I have received collection actions, negative and erroneous credit reporting against me on a joint debt, formally held by my ex-husband as the primary and myself as the secondary party that is erroneously being reported. Additionally, not full or accurate accounting of the collection has been provided to me or reflected in the reporting to the credit bureau. Nor has proper identification of the original mortgage holder been reflected or the correct account status. This debt is a result of a foreclosure that was requested by my ex-husband. After I was approved for mortgage modification and completed the trial period payments to pay the obligation separately since he refused to meet his. Although, my ex initiated the foreclosure and is jointly obligated, he is not being pursued for the obligation due to his bankruptcy protection and XXXX refused to continue with a modification without his signature. The following details are being provided to support my reason for requesting assistance and for the CFPB to intercede. The property balance being collected on had a Sheriffs sale/foreclosure date of XX/XX/XXXX. The property was redeemed and sold XX/XX/XXXX in which the mortgage company received {$43000.00} in sale proceeds. The last statement received from the collection agency dated XX/XX/XXXX had the current foreclosed mortgage balance in the amount of {$120000.00} as of XX/XX/XXXX. ( Exhibit 1 ) The statement does not reflect the {$43000.00} the financial institution received in proceeds from the sale of the home. It also reflected over {$6700.00} in unapplied payments and included multiple fees for interest on escrow for payments in access of the escrow account. Had the unapplied payments been applied to the escrow account, no interest charges would have occurred. Additionally, as a second option, had these fees been applied to the mortgage interest, the mortgage balance would have also been lower. This appears to be a prime example of the mortgage company performing favorable accounting practices at the expense of the consumer. Lastly, there are over {$2000.00} in charges for preservation fees on an abandoned property that were charged erroneously reflected in the attached statement dated XX/XX/XXXX. This was after the preservation company admitted erroneous entry into the home. ( Exhibit 2 ) Additionally, attached is the first and last page of the property management agreement reflecting management since XXXX and the first and last page of the subsequent lease agreement enter into post entry in and upon the premises. These figures alone total over {$52000.00} in erroneously charged or misapplied funds and fees. After extending a loan modification ( Exhibit 4 ) and then stating they would not move forward with a modification without both signature, XXXX stated that foreclosure had been requested by the other party and they were basically honoring the other partys request. My exs bankruptcy protected him and leaves me obligated even after several attempts and success at getting modified terms to in which I could meet my obligations. Only to have the rug snatched out from under me. Lack of assistance then and lackluster efforts now continue to impact my life. In addition to the aforementioned, XXXX has done the following in no specific order. ( Exhibit 3 ) Started re-reporting their closed account with current payments in XXXX, XXXX and XXXX XXXX and then delinquent payments erroneously thereafter. This is appearing to my creditors that I am still missing mortgage payments and am 120 day or more past due. XXXX refuses to correct. It is also reflecting that a foreclosure when the property was redeemed out of foreclosure, that there has not been any activity since XXXX and that the last payment was XXXX of XXXX which is not inclusive of the {$6700.00} in unapplied payments still reflecting in XX/XX/XXXX. I attempted to hold myself accountable by getting a modified mortgage and doing everything in my power to meet my obligations. XXXX and Dyck O'Neal should have done everything in their power to get the reporting and accounting right. There has not been any efforts from either company to get things corrected and they snub their noses at my requests for assistance with something as simple as accuracy. This is my life. This collection and erroneous reporting is drastically affecting my ability to move on with this life and/or restart after a divorce and very bad time. The matter is only being exacerbated after making several, unsuccessfully, attempts to work out corrections on balances and reporting and some sort of mutual resolution and manageable payment terms that also doesnt set me up for failure or make matters worse. I seek assistance with moving on and past this chapter. They had years to get this right at my expense now its time to just get it removed.

XXXX I had XXXX to move from XXXX, XXXX to XXXX XXXX, XXXX. I moved entering into a buy out house program by the XXXX. The XXXX only offered $ XXXX on a house that I owed $ XXXX and was worth $ XXXX. I was short by $ XXXX. I was already living in XXXX XXXX when I found out about this shortage. XXXX advised I sign a promissary note for the $ XXXX for the bank would not right off the remaining balance even thou I was put in a short sale process to sell the home. I came to the closing with the the $ XXXX from XXXX and my promissory note showing paid off in full. Months later my credit was hit with a foreclosure attached to it. The XXXX per a BRAC law said they could not reimburse me the $ XXXX because I had not lived in the house 2 years. Upon being hired I was never told the base would be closing or I would have to move. Key information in deciding to build the new house we lived in. We were advised by a lawyer to file bankruptcy to get rid of the $ XXXX we owed Dyck O Neal. We did so. However XX/XX/XXXX the bankruptcy was dismissed. Judge told lawyer that a company or bank can not not double hit a individual. What he was saying is our credit was ruined with the foreclosure for 6 years and then on top of it we were being asked to pay $ XXXX for a house we no longer owned. The judge said this is not right. The judge could not fix my credit and I would be stuck with that for 6 years but advised the lawyer to send letter to Dyck o Neal that I am not responsible for payment of the $ XXXX. A request to cease collection efforts was sent to Dyck O Neal in XX/XX/XXXX. In XX/XX/XXXX we moved to XXXX, XXXX. XXXX XXXX we the foreclosure/short sale fell off our credit as well as bankruptcy information. However, every month over the last 6 years Dyck O Neal has banged my credit lowering it from an XXXX score to XXXX. This has hurt us over the last 6 years where we can not get a credit card, car or house. We went to banks in XX/XX/XXXX to purchase a house since the stuff dropped off our credit except the Dyck O Neal debt. Not one bank would give us a house loan even with back up from our lawyer saying we are not responsible for the debt. All banks mentioned that the removal of this debt from our credit report was crucial. We have tried multiple different methods with no results. In XX/XX/XXXX Dyck O neal claims they matured the loan to the full amount owed but mis-represent this on our credit report. We have disputed this and it has not been corrected. Per the statue of limitations Dyck O Neal can no longer attempt to collect on this debt. This has done significant damage to our credit for 6 years by them misrepresenting a foreclosure on our credit report for the 6 years and also attempting to collect up and beyond that. They misrepresented that we came to the closing of the loan on our home with all intention of showing a full payment so we would not have to short sale a home and have bad credit. They not only damaged our credit but want to collect per the promissory note after doing such damage and was not supported by a judge for their actions. They continue the threat to sue but the statue of limitations has exceeded the time they can do so. We would like to resolve this issue in any way possible has it has done great damage to our family for over 6 years and continues to be a problem.

