RE : Attentively review my formal writ composed declaration of not proven complaint misinformation that is all or in part : deficient of the adequate current status in the fullness of TRUTH, ACCURACY, COMPLETENESS, TIMELINESS, documented OWNERSHIP, certifiable RESPONSIBILITY, or otherwise irrefutable, complaint obligatory, and regulatory requisite reporting thereby mandating your immediate actions to rectify and remedy and any infractions behavior ( s ) by retaining or returning to demonstrate TRUE, CORRECT, COMPLETE, and COMPLAINT XXXX XXXX data field formatted reporting!!! I am a victim of identity- theft, I am writing to request that you block all accounts disputed as fraudulent on my credit reports with XXXX XXXX XXXX XXXX and XXXX. This information does not relate to any transactions I have made. I did not give anyone authorization or consent to use my personal information. I hereby exercise my legal rights enacted by XXXX and The Federal Trade Commission, which explicitly states when a victim of identity-theft dispute a fraudulent account on his/her credit report it shall be honored by all credit bureaus and all fraudulent information should be blocked within 4 days and proper notification shall be given to all data furnishers pursuant to section 605b of The Federal Fair Credit Reporting Act. Failure to comply shall lead to complaints being filed with XXXX XXXX XXXX XXXX, Consumer Financial Protection Bureau, and Attorney General stating your companys unlawful collection practices, misrepresentation of creditworthiness, defamation of character, and noncompliance to abide by laws enacted by Congress to protect victims of identity-theft who's credit been impacted by acts of fraud. Because I know my rights under THE FAIR CREDIT REPORTING ACT, CONSUMER CREDIT PROTECTION ACT ( CCPA ), and FAIR and ACCURATE CREDIT TRANSACTION ACT of 2003 ( FACTA ). I will be taking action. I also know my rights under this paragraph of Section 312 of the FACTA LAW : SEC.312. Procedures to enhance the accuracy and integrity of information furnished to consumer reporting agencies. ( b ) duty of furnishers to provide accurate information. -- Section 623 ( a ) ( 1 ) of THE FAIR CREDIT REPORTING ACT ( 15 U.S.C . 1681s-2 ( a ) ( 1 ) is amended ( 1 ) in subparagraph ( A ), by striking " knows or consciously avoids knowing the information is inaccurate '' and inserting " knows or has reasonable cause to believe that the information is inaccurate '', and ( 2 ) by adding at the end of the following : ( D ) DEFINITION -- For purposes of subparagraph ( A ), the term 'reasonable cause to believe that the information is inaccurate ' means having specific knowledge, other than solely allegations by the consumer, that would cause a reasonable person to have substantial doubts about the accuracy of information. Policy states. According to the Fair Credit Reporting Act FCRA 611 ( 15 U.S.C 1681 ), Procedure In Case of Disputed Accuracy. ( a ) Reinvestigation ( 1 ) Reinvestigation ( a ) In general. Subject to Subsection ( f ), if the completeness or accuracy of any item of information contained in a consumers file at a consumer agency is disputed by the consumer and the consumer notifies the agency directly, or indirectly through a reseller, of such dispute, free of charge, conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate and record the current status of the disputed information, or delete the item from the file in accordance with paragraph ( 5 ), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer or reseller. Therefore, my position is being clearly stated, these accounts do not belong to me, meaning that you are reporting inaccurate account information within my credit file. The fact that these are inaccurate account information means that you, this credit-reporting agency, are reporting incorrect accounts. 1. DIGNIFI bal. {$0.00} I am well aware of my rights as a consumer. The Fair Credit Reporting Act requires that you, the credit-reporting agency report accurate and/or correct account information within my credit file. My credit issues are very specific, these accounts and/or items do not belong to me. This means that you are reporting incorrect account information within my credit report. It is this in mind that I request that these listed accounts and items be Blocked and Deleted. According to the Fair Credit Reporting Act FCRA, Section 1681c ( 2 ) Block of information resulting from identity theft. 