Diverse Funding Associates, LLC Phone : ( XXXX ) XXXX and ( XXXX ) XXXX and XXXX Address : Diverse Funding Associates, LLC XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, NY XXXX -- -- -- -- -- -- -- -- -- -- -- -- -- -- I am requesting an escalation to the FTC to include a full investigation into the unlawful and deceptive business practices of Diverse Funding Associates, LLC, its executive management team, in house collection agents and 3rd party collection service companies. Currently I am being harassed by Diverse Funding Associates, LLC regarding a debt they currently hold under my SSN. I verified during the closure with the owner of the original account that they received my request for a cease and desist for no contact and the agent was advised to mark the account in a manner that if the debt was outsourced for collection that they would see the account notated for no contact as well. Diverse Funding Associates, LLC has willfully engaged in a complete disregard for my request. They are impossible to deal with, regarding the robo calls, multi line phone numbers and refusal to disengage with contacting my family and roommates. The sources of contact and information uncovered lead back to Diverse Funding Associates, LLC and can not be confused with any other debt purchaser. I feel I am under extreme duress from their relentless refusal to cease their harassment. I provided direct notice to their Diverse Funding Associates, LLC as a company, along with their partners, but they continue to send physical letters to my home mailbox, make phone calls, and send other digital correspondence. Their company, agents and partners continue to attack me, my family, and my roommates forcefully attempting to collect on a debt held by their office and they tell me that they have filed multiple lawsuits against me in court ; even though I already have verified that my documents reached them and they received the notices I mailed them, as well as their partners containing cease and desist letters to each of their correspondence addresses. In addition to those notices, I also verified that Diverse Funding Associates, LLC and its partners did receive the separate letters advising that I am having to file a bankruptcy and Im getting together my filing fees. I dont have the funds at this time and although there are several legal firms who have offered to take my case against Diverse Funding Associates, LLC at no cost upfront ; my bankruptcy filing is a different issue it takes time to get together the funding for that with help from my family. There is no confusion regarding my clear communication to Diverse Funding Associates, LLC. I made sure to send the appropriate notices to Diverse Funding Associates, LLC XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, NY XXXX, as well as to the addresses of their partner firms. In order for Diverse Funding Associates, LLC to fraudulently obtain a default court judgement in their favor, they and their partner firms lie outright about their contact records and deny any receipt of my correspondence and continue to aggressively collect on a debt held by their offices. I am certain they have falsified their records. In the process of their profane and aggressive collection efforts before and after receiving my cease and desist requests with notification of bankruptcy intent ; they have exposed my private financial issues to estranged family members and my roommates. Their actions have put an agonizing amount of stress on me and ruined my mental health state. I have also escalated a formal complaint to the Virginia State Attorney Generals office for investigation into the business dealings of Diverse Funding Associates, LLC in my state. After consulting with a legal advocate attorney who is handling other complaints against Diverse Funding Associates, LLC, I intend to seek all options through class action or individual suit including any compensation available to me based on the array of evidence I have accrued that documents in full detail their continued aggressive harassment, their collection agents and 3rd party firms abuse and coercion using lawsuits against me, intimidation and blatant disregard for the protective laws in place by flat out refusing to abide by my cease and desist requests for no contact along with an additional refusal even after receiving notice of my intent to file bankruptcy.

I have been dealing with identity theft and its repercussions for over 8 years now at least. I first noticed this account with the original creditor prior to XXXX. I tried contacting them, however, they would not speak with me because I couldn't verify the security questions they were asking. I asked them to close the account as fraud, to which they still said they couldn't speak with me because I couldn't be verified. This account was soon after removed from my credit report, so I assumed it was canceled. Fast forward to XX/XX/XXXX, I received a citation for a lawsuit for another fraudulent debt, which got me to start checking my credit report. I noticed XXXX as one of the negative accounts. I contacted them via phone and certified mail ( XX/XX/XXXX ), to which they told me the debt was sold to DNF Associates and gave me their contact information. I had asked XXXX for verification of debt via the letter, but they said it was sold to DNF Associates . I filed an identity theft report with the FTC in XX/XX/XXXX, listing this account as well as others that were still appearing on my credit report. On XX/XX/XXXX, I sent two letters in the same envelope via certified mail to DNF Associates. The first letter was asking for full validation/verification of the debt as well as notifying them of the dispute due to identity theft. The second letter in the envelope was for a cease and desist after they sent the validation/verification. I also included the identity theft affidavit from the FTC, as well as a police report from XXXX when I had another identity theft incident in regards to false unemployment claims filed under my name. I never heard anything, nor received a validation/verification from DNF Associates . I did, however, receive the signed return receipt showing that DNF did receive the letters. In late XX/XX/XXXX, I received a citation of lawsuit from XXXX XXXX XXXX, XXXX. in XXXX, TX at my po box . I responded to this within the required timeframe in early XX/XX/XXXX with the lawsuit answer, along with the identity theft report from the FTC. Copies certified from the court were sent to XXXX XXXX XXXX, XXXX. via certified mail. On XX/XX/XXXX, I called to the original creditor to gain more information. They again referred me to DNF Associates. I called DNF Associates to ask why I never received the debt validation/verification as requested from the letter send on XX/XX/XXXX. They confirmed receipt and said they forwarded everything to another organization named XXXX XXXX on XX/XX/XXXX and I would need to ask them why it was not sent. DNF gave me the number to XXXX XXXX, which I called. I asked the same thing of XXXX XXXX, to which they said that anything would have been sent to the local attorney handling the case, XXXX XXXX XXXX, XXXX. and gave me their number. I contacted XXXXXXXX XXXX XXXXXXXX, XXXX, and from what little they would tell me, it does not appear that the letters were ever sent down to them. They have asked me to re-send everything to them via email so they can start an identity theft packet. They also kept asking for a Police report. In the past when I called XXXX Police to ask how to proceed with the credit card identity theft, they advised that the FTC report trumps any report they would be able to take since the FTC is the federal level official agency to report the issue to. My issue is that DNF never fulfilled the requirement to sent a full validation/verification of the debt and pass the issue onto others, who then say they never received it. In the midst of all of this, I have been on different medications from a XXXX XXXX XXXX XXXX XXXX XXXX and attempts due to the identity theft and different bill collectors saying they are coming for my house and my property. Under the advice of the Texas DMV, I replaced my driver license in XX/XX/XXXX after I found out that my license, social security number, phone number, email address, and other identifying information was found on the Dark Web. Due to multiple data breaches over the years, Ive had to set up credit bureau blocks with XXXX, XXXX, and XXXX. Ive had to set up active credit monitoring with those three companies. Ive had to file identity theft reports with the State of Texas and the IRS. My life has been difficult and Im trying to find an end.