I had a mortgage foreclosure by XXXX XXXX on XXXX XXXX, XXXX, with a XXXX XXXX, XXXX auction date. Fannie Mae insured the note and paid XXXX XXXX. On XXXX XXXX, XXXX, I received a letter from Dyck-O'Neal Inc. ( DONI ) ) stating the note has been assigned to DONI by XXXX DEFICIENCIES. The letter stated no collection efforts will occur on this account for the next 30 days. The next day, XXXX XXXX, XXXX, they filed a lawsuit for {$61000.00}. On XXXX XXXX, XXXX, I received a summons on this matter with twenty days to respond or be in default. I quickly researched the statute of Limitations ( SOL ). I found out the SOL was five years and therefore the lawsuit was beyond the SOL and did n't apply and I responded to the court as such. In XX/XX/XXXX, The state of Florida changed the SOL to one year. However, all of the old foreclosures within the five years, the Collectors had until XXXX XXXX, XXXX to file lawsuits. Hence DONI filed about XXXX lawsuits in Florida. I still thought I was outside the SOL as the foreclosure took place on XXXX XXXX, XXXX with an auction date for sale on the property set for XXXX XXXX, XXXX. When I looked up the court records I found out the sale was postponed until XXXX XXXX, XXXX, which now put me inside the SOL, hence the lawsuitI researched THE FAIR DEBT CONSUMER PROTECTION ACT ( FDCPA ) and other legal and non legal documents. In the FDCPA I noted many violations. Some of which are Section 809 ( validation of debt ) ( a ) ( 1 ), ( a ) ( 2 ), ( a ) ( 3 ), ( a ) ( 4 ), ( a ) ( 5 ) and ( b ). Section 813 ( Civil Liability ), ( a ) ( 1 ) and ( a ) ( 2 ) ( A ). ( Copies of these statutes are uploaded as attachments ) In The Florida Rules of Civil Procedure ( Rule 1.070 Process ) Item ( j ) states : If the service of the initial pleading is not made upon the defendant within 120 days, the court on its own initiative or upon motion to dismiss the action ... .... In this case the plaintiff was not in compliance. Instead, they returned the summons on the 120th day, XXXX XXXX, XXXX to the court. On XXXX XXXX, XXXX, the plaintiff got a new summons from the court which was served on XXXX XXXX, XXXX. It should be noted the defendant has resided at the same address since XXXX XXXX. DONI has an appraisal on the foreclosed property in an amount of {$210000.00} dated XXXX/XXXX/XXXX. The defendant has an appraisal of {$280000.00} dated XXXX/XXXX/XXXX, prepared by the same appraiser used by XXXX XXXX in order to approve the note. The balance of the note up to Final Judgment of Foreclosure was {$250000.00} plus interest of {$15000.00} and late fees of {$230.00} which equals a total of {$270000.00}, which results in the DONI receiving a value of {$11000.00} in excess of what the defendant owed. In as much as XXXX received property at a value greater than what the defendant owed that amount should be paid to the defendant. On XXXX XXXX, XXXX, the plaintiff reported to the Credit Bureaus ' an Account in Collection in the amount of {$61000.00}. The defendant 's credit score dropped from XXXX ( very good ) to about XXXX ( bad ). This has had a deleterious effect on the defendant in gaining employment, her voluntary community service, difficulty in finding housing and obtaining credit

In year XX/XX/XXXX I bought an investment property located on XXXX XXXX XXXX, XXXX, XXXX XXXX. There were XXXX mortgages, XXXX {$80000.00} and the XXXX {$15000.00} XXXX financed by XXXX XXXX XXXX XXXX XXXX Total {$95000.00} with a down-payment of {$6000.00} +.

XXXX XXXX XXXX XXXX XXXX was then bought by XXXX XXXX XXXX In XX/XX/XXXX, I became sick with XXXX XXXX and still is till today, on XXXX. Due to my illness, I could n't go to the property to collect mails or rent the place. Two months into a foreclosure process in XX/XX/XXXX, XXXX XXXX XXXX foreclosed on my property for FULL price. I called when I discovered that the house was foreclosed. XXXX XXXX XXXX told me that FULL price was paid by XXXX XXXX who bought it and that I do not owe XXXX XXXX XXXX any amount on the XXXX mortgages. My XXXXbureaus credit reports started to reflect XXXX balance on XXXX accounts.

Then in XX/XX/XXXX, a company called DykeOneal, located in XXXX XXXX XXXX XXXX, XXXX started to call and write to me that I owe them {$15000.00} XXXX mortgage. Tel : XXXX.

First, their letter stated that I owed XXXX XXXX XXXX, however, a note they called Alonge-to-note claims that they bought the XXXX mortgage from XXXX XXXX XXXX

I tried to obtain evidence of sale from XXXX XXXX XXXX, XXXX but XXXX kept telling me that I do not owe them and that I should talk to their attorney because the file has been closed long time ago. Their attorney meanwhile said that only XXXX can provide me the evidence of foreclosure sales I needed.

DykeOneal then took me to court. To summarize, I was ill and couldnt appear in court the first time. I wrote to the judge with my complaints. The judge ruled against me WITHOUT EVIDENCE.

The I went to the court the second time to see the judge who thought I lived in XXXX XXXX whereas I live in XXXX XXXX near XXXX where his court is located.

After passing judgment without evidence, he advised me to go to XXXX County to obtain the original sale papers and the Foreclosure sale papers. That I should compare the XXXX to see what is owed.

I did. Both papers show and proved what XXXX said that I owe them nothing. However, the judge did not rescind in his judgement. He said I should go and get a lawyer to appeal it. I am on XXXX and could not afford a lawyer.

Dyke ONeal has been harassing me since then and accruing interest on the {$15000.00} which they now calculate to be {$19000.00}.

PLEASE RESCURE ME FROM DykeOneal. I DO NOT OWE THIS COMPANY A PENNY.

I recently received a writ of execution for my personal residence and personal property for a paid in full mortgage and a debt not owed. ( See attached XXXX XXXXXXXX XXXX documents. In XXXX of 2015, Dyck-O'Neal 's attorney debt collector filed a writ of execution for unoccupied, unencumbered Real Property but failed to pay the Sheriff to finalize and collect his judgment. Now, instead of refilling his writ of execution for the previous, unencumbered and unoccupied, real property worth far more than its illegal judgment, XXXX 's counsel has decided to harass and attempt to forcibly take our occupied home where I take care of my ill mother solely to harass, abuse, and extort money not owed. Our personal residence has two mortgages which encumber or secure the property for the amount it is worth placing mortgagees, including XXXX XXXXXXXX XXXX, XXXX, in jeopardy to an illegal debt collector extorting us for money owed. I have sent an offer again to the illegal debt collector 's counsel for clear and free, unencumbered unoccupied, real property or raw land, previously sought by writ by the illegal debt collector 's counsel, but the attorneys will NOT respond to any messages to settle the illegal debt for money not owed using my unencumbered and unoccupied real property previously sought by the illegal debt collector 's counsel for money not owed. How do I stop the insidious harassment of attorneys who will NOT stop threatening us because we reported their crimes of using fraud to extort money not owed? Failing to act on the original writ, causing three ( 3 ) more years of interest to add up on the illegal judgment, is another crime of abuse, harassment, and extortion for money not owed. In 2015, I filed a Quash for the property writ, in opposition Dyck demanded I give alternate property to the sheriff and therefore I was Denied. At that point, Dyck was able to collect its illegal judgment for money not owed but failed to do so by not paying the sheriff and allowing the writ to expire. The Sheriff said Dyck 's Counsel " NEVER showed up to pay for the Writ of Execution ''. It is illegal to harass us by now choosing our residence which fully encumbered, serving as security for two loans, one mortgage from XXXX XXXXXXXX XXXX and another private promissory note, while I have unencumbered and unoccupied real property, raw land in the same county, worth far more in value than the illegal judgment? I would appreciate a response to the pressing issue of abuse, harassment, and extortion for money not owed. Thank you.

