On approx. XX/XX/XXXX. I reached out to E Mortgage Capital for a quote. I received a quote and went back an forth with a gentleman names XXXX. There was some misunderstanding on his end and I ended up reaching out to his supervisor. His supervisor who's name is " XXXX - XXXX # XXXX, # XXXX " took over the request. After going back and forth with XXXX, we finally came to an agreement and signed documents moving forward. I was very responsive and quick on any requests XXXX and his team made to make my loan process go as smooth as possible. I had little communication from him, no calls back when he did inform me he would call me back. Many of the times I did call him, I was joined in on a three way call with another one of his clients. I hung up multiple times therefore I was not hearing personal information from another client. This happened on multiple occasions. I signed closing documents on XX/XX/XXXX. This quickly changed. They stated that my documents were not going through due to some other issues with XXXX XXXX This included a credit dispute that was on my acct. I ran around in circles to get it resolved. After over a week going to my bank, calling the XXXX number to get things taken care of. I was assured by XXXX and his team that this would get my loan pushed through with no other changes. Note, this is well after me signing my CLOSING documents. After getting this taken off. My credit then was XXXX points higher than previous. I was then informed by XXXX that my loan does not qualify and I would need to come up with 5 percent down instead of the 3 percent that I signed for. He ended up working up the loan multiple different ways and informed me he would be waiving all fees for his underwriting to get this done. After going around and around, I supplied him with documents supporting more income from my kids ( survival benefits ). This ended up getting the loan pushed and authorized. He at the end did not waive his fee as he stated and still charged me. XXXX had made multiple comments about how much he makes, how much I am " Winning '' by getting house and that it would pay off. He ended up also stating that a lot of other " lenders '' would of dropped me and moved on due to bigger deals out there and that my deal was " minor ''. I am absolutely infuriated by how I was told multiple times the loan terms and agreements, got all the way up to my closing date and the loan terms then changed ( after closing documents were signed ). My closing date was missed. I had to come up with over XXXX more than what I was originally quoted and signed for. I am more than happy to speak to someone regarding this in more detail.

On XXXX XXXX ( XXXX XXXX XXXX made an offer on a home at XXXX XXXX XXXX XXXXXXXX XXXX XXXXXXXX, I also stated to the lender XXXX XXXX XXXX Mortgage that I would need down payment assistance. The offered-up XXXX XXXX had a program for me. Through the course of the Loan Process i have asked XXXX XXXX on his recorded line do I need to get closing costs, XXXX stated that Fannie Mae would take care of all closing cost. I believe I have had XXXX different mortgage companies over the past XXXX weeks. I pulled my XXXX money to pay for the Appraisal, Home inspection, and XXXX money, I borrowed XXXX from my parents and when I received XXXX monies i returned the XXXX back to my parents. My original date to close was XXXX, but due to a form not being filed it was pushed to XXXX no explanation given. During this whole process i continued to ask XXXX if I were going to need any monies for closing, he assured me I would not. On XXXX XXXX XXXX from XXXX XXXX emailed me and stated i would need XXXX for closing costs, and XXXX in reserve and show proof of how monies were obtained, before closing on XXXX. I have emails between myself and XXXX locking me into a XXXX XXXX XXXX, XXXX XXXX he has me Locked in at XXXX XXXX. I have documents showing i signed a XXXX XXXX loan estimate. I also have the XXXX XXXX estimate unsigned document. XXXX stated in an email that i am now at XXXX XXXX he needs to provide that documentation. Over the course of the XXXX weeks i have watched my loan payment grow by almost {$600.00}. i was instructed to take a XXXX XXXX course in the course there is a XXXX calculator after doing it XXXX XXXX said i was only eligible for XXXX dollars, my purchase price for this home is XXXX. I can not come up with the XXXX closing cost, and the XXXX in reserve in a three-day period. an in accordance with XXXX XXXX I should not even be buying this property. I have been given misleading information this whole process, i have emails and correspondence to back up my claim, XXXX uses a recorded line when you call his office.