I recently received a debt collection letter from XXXX, XXXX XXXX XXXX XXXX XXXX XXXXXXXX dated XX/XX/XXXX, claiming I owe a debt from XXXX with a total amount due of {$1000.00}. They claim to be representing XXXX XXXX as assignee of XXXX XXXX, XXXXXXXX XXXX XXXX XXXX for an account ending in XXXX. Please consider this complaint as my formal dispute of this debt. I have never had any such account and do not have any outstanding/delinquent debts and have not had any such account number associated with my name or with DNF Associates LLC or XXXX XXXX XXXX XXXX XXXX XXXX Further, I resided at the same address the letter was sent to since XXXX, XXXX and have never received any claims, bills, or correspondence for any such debt from any of the aforementioned company names as required under the FDCPA. XXXX, XXXX XXXX XXXX XXXX XXXX XXXX should hereby be put on notice that I dispute this debt. They are required to comply with the law and requirements thereunder. I have also consulted with a GA attorney who advised that I file this formal complaint in an attempt to resolve this matter. Should this not immediately resolve the matter, I will be retaining the attorney and filing legal action to resolve and will request all attorney 's fees as I am entitled under the law for these attempted debt collection violation efforts. As indicated, I was never notified of any such debt and strongly believe this information is inaccurate. Under the FDCPA, I have the right to receive validation of any debt being claimed I owe. I would like the following information so that I can be fully informed : *Name and address of creditor to whom debt is currently owed, account number and amount. If this debt started with a different creditor, please provide the name and address of original creditor, their account number, and amount owed to creditor at the time the debt was transferred. *Provide a copy of the written agreement that created my original requirement to pay. *Provide a copy of the last billing statement sent to me by the original creditor. *State the amount of the debt when this firm obtained it, and when that was. *Itemization of any additional interest, fees or charges added since last billing statement from original creditor showing dates and amounts for each added amount. In addition, please provide explanation how the added fees are expressly authorized by agreement creating the debt or are permitted by law. *Tell me when the creditor claims this debt became due and when it became delinquent. *Identify the date of the last payment made on this account. *Confirmation that this debt is within the statute of limitations applicable to it and when this firm thinks the statute of limitations expires for this debt and how that was determined. I would also like more information about this firm before discussing the matter further. Does this firm have a GA debt collection license? What is the license number, name license is under, address and telephone number of the state agency issuing the license. I will need a copy of said license. Again, I believe this debt to be inaccurate and not belong to me. I have an extremely common name and monitor my credit daily. I have no knowledge of any such account. I need to receive the documentation requested to make an informed decision on how to proceed. I plan to resolve this to the fullest extent under the law. In the meantime, please treat this debt as being in dispute and under discussion. I look forward to your prompt attention to this matter.

I received a letter from XXXX XXXX XXXX in XX/XX/XXXX saying I owed a debt to DNF Associates. The letter stated I needed to contact them by XX/XX/XXXX. I kept a log of my contacts : XX/XX/XXXX XXXX - I rang the number on the letter ( XXXX ), after it rang for a very long time the call seemed to be answered, there was silence for 29 seconds ( with me repeatedly saying hello, asking if they could hear me ), then the line went dead. XX/XX/XXXX XXXX - I rang again, this time I got a voicemail system, I left a message asking to be called back. XX/XX/XXXX XXXX - I rang again, voicemail again, this time I left a detailed message explaining that I didn't know which account this was for and I requested proof that I owed the debt in question. XX/XX/XXXX XXXX - having not hear back I went to their website, as suggested in the letter, and used their form and gave the same details of my voicemail, requesting proof of the debt. I never heard back from them. XX/XX/XXXX I noticed my credit had a derogatory remark on it re debt collection. XX/XX/XXXX XXXX - I called again, this time got a human spoke to XXXX who was apparently a manager, who gave me a contact at DNF Associates. XX/XX/XXXX XXXX - I called DNF Associates ( XXXX ), spoke to XXXX XXXX who was able to give me more details, and I explained that I closed the account in XX/XX/XXXX, and XXXX had made a mistake in the closeout figure, which they'd subsequently tried to credit in XX/XX/XXXX, where they'd made another mistake in the credit, and so this was not a debt I owed. She gave me an email address to send her a copy of my closure letter. XX/XX/XXXX XXXX - I emailed XXXX the closure letter. XX/XX/XXXX - I received a bunch of XXXX statements from DNF Associates dating back to XX/XX/XXXX, although these did not show a debt dating back to XX/XX/XXXX, it DID show the attempted credit in XX/XX/XXXX, and the XXXX balance that the XXXX XXXX representative left in the account, and it showed that 96 ballooning into the {$140.00} that DNF Associates was now trying to collect. XX/XX/XXXX XXXX - I emailed XXXX again, stepping her through the statements, and demonstrating how they supported my claims that this was an XXXX error, and not a debt I owed. I never received any response from XXXX, but the derogatory mark on my credit was removed a few days later, so I assumed the matter was finished. XX/XX/XXXX - I received notification ( from XXXX XXXX ) that our credit report had changed. Logging in I see that the XXXX account is now showing as " charged off '' and has 6 late payments listed. I have now rung XXXX twice, XXXX ( XXXX XXXX XXXX XXXX ) three times, DNF Associates multiple times ( I can never get through ), as well as two other collection agencies that XXXX referred me to ( XXXX and XXXX XXXX ). All information I have is that DNF Associates are acting on the debt and are the ones who have reported the late payments and poor account standing, and yet I am unable to reach them to sort this problem out.

