XXXX XXXX XXXX, ( XXXX ) XXXX XXXX XXXX XXXX. XXXX XXXX, CO XXXX E*TRADE Bank XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX VA XXXX Please take notice as follows : 1. Authority : That this Notice of Dispute of Alleged Debt ( Notice of Dispute ) is sent to you pursuant to Title 15, United States Code Annotated ( U.S.C.A ) 1692 et seq, known as the Fair Debt Collection Practices Act ( FDCPA ), the legislative purpose of which is to protect consumers from abusive, deceptive, and unfair debt collection practices by debt collectors, including alleged E*TRADE Bank , ( XXXX ) XXXX XXXX XXXX, ( XXXX ), and XXXX XXXX, ( XXXX ) and its alter egos acting as a vehicle for FRAUD for these alleged creditors in this CIVIL THEFT ; 2. Your notice of default/debt collection letter dated : XX/XX/XXXX : That we have received on XX/XX/XXXX and read your debt collection letter referenced above, identifying yourself as Servicer and its agent and falsely stating the XXXX and XXXX as Debt Collector of the above-reference false creditor, wherein you allege that we have a debt obligation to the alleged creditor referenced above. 1 ) Your letter dated XX/XX/XXXX, falsely stated that, the above referenced mortgage account is delinquent ( your ltr. para 1 pg.1 ) Please note that the above referenced loan was rescinded, and your status was changed from secured to unsecured, and was discharged in Bankruptcy Cases. There is no default and you are forever barred to collect on a discharged loan. You are knowingly and intentionally falsifying and misleading, committing bankruptcy discharge violation, because Debts were discharged in Bankruptcy and there was permanent injunction of 524, which forever prevents XXXX, XXXX XXXX, and XXXX et al from collecting a discharged debt. 2 ) For your information we disputed this debt with XXXX, and XXXX asked for verification and validation of the alleged debt, via Certified Return Requested Mail Number XXXX for XXXX and Certified Return Requested Mail Number XXXX dated XX/XX/XXXX, received by XXXX and XXXX on XX/XX/XXXX, and on XX/XX/XXXX. In a letter dated XX/XX/XXXX XXXX informed and stated ; The Above reference mortgage account was discharged from the Chapter XXXX Bankruptcy, therefore there is no longer a debt for us to validate XXXX Letter dated XX/XX/XXXX XXXX ) XXXX letter of XX/XX/XXXX is in violation of Rescission and Bankruptcy Discharge. We are asking the Bankruptcy Court to act for these violations against XXXX, XXXX, XXXX and all others involved in this civil theft. 4 ) The subject loan was rescinded within 03 years with, XXXX XXXX XXXX a division of XXXX XXXX XXXX XXXX XXXX, ( XXXX XXXX XXXX ), XXXX Customer Service, ( XXXX ), the prior servicer and XXXX and later as a defense to foreclosure., XXXX XXXXXXXX XXXX XXXX XXXX and XXXX intentionally ignored our rescission notice and failed to act within 20 days window and by operation of law rescission was self-imposed and their status was reduced from secured to unsecured creditors. 5 ) The subject loan was unsecured and listed as in Bankruptcy cases and was discharged. 6 ) XXXX letter of XX/XX/XXXX is in violation of Rescission, Bankruptcy Discharge, and Bankruptcy laws. 7 ) XXXX, XXXX and XXXX failure to perform as requested showed bad faith and established the fact that XXXX XXXX and XXXX are using abusive, deceptive, false, and unfair collection tactics against us as a consumer. Furthermore, since XXXX, XXXX and XXXX remained silent to our request or were unable to verify and validate the debt as above, the legal concepts of estoppel by acquiescence and tacit admission came into play whereby the alleged debt was admitted invalid, a nullity, and unenforceable, and thereby repudiated in its entirety ab initio. 3. Purpose of this notice : That the purpose of this Notice of Dispute is to assert our rights in debt collection under FDCPA 1692 XXXX g ) ( b ) without delay and within thirty ( 30 ) days of our receipt of your aforesaid debt collection letter ; 4. Alleged debt disputed : That we hereby dispute the validity of the alleged debt in its entirety ; 5. Verified documentary evidence requested : That we hereby request you provide us with the following verified ( sworn to by affidavit ) documentary evidence in substantiation of the alleged debt claimed by the alleged creditor referenced in your debt collection letter cited above ; ( a ) Proof of authority : Please provide us with verified ( sworn to by affidavit ) proof of your authority to represent the alleged creditor in this instant matter ; ( b ) Real party in interest : Please verify who the real party in interest and or Person Entitled to Enforce, ( PETE ) is in this debt collection matter, because, XXXX XXXX XXXX and XXXX and XXXX sold this loan as unregistered and unregulated security, using leveraging, therefore neither XXXX XXXX XXXX and XXXX nor XXXX are owners of this DISCHARGED LOAN as stated above ; ( c ) Alleged original creditor. Please provide us with the name and address of the alleged original creditor if different from the alleged creditor identified in your above-mentioned debt collection letter, because, XXXX XXXX XXXX and XXXX and XXXX sold this loan as unregistered and unregulated security, using leveraging, therefore neither XXXX XXXX XXXX and XXXX nor XXXX are owners of this DISCHARGED LOAN as stated above ; ( d ) Alleged original agreement : Please provide us with a verified ( sworn to by affidavit ) copy, both front and back, of the alleged original agreement and any other alleged original instruments in their entirety, including the allonge, affixed to the original alleged agreement for endorsements. Said affidavit is to be sworn to be true, correct, complete, and not misleading, by a properly identified and authorized officer of the alleged creditor, who states that he or she has personal knowledge ( Federal Rules of Evidence [ FRE ] Rule 602 ) of the validity of said alleged original document ( s ). ( i ) Inspection of document ( s ). Please provide us with the date, time, and place convenient to ( CITY, STATE ), that we can personally inspect the above alleged original agreement, with bond/security with the investors name on it and any other alleged original instruments in their entirety relevant to the above alleged debt with our legal representative and the Court Reporter, and expenses for the said inspection must be remitted to us in advance ; ( ii ) Custodian of document ( s ). Please provide us with the name, title, and address of the natural person custodian of the alleged original agreement and of any other alleged original instruments. ( iii ) Address of physical location of document ( s ). Please provide us with the address of the physical location of the alleged original agreement and any other alleged original instruments if different from ( ii ) above. ( e ) Holder in due course. Please provide us with verified ( sworn to by affidavit ) evidence that the alleged creditor is the party in the instant matter, i.e., holder in due course, and has a perfected interest in the aforesaid alleged agreement and alleged debt ; ( f ) Proof of Value Given : Please provide us with verified ( sworn to by affidavit ) copies, both front and back, of all documents and records with respect to the aforesaid alleged agreement and alleged debt from the beginning, including but not limited to, any and all issued cancelled certified checks, cashiers checks, money equivalents or similar instruments, identified as or evidencing assets provided by the alleged creditor and/or the alleged original creditor to us and indorsed by us ; ( g ) Deposit slip and cancelled check : Please provide us with a verified ( sworn to by affidavit ) copy of the deposit slip for the deposit of my alleged agreement in its entirety by the alleged creditor associated with the above alleged account/file number, and a verified copy of the cancelled check issued by the alleged creditor as payor in payment for our alleged agreement in its entirety and any other alleged related instruments ; ( h ) Affidavit of debt & damages : Please provide us with an affidavit of debt and damages incurred, sworn to be true, correct, complete, and not misleading, by a properly identified and authorized officer of the alleged creditor, hereinafter affiant, upon his or her personal knowledge ( FRE Rule 602 ) stating : ( i ) That the alleged creditor is, indeed, the party and holder in due course and PETE of the aforesaid alleged original agreement in issue and has an enforceable perfected interest therein pursuant to law and in compliance with, or equivalent sections of the Commercial Code of Virginia State, because, XXXX XXXX XXXX and XXXX and XXXX sold this loan as unregistered and unregulated security, using leveraging, therefore neither XXXX XXXX XXXX and XXXX nor XXXX are owners of this DISCHARGED LOAN as stated above ; ( ii ) That the alleged creditor provided consideration to us, the alleged debtors, from the assets they had on hand before the alleged credit was made, and incurred a financial loss under the full and complete alleged original agreement and alleged debt, and state each and every loss that the alleged creditor has incurred to date under the alleged debt in issue ; and ( iii ) That affiant has personal knowledge ( FRE Rule 602 ) regarding the facts of the alleged debt and is the original custodian of the books of entry, or directly supervises said original custodian of the records. ( j ) Bookkeeping journal / account ledger entries : Please provide us with a verified ( sworn to by affidavit ) copy of the complete set of original bookkeeping journal / account ledger entries associated with our alleged agreement and alleged file/account number using Generally Accepted Accounting Principles, ( GAAP ) per 12 U.S.C. 1831n, showing all debits and credits and identifying the source ( s ) and amount of the credit funds/assets ; Note : The verifying affidavit of journal / account ledger bookkeeping entries, assets side and liability side of the ledgers, is to be completed by the original custodian of the books and records, sworn to be true, correct, complete, and not misleading. Further, said affidavit shall contain positive identification of the custodian, and state that he or she has personal knowledge ( FRE Rule 602 ) of said entries. ( k ) Assignment contract : Please provide us with verified ( sworn to by affidavit ) proof of an assignment contract in its entirety of the alleged original agreement and the alleged debt in issue from an alleged original creditor, as assignor, to the alleged creditor, as assignee ; ( l ) Proof of authority : Please provide us with a verified ( sworn to by affidavit ) copy of the contract XXXX and its alter ego XXXX has with the alleged original creditor which authorizes XXXX XXXX and XXXX to engage in collection activities on their behalf against the above alleged account, and naming you, ( XXXX ) as an authorized servicer/collection agent / claims adjuster, after the REMIC Trust was dissolved in XX/XX/XXXX due to major trigger event when XXXX and the Banks were bailed out through the Taxpayers money ; ( m ) Certification of authority : Please provide us with a verified ( sworn to by affidavit ) certificate of authority, authorizing your company XXXX and its alter ego Computershare to transact business in the state of Virginia and a photocopy of your State Department of Commerce and Insurance certificatXXXX XXXX and Malpractice Insurance Policy numbers etc. ; ( n ) Form XXXX : Please provide us with Department of the Treasury Form XXXX Custodian of Documents attached or associated with our alleged original agreement and /or the name and address of said custodian per ( b ) ( ii ) above ; ( o ) Form XXXX : Please provide us with Department of the Treasury Form XXXX Original Issue Discount, ( XXXX ) for each year the alleged creditor was holder in possession of the alleged original agreement ; ( p ) Vendor sales slips/vouchers : Please provide us with verified ( sworn to by affidavit ) copies of all original sales slips/vouchers from all alleged vendors covering all alleged transactions in the above referenced file/account from its inception to date. Note : This Notice of Dispute is not a request for confirmation that you have mere photocopies of alleged documents. We are requesting ONLY VERIFIED DOCUMENTARY EVIDENCE in validation of the alleged debt pursuant to the FDCPA. 6. Warning : That all your communications and omissions will be made a part of and incorporated into any litigation arising from this matter. 7. Time is of the essence ; reply deadline : That time is of the essence, therefore, we extend to you, RightWay, thirty ( 30 ) days from the date of your receipt of this Notice of Dispute to perform in compliance with verifying the alleged debt as requested above per FDCPA mandates. We will consider a reasonable extension of timeonly to produce verified documentsshould you need more than the thirty ( 30 ) days if you request it in writing to the address above. Your failure to perform as herein requested will show bad faith and will establish the fact that you are using abusive, deceptive, false, and unfair collection tactics against us as a consumer. Furthermore, if you remain silent to this request or are unable to verify the debt as above, the legal concepts of estoppel by acquiescence and tacit admission will come into play whereby the alleged debt will be admitted invalid, a nullity, and unenforceable, and thereby repudiated in its entirety ab initio. In the interim, you are prohibited from any contact with us, the undersigned, except in writing, and only regarding the matters herein expressed. All debt collection activity including litigation is to cease per FDCPA 1692g ( b ) the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt 8. Mandatory reply to undersigned : That all of the above demanded verified evidence, sworn to by a competent witness per FRE Rule 602, should be sent to us, the undersigned, as indicated at the address above within the above-mentioned thirty ( 30 ) days from your receipt of this Notice of Dispute. Please do not send any reply correspondence to us at any other mail location except as below : 9. We hereby object and dispute the alleged debt, because this is the violation of the rescission and Chapter 7 Bankruptcy Discharges, and you and your alleged client can not add any fee and or amount to that, discharged debt ; 10. Please ask your alleged client to provide the following accounting ledgers ; 1 ) Servicers REMITTANCE LEDGER, since inception ; 2 ) Master Servicers REMITTANCE LEDGER, since inception ; 3 ) Trustees REMITTANCE LEDGER, since inception ; 4 ) Distribution Report amount received through and entered in above ledgers ; 5 ) FASB-95, Cash Flow Statement : Please provide us with, FASB-95, Cash Flow Statement. We have an asset that you are holding of ours that you failed to give credit to us, where the alleged creditor has made a mistake, is that they are likely carrying our asset on liability ledger of balance from your accounts receivable. 6 ) We have already requested to you and your predecessors and are requesting again from you, your alter ego, to go and check the record, asset side ( receivable side ) and liability side ( accounts pay able ) of the accounting ledger. 7 ) On the corporate liability off balance sheet ledgers, there has been a setoff deposited there and while comparing both sets of books, you will see there is a setoff, which is a claim under civil rule 13, which we have timely invoked and are invoking again for the record for future use. 8 ) We signed the promissory note under UCC Article 3 and after securitization it comes under the Article 8 and you and your alleged client have failed to record a debt to us on their liability side of the ledger. 9 ) Your client being the alleged creditor, have waived their status as a creditor when they accepted our tender of payment under UCC 3-409 ( a ) & ( b ) and UCC 3-604 ( a ). 10 ) You and your alleged client did not adjust their accounting ledger to reflect settlement and closure of the accounts receivable side of the accounting ledger. All you and your alleged client have done is to keep the ledger separate and commit fraud upon fraud, in committing this civil theft. 11 ) We also request you XXXX, your alter ego XXXX, XXXX its owners, servants, employees and agents to go and see both accounts receivable and accounts payable and to do a setoff under FAS XXXX as the debt is extinguished from the books when we tendered the promissory note to you. Under Article 9 in commercial law everything becomes the cash proceeds. 12 ) We also request you to produce XXXX registration statement which will indicate that your alleged clients have sold the note and that is a transfer and your alleged client and or its agents are not the real party in interest. 13 ) The balance sheet, a XXXX, XXXX, and XXXX, have OMB numbers on them which will tell you that Factious entity including XXXX XXXX XXXX, XXXX, XXXX, have sold the note. ( These balance sheets are subject to disclosure under the privacy act, Title 5 USC 552 ( b ) ( 4 ). 14 ) Your alleged clients are required to file balance sheets, under USC 248 and 347 with the Federal Reserve Board. The balance sheets show the assets and liability that you have use in accounting. The liability would be the promissory note. It is liability because it is an asset to us. 15 ) We have decided why to carry the payables on the books if it has been abandoned. Why not write them off and sell them for more cash. Your alleged client and its agents are calling it an offset accounting, but in UCC it is called a recoupment. 16 ) We hereby do a defense in recoupment under UCC 3-305 and a claim under 3-306. 17 ) We have a possessory and property claim against the cash proceeds under the liability side of the ledger. 18 ) As per UCC 3-306, there can not be a holder in due course on the promissory note after your client has deposited it. 19 ) Your clients are doing an off-balance sheet entry. This means that your clients have taken our note after they sold it, instead of showing it on balance sheet they have moved over to some other entities balance sheet. It is no longer on the banks books and this is called off balance sheet bookkeeping. 20 ) You and your client are not showing the liability side of the ledger or the accounts payable because it has been moved over to someone elses balance sheet. 21 ) Now we are bringing in recoupment on behalf of the real party of interest which are us because we are the real creditor against the liability side of the account. 11. Abusive/Deceptive/Unfair and Deceptive Practices Neither XXXX nor the XXXX, the Servicers, did not comply with all federal and state requirements in connection with the servicing as stated above in paragraphs 1-10 above ; they violated rescission laws and Bankruptcy Discharge and repeatedly sent us notices/letters in violation of FDCPA illegal foreclosure when Deed of Trust, ( DOT ) ) was VOID due to rescission. They were involved in Unfair, Deceptive, or Abusive Acts or Practices, ( UDAAP ) in Collection of Consumer Debts, and failed to comply with any obligations they have under FDCPA, in addition to any obligations to refrain from UDAAPs.We have correctly requested to Consumer Financial Protection Bureau, ( Cfpb ) and requested to take action against, them, for this fraudulent debt, in violation of 15U.S.C. 1692e ( 2 ) ( A ), threatened to take an action that can not legally be taken or that it did not intend to take, in violation of 1692e ( 5 ), and used a false representation or deceptive means to collect or attempt to collect a debt, in violation of 1692e ( 10 ). Under Dodd-Frank Wall Street Reform and Consumer Protection Act ( Dodd-Frank Act ), XXXX XXXX XXXX XXXX, XXXX, XXXX and XXXX and its alter ego are legally required to refrain from committing, UDAAP. XXXX XXXX XXXX, XXXX, XXXX XXXX and XXXX and it alter egos UDAAPs caused significant financial injury to us as consumer, erode confidence, and undermine fair competition in financial marketplace. XXXX XXXX XXXX XXXX, XXXX, XXXX and XXXX and its alter ego under Dodd-Frank Act involved in collecting debt related to any consumer financial product or service are subject to prohibition against UDAAPs in the Dodd-Frank Act. See Dodd-Frank Act, 1002, 1031 & 1036 ( a ), codified at 12 U.S.C. 5481, 5531 & 5536 ( a ). It is prohibited for any person, to knowingly or recklessly provide substantial assistance to a covered person, XXXX XXXX XXXX, XXXX, XXXX XXXX and XXXX and its alter ego or service provider in violating section 1031 of the Dodd-Frank Act. See 1036 ( a ) ( 3 ), 12U.S.C. 5536 ( a ) ( 3 ). 12. Failure to Response/Acquiescence/Admission Please note that in the past we sent to your office and others our, NOTICE OF RESCISSION AS DEFENCE TO FPRECLOSURE PURSUANT TO 11. U.S.C 1635 ( i ) ( 2 ) and the XXXX XXXX XXXX, XXXX, XXXX, XXXX and XXXX and its alter ego without reading it, acknowledged our Rescission Notice and failed to take action required within 20 days as required by the Statue and rescission is self-imposed by operation of law. Your abusive, deceptive, and unfair debt collection practices by debt collectors ; we have already sent Dispute letter to other actors in this fraud and have not heard any response from them. Your failure to perform as herein requested have shown bad faith and established the fact that you are using abusive, deceptive, false, and unfair collection tactics against us as a consumer. The actual money trail representing the WHOLE accounting for every penny that went in and every penny that went out that related to each loan or was attributable to each loan for which there is no accounting in existence because if it existed it would need to be produced and if it was produced it would be discovered that two things are true ; ( a ) that the balance owed on the obligation of the homeowner had been paid down by resort to undisclosed funds created from the transaction between the borrower and the investor-lenders and ( b ) that far more money went into the system than went out, leaving the intermediaries richer and the investor-lenders and homeowners poorer. Your irregularities in the modification /short sale/ foreclosure process reflect deeper failures to document properly changes of ownership as mortgage loans were securitized, sold as unregistered and unregulated security using leveraging. XXXX, the servicer for the known securitizations participants do not have any authority to represent the alleged creditor, and could not represent them due to the obvious conflict of interest, to wit : the investor upon learning that a substantial amount of their advance of cash was pocketed by the intermediaries like XXXX XXXX XXXX, XXXX, XXXX and now is left with the mortgage whose nominal value is far below what was paid, and whose fair market value is far below the nominal value, would have potential substantial claims against the securitization participants XXXX XXXX XXXX , XXXX, XXXX for fraud, conversion, breach of contract, and other claims. Fraud upon investors in relevant to borrowers because it is additional evidence of an overall fraud and conversion scheme against us as homeowners, because it tends to show motive and intent in the fraud and conversion claims by the borrowers. Accordingly, we hereby rescinded said Mortgage Loan as a full and complete defense to your any illegal intent to illegally foreclose based on a VOID Instrument ( DOT XXXX on our promissory residence pursuant to 11 U.S.C 1635 ( i ) ( 2 ), when we are not in default. Through the Qualified Written Request, ( QWR ) and other Dispute, and Cease and Desist letters/Notices, we have requested accountings, ledgers and other information were not provided by the XXXX XXXX XXXX XXXX, XXXX and XXXX. See Supra pg.7 para 10. Please see also Bankruptcy Cases, 08-18049-RGM Dkt.19 pg.8 of 39 ; Case No. 13-14502-RGM Dkt.20 pgs. 7, 8 and 18 ; and case no.20-12093-KHK Dkt.7 pg.20, 30 and items,2.7, 2.36, 2,37 and 2.38. You are knowingly and intentionally falsifying and misleading, committing bankruptcy discharge violation, because Debts were discharged in Bankruptcy and there was permanent injunction of XXXX, which forever prevents XXXX, XXXX XXXX, and XXXX XXXX al from collecting a discharged debt. 13. XXXX XXXX XXXX XXXX, XXXX, XXXX ( previous servicer ) and XXXX ( current servicer ) did not comply with all federal and state requirements in connection with their servicing as stated above in paragraphs above. XXXX XXXX XXXX, XXXX, XXXX XXXX XXXX violated rescission laws, bankruptcy laws, bankruptcy discharge and repeatedly threatened to schedule for illegal foreclosure when Deed of Trust, ( DOT ) was VOID due rescission. Id XXXX XXXX XXXX, XXXX, XXXX XXXX XXXX were involved in Unfair, Deceptive, or Abusive Acts or Practices, ( UDAAP ) in Collection of Consumer Debts, and failed to comply with any obligations they have under FDCPA, in addition to any obligations to refrain from UDAAPs. 14. The claim that we ( originator and maker ) can make is set off because XXXX XXXX XXXX XXXX, XXXX XXXX XXXX has sold an unregistered note and can not be a holder in due course because they are taking it subject to administrative and commercial claims. They have created a mortgage purchase loan ( 16 CFR 433.1 ). This whole process is not about mortgage at all, because they have sold the note and received the funds and closed the account by assuming, they have repaid the originator ( us ) on the loan. If they have already repaid the originator ( us ) on the loan, the living man who signed the note, then the whole thing is closed. 15. We request XXXX XXXX XXXX, XXXX, XXXX XXXX XXXX to go and check both sets of books and to do the setoff as we are bringing the offsetting claim under the rules of procedure as they have waived their status as a creditor when they accepted our tender of payment under UCC 3-409 ( a ) & ( b ) and UCC 3-604 ( a ) and failed to adjust their accounting ledger to reflect settlement and closure of the accounts receivable side of the ledger. 16. XXXX XXXX XXXX, XXXX, XXXX XXXX XXXX are not applying the correct accounting entries under GAAP and GAAS and not giving the claim to us, as we have the processionary right in the instrument and its proceeds under section 3-306 of the UCC. 17. If XXXX XXXX XXXX, XXXX, XXXX XXXX XXXX, and their agents have valid authority from the creditor to proceed in this matter, please note that the subject loan has been rescinded, under TILA within three years and as a defense to foreclosure and alleged creditors status has been reduced from secured to unsecured creditor and discharged in chapter 7 bankruptcy. 18. Since you or your alleged creditor failed to dispute the rescission or take the requisite next steps within 20 days and rescission is self-imposed and you and your alleged creditor is in violation of TILA again. 19. Upon serving the notice of rescission, the TILA statute and Regulation Z states that by operation of the law, the security interest automatically becomes void and the debtor is relieved of any obligation to pay any finance or other charge ( 15 U.S.C. 1635 ( b ), Reg. Z 226.15 ( d ) ( 1 ), 226.23 ( d ) ( 1 ) ). 20. Our Notice of Rescission has reduced XXXX XXXX XXXX XXXX, XXXX XXXX XXXX and other alleged creditors, as unsecured creditors. The facts and circumstances that we filed a copy of the notice of rescission as a defense to foreclosure. Thus, since the security interest is automatically voided per TILA and Regulation Z upon rescission, the mortgage note is no longer secured, classified as unsecured and discharge in bankruptcy. 21. WE ASSUME SINCE THE 1099-C WAS ISSUED BY THE IRS, THAT THE OWNERS OF THE LOAN AT THAT TIME XXXX XXXX OR XXXX ETRADE BAND, THAT ALL PARTIES MUST HAVE BEEN AND SHOULD HAVE BEEN AWARE OF THIS CANCELLATION OF DEBT ISSUED BY THE XXXX XXXX , WERE USED AS A TAX WRITE OFF FOR THE BANK BUT WERE NOT PROPERLY, IF AT ALL, APPLIED TO OUR LOAN, BUT WERE REALIZED BY XXXX XXXX/ETRADE BANK AND THEN LATER BENEFITED FROM SELLING THE LOAN TO OTHER PARTIES. THEREFORE, THERE ARE TENS OF THOUSANDS OF DOLLARS OF CANCELLED DEBT THAT WERE NOT APPLIED BY XXXX OR XXXX TO OUR ACCOUNT AND IS THEREFORE MISSING FROM OUR ACCOUNT WHILE XXXX, WHO OWNED BOTH OUR 1ST MORTGAGE AND HELOC LOAN, HAVING COMMITTED GRAVE ORIGINATION ILLEGALITIES, DIVIDING AND SEPARATING WHAT ORIGINATED AS A SINGLE LOAN, WHEN CLOSING BOTH THESE NO DOC, INTEREST ONLY LOANS ON THE SAME DAY. XXXX SOLD OUR 1ST MORTGAGE IN XXXX OF XXXX. BUT AFTER THE 1ST MORTGAGE WAS SOLD, THE HELOC DISAPPEARED COMPLETELY, ONLY TO SUDDENLY RESURFACE IN LATE XXXX AFTER ALMOST 9 YEARS, EXCEPT FOR THE 1099-C CANCELLATION OF DEBT DOCUMENT THAT WE RECEIVED IN XXXX, 3 PLUS MONTHS AFTER XXXX SOLD OUR MORTGAGE, LEADING US TO BELIEVE THE 1099-C HAD BEEN PROPERLY APPLIED TO OUR HELOC WHICH COMPLETELY DISAPPEARED OFF THE RADAR AT THAT SAME TIME. XXXX STATED IN RECORDINGS TO ME, THAT THEY DISCHARGED OUR HELOC IN XXXX, WHEN THEY SOLD OUR 1ST MORTGAGE AT THAT SAME TIME, THEN SUBSEQUENTLY CANCELLED OUR HELOC, BURIED IT WITH NO COMMUNICATIONS TO US, SOLD OUR LOANS TO OTHER COMPANIES, THEN GOT IT BACK, DISCHARGED IT AGAIN DUE TO THE STATUTE OF LIMITATIONS IN XXXX OF XXXX, THEN SOLD THIS HELOC AGAIN, AFTER 2 DISCHARGES AND 1 CANCELLATION OF THE DEBT, THEN SOLD IT IN LATE XXXX, AND ALL THE WHILE HAVING NOT PROPERLY APPLIED THE CANCELLATION OF DEBT ISSUED BY 2 FEDERAL AGENCIES. AGAIN, I HAVE ALL THESE STATEMENTS RECORDED AND THEREFORE CAN BE TRANSCRIBED FOR YOU AND THE COURT. WE HAVE APPLIED FOR NUMEROUS LOANS OVER THE YEARS, SINCE XXXX WHEN WE RECEIVED THE 1099-C CANCELLATION OF DEBT AND THIS LOAN DID NOT SHOW UP ON OUR CREDIT REPORTS AND WAS NEVER MENTIONED AS EXISTING, DELINQUENT, DEFAULTED OR AS AN ISSUE OF ANY KIND IN THE LOAN APPLICATION PROCESS AND GRANTING OF THE LOANS. XXXX XXXX XXXX GRANTED US A HOME EQUITY LOAN RECENTLY BUT THOSE FUNDS SEEM TO HAVE BEEN FROZEN UPON THE FILING OF THIS FRAUDULENT FORECLOSURE COMPLAINT, THUS DAMAGING, HARMING AND LIMITING OUR ABILITY TO ACCESS THOSE FUNDS FOR NEEDED REPAIRS ON OUR HOME, AND CRIPPLED OUR FINANCIAL PLANNING IN PREPARING FOR OUR RETIREMENT WHICH WE BELIEVE CLEARLY CREATES DOCUMENTED LIABILITY FOR THOSE FILING THIS FRAUDULENT COMPLAINT AGAINST US AS WELL AS FOR OTHER 3RD PARTIES. This complaint is in response to the investigation closure, and the response from XXXX XXXX XXXX XXXX Compliance officer. The letter is as follows and the crux of the complaint the ( CFPB ) should review : Dear Sir, The deficient inquiry into the investigation of XXXX XXXX XXXX XXXX for unauthorized charges of {$550.00}, beginning with my written dispute form delivered by fax on XXXX/XXXX/XXXX and again XXXX/XXXX/XXXX to : ( XXXX ) XXXX, breach agreement performance as outlined in the Account Holders Agreement Duty of Care obligations and under XXXX XXXX XXXX Operating Regulations. ( Volume I General Rules, 7.4.D.3 Documentation Section 7.4.D.3.b and 7.4.D.3.c ) As indicated in writing and by phone on multiple occasions the above charges were unauthorized inclusive of over charges by account holder, a party to Account Holders Agreement. E*TRADEs Operations omits multiple communications by messaging and email, confusing two disputed transactions of {$190.00} and the later, {$550.00}. Further complications of the dispute communication arose from two transactions by the same merchant, XXXX XXXX, one for {$23.00} and the other, XXXX. Notwithstanding, per the statements contained in the compliance Directors letter dated, XXXX XXXX, XXXX by XXXX XXXX, states that Our records confirm that when you contacted E*TRADE to dispute the charge, you advised that you were overcharged by XXXX XXXX, not that the charge was unauthorized. contradicts all written, endorsed and faxed documentation. The position taken by E*TRADE Operations Management undermines the relationship and dispute process as defined in the Account Holders Agreement and is totally unsupported per all written documentation provided to E*TRADE Disputes Department as outlines in XXXX ( Regulation Section 7.4.D.3 ) Further, the agreement between account holder and E*TRADE Bank, a party to under E*TRADE Bankss Account Holder Agreement, failed to adequately protect and/or investigate authorization by account holder signature file or account holders check and/or deposit endorsements. E*TRADE Bank failures of its Duty of Care obligation compounded losses thru retaliatory account closures on XXXX XXXX, XXXX. Before all ( 3 ) account closures were decided by E*TRADE operations department, a request for documents used in support of XXXX decision to invalidate my claim was delivered on XXXX XXXX or XXXX, XXXX. The requested documents contained a listing for XXXX XXXX Retrieval Code, per VISA rules and regulation requirements of issuers of XXXX XXXX bearing the XXXX Logo dated, XXXX XXXX, XXXX, ( XXXX, Dispute Resolution Department, Case No. XXXX ) indicating E*TRADEs investigators predetermined retrieval code request was for merchant receipt copy only. Following my request for the documents all my accounts were closed and customer service statements naming me as acting in a fraudulent manner were posted to the E*TRADE messaging center. ( Retrieval Request Reason Code 28 : Transaction receipt copy bearing signature ) The documents used to determine E*TRADE Banks decision included a signed merchant receipt with someone other than the account holders signature. E*TRADE failed to investigate card holder authorization according the XXXX Rules ; 7.4.D.3.c. to account holder signatures until XXXX XXXX, XXXX by a sympatacthic customer service operator whom affirmed a mistake was made requiring an escalation of the claim and actions taken for account closures. Between XXXX XXXX, XXXX and XXXX XXXX, XXXX, E*TRADE customer service operators reviewed my accounts and made defamatory statements including account holder was engaged in Fraud, and was Abusing Accounts held at E*TRADE bank., XXXX failure to reasonably investigate the Authorized Charges per XXXX regulations, as cited, or abide by Account Holder Agreement for the doctrine of Duty of Care of the dispute and/or retrieval process and, retaliatory Account Closures has undermined the relationship of the Account Holder/Creditor Bank. Account Holders Arbitration requirements is unenforceable due to the Creditor Banks breach of the Account Holders Agreement which they are party to. My loan which was conceived as a XXXX XXXX Bank XXXX XXXX XXXX line of credit of {$70000.00}, with a rate of 9.5 % interest and placed me at great risk based upon complete disregard for my Tangible Net Benefit and ability to repay. At the time my loan was originated with XXXX, failed to protect my future financial interests and ultimately forced my loan into foreclosure as a result of ignoring basic underwriting guidelines as well as violations to The Real Estate Settlement Procedures Act ( RESPA ) which prohibits unfair lending practices. Furthermore, there has been unfounded and incomplete evidence provided by SLS surrounding that the above mentioned loans origination, chain of title and assignments are unclear. SEE EXHIBIT " A '' XXXX INCOMPLETE QWR RESPONSE Due to the XXXX, failed response to my issues, I 'm considering raising this matter in the Court as I feel it may be the proper venue for action under XXXX UXXXX XXXX, because XXXX or more of the Defendants maintains executive offices in or conducts business in the district relevant to where real estate is located in this concern. The interagency Statement on XXXX enumerates certain tactics that may indicate predatory lending. Nonprofit groups have also published widely accepted guidance on these kinds of practices that may constitute predatory lending. Predatory loans typically combine risky loan features, thereby placing the borrower at an excessive risk of default or foreclosure. For purposes of this Complaint, " Combined-Risk Loans '' are loans that meet the definition of high-cost loan under XXXX. XXXX, which is an extension of The Home Ownership and Equity Protection Act ( HOEPA ) and enacted in XXXX as an amendment to the Truth in Lending Act ( TILA ) to address abusive practices in refinancing and home-equity mortgage loans with high interest rates or high fees. Hello, Please reference Case No. XXXX XXXX XXXX. On Friday, XX/XX/XXXX, I received a scheduled phone call from an E Trade Banking operations technician, XXXX XXXX ( XXXX ) XXXX. This scheduled phone call was generated by multiple customer service calls concerning account restrictions, claims of fraud and account closure starting on XX/XX/XXXX. The customer service calls resulted in then escalated to investigative operations management concerning an unauthorized transaction at XXXX XXXX XXXX XXXX XXXX on XX/XX/XXXX. Before account review escalation procedure was implemented, the customer service rep. reviewed check endorsements deposits and determined a full investigation of my claim of Unauthorized transaction dispute was not done properly, and claim of fraud should be rescinded from the credit reporting accounts. E trade who filed a fraud report to XXXX XXXX and XXXX, restricted all existing accounts at this bank, whereby they would not allow any deposits or withdrawals because of an " Unauthorized Transaction Dispute '' at XXXX XXXX XXXX XXXX XXXX in the amount of {$550.00}. THE INVESTIGATION AND SCHEDULED PHONE CALL Before my account restrictions were implemented by E trade Bank, a written request for the documentation used to qualify E trade Banks refusal to provide refund and further investigate the claim of unauthorized transaction. The materials sent in response to my request were as follows, ( 1 ) Copy of Merchant Receipt with Signature, ( 2 ) Letter containing the merchant response affirming signature of acceptance of charges and ( 3 ) XXXX XXXX XXXX XXXX transaction details. After account restrictions and closure notices were received XXXX XXXX XXXX XXXX XXXX Management were sent a letter disputing the charges and copy of their own merchant receipt they provided, also I provided a copy of my signed Passport Photo. XXXX XXXX XXXX XXXX responded by refunding the charges and apologizing. E trade Bank representative, XXXX XXXX respond by investigation at to my whereabouts on the day in question of the charges, and why my dispute story changed from a partial dispute to a full dispute of the charges, it was unauthorized period ... ..per " XXXX Core Rules and XXXX Product and Service Rules '', and under " Card Acceptance Guildlines for XXXX Merchants ''. This is what the requirements of card providers and merchants whom accept the XXXX debit or credit cards. Furthermore her line of questioning was not about the the unauthorized transaction, nor the failure of her Banks ' dispute department to compare the signatures of the merchant receipt and check endorsements on file at e trade, but more of an investigatory process to cover their legal liability in the case of their Failure of Duty of care. The dispute resolution process, per the Account Holders Agreement should not have exceeded 90 days, and it did - ( XX/XX/XXXX, first fax dispute form sent, XX/XX/XXXX, dispute canceled because of none receipt of fax dispute, XX/XX/XXXX refiled fax dispute til XX/XX/XXXX account closure and fraud report submitted and accusation of fraudulent activity by account holder submitted to credit reporting agencies ). The scheduled call resulted in wasting three weeks of my time, they never rescinded the reporting of fraud, never mentioned the unauthorized transaction was a valid dispute, never follower Account Holders agreements, never followed the XXXX Guidelines for Card holder authorization or followed through with investigation on the dispute. I have made a formal complaint with XXXX and will follow with a civil action regarding the compulsive fraudulent nature of this bank and its culture of deceitful practice. I had been a former employee, then customer of E-Trade for many years. I had my E-trade checking account linked to my Pay Pal account. XX/XX/XXXX, there were several unauthorized charges in my Pay Pal account, which spilled over to the E-Trade account, since it was attached. I first contacted Pay Pal, and they went ahead and credited my account for the unauthorized charges. The problem is E-Trade Bank. Because there was n't enough money in the ET Bank account to cover the unauthorized charges, they charged me XXXX NSF ( insufficient fund fees ) in a matter of a few days, for {$25.00} each ... that 's {$450.00}!!!! I spoke with them several times, explaining that I did n't make these charges, but they refused to reverse any of the XXXX fees. I spoke with Pay Pal again, and they informed me that since these fees were charged by ET Bank, they would be the ones to reverse them. This makes sense. Pay Pal did their part ; they credited my account for those charges, and even provided me with XXXX letters to give to ET explaining that these charges were n't my fault. I ca n't begin to tell you the XXXX that ET Bank continues to put me through. I have spoken with many reps from there, most of whom are clueless as to what 's going on ( even though they are on an " XXXX '' team- XXXX ). I get different reps every time & have to rehash the story to them, they 've given me incorrect information on a regular basis, and they put notes under the incorrect account numbers so that other reps do n't see the notes. I have also sent many " secure messages '' to their Customer Service Dept. I 'm supposedly a " valued client '' but, again, nothing. They just refuse to credit my account for anything, and they wo n't even give me a reason. On top of that, around this time, they went ahead & closed all of my accounts. I had a checking & savings account, along with XXXX brokerage accounts ( for myself, kids, etc ). The problem was with the checking account ... why close my brokerage accounts???? Again, no answer. I have attached some of their messages, and, in XXXX, they say that I requested to close my account ... real swift. They hide behind the policy that they are n't required to give a reason, but it 's obvious that they do n't want to reimburse me. They are aware of every word in this complaint, including that under Regulation E, it 's against the law to charge NSF fees for unauthorized charges. I have spent a lot of time & energy on this for nothing. They continue to send me useless, generic messages that they need me to call in as they require further information. When I do call in, the rep does n't have any or ask me for any information. He just said that they wo n't agree to credit my account. Also, what more information do they need????? I have given you the facts, the letters, print-outs of the transaction history, etc ... ..what more do they want????!!!! Finally, they sent me a message stating that they will no longer address this issue via e-mail or phone call ; I had to send them a letter. I put together a very detailed letter and mailed it certified. I got a message that the incoming correspondence was received, but nothing else. I have given them over two months to do the right thing, but they simply refuse. At this point, I 'd like for everyone to know what a horrific " bank '' E-Trade Bank really is, and I still want that {$450.00} back.