In XXXX, I was cold called by E Mortgage Capital to apply for a home refinance. Due to a professional mistake, I was put on the XXXX XXXX XXXX XXXX which, to my incredulity, did not allow me to obtain a personal mortgage ( that must be changed ; has nothing to do with a professional mistake!! ). I let them know that XXXX XXXX allowed a lender/servicer to apply for a XXXX XXXX to allow me to obtain the refinance. They declined to do that. In XXXX XXXX, I was called by E Mortgage Capital again, same person! I reminded them about the XXXX XXXX problem and he insisted that there was a program to BYPASS XXXX XXXX! I asked how? He insisted they could bypass XXXX XXXX. Summarizing the next XXXX months : I applied ; I gave them every doc they asked for ; Since I was semi-retired and did not have enough income, he asked XXXX TIMES for IRA distributions as each time it was not enough?? Totally unprofessional, should have known XXXX amount for XXXX distribution! That took months!!! Along the way, he apologized for the length of the application. I answered that they were the only game in town for me as it bypassed XXXX XXXX. I kept asking, again and again, how did he do it? I was thankful but could not believe it! Finally as the loan was ready to close, I was told XXXX XXXX XXXX found out I was on the Exclusionary List and I was out of luck. I replied, Are you kidding me, you knew about this from the start and you assured me of bypassing XXXX XXXX! Why did you lead me on for XXXX plus months and make me take IRA distributions which I did not intend to take? No response but Im sorry. I then sent he mails to the top executives of the company and recounted everything. No response! Then, lastly, I asked them to apply for that One-Time Exclusionary List Waiver to see if I can get my loan. Again, no response!!

I applied for a mortgage on a rental property that I own outright after being contacted by one of E Mortgage Capital 's loan officers, XXXX XXXX on XX/XX/. We went back and forth on terms for a couple of days and after arriving at numbers I was comfortable with, we proceeded with the process. I submitted all my documentation to support the loan and completed everything by XX/XX/. XXXX XXXX sent me the final forms with the new disclosure on XXXX XXXX XXXX and there were new charges added ( most egregiously was a new {$990.00} " Underwriting '' fee ) that increased the closing costs around {$1300.00}. I reached out to XXXX about the increase on the XXXX and received no response. I followed up a week later with : " XXXX : Hey XXXX. I don't know if you got my last but wanted to check in and see where we're at. XXXX : I apologize. I thought you were not moving forward due to the closing costs. Are you still interested in moving forward? XXXX : I assumed the additional underwriting charge was in error and we could correct that. The original disclosure did not contain that charge. '' Nothing more from XXXX XXXX after that. It's pretty clear to me that this company or XXXX XXXX was trying to pull a bait and switch and commit UDAAP violations by getting me to go through the process under one set of terms and then jacking up the price with additional fees after I had done all of the work to support the loan and was at the end of the process. I have never made a complaint before but I felt this warranted one so that future customers are not subjected to the same tactics, or worse, miss that the company is increasing their fees when they get to the final stage and pay more than they agreed to.

FRAUD, FRAUD, FRAUD I am the property owner of XXXX XXXX XXXX XXXX. XXXX, TX. XXXX. The home was rented to XXXX and XXXX XXXX in XXXX. In XXXX we completed a warranty deed transfer so the XXXX 's could purchase the home on XX/XX/XXXX. They were unable to obtain a mortgage so I verbally extended the agreement to XX/XX/XXXX in which they were again, unable to obtain lending. I hired an attorney to draft a Deed in Lieu document to have the deed transferred back into our name. The XXXX were asked to sign and return the documents on XX/XX/XXXX with an anticipated move out date of XX/XX/XXXX. Since XX/XX/XXXX the XXXX have been unresponsive. On XX/XX/XXXX a notice to vacate was sent via certified mail to the home. On XX/XX/XXXX I receive a payoff request from XXXX XXXX. On XX/XX/XXXX I receive an email from XXXX XXXX stating they are attempting to obtain lending on the home and expect to be funded by XX/XX/XXXX. XXXX. Upon review of the document I notice strange issues and begin contacting entities and parties denoted on the loan documents. I find that no one listed on the document is aware of the loan origination. I personally spoke to the loan officer XXXX XXXX and sent an email but was informed that his email is not XXXX XXXX XXXX Instead, the email belonged to his son XXXX XXXX. I will be filing an eviction on Monday XX/XX/XXXX and am very concerned there's fraudulent activity occurring. I've notified all parties involved and am not sure what the next step is to protect my family and assets. Not attached, but I do have proof of above information if required. Attached is the loan paperwork received from XXXX XXXX.