This letter is to initiate a complaint against Dyke ONeal collection agency, located in XXXX, Texas ( please see attachment provided ). At an earlier time, I was forced into a short sale of a property I had owned due to vandalism. The mortgage holder required that a {$5000.00} promissory note, with payments of {$42.00} per month. This note was subsequently turned over the Dyck ONeal for servicing. Dyke ONeal sent me monthly billings on a regular basis until the middle of last year ( XX/XX/XXXX ). For five months, I received no billing statements - and therefore no payments were made on the note. In XX/XX/XXXX, a representative of Dyke ONeal contacted me by telephone and informed that the note was in arrears. I promptly brought the note current. Later, Dyke ONeal placed a derogatory note on my credit report, stating that I had missed five payments. I phoned the company to request that the derogatory information be removed, as I had not paid because I had received no billing statements. The company refused to do this, citing that they sent out billings as a courtesy only, and hung up the phone on me when I complained. I would like to request that action be taken to compel the removal of this information from my credit report. I have excellent credit otherwise, and what they have added is very damaging. In addition, the short sale was originally mis-reported on the credit report as a foreclosure, when this was not the case. This issue was already referred to the Maryland Division of Financial Regulation, but they were unable to have the derogatory information removed. Further, XXXX XXXX, XXXX at Dyck-O'Neal made several untruthful statements to that agency during the course of their investigation. As a result of this situation, I am looking at payments on a used car of nearly {$100.00} more PER MONTH due to the fact that my credit score dropped approximately 115 points. This is a material adverse financial impact. What rights do I have as a consumer regarding credit reporting agencies? There would seem to be no accountability for the veracity of their information, despite its impact on peoples lives. In XX/XX/XXXX, my ex-husband, XXXX XXXX XXXX, XXXX and I signed a 10 year promissory note which was due to be paid in full in XX/XX/XXXX/XX/XX/XXXX due to the short-sale of the marital home. We had been legally divorced for 6 months, living in separate homes/addresses, and separate bank accounts. For the first 3 years of this repayment period, Dyck O'Neal only sent bills to XXXX. Repeated calls to Dyck O'Neal were unsuccessful. I was always told that it is there policy to only send the bill to the first person on the account. For three years I wrote, " Please send me a copy of this bill so I can pay on time. '' Once they began doing that, I received monthly bills and payments were sent consistently. XXXX consistently paid $ XXXX/month over almost 8 years. My amounts were varialbe over the years, sometimes minimal, sometimes extra. In XX/XX/XXXX, XXXX has a small XXXX as the result of XXXX XXXX XXXX for 2 1/2 years and was at the VA Hospital in XXXX XXXX XXXX, VT. I was not notified of this by my former step-children until my repeated phone calls to him to check on his well-being. I spoke to XXXX, via phone, and told him that I would send the entire monthly amount and he said that he would pay the balance of the loan. On XX/XX/XXXX, XXXX passed away due to his XXXX XXXX XXXX XXXX. I never received another bill from Dyck O'Neal and assumed that XXXX had followed through and paid of the loan. I was notified by XXXX XXXX that my score had gone down and a past 30 day payment was reported. I have filed a complaint with the credit bureaus on three separate occassions and won each time. Dyck O'Neal negative reporting was removed, but they keep putting it back on my account. If I'm late 30-60 days, please explain to me how we've paid this debt off 2 YEARS early. I've called Dyck O'Neal customer service again and warned the rep that if they reported the account as late again that I would be filing a formal complaint. Please help fix this for good. They still have not fixed their policy of only notifying the first person on the account despite knowing that we were divorced and living separately before even signing this promissory note. The debt buyer Dyck O'neal Inc has engaged in multiple deceptive, unfair, and misleading debt collection practices. Please closely review the violations listed below and supporting documentation I have included : 1. Dyck O'neal Inc purchased this " deficiency debt '' for only {$1.00} and then claimed I owe them {$100000.00}. However this is totally inconsistent with the final statement I received from the original creditor XXXX XXXX XXXX regarding this property which clearly states that the Balance outstanding was {$140000.00} and the Fair Market Value of the property was {$170000.00}, leaving NO deficiency and making this a phantom debt. ( see judgment assignment and XXXX XXXX XXXX Statement ) 2. The original action occurred XX/XX/XXXX, that is over 5 years ago. The statute of limitation in XXXX is only 1 year, making this time-barred. Also I am a XXXX resident and the statute of limitations in XXXX is only 90 days. So this also violates XXXX public policy. 3. Based on the XXXX XXXX XXXX statement I provided, my drivers license, my credit report, my address has always been in XXXX. But based on the XXXX County Public Records website ( see printout from XXXX/XXXX/XXXX ), Dyck O'neal intentionally and willfully filed this lawsuit with a false XXXX address I have never lived. Potentially disclosing my information to a third party and commencing legal action and obtaining a default judgment without my knowledge. The sewer server service denied me the legal right to defend myself. Since I am a XXXX resident with absolutely no connection or contacts to XXXX. It 's difficult, inconvenient, and expensive for me get out-of-state legal assistance regarding this issue so I am desperate for the Consumer Financial Protection Bureau to assist ensure a fair resolution. I recently became aware of this after reviewing my credit report which dropped XXXX points. I also applied for a job, and after a background check they sent me a Fair Credit Reporting act notice ( see enclosed letter dated XXXX/XXXX/XXXX ). Not only is this embarrassing, but this illegally obtained judgment has devastated my credit score, damaged my reputation, causing me XXXX.