These banks are the biggest banks of America and they supposed to comply with the Federal regulations to know their customers allowing these fraudsters to operate ; therefore, I believe they have insurance that shall cover this fraudulent activity. Also attempted to request withdrawal from XXXX working new site but stopped there because I believe I just will provide them with my account data and they will attempt to steal more from me. back in XX/XX/XXXX I tried to open a max rate checking account with e*Trade bank and received an error message that my SSN was invalid, so I called in a spoke with a rep. I confirmed that I previously had an account but it was closed. I was advised if the system was not allowing it to be done online to print and fax the application for a new account which I did. I submitted it and called to check on it later, this went on for about a month. I would call every couple of days to check on the status of the new account and was told it was in review, I was told send color copy of photo ID and SSN, which was done. I called few days later and told to submit again, this happened multiple times. Well almost one month later they finally opened the new account, they opened it up on XX/XX/XXXX which was exactly 3 days shy of being a month that this application for the new checking account had been in review but it was finally opened on XX/XX/XXXX. I called in to inquire about my debit card issuance and was told they sent card to my old address and when the new account was opened they did not update my to new address or update any of my contact numbers or info and still had all the old info. I would have assumed they would have updated everything since all my updated info was provided with the new application that they took a month to process, review and open. So the rep tells me they sent debit card to wrong address as they had my old address and had my new one as a mailing address but she would fix but I needed to send a written request along with a copy of my ID yet again, this was their fault not mine so I Did as they asked after complaining about it. The account was In review to even be opened for a month I would have thought this was already addressed since it took so long to even open. They resend debit card to me to correct address and the day after I activate card IM told my account in restricted. I call in and am told they again need another copy of my drivers license, SS Card and I explained all provided before and they say they cant see. So I upload info and call, to my surprise I'm told more info is needed yet again and a photo of myself holding my ID in the photo which I provide. I speak to supervisor who says they appreciate info being sent but need another photo, now they are holding my funds in the account and won't release even though they have verified the check deposited was valid by the bank who issued it. they have had the funds and check for weeks, if it was bad it would have surely been returned by now as its been three plus weeks, they accuse me of not being the person to open the account and are not returning funds in the account and send letter accusing someone of fraudulently opening account in my name and are not holding my Money and won't return it even though they closed my account a week and a Half ago, this is ridiculous and a joke.