1.Block. Except as otherwise provided in this section, a consumer reporting shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from alleged identity theft, not later than four ( 4 ) business days after the date receipt by such agency of 1. Appropriate proof of identity of the consumer ; 2. A copy of an identity theft report 3. The identification of such information by the consumer ; and 4. A statement by the consumer that the information relating to the transaction by the consumer. I have provided all of the above listed four ( 4 ) items within this package. Therefore, I expect these listed accounts to be deleted and blocked within ( 4 ) business days. This is clearly an identity theft issue. I am also entitled to receive a free copy of my credit report, so I am requesting a free credit report and that all of these accounts, public records items, and inquiries be permanently blocked and deleted. In XX/XX/XXXX, I assisted my aunt in purchasing a vehicle at XXXX XXXX. She was told she would need an additional down payment and the salesperson stated they had an " Inside '' program to help us. They sent me a link to my phone and I was given XXXX in a loan with 180 day interest promotional period and they used that XXXX for her down payment. We had set payments which fluctuated and when we tried to discuss it with the " DIGNIFI.com '' call center which was not at all an Inside program specific to XXXX as stated, we were ignored. We submitted a complaint to their home office with all the info and again were ignored. In XX/XX/XXXX, my aunts window got broken out and she needed more to pay for this very expensive repair. DIGNIFI, because she had made all of her payments, extended me a XXXX loan for {$650.00} with a 180 day promotional period to pay it off so that I would not incur any interest.I spoke with the person at dignifi just to verify and they said yes, it is XXXX separate loans. My documents do confirm that all of this. On XX/XX/XXXX I contacted Dignifi to get the payoff and was given a 10 day payoff agreement, a balance ID number for this specific loan to add to the check, and an address to overnight the funds to. I sent the payment the following day with clear instructions and all the info provided from the XXXX to ensure it was properly applied and the loan was paid off. on XX/XX/XXXX, the check cleared my bank and when I looked at the loan, it was applied to both loans despite the XXXX ID number specific tot he loan written on the check and the attached very clear letter with instructions. Today I spoke with dignifi and they said " well there is nothing you can do. The payment was applied to both loans and there is no way to reallocate the funds ''. They said there is no way to separate the loans. They are separated on my monthly invoice, there was a payoff balance and a balance ID number for this particular loan given to me by dignifi so that made no sense. Then I was told there is noone else to talk to, that the 180 days of interest would be accruing despite all of the time, effort, money, and original promotional agreement which is why I even agreed to the loan with such high interest ( almost 30 % ) in the first place. This will impact my credit negatively when the interest accrues by lowering my score, cost me maybe a grand or more in additional money to pay due to interest, affect my ability to pay my other loan with them as I just paid {$440.00} roughly to pay the XXXX loan off and my monthly for the XXXX loans was only {$220.00} so I overextended myself trying to pay the one off within the XXXX promotional period. THIS IS FRAUD!! I have all the documents and can prove every ounce of what I am saying. The sad part is, Dignifi is in most every dealership, tire shop, oil changing place, etc throughout TEXAS and I am sure other places so I am definitely not the only person this is happening to. Worst of all, everything is very cryptic with them. You have no escalation measures. You speak to a customer service rep, then they send you to a supervisor and they tell you that you can go no further. I looked on the site and saw that I could WRITE to a XXXX XXXX which I did before due to an increase in my monthly payments suddenly and no one even bothered to answer. This place is a scam. DEFINITELY! Page XXXX of the attached invoice states the terms, I also am attaching payoff letter and check along with bank screenshot showing where check cleared and the balance ID is printed directly on the check and in the letter provided. I also have the original text sent to me with the terms as well while they had me apply on their app as they have everyone do. Please let me know if you need any additional information as I have saved it all.