XX/XX/XXXX I purchased my current private residence and originally had XXXX mortgages ( first + second XXXX ) with " XXXX XXXX '' XX/XX/XXXX. 1st was for {$480000.00}, 2nd for {$120000.00} Within 1 year the 2nd mortgage was transferred to another lender and then both mortgages ended up with XXXX XXXX XXXX around XX/XX/XXXX. We had XXXX loans with XXXX at that point, a 1st and a 2nd. I still have the papers and XXXX loan numbers. XX/XX/XXXX my husband and I filed for chXXXX with the help of XXXX XXXX XXXX, discharged XX/XX/XXXX. We had stopped paying the 2nd XXXX mortgage around XX/XX/XXXX. We learned from XXXX that they charged off the 2nd mortgage. After the XXXX discharge we never heard about the 2nd mortgage again, no correspondence whatsoever. On XX/XX/XXXX we received a letter from a company called " Dyck O'Neal '' claiming possession of a lien against our property. On XX/XX/XXXX XXXX XXXX XXXX sent a " Qualified Written Request '' to Dyck O'Neal on our behalf. Until today there is no response. On XX/XX/XXXX my husband went to the XXXX recorder 's office to search our property 's records. He found out the following : 1. A record recorded with XXXX recorder on XX/XX/XXXX showing that in XX/XX/XXXX a transfer of 2nd mortgage from lender " XXXX XXXX '' to a company called " XXXX XXXX XXXX '' in Texas took place. These documents were recorded with the LA recorder 's office 2 months after XXXX XXXX XXXX had sent them the " Qualified Written Request '' Dyck O'Neal never responded to. Besides, to our knowledge XXXX XXXX could not have transferred this 2nd mortgage as the original 2nd had been moved to XXXX other lenders and it ended up with XXXX before our chXXXX filings in XX/XX/XXXX. 2. Another record dated and recorded with XXXX recorder on XXXX/XXXX/XXXX showing a transfer of this same 2nd mortgage from " XXXX XXXX XXXX '' to " Dyck O'Neal, Inc. '' dated XX/XX/XXXX. On XX/XX/XXXX I received another letter from Dyck O'Neal similar to the letter they had sent in XX/XX/XXXX, claiming possession of a lien against our property. I have been sued for a time-barred debt from XXXX. Most importantly I do not believe I owe this debt. Plaintiff is providing minimal information for Servicer Chain of Custody for the last Servicer from XXXX. Plaintiff can not or will not provide any Servicer Chain of Custody records for the Servicers prior to XXXX. None of the Servicer paperwork references the loan number for the debt in question. I have not received information from " anyone '' since XXXX. Nor was I ever told there was payment due. Plaintiff never told me this was a time-barred debt which I believe he is required to do. Instead he replied to me in a letter stating that this debt is not affected by the Statute of Limitations. In XXXX we sold our home in XXXX Ca. The mortgage company said they would give us a no interest loan for the difference in the selling price of our home. We agreed to do it as I didn't want to jump on the foreclosure bandwagon, that was happening at that time. Another reason I agree is there was no advisory language in the agreement, which meant to me that this would not be reported to any collection agency. The money amount on the Promissory notice is different from the written amount. The payment for the note was {$1200.00}. I paid {$50000.00} on this note for my mortgage at XXXX XXXX XXXX. Then I lost my job after 34 years. XXXX went out of business in the real estate scandals that went on in XXXX. They sold the note to Dyck-O'neal, I contacted them in XXXX and told them about losing my job and offer a settlement after many emails I finally received a response and their answer was no, they would not except my offer. I went to an attorney and showed him the note and explained that was a note regarding my mortgage and I was told by the attorney that this note was illegal for many reason and that it was being report incorrectly, it was being reported as an account when it was actually a mortgage loan. I fought for years with Dyck O'neal in XXXX they sent me a notice saying that the debt is unenforceable due to the expiration of the applicable statute limitations. My husband was employed throughout this fiasco, I ask Dyck-O'neal on several occasions to take this to court so we could deal with it legally, they choose not to do it. I believe it's because they knew this was an unenforceable agreement. I am in the process of buying solar for my home and because of their derogatory mark on my credit and my Husband XXXX XXXX credit it is stopping us from purchasing it. I have written to the Credit Bureaus disputing this account and they will not remove it because Dyck-O'neal keeps saying its a debt owed to them. Our credit is perfect no missed payments, no collections, the only mark we have is for a contract that is unenforceable.

My ex husband had taken out 2 mortgages with Own it mortgage. When we divorced i was awarded the house. The loans were only in his name. This company went out of business and XXXX XXXX acquired the bigger mortgage. And then XXXX loan took over. I was ready to close on the refinance. ( I 'm listed on title only through a quick claim deed. ) When the 2nd mortgage showed on title, No one at my bank, the county, or at the current lender could tell us where the loan went. It was not showing on his credit report or on title. Nothing had been filed. We had not received anything from them, so we assumed it was consolidated into the first mortgage. We have been working on this for approximately 3 weeks when I decided to open up my own escrow and purchase a title report. He spoke to a rep there named XXXX who told him that since it was there for over 10 years that they had charged him interest at the sum of XXXX and the original balance of {$10000.00}. The rep at this collection company wanted to know how much the house appraised for and how much money I was getting back to assess the amount, if any, of interest they MAY take off. I do n't think that 's any of their business. Seems shady to me. XXXX has all the copies deeds, title documents, etc. I do n't feel that 's right to charge that interest If you 've never attempted to collect it or not filed the correct documents with the county. I do not owe this person anything at all AND his desperate attempt to reach me by phone is frightening. I saw the company name through caller-ID. I did not answer the call. About 5-10 minutes later, my sister ( who lives in XXXX ) receives a call and she assumed it was a family she had been XXXX. She placed me on hold and answered the call. In a few minutes, she returned to me and told me that someone named " XXXX XXXX '' had called and sternly asked for " ME '' by name. She told the person that I did not live there, but I was her sister and what did they want? She said the person immediately disconnected the call. Now ... .I DO NOT RECALL EVER, EVER VERBALLY COMMUNICATED WITH THIS DEBT COLLECTOR AT ALL ... ..NEVER. So, there is no way they would have access to my sister 's phone number and I have never, ever used her name for any ; absolutely any form of business. So, how did they get her phone number? And if they have been calling my phone number over time, what would lead them to call a different number? How did they get my sister 's phone number? So, my concern is : somehow, this company was able to tap into my sister 's land-line phone while we were on the phone at the time of their call. I do n't lknow how they did it, but this truly happened and they should not be allowed to get away with it. They clearly had a way to do that which is invasion of privacy and by doing so, exposed a personal issue of mine to my family member, who had no prior knowledge. I am offended ; I feel violated and I am fed up with the constant harrassment I have been receiving from this company. my house was set for a deed in lieu. The mortgage company asked the judge to cancel the foreclosure but the motion was denied. The house was foreclosed on. I cooperated fully with XXXX XXXX and vacated the home as agreed. I submitted a request to dispute a collections account on my credit report on XX/XX/XXXX expected to be completed on XXXX account is a XXXX XXXX account XXXX I never received a update that my dispute was complete only that it was in progress. Over the course of the last 2 months I have logged in and checked said dispute and it was showing still under investigation. As of XX/XX/XXXX, past the 30 day even 45 day mark the dispute was not complete. I logged in today just to check due to the fact my credit report through Equifax is still showing a Derogatory mark for this account. The dispute is now showing complete and the letter attached is stating the dispute was states it was completed on XX/XX/XXXX, but the last time I logged in was XX/XX/XXXX and it was not completed. Also the company continues to call me while the dispute was open. They only stopped calling once I left them a voicemail stating there was and open dispute that was past 30 days. The dispute report is stating that the information was updated and that is it. Based on the Fair Credit Reporting Act the company has 30 days to review the dispute and if they do not get back within 30 days the agency is obligated to remove the disputed report. Not only did they take over 30 days to submit their findings ( almost 60 days based on my records ) they also send a dispute letter that clearly does not have the correct date on it. There is no way the dispute was completed on XX/XX/XXXX seeing as I logged in on XX/XX/XXXX and it was still in process. They are lying about when it was completed. This needs to be removed from my report based on FCRA. This account has been disputed and removed off of all other agencies except for this one. The company called me again today. This is my formal communication in an effort to get this inaccurate and invalid account from my credit report. I have sent several dispute requests to XXXX and XXXX to investigate the Dyke O'Neal account, which is reporting inaccurately on my credit report because I have NEVER done any business with Dyke O'Neal & they are reporting this account as if they are the original creditor when they are NOT. I sent a communication to Dyke O ' Neal, requesting validation of this debt and they sent me a communication stating they were a 3rd Party Debt collector, collecting on behalf of Purchasing Power. However, if you take a look at my credit report ( see attached ) Dyke O'Neal is reporting on my credit report as an " original creditor '' who has charged off an account in my name and transferred it. I have attached a copy of how this account is reporting to my XXXX and XXXX report, and if XXXX and XXXX were conducting a proper investigation they could easily determine that this account shouldn't be reporting as an " original creditor '' to who I owe a debt to. Also, if you take a further look, Dyke O ' Neal is reporting a payment status of charged-off on XXXX, but as " Late 120 Days '' on XXXX. Additionally, XXXX is double reporting this same account as a " charge off '' and as a " collection '', which is a clear violation of the FCRA. It's clear that Dyke O ' Neal is conducting deceitful and unfair practices in an attempt to coerce me into paying a debt, I HAVE NEVER OWED TO THEM and haven't validated that I have even opened up this account with them. I've exhausted my attempts to correct the inaccurate and invalid account with the credit bureaus and they have refused to do so. My next step is to contact my attorney general followed by a civil lawsuit against all 3 companies.