Etrade Bank agressively marketed HELOC in XXXX. I replied and eventually signed loan documents for a HELOC on my primary residence. The line of credit was {$350000.00}. All payments were made thru the Etrade website, which was XXXX of their marketing tactics since the HELOCs were targeted for current Etrade customers. I already had a brokerage account, a XXXX IRA, a XXXX IRA, and a banking account. They sold me due to the fact that I could make payments/monitor the account online ... .all in XXXX place, with my XXXX user name, log in password, etc. I had excellent credit and was receiving many offers at the time. I went with Etrade for the convenience and because I knew Etrade to be reputable, responsible and had a well designed website and method for making payments, transferring money, etc. XXXX then took over the processing of the HELOC ; I was still able to use the website with the one username, password, and see all accounts in XXXX play. I did n't have any problems for the almost 7 years of making monthly payments thru their website. In XXXX XXXX, things changes drastically. I continued to make my payments the same way I had for years ; eventually I saw that my payment to XXXX had been put back into my checking account. I thought.. '' Well, that is strange.. '' However, by the time this had happened I had already made the next month 's usual payment in the same way I had for almost 7 years. Then, I get a threatening phone call from a company saying they were a debt collection agency, that they were taking legal action against me. I called the XXXX customer service number for Etrade and explained what happened. I was then told that a company called " XXXX '' was now " in charge '' of my loan. I said, " What does that mean? My loan is with you. '' He agent replied, " I do n't really know..I do n't really do HELOCS '' I said, " Okay, can you connect me with someone who DOES " do '' HELOCS '' He said, " Mamn..there is n't anyone. You have to call XXXX. '' I said, " Did XXXX buy the loan portfolio or are they just a servicer? '' He said, " They bought it. Well ... maybe they did n't ... '' I said, " Etrade is a reputable company. I 'm sure there must be somone who has been designated to oversee the transition for the customers. '' He said, " There is n't ''. I then called the corporate office, explained my situation to the person hired to funnel calls and she came me the name and number for an employee who would " know what to do ''. After more than 2 weeks of speaking with this person, my problem with XXXX continues.