1. The mortgage broker E Mortgage XXXX XXXX, CA improperly completed their paperwork and failed to seek a subordination for another lender. 2. After all signatures were done they still had not completed their paperwork. 3. Once the loan was closed and I received the main cash out pmt. I received a letter from the previous loan company that the payoff was short paid not by much but {$160.00}. It took about 5-6 phone calls to even talk to the broker XXXX XXXX. 4. It was rectified after two weeks of calls. 5. Then I got contacted, post loan from a Notary who had no Idea what he wanted me to sign. I tried to contact XXXX XXXX no answer and voice mail full. A day or two latter he contacted me and explained the above that they had failed to get the subordination. I then waited another week before the Notary contacted me and the papers got signed. 6. The broker had told me they would reimburse me {$520.00} I was charged for I think the appraisal. 7. After I was told several times the check was being sent out and was not I finally called XXXX XXXX company and asked for his boss XXXX, He was able to get XXXX to call me. XXXX does not seem to answer his phone and his voice mail is always full. XXXX agreed to get a cashiers, take a picture of it and text that to me. ( He did that ) now we will see if the check comes. Personalty I will never deal with XXXX or E Mortgage again and will never encourage any one to deal with ether of them.

I have prepared my file of over 300 emails documenting all of the ways in which eMortgages conduct violates State and Federal lending laws including but not limited to : mishandled and losing my sensitive personal information continuously over a 6 month period ; improperly, inaccurately, and negligently directing us not to make our mortgage payment resulting in a detrimental mark on our credit report ; improperly transferring our property insurance leaving my lender uninsured for over two months ; knowingly providing incomplete and inaccurate information on our refinance application and closing documents even after I informed them that the information was not correct ; making misrepresentations and false statements about eMortgage practices and required documents ; continuously delayed processing the refinance resulting in the expiration of documents and requiring updated documents on multiple occasions ; requiring documents that had previously been provided 2, 3 and 4 times prior ; and failing to expeditiously pursue and secure refinancing in good faith and in our best interest. I also believe that eMortgage engaged in racial bias as eMortgage initially approved the refinance loan, indicating on the refinance application that my husband and I were XX/XX/XXXX. I informed eMortgae that my husband is XXXX XXXX and that I am Native XXXX and XXXX and after that, the above described conduct began.

I have two loans on my mortgage. the second one has 7.5 percent interest charge. i talked to E Mortgage Capital XXXX XXXX Mortgage Loan Officer / Broker and he told me that i can combine both of them with 2.999 percent. i submit all the documents and after one or two weeks Mr. XXXX XXXX XXXX. XXXX, E Mortgage Capital send me an email which Congratulations, your loan has been approved! If you could please gather the list of items mentioned below we can get final sign off and move forward with issuing loan documents and they send me phone number for an appraisal which he charge my credit card for {$460.00}. Today mr. XXXX XXXX send me an email which I am very sorry to inform you that the lender has declined the loan to refinance both loans due to the high loan to value. I will call you as well to discuss.we talk to each other and i asked him who is responsible for {$460.00} charge and he is telling me you. i called to my credit card company and dispute the charge.

Multiple customers have contacted us, XXXX XXXX XXXXXXXX, XXXX, about marketing encouraging them to refinance. On XX/XX/2021, a customer dropped off a marketing piece he assumed was from XXXX XXXX XXXX, XXXX We do not currently have a direct mail campaign. The marketing is coming from E Mortgage Capital and misleads the consumer into believing we are encouraging them to refinance. The marketing piece uses XXXX XXXX XXXXXXXX multiple times yet names their company only once. There is no E Mortgage Capital company branding, no NMLS # listed for WY, and only a phone contact # for their sales representative.

I was locked into a 3.875 % rate for my loan on a second home I am purchasing, with a close of escrow at XX/XX/2022. The lender updated me that my loan did not meet QM compliance and that because of XXXX XXXX Guidance, they have to change my rate to 4.625 %, and that I would have to pay points towards that rate. I am attaching a copy of the loan information and disclosure that I am seeing.

This is not the company the borrower applied with, they purchased a trigger lead from the credit bureaus ( which is legal ), however the phrasing in their text message to the borrower is deceptive and misleading. And there's no acknowledgement that this is not the lender they applied with.

XXXX and XXXX are very deceiving. He promised to pay me which I never got paid. He then got his lawyer to email me to stop asking about where my money is. I have recorded conversations of him promising to pay me and never did. Please help me or let me know who to go to.