I received a call from an attorney offering to hire him to be represented in the lawsuit that has been filed with DNF. I was not aware of why I have been sued. I was not served any legal court paperwork, received any calls or emails. I was never contacted either. When I was able to speak to this attorney he told me my name had came up as an open case at the XXXX XXXX Court house he advised me to look up the case online to get further information and to contact the office. When I did, I verified who was I being sued by and I had no idea who DNF was, I called the law firm that contacted me for representation and gave them the information and they provided me with a phone number to try to reach a representative for DNF. I called a few times and they wanted me to verify my SSN #, I'm aware of scams and I was not wanting to provide that information, I asked if I could verify myself another way and one of the representatives said " You don't know your SSN #? I said no I don't. I provided my full name and DOB but that wasn't enough to give me information. ( already a red flag ) I finally decided to call again and try to provide the least amount of information to prevent any future fraud. I was told there was a balance with a XXXX credit card. I asked for the amount and contacted XXXX. XXXX was unable to give me any information, and it's never been on my credit report. I contacted the law firm to hire them for representation they asked if I had any idea about this debt, have I been contacted by this debtor? and I said no, if you wouldn't have told me I would of never known about this lawsuit. I was told I needed to wait to be served and to see if this account could be validated as mine. Weeks went by and I heard nothing, again I call this lawfirm who tells me it looks like you've been served. I said no I still I have no idea on who this company is and what's going on. Well now I get the information that I'm limited on what I can do because this company is now going to to garnish my wages without even giving me a chance to file anything on my behalf. They went behind my back and filed a lawsuit AND then said they served me with papers that I never received. They have never once sent communication by mail so that I had something in front of me to review nor spoke to me about what was going on. I had to spend money to purchase the documents to view online ( Complaint demanding, Original Summons, and Civil Case Cover sheet ) Furthermore DNF has violated FDCPA by not sending a written debt validation notice including the amount of the debt, name of the creditor, and a notice of the consumers right to dispute the debt within 30 days they used unethical communication tactics ( by filing a lawsuit against me without letting me know and stating I was served ). Theyve caused me unnecessary stress and frustration in trying to figure this situation out with little to no information

To whom it may concern, I was sent a packaged back in XXXX from an associate/lawyer from DNF Associates LLC back in XXXX. I sent them a letter letting them know that I responded to the credit bureau about DNF AssociateXXXX truing to collect {$14000.00} in fees from an account that was sold to them from XXXX XXXX. They want me to settle in court in the city that I live in. I am in XXXX, CA truing to help my daughter with her second set of XXXX, plus her husband is having rXXXX XXXX XXXX XXXX XXXX. My ex-husband called me to let me know I was summoned to appeal in court to settle the debt. The handwritten envelope, he sent me some of the package document. I can not affords to pau and old debt that was sold to them. They are the fourth company that are trying to get the remaining {$14000.00} plus court fees from a debt that on my credit report was reported as a settle with ... I contacted the credit bureau, not once but three times about LLCs companies trying to extort the remaining balance of a loan I had and they bought for way less or bargained for. I am not in any position to be paying off an old debt that they bought and trying to settled for what the original loan was for. It was deceptive of them to try and collect money in a crisis time that we are living in. I am a divorced mom and my son and I are making it from pau check to pau check. I am trying to get my credit score builds back up. As of today, I am at a XXXX and hope to build it to a XXXX by the end of XXXX. Why now? Why are they asking me to appear in a Superior Court in the city that I live in. I am an instructional aide and I can not just take off to work out or make a deal from a old loan that was passed down from four different collection agencies. The last LLC, I had to assist the help of the CFPB because XXXX and XXXX were swindling me and I could not take it. I was threaten with my credit score being affected and wages being garnished. But, this time the DNF Associates is not including the amount I owe, but they want me to appear in court to negotiate a settlement. What can I pay them? I get paid once a month and it is my son and I. I am trying to do the best I can to survive and I do not need any other headaches and stressors that are going to make my XXXX and XXXX XXXX flare up. Again, why are DNF Associates coming after me now? These 15-28 pages of trying to retrieve a debt that was sold four times and it did not cost them {$14000.00} or {$16000.00} to purchase the debt. I need to help on where I stand and why are they coming after me during the Corona Virus Pandemic XXXX? I am broke! I am a XXXX XXXX, not a XXXX or a XXXX XXXX. My monthly paycheck is at the end of the month. After my monthly expenditures and my sons contribution, my check is gone. I ride the public bus from point A to point B. DNF Associates XXXX XXXX XXXX XXXX XXXX XXXX XXXX, NY XXXX XXXX Has reported to XXXX ( and possibly others ) that they are attempting to collect a debt in the amount of XXXX that originated with XXXX XXXX XXXX at some point around XXXX Previous debt collectors have not been able to provide me with the details of the debt ( dates, communication, etc. ). DNF has not contacted me via phone or mail to offer any of the above information, their contact information, or any other information that has offered an opportunity to ( once again ) explain this debt. This debt ( not mine ) was the result of credit fraud that occurred sometime between XXXX. I personally reported to the XXXX XXXX that someone had fraudulently opened an account in my name. I went round and round with this merchant about the credit fraud. They convinced me to try and make payments. I consulted an attorney and was told to report it to law enforcement, the merchant, and to the credit agencies that the account was fraudulently created. This was done. Eventually the merchant told me they had resolved it, eliminating my responsibility. However, the debt has been sold and resold to various debt collection agencies and I have had to repeatedly dispute this debt, despite its origin at least 8 years previous. Why this debt continues to be sold, after it has been, at least, four times reported to be credit identity fraud ( reported to authorities ), I have no idea. DNF, as a company, has been extremely sketchy and has violated my FCR rights in that it failed to identify themselves as debt collectors, provide me with 30 days written notice with my options of disputing this debt ( again ), provided no reliable means of contacting them ( multiple attempts unanswered in which I had to track them down ), reported to a credit reporting agency ( XXXX ) that such a debt exists, purports that the debt is valid, and has not responded to written communication. Yet persists in harming my credit status by carelessly reporting this fictional activity, while I have been steadfast in maintaining and growing my credit history. While trying to call DNF at their given number ( identifies as " XXXX XXXX '' }, they offer only XXXX options : find account number, check account balance, and Make a Payment. To find an account number, they ask for one 's social security number. When I entered mine, they have no record of an account. The recording informs me to " call back. '' Nobody answers the phone, ever. SKETCHY! They have to this point provided me with absolutely no information about themselves, or any activity they have engaged in. Your complaint for the companies identifying information about myself. There is none. Yet they appear on my credit statement.