XXXX XXXX : DYCK-ONEAL Amount XXXX {$22000.00} I am disputing this claim due to : On XX/XX/XXXX a foreclosure hearing was held regarding property associated with mortgage loans with both XXXX XXXX and XXXX XXXX XXXX XXXX XXXX the original holder of the mortgage was notified of said hearing. The outcome was a deficiency waiver. XXXX XXXX did not establish any claim or defenses legal or equitable and no relief was granted. All those who may or may not have been entitled to claim through or under the title or interest is absolutely barred and forever foreclosed of any rights, titles or interests. No personal or deficiency judgment was demanded. I have emails and court documentation supporting both the court litigation and evidence that the lienholders were aware of the foreclosure proceedings prior to the date of the hearing. I had a loan with Dyck O'neal Inc. that was created as part of a settlement after a short sale of my home in XXXX. I had this loan from XXXX until the autumn XXXX when I paid the loan off and closed the account. I was offered twice a year by Dyck O'neal a 15 to 20 % discount on the principal of the loan if I paid it off all at once instead of the installments. This past fall I had the money to pay off the remaining balance of about {$5000.00}. I took the offer of a 20 % discount and paid the loan off and closed the account. I learned today as I was checking my credit score in preparation for a new mortgage application that I was reported by Dyck O'neal to the credit agencies as having paid my loan off for less than the agreed upon amount. This is a negative report that has resulted in dropping my credit score over XXXX points from XXXX to XXXX. My XXXX score is XXXX, my XXXX score is XXXX and XXXX is XXXX. Dyck Oneal apparently does not report to XXXX. I called Dyck O'neal and they said they have no control over how they report to the credit agencies which I think is a lie. They also never once explained in any of the twice yearly teaser coupons offering a 15-20 % discount that it will be considered a negative on your credit. They never told me this in any conversation I had with them when I called to pay off the loan. They were all too happy to take my money. How can they say I paid the loan off for less than the agreed upon amount if they agreed to offer me a discount so I would pay it off sooner. I ca n't have paid a loan off without them agreeing to it correct? I feel this is extremely deceptive and also harmful to my financial condition because I will now have to pay a much higher interest rate on a loan.

To whom it may concern, This concerns Dyck O'Neal collection agency. In XXXX of 2015 I was told by phone that I was past due on an account. I had become late on monthly payments of {$77.00} to the XXXX XXXX Mortgage XXXX. My past due amount was appx {$2400.00} according to Dyck O'Neal in XXXX of 2015. On XXXX XXXX I made a {$250.00} payment online. The XXXX statement reflected that payment and stated I owed {$2400.00} ( past due ) plus {$230.00} in late fees for a total of {$2600.00}. On XXXX XXXX, 2015 I called Dyck O'Neal to make a payment to be current. I was told on the phone that to become current I had to make a payment of {$1700.00}. I asked several times if this was correct and I was told several times this would bring me current. I made the payment over the phone for {$1700.00}. The XXXX statement reflected this payment but nothing was applied to late fees. The amount owed was shown as {$690.00} plus {$240.00} in late fees for a total of {$940.00}. ( {$77.00} was added to each statement as that was what the monthly payment is suppose to be. ) On XXXX XXXX I phoned Dyck O'Neal and asked how much did I owe to become current. The woman stated {$950.00}. I again asked several times, " will this bring me current ''. Several times she said " yes ''. I made the payment for {$950.00}. The XXXX statement came and it shows that only {$21.00} has been applied to late fees. It states I owe {$77.00} plus {$230.00} in late fees for a total of {$310.00}. Since the XXXX statement which showed that I owed {$2600.00} ( I do not dispute this amount ) I have paid Dyck O'Neal {$2700.00}. They are still asking that I pay {$230.00} late fees. XXXX they have told me on the phone that I am " current ''.

