On XXXX XXXX XXXX, 2015 around XXXX, someone called my sister n law 's phone looking for me and she told them that they have the wrong number. I called them back and spoke to a man who said that I was being accused of fraud for writing multiple bad checks and that I owed around {$5400.00} in fees. He said that I probably just made a mistake and that could settle this for about {$1000.00}. I told him that I needed him to send me something in writing to verify this and he told me that he did not have to because it was past the point of collections. I told him that the conversation would be over if he could not provide this information to me and he began yelling at me and hung up on me. When I came home i also received a voicemail from this same number just stating that there was a claim in their office and I needed to contact them back. On Tuesday, XXXX XXXX, 2015 at XXXX, I received another call from this number. I called this number back and spoke to a woman who identified this company as Direct Capitol and stated that she was not a debt collection agency, but a mediation agency. She stated that I was being accused of fraud for writing bad checks as well and I explained to her that I would need something in writing stating what I was being accused of and how much I owed. She said that if I did n't resolve this issue that I would be referred to the county for fraud. She told me that they had me on camera walking into a loan store and writing a bad check and that is considered fraud. I then told her that I did have a payday that I took out in the past that defaulted and that I tried to make a payment arrangement with that company and the company did not want to accept my arrangement. She told me that I could settle this for about {$1000.00} and I told her that I needed to see what I was being accused of in writing first. She kept insisting that I make a arrangements with her and I kept insisting she give me something in writing. After going back and forth she said that she was just going to send this in and that I needed to get an attorney and that I would be liable for about {$4000.00} and hung up on me. I have this conversation recorded on my phone and can email it to any party that needs this or I can replay it. I tried googling this company and found no results. This woman did have some information about this debt but was not accurate. I believe that this company has violated The Fair Debt Collection Act for accusing me of a crime for owing a debt and accusing me of writing multiple bad checks because I took out a payday loan that defaulted. They also are not representing themselves as debt collectors which is also fraud.

He broke the law with Multiple FDCPA violations. Lets start with : # 1 ) Communication : a debt collector shall assume that the convenient time for communicating with a consumer is after XXXX XXXX XXXX and before XXXX XXXX XXXX, local time at the consumer 's location. The incoming call was made at XXXX XXXX # 2 ) False or Misleading Representations : The threat to take any action that can not legally be taken or that is not intended to be taken. In the call XXXX XXXX in a threatening demeanor said he was going to pursue further litigation, when I asked for their " BAR # '' XXXX XXXX said they had none. A litigating attorney has a BAR #. He also failed to recite the XXXX. # 3 ) Harassment or Abuse : A debt collector may not engage in any conduct the natural consequence of which is to harass, oppress, or abuse any person in connection with the collection of a debt. Spoofing is used as a form of deception ....

It is a debt collector ( Direct Capital XXXX ) who claims that I owe for a payday loan. I asked for all their contact information and the man I spoke to hesitated to give me all the information. I asked for a verification letter and he said they could n't mail XXXX out and the best they can do is email it. I pushed for a hard copy to be mailed to me and he reluctantly agreed. It 's been 2 weeks and I have n't gotten a hard copy mailed to me. I finally got an email today but it does n't look legit. I looked up the address he gave me and it is a business called XXXX XXXX. It 's not Direct Capital XXXX like they claim it is. They called my sister looking for me and she got an automatic message that said they were looking for me and there was a complaint filed with my SSN and I need to contact them. They left that same message for me and when I contacted them, they said they were about to send my information to a legal party and sue me for triple the amount if I do n't pay. He also stated that they had mailed out letters. He told me which address they mailed them to and I had n't been at that address for 6 years or so. He said they tried to find my current address but were unable to. I told him I do n't know why that is since I had changed my address with the post office to my current XXXX about 3 years ago. I would like to send them a cease contact letter but I do n't know if it would do any good since the address they have listed and the address he gave me seems to be for another company entirely. I have been called from various numbers by them. XXXX number was local and the other numbers have been out of state - Florida I believe. They never leave any messages.I am trying to take care of my legitimate debts but this XXXX I really believe is a scam.

I received several calls from XXXX XXXX @ Direct Capital XXXX as well as XXXX They advised they had time sensitive information regarding a civil action they needed to get to me, but i needed to verify information. I stated i do not verify information over the phone and i will only communicate with them via US Mail, he stated i can not send you out any information without verification. I said if you have a civil issue against me then you have the information to send all information via US Mail. I said please do not call me again. I hung up and he proceeded to call me 6 more times, each time telling him not to call. I then blocked his number then he proceeded to call with other numbers. I advised him i was reporting him for harassment. Then he started to call my work number I made the same statement. He called back again and asked for my supervisor I said not then he said please transfer me to HR i said no, and stop calling my work number. He continued to call a 3 more times. He also called my ex husband and left a voice mail for him. I do have the voicemail as he forwarded it to me. He called him after I repeatedly asked him to for communication to only be through them mail. This VM states they have time sensitive information regarding my personal information. Calling me at least 10 times in a 20 min span after asking him to stop each time is harassment. Calling my job and requesting HR and my supervisor is an attempt to intimidate me to give them information.