I was notified on XX/XX/XXXX by XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX that they represented DNF Associates, LLC regarding a so-called debt with XXXX XXXX XXXX account in the amount of {$2600.00}. I disputed on XX/XX/XXXX via certified mail return receipt of their claim of debt in the amount of {$2500.00}. I communicated that I did not owe this debt. I disputed the validity of their claim of debt in the amount of {$2600.00} due to DNF Associates, LLC. given the claim of indebtedness is without basis or merit. I did not have or ever had a XXXX XXXX account, In addition, I do not have a business relation nor history of any business transactions with XXXX XXXX nor DNF Associates, LLC. I requested as of XX/XX/XXXX pursuant to the Fair Debt Collection Practices Act, Section 809 ( b ) Validating Debts that they provide proof to me of the following : - amount of the debt including evidence of any and all transactions giving rise to this so call claim of debt ; - the name of the creditor to whom the debt is owed ; - verification or copy of any judgment ; - evidence a XXXX XXXX account in my name ; - evidence a business relationship with the original creditor ; and - proof that they are licensed to collect debts in XXXX XXXX XXXX XXXX responded on XX/XX/XXXX to my XX/XX/XXXX request and failed to provide and information evidencing that I incur the so called indebtedness with XXXX XXXX via a XXXX account. On XX/XX/XXXX I was served with a summons concerning a Civil Complaint in the State of Michigan in the XXXX District Count for the County of XXXX with DNF Associated , LLC. by and through its attorneys. XXXX XXXX XXXX XXXX XXXX. the Jurisdictional Allegations 1. Plaintiff is the assignee of Defendant 's account with XXXX XXXX XXXX 2. The amount in controversy, exclusive of interest and costs, is less than {$25000.00} On XX/XX/XXXX, I filed with an Answer and Affirmative Defenses to Plaintiff 's Complaint. I denied all of the Plaintiff 's Claim for Relief and provided my Affirmative Defenses : 1. Lack of Privity. I asserted that there is no contractual relationship of agreement between the plaintiff, or the plaintiff 's assignor and the defendant. Specifically, I never entered into the contract of agreement alleged in the Complaint, and I am the victim of identity theft and the account, contract or agreement was created with my knowledge or consent. I therefore report this complaint to the Consumer Financial Protection Bureau of identity theft and ask for your assistance,

XX/XX/XXXX XXXX received a certified letter disputing an account listed on my credit report. I requested, by certified mail, that the accounts be disputed in accordance with the Fair Credit Reporting Act Sec 623 ( a ) ( 3 ). Additionally I requested proof of debt bearing my signature. I received only a letter from XXXX stating they needed additional information to verify account holder information. The letters I sent all included my address and a partial account number they were reporting to the credit reporting agencies. I re-ran my credit report 30 calendar days after the receipt of my dispute letter, and the company had not requested the accounts be marked as disputed to the Credit Reporting Agencies. That act alone makes them guilty of non-compliance of FCRA 623 ( a ) ( 3 ) - Responsibilities of furnishers of information to consumer reporting agencies [ 15 U.S.C. 1681s-2 ] After I verified that the XXXX had not even communicated that the account had been disputed to the credit reporting agencies, I sent another letter letting them know they were in violation of federal laws. I received nothing back from them. XX/XX/XXXX, I sent a third letter telling them that the account remained undisputed on my credit report and that my intention was to file a complaint with the FTC, and sue them for willful noncompliance with the FCRA 623 ( a ) ( 3 ). I have found out since that even though XXXX has received all my letters requesting proof of any sort of debt, the account was sold to a company named DNF Associates. They ( DNF Associates ) have since begun to harass me and my parents. They contacted my parents and told them they were attorneys, and were needing to speak with their son ( me ) concerning an urgent legal matter. I called the number the next day and talked with a man named XXXX who was trying to verify my identity by asking if " I was the XXXX who had a bankruptcy in XXXX. '' Clearly these individuals have no intention of doing the right thing. The information they are reporting is incorrect and fraudulent. I have acted in good faith and gave them an opportunity to send some sort of contract, or proof of a debt. I am requesting that the accounts be removed as they have already exceeded authorized time ( 30 Day ) to investigate the accounts, and provide me any documentation bearing my signature for proof of debt or account ownership. I want it rectified asap. My next step is to contact a lawyer to litigate due to harassment, and defamation.

Im confused and stressed and shocked when I reviewed my credit report this week and I found multiple inaccuracies on my credit report from the 3 major credit bureaus from a collection company that I never have dealt with before. I've attempted several times to ratify the issue with the original creditors and credit bureaus and they still reporting inaccurate, unverifiable information. I have disputed this item with the credit reporting agency and they reported you confirmed the account as valid. I honestly do not believe to ever have any relationship with this collection agency or original creditor. Also there are several inaccuracies with this account the way it's reporting and that's a total violation of FCRA and FDCPA laws and regulations. In a good faith effort to resolve the matter amicably, I must demand proof of this debt, specifically the alleged contract or other instrument bearing my signature, as well as proof of your authority in this matter. Absent such proof, you must correct any erroneous reports of this past debt as mine. I am writing to request that you please provide the following information : 1. Please evidence your authorization under 15 USC 1692 ( e ) and 15 USC 1692 ( f ) in this alleged matter. 2. What is your authorization of law for your collection of information? 3. What is your authorization of law for your collection of this alleged debt? 4. Please evidence your authorization to do business or operate in this state. 5. Please evidence proof of the alleged debt, including the alleged contract or other instrument bearing my signature. 6. Please provide a complete account history, including any charges added for collection activity. You have 30 days upon receipt of this letter to provide strict proof of contract. In the event you can not provide strict proof of contract, you must cease and desist any and all collection efforts and immediately remove any derogatory information reported to the consumer reporting agencies. In addition, you will need to provide me your agreement, in writing, that you are closing your file, ceasing collecting activity, and deleting all information related to this reference number from any and all credit reports youve furnished the information to. In the event you transfer this account to an attorney without providing proof of contract, and proving your claim, he/she will be immediate reported to the XXXX XXXX XXXX and XXXX XXXX XXXX for code of ethics violations.