2 accounts showed up out of nowhere on my 3 credit reports from a company called Dyck O'Neal. Acct. # XXXX & Acct. # XXXX, claiming I have a contract agreement with them on a debt that is in another persons name. I wrote XXXX validation letters to the company requesting complete validation as defined by the FDCPA. in over 15 months of going back and forth trying to get validation from them unsuccessfully But they have been continuing to report to the three CRA that accounts are accurate without properly validation and investigation and telling the 3 bureau 's everything accurate and verified without submitting the Bureau 's any documentation also. Lastly they are mis representing there entity to the credit bureaus claiming to be a creditor of mines with terms and and contractual agreement with me when they are in fact a collection company and not reporting it as such to the Credit Bureau which is false reporting. They continually report on a monthly basis to the bureau 's as me being late for the last 15+ months but never validated or produce any documents stating as such or according to the way proper debt validation is define by Federal Law. I am selling my house to my ex-wife, XXXX XXXX. When she was ready to close a 2nd mortgage popped up that I had not seen or heard of for 10 years. I do not have this 2nd loan showing on my credit report. I 've spent 3 weeks trying to find out who assumed that second loan. There 's nothing on the title and no one could help me. My ex-wife finally order a title report and she emailed to them. She is showing on the deed only, not on any of my loans. They told me after a few days that the loan had been sent to collections with Dyck O'Neal Inc. I called them and spoke to a representative named XXXX. He told me that they had it. It had been there for 10 years. It had accrued interest in the amount of {$14000.00} plus the XXXX that was owed. Then he asked how much the house appraised at and how much money my ex-wife was getting back. Then maybe they would consider removing some interest? She was only approved for the original balance. I do n't think this is right. I feel that since they made no effort to get a hold of me and it was n't showing anywhere on my credit report or with the county on the title that that 's not legal. My ex husband and I owned a house in XXXX, NY. As a result of our divorce, we had sold this house as a SHORT SALE XXXX 2013. Our mortgage company XXXX XXXX used XXXX insurance company for the PMI insurance. After closing of this home, XXXX sold the loan to DYCK O'NEAL collection agency. DYCK O'NEAL then came after my ex husband and I for {$50000.00}. Because of this, my ex husband filed bankruptcy and included this {$50000.00} in the bankruptcy process. Since he was no longer responsible for this, DYCK O'NEAL has now been after me for the FULL amount of {$50000.00}. It shows up on my credit report and is a red flag which is not fair since it was a joint account. My question is why is this {$50000.00} if this was part of my mortgage payment that I paid for four years prior to the short sale. Also, if it was included in the bankruptcy files, why is this still a problem? DYCK O'NEAL has not wanted to work out a deal with me or help me with REASONABLE payments. Now, after speaking with many different mortgage companies and banks, I 'm realizing that this may all be in error or I have been a victim of a scam. The bank representatives told me that they have never heard of the PMI collection agencies requesting this large amount before. I just want to make sure that this is legal and would appreciate information on how to proceed. If proof of my ex husband 's bankruptcy is needed, I can obtain those records. A clear chain of title can not be completed without those assignments of mortgages. Without a clear chain of title the property can not be sold. I had a {$5000.00} promissory note assigned to me in the short sale of my condo back in XXXX. Dyck O'Neal was the debt collector in charge of servicing my note. From the beginning, communication was poor. I began paying on my promissory note In XXXX of XXXX. I set up an autopay and each month, from XXXX of XXXX through XXXX of XXXX, Dyck O'Neal was paid the agreed upon monthly amount. In XXXX of XXXX, I began receiving late payment notifications in the mail, which confused me since I was on autopay. When I called Dyck O'Neal and inquired, they told me my account was fine and my monthly payment had been received. I continued to sporadically receive late payment notifications, and another time when I called, I was told my loan needed to be modified and they would send me the paperwork. Twice, I never received the paperwork they said they sent. So even though I paid Dyck O'Neal every single month, my account was in default. They never once told me this would affect my credit, and that my account was showing late payments month after month on my credit report. Whenever Dyck O'Neal would try and contact me, it was during working hours, and they would never leave messages. I finally did modify my account this year and ultimately paid the remainder off just to be done with them. I am extremely upset that my credit has been destroyed due to their lack of communication and mixed messages that I was told over the past 5 years. I never missed a month in payments, and I don't believe my credit should be impacted by this company.

In late XX/XX/XXXX/Early XX/XX/2018, I requested a debt validation from a collection company and they sent me information from the original creditor. I also submitted a dispute online with all 3 credit reporting agencies, XXXX, XXXX and XXXX. I received a status report that Account information disputed by consumer, meets FCRA requirements. The collection agency then reported on my credit report as an open installment account currently past due 120 and 180 days late. This is not the original creditor and I have never entered a contract with DYCK O'Neal. I tried disputing this with XXXX again on XX/XX/2018 around XXXX central standard time. They replied that no such dispute ever took place despite me providing the email file number for the dispute. I asked them to send me the information the collection company sent them to verify the account information was accurate. They replied that the company sent no such information to which I replied, then how did you guys agree it was accurate without any information or validation? The supervisor, XXXX XXXX, then stated it was NOT a collection account but the original creditor, which is FALSE. Dyck O'Neal is a collection company and should not be able to report monthly current past due late payments nor represent themselves to the credit reporting agency as the original creditor. XXXX refused to do anything but dispute it again. They stated it was not their job to investigate disputes and whatever the creditor told them, they simply report.

This is connected to previous complaint submitted on XXXX XXXX, 2015, case # : XXXX. In the previous complaint, I stated XXXX XXXX claims that I owe him money on a debt. I do not owe him any money. After he was contacted XXXX, he sent me a letter stating he was attempting to make a collection on behalf of XXXX XXXX XXXX in XXXX XXXX, XXXX. I contacted XXXX XXXX XXXX around XXXX XXXX, 2015 and inquired about any debt I may have owed them. XXXX XXXX XXXX performed what they called a " thorough check '' and did not find any thing that indicated that I owed them money ; that there was NOTHING NEGATIVE AT ALL on my account/record with the credit union. I was told by XXXX XXXX XXXX that they could only conclude that I was being scamed, as they had no connection with anyone named Dyke O'Neal. If this is true, why is this man contacting me? He is sending mail to me suggesting that he is willing to settle for a lesser amount to collect the debt in an effort to assist me. I have no intention of giving this man any money and would like to have assistance in getting him to leave me and my family alone. As I stated in the previous complaint, he has been calling my family members as well. Additionally, since I made the initial complaint, I have been gettig even more calls with a XXXX area code from Missouri. I had previously tried to get Dyck O'Neal to correct their improper reporting on my credit reports. This last time they finally listed the original creditor which proves they are indeed a collections account. Yet they are not listed on my report as a collections account but rather as an open loan. So this makes my account look like I haven't made payments on a recent loan these past 120-149 days. The first deliquency was XX/XX/2016. This is basically termed, 'parking a debt ' to make it appear newer than it really is and is thus illegal. I have told them I am willing to pay the debt provided they furnish me a true validation that they own the debt ( not just them saying so and not a contract with the XXXX or bill, but a purchase agreement between them and the XXXX or a simple letter from the XXXX on XXXX company letterhead ) AND they correct the illegal parking tactic reporting they put in my report. Just correct what is wrong. That's it. No deleting, just accuracy. I even asked if I could disputed the inaccuracy and they just not reply, because they are wrong, but they declined stating they must accurately report to the agencies by law, though they are inaccurately doing so. I'm running out of available options and feel that the company 's tactics infringe on my rights.

