly-available job and salary data ) and XXXX ) the customer service agents are inept ( a representative told me on the phone not to worry about the extension- which was then denied by a different person ). The above is now in the past- the company has responded ( poorly ), but they have done so. Here is where this complaint begins : When repayment began, the roughly {$260.00} minimum payment the representative quoted on the phone in XXXX ( I have a follow-up email from her, which doesn't record the amount, that was sent on XX/XX/XXXX - the call should be recorded ) when we discussed what the worst case scenario of an extension application would be ) had become nearly {$400.00} by XXXX. How could she be so wrong? How could the company miss the mark that much, by not only encouraging me not plan for much given the chance of an extension and then being off my nearly double? Then the worst part : I received a paper bill indicating {$0.00} due by XX/XX/XXXX. When I log into my account to see why repayment hadn't begun, I notice the {$380.00} payment required by XX/XX/XXXX. This is trickery in its clearest form and a very clear effort to both XXXX ) rack up fees and XXXX ) extend the length of the loan and interest-bearing period. I have been trying to apply for student loan refinancing because my XXXX student loan was given to me at a predatory variable rate of 10 % and 9 % when I was just XXXX years old. As a XXXX year old woman, with a well paying job, I have been making over {$1600.00} payments on-time every month, but the principal in each payment is less than {$500.00}. My student loans have been in repayment for over 2.5 years. I applied to refinance with Earnest by applying for loan refinancing on XX/XX/2019. Although I am able to get approvals at other institutions with my good credit and low risk factors, Earnest denied my application because I didn't have a college degree. I believe this to be discriminatory to people who are unable to finish school, have to take extended breaks in enrollment, or have extenuating life circumstances. I pay my student loans on-time each month and maintain high credit and low risk factors as a borrower, only to be discriminated against when trying to lower my interest rates. When I spoke with Earnest on XX/XX/2019, they stated it is one of their requirements in their lending license. Having, obtaining, or not holding a college degree is not a risk factor in determining credit worthiness and should not be held against people trying to refinance their student loan debt burden. This type of discrimination is completely unnecessarily prejudiced towards borrowers with a very common academic path and does not determine one 's credit worthiness. I believe Earnest to be discriminating towards people from unprivileged backgrounds who do not/did not have the ability to have a linear college experience and are endowing extra pressures to maintain predatory student loan interest rates.

On XX/XX/2022, the court granted preliminary approval for federal loan cancellation and refunded payments for class members who applied for the Borrower Defense to Repayment. The class action lawsuit, Sweet v. Cardona, which is involving predatory and fraudulent for-profit colleges such as the one I attended ( XXXX XXXXXXXX XXXX XXXX XXXX ), proves without a doubt that we have been absolutely and massively scammed and ripped off for thousands if not hundreds of thousands of dollars per applicant. It's wonderful news hearing we have received preliminary approval, but we need to also take a look at the private loans borrowers have taken out to attend these scam schools. Many of us have even more debt in private loans than federal loans, and we are still expected to pay it despite overwhelming evidence of fraud, mishandlings, losing payment records, deceit, and other criminal activity involving our loans and payments. We need to take action while this issue is in the spotlight, to have these private loans discharged in addition to the federal student loans. Loan balances through companies such as XXXX, XXXX, XXXX XXXX, and loan companies used for consolidation purposes ( such as Earnest, with whom my private loans are now held in the amount of approximately {$24000.00} ) should all be cancelled and refunded if those loans are taken out for a university on the list of fraudulent schools from the Sweet v. On XX/XX/2021 I was notified via email ( Juno ) about an incentive to refinance student loans. I decided to get more information regarding the incentive and found that if I applied for a refinance loan with XXXX, I would be eligible to receive a {$500.00} reward if the following conditions were met : not current XXXX client, or received the bonus before, submit completed student loan refinancing application via link, provide valid email address and checking account number in the application, loan must be fully disbursed. I proceeded to click the external link and completed an application which was subsequently approved. I never received my reward. I contacted XXXX customer support. I was told refinance loans did not qualify for reward. I subsequently sent an image of the conditions of the reward offer from which i was referred. The rep then said he was mistaken and refinance loans do indeed qualify for the referral reward, but claims I did not click the link that would entitle me to such. I then sent images of my browser history that shows I arrived from the partner link, including time stamps. After speaking with another rep, who clearly stated that this has been frequently occurring issue with new loan applicant, I was told they have no record of my clicking the referral link despite my immutable evidence to contrary. XXXX representatives claim they have evidence my account is not associated with any referral link, but refuse to provide such evidence. XXXX is actively baiting prospective applicants with a reward they have no intention of providing.