This is to advise that etrade XXXX closed my accounts without any written or email notifications per their customer agreement. On XXXX XXXX while out of town i noticed i did not have access to my accounts. I called etrade bank and they advised two of my accounts were closed suddenly and the third was closed for everything except investment deposits. I asked why? they stated per their customer agreement they are able to close accounts down. I was questioned about all of my deposits which are all legitimate deposits into my account and the rep questioned why so many companies. I advised that I am a business owner. I have been discriminated against from this banking institution that i have been a customer of for the last 8 years. The rep kept insisting based on the customer agreement they had that choice. I advised per the agreement it also states they would give a customer a 30day notification and send letters to advise of the closing of any accounts and representative confirmed on many occasions during this call this was not done. I had to quickly change banks for direct deposits and withdrawals some of which I had coming in the same day they decided to close the account. They were also redlining the use of my card and account before this denying certain transactions and would not approve them when the funds were available in my account. They have in the last year done unfair trade practices as a banking institution, which has caused me a lot of havoc personally and in my business. They should not be allowed to no follow protocol or discriminate and in their agreement in print it states they will notify a customer and give a 30 day notification. During the time of the account closure there was not a negative balance, I have never carried a negative balance on any of the accounts more than 30 days. There was no fraud activities and although many deposits came in they were legitimate deposits. I asked the rep why was I being questioned what cause and she could not give a complete answer. Also the day before the accounts were suddenly closed I called in with a third party to verify a transaction and the rep asked for my security question with a third party on the line. When asked why this was done he had no answer. I advised when third parties are on the line basic information such as account number and name are only to be disclosed based on what I was told by ETrade. After this situation my account was closed.