In XX/XX/2018 this collector XXXX XXXX appeared on my credit report as a late payment. I had no idea who they was and what debt I had with them so I had to call and reach out first. Once I got in contact with this agency I was told who they brought the debt from and made it into a unsecure loan with them with past due balance of XXXX late payment of XXXX dollars. I never got one notice from this. Agency about this debt they have failed to set up a formal payment agreement and just decided to put a late payment on my credit report. On XXXX/XXXX/XXXX, I submitted CFPB Complaint # XXXX. Dyck-O'Neal was attempting to collect on a debt that was a result of identity theft. The complaint was resolved, Dyck-O'Neal, agreed the debt was the result of identity theft, and Dyck-O'Neal deleted the credit line that appeared on my credit report. Two months later, Dyck-O'Neal issued me a XXXX indicating that it " cancelled a debt. '' I filed CFPB Complaint # XXXX, indicating that the issuance of the XXXX was in retaliation for my CFPB complaint. The following day, Dyck-O'Neal responded to the complaint indicating that the XXXX was issued in error, and that a corrected XXXX would be issued. In an apparent total disregard for the CFPB, Dyck-O'Neal appears to have sold / transferred the original debt that was the result of identity theft. Dyck O'neal is a debt collection agency. They have purchased a debt and reported it as open installment accounts. They have dishonestly reported an account ( ending in # XXXX XXXX to all the reporting agencies. They are currently reporting this as a part of a bankruptcy that was discharged in XXXX yesterday the account as opened in XXXX XXXX. I have disputed several times and they continue to change the data inaccurately, fraudulently and misleading. To find out this is in fact an attempt to collect a debt. This company has failed to provide me with adequate information to assist me in investigating the alleged debt of {$360.00}. I have also reached out to the company and provided them with enough time to provide me with debt validation. They sent me a document that was seemingly manipulated ; consequently, I requested pages 1, 2, 4, 10 and 11 of what appears to be a Purchasing Power Agreement as evidenced by the attached letter and proof of delivery. I have been a member of XXXX since XXXX. They are unable to locate any records regarding a mortgage that I supposedly received in XXXX. I never received that mortgage. I have only had one mortgage on a property ( located at XXXX XXXX, XXXX ), and that went into foreclosure in XX/XX/XXXX as a result of predatory lending practices that led to a class-action lawsuit and subsequent forgiveness of the mortgage ( proof attached ). Since the original mortgage was issued through XXXX, I would not have gone to another lender for yet another mortgage. On XXXX the XXXX, 2019 I contacted this company to see what was the debt, and how much the amount actually was. Since I never received correspondence about this debt, the debt just popped up on my credit report with two separate accounts with two different amounts. At the time of the conversation I asked the rep if I paid would they delete this account from my credit report and they said they would, after payment was processed they did not follow-up on their agreement with deleting this account. As well they are still reporting this account as 120 days late w/over 10 late payments. They are not the original creditor, and bought the accounts from XXXX XXXX, XXXX. On XX/XX/XXXX I contacted Dyck-O'Neal in regards to their account # XXXX. In the letter, I explained that the note was a modification of an existing mortgage loan, not a new financial instrument. Further more, I supplied a XXXX clearly showing that the entire balance was charged off and that a Satisfaction of Mortgage was filed on XX/XX/XXXX after the date that Dyck-O'neal states this account was opened. Since my communication to Dyck-O'neal, no satisfactory explanation of how their account is a valid debt has been provided to me. Communication from them has been sporadic at best, with no communication during recent periods of a year or more. Recently, I disputed this account with XXXX credit reporting agencies since Dyck-O'neal decided to start reporting this account as late. The disputes resulted in still no details of why this debt is valid. In a nutshell, this debt was 100 % charged off by XXXX XXXX during a Deed-in-lieu of foreclosure and Dyck-O'neal has no right to attempt to collect on this.

For 2 years, since XXXX, Dyck-O'Neal made my life unbearable with incessant phone calls and letters alleging that I owed a debt to XXXX XXXX that they were authorized to collect ( attached ). Uncountable times, I responded and advised them that I did not owe XXXX XXXX any money but they continued to harass me. Several times I called the number I was advised to call but the harassment continued. Debt was discharged during short sale. In XXXX we sold our investment property in a short sale with XXXX XXXX. We later received a XXXX from the lender, for the cancelled debt amount of {$8000.00}. Immediately after the short sale, we also started receiving statements from Dyck O'Neal regarding this same shortage as though the cancelled debt was now owed to them. Not fully understanding the situation, my husband paid their invoices for over a year until he was advised by our accountant that we would not be responsible for both the cancellation of debt and the reimbursement of the short sale funds. At the close of escrow we were required to sign a promissory note for {$8000.00} but we understood that we would either receive a cancellation of debit XXXX or the possibility of having to pay the promissory note. in 2012 I entered into a " settlement note '' whereby I would pay {$100.00} a month for 100 months in exchange they would release me from my personal liability for a mortgage that was in foreclosure. We signed all the papers and I began making my payments. After a few months I began to inquire about the release document and was told that it was forthcoming. after that I was told I would have to get it from XXXX. Than I was told to get it from fannie mae all along I continued to make my payments timely. I am writing because XXXX XXXX has foreclosed on my home using what I believe are fraudulent documentation. They submitted a Deed of Trust that is not even recorded in the county, it does not bare my signature. Once I pointed that out to the court they then went to the county and submitted my deed of trust that is recorded in the county. Please see their motion attached. They also are a debt collector claiming to be the secured party and foreclosed on a debt they claim is twelve years old. They foreclosed on a debt they claim defaulted in XXXX, which exceeded the statute of limitation. Even if they were the secured party ( which I believe they are not ) they are trained and should be familiar with the statue of limitation as they are registered debt collectors. This is why I believe they have committed theft over {$300000.00}. Just because a foreclosure has taken place does not mean it's a legal foreclosure and that no crime has been committed.

They took my money from the sale of my home. How did it go from $ XXXX to XXXX. This left me in major financial bind. I called Dyck-Oneal crying and they didn't care. I wasn't able to complete the sale of my house until they got the money. This was a great rip off, it wasn't fair and I would like you all to look into this so I can get my money back. About XX/XX/XXXX Dyke O'Neal started trying to collect a deficiency amount on a mortgage that had been improperly foreclosed by XXXX XX/XX/XXXX. XXXX has since admitted violating the required procedures for foreclosure and I was compensated by XXXX different federal settlements from the mortgage lawsuits. XXXX shows my balance as {$0.00}. No Deficiency judgement was ever sought or obtained for this amount by XXXX or Dyke O'Neal and Tennessee has a 2-year statute of limitations for such filings under Tenn Code Ann 35-5-118. Dyke O'Neal is aware of this law but has continued to report this to XXXX and XXXX as an unpaid collection. I have disputed this with XXXX bureaus and XXXX has remove it but not XXXX. This has hindered my ability to obtain a mortgage using my VA loan. Dyke O'Neal is unresponsive about this. This is an unfair collection attempt by a 3rd party for a balance that the original lender agreed to remove under the federal settlement.