I have a student loan through Earnest and ever since they were bought out and transitioned to to the new servicer I have had nothing but problems!! when I signed up for them they had biweekly auto pay, an app and you could change payment amount online and see payoff date. All of these things are no longer available. The also made me change my payment date when they switched. App has been down for over a year and they have made it next to impossible to pay off the loan. I scheduled a payment mid XXXX for XX/XX/XXXX and received confirmation of my payment. It is now XX/XX/XXXX and the payment hasnt posted on my account. It has been taken out of my checking account as of XX/XX/XXXX. Meanwhile the interest keeps accruing! I called Earnest and they tell me that there is a glitch and payments are not crediting. THIS IS A MAJOR ISSUE. had I have not been mini obsessed over my student loans I would have never known and they would have made {$860.00} plus interest off me. The person told me the are updating their system. Updating system when they just did and it wasnt working right? Its been a whole day and my payment has yet to credit. My next payment is coming due soon and I am scared they arent going to credit my account properly for the interest. My daughter refinanced her XXXX XXXX Student Loan with Earnest with a loan approval date of XX/XX/2020. Earnest was supposed to payoff XXXX XXXX by XX/XX/2020. On XXXX XXXX she received notice from XXXX XXXX that she was in arrears on the loan. She inquired with Earnest via phone found that Earnest had a batch of checks that did not clear the bank and had to be resubmitted. Ernest had not contacted her about this delay. Previously they had told her that her XXXX XXXX loans had been paid. Her accounts with Earnest reflected that everything had been paid and disbursed to XXXX XXXX. On XX/XX/XXXX she received notice from XXXX XXXX that Earnest still had not received a payoff from Earnest and that I was 60 days in arears on the loan. To this day, Ernest has not contacted XXXX XXXX to take responsibility for the error. This is now affecting both her and my credit score ( as her co-signer ). Although Earnest paid XXXX XXXX as of XX/XX/2020, my credit score has not changed. I am respectfully requesting that you investigate Earnest and 1 ) request they contact XXXX XXXX Education Financial Services and take responsibility for the lateness of the payment and payoff, and 2 ) instruct earnest to request XXXX XXXX request a rapid rescoring of XXXX and my credit with each of the three credit bureaus. Earnest overcharged me by {$370.00} on XX/XX/XXXX. This was after repeated back and forth to try to customize the amount I would pay ( I wanted to pay off my loan on an accelerated schedule ). I asked XX/XX/XXXX and received confirmation on XX/XX/XXXX that I would be charged the monthly minimum gong forward starting with the next payment on XX/XX/XXXX. I was billed twice that day, once for monthly min. of {$730.00}, then the additional charge of {$370.00}. This was after months of aggravating back and forth with their support team. Not blaming the support team so much as a lack of proper investment by management in their systems ; it's a highly antiquated system they force on their customers that lacks even basic features like same day verification of payments being received, or an ability to set auto-payments in a specific amount ( the amount must be coordinated through support, which can't take any action with less than about three weeks notice - yet they are dependent on you adjusting the payment schedule from bi-weekly to monthly ... which almost guarantees a misalignment if you desire to adjust the payment amount and cadence at the same time! ) I would have long ago abandoned their auto-pay ... yet they force this to obtain the lowest interest rate ... and then make it nearly impossible to manage. In my opinion, it's an egregious failure to provide a basic level of service to enable customer to pay what they want, when they want to.

okay, so i wanted to consolidate my student loans to get one payment because i have like 6 right now. i researched online and came up with a fairly reputable earnest.com. as i was going through the process, they said they must get access to my bank information, username and password in order to process my loan. since i have searched and found it a legit company on many, many reputable websites i decided i would give it to them and then immediately change my password because this is just not normal. as i went through the process, it seemed more and more off so i decided to stop the process and not do business with them. i emailed the company and asked them to stop trying to access my bank account and to remove all my information. they have not. it has been 4 days since and they are still trying to gain access to my bank account. further, i dont believe they should be able to force me to give them my banking credentials. i figured they just wanted to confirm i had one as most financial services companies do but this is beyond that. they clearly have intentions to continue to monitor me whether i am doing business with them or not ... .and i realize that XXXX XXXX XXXX is running the cfpb right now and probably that coward will appluad their efforts to defraud me but maybe you could do something when that coward is finally removed. there is a lot wrong with earnest.com both signing up and after!