I originally obtained this HELOC loan through E-TRADE mortgage back in XX/XX/XXXX because I had a huge hole in the front of my house due to water damage, so I was desperate. E-TRADE offered to help but I was skeptical because when I tried to tell them my income over the phone they would put me on hold then com back and say, " oh so you make XXXX a year, '' which was about XXXX more than I made but I went with whatever game they were playing cause I needed the money. In XX/XX/XXXX I filed for bankruptcy and all my debt was discharged accept the HELOC, it was reaffirmed. Now the only advantage for me to reaffirm that loan was to help rebuild my credit and by law the lender is required to report my payments to the credit bureau. They did not. I brought this to their attention several times but they continued to treat my loan like it was discharged. So fast forward to XX/XX/XXXXand E-TRADE raises my payment from {$260.00} a month to over {$900.00} on a {$82000.00} loan. I called them and told them there was no way I could pay that. It was way more that my 1st mortgage. I tried to get them to work with me but they were nothing but rude, so I quit paying. It was the only way to get them to work with me. 18 months later I found out they sent my HELOC to XXXX, a debt collector/loan servicer for discharged loans. I have tried to settle with them for a lesser amount a few times through refi but each time my financing fell through. XXXX had approved a settlement 18 months ago for {$35000.00} but once again financing fell through. I now have financing in place and offered them even more, {$37000.00}, but this time they said they want {$90000.00}. So here I am with a loan that they never reported any payments on in 9 years. This loan should not be tagged as a reaffirmed loan since it was never treated as such and I should not be accumulating overages and past due amounts over the bankruptcy amount of {$82000.00}. I would really like XXXX to honor their agreement that we had to settle at $ XXXX or for this loan to just go away. I tried to due the right thing and make my payments after bankruptcy and have not missed any payments on any of my loans accept this one. I really feel I was forced into a bad situation and ETRADE never followed the law on reporting. My wife and I file joint tax returns and refunds are issued to both of our names. Federal refund is deposited electronically to the account I specify in Tax Cut software. State of XXXX issues a check that I usually deposit to my account. We do that over a decade. There was never an issue with that. On XX/XX/XXXX I tried to deposit such check by phone to my account ( at E*Trade Bank ) but it was rejected as unreadable - that seldom but sometimes happens. I called them and they said I have to mail it in. But when they received the check, only then they said they could not deposit it to my account, because it was issued to both me AND my wife. This despite they deposited those checks for 15 years every XXXX without a single complaint, and despite me being their customer for even longer than that, and despite both me and my wife have accounts there linked on-line. They suggested that the check may be deposited to our brokerage account since that account is joint account in both of our names. However, a day had passed and I do not see the check deposited in either my checking account or our joint brokerage account. I got an email with the PDF form referring to the name change without explanation. I understood they want my wife to file the name change - because at that bank she still uses her maiden name, and on this refund check she already has my last name. But she did not change the name at marriage, and that change was therefore not recorded on the marriage certificate. She changed it at naturalization. And besides - I am with the form in XXXX, and she and her signature are in XXXX - maybe sometimes during the summer she will find the time to deal with that name change. But we need that check deposited or cashed yesterday, not sometimes in the future. Now their agent can not locate our physical check - she only sees the image of my rejected mobile phone deposit. Which leads me to believe that they were not completely honest with me when they told me the mobile deposit was rejected for readability. If they spoke up about the XXXX names issue, I might have handled the situation differently. But now they are in possession of our check and they are finding an excuse after an excuse for not depositing it, and finally they lost track of it. This is an outrage. They should be held liable for theft.