To Whom It May Concern : Be advised this is not a refusal to pay, but a notice that your claim is disputed and validation is requested. Under the Fair Debt collection Practices Act ( FDCPA ), I have the right to request validation of the debt you say I owe you. I am requesting proof that I am indeed the party you are asking to pay this debt, and there is some contractual obligation that is binding on me to pay this debt. This is NOT a request for verification or proof of my mailing address, but a request for VALIDATION made pursuant to 15 USC 1692g Sec. 809 ( b ) of the FDCPA. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you. At this time I will also inform you that if your offices have or continue to report invalidated information to any of the three major credit bureaus ( XXXX, XXXX, XXXX XXXX ), this action might constitute fraud under both federal and state laws. Due to this fact, if any negative mark is found or continues to report on any of my credit reports by your company or the company you represent, I will not hesitate in bringing legal action against you and your client for the following : Violation of the Fair Debt Collection Practices Act and Defamation of Character. I am sure your legal staff will agree that non-compliance with this request could put your company in serious legal trouble with the FTC and other state or federal agencies. If your offices are able to provide the proper documentation as requested in the following declaration, I will require 30 days to investigate this information and during such time all collection activity must cease and desist. Also, during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with legal counsel for suit. This includes any listing of any information to a credit-reporting repository that could be inaccurate or invalidated. If your offices fail to respond to this validation request within 30 days from the date of your receipt, all references to this account must be deleted and completely removed from my credit file and a copy of such deletion request shall be sent to me immediately.

In reference to a Charge-Off, Written-Off Amount, and Balance Amount appearing on my personal credit report for XXXX BANK XXXX XXXX XXXX I recently received notice in a letter dated XX/XX/XXXX, from DNF ASSOCIATES LLC that a FORM OF ASSIGNMENT AND BILL OF SALE closing date occurred on XX/XX/XXXX. Which also acknowledged in the FORM OF ASSIGNMENT AND BILL OF SALE that the closing date for Pools shall be on or about XX/XX/XXXX. XXXX BANK XXXX XXXX continues to update and modify the Charge-Off, Written-Off Amount, and Balance Amount in violation of 15 U.S.C. 1681g. XXXX BANK XXXX XXXX continues to report a Charge-off, Written-Off Amount, and Balance Amount at the same time that would be inaccurate, false, and incorrect. While at the same time, DNF ASSOCIATES LLC alleges to be the owner of a FORM OF ASSIGNMENT AND BILL OF SALE closing date that occurred on XX/XX/XXXX. Yet, DNF ASSOCIATES LLC failed to validate how debt is owed by me to XXXX BANK XXXX XXXX in a contractual agreement that expressly identifies my full social security number and accurate signature. DNF ASSOCIATES LLC fails to validate the specific form of assignment that carries the contractual agreement with it. I dispute that XXXX BANK XXXX XXXX is my original creditor and that XXXX BANK XXXX XXXX is my creditor past or present. I further dispute that DNF ASSOCIATES LLC is my creditor or current creditor and dispute that DNF ASSOCIATES LLC holds enforceable security interest to collect on a debt in their name as my creditor. DNF ASSOCIATES LLC is not my creditor and should be removed from my credit report as my creditor. DNF ASSOCIATES LLC failed to timely validate the debt that is alleged to be owed to XXXX BANK XXXX XXXX. DNF ASSOCIATES LLC has no right to collect any debt for this account from XXXX BANK XXXX XXXX that was transferred or sold. XXXX BANK XXXX XXXX through admission from DNF ASSOCIATES LLC of a FORM OF ASSIGNMENT AND BILL OF SALE has no right to report any such Balance Amount on my personal credit report. The Charge-off, Written-Off Amount, and Balance Amount are incorrect, inaccurate, and false reporting.

First, I found this collection on my credit report and I disputed it. Then I had a letter sent to me at an old address but it was forwarded to me, claiming they bought some account of mine and I needed to pay them. I responded with a demand for validation and I gave them my correct mailing address. They did not respond with validation. What they did is send information about me to a different tenant in the same building and actually addressed it to him. He is a lawyer and I guess they think they were being funny by harassing and intimidating me. The lawyer got my mail to me and I responded to DNF Associates letting them know that they didn't validate ( which I'm sure they knew because they didn't send anything I requested ) and I also called out several violations that they committed. I also told them to cease and desist all communication with anyone other than me. Now I have received another correspondence from DNF Associates and again they intentionally addressed it to the lawyer they sent stuff they were supposed to send to me. It was basically more of the same XXXX they sent before, not validation, but personal collection information to embarrass and intimidate me AGAIN! This is after I gave them a cease and desist order and they absolutely know what they are doing. They aren't even addressing the envelope to me! I have just sent them another letter. I will include the letters I have sent to them and a copy of the envelope that they sent to the tenant that is NOT me and who I specifically instructed them not to contact. The gentleman is NOT my lawyer and has nothing to do with me. We share space in the same building, we are both tenants, that's it. I've never even met the gentleman. DNF 's behavior is criminal and ruthless, violating federal law over and over again. The only thing they did correctly is to remove it from my credit reports, which they had no authority to furnish to in the first place as I had never consented and have never done business with them.

In XXXX of XXXX I was contacted by XXXX XXXX XXXX to settle a XXXXXXXX XXXX credit card account. I was advised I could make a pay agreement and when the account is paid in full it would be removed from all credit reporting agencies. The account was paid and settled in XX/XX/XXXX. DNF Associates filed a lawsuit in XXXX XXXX XXXX. Not sure how as do not even know this collection agency. False claims filed in court without contact to me without providing a legal valid debt by law. Old debt XXXX I have sought legal rights which is to wait it out from hardship that I have no assets or garnishable income. I can file bankruptcy any day if needed. However too old of a debt that was discharge by XXXX that am not sure how this was obtained as a write off by XXXX if they sold an old debt but regardless legal debt practices were not followed. Not sure why 2 copies of debt paperwork that is most likely hacked sources would be accepted by a court and why questions are not legally asked on attempts from them. This is illegal debt practices by law. Bill of sale also does not have DNF signature. 3 signatures same name. Not notarized. My name is not on documentation. From XXXX and never been contacted by them. Bill of sale has XXXX XXXX XXXX XXXX XXXX and DNF is listed but no where am I listed with sale amount. An attachment of the debt service from this is provided however no where on Bill of sale is there any legal binding to any debt owed. XXXX XXXX was debt holder at the time of XXXX of my account was the only owner of debt and seems odd namage of non binding XXXX on Bill of sale to gain funds illegally with no contact at all by named DNF in lawsuit. Debt is a minor amount that attorney fees would be above debt that appears harassment and other illegal activities. Named attorney XXXX XXXX XXXX I have had other harassment in the area and difficult time in comparison to others I know whom have had debts. I did attend high-school with a XXXX XXXX and I believe they are related to XXXX from reading about XXXX and XXXX. XXXX works at XXXX in XXXX XXXX. Another XXXX was at a doctor 's appointment when do not think he was an employee that was reported to the FBI. He wanted me to sign an unlawful pre-written document at time of doctor 's appointment for work injury.