To make a long story short. Since XXXX of 2018 I have been using the APP to make my payments a month in advance. So EARNEST decided to take my early payment I made on XX/XX/XXXX and reallocate it to my priniciple. Then on XX/XX/XXXX they charged me again for my payment. I was basically double billed in XXXX when I had a balance of {$0.00}. When I called to get the issue resolved, I was told there is nothing they can do about it. That now my loan will just be paid off a month earlier then planned. This was not the point of this payment nor did I authorize an additional payment to be made. I authorized my XX/XX/XXXX bill to be paid on XX/XX/XXXX. Which Earnest had had no problem taking my money for, but then charged me again on XX/XX/XXXX because their " New System '' Cant process that correctly.

On Thursday, XX/XX/2022 at XXXX XXXX, after President Biden announced debt relief for borrows of federal student loans, student-loan refinance company Earnest sent an e-mail with a headline that wrongly suggested that the relief had already been applied to accounts. The headline read, " [ My name ], up to $ XXXX in fed loans is gone but what about the rest? '' At issue, someone seeing this headline may inadvertently refinance their student loan before their debt relief is applied. Also, the body of the e-mail says that " the Fed [ is ] raising their interest rates, '' which may make potential borrowers wrongly think that the rates on their federal loans are being raised. The e-mail is attached. To be fair, a disclaimer is at the bottom, but the whole of the e-mail can be misleading. Furthermore, the disclaimer on Earnest 's website does not reflect the payment suspension through the end of the year, let alone through the most recent actions towards forgiveness. The screenshot is attached. I requested an Earnest account for my tuition at XXXX XXXX. After I requested the loan I found a way to pay for the tuition without the loan. Earnest sent me a notice that the loan was dispersed to XXXX on XX/XX/2022. I asked XXXX if they received the payment and could they return it to Earnest? They did not received payment from Earnest. This was confirmed by XXXX on XX/XX/2022. Earnest stated they had dispersed the loan. XXXX does not have the funds on XX/XX/2022. Earnest will not cancel the loan without the funds being returned. Earnest charged me {$25.00} payment of funds that were not dispersed to XXXX. Asked Earnest again to cancel the loan. They stated they could not until the funds were dispersed on XX/XX/2022. XXXX again states no funds received. XX/XX/2022 Second payment is now due on a loan that has not dispersed to XXXX. I can not get the loan cancelled. There is no number for servicing. All correspondence is via email. Some emails go unanswered. Tuition is due in full on XX/XX/2022 and still no dispersement from Earnest. However, both payments are now due. This is impacting my credit and my opening of a loan for a mortgage. I have all billing and email correspondence for reference.

Initially, the monthly cost of my student loan payments took up more than 50 % of my monthly income. I struggled for months to pay both rent, to get food, and pay off my student loan. The student loan bill is the largest out of all of these. I was never able to find a job with my XXXX XXXX XXXX that pays a comparable salary to what it cost to get the degree. I would have never gone to school for this degree if I knew that the job market had no jobs that would compensate me for my specific education. Now every single month, even since refinancing with Earnest I barely get by. Now I am about to have a baby and I have no idea what I am going to do in order to feed my family, this loan takes up an unreasonable amount of my income and they are not willing to work with me on lowering the payment without me being in debt for the rest of my life. Please, I need help. If something else doesn't happen soon I fear for my family. I worry I am going to have to raise a child homeless and couch surfing because of the unreasonable price of my degree.

On Monday, XX/XX/XXXX, Earnest/XXXX, my private student loan company, harassed all of my family members to include my parents, my husband, my husband 's parents, my brother, my brother-in-law, and my sister-in-law to try to get in touch with me relating to MY student loan. The only person listed on the student loan is myself. Not once I have a received a call from Earnest or XXXX. The only form of communication I received, was an email and a letter in the mail asking me to call them to settle my account. I am having difficulty making my payments and their lack of support to work with me to pay the amount I can afford is unbelievable. I also do not understand or appreciate this company contacting and harassing my family to get into touch with me. Meanwhile, I do not have a single phone call or voicemail from either Earnest or XXXX to discuss my student loans. This is completely unprofessional. A situation that is meant to be private and handled by the person listed on the account is the only person that both Earnest and XXXX should be communicating with. I re-financed a couple of my student loans through a company called earnest. I have a fixed rate loan with them so the monthly payment through the life of the loan should be fixed. I've made every payment on time. But recently, I noticed that the minimum monthly payment went up. I called them on XX/XX/18 about this issue and the lady on the phone was very apologetic saying that shouldn't have happened and they will get it fixed. On XX/XX/18, when my payment was due, the issue was still not fixed so I called again. Again, they told me that the payment shouldn't have gone up and they will fix it. They told me to just pay the normal amount they will fix the issue. I paid what I knew was due rather than the elevated amount like they told me to. Today, on XX/XX/18, I received a letter in the mail saying that there is unpaid interest and unpaid fees on the account. This company pushes for automatic payment. If I had been using the automatic payment option, this problem would've gone unnoticed. There are likely many other people that are victims to this highly unethical business practice.