We took out a HELOC with E-Trade Bank several years ago. We were making monthly automatic payments from our Credit Union in XXXX for many years on that loan thru a loan servicing company hired by E-Trade Bank. The name of the Loan Servicer was XXXX XXXX XXXX. In XXXX 2015 XXXX XXXX XXXX was replaced by another loan servicing company hired by E-Trade. The replacement loan servicer is called XXXX. We made a monthly payment of {$1000.00} on the HELOC as usual to XXXX on XXXX XXXX, 2015, and we believe XXXX received this payment on XXXX XXXX, 2015. AFTER WE HAD ALREADY MADE THAT PAYMENT we received in the mail a notice from XXXX that all payments after XXXX XXXX, 2015, were supposed to go to XXXX rather than XXXX. Because we had not received adequate advance notice of this change, XXXX is now demanding the {$1000.00} payment we made on XXXX XXXX, 2015 to XXXX. We can not call XXXX at all as they refer all inquiries to XXXX, the new servicer. We wrote to XXXX on XXXX XXXX, 2015 demanding return of the {$1000.00} payment we sent to them on XXXX XXXX, 2015, so we can forward the XXXX 2015 payment to XXXX to bring their account current. XXXX stills says we have not made the XXXX 2015 payment to them because it went to XXXX. As of this date we have not gotten the refund from XXXX and we do not have an extra {$1000.00} laying around to sned a duplicate payment to XXXX while XXXX is illegally holding on to our {$1000.00} payment for XXXX 2015. We 've filed complaints with CFPB against both XXXX and XXXX. XXXX refuses to acknowledge they sent their notice of changed servicer RETROACTIVELY. CFPB wrote to us and said they do n't have enough info about XXXX. We already gave CFPB all the info we have about XXXX. This is the company E-Trade hired to service our HELOC. Since XXXX is probably bankrupt or being investigated for some federal fraud related to loan servicing and it seems XXXX swooped in to take this over for E-Trade ... NOW WE WANT TO FILE A COMPLAINT AGAINST E-TRADE BANK FOR NEGLIGENTLY HIRING THE DISHONEST AND CRIMINAL LOAN SERVICER CLC WHO WILL NOT RETURN OUR {$1000.00}!!! Dear Sir or Madam : In a late response to my earlier CFPB claim ( XXXX ), E*TRADE 's corrected their false statement of the existence of proprietary evidence to : " E*TRADE reviewed this matter further and confirmed that there were, in fact, no documents available to provide in response to your request. '' Over the phone, an E*TRADE associate admitted that while they had no direct evidence showing that these transactions were legitimate and could in fact be fraudulent, but they would still deny the claim. This is in direct violation of a Regulation E of the Electronics Funds Act. On top of that, the disclosure and decisioning period of my case was over 30 days from initial claim to decision. Requests for documentation relied upon E*TRADE to review my dispute were subsequently denied. E*Trades only defense in this whole manner is that I have " recently submitted a similar dispute ''. This is to imply that it is impossible for fraud to happen to me twice. In retaliation for filing the CFPB complaint and my persistence in following up with the CFPB case, E*TRADE closed my account on XXXX XXXX denying me access to a majority of my liquid assets during the long holiday weekend. This was a major inconvenience and resulted in several fees and missed payments. In summary, E*trade failed to provide documentation in a timely manner, has admitted in writing that there was no evidence used to deny my unauthorized transaction claim and thus violated Regulation E and in retaliation closed all my bank accounts. I request that that the CFPB subpoena all records related to this case including phone conversations, evidence used in decisioning, case management system notes, and emails. I would also like the CFPB to audit the E*TRADE 's Reg E processes and procedures and customers. There appears to be evidence of discrepancies between their implementation and the law. On XXXX/XXXX/2015 I received a refund check from the Pennsylvania treasury in the amount of {$2500.00} via regular mail. I attempted to deposit it into my joint check account with my wife using Etrade mobile application check deposit. Initially it went thru but later I noticed that the bank rejected it and charged me XXXX and upon calling the bank and asking why they told me that the check was considered 3rd party based upon my last name being first and first name being second. I was advised to just mail in the deposit with a deposit slip which I did. Etrade bank received the check on the XXXX/XXXX/2015 and I noticed that they did not deposit it, after calling, emailing and more calling I was advised that the check is still considered a third party because my last name is first and that due to new banking laws they can not deposit it. I was told to fax them a letter of instruction changing my name on the account and then they maybe could deposit my check. I provided a letter of instruction citing that my name is as it appears on the check with the last name being first. I was told that the check name needed to be changed in order to process it. I called Pennsylvania Treasury and was advised that this is something that they do not do and that all checks are issued with the last name first. I advised the bank of this and was told that there is nothing that they could do. Etrade bank also refuses to return my check citing they must hold it for 20 days before returning it. In the meantime Etrade bank is hitting with service fee 's in the amount of XXXX each and to date there are {$300.00} in fee 's that they hit me with because they refuse to deposit my check. I have also been charged XXXX for the rejection by the mobile application. I do not have access to my funds and Etrade refuses to return the check.

On XX/XX/XXXX I purchased a condominium that had been foreclosed on by the homeowners association on XX/XX/XXXX. On XX/XX/XXXX E Trade Bank instructed XXXX XXXX company to record a full reconveyance of a prior owners loan against the home ( That prior owner had not owned the home since the foreclosure on XX/XX/XXXX ). The reconveyance indicated that the mortgage company had no interest in the property. In XXXX after I purchased the property and cleared all tax liens and repaired the property to live in it {$60000.00} the mortgage company filed a rescission of the reconveyance stating on that document that an error had been made and they did not intend to release the prior owners mortgage. I filed a dispute with E-Trade and XXXX to which I received the reply that the prior owner from XX/XX/XXXX called and stated that he was a victim of identity theft so the reconveyance should n't have been completed. ( This is no explanation for why they would do this ) I am filing a complaint because I relied on the clear title at the time of purchase that I have record of and I believe the mortgage company released interest in the property due to many liens against the unit and its poor condition. They enticed me to invest in the property by recording the lien was not in place. As soon as they found that I had purchased and improved the value of the property and paid all the liens off. They then reapplied their lien. This is simple and plain fraud on the part of the loan company and the XXXX company they are attempting to call a " mistake ''. However their Vice president and XXXX had to go before a notary and record a deed in this error so I believe it is intentional. I put nearly all of my savings into this home and I ca n't reside there or sell it now.