My husband and I are paying Dyck O'neal, a collection agency, a deficiency of {$12000.00} that occurred after the closing of a Short Sale of our first-time buyer property condominium in XXXX, FL. At time of closing the Financial Advisor did not have the name, address, and telephone # of the prospective collector. By the time we finally start paying an agreed amount of {$70.00} per month at no interest charge, Dyck O'neal had already figured how to present the month/months prior to our first agreed payment as pass due. We have been paying our dues from the moment we knew who to pay it to, their address and telephone No. for it was a Promisory note, therefore, it was to our best interest to pay this account. To Whom it May Concern, Upon looking at my credit report. I found a collection item from Dyck Oneal. In which their were no collection items on my credit report at all. I have no knowledge of the amount, don't know who it is from, have not applied for any credit with this company therefore I don't owe them any debt. Once I found this debit on my credit report I call the number that was listed. I was not able to get in contact with anyone. The phone will ring and then I am asked to leave a message. I called more than ten times and it was the something. I left a message and I have not had a return call. Per my investigation this company deals with loans and mortgages in the state of Florida. I am not a resident in the state of Florida and never been. I also found that this collection agency is in violation of the FDCPA, CCPA. In the process of closing on a Short Sale, our attorney informed us that XXXX required us to sign a Promissory Note or the Short Sale would not be approved ; basically extortion. We had no choice but to comply. However, the Promissory Note we signed was for payment to someone called Dyck O'Neil, a company in Texas. The Note was very poorly constructed and look like a scam to us. In checking the company 's website, there is no indication they are affiliated with XXXX ; a very poorly constructed website. We requested that the company invoice us for the payments and also asked that they provide XXXX documentation that shows the money is indeed going to XXXX. They refused. We have no way of knowing if the Note is legitimate and wo n't pay on it until we do. Of course, Dyck O'Neil is now reporting missed payments to the credit bureaus. In XX/XX/2018 four new installment accounts appeared on my credit reports ( XXXX, XXXX, and XXXX ). These accounts are listed under creditor Dyck O'Neal and each is being reported on my XXXX, XXXX, and XXXX accounts as greater than 120 days past due each month. After doing my research I have found that Dyck O'Neal is a collection agency that buys old debt. After expressing that I do not have an obligation to pay Dyck O'Neal I have not been able to have the installment accounts removed from my credit report. Rather than report the accounts as the collection accounts they truly are, Dyck O'Neal is listing these accounts as installment accounts and/or unsecured loans and reporting those loans as past due each month. These collection accounts are made to appear on my credit report as though I took out a loan with Dyck O'Neal and grew significantly behind in my payments.

I received a notice from a debt collector company called Dyck O'Neal, that in XXXX I used a XXXX XXXX XXXX loan through XXXX. I am being notified that on this date ( XX/XX/XXXX ) that I had not paid on that loan through XXXX XXXX, not XXXX XXXX. But, I contacted XXXX XXXX and they said there is an underwriting problem because the mortgage had been transferred so many times and we still own the home. I contacted HUD and spoke with a lawyer then I contacted the debt company and tried to explain who is trying to collect because the papers said it was from XXXX and it was applied to the mortgage. For 1-1/2 yrs ( est. ) Dyck O'Neal Inc.- a debt collector ( Texas addresses ), has repeatedly left the following message : " We have an important message from Dyck O'Neal Inc . This call is from a debt collector. Please call XXXX. '' Always the same words spoken in the same female voice, left on our home voice mail. We ran a Credit Report and found no unsatisfactory ratings. No one has been trying to collect debt from us, to our knowledge. We 've followed advice to avoid communicating directly with the company, and are attempting a solution through the Bureau of Consumer Finance. See prior cfbp case # XXXX. Dyck-O'Neal, Inc. initially attempted to collect debt from me based on stolen identity. I submitted a Federal Trade Commission Identity Theft Victim 's Complaint and Affidavit, signed in front of a XXXX County, Maryland police officer. In cfbp case # XXXX, XXXX Inc. agreed that I was the victim of identity theft and agreed to delete its trade line from my credit file. BUT, within days of receiving the resolution to cfbp case # XXXX, XXXX, Inc. issued me an IRS Form XXXX ( Cancellation of Debt ) for {$210000.00}. I am a victim of identity theft. Due to the Corona Virus Pandemic, we are all facing which has me sitting still at home and I saw the recent news about the multiple XXXX Data breaches. Dyck O'neal currently has numerous complaints with the XXXX for reporting inaccurate information to consumer reports. In XX/XX/XXXX Dyck O'neal added a {$18000.00} collection debt to my XXXX and XXXX credit report for a debt that was paid off in XX/XX/XXXX, per my credit report ( see attached ). In an attempt to circumvent the system Dyck Oneal reported negative outdated information from XXXX as NEW information in XXXX, which is a direct violation of the Consumer Fair Reporting Act. Negative information that is more than 10 years old can not be reported on credit reports. This inaccurate information has been disputed with the Dyck O'neal and both credit reporting agencies but has not been removed from my credit report.

In XX/XX/XXXX, my XXXX was discharged during a foreclosure. There is a XXXX balance. Two years later, I noticed a claim was made by Dyck O'Neal stating I owed {$7100.00} in reference to a mortgage. They put this amount in collections and reported to all XXXX credit bureaus. I have never done business with this company nor have I ever signed any agreement for any balance that they claim I owe. I tried mitigating this issue by disputing their claim through the credit bureaus but was unsuccessful. I received a letter on my front door from a company who claims they a second lien on my house. I am unaware of this company and need to know if they are legit. When i first purchase my home i had two mortgages but later to my understanding i refinanced and combined the debt. This company by the name of Dyck Oneal claims they bought the account from the second lien holder. They never sent me any packet info neither have i signed any paperwork within the last ten years. Now they have sent a payment book and threaten to report to the credit bureau if i don't pay. I negotiated a debt settlement arrangement directly with the debt collector. I took their enticing offer while I was already making on time monthly payment to that same debt collector. I paid the full one time payment requested at the time. Paid in full the amount offer proposed and arranged by the debt collector. And find out that they reported me to the credit bureaus negatively for paid less in full well I actually paid in FULL my debt under their enticing offer! AT NO TIME, they reported to me that they would report this negatively to the credit bureaus otherwise I would have refused and kept my monthly payment. They should have reported this as paid in full! Or disclosed their bad intentions against me.

Dyck Oneil ( Texas collection agent ) is attempting to collect on a mortgage deficiency related to a foreclosure on my Florida home in XXXX 2014. They have failed to properly validate the debt, including the original credit information, and there was no deficiency judgment on my foreclosure. The final sale and transfer was completed XXXX/XXXX/14 and the one year Florida statute of limitations on any deficiency action has expired. I have contacted them multiple times and they have continued to report this debt, with a new " start '' date on my credit report in violation of the FDCPA. I have been in an on going situation with Dyck O'Neal for debt collection from a foreclosure I had in RI. In XXXX I lost my job and began the divorce process. I fell behind in mortgage payments with XXXX XXXX. In XXXX I started the process of a short sale and had a buyer. Somehow the foreclosure occurred and XXXX XXXX transferred the loan to XXXX. In XXXX I was contacted by Dyck ONeal and was told I was responsible for $ XXXX because of the foreclosure. They offered to settle for $ XXXX over 60 months. I typically made payments on time, faced other financial hardships but ultimately paid it off. I have about 40 late payments on my credit report just because of this. Because of PMI I may not have been financially responsible for the $ XXXX but I paid anyway.

I've tried several attempts to resolve this matter with the company listed below. After several attempts I have been forced to file a police report and also seek legal advice against the account listed. DYCK O'NEAL, In addition please find attached a copy of the police report and DC number that was provided to me when report was filed. In addition I would like these accounts to be removed from my credit report. As I have asked before. These accounts are part of fraud and should be removed from my credit report immediately. Per Federal Guidelines in 603B letter when ever there is fraud on your credit report is shall be removed with in 4 business day.

I settled with my mortgage company on the short sale of my home. An amount was agreed upon but no timeframe or monthly amount due was part of the agreement. Only that the debt will be paid in a reasonable time. Dyck Oneal purchased this debt and converted it into a monthly payment with a fixed term without my consent. Filed a recent complaint pertaining to same issue. Dyck O'Neal has continued to erroneously report my account late for the last 2.5 years.