Earnest Operations, LLC is using deceptive and unfair lending practice in regards to their student loan refinance product. They are requesting 10 day payoff letters from your institution that your are refinancing your loan with ; however, they are experiencing a XXXX backlog in payoff processing. They are not making any consumers aware of this back log until after they sign final loan documents. This places many consumers at peril or higher interest expense, opens them up the possibility of incurring late fees from their previous lenders, and the possibility of negative credit bureau reporting due to their lack of ability to process payments in a timely manner. I work in the XXXX and have the skills necessary to protect myself from these instances ; however, not all of their customers will have the level of financial sophistication that I have. I have already had to incur higher interest expenses as a result of their actions, and want to protect further consumer from being harmed. I would welcome a phone call to discuss the entire situation in its entirety.

Earnest reported my payment as 60 days past due after to phone calls where I stated hardship and noted I would pay within 2 months and asked if there would be any adverse impact on my credit and they said no. Only to my surprise that a day before the scheduled payment my credit score is now tanked over XXXX points preventing me from buying the townhome I was planning to save for this fall. I spoke to Earnest on XXXX occasions to no avail. The account is now up to date and I am seeking the 60 days past due removal as it was predatory and done to ruin my creditworthiness and not reflective of my creditworthiness and Earnest lied when they noted that due to hardship the later payment would have been fine. Also despite disputes and numerous calls they have failed to update the account as current and still have it listed on all my credit reports as late. After a phone call I was told a manager would call me back and never received a call, I called again and was denied access to a supervisor or escalation to a more senior employee.

My lender is Earnest.com. My regular monthly statement should have been released on or about the XXXX ( XX/XX/XXXX should have been the most recent ). They have not sent it. I waited a few days and called in and they said it was a known issue, still no statement. A few days later I received an email from them saying to log in and review my statement, still nothing, so I called in the next day. They promised they were fixing the issue and the statement would be out by the end of the week ( XX/XX/XXXX ) - XXXX XXXX came and went still nothing. They don't have customer services on the weekends so today- Monday Morning - I called in and they now say they have no ETA on when the statement will be available. I have a quote from another lender to refinance this student loan. It includes a {$500.00} incentive and a lower rate. On XX/XX/XXXX Earnest sent a payoff letter for an installment loan we had taken out via their website. The loan was in good standing and we never missed a payment or were reported late. The payoff letter clearly stated, " Balance : ( payoff now ) {$5200.00} ''. The letter further states that if paid on XX/XX/XXXX the balance would reduce to {$4800.00}. This loan was paid through a settlement at XXXX XXXX XXXX on Friday XX/XX/XXXX and the check was received by Earnest on XX/XX/XXXX according to the signature from the XXXX receipt. XXXX XXXX sent a check ( attached ) for the amount of {$7200.00} leaving a {$2000.00} overage. After contacting Earnest several times to receive the overage back, we have been unsuccessful in obtaining our money. We have spoken with XXXX and XXXX several times via telephone at XXXX, and although they are/have been extremely kind and cooperative, nothing has been done to honor their payoff amount, nor have we received any satisfactory account and return.