I have had a checking account at E*Trade Bank since XX/XX/XXXX. On XX/XX/XXXX I opened a new money market account at E*Trade Bank and on XX/XX/XXXX I opened a second new money market account at this Bank. On XX/XX/XXXX, I sent a certified letter to E*Trade Bank to opt-out of the mandatory arbitration clause following the instuctions contained in the Banks account agreement, which as mailed to me with the new accounts signature card. The Banks acccount agreement states opt-out of arbitration is permitted if requested within 60 days. The US Postal Service confirmed the certified letter was delivered to the Bank on XX/XX/XXXX. On XX/XX/XXXX ( 5 business days latter ), E*Trade Bank informed me they would no longer be doing business with me, were placing me on their no further business list, and I had 30 days to remove funds from my accounts. I sent E*Trade Bank a complaint letter via their online submission system on XX/XX/XXXX and I received a call back on XX/XX/XXXX in which a representative of the bank verbally confirmed that my account was being closed because they viewed me as a business risk since I was requesting to opt-out. I offered to rescind my opt-out if the Bank would allow me to keep my checking account with them open. On XX/XX/XXXX, with all my account balances at XXXX, the Bank closed my checking account without my permission and locked me out of their online website to view statements and account information. What is the point of arbitration opt-out if E*Trade Bank closes my account? That isnt an opt-out if they close your accounts because you opt-out.

I opened multiple accounts with ETRADE back in 2020 ; savings account, and accounts to trade stocks. Thursday XX/XX/XXXX I requested funds to be transferred out of my account and into a bank account I provided ETRADE the information for the wire. This transaction has yet to take place. I was told the account will be under review for 24 hours and would be released after that. At this point, 12 days later, all of my accounts and funds are not accessible. It has been requested of me by ETRADE to provide identification, a letter of intent and various questions be answered so they will release my funds. These requests have been completed multiple times, multiple representatives in the account activation department have been talked with, XXXX. Every time we talk I provide what they ask and I am told they will call me back. I have requested to be transferred to a manager or a person that can resolve the matter. Every time I get the same answer, there is no one they can forward me to, the account is in the back office for review, they have all the information they need and will call me back to resolve the matter. At this point I am unable to even log into any of my accounts, I can not see what is being done with any of my money, I am unable to trade any positions of stocks I hold. Upn not being able to transfer funds either by ACH (check) or Direct Deposit i phoned customer service. My name is XXXX XXXX and I opened a bank account with ETrade around XXXX of last year when I turned XXXX. I did this because my mom said she wanted me to start investing early. I am in school to become an animator and illustrator and do a lot of social media content management and graphic work for companies. I deposited my 2 payroll paychecks after I opened my account with E Trade, even after a two week hold on my account E Trade refused to release my funds and then proceeded to close my account with no reason why, no letter, and no call back when I called them to ask why they are doing this. I asked them where is the written policy for how they are handling me. They literally have never called back or sent my funds to me. This is Theft and XXXX. I am a college kid and need all the money I make. The total amount was XXXX ( It was my two paychecks..each XXXX ) I feel that it is unfair for them to hold my money for no reason for this long. My mom would have helped me invest it to make more money and now I have missed out on that opportunity. *** I have had a freeze on all three credit reporting agencies for just over one year XXXX On or about XX/XX/2021, I received a packet in the mail from E*Trade in a solid green plastic envelope. Out of curiosity I opened the packet to find checks, deposit slips, check register, and check book cover. My full name and address were on the checks/deposit slips. I DID NOT REQUEST A CHECKING ACCOUNT FROM E*TRADE! I called E*Trade using a phone number I found on their website and explained the above. He asked for my name and account number - which I gave him. He then asked for my social security number - I gave him no other personal identifying information. The representative offered no information as to how or who created the account. He said he would immediately close the account ; they would research the creation of the account ; and send me a letter with their findings. I received a letter from E*Trade on XX/XX/2021. This letter shows the last 4 digits of the account, and is addressed in my first and last name and current address. The letter states, " E*Trade Bank has decided to exercise its discretion to close the above referenced account. '' NO EXPLANATION OF ANY KIND. The final paragraph states if I did not recently open an account at E*Trade to consider several of eight different options ; i.e. complete a notarized affidavit of identify theft at ftc.gov ; file a police report ; etc.

Had a Home Equity Loans through XXXX, on XXXX, recorded with the XXXX County Register of Deeds under Liber 3075, Page 904 that was transferred to E*Trade Bank under account number XXXX. I paid this loan off with check number XXXX on XX/XX/XXXX ( see attached copies ). To Date, this loan was never sent to the XXXX County Register of Deeds as being paid off. I have been trying to get this information recorded since XXXX and continually am being told it was transferred to XXXX XXXX. It was not as I have the documentation showing I paid it off. There was a different XXXX Home Equity Loan that had gone to XXXX XXXX and was recorded as released to the XXXX County Register of Deeds. I have contacted E*Trade about this problem and was told that it was sold to XXXX XXXX XXXX again ... it was not or I wouldn't have the documentation showing my check information and subsequent bills from E*Trade Bank showing my balance is " XXXX '', not that it was transferred to anyone else. I am submitting copies of my documentation showing I was the one that paid it off through E*Trade Bank on XX/XX/XXXX. The response they sent me in XX/XX/XXXX is for a different Liber and Page number for a different loan, not the one under Liber 3075 Page 904 that still shows outstanding. On XXXX XXXX, 2016 I issued an electronic payment from my E*Trade checking account in the amount of {$2700.00} to XXXX XXXX by mistake. This payment was delivered to XXXX on XXXX XXXX, 2016. E*Trade confirmed this was delivered to XXXX. I am attempting to have it refunded. I have spent hours on the phone talking with XXXX service agents and the results have been a complete dead end. My account with XXXX is no longer active. It was discontinued at least 8 years ago but I failed to remove XXXX from my payee list. They could find no record of my old account no. XXXX. They could find no record of my name. They could find no record of my old phone no. ( XXXX ) under XXXX. They apparently have no idea of where to look for this payment or who to refer me to for help. The various departments I talked to did consult their supervisors and they were no help either. This payment was labeled with my old account no. and my name. As the XXXX XXXX XXXX, I reached out to eTrade to set up a business bank account, along with an initial deposit and IRS EIN. I received a letter saying that the account was approved and open, along with instructions for accessing the account. When I tried to do so on XX/XX/XXXX, however, I received errors from their Web site. Upon calling in, I was told that eTrade has chosen not to do business with my team ( my existing personal accounts were not affected ), no explanation would be given, and that I would have my money refunded within 7-10 days. Today, on XX/XX/XXXX, I received a call saying that I would have to submit a letter from my XXXX and proof of identity in order to get my initial deposit back, despite that deposit being transferred from my personal eTrade account. It is bad enough to opt to close my account days after it was initially opened. It is worse to opt not to provide any explanation. But it is ( or should be ) downright criminal to then hold my funds for well over a month while waiting to supply me with instructions on how to receive my money. I am in the process of supplying eTrade with the requested documentation, but I 've been given no ETA on the refund of my initial deposit. I will be looking at alternatives for my personal and business banking and trading needs and suggest others do the same.

I am a victim of identity theft. On XX/XX/2021, I received in the mail a new debit Mastercard for a new checking account at E-Trade Bank that I did NOT open. I immediately called E-Trade, waited 30 minutes on hold, and the rep told me that the account was " restricted '' and that he couldn't close it but it would 'eventually ' be closed. I asked that the fraud dept ( which was not avail on a Saturday apparently XXXX contact me. By XX/XX/2021, I still had not heard anything, so I called again. The rep again told me that the account was 'restricted '. She tried to close it for me but was not allowed to close the account. She stated that the 'restricted ' account could be opened if identifying documents were faxed in. I told her that since the fraudsters have all of my information, they could easily make and fax in false documents. She offered to transfer me to the fraud department but noted that their wait time on hold was 47 minutes. She said she would put my information in the queue and someone from Fraud would call me that day or the next day. No one ever called. I also submitted a request via email ( XXXX ) and received no reply. I want this account closed. I do not want to sit on hold with ETrade anymore. I want them too have easier access for consumers to the fraud department.

E*Trade Bank Issue - Complaint - I have both banking and brokerage accounts with E*Trade Bank and there is no way to get in touch with them for a Customer Service issue. They do not staff the customer service numbers with automated or live persons. The issue- My account has been restricted because of suspicious activity, which is helpful to protect my account, despite the fact I initiated and authorized the XXXX XXXX transfer from my banking account. I received messages that I have to call them to discuss the issue and un-restrict my accounts and I can not get a person to answer the customer service phone numbers. I've tried every number available from my cell and land lines. I've been on hold for over 7 hours over the course of two days. There is no live chat available, despite it being offered as a link, no we'll call you back option, and no email address available to contact them. How can this be when banking access and brokerage access is critical to modern life. I would like to close my five accounts due to this horrible non-responsive non-existent customer service but I am unable to reach a person for access to my funds and accounts. All the while E*Trade is completing a merger and providing egregious bonuses to their Corporate level executives. Please help? Thanks.