I received a notice from XXXX XXXX XXXX XXXX XXXX XXXX in regards to a past due debt owed to DNF Associates on XX/XX/XXXX. To my knowledge, I have no contractual obligations or have never had a business relationship with DNF Associates. My wife, XXXX XXXX, called XXXX on XX/XX/XXXX immediately upon receipt of this letter, she was advised that I was being sued for this debt and had the opportunity to resolve it, per Mr. XXXX. Not understanding who XXXX and DNF is and why they would be suing me, she asked them to provide validation of this debt. Shortly thereafter, I received the documentation showing I owe a balance to DNF who purchased a charged off debt from XXXX XXXX on XX/XX/XXXX. While I am familiar an outstanding debt to XXXX XXXX, the documentation attached is an incomplete/invalid validation of debt. For the following reason, this account remains in dispute. When XXXX XXXX charged off this debt, they sent me a 1099 - debt cancellation form and reported to the 3 credit bureaus that this was charged off. Therefore, XXXX XXXX is no longer pursuing this item for collection. DNF Associates did not send any documentation indicating they acquired this debt. Furthermore, the first notification in regards to this debt being owed to DNF was from their servicer, XXXX who is now threatening litigation on the past due balance. The last payment made on this account was on XX/XX/XXXX. The exhibit indicates the debt was sold on XX/XX/XXXX, which is prior to charge off. My account with XXXX was still active at the time the exhibit indicates the debt was sold to DNF Associates.

On XX/XX/XXXX, I received notification through the XXXX XXXX Sheriffs Department concerning a lawsuit by XXXX XXXX, XXXX. After reading over the summons, the only information supplied by this company to the court is an affidavit. Until XX/XX/XXXX, I never heard of this company not to mention had any contact with this company by telephone, mail nor email. I contacted this company the same day to find out what this lawsuit is pertaining to and the female refused to give me any information and I advised her that this court summons do not advise me of anything. She advised me very coldly that they sent me a letter back in XX/XX/XXXX. I asked her could she send me a copy of this letter she advised me that she can put in a request but doubt if it will be approved. I never had any business with this company what so ever. XXXX XXXX never notified me in writing or by telephone or email concerning an debt. An Affidavit submitted to the court alone does not constitute that XXXX XXXX own this debt. XXXX XXXX failed to prove the following : 1 ) that it owns this debt ; 2 ) an itemize ledger of what I owe ; and 3 ) the terms of my account. XXXX XXXX failed to send an Validation Notice to me and allow me the thirty days of the date of the validation notice to dispute the debt. This company went straight to filing a lawsuit without first validating the debt, which violates the following : Fair Debt Collection Practices Act 808. Unfair practices 809. Validation of debts I am asking that this company be investigated because clearly they're not following the FDCPA.

I received a phone call in XX/XX/XXXX from XXXX representing DNF Associates saying I owed on XXXX XXXX account they claimed I last paid in XXXX. I told them I did not recognize that account and it isnt mine. On XX/XX/XXXX I received an email from XXXX representing DNF Associates saying I owe them on an account now saying the last payment was in XXXX - so the rep lied as the date now makes it out of the statute of limitations to sue since I do not even claim this account. I also got a letter from them a few days later. I completed the form to dispute and returned it via certified mail. I got the received receipt early XX/XX/XXXX. Never received any information from DNF showing I own this account. Then beginning in XXXX I received contact from DNF through XXXX XXXX. The email sent on XXXX gave me an amount but no dates at all. Shortly after I got 2 phone calls a day for a few days. I called and told the rep it is not mine and I am disputing it. She became belligerent talking over me saying she doesnt believe I dont remember and that it wont do any good to dispute it. I hung up. I sent the dispute form in and on XXXX filed a complaint with the PA Attorney General. After XX/XX/XXXX DNF added this account on my credit report- despite not validating this debt. I believe they know they cant validate it as it isnt mine and they are trying to bully me into paying by barraging me with debt collectors and adding unverified info to my credit report

I had proof that I made that and all payments to XXXX XXXX at XXXX XXXX XXXX. He then told me that my current balance with XXXX was over {$3000.00}, which is more that the settlement amount that XXXX XXXX had given me in writing. He went on to explain that he " may '' be able to get me the same settlement amount but needed to know when I could pay the balance because this might help my case. I told him that his information was incorrect and that he needed to get everything in writing and send it to me. I am writing to inform you that my rights under the Fair Credit Reporting Act ( FCRA ) have been violated by your company. Specifically, that XXXX has placed my account for collection and selling my information to DNF without my consent of communicating to any unauthorized third party and without XXXX providing me with an opt-out disclosure in our initial transaction, you are in in violation of 15 U.S. Code 1692c. As evidence of this violation, I have attached a copy of my consumer report, which shows that your company has placed my account for collection with the notation that the original creditor was XXXX. However, I have not given consent for my personal information to be shared with DNF Associates. This action by your company has caused me harm, and I am requesting payment of {$1000.00} for the violation. On XX/XX/2023 I received a summons from XXXX XXXX court that a collection agency named DNF Associates LLC has filed a complaint to collect on a debt from a credit card XXXX. The information I received from the court had the account number blacked out. On Monday XX/XX/XXXX, I contacted DNF Associates LLC and spoke with XXXX at ext XXXX. I advised her that I had no knowledge of such debt. I also advised I did not receive any notification regarding this debt. She acknowledge that NOT correspondence was ever sent to me about this debt, which violated the fair debt reporting act which allows me, by law, 30 days to dispute the debt. XXXX did not express any concerns about my rights not being exercised, and threated to proceed with taking me to court. I told XXXX that I did not owe the debt. I told her that I did not recognize the card and I was offered no correspondence to from their office where I would have disputed the debt. She was proceeding to try to make some type of settlement arrangement for 80 %. I thought possibility it was my ex wife, but I told XXXX that I was not sure. She again that her company has never sent any documents and she verified my address. They also never called me about the debt to dispute.