I was reviewing my monthly statements on my student loans and realized that it does not appear that I have been receiving the interest rate credit for automatic payments. I am supposed to receive a .25 % discount on the interest rate of 4.560 % on my loans. I have been enrolled in auto pay for the life of both loans that I have with them. On my statements its listing my interest rate as 4.560 % and shows no discount. I called to check on this and the customer service agent confirmed that my statement should show the reduced auto pay rate and that this was just an error on the statement. I asked for an amortization schedule on this over 20 days ago and they said I should have it in 10 days. I still have not received. My latest statement also still shows the non discounted interest rate. On the quick math that I have done it does not appear that I have been receiving this discount. I have two student refinance loans with XXXX/Earnest ( Earnest.com ). I recently moved and changed my address for many of my personal accounts. I gave Earnest my correct new address, but they still somehow reported it incorrectly to the 3 major credit bureaus as well as the 2 smaller ones ( XXXX and XXXX ). When XXXX bought out Earnest, they removed the biweekly payment option. When I called to discuss this with representatives in XX/XX/2018, they told me that switching to monthly payments would not affect the amount of interest I paid. That was false. A basic economic principle is that paying a loan more frequently reduces the amount of interest. I continued to make biweekly payments despite Earnest 's false representations. In XX/XX/2018, the interest being charged on my loan doubled. I have a variable interest rate, but the increase in LIBOR was not enough to cause the interest to double. I suspect XXXX changed the way they are calculating interest. Since XX/XX/2018, the interest being charged on my loan increases even when the interest rate and LIBOR decrease, and even though my loan balance is decreasing. This does not make sense. Earnest is either calculating the interest rates incorrectly, or charging hidden fees.

I applied for a student loan re-finance with Earnest. They are advertising a 3.5 % APR as the lowest fixed rate. I earn well into XXXX, have a XXXX XXXX, no other debt other than a 2015 car with a loan of approximately 50 % LTV and a {$1200.00} mortgage, 10+ years of work experience, XXXX XXXX with no late or negative information. They offered me over 5 % as the best APR, which is congruent with the non-fintech market rate. I firmly believe that this company is engaged in false advertising of the 3.5 % APR. The explanation for the credit offering of 5+ % did not hold water, given the aforementioned credit basis. The only resolution that I will accept for this inquiry is a disclosure of what percentage of applicants are being offered the optimal 3.5 % fixed APR. Earnest refused to disclose this information ; I will continue to escalate this through Congressional inquiries if that information is not released.

Hello, I received an email on XX/XX/2022 that stated my previous XXXX loans would be forgiven and or reimbursed. However, my challenge is that my loans were consolidated to a company called Earnest ( Now owned By XXXX ). So I am still paying these loans monthly. When I called both the Federal Student Aid and Earnest about this issue. No one would help me with a solution of getting this resolved. I provided proof of the original XXXX loan and proof of my continued payment toward these charges. Millions of people who suffered the hardship caused by XXXX more than likely consolidated these loans to bring the ridiculous monthly payments down. It is unfair to not apply these individuals under this forgiveness or not work on their cases to reimburse for such loans taken out. The original loan was started with XXXX and should be treated the same way from a forgiveness standpoint.

Attempted to refinance my daughter 's XXXX school loans ( which I co-signed for ) with Earnest into one loan to make it clearer & easier for her to pay back. Same total amount, similar interest rates, same payment amount. I am on XXXX due to XXXX caused by military service and 100 % of my income comes from the gov't ( VA and XXXX ). They went back a number of years somehow and pulled the lowest credit score they could find of XXXX from XX/XX/2022 ( which happened to be the month following a 2-week long XXXX vacation I took my XXXX kids on and I immediately paid off that following month ) and claimed they were concerned my score was too low and that I wouldn't be able to make payments if I got sick, injured, or became unemployed- which isn't even applicable to me. I believe this was willful discrimination because I am a XXXX veteran on public assistance.

I called during my application process to make sure that my individual situation would be okay in being approved for the loan. I got denied for a reason that does not even apply to me " income variability ''. They falsely denied me, did a hard credit inquiry, which they won't even reverse, and lied about the application and approval process. I received terrible customer support after trying to figure out what was going on because they did not even contact me with an email or phone call to go over my documents. I was approved for a refinancing of my existing student loans by Earnest , Inc. Upon signing the loan documents, I was informed that i needed to get a " 10 day payoff '' quote from my existing loan servicers, and that Earnest would hold the loan funds for 3 days, then send my existing loan servicers a check, which would take about 7 days to clear, thereby closing those loans. After several days, I was notified by Earnest that they were suddenly backlogged, and unable to disburse funds on this loan for 45-60 days. My worry is that they are out of cash. I am hoping that the CFPB can require Earnest to disclose their inability to fund loans in a timely manner to consumers BEFORE they enter into loan agreements. I am also concerned that Earnest may not be complying with the law and/or relevant regulations regarding capital requirements for lenders.