ETRADE BANK I have had a 5 year CD ( earning less than {$2.00} a year ) that I have been trying to close for 15 years. Each time they never respond until the 7 day grace period is over and then insist on such a hefty fee, I have just left it. This year I was determined to close it on it's maturity date of XX/XX/2022. I spoke in XXXX to a helpful customer service person who instructed me on the form I was supposed to complete and upload. I did that on XX/XX/XXXX. The file said 'in progress ' for weeks and finally a few days before maturity, I waited 47 minutes online in the middle of the night to get through to customer service. I talked to a helpful woman named XXXX XXXX who informed me they were waiting for me to upload my ID. No one had told me this, though it had been sitting 'in progress ' for a month. I uploaded my ID. Three days after maturity, still nothing. I waited now 88 minutes on hold and talked to another helpful customer service person named XXXX XXXX supposedly brought it to one of his superiors who said it would be paid out within 5 business days after maturity. It has now been nine days since maturity and there is no movement whatsoever on the account. Please check the complaints on their XXXX book for similar issues.

I want to preface this complaint with the fact that I have, up until this point, had no issues with either my Etrade account services nor any customer service issues. I had initiated an online ACH transfer from my Etrade checking account on XX/XX/XXXX to fund a new account opening at another bank. There were issues at the other bank, so the account closure set off a string of poor customer service experiences related to the retrieval of the original ACH transfer at both banks. In addition to numerous customer service email requests and phone calls, the funds have still not been credited back to my account. The fact that an unknowledgeable customer service representative indicated that the funds will be credited within 1-2 days over a week ago, and the bank is now backpedaling regarding the need for dispute documents makes me just as suspicious of where my money currently is as I am with the new bank. When they told me today that this simple credit of the funds back to my account will take 90 days, I couldn't help but have to file this complaint for incorrect information provided by the initial customer service representative and the fact that a legitimate transaction would take 90 days to resolve.

ETRADE Bank owns my second mortgage.This was discharged in Bankruptcy in XXXX and from XXXX to XXXX it was protected by the injunction in Bankruptcy.ETRADE has been illegally trying to collect the debt through its servicers of XXXX XXXX.Other illegal collection efforts had been orchestrated by XXXX and XXXX all trying to collect a debt owned by ETRADE and discharged in Bankruptcy. I complained to the current servicer XXXX XXXX XXXX ( XXXX ) and they said its not their fault or responsibility.ETRADE sends it back to XXXX as the servicer so its a circle where the owner of the debt can have a servicer make illegal efforts to collect the debt and when caught, change servicers and say they are not responsible.ETRADE should be held accountable and according to the CFPB compliance bulletin on mortgage servicing transfers they are.I am including some of the illegal written efforts to collect debt discharged in bankruptcy along with evidence of ownership of the debt and letters from XXXX and to ETRADE Bank.ETRADE is trying to absolve itself of responsibility and should be held accountable, otherwise they will continue this practice of illegal debt collection while switching servicers.

ETRADE : Opened Account on the XX/XX/2018 Deposited Check for {$1100.00} via edoposit on the same date. Called to verify receipt. Agent advised a 10 business day hold which was not what their website advised ( 3 business day hold ) Advised to cancel deposit and account, they hung up on me. Called back, was given to a Supervisor who would not repeat his name after I verified my information and he reviewed my account. Advised ETRADE closed my account and I would receive a letter in 7-10 business days. Received letter today ( XX/XX/2018 ) stating the closure of my checking, savings and investment account but nothing about the money I deposited and they are holding. Tried to call but no one knew what was going on and that someone would call me back later. Bottom line : I opened accounts. deposited money. They cashed the check. they have the money. I opened a CD account with ETrade Bank on XX/XX/XXXX in the amount of {$1000.00}. I made no further deposits after that date. When I recently checked on the status of the account by phone with ETrade bank they told me they have no record of the account. I have the actual CD in my possession. It shows Account Number # XXXX with a annual renewal term and Interest to be paid Quarterly to the Account balance. After speaking to ETrade and getting nowhere I did some research and found that ETrade had sold their CD accounts to XXXX XXXX on XX/XX/XXXX and that all funds would be transferred to XXXX XXXX beginning XX/XX/XXXX. I contacted XXXX XXXX and they confirmed that ETrade accounts were purchased but when I asked them to research my account they were not able to find it. This account should be worth {$1700.00}. On XX/XX/2021, I requested to have a recent checking account closed. ETrades customer service representative provide incorrect procedures and processes regarding their checking account product. From day one, there has been one issue after another and resolving the issue is like pulling teeth. The representative repeat the issue several times without any coherent resolution. On XX/XX/2021, I received an email stating they could not close my account because of a negative balance of {$510000.00}. This is to cause further issue with closing the account. Although theres never been over XXXX in that checking opened 2-3 weeks prior, I reviewed the account to see there had been any identity theft on the account. On XX/XX/2018 I requested information from my bank, E*Trade Bank , regarding a wire transfer from a XXXX company as part of a travel reimbursement for US {$1200.00}. Using their chat function online the agent provided me wire transfer instructions ( transcript attached ). After waiting approximately 2 weeks without receiving the funds I contacted E*Trade and was told that their agent had given me the wrong information for the transfer and that there was nothing they could do. I then contacted the vendor in XXXX. Their bank, XXXX XXXX XXXX XXXX, indicated that the wire transfer had been accepted by XXXX XXXX, the bank that acts as intermediary for E*Trade on wire transfers. The vendor eventually had their bank run a trace on the transfer but evidently XXXX XXXX would not respond ( information attached ). My vendor had XXXX XXXX XXXX XXXX run the trace a second time with the same result. All of this back and forth has taken several months. Customer Service informed me account was never closed, and this was an error. Account would remain open if requested. I did so request account to remain open. There is a 2nd Trust Deed that should have been expunged or otherwise eliminated from my Property Lien history a long time ago. It shoes up on my Preliminary Title Report ( Attached ) and is complicating things for me to be able to get a new refinance loan.

My ex husband and i took out a open end loan with Etade ( XXXX ) XX/XX/XXXX. the loan was for {$60000.00}. Hello, I am an online checking account customer with E*TRADE ( now owned by XXXX XXXX ) . Unfortunately, it is essentially impossible to contact E*TRADE to manage account requests, such as getting new paper checks. I have been trying to get paper checks from E*TRADE since XX/XX/2021 and have been unsuccessful. E*TRADE has no physical locations, so it is only possible to contact the company ( i ) by electronic message or - if I need immediate assistance -- ( ii ) by telephone. ( E*TRADE purports to have a " chat function '' but it has not worked for months. ) Unfortunately for those who need immediate assistance, there is essentially no way to contract E*TRADE because telephone wait times can be 90 minutes. I have a baby son and am unable to wait on hold that long to obtain service. This customer ( XXXX ) purchased a coaching program from my company. We spent 6 weeks on coaching calls, delivered multiple worksheets, and performed work on their behalf. They purchased with agreement to our terms of service that we do not issue refunds after 30 days. The 30 days had passed and the customer did a chargeback on my XXXX account. XXXX did an ACH overdraft on my bank account making it go negative and my bank. It is my understanding that banks are required by law to give IMMEDIATE CREDIT for direct deposits from the Federal Government -- in this case " Civil Service Retirement. '' IF MY UNDERSTANDING OF THE LAW IS INCORRECT PLEASE ADVISE. The bank failed to pay three checks at XXXX XXXX XX/XX/2021 as NSF while waiting to post the Federal Government 's direct deposit of $ 5,000+ until XXXX XX/XX/2021. I have been waiting for ETrade to return my {$100.00} checking account balance for XXXX XXXX months since requested ( 5 months after I closed the account ). I opened an account with ETrade in XXXX 2015. After a few weeks of 'please resend this or that document ' and them losing the documents, I closed my accounts ( checking, brokerage, ira, etc. ). On XXXX/XXXX/2016 someone made a few online purchases ( {$400.00} ) using my Etrade debit VISA card fraudulently. I called Etrade to report it and since then I have been trying to get reimbursed for my funds without success. I have been a customer of Etrade Bank for close to 11 years. I had a few charges from XXXX on my ATM and Etrade put a block on my checking account. I called them to let them know that I made those charges and that they were not fraudulent after I received an email that my account had been blocked. ETrade bank alerted me to ( XXXX ) fraudulent purchase transactions on my debit card before they posted to my checking account. The next day they posted to my account deducting the funds because they claim they are powerless to stop them from posting. On XXXX/XXXX/15 my atm card was lost/stolen in downtown XXXX. Later that night {$1000.00} was taken from my account in several large ATM withdrawals, which were not authorized by me. The next morning I was informed by card security that there might be fraud on my account and proceeded to cancel my card. E*Trade gave someone the login information and password to my account. After changing my username and password to prevent this in the future I asked that they close my three checking accounts and open new ones for me. After calling and emailing them for two months this has yet to be completed. Also, after several requests they have not sent me copies of my bank statements. I originally received an insufficient funds notice from E*Trade and I do not have an account with them. I then pulled a XX/XX/XXXX consumer file and indeed had an inquiry from E*trade on there. I called E*Trade and they advised me that I do not have an account and that nothing exists.