Fraud was reported to DigniFi XXXX XXXX XXXX XXXX XXXX XXXX, SD XXXX on XXXX XX/XX/XXXX after I was alerted by my account with XXXX Credit Agency that a new credit account, DigniFi XXXX credit card, was opened and used in the amount of {$3900.00} on XXXX XX/XX/XXXX in XXXX XXXX Nevada at a XXXX XXXX XXXX XXXX located on XXXX. DigniFi XXXX sent me an " Identity Theft Affidavit '' on XXXX XX/XX/XXXX that requested copy of Driver 's License, copy of SS card, Proof of Address, Copy of Police Report. Police Report was opened on XXXX XX/XX/XXXX and a notarized copy of the report was included in the Identity Theft Affidavit returned XXXX XX/XX/XXXX. DigniFi confirmed receiving XXXX XXXX XX/XX/XXXX. Since that time I have received no progress in resolving the situation and the account and accruing late payments continue to stay on my credit report, which I believe is against the law as it should be remain frozen until the investigation is complete. Below you will find a detailed log of my call attempts to resolve the situation to no avail. XX/XX/XXXX DigniFi Identity Theft Affidavit ( Notarized ) mailed to DigniFi Attn Security/Fraud Department XXXX XXXX XXXX XXXX XXXX, SD XXXX XX/XX/XXXX Date DigniFi confirmed Identity Theft Affidavit ( Notarized ) received XX/XX/XXXX Spoke with customer service rep about status of fraud package submitted and was told the investigation was still in-process XX/XX/XXXX Spoke with Customer service rep XXXX XXXX XXXX , along with supervisors XXXX and XXXX due to getting disconnected, they shared the investigation was still ongoing and they require 30-45 days to conclude an investigation after receipt of Affidavit which would be the XXXX of XX/XX/XXXX for when investigation should be complete. XX/XX/XXXX ( XXXX day ) Spoke with XXXX ( Supervisor ) and was told again the investigation was still on-going ; case has been escalated for resolution. Should take another 3 -5 business days to conclude. XX/XX/XXXX I called Spoke with XXXX ( customer service rep ) and XXXX ( Supervisor ) ; Case has been escalated to a manager and they should be contacting me within 24/48hrs. XX/XX/XXXX Spoke with XXXX ( customer service rep ) and XXXX ( Supervisor ) and again the case has been escalated to a manager and they should be contacting me within 24/48 hrs. XX/XX/XXXX XXXX ( cst ) spoke with XXXX XXXX Manager ) who asked for the information I mailed to be emailed to her as t appears she can not locate my Identify Theft Affidavit, which is very concerning due to the personal information contained within the documents mailed along with if I have been lied to this whole time about an on-going investigation. I was told to they will reach to me the next Wednesday XX/XX/XXXX, however that did occur. As a result, I called back on XX/XX/XXXX looking to speak with mgr. XXXX. XX/XX/XXXX Spoke with XXXX ( customer service rep ) and XXXX ( Supervisor ). And was told a Manager should be contacting me within 24/48 hrs. Spoke with XXXX a few hours later, and was told there was no update at this time on the investigation. Received information is still under review. Expect call back next Friday XXXX. We are now at day XXXX since DigniFi XXXX received my information to support Fraud and there is still no resolution and I continue to have this impact my credit report with the original amount and past dues. Also, i have never received any information from DigniFi besides the original credit card mailed to me and the Identity Theft Affidavit. I have never received the information I have asked for, nor any form of a credit statement to date.