A year ago someone from DNF Associates LLC contacted me regarding a department store debt. The lady on the phone demanded payment over the phone but without providing a mode to verify the debt. I asked her if she could send me a statement in the mail, or if I could log in to an account online, if there was any way I could visually see that they held the debt before submitting a payment. She was very rude and insisted that she could not issue any paperwork to me until I gave her a payment, and there was no way to see the debt online. I told her I was uncomfortable giving a random stranger that called me demanding a payment over the phone my banking information. I made it very clear that I was not refusing to pay, but that I was not going to give my banking information blindly over the phone. At the end of the conversation I was informed that I would be sued. I, again, told her I would be happy to submit payment as soon as I had some way of validating who she was representing and where the payment would be going. I was just served with papers stating I am being sued in small claims court. I feel that this is unjust. I should have been given the proper documents and been able to make the payment without being sued.

On XX/XX/2019 My mother was contacted by a company DNF Associates? regarding further termination of working with XXXX XXXX? Stating that my PARENTS needed to verify ALL of their information, INCLUDING their social security numbers in attempt to send a notice to ME. First of all, my parents NOR me are associated with XXXX XXXX in any way. I believe they use this as a tactic to be called back. When contacted, the company had MY social, MY address, and MY phone number, and I have NO idea how they got me parents information. I am NOT a minor, and the debt they are claiming to try and claim, is not associated with my parents in ANY way. When on the phone, the guy was very rude and abrupt and stated that IF he sent ANY sort of validation, that I could not settle the debt and the attorney would take this to court. I asked was it not my right to see what they said I owed? Very rudely, he said yes, he could mail my a validation but then it was out of his hands and there was no way he could help me and I would be sued. In addition, to being rude, and abrupt, he has no legal right to contact my parents, as I am not a minor and he legally had ALL of MY information on file.

I got a loan for a XXXX XXXX from XXXX XXXX for a little over {$9000.00} and was told I could return it within 30 days. I did return it within 30 days and they said everything was fine. Next thing you know it shows up on my credit report as a late payment. I never made one single payment, yet the history shows I paid for 1 year 3 months, then missed a month, then paid two months and then was 120 days past due 5 months later ( then charged off ). This is all entirely bogus, not a single payment was ever made and it was returned within 30 days as stated earlier. Following this they sold the debt to DNF associates as a collection, which as I've been told still reports after 7 years... so this bogus situation is really hurting me. It will continue to affect me until something is done to remove not only the falsehood of the entire XXXX XXXX listing in my credit report, but also the collection account from DNF associates. ( By the way, the DNF balance was around {$270.00}, which wouldn't even make since balance wise with the payments they claimed I made ) I have tried numerous times to dispute this with XXXX XXXX, DNF associates and all 3 credit bureaus. Please help!

DNF Associates, it is believed has violated at least 10 title 15 U.S. Code violations ( see attached Notice in the form of an Affidavit DNFNotice91721 and related documents ) The packet ( attached ) was sent to DNF Associates and the Registered Agents. This is a follow up complaint to an initial complaint. On or about XX/XX/XXXX DNF associates placed a trade line on my XXXX credit report. After disputing through several agencies the company responded that the line item was due to a XXXX XXXX credit card - allegedly taken out XX/XX/XXXX, with no payments made, closed XX/XX/XXXX. The debt was sold to XXXX associates XX/XX/XXXX. The FCRA regulations are clear that the date listed on the credit report should be the date of delinquency. The account is listed as opened in XX/XX/XXXX. In the response from my other complaint the company clearly indicates the account was opened XX/XX/XXXX, and with no payments made the date of delinquency would be 30 days after XX/XX/XXXX. DNF has changed the date on the account to park the debt. The date on the account should be changed to reflect their own records of XX/XX/XXXX as the open date and the delinquency date of XX/XX/XXXX. Debt parking is illegal. Fraudulently and knowingly reporting incorrect information to the credit bureaus is illegal. DNF should be investigated for debt parking.

I received a telephone call from XXXX XXXX for a debt owed to XXXX XXXX XXXX ( XXXX at XXXX ) in the amount of {$630.00}. The first call I received was from a Service Processor stating that I would be served a complaint and that someone would need to be at my resident with two pieces of ID to sign for this Complaint and if I wanted to stop the process - I would have to call their office. I did call -- they wanted the following arrangements in order to stop the Service Processor : {$190.00} on XX/XX/2018 ( which I paid - and it was a struggle ). They also wanted me to pay {$440.00} on XX/XX/2018 to close out the account. I was unable to come up with the finances - so I called and they asked what could I pay - I told them that I would try to get at least {$100.00} - which I did and paid - but set up arrangements to pay the final {$330.00} by XX/XX/XXXX - which I am still unable to do. I pressure and stress to met their expectation is overwhelming. They stated that if I did not keep these arrangements that I would have to come to court and let them settle the matter. Help!

DNF Associates placed a collection account, for the original creditor of XXXX XXXX XXXX, on my credit reports on or around XX/XX/2023, in the amount of {$5600.00}. Prior to this item being placed on my credit report, I had not received any contact from DNF Associates -- no phone call, no postal mail message, no email, nothing. In short, I was not made aware of this debt by DNF Associates as required by the FDCPA and FCRA. DNF Associates did not ever provide me with a notification of this debt, a debt validation letter, nor an opportunity to dispute this debt, as is required by law of DNF Associates. If DNF Associates has proof that they attempted to contact me and have sent me all required notifications and opportunities to dispute this debt, I welcome them to supply it in their response to your office. DNF Associates is also not a licensed debt collector in Washington state, as is required of them to collect debts from Washington state residents.