My complaint is with Earnest/XXXX who I recently refinanced my loans with. I was informed on XXXX ( Friday ) that my payment via autopay was rejected even though this is the same account that was used to receive a refinancing bonus. When I went to make a payment online, I was charged twice the amount. There is no option on their website to alter the scheduled payment amount, which I find to be preposterous. I was debited twice the amount from my account the following Monday. The website also stated that my autopayment discount would not be applied to my loans. As of XX/XX/14, I still have not received the second payment and I was informed by a customer service representative that their systems do not allow them to update autopayment accounts online. I refinanced a student loan with Earnest, with a payment amount of {$580.00} ( fixed rate ). The company deferred the loan, upon request until graduation. Upon graduation, I received a bill for {$590.00}. There had been no discussion of what the amount would be upon end of deferment. Ok, I understand this ; however, the following month my payment again increased. This time to over {$610.00}! I contacted the company and it took over three weeks to get this adjusted. They hadn't changed the end date after the grace period/deferment. I was told this was fixed and that my payment would be {$590.00} moving forward. I just received my statement and now it's {$590.00}. I want my payment and my account fixed! This should not be difficult. There are rules and regulations about billing correct payment amounts and this company is NOT meeting these.

I currently have a loan through " Figure XXXX '' and I am attempting to refinance through " Earnest. '' On XX/XX/XXXX, the dispersement was sent from Earnest to XXXX but was refunded for some reason. I have spoken to reps from each company multiple times and neither will take fault for the error. On XX/XX/XXXX, Earnest states they resent the payment to XXXX, but due to this not being an " Earnest error, '' I was charged interest for the days that Earnest did not have the money. This totals {$430.00} in interest that was accrued on my Earnest loan even though XXXX states they never received payment. There was no notice sent to me letting me know that they needed information from me about my enrollment. I had filed a deferment form with XXXX in XXXX of XXXX that was good for 36 months and was approved. There was no communication with me about them taking me off forbearance. Without notice they over drafted my bank account and took all the money I had in bank account which is use to get by week to week. Earnest ( www.earneset.com ) asked about monthly expenses, including rent. I do not pay rent ( my spouse pays all of the rent and since they do not consider spousal income, they should not consider spousal monthly expenses ). They refused to accept that I do not pay rent when considering my loan and offered me a higher interest rate than I should have qualified for based on my monthly expenses. Additionally, they refuse to consider assets and property when calculating interest rates. They are currently considering household debt and monthly expenses, but refuse to consider household income. Two years ago I refinanced my Student Loans with Earnest. Refinancing helped consolidate my loans and it gave me flexibility in repaying them. Initially everything was great and I was satisfied. More recently, Earnest has made changes to their website, repayment terms, and general way of doing business it seems. I imagine this has to do with Earnest being bought by XXXX. I applied to refinance my law school student loans. During the application process, I was asked if I was a lawful permanent resident ( " LPR '' ) or U.S. citizen, but the application did not specify that the company discriminates between types of LPRs. I have a loan with Earnest. In my account I have selected an option to reduce the amount of my minimum payment when I make additional payments. With that setting I have made twice monthly payments summing to the amount I owe. I've done this since XX/XX/2019. Recently I decided to take advantage of a small interest discount by enrolling in autopay. I was enrolled in autopay for only 3 days when I saw that my preference to have additional payments applied to my next payment was nullified by the autopay program. I refinanced my private and federal student loans through Earnest. I feel the company took advantage of me by knowing my expenses and monthly income and charging me a very high monthly rate. Right now the amount I am expected to pay is 30 % of my monthly income which is very hard for me to afford. Today XX/XX/18 customers of the student loan refinancing service, Earnest, received an email from the company outlining a new change to their dashboard. However in the smaller print of the email they revealed that they will no longer allow customers to pay their loans bi-monthly. It has been proven that paying loans bimonthly reduces the overall interest paid and can significantly reduce the life of the loan. Not allowing customers to make payments in this way is 1 ) not beneficial to the consumer and instead benefits the companys profits 2 ) limits the options customers have to make reasonable on-time payments. Paying bi-monthly or more often is a right consumers should have with their debt as it is more financially responsible and reduces the likelihood of loan default.

Back in XX/XX/2018 Earnest approved me for a {$50000.00} loan which was deposited as agreed upon and paid back in full within 2 months. Because of a system glitch, my student loan provider executed an unauthorized payment against my student loan a whole week prior to my scheduled auto payment. I was given higher interest rates due to my marital status and the company 's unwillingness to consider household income ( they only consider my " individual '' income which is discrimination considering that my spouse and I are ONE household and we make ONE income ). I requested that my new student loan lender, Earnest, apply the extra {$50.00} a month my employer pays on my behalf towards my principal balance, and I was told that the only way that could be done is if my employer sends it on the same date my payment is processed.