I accepted a short term line of credit for auto repairs offer by the company DigniFi. The loan was as for approximately XXXX dollars and I began paying it off in monthly installments of XXXX dollars ( setup with the companys auto-pay option. ) Because of an error on my part, my final payment of XXXX dollars was declined by my bank due to insufficient funds. However, I noticed my mistake immediately moved money into the anccount, and reached out to the company the same day to correct the issue. A representative of the company informed me that they would not accept another payment from me at that time until the previous payment attempt ( which I informed them had already been decided ) had processed. I called them back 2 more times over the course of the next approximately 10 days in further attempts to make the final payment with the same result. The 3rd time I called, I actually received another automated payment request from Dignifi within 20 minutes of ending the call where a dignifi employee had just informed me for a 3rd time that they would not accept a payment from me in any form. Following this, I emailed the company the below message to the contact email address posted on their website ( XXXX ) Subject : 4th attempt to make payment To whom it may concern : I am specifically instructing your company to stop harassing me with automated emails regarding my account with dignifi. I have personally contacted your telephone support center on 3 occasions over the last 2 weeks in an attempt to pay off the remaining balance of my account and have been told by two separate supervisors in that center that they either would not or could not accept a payment from me regardless of the method. You may not harass me for payment and then refuse to accept that payment when I attempt to make it. When your company is ready and able to accept my payment on this account please reply to this email or contact me at XXXX XXXX XXXX XXXX This week I am available between the hours of XXXX and XXXX Monday through Friday. I will not waste my time with more futile attempts at calling in and resolving this issue again until I hear from a representative of your company who is authorized to accept a payment. Regards, ( XXXX ) Following the above communication, I contacted the company at the same email address two more times and have not yet received a response or separate communication by phone or email. However, I continue to receive payment request messages regularly.

In XXXX of this year, I was the victim of identity theft. Fortunately, I was able to catch it fairly quick and the fraudster was only able to open up XXXX accounts- a credit card and a personal loan. I was able to very easily work with the credit card company to dispute the account and it was closed in a fast and efficient manner. I filed a police report with XXXX XXXX Police Department at the time of the event. A few weeks later, I noticed the personal loan and immediately got in touch with Dignifi. I was told they would be unable to do anything until I provided a police report. I attempted to work with them on other options in the meantime to ensure they didn't report this as fraud to XXXX and the other credit agencies. I was told they are unable to do that and they would not take action until they had a police report that said Dignif on it. I was also told that if I provided a police report case number they could work with XXXX directly to take care of it. I went back to the police station, added dignfi to my complaint, and request a copy of the report. XXXX is fairly backed up and I still have not gotten the report. I tried emailing Dignifi to work through next steps and gave them the case number. I have sent XXXX unanswered emails since XX/XX/XXXX. In the meantime, they have called me to try and get a payment on the loan and have also attempted via the mail. Additionally, when XXXX reached out about my dispute, Dignifi reported it as legitimate. On top of all of this, I asked Dignifi when I was on the phone what kind of XXXX they conduct and they told me they do not require a copy of an ID to get a loan which I found disturbing. Overall, the customer support has been terrible and they still have not resolved this.

Dignifi is reporting inaccurate information.Dignifi has stated I was late on XX/XX/XXXXXXXX and XXXX XXXX.I have a right to a accurate consumer report and by law I have the right to ask for a proper investigation into claims of the inaccurate information and FCRA Section 623 ( a ) ( 8 ) that allows the consumer to follow up with the data furnisher if they believe that the previously disputed account is inaccurate by requesting an investigation be done by the furnisher to prove the accuracy. Dignifi fail to report that consumer even disputes account.I have proof that Dignifi is inaccurately reporting and Im asking for {$1000.00} for each inaccuracy.Todays date is XX/XX/XXXX and I have proof that I paid XX/XX/XXXX Dignifi is reporting that I am 30 days late when in facts it not 30 days over delinquent date stated in federal law a Furnisher can not report an account as delinquent until 30 days 15 usc 1666b timing of payments addition to inaccurately reporting, Dignifi agreed to modify and defer payments. According to the cares act XX/XX/XXXX if your loan is considered delinquent ( past due ) when you make an agreement with your creditor, your status will continue to show as delinquent until you bring the account back into good standing. Once you bring the, the creditor must report your status as current to the credit bureaus. Under 15 USC 1681a ( i ) there is an exclusions as to on your consumer report containing information solely as to transactions or experiences between the consumer and the person making the report.late fees are transactions and should not be on consumer reports.This is affecting my life and living because of the illegal acts of Dignifi.