The collection agency also has my personal number for which I have cooperated with them and attempted to set up a repayment plan to resolve my debt. I have asked that they do not call my work after setting up the repayment plan and XXXX XXXX agreed that she would remove my number. This is a matter that my colleagues at work should not need to hear discussed as it is embarrassing. After submitting my verbal request XXXX XXXX continues to call my workplace stating she hasn't been able to get in touch with me by phone. I always return her calls because I feel the need to remain complaint with my current arrangement however money is tight and I missed a payment for which has resulted in the collection agency calling my workplace in addition to my personal number.

There is this account on my XXXX credit report that I do not recognize, I dont know who the data furnisher is and the account is showing that it was XXXX in bankruptcy but the problem is that I never had an account with this company called XXXX XXXX, there is no phone number being reported and it says that the account was opened in 2014. I have disputed this account with XXXX and XXXX also and for some reason they told me that the account was verified as accurate. I know this cant be right because like I said I never had an account with this company. I asked XXXX and XXXX for the original contract that has my signature on it that proves that I opened this account since they are claiming that the account was opened by me, and they cant seem to provide me with anything. By law the credit bureaus have to report the information on a credit file 100 % correct without any errors or mistakes. This is affecting my credit worthiness really bad.

This agency was trying to collect a debt for a company called XXXX and associates ( XXXX ) XXXX. I am being harassed for a debt that does not belong to me. I had a missed call with a voicemail from an XXXX company. They kept calling me and so I called them back. I spoke to a gentleman who told me that they had been sending me emails ( I don't receive emails to that email address ) I then asked for proof of debt which he then hung up on me... I called back to talk to another associate and a woman answered the phone. She said that they have been sending letters to my house but I have not received any letters from them. I explained to her that we've had about four different mail carriers in the last year and she got real sarcastic and said I apologize. That's my fault... She then started getting real upset and using foul language... Which then I told her to quit harassing me especially when they will not send me proof of debt with my signature on showing that I have signed for the loan or credit card, whatever it is...

Upon review of my recent credit report, I noticed a negative collections account reported by DNF Associates that I have no knowledge of. I have never received any correspondence via mail, phone or email to dispute any collection accounts. To resolve this matter, I sent a dispute letter to DNF Associates on XX/XX/2023, and over 30 days has passed with no response.By not replying in a timely manner to my initial letter on XX/XX/2023 DNF Associates have not only violated federal law, but have also failed to provide me with a copy of any viable evidence, bearing my signature, showing the account is being reported accurately. DNF Associates have now violated federal law, by not properly investigating within the required timeframe, and I have evidence of such, via certified mail receipts. I would like this negative item removed immediately from my credit report.

I noticed a negative report added to my credit bureau by DNF Associates today. I never received calls or mail and nobody validated this Debt. I dont know this company DNF? Nobody attempted to call me for any debt or mail me letters for this debt? How is it that this is reported to the credit report without any communication? No letters, no mail, no calls? There were no calls or mail sent to me by any companies so why would they go ahead and add it. This is a violation of the fair credit act and a violation of my rights. I would like this removed from my credit report since it is a violation of the fair credit act. I did not receive and call or any mail to validate any debt. There were no communications received from either company. Please remove this from my credit bureau at once.

DNF Assoc is listed on my credit report as a collections account. I have been trying very hard to rebuild our credit, and this account is a problem. According to my credit report this was reported in XX/XX/2020, amid the pandemic. I was not given any notification of this debt, nor have I been contacted since this debt has been added to my credit report. How can you report a debt to the Credit Bureau, especially in a derogatory manner without giving any kind of notice to the creditor? I wasn't even given the chance to settle this account. DNF Associates, LLC, is debt collector, who filed a lawsuit against me on XX/XX/2023, I first found out about this lawsuit and Default Judgement on XX/XX/2023 after searching court records. DNF Associates, LLC has never communicated with me about this debt. I never received from DNF Associates LLC, who is a debt collector a validation notice, that is required by law, that would state the amount of the debt, that I could dispute the debt and who the original creditor was of this debt pursuant to 1692g of the FDCPA. I was never served with a complaint and summons, and have no idea what this matter is about. DNF Associates LLC obviously used false service, as this matter is not in the same district that I live.

As of XX/XX/XXXX, this debt was paid directly with the original creditor. I have reached out to the organization requesting assistance. I was told they could not assist me because I was not paying them directly. In fact according to the amount the company representative indicated I owe shows I have made overpayment and am due a refund. They show no payments since XXXX and were unwilling to follow up stating the company takes 120 days to report a payment, at this rate it would be years before this debt would show paid in full. If I am paying, why won't anyone help to satisfy what is owed, is it because DNF is not receiving any money for receiving payments from me. This is inappropriate business practices.

I contacted XXXX XXXX XXXX XXXX XXXX and they said that a lot of the information on the credit file like drivers license the address, the phone numbers the emails did not match up correctly to my actual information. They believe that the debt was fraudulent. They instructed DNF associates to have XXXX buy back the debt and then they could cancel the debt based on fraud. I have filed a report against XXXX XXXX XXXX and they have recently stated that they have given the debt back to DNF associates. I am trying to have this resolved appropriately and removed from my name.

On XX/XX/2021 I received via US mail a communication that was post marked XX/XX/2021 from DNF Associates. Upon opening this envelope, the contents were found to be several credit card statements from a " XXXX Mastercard '' company. There was no letter addressed to me nor an explanation of why I was receiving this communication from DNF Associates. Upon further review, I have come to the conclusion that I am unfamiliar with the information which was sent nor have I been associated with " XXXX Mastercard '' if this account was opened, it was opened fraudulently without my consent. If this communication is an attempt to collect a debt, DNF Associates failed to advise me of this.

Sent 3 emails to my daughter about a debt they want to collect and gave her all information about the debt including original creditor, debt amount, etc. This is an explicit FDCPA violation. The email address was created BY MY DAUGHTER several years after the debt was incurred, was never associated with the account and she lives in a different home than I do and has for 4 years. If they are sending to her then I don't know who else they are sending this same information to in a blanket attempt to collect an old debt they purchased from the original creditor. CFPB should request this information and take further action based on who else they contacted.