Received call from ( XXXX ) XXXX and msg indicated call ( XXXX ) XXXX -- person answering did not identify the company I was calling and got testy when I asked what company I was calling ( interestingly, without my telling this person my name, they had my name ) -- I refused to give this person my name and asked at the get-go what company had called me. This person was yelling at me stating that " no one ever calls and not states who they are ... '' -- stated I was being sued for a $ XXXX debt and writing a bad check for over {$1000.00}. I am not the person they wanted : name was my first and last name, date of birth not mine, state of residence at time of " crime '' was in Louisiana. This person was very, very rude, yelled at me, and threatened to send case for me to be arrested. Finally after verifying the above name, date of birth, and state, the said would remove my name and number ; however, I have received several calls from this same number. Please do something about this. When I looked up both telephone numbers on the internet, there are complaints about a man named " XXXX XXXX '' -- I still do not know anything about the company or the company he is " representing ''.

Multiple people called from Direct Capital, claiming to have an account of over {$11000.00} in my name for a bad check, said they would settle for {$1000.00}. They also claimed they were a mediation company and did not have any information other than the amount owed. Would not give me any information regarding the account or what it was for - when I asked for more information and documentation, I was hung up on by a representative as well as a supervisor. I recorded the conversations for documentation. I called back 3 times, each time to be yelled and berated by the representative. I told them I would not settle anything or confirm anything until I received documentation showing what the debt was for. They sent me an email that did not display any of the information needed and have continued to call, from varying numbers as well as my work. This is not only frustrating, but embarrassing. If I do have a debt, I will take care of it, but so far it seems like they are a scam harassing people for reasons they are not willing to disclose.

I think the debt is too old. It occured in 2011.The payday loan was XXXX XXXX Armands XXXX XXXX I do n't recall if I pay them. They sold this debt to a collection agency called Direct Capital Associates.XXXX, XXXX XXXX XXXX, XXXX, NY XXXX. They call me numerous times a day. They called relatives I did not give permission for them to call. My mother, brother and sister-in law. They threatened me to my family telling them I am going to court and going to prison. This has caused me so many problems and I have XXXX. I am so upset and ca n't handle this. Please do yourself a favor and learn from me. Please do not take out payday loans. They are expensive and the companies will torment you, by calling continuously, even before it is time to pay. I truly believe they should be outlawed. I know people need money. Please try to learn strategies on managing money. This has been a big lesson for me. I do n't care if I have to do with out food, I would never do this again. This was in 2011 and I thought I paid them.

I took out a payday loan that was eventually included in my bankruptcy back in 2011. Since then, every 6 months I get a batch of phone calls from a new company who purchased this bad debt and sold it to another that does the same and so on. This latest company, Direct Capital/XXXX, has had it for some time and is relentless in their phone calls. Even worse, they are calling my parents who tell them I do n't live there but it does n't deter them from calling. I have actually spoke with various representatives and explained my situation, gave case numbers, etc. and many have 'found ' my bankruptcy and assured the calls would stop within days. They do n't. I contacted my bankruptcy lawyer who says to use the words 'harassment ' when dealing with them, as this is what it is at this point, but yet the calls continue. My parents are looking to me for a solution, for which I have none. Worse yet, the number they leave, XXXX says they are unable to answer at this time ... and never are.

This company calls from various phone numbers and they are very rude. They call my wife and harass her about a debt that she does not know about about. They talk with her about debt and confirm my SSN and info, which they did not check with me first. This guy tells my wife he is going to sue her and take everything and trys to scare her into paying. At one point my wife offered to make a payment, which her card was declined. She never received a call back to confirm payment. 20 days later this company calls from XXXX and they say they will seek legal action immediately. They called 3 times within a 2 min window. My wife asked for the operator ID of the person she was speaking too to write a complaint and the call was disconnected. This debt has disputed on my credit.

I am repeatedly getting calls from local number XXXX stating that severe allegations have been attached to my name and ss number and that I have XXXX hours to contact them at XXXX to provide a statement or they will file paperwork with the courts and I will lose all legal rights. They have also contacted my ex fiance. I have attempted to call back XXXX to both the local and toll free number. After several rings it states to leave a message then says that the mailbox is full. No identification of company. I do not owe anyone any money nor have I taken any loans out. I did some research since you are unable to actually speak directly to a person and discovered that this is a company named Direct Capital and they are harrassing numerous people.

XXXX from Direct Capital called me ( an unrelated party to the obligation ) in an attempt to locate their debtor. When I told him I was not the person they were looking for, he proceeded to tell me that they were attempting to collect on a bad check for this 3rd party that I am not on an account for ( although I am sure they found me via skiptracing as I do know the 3rd party ) I then explained that he was violating privacy laws by telling me this persons business as it was not mine at which he stated that 'he could have his attorney contact him as well ' The number they called me from was XXXX. Had he simply asked me to relay a message without disclosing personal information, I would have done so.

Called from XXXX. Announced himself as XXXX XXXX, an officer of Direct Capital. Says hes calling about a legal claim his office will soon file against my social security number. He wants to speak with either me or my counsel, in order to obtain a statement of intent for repayment. Says, this is a time sensitive matter ; in order for this to not go into a legal setting, they need to hear from me by close of business tomorrow. If they dont hear from me, a decision will be rendered and all rights forfeited. Gave an office number of XXXX. I am submitting this complaint to an unknown collection agency that continues to contact me at my employment and refuses to give information about this supposed debt I owe them. The contact person that continues to harass me is XXXX XXXX XXXX. XXXX XXXX has also went as far as providing this so called debt information to my co-workers in a harassing manner. This is not only wrong but humiliating. I believe that as a tax payer I have the right to file a complaint. If someone can assist me, I will definitely appreciate it.

This company- Direct Capital continues to Robocall my phone number. I am NOT on a debt with them, nor am I the person they are trying to contact. They continue to hang up on me when I ask them to stop calling me and will not remove my information from their calling queue.