My identity was stolen and I made Dignifi aware of this and sent numerous of letters and documents as proof to the identity theft and account that were associated with the theft.This company is still reporting these accounts as thou they are accurate when in fact they are included in my information being stolen. According to 15 USC 1681b ( c ) Furnishing reports in connection with credit or insurance transactions that are not initiated by consumer ( 3 ) Information regarding inquiries ; Except as provided in section 1681g ( a ) ( 5 ) of this title, a consumer reporting agency shall not furnish to any person a record of inquiries in connection with a credit or insurance transaction that is not initiated by a consumer. Also Aggravated Identity Theft pursuant to 18 U.S.C. 1028A. ( 1 ) IN GENERAL.-Whoever, during and in relation to any felony violation enumerated in subsection ( c ), knowingly transfers, possesses, or uses, without lawful authority, a means of identification of another person shall, in addition to the punishment provided for such felony, be sentenced to a term of imprisonment of 2 years. I opened a XXXX XXXXXXXX XXXX XXXX on XX/XX/XXXX to use to charge {$2000.00} towards the purchase of a motorcycle. I paid the entire {$2000.00} in XX/XX/XXXX. The card was at that point at a XXXX balance. I have never used the card since. In fact, I don't even have a physical credit card. On XX/XX/XXXX the account was charged {$59.00} as an annual fee. I wasn't aware of this charge and became aware of it in XX/XX/XXXX. By that time, the company had added a late fee and interest. The total amount on the card was {$80.00}. I paid that balance off on XX/XX/XXXX. On XX/XX/XXXX I sent a certified letter to XXXX XXXXXXXX XXXX XXXX instructing them to close my account. I received a certified return receipt from them. On XX/XX/XXXX XXXX XXXX Credit Card started to text me about a balance due, but my phone reported it as spam. I logged into the XXXX XXXXXXXX XXXX XXXX account and found that they company had once again charged the account an annual fee of {$59.00} plus a late fee and interest. The total amount they say is due is now {$80.00}. However, I requested account to be closed in XX/XX/XXXX, and therefore, I should not be charged a fee. The company clearly did not follow my instructions to close the account. I called them today ( XX/XX/XXXX ) to ask them about this. They told me I could only close the account by calling them. This seems ridiculous. Please help.

I am filing this complaint in regards to the company Dignifi. I signed a fraudulent contract on XXXX XXXX with a finance balance of { {$1000.00} }. Which is at XXXX XXXX .Since then I have paid a total of { {$600.00} } and as of today XXXX XXXX my balance has only decreased by { {$97.00} }. This company has not applied any payments that I have made to my principle balance of the loan. This company is illegally charging high interest on this account that is not even being documented properly. I reached out to them on multiple occasions and have asked why the balance hasn't decreased and why the balance was still very high although I have been making payments and the company 's only response is that its from interest.This is fraud!! The total amount of interest paid to date is { {$500.00} } which is unfair but not even that only { {$97.00} } was put towards principal why hasn't the payments been applied to the principal balance that on a loan of { {$1000.00} } at XXXX XXXX .Dignifi is still saying I owe a sum of { {$960.00} } .this is malicious and deceptive practices. Dignifi is also reporting under my consumer report as confident financial solutions which I never signed a contract with and also reporting inaccurate data which has effected my credibility, creditworthiness and reputation.Which is fraud? In XX/XX/XXXX I tried to purchase a car at a XXXX dealer in XXXX, XXXX XXXX, NY. Unfortunately I was unable to get approved for a vehicle, yet the dealer proceeded to get me approved for a car repair or insurance loan to assist in helping with the approval costs if there was one. I was approved by a company XXXX deals with called Dignifi. I was told that this loan would only be applicable if I was approved for a vehicle or if I had a vehicle already that needed repairs or insurance. I left the dealership with no vehicle and unaware that this loan was still open under my name. Within a month I noticed the account on my credit report and started receiving calls for payments. How can I pay for a loan I never used more needed to use? You can only access funds for vehicle needs and I don't have a vehicle so the company couldn't possibly be owed money that was never used. I called Dignifi and they told me to have the XXXX dealership call them to void the account. I did that and I waited, nothing was done. By the end of XXXX I was irate because I still received harassing texts and calls. I spoke with a rep from Dignifi and told her to cancel the account because I never had a car nor needed their services. It's XX/XX/XXXX and this account is still affecting my credit report and still isn't closed.

Back in XX/XX/XXXX - I signed a Unsecured Loan Agreement ( Fixed Rate ). The problem I'm having with them is their calculations of the monthly payments. Everything I've tried to use, do not add up. I've contacted them on several occasions, asking them how they arrived and the payment amounts listed as monthly payments on their website. I told them it don't add up - I asked them for an explanation of their calculation. They refused. I filed a complaint with the XXXX. I still can't get a response. I called XXXX XXXX and spoke someone at least twice and told me I have to call them. The second problem is Interest Rate and the APR. The APR is listed as 27.99 % and but in the letter to the XXXX they listed the APR at 31.02 % and the Interest rate as 27.99 %. They said the loan date is XX/XX/XXXX, but its really XX/XX/XXXX. I filed a complaint with the XXXX on XX/XX/XXXX - the company responded on XX/XX/XXXX. I called to talk to them and I mentioned them responding to a complaint I submitted she said it wasn't true. I gave her the XXXX reference number, information that the company wrote to XXXX. I was for an updated contract, it had been amended. Just the pages they changed or amended. I haven't been successful in getting them to do anything. Contract and letter of response is attached.

Dignifi is deliberately ignoring the law and continues to practice malicious and deceitful business practices. In previous response Dignifi has admitted and responded that there address that they reported on my consumer report is not an accurate address.This is in clear violation of 15 USC 1681s-2 : Responsibilities of furnishers of information to consumer reporting agencies.Dignifi also in violation of 12 CFR 1022.43 ( c ) Direct dispute address. On XX/XX/2022, I received an alert from XXXX that my XXXX XXXX has a negative change. When I looked into my Experian account I saw that a credit line I had never heard of had been opened in my name and was past due on payments. The creditor is XXXXDignifi , and when I contacted them I was told that I had opened the account in XXXX of 2022 and was past due on payments as of XX/XX/XXXX. I disputed that this was my account and they immediately closed the account to and said they were sending me paperwork about further disputing the fraud ( which has not yet happened ). I have tried multiple times to get Dignifi, my bank XXXX XXXX XXXX XXXX, and XXXX ( Payment processor for my bank ) schedule some time to work together to find the missing payment that has been missing since XXXX. I applied for a loan from this company to fix the transmission on my car. I was approved but the interest rate was higher than the one on my credit card. So I called them and told them I didnt want it and they said they would take care of it and that I could log into my account and I would see that the loan had been withdrawn. I logged in and it does show that it has been withdrawn. I went to delete the account and could find no where to do that. So I called them back to find out how and they said that since they had ran my credit and offered the loan to me that they could not delete the account, that there was no where on my account online that I could delete it either and that all of my information would be kept with their company. After filing a separate complaint with CFPB ( reference ID : XXXX ), Dignifi apologized for the inconvenience and stated that they would be providing monetary compensation in the amount of {$0.00} which according to Dignifi was the remaining balance on my account with them. This occurred after I had already paid the remainder of the debt in full. I do not understand nor did the company clarify how there could possibly be a balance of {$0.00} cents left on the account after I had paid the full balance of the debt but I didnt worry about it because DigniFi forgiving that balance amounted to the same thing. On XX/XX/22 about XXXX DigniFi contacted me about my past due account. I was advised that the call was an attempt to collect a debt and that the call was being recorded. I advised that I did not want the called recored, when I was told that the call had to be recorded I explained that Maryland is a XXXX party consent state where both parties have to agree to the call recording. Dignifi reported a 30day late payment on my credit report for XX/XX/XXXX. I called them immediately upon seeing this, I was told by the customer service representative XXXX, that my payments were never 30 days late and that I need to submit this in writing and fax it to them. Dignifi is reporting fraudulent accounts to the credit bureaus. These accounts arise from identity theft. My information has been compromised in the XXXX data breaches. Dignifi is also reporting late payments. I am being harassed by text, phone calls and emails about payments due that are not mine.
